The Insolvency and Bankruptcy law is yielding results. It is also a work in progress.

Of the two structural reforms associated with this government — the Goods and Services Tax and the Insolvency and Bankruptcy law — it is the second which has shown an early demonstrable impact in terms of behavioural changes on the part of economic agents. It has also recast the terms of engagement between lenders and debtors, skewed for long in favour of large borrowers in India.

This is visible with the implementation of the Insolvency and Bankruptcy Code (IBC) starting November 2016 with a couple of big transactions being put through under this framework, the latest being the takeover of Bhushan Steel by Tata Steel. Over the next few months, there will be a closure — either through a resolution or liquidation in the case of the 12 large firms referred to the National Company Law Tribunals under the IBC, thus promising to ease the pain for Indian lenders.

While there have been concerns regarding the timeline of 270 days, what cannot be lost sight of is the fact that the IBC is a new law and there is nothing cast in stone. From the point of view of the lenders burdened already by a huge pile of bad loans, maximising value will and should be an overriding priority. High recoveries will mean a lower burden on the taxpayer who underwrites the recapitalisation of state-owned banks. With the new law in force, there has been a gradual emergence of a new breed of insolvency professionals, quasi judicial officers handling a range of corporate default cases and a proactive Insolvency and Bankruptcy Board of India.

Overall, the experience has been positive even if it means learning on the job for those involved in this process and going by the changes carried out by the government to plug loopholes in the law and some of the changes proposed by a committee.

It can be argued that the government should have moved much faster on this law hand in hand with governance changes in state-run banks when the macro economic backdrop was far more favourable at the start of its term. Indian promoters who default may no longer have a “divine right to stay on” regardless of how badly they manage an enterprise, as former RBI Governor Raghuram Rajan said. But for the pendulum not to swing the other way, it is important that the government also quickly addresses the issue of getting projects off the ground and putting in place a stable tax and policy regime to ensure that Indian industry does not miss out riding the current global economic growth cycle.

The Nipah test

Age-old practices of infection control are crucial to limit the deadly outbreak

The outbreak of the deadly Nipah virus around Kozhikode, Kerala, is a test of India’s capacity to respond to public health emergencies. In 2018, the World Health Organisation listed Nipah as one of the 10 priority pathogens needing urgent research, given its ability to trigger lethal outbreaks and the lack of drugs available against it. As an RNA (ribonucleic acid) virus, Nipah has an exceptional rate of mutation — that is, it can easily adapt to spread more efficiently among humans than it does now. Such an adaptation would result in a truly dangerous microbe. Nipah already kills up to 70% of those it infects, through a mix of symptoms that include encephalitis, a brain inflammation marked by a coma state, disorientation, and long-lasting after-effects, such as convulsions, in those who survive. Thankfully, in most outbreaks in South Asia so far the virus has displayed a “stuttering chain of transmission”. This means that once the virus spreads from fruit bats, its natural reservoir, to humans, it moves mainly to people in close contact with patients, such as hospital staff and family caregivers. But these caregivers are at high risk, because the sicker the patients become, the more virus they secrete. Preliminary reports suggest that the Kozhikode outbreak is also displaying a stuttering chain of transmission. Of the 11 confirmed Nipah fatalities, three were from the same family. While researchers are still investigating how they were exposed, a bat colony living in a well in the family’s yard is a strong suspect.

This fits in with how outbreaks have historically begun in the subcontinent. In a 2007 outbreak in Nadia, West Bengal, for example, patient zero is believed to have acquired the virus from palm liquor contaminated by bat droppings. The next wave of infections have historically occurred among close contacts and caregivers, such as nurses; the same pattern has been detected in Kozhikode as well. But these are preliminary reports, and new information may change what we know about the present virus. Several patients with symptoms of infection are under observation. Only when clinical investigations are complete can it be determined how contagious the virus really is. If it is found travelling over long distances, the authorities will have to be ready with strategies to combat its spread. The good news is that Kerala’s public health systems have acted with extraordinary efficiency so far. Doctors identified the virus in the very second patient, a diagnostic speed unrivalled in developing countries. This must be commended. But big challenges remain. The death of a nurse shows that health-care workers may not be taking adequate precautions when dealing with patients, by using masks and following a strict hand-wash regimen. The virus has no specific treatment. The best defences against it are the age-old principles of infection control, which Indian hospitals have not mastered as yet. Kerala’s health authorities must ensure these principles are widely adopted, and no preventable transmission takes place.

जानलेवा निपाह

केरल के शहर कोझिकोड में पिछले दो हफ्ते में ‘निपाह’ की चपेट में आए ग्यारह लोगों की मौत, इस वायरस के बेहद खतरनाक असर का ही संकेत है। गौरतलब है कि कोझिकोड में एक ही परिवार के तीन लोगों की मौत के बाद जांच के क्रम में यह तथ्य सामने आया कि तीनों ने चमगादड़ से संक्रमित हुए फल खा लिए थे और उसमें मौजूद निपाह वायरस की चपेट में आ गए। इस वायरस के असर से व्यक्ति के भीतर बुखार बहुत तेजी से फैलने और फिलहाल इसका कोई कारगर इलाज पता न होने के कारण मरीज की मौत लगभग तय मानी जा रही है। इसलिए तमाम एहतियाती उपायों के बावजूद इस वायरस से संक्रमित मरीजों का इलाज जोखिम भरा और मुश्किल साबित हो रहा है। हालत यह है कि बचाव के पुख्ता इंतजामों के साथ निपाह-पीड़ित मरीजों की देखरेख करने वाले भी अब इसकी चपेट में आ रहे हैं। खबरों के मुताबिक निपाह से पीड़ित एक मरीज की तीमारदारी के क्रम में नर्स लिनी पुथुस्सेरी इसके विषाणु की चपेट में आ गई और उसकी भी मौत हो गई।

लिनी पुथुस्सेरी ने अपने दायित्व के लिए अपनी जान पर आने वाले जोखिम का भी खयाल नहीं रखा और अपनी ड्यूटी और इंसानियत के तकाजे को प्राथमिक माना। लेकिन यह भी जाहिर है कि चिकित्सा के क्षेत्र में तमाम वैश्विक उपलब्धियों के बावजूद निपाह जैसी चुनौतियों से निपटने के लिए अभी बहुत कुछ किया जाना बाकी है। 1998 में पहली बार मलेशिया के कम्पंग सुंगाई निपाह इलाके में सामने आए इस वायरस को भी उसी जगह के नाम से जाना गया और इसके वाहक तब सूअर माने गए थे। उस समय ढाई सौ से ज्यादा लोग इसकी चपेट में आकर मारे गए थे। लेकिन 2004 में बांग्लादेश में इसकी चपेट में आए लोगों की जांच के बाद चमगादड़ों को इसका जरिया बताया गया। कोझिकोड में भी यही आशंका जताई गई है कि सबसे पहले पीड़ित परिवार के लोगों ने इस वायरस से संक्रमित चमगादड़ का चखा फल खा लिया था। लेकिन इससे संक्रमित व्यक्ति को अगर पूरी तरह सुरक्षित दायरे में नहीं रखा जाए तो दूसरे इंसान भी इसकी चपेट में आ सकते हैं।

विश्व स्वास्थ्य संगठन ने निपाह को तेजी से उभरता हुआ वायरस बताते हुए कहा है कि यह जानवरों और इंसानों में गंभीर बीमारी को जन्म देता है और इसके संक्रमण की गति भी काफी तेज होती है। अभी तक सामने आई जानकारी के मुताबिक निपाह का संक्रमण जापानी ज्वर से जुड़ा है, जिससे दिमाग को भारी नुकसान होता है। यों पिछले दो-तीन दशकों के दौरान यह देखा गया है कि कई खतरनाक संक्रमणशील विषाणुओं के जरिए होने वाली बीमारियां अचानक फैल जाती हैं और जब इससे लोगों की मौत होने लगती है तब जाकर इससे बचाव की पहलकदमी होती है। अमूमन हर साल इनसेफलाइटिस की जद में आकर सैकड़ों बच्चों के मारे जाने की खबरें आती रहती हैं। जहां तक निपाह का सवाल है, करीब दो दशक पहले चिह्नित हो चुके इस वायरस और उससे पैदा बीमारी को रोकने के लिए अब तक कोई कारगर इलाज या टीका नहीं तैयार किया जा सका है। इसलिए फिलहाल जरूरत इस बात की है कि इससे बचाव के उपायों को लेकर व्यापक रूप से जन-जागरूकता अभियान चलाया जाए।

किशनगंगा पर पाकिस्तानी रुदन

किशनगंगा बिजली परियोजना पर पाकिस्तान के विलाप का कोई मतलब नहीं है। बीते शनिवार को ही प्रधानमंत्री नरेंद्र मोदी ने यह परियोजना राष्ट्र को समर्पित की है, और अब इस पर एतराज जताते हुए हमारा पड़ोसी देश विश्व बैंक के दरवाजे तक जा पहुंचा है। उसने शिकायत की है कि सिंधु नदी जल समझौते का भारत उल्लंघन कर रहा है और किशनगंगा जैसी परियोजनाएं उसके यहां जल संकट बढ़ा सकती हैं। अव्वल तो हमने सिंधु नदी जल समझौते के प्रावधानों के मुताबिक ही बांध का निर्माण किया है, और फिर यह ‘नॉन कन्जम्प्टिव’भी है। यानी पानी की जितनी मात्रा का इस्तेमाल हम बिजली पैदा करने के लिए करेंगे, उतना वापस नदी में डाल दिया जाएगा। असल में, किसी भी जलविद्युत परियोजना में पानी को एक रफ्तार से टरबाइन से गुजारा जाता है और जितनी तेजी से टरबाइन घूमता है, उतनी बिजली पैदा होती है। इसमें पानी की कोई खपत नहीं होती। ‘कन्जम्प्टिव यूज’ यानी खपत का अच्छा उदाहरण कृषि के लिए पानी का इस्तेमाल करना है।

पाकिस्तान के आरोपों की सच्चाई सिंधु नदी जल समझौते के प्रावधानों को देखकर बखूबी समझी जा सकती है। यह समझौता 1960 में अस्तित्व में आया था। समझौते के तहत एक स्थाई सिंधु आयोग बनाया गया है, जिसके दो आयुक्त होते हैं, एक भारत के और दूसरे पाकिस्तान के। ये दोनों आयुक्त साल में एक बार मिलते हैं और आपसी विवादों का निपटारा करते हैं। साल 1965, 1971 और कारगिल की जंग के दरम्यान भी दोनों देशों के आयुक्त मिलते रहे हैं। संभवत: इसलिए आज भी यह समझौता तमाम राजनीतिक असहमतियों के बावजूद प्रासंगिक बना हुआ है। पाकिस्तान को लगता है कि अगर भारत के साथ संबंधों में तल्खी आएगी, तो नई दिल्ली कहीं पानी ही न रोक दे? यह सच है कि भूतल के हिसाब से पाकिस्तान हमसे नीचे है, मगर भारत ने कभी पानी जैसी बुनियादी मानवीय जरूरत से उसे वंचित करने की नहीं सोची। इसलिए हमने सिंधु नदी जल समझौता किया है, क्योंकि हम एक जिम्मेदार राष्ट्र हैं। जबकि देखा जाए, तो चीन भूतल के लिहाज से हमसे ऊपर है, पर उसने हमारे साथ ऐसा कोई समझौता नहीं किया है।

किशनगंगा जैसे बांध हमारी, खासकर जम्मू-कश्मीर की जरूरत हैं। इनसे हम बिजली का उत्पादन कर सकेंगे, जो विकास का एक महत्वपूर्ण वाहक है। हालांकि हमारी हुकूमत को जम्मू-कश्मीर की आकांक्षाओं पर भी गौर करना चाहिए। अभी सूबे की किसी भी जलविद्युत परियोजना से जितनी बिजली का उत्पादन होता है, उसका महज 12 फीसदी हिस्सा ही जम्मू-कश्मीर को मिलता है। यहां की उम्मीदें परवान चढ़ सकें, इसके लिए जरूरी है कि यह हिस्सेदारी बढ़ाई जाए। केंद्र सरकार इसे 15 या 20 फीसदी कर सके, तो बेहतर होगा।

बहरहाल, यह समझौता विवाद के निपटारे की राह भी बताता है। इसमें सुलह के तीन तरीकों का जिक्र है। पहला और सबसे प्रभावी है, आपस में मिल-बैठकर मसले का निपटारा। इसमें किसी तीसरे देश का कोई दखल नहीं होगा। दूसरा तरीका है, विश्व प्रसिद्ध इंजीनियरों को बुलाकर विवाद का हल खोजना। और तीसरा, कोर्ट ऑफ ऑर्बिट्रेशन यानी मध्यस्थ अदालत का गठन। पाकिस्तान की मंशा हर मसले को मध्यस्थ अदालत में ले जाने की होती है, क्योंकि ऐसी सूरत में विवादित परियोजना पर तत्काल काम रुक जाता है, और काम में देरी होने का मतलब है, उसकी लागत बढ़ना। इस समझौते का एक महत्वपूर्ण पक्ष विश्व बैंक भी है। उसने ही दोनों मुल्कों को इस समझौते पर पहुंचने में मदद की है, इसलिए पाकिस्तान अभी उसकी शरण में गया है। मगर हमारा रुख साफ है। हम किसी भी मसले में किसी तीसरे देश या पक्ष की मध्यस्थता के हिमायती नहीं रहे हैं। आपस में मिल-बैठकर समस्या का निपटारा करना हमारी नीति रही है।

सिंधु और उसकी सहायक नदियों पर जलविद्युत नदी जैसी परियोजनाएं जम्मू-कश्मीर को काफी लाभ पहुंचा सकती हैं। यह बात सिंधु नदी जल समझौते को अंतिम रूप देने वाले नेताओं ने भी समझी थी। संभवत: इसलिए समझौते में ऐसी तमाम परियोजनाएं बनाने का जिक्र किया गया है, जिससे नदी के बहाव पर कोई असर न पड़े। मगर पाकिस्तान को यह हजम नहीं हो रहा। वह जिस तरह वक्त-बेवक्त इस समझौते की आड़ में भारत पर दबाव बनाने की कोशिश करता है, उसे देखकर कुछ अतिवादी सोच के लोग इस समझौते को निरस्त करने की मांग करते हैं। उनका कहना है कि कभी-कभी हम जो करना चाहते हैं, उसे करने की इजाजत यह समझौता नहीं देता। जब यह बना था, तब तकनीक सीमित थी और पानी का प्रवाह अधिक। अब पानी का प्रवाह कम हो गया है और तकनीक विकसित। इसीलिए अतिवादियों की नजर में यह समझौता बोझ बन गया है। मगर उदारवादी लोग इसमें सुधार के पक्षधर हैं, ताकि विश्व मंच पर भारत की छवि को कोई नुकसान न पहुंचे।

इन दोनों के अतिरिक्त एक मध्यमार्गी सोच भी है, जो कहीं ज्यादा संतुलित दिखती है। यह सोच कहती है कि सिंधु नदी जल समझौते के मौजूदा प्रावधानों के तहत तमाम कार्य चलने चाहिए, और जब वे पूरे हो जाएं, तब जाकर इसे सुधार करने या निरस्त करने के बारे में सोचा जाए। हालांकि पाकिस्तान भी यह जानता है कि इस समझौते के निरस्त होने का सर्वाधिक नुकसान उसे ही होगा और ऐसा करने से उसके हिस्से में कुछ भी नहीं आएगा, उलटे अभी जो संसाधन उसे मिल रहा है, उस पर भी रोक लग सकती है।

साफ है, पाकिस्तान ने बांध के विरोध में जो भी तर्क दिए हैं, वे कहीं नहीं ठहरते। 2010 में भी वह इसके खिलाफ मध्यस्थ अदालत जा चुका है, जहां उसे मुंह की खानी पड़ी थी। इस बार भी उसे फायदा नहीं होने वाला। यह बेवजह का विवाद बनाया जा रहा है। चूंकि पाकिस्तान और भारत के राजनीतिक समीकरण जटिल हैं, इसलिए पानी के बहाने वह तनाव का बहाना ढूंढ़ रहा है। मगर किशनगंगा बांध पाकिस्तान ही नहीं, पूरी दुनिया के लिए संदेश है। यह इंजीनिर्यंरग की हमारी ताकत दिखा रहा है। ऐसी परियोजनाओं से हम विश्व मंच पर अपनी तकनीक और ज्ञान का लोहा मनवा रहे हैं।
