There can be no more delays in Personal Data Protection legislation

The government stepped in to demand an end to WhatsApp’s proposed change in its terms of service and privacy policy. The episode should serve as a wake-up call. India has seen an explosion of digitisation, with the pandemic adding momentum. There were over 500 million internet users in India last year, a number that’s bound to have gone up. This growth has come in absence of a coherent legislative framework to govern data usage and safeguard privacy, a fundamental right that was established through a landmark Supreme Court judgment in 2017.

In December 2019, the government tabled a Personal Data Protection Bill in Parliament. The bill is currently under scrutiny by a parliamentary standing committee, expected to give its report soon. The most comprehensive data protection legislation around is the EU’s General Data Protection Regulation (GDPR). India’s data bill could do with much greater emphasis on GDPR’s core principles – purpose limitation, storage limitation and accountability in use of data. The current bill’s exemption for government agencies from its provisions is too loose and all-encompassing. Tighter wording is essential to safeguard against abuse.

Given that we are late in legislating, we should legislate to cover emerging concerns. The salient features of the digital economy are extreme returns to scale, network effects and data. That’s what triggered the WhatsApp attempt to change its policy. Parliament should take into account the EU’s proposed Digital Markets Act which forces gatekeepers such as Facebook and Google to create data silos and thereby check unfair competition. The different strands of the digital economy are intertwined and a legislation on personal data protection should seamlessly merge into a regulatory framework that thwarts monopolisation. GDPR is a good template. Adopting something like GDPR would also facilitate Indian tech and services trade with Europe. There should be no more delay.

Necessary, not essential

Need to control prices of certain commodities is historically contingent

Times change and economies evolve. If one hangs on to policies simply because of a historical legacy, that will be an inferior response. There was an Air Corporations Act of 1953, repealed in 1994. It is unlikely anyone will want the pre-1994 monopoly of Indian Airlines and Air India simply because this was perceived to be important in 1953. The Essential Commodities Act (ECA), dated 1955, is roughly of the same vintage. That’s not quite correct — ECA’s antecedents are of an earlier vintage. It goes back to war-time shortages and the Defence of India Act, 1939. When World War II was over, there was no possible justification for that particular Defence of India Act and it was repealed. However, there was justification for government control over “essential” commodities, “essential” being defined as necessary and indispensable.

Accordingly, there was first an ordinance and then an Act in 1946, the Essential Supplies (Temporary Powers) Act. The preamble and title indicated this was meant to be temporary. Meanwhile, we had the Constitution and under Article 269, the Union government had powers to enact laws for items on the State List, as if they were on the Concurrent List. But only for five years “from the commencement of the Constitution”. That took us to 1955 and we can skip the details of how Entry 33 in the Concurrent List was amended so that the ECA permanently entered the statute books.

Footwear may be essential, in the sense of being indispensable. That doesn’t necessarily mean the government should “control the production, supply and distribution of, and trade and commerce” in footwear. At least that’s what most people will think now. However, if we cast our minds back, in 1973, a Planning Commission “Committee on Essential Commodities and Articles of Mass Consumption” concluded that the following were essential items — cereals, pulses, sugar, gur and khandsari; edible oils and vanaspati; milk, eggs and fish; common clothing; standard footwear; kerosene oil and domestic fuels; common drugs and medicines; bicycles, bicycle tyres and tubes; matches, dry cells and hurricane lanterns; soaps and detergents; textbooks and stationery. Hence, it felt, “In the urban sector the requirement would be to make available one or two common types of footwear — called “Janta” shoes or chappals – at reasonable prices.” The distribution of “common clothing, standard footwear and soaps and detergents may be entrusted to the National Cooperative Consumers Federation”.

Over time, in addition to those listed by Planning Commission, the essential products list included aluminium, art silk textiles, cement, cinema carbon, coarse grains, coconut husks, coir retting, cold storages, collieries, copper, cotton, drugs, dry batteries, electrical appliances, electrical cables and wires, ethyl alcohol, fertilisers, food grains, fruit, furnace oil, electric lamps, diesel oil, household electrical appliances, cars, maize, insecticides, iron and steel, jute and jute textiles, kerosene, linoleum, LPG, lubricating oils and grease, meat, molasses, mustard oil, newsprint, oil pressure stoves, paper, paraffin wax, petroleum products, plants, fruits and seeds, pulses and edible oils, groundnut oil, rice, salt, sugar and sugarcane, synthetic rubber, tea, textiles, tractors, two-wheelers, tyres and tubes, vegetable oil, wheat. The ECA has a schedule (Section 2) of what is “essential” and if an item is in that schedule, it is axiomatically “essential”. Before liberalisation, there were around 80 Union government-level orders and around 150 state government-level orders decreeing various items as “essential”. Note that if an item is not in the schedule, under that same Section 2, when circumstances warrant, it can be put back on the schedule, sometimes for a limited period of six months.

The progressive tightening of the ECA manifested itself through more and more items being added to the schedule. In addition, offences were made non-bailable and there were special courts. For example, in 1974, an amendment noted, “The hoarders, black-marketeers are playing hell with the lives of millions of people in the country.” Hence, offences were made non-bailable. We shouldn’t forget the Essential Commodities (Special Provisions) Act of 1981 or the 1980 Prevention of Black Marketing and Maintenance of Supplies of Essential Commodities Act either.

Hoarding has a negative nuance attached to it, though hoarders often perform a useful function of reducing price volatility. In contrast, black marketing has a uniformly negative nuance. But black markets exist only when there is a shortage. Just because an item like footwear is indispensable, there is no call for the government to intervene in the market. The antecedents were because of war-related shortages. The subsequent shortage was created through industrial licencing. Licencing led to entry barriers and shortages. Shortages led to price controls and government intervention. In 1973, the Planning Commission also recognised this: “Assured supply of specific essential commodities and articles of mass consumption at reasonably stable prices will not be a practical proposition if domestic availability of these items does not expand in line with the growing demand.” But, in that day and age, it didn’t recommend an end to licencing.

When delicencing occurred, there was no longer any shortage of manufactured products and several items have progressively been removed from the essential items schedule. Why are people upset that cereals, pulses, oilseeds, edible oils, onions and potatoes have been removed from the schedule? If necessary, they can always be put back, hopefully temporarily. More importantly, there is an issue of de-seasonalising prices of agricultural commodities, often subject to cycles. But the ECA doesn’t solve that problem. It is solved by ensuring storage and processing, allowing markets to function, not through limiting them.

Defending liberty against political prosecution

Courts need to recognise selective prosecution as a threshold constitutional defence against the abuse of state power

One of the oldest, most pernicious and widespread forms of abuse of state power in India involves the police and enforcement agencies selectively targeting political and ideological opponents of the ruling dispensation to interrogate, humiliate, harass, arrest, torture and imprison them, ostensibly on grounds unrelated to their ideology or politics, while sparing comparably placed supporters and friends of rulers of the day.

As a recent example, the November 27, 2020 Supreme Court judgment granting TV anchor Arnab Goswami bail says, not without considerable irony because of the personality involved (https://bit.ly/2XXTlL0), “The specific case of the appellant [Arnab Goswami] is that he has been targeted because his opinions on his television channel are unpalatable to authority.” Scores of others are currently so targeted. Many, not as fortunate as Mr. Goswami to be quickly bailed out by the top court, are languishing in prison in inhuman conditions. Is this use of state power legally permissible? Is there no escape for victims of such abuse of state power? Is their only remedy bringing an action for wrongful prosecution years later — if they are acquitted and after suffering through many years of process as punishment? Or is there a legal remedy for nipping this evil in the bud, at the very outset, to protect the life and liberty of the accused?

Separating two legal issues

The problem is that the illegality involved in this type of prosecution is not self evident. At first glance, the prosecution appears legally kosher — acting on information about legal infractions, the police pursue the accused as per law. The illegality becomes plain when two legal questions are clearly distinguished and separated: first, the legality of the exercise of prosecutorial discretion in the selection of the accused for being investigated and prosecuted; and second, the merits of the criminal case filed against them. The two are independent legal issues and should not be wrongly conflated.

Selective prosecution

On the first question, the applicable legal standard is that while the police and prosecutors in common law jurisdictions enjoy vast discretion in deciding who they may pursue and who they may spare, the choice of accused must not be based on grounds that violate Constitutional rights, including the Article 14 right to equal protection of the law. The accused should not be selected, either explicitly or covertly, on constitutionally prohibited grounds. The illegal selection of accused based on grounds prohibited by the Constitution is called “selective prosecution”.

In the words of then Chief Justice W. Rehnquist of the United States Supreme Court (https://bit.ly/3918fqb), “A selective-prosecution claim is not a defense on the merits to the criminal charge itself, but an independent assertion that the prosecutor has brought the charge for reasons forbidden by the Constitution.” (United States v. Armstrong (1996)). “Selective prosecution” is thus a constitutional claim asserted by defendants to assail the proceedings against them on the basis that they were selected for being prosecuted in violation of Article 14 because the grounds of selection are constitutionally prohibited and are arbitrary. When the choice of accused runs afoul of the Constitution, the entire criminal proceeding is vitiated, irrespective of the determination of the second issue, viz., whether the accused are convicted or acquitted on the charges brought against them. Once the proceedings fail under the first issue, there is no legal basis to proceed to the second issue., i.e., trial on the merits of the case. The theory is that the Constitution cannot be violated to uphold the law — such an approach would spell doom for the Constitution. The selective prosecution claim must be adjudicated as a threshold issue, with the prosecution being quashed at the outset of the criminal case if the claim is justified. In the context of this discussion, the constitutionally prohibited ground we are confronting in India is the political or ideological affiliation of the accused. It is an arbitrary ground that violates the Article 14 guarantee of equal protection of the law.

Common law jurisprudence

The United States Supreme Court has a long record of experience with the claim of selective prosecution relevant to us as it is based on American equal protection jurisprudence to which our own Article 14 traces its roots.

In Yick Wo v. Hopkins, the United States Supreme Court said some 135 years ago (in 1886) that to punish some persons for “what is permitted to others as lawful, without any distinction of circumstances [is] an unjust and illegal discrimination”. The Court said further, “Though the law itself be fair on its face and impartial in appearance, yet, if it is applied and administered by public authority with an evil eye and an unequal hand, so as practically to make unjust and illegal discrimination between persons in similar circumstances, material to their rights, the denial of equal justice is …within the prohibition of the Constitution.” Chief Justice William Rehnquist said in Armstrong, “A prosecutor’s discretion is subject to constitutional constraints… One of these constraints, imposed by the equal protection component of the Due Process Clause of the Fifth Amendment… is that the decision whether to prosecute may not be based on “an unjustifiable standard such as race, religion, or other arbitrary classification”…. Justice John Paul Stevens said in the same case, “the possibility that political or racial animosity may infect a decision to institute criminal proceedings cannot be ignored… For that reason, it has long been settled that the prosecutor’s broad discretion to determine when criminal charges should be filed is not completely unbridled….”

Failure of Indian courts

Our courts have not recognised selective prosecution as an independent claim because of the erroneous assumption that the lawfulness of prosecution can only be taken up after the trial, if the accused is acquitted. Thus, for example, the 2018 Report of the Law Commission on ‘Wrongful Prosecution (Miscarriage of Justice): Legal Remedies’ discusses remedies for wrongful prosecution available only if and after the accused is acquitted. Remedy after acquittal comes far too late, well after a brutal and long drawn out criminal justice process that upends the lives of the victims. Also, the right against selective prosecution cannot be extinguished by conviction. Separate from post-acquittal actions for wrongful prosecution (which will still be available), the claim of selective prosecution is a threshold issue that is required to be adjudicated at the outset of criminal proceedings (even during the investigation stage) irrespective of the merit of the charges.

Importance of Goswami case

The judgment of Justice D.Y. Chandrachud in the Goswami case is crucial in this regard. It provides a much needed and long awaited legal opening to strengthen the recognition and use of the selective prosecution claim in India to counter politically coloured prosecution unleashed by the state and defend our liberty. In addition to acknowledging Mr. Goswami’s claim that he is being targeted for opinions he holds and expresses, the judgment says, “Courts should be alive to… the need …of ensuring that the law does not become a ruse for targeted harassment …The doors of this Court cannot be closed to a citizen who is able to establish prima facie that the instrumentality of the State is being weaponized for using the force of criminal law”. The Goswami judgment also quotes the 2018 Supreme Court holding in Romila Thapar v. Union of India that, “[T]he basic entitlement of every citizen who is faced with allegations of criminal wrongdoing is that the investigative process should be fair. This is an integral component of the guarantee against arbitrariness under Article 14 and of the right to life and personal liberty under Article 21.” To strengthen the protection of civil liberty, equality and democracy, it is time our courts — at all levels — recognise selective prosecution as a threshold constitutional defence against the abuse of police and prosecutorial power.

Privacy and surveillance

Data localisation is not the only approach towards protecting data privacy

Following an exodus of its users from its messaging service, WhatsApp, to apps such as Signal and Telegram, which promise more privacy options, the Facebook-owned service might have been forced to postpone the date for users to accept its new privacy policy terms to May 15. In just days after the earlier announcement by WhatsApp, Signal has emerged as the leading app on “app-stores” as Indian users signalled their discomfort with the former’s data sharing policies. WhatsApp, with 459 million users, had emerged as the leading communications application for most Indians. What has caused patrons discomfort is WhatsApp’s ability to seamlessly share user metadata and mobile information with its parent company and social media behemoth, Facebook. Facebook Inc., which also owns Instagram, has sought to integrate the offerings from WhatsApp, Instagram and Facebook, with the former acting also as a tool that secures payments for services and ads posted on the latter two applications, beyond its primary use as a messaging service.

This integration of three large consumption products is a means to monetise their everyday use by consumers and considering the fact that Facebook’s revenue model uses data on its platform to allow advertisers to target ads towards users, the algorithms would benefit from the WhatsApp data as well. Such data transfer from WhatsApp to Facebook is not possible in regions such as the EU, where data protection laws have stringent restrictions on storage and transfer of user data. This regionally differential treatment has attracted the attention of the Ministry of Electronics and IT, which has sent WhatsApp a series of queries, including on why Indian users would be sharing information with Facebook, unlike in Europe. The onus is also on the Indian government to quickly take up the legislation for robust data protection, that aligns with the recommendations of the Srikrishna Committee, which tried to address concerns about online data privacy in line with the 2018 Puttaswamy judgment. The draft Bill proposed by the government in 2019 diluted some of the provisos, for example, by limiting data localisation in proposing that only sensitive personal data needed to be mirrored in the country, and not all personal data as mandated by the committee. But data localisation as proposed by the committee may not necessarily lead to better data privacy, as it carries the possibility of domestic surveillance over Indian citizens. Privacy is better addressed by stronger contractual conditions on data sharing and better security tools being adopted by the applications that secure user data. The proposed Bill has some of these features, similar to Europe’s General Data Protection Regulation, but it also requires stronger checks on state surveillance before it is passed.

Are courts encroaching on the powers of the executive ?

The courts are increasingly intervening in matters without providing sound legal reasoning

On January 12, 2021, the Supreme Court stayed the implementation of three controversial farm laws passed in September 2020 and ordered the constitution of a committee of experts to negotiate between the farmers’ bodies and the Government of India. Rather than deliberating on the constitutionality of the three laws, the court appears to be trying to move some of the parties towards a political settlement. Arguably, in doing so, it is wading into the domain of the government. Has the court in this case abdicated its constitutional duty mandated by the Constitution and is this a growing trend? Anuj Bhuwania and Arun Thiruvengadam discuss this question in a conversation moderated by Jayant Sriram. Edited excerpts:

In the present instance of the court staying the farm laws and forming a committee to break the deadlock between the farmers and the government, what really stands out to both of you as problematic about this particular intervention?

Anuj Bhuwania: What’s really striking here is that nobody asked the court to intervene in this particular manner, to break the deadlock. As the court itself noted in its January 12 order, there are three sets of petitions: one is challenging the constitutionality of the laws and the others are with regard to the protests. None of them ask the court to negotiate between the two parties.

Now, the court has repeatedly said in its oral comments that it views the protests as completely legal and part of the exercise of citizens’ rights under Article 19 of the Constitution. And it has also said that the police alone can take a call on the security aspect. The court is not even framing these cases before it in legal terms. But it has still gone ahead and intervened in this manner, noting that the government has not been particularly successful in negotiating with the farmers’ groups. It has decided that it can do better than the government and appointed its own committee.

The court gave the precedent of the Maratha reservation case in which it had issued a stay, but in that instance, the stay was given on constitutional grounds. Here it does not take up any such constitutional issues though these issues have been pleaded before the court by the farmers associations. The issues are of federalism, of agriculture being a State subject, as well as the manner in which the voice vote was passed in the Rajya Sabha, which was controversial.

Arun Thiruvengadam: If you look at the January 12 order, what is striking is that the court does not even set out clearly what the legal grounds of challenge are. The petition filed by the Bharatiya Kisan Party argues that under our constitutional scheme, agriculture and farm produce are matters reserved under entries 14, 18, 30, 46, 47 and 48 of List II of the Seventh Schedule to the Constitution, which lays out the subjects on which State Legislatures are competent to enact law. The argument is that the Centre simply could not pass the farm bills as it did not have legislative competence.

Courts are, of course, competent to issue stay orders on parliamentary laws, but they need to set out legal reasons. When you look at the reasoning given by the court, in paragraph 8, the court says, “We are also of the view that a stay of implementation of all the three farm laws for the present may assuage the hurt feelings of the farmers and encourage them to come to the negotiating table with confidence and good faith.” Now, this is a strange reason and arguably not a sound legal reason. To issue a stay, courts usually state the legal and constitutional arguments which make them take the view that the law, on its face, raises a question of constitutional violation. But when the court cites “assuaging hurt feelings” of a section of people who are protesting against the laws as a reason to stay a parliamentary law, the order does not seem to have a clear legal basis. That’s why some commentators have asked whether the court is looking at administrative concerns rather than legal considerations.

In a different but related case, the Supreme Court told the Delhi Police that the question of whether the tractor protests should be allowed or not is a ‘law and order’ question and that it is for the police to deal with. It said, don’t come to us. This seems particularly strange because the question of the protesting farmers is also a ‘law and order’ question that authorities have to deal with. The constitutional challenge to the farm bills involves far more people and far more serious questions than only the farmers who have gathered at the borders of Delhi. So, it seems to me that the Bench has been inconsistent in how it is approaching these questions.

Broadening the scope of the discussion, is there a case for the Supreme Court, or for the High Courts for that matter, to be more proactive in matters of governance?

AB: In India, almost every political issue gets rapidly translated into legal terms, and there’s nothing inherently wrong with that. In fact, what we see here with regard to the court is not just a problem of commission but also a problem of omission. There are issues central to Indian politics such as the change to Article 370, the Citizenship (Amendment) Act, reservation quotas for economically weaker sections, electoral bonds, and, more recently, the so-called ‘love jihad’ laws which are all extremely politically controversial. What is striking is that the court has shown no urgency in hearing any of them and has refused to pass a stay order in all of these cases.

On the other hand, the court has very much intervened in matters that are extremely controversial, the most recent obvious example being in the Ayodhya case, if it is determined to do so. So, what we see is that the court is actually abdicating its constitutional responsibility of judicial review. At the same time, it’s acting in usurpation of executive and legislative powers, going beyond the standard areas of judicial behaviour.

AT: Let me take a slightly broader view. This question of judicial overreach is a phenomenon that has been observed in multiple contexts in various countries. Historically speaking, the idea that judges can exercise review powers to overturn laws enacted by democratically elected governments and Parliaments is of fairly recent origin. It is only in the post-World War II era that this idea has become dominant around the world. This has also led to changes in thinking about the role of courts. For instance, in South Africa, there is an interesting provision in their Constitution that enables courts to enter into a dialogue with legislators to prevent a situation of a legal vacuum. So, the court can point out that a law that Parliament has passed is inconsistent with the Constitution to a particular extent, and can allow Parliament time to fix the identified problem.

In India, while adopting our Constitution in 1950, the framers of our Constitution made departures from the idea of parliamentary sovereignty, i.e., the kind you see in the Westminster type of Constitution in the U.K. (where Parliament has much greater power as compared to other systems). The framers gave courts the important power to strike down parliamentary laws. Over time, courts have used this power to check the power of the executive, while also extending their own authority. So, to give you an example, take the power of imposition of President’s rule under Article 356. It was initially understood that courts cannot go into the question of whether President’s rule has been properly imposed as this was based on the ‘subjective’ satisfaction of the President, but the Supreme Court has held that even that high power can be reviewed, at the very least on procedural grounds (S.R. Bommai v. Union of India).

So, these are some of the trends that led to the Indian Supreme Court being described routinely as the world’s most powerful court, from about the 1980s till about 2015. But in all the recent cases that Anuj has mentioned, where legal and constitutional questions were raised, the court simply has not taken on those questions, and has put them in cold storage, often for years at a time. Instead, it is choosing to intervene in cases which are arguably less consequential or relevant, leading to questions being raised about the legitimacy of its intervention. Looking at the work of the court since 2017, it is quite debatable whether it is as strong a defender of constitutionalism and rights as it was in previous years.

AB: Usually when we talk about the Supreme Court, we say that in the initial period it was a more conservative court and then it became more radical over time. But even if you look at the so-called conservative period and the big-ticket political issues that came its way such as land reforms, reservations, the use of Article 356, bank nationalisation, privy purses etc., these are all issues on which the court actually adjudicated pretty promptly. Not necessarily in ways that many of us may agree with but the point is that the court didn’t shy away from giving its opinion. But what we’re seeing recently is the court is very reluctant to take up constitutional challenges to similarly politically controversial moves. That’s quite unfortunate.

Can we point out instances in which the court has played a positive role in protecting or advancing the rights of various groups, in some cases, perhaps even taking up issues before the executive could come to them? Has the manner in which the courts have done so changed over the years?

AT: The classic justification for taking up these cases is to uphold the interests of a group which cannot prevail in a majoritarian system of elections, which are important but not the only concern of constitutional democracies. I think a classic instance fairly recently where the court was seen as performing that role is in the Navtej Johar case (Navtej Singh Johar v. Union of India) which relates to the question of the LGBTQ community and specifically on the question of decriminalisation of Section 377. This is an issue that the courts grappled with for a fairly long time. We know that LGBTQ populations in any human population are going to be a fairly small number. So, for them to run a political campaign and get a majority in Parliament for their position was going to be difficult. After a long struggle and considerable back and forth, the court finally decriminalised same sex relations in 2018.

AB: The court’s record of acting in a counter-majoritarian manner is extremely erratic if not non-existent. Even if we take the Navtej Johar case as an exemplary instance, it was preceded by the Kaushal v. Naz judgment, where the court dismissed the LGBTQ community as a minuscule minority. The court has not been particularly interested in performing any counter-majoritarian role for a long time now. The Navtej Johar judgment is more like the exception that proves the rule. I would say in general that when we look at the court’s role we have to think of it more institutionally, we have to think about how it grounds its decision in terms of its reasoning. And look at its politics somewhat expansively — not just in terms of outcomes and who it benefits, but also in terms of its process. And the process includes who it hears and how it hears but also how it decides in terms of its reasoning.

AI प्रशासन, रक्षा, शिक्षा, कारोबार, स्वास्थ्य समेत सभी क्षेत्रों में प्रवेश द्वार पर है या जीवन का हिस्सा है। यह तकनीक पुरानी व्यवस्था को ध्वस्त कर देगी। जो इस सदी के ज्ञानयुग का हिस्सा हैं, वे फायदे में रहेंगे। उनकी सामाजिक-आर्थिक हैसियत निखरेगी।

इस तकनीक के जानकारों का निष्कर्ष है कि भारत के अंदर जो विकसित राज्य हैं, वे तेजी से इस डिजिटल वर्ल्ड में आगे बढ़ेंगे। जो पीछे हैं, वे हाशिए पर जा सकते हैं। AI के विशेषज्ञ मानते हैं कि भविष्य अब इलेक्ट्रिक कारों का है। AI से बिल्कुल सटीक ड्राइविंग होगी। ऐसे हालात में पुरानी कार इंडस्ट्री, उसके कारखाने-कर्मचारी नहीं टिक पाएंगे।

AI के दौर में इस नई कार के कारखाने भी बेंगलुरु जैसे जगह ही होंगे। जहां पहले से नॉलेज इंडस्ट्री है। विकसित शहर नए रोजगार केंद्र बनेंगे। संदेश स्पष्ट है कि समय के अनुसार जो नहीं बदलेंगे, वे अतीत बन जाएंगे। भविष्य उनका होगा, जो समय की करवट से तालमेल बैठा पाएंगेे। जहां ‘टेक इंटेंसिटी’ (सत्या नडेला का नया मुहावरा, आज के डिजिटल संसार में टेक्नोलॉजी सघनता से तात्पर्य) होगी, वे समृद्धि के नए टापू-केंद्र होंगे।

टेक्नोलॉजी बदलाव के इस ज्वार-वेग में सरकारों की नीतियां निर्णायक होंगी। पर समाज और एक-एक इंसान की पहल और सजगता से ही देश अपनी नियति लिखेंगे। एक-एक विश्वविद्यालय, शिक्षा केंद्र इस बदलाव के हरावल दस्ते बन सकते हैं। अपने मौलिक शोधों से, खोज से, टेक्नोलॉजी ईजाद से।

विशेषज्ञ मानते हैं कि देश के विकसित राज्य या हिस्सा, पढ़े-लिखे लोग, सामर्थ्य वर्ग इससे और लाभान्वित होंगे। उनकी मान्यता है कि इसी तरह संसार स्तर पर दुनिया के विकसित मुल्क पीछे छूटे देशों को कोलोनाइज करेंगे। नए ढंग से। नए संदर्भ में। अपनी इस टेक्नोलॉजी के बल दुनिया के मौजूदा सामाजिक तानाबाना पर गहरा असर पड़ेगा।

अंग्रेज आए, तो यह देश बंटा था। पिछड़ा था। फिर अमेरिका का दौर आया। अब चीन है। भारत भी इसी राह पर है। इस ग्लोबल वर्ल्ड में हर भारतीय सारी चीजें देख रहा है। यह भारत की नियति को फिर नए सिरे से लिखने का मौका है। जरूरी है कि बदलाव की इस महाआंधी को देश समझे।

डिजिटल इंडिया भारत के भविष्य से जुड़ा जरूरी सवाल है। आज दुनिया की टॉप टेक्नोलॉजी भारतीय प्रतिभाएं तैयार कर रही हैं। यह काम देश के कोने-कोने में हो, यह माहौल मिलकर बनाना होगा। सॉफ्टवेयर का पुनर्लेखन हो। टेक्नोलॉजी पार्क विकसित हों। नई टेक्नोलॉजी विकसित करने का देशव्यापी अभियान हो। अपने देश की प्रतिभाओं को देश और राज्यों में फलने-फूलने और कुछ करने की सुविधाएं मिले। देशव्यापी रचनात्मक माहौल बने।

पिछले दिनों एक रिपोर्ट पढ़ी कि 1996 से 2015 के बीच सीबीएसई, आईसीएससी, आईसीएस के 86 टॉपर्स में से आधे से ज्यादा आज विदेशों में हैं। ज्यादातर अमेरिका में। वह भी साइंस-टेक्नोलॉजी क्षेत्र में विशिष्ट जगहों-पदों पर। 50-60 के दशकों में हम ‘ब्रेन ड्रेन’ नहीं रोक पाए।

हालात बदलने का राष्ट्रीय संकल्प अब मिलकर लें। यह लोक अभियान बने। हर शिक्षा केंद्र, बौद्धिक शोध केंद्र, प्रयोगशालाएं, भारतीय मिट्टी-आबोहवा और जरूरत के अनुसार इस तकनीक पर पहल और शोध करें। उद्यमी उद्योगों को इस बदलाव का न सिर्फ हिस्सा बनाएं, बल्कि वे दुनिया के लिए मॉडल बनें। उनके बिजनेस मॉडल, उत्पाद, इनोवेशन को दुनिया अपनाए।

भारतीय उद्यमियों में यह क्षमता है। देश खुद अपनी टेक्नोलॉजी बनाए। अपना एआई, अपना प्लेटफॉर्म भारत में बने। यह देश के अस्मिता-भविष्य से जुड़ा प्रसंग है।

आज टेक्नोलॉजी की ताकत कहां पहुंच गई? दृष्टिविहीन नए ढंग से दुनिया देख सकते हैं। इतिहासकार अतीत के रहस्यों-खंडहरों का पाठ कर सकते हैं। वैज्ञानिक बीमार धरती को बचाने नई तकनीक ढूंढ सकते हैं। इंसान दीर्घायु होने की ओर पांव बढ़ा चुका है। असंख्य बदलावों की दहलीज पर खड़ा है, इंसान और संसार। टेक्नोलॉजी के बदलाव की यह गति धीमी नहीं हो सकती। बदलाव के भूचाल से देश को तालमेल बनाना होगा, ताकि हम उसी गति से नई दुनिया में, नई ताकत से जगह बना सकें।

परिपक्व लोकतंत्र की छाप छोड़ता भारत

प्रवासी भारतीय दिवस सम्मेलन में 9 जनवरी को प्रधानमंत्री नरेंद्र मोदी ने अपने संबोधन में भारतीय लोकतंत्र से जुड़ी कुछ महत्वपूर्ण वास्तविकताओं पर प्रकाश डाला। चूंकि कुछ दिन बाद ही देश अपने गणतंत्र की वर्षगांठ मनाने जा रहा है तो इन तथ्यों की प्रासंगिकता और बढ़ जाती है। मोदी ने स्वतंत्रता के समय वाले उन बयानों का भी उल्लेख किया, जब तमाम लोगों ने संदेह व्यक्त किया था कि इतने गरीब और अशिक्षित देश में लोकतंत्र का टिके रहना असंभव होगा। इसके उलट सत्य यही है कि भारत आज भी एकजुट है और दुनिया में लोकतंत्र का सबसे सशक्त एवं जीवंत प्रमाण यदि कोई देश है तो वह भारत ही है। भारतीय नागरिक अपनी उस लोकतांत्रिक व्यवस्था पर उचित ही गर्व महसूस करते हैं, जो सार्वभौमिक वयस्क मताधिकार पर आधारित है। इसमें अठारह वर्ष से अधिक के प्रत्येक भारतीय को मत देने का अधिकार प्राप्त है। स्वतंत्र एवं निष्पक्ष चुनाव में भारतीय अपने प्रतिनिधियों का चुनाव कर सरकार को आकार देते हैं।

ऐसे में भारतीय राजव्यवस्था के इस खास पहलू की ऐतिहासिक पृष्ठभूमि पर चर्चा आवश्यक है। यह दर्शाता है कि हमारे राष्ट्र के संस्थापकों ने सार्वभौमिक वयस्क मताधिकार और पूर्ण लोकतंत्र को देश के आधारभूत राजनीतिक सिद्धांत के रूप में अपनाने जैसा जोखिम उठाने का साहस दिखाया था। उस दौर के अधिकांश पश्चिमी राजनीतिशास्त्री और ब्रिटिश नेताओं ने आशंका व्यक्त की थी कि भारी तादाद में अशिक्षित और गरीब आबादी लोकतांत्रिक प्रणाली से ताल नहीं मिला पाएगी। उनकी आशंका खासतौर से इस तथ्य को लेकर और बलवती थी कि सार्वभौमिक वयस्क मताधिकार वाले पूर्ण लोकतांत्रिक ढांचे को साकार करने में यूरोपीय देशों को सैकड़ों साल लग गए। वहां मताधिकार पुरुषों को ही प्राप्त था और वह भी धन-संपदा और शिक्षा पर आधारित था। महिलाओं के पास तो मताधिकार था ही नहीं और उन्हें वह हासिल करने के लिए लंबा संघर्ष करना पड़ा। ब्रिटिश महिलाओं को यह 1918 में जाकर हासिल हुआ तो फ्रांस में यह 1944 में मिला और स्विट्जरलैंड में तो केवल पचास साल पहले ही संभव हो सका।

भारतीयों ने दिखा दिया कि राजनीतिक परिपक्वता का साक्षरता से कोई संबंध नहीं। भारतीय नागरिक वर्ष 1952 में हुए पहले आम चुनाव से ही अपनी इच्छा और अपने हितों की समझ के हिसाब से राजनीतिक बुद्धिमत्ता का प्रदर्शन करते आए हैं। न केवल उन्होंने, बल्कि राजनीतिक वर्ग ने भी चुनावी नतीजों को हमेशा पूरी गरिमा के साथ स्वीकार किया। यही कारण है कि भारत में ऐसा कोई वाकया नहीं दिखा, जैसा विगत छह जनवरी को अमेरिकी संसद में तब देखने को मिला जब नए राष्ट्रपति जो बाइडन के निर्वाचन पर अंतिम औपचारिक मुहर लगाने की प्रक्रिया जारी थी।

किसी भारतीय नेता ने चुनाव नतीजों को प्रभावित करने के लिए कभी अपने समर्थकों को इस प्रकार नहीं उकसाया। किसी ने विधायिका को अपमानित नहीं किया। यह दर्शाता है कि न केवल भारतीय लोकतंत्र सशक्त है, बल्कि निर्वाचन आयोग भी सभी चुनाव बेहतर तरीके से संपन्न कराता है। यह भी अमेरिका से उलट है, जहां चुनावों को विश्वसनीय बनाने के लिए चुनाव प्रबंधन में सुधार अपरिहार्य हो गए हैं। भारत में सत्ता हस्तांतरण में वैसे तेवर कभी नहीं दिखे जैसे अमेरिका में डोनाल्ड ट्रंप ने 20 जनवरी को दिखाए, जो परंपरा के अनुसार बाइडन के शपथ ग्रहण में शामिल नहीं हुए। उन्होंने परिपक्वता नहीं दिखाई। भारत में तल्ख चुनावी अभियान के बावजूद राजनीतिक बिरादरी परंपराओं का पालन करती है। यहां किसी पार्टी ने चुनाव नतीजों को वैसे खारिज करने का प्रयास नहीं किया जैसा अमेरिका में हुआ। सौभाग्य से अमेरिका में भी ऐसी कोशिशें फलीभूत नहीं हुईं।

यह अतिशयोक्ति नहीं कि औपनिवेशिक दासता से आजादी पाना भारतीय इतिहास की सबसे उल्लेखनीय उपलब्धि मानी जाती है। हालांकि इसकी अनदेखी की जाती है कि यह केवल भारतीय इतिहास ही नहीं, बल्कि विश्व इतिहास के लिए भी उतना ही महत्वपूर्ण है। ऐसा इसलिए, क्योंकि भारत की स्वतंत्रता ने एशिया और अफ्रीका के तमाम गुलाम देशों को आजादी की राह दिखाई। भारत उन नवस्वतंत्र देशों को लोकतंत्र अपनाने में प्रेरक भी बना। हालांकि उनमें से तमाम देश लोकतंत्र को कायम रखने में नाकाम रहे। पाकिस्तान इसकी बड़ी मिसाल है, जहां फौज लोकतंत्र पर हावी होती गई। ऐसे देशों के लोग भारतीय लोकतंत्र से अभी भी रश्क करते हैं। 1977 में मिस्न में तैनाती के दौरान मुझे भी इसका अनुभव हुआ। यह वह साल था जब आपातकाल के बाद हुए लोकसभा चुनाव में इंदिरा सरकार को सत्ता से बाहर कर दिया गया था। मिस्न में तब सैन्य तानाशाही थी, लेकिन दिखावा लोकतंत्र का था। हालांकि मिस्न की जनता इसे भलीभांति समझती थी।

निजी मुलाकात में वे अपनी भावनाएं व्यक्त करते थे। कई लोगों ने खुद मुझे बताया कि वे भारतीय लोकतंत्र के मुरीद हैं, जहां लोग मताधिकार का इस्तेमाल कर इंदिरा गांधी जैसी मजबूत नेता को सत्ता से बेदखल कर सकते हैं। तमाम लोग यह भी कहते थे कि भारत में भले ही साक्षरता बहुत अधिक न हो, लेकिन राजनीतिक परिपक्वता का स्तर काफी ऊंचा है। स्वतंत्रता के उपरांत शुरुआती वर्षों में भारतीय कुलीन वर्ग के एक तबके, विशेषकर जिसने पश्चिमी देशों में शिक्षा प्राप्त की थी, को आशंका थी कि गरीब और अशिक्षित लोग प्रतिनिधि चुनने में नकारात्मक पहलुओं से प्रभावित हो सकते हैं। वे गलत साबित हुए। चुनाव दर चुनाव गरीब और हाशिये पर मौजूद समूहों ने मतदान में सूझबूझ का ही प्रदर्शन किया। उन्होंने अपने हितों के हिसाब से अपनी पसंद के प्रतिनिधि चुने और यह बुनियादी लोकतांत्रिक परंपरा के अनुरूप हुआ।

अपने संबोधन में मोदी ने याद दिलाया कि ब्रिटेन में भारत विरोधी तमाम वर्गों को यह भी अंदेशा था कि भारत अपनी एकता कायम नहीं रख पाएगा। वे भी गलत सिद्ध हुए। भारत ने लोकतांत्रिक परंपराओं और संवैधानिक मूल्यों को संरक्षित रखते हुए इन चुनौतियों को धता बताया। इससे सुनिश्चित हुआ कि भारत एक स्वतंत्र एवं समावेशी समाज बना रहेगा, जो अपने सभी नागरिकों की प्रगति के लिए प्रतिबद्ध होगा, जिसमें सबसे कमजोर तबके को प्राथमिकता दी जाएगी। ऐसे में गणतंत्र दिवस के अवसर पर भारत को लोकतांत्रिक ढांचे के प्रति नए सिरे से अपनी प्रतिबद्धता दर्शानी चाहिए, ताकि अंतरराष्ट्रीय समुदाय में वह अपना सिर गर्व से ऊंचा उठाए रख सके।

श्रम सुधारों की दिशा में सार्थक पहल

कृषि कानूनों पर राजनीति से प्रेरित आंदोलन इन दिनों सुर्खियों में है। इस बीच केंद्र सरकार ने समग्र दृष्टिकोण के साथ एक क्रांतिकारी सुधार की दिशा में कदम बढ़ाया है। सरकार ने सभी पक्षों के साथ व्यापक विमर्श कर श्रम सुधारों की पहल की है। पहली बार किसी सरकार ने संगठित के साथ असंगठित क्षेत्रों के कामगारों और उनके परिवारों की सुध ली है। इसके साथ ही नौकरी देने और पाने वालों के संबंधों को एक परिवार भाव में पिरोने की कोशिश की है। इसे दीनदयाल उपाध्याय के अंत्योदय के सिद्धांत के तहत आगे बढ़ाया है। श्रम सुधार कानून का लक्ष्य समाज के अंतिम पायदान पर खड़े व्यक्तियों को निश्चित वेतन, बीमा, स्वास्थ्य सेवा और पेंशन की सुरक्षा के दायरे में लाना है।

इन सुधारों से अब हर क्षेत्र में काम करने वाले मजदूर और डिलीवरी ब्वॉय से लेकर मैनेजर और इंजीनियर तक सबको सम्मान के साथ आर्थिक न्याय मिल पाएगा। देश में 29 करोड़ परिवार और सभी क्षेत्रों में काम करने वालों को मिलाकर 55 करोड़ श्रम बल है। इसमें 60 फीसद काम करने वाली आबादी यानी करीब 30 करोड़ लोग गैर कृषि क्षेत्र से जुड़े हैं। श्रम सुधार सीधे इन 30 करोड़ लोगों पर सकारात्मक असर डालेगा। देश के करीब 13-15 करोड़ परिवार इससे लाभान्वित होंगे। इस लिहाज से देश का हर दूसरा परिवार इन सुधारों से प्रभावित होगा। चार श्रम कानूनों के माध्यम से अब राष्ट्रीय न्यूनतम वेतन निर्धारित किया जाएगा। सभी कामगारों को हर महीने की सात तरीख से पहले बैंक ट्रांसफर से वेतन उपलब्ध कराने की मुहिम चलेगी। पुरुष एवं महिला मजदूरों को समान वेतन देना अनिवार्य होगा। कुल मिलाकर 13-15 करोड़ निम्न मध्यमवर्गीय भारतीय परिवारों का जीवन स्तर और मौजूदा आमदनी बढ़ेगी।

सभी कामगारों को सुरक्षा दिलाने के मकसद से केंद्र सरकार ने नौ श्रम कानूनों को सामाजिक सुरक्षा और कल्याण कोड से जोड़ दिया है, ताकि श्रमिकों को बीमा, स्वास्थ्य चिकित्सा, बोनस, पेंशन, मातृत्व लाभ आदि के अधिकार सुरक्षित हो सकें। श्रम सुधार कानूनों में फैक्ट्रियां, रिटेल शो रूम, रेस्तरां, ई-कॉमर्स डिलीवरी, खनन, कंस्ट्रक्शन, प्लांटेशन, मोटर ट्रांसपोर्ट से लेकर संविदा श्रमिक और अंतरराज्यीय प्रवासी मजदूर सभी के हितों को सुनिश्चित किया गया है। सरल भाषा में कहा जाए तो बड़े बहुराष्ट्रीय कंपनी के मैनेजर से लेकर डिलीवरी ब्वॉय तक सभी कामगार सामाजिक सुरक्षा के दायरे में समान रूप से आएंगे। साधारण नौकरी करने वाला व्यक्ति भी इस मूलभूत सुविधा से वंचित नहीं होगा।

पहले श्रम कानूनों में कई प्रविधान अंग्रेजी राज के थे। इससे सभी क्षेत्रों में काम करने वाले कामगार और काम देने वाले नियोक्ता, दोनों के हितों की रक्षा के बजाय उन्हें परेशानियों का ही सामना करना पड़ता था। कानूनों का जाल ऐसा था कि एक ही काम के लिए कामगार को कई फॉर्म भरने पड़ते थे तो कंपनियों को तमाम धाराओं और अन्य बिंदुओं में बंटे 44 कानूनों की वजह से श्रम विभाग के दफ्तरों में चक्कर काटने पड़ते थे। ऐसे में बेकार कानूनों को मौजूदा सरकार ने रद किया और अब सभी श्रम कानूनों को चार कोड में समाहित किया जा रहा है। श्रम सुविधा के पोर्टल के जरिये उद्योगों को भी ऑनलाइन और फेसलेस रिटर्न की व्यवस्था की गई है। उद्योग जगत को मिली सहूलियत से लाखों घंटे मानव श्रम की बचत होगी। इतना ही नहीं, इससे श्रम विवादों की संख्या कम होगी। कारोबारी सुगमता से भारत की रैंकिग सुधरेगी और विदेशी निवेश के माध्यम से अर्थव्यवस्था को मजबूती मिलेगी।

भारत विश्व की छठी सबसे बड़ी अर्थव्यवस्था है। प्रति व्यक्ति आय के हिसाब से दुनिया में भारत 148वें पायदान पर है। ऐसे में जरूरत है कि बेरोजगारी के साथ कम वेतन की समस्या को दूर करने पर काम भी हो। श्रम सुधार इसी दिशा में एक क्रांतिकारी कदम हैं, जो न सिर्फ रोजगार के अवसर सृजित करेंगे, बल्कि पूरी सामाजिक सुरक्षा के साथ-साथ सुनिश्चित वेतन- भत्ते से हर नौकरीपेशा का जीवन स्तर भी बेहतर होगा। इस नए फ्रेमवर्क में लैंगिक भेदभाव को पूरी तरह समाप्त करते हुए महिला-पुरुष के लिए समान वेतन निर्धारित किया गया है। मैन्यूफैक्र्चंरग ही नहीं, सेवा क्षेत्र से लेकर निर्माण आदि सभी क्षेत्रों में भी यह लागू होगा। साथ ही नौकरियों की गुणवत्ता में सुधार सुनिश्चित करेगा।

घरेलू उपभोग हमारी कुल अर्थव्यवस्था (जीडीपी) का करीब 60 फीसद है। यानी निवेश, सरकारी खर्च और कुल आयात-निर्यात को छोड़ दें तो यह जीडीपी का सबसे बड़ा हिस्सा है। ऐसे में भारतीय अर्थव्यवस्था को तेजी से विकसित करने के लिए आवश्यक है कि घरेलू मांग और खपत को बढ़ावा दिया जाए। इस दिशा में श्रम सुधार सबसे अहम है, क्योंकि इससे घरेलू आय में बढ़ोतरी होगी और उपभोग की क्षमता बढ़ेगी। अभी देश के 29 करोड़ परिवारों में से 13-15 करोड़ परिवारों की आमदनी 1.5 लाख से 3.5 लाख रुपये के बीच है।

आने वाले वर्षों में इसमें 20-30 फीसद की वृद्धि होगी। ऐसे में इस वर्ग की आय में बढ़ोतरी मांग को बढ़ावा देगी। यानी श्रम सुधार इन निम्न मध्यम आय वाले परिवारों के लिए घरेलू आय में वृद्धि करके मांग को बढ़ावा देगा और मांग बढ़ने से जीडीपी में वृद्धि होगी। जब सरकार किसी कंपनी को कर छूट देती है तो वह तत्काल निवेश या खर्च में तब्दील नहीं होता, लेकिन किसी कामगार को 500 रुपये भी अतिरिक्त मिलता है तो वह कुछ जरूरत की नई चीजें खरीदना चाहता है, जो तत्काल मांग पैदा करता है। निश्चित तौर से नए भारत के नए श्रम कानून देश के श्रम जगत को सही मायने में सामाजिक-आर्थिक न्याय दिलाने और केंद्र सरकार के न्यू इंडिया के संकल्प को साकार करने की दिशा में क्रांतिकारी कदम बनने वाला है।

भविष्य की ओर

अमेरिका के 46वें राष्ट्रपति के शपथ-ग्रहण समारोह का विवादों एवं शोर-शराबे से मुक्त होना यह आभास देता है कि दुनिया की इकलौती महाशक्ति में हालात सामान्य होने लगे हैं। दो हफ्ते पहले सत्ता पर कब्जा जमाने की पिछले राष्ट्रपति की कोशिश के मद्देनजर ऐसी सोच भ्रामक हो सकती है। इस नए अमेरिका का सौम्य रूप देश की पहली अश्वेत एवं दक्षिण एशियाई महिला उपराष्ट्रपति के तौर पर कमला हैरिस के शपथ में भी दिखा। नए राष्ट्रपति जोसेफ बाइडन ने खतरे की आशंका के बावजूद शपथग्रहण समारोह परंपरा के अनुरूप खुली जगह पर आयोजित कर स्थिति सामान्य होने का संदेश देने की कोशिश की। लेकिन उन्होंने अपने जज्बाती भाषण में अमेरिका के समक्ष पेश आने वाली चुनौतियों का भी जिक्र किया। उन्होंने चुनाव नतीजों पर मुहर लगाने के लिए गत 6 जनवरी को बुलाई गई कांग्रेस की बैठक के दौरान ‘कैपिटल हिल’ पर धावा बोलने की नाकाम कोशिश का परोक्ष जिक्र करते हुए कहा, ‘लोकतंत्र जिंदा बच गया है।’ भले ही बाइडन या मंच पर मौजूद किसी दूसरे शख्स ने 45वें राष्ट्रपति डॉनल्ड ट्रंप का नाम नहीं लिया लेकिन परंपरा को धता बताते हुए शपथग्रहण समारोह से दूर रहने वाले ट्रंप का साया चारों तरफ नजर आया।

बाइडन ने अपने पूर्ववर्ती की विभाजनकारी विरासत का खुलकर जिक्र किया। उन्होंने नस्ली इंसाफ को आवाज देने और राजनीतिक अतिवाद, श्वेत श्रेष्ठता एवं घरेलू आतंकवाद को परास्त करने की भी बात कही। उन्होंने डेमोक्रेटिक पार्टी के प्रमुख चुनावी वादों पर अमल करने की बात भी कही जिनमें पेरिस जलवायु समझौते का फिर से हिस्सा बनना और कम कठोर आव्रजन नीति भी शामिल है। लेकिन उन्होंने अपना एजेंडा महान अमेरिकी स्वप्न के हिस्से के तौर पर पेश करने की कोशिश की जिसे सिर्फ एकजुट देश में ही हासिल किया जा सकता है। उन्होंने एकता की अपील करने के साथ यह कहते हुए असहमति की सीमा भी तय कर दी कि, ‘वह लोकतंत्र है। वह अमेरिका है। हमारे गणतंत्र की सुरक्षा दीवारों के भीतर शांतिपूर्ण तरीके से असहमति जताने का अधिकार शायद इस देश की सबसे बड़ी ताकत है।’ उन्होंने कोविड-19 संकट से निपटने के ट्रंप के क्रूर तरीकों से भी खुद को अलग करते हुए महामारी में मरे 4 लाख अमेरिकी नागरिकों की याद में कुछ पलों का मौन रखा।

बाइडन ने कार्यकाल के पहले ही दिन 17 कार्यकारी आदेशों पर हस्ताक्षर किए। इनमें से कई आदेश एच1बी वीजा समेत आव्रजन, किफायती स्वास्थ्य देखभाल, पर्यावरण, रोजगार एवं अर्थव्यवस्था पर ट्रंप की कट्टर नीतियों को पलटने वाले भी हैं। लेकिन डेमोक्रेटिक पार्टी एवं रिपब्लिकन पार्टी के नेताओं के बीच समारोह में नजर आई गर्मजोशी एवं हल्के-फुल्के अंदाज को बहुत गंभीरता से नहीं लेना चाहिए। बाइडन का सीनेट में कई दशकों के अपने कार्यकाल के दौरान विरोधी दल के साथ भी बढिय़ा संबंध रहा है लेकिन ट्रंप को रिपब्लिकन पार्टी के सांसदों में तगड़ा समर्थन हासिल है और 6 जनवरी की निर्णायक मंजूरी के समय यह नजर भी आया था। भले ही डेमोक्रेट सांसदों के पास दोनों सदनों का नियंत्रण है लेकिन प्रतिनिधि सभा में उसे मामूली बढ़त ही हासिल है।

ट्रंप पर महाभियोग सुनवाई करना सीनेट का शुरुआती काम होगा। उसका नतीजा बाइडन के कार्यकाल में राजनीतिक ध्रुवीकरण की सीमा तय करेगा और वैश्विक राजनीति के लिए भी उसके कई अहम संकेत होंगे। मुख्यत: अमेरिकी अवाम पर केंद्रित अपने उद्घाटन भाषण में बाइडन ने यूरोप एवं एशिया के अपने सहयोगी देशों को भी भरोसा दिलाया। ट्रंप ने अमेरिका को एक गैर-भरोसेमंद सहयोगी के तौर पर पेश करने के साथ ही दुनिया भर में व्हाइट हाउस की साख गिराने वाले तमाम काम किए हैं। इस निचले स्तर से अमेरिका को फिर से महान राष्ट्र बनाने के लिए अमेरिका के सबसे उम्रदराज राष्ट्रपति को बहुत कुछ करना होगा।

हकीकत से बेखबर नए कृषि कानून

कृषि उत्पादों के विपणन से संबंधित नए कानून खाद्य प्रसंस्करण कंपनियों एवं खुदरा चेन कंपनियों के लिए किसानों से सीधे संपर्क साधना आसान बनाने के मकसद से बनाए गए लगते हैं। आक्रोशित किसान भारी विरोध कर रहे हैं क्योंकि उन्हें लगता है कि ये कानून उनके हित में नहीं हैं। हालांकि कई अर्थशास्त्री इनके समर्थन में खड़े दिखे हैं। उनका मानना है कि मुक्त बाजार-आधारित व्यवस्था होने से कृषि उत्पादों की कीमतें मांग-आपूर्ति संतुलन को बेहतर ढंग से परिलक्षित करेंगी और फसलों के पैटर्न में अधिक तार्किकता आएगी।लेकिन इस दलील में वितरणकारी आयाम को नजरअंदाज कर दिया गया है। कृषि विपणन प्रणालियां ऐसी होनी चाहिए कि उत्पादक एवं उपभोक्ता दोनों के ही लिए वाजिब कीमतें हों और बिचौलियों को साधारण मुनाफा ही मिले। राष्ट्रीय स्तर पर खाद्य एवं पोषण सुरक्षा के लिहाज से भी यह समरूप होना चाहिए। भारतीय संदर्भ में इसकी संभावना नहीं है कि कृषि उत्पादों में मुक्त बाजार होने से ऐसा हो पाएगा। इसकी वजह यह है कि कृषि उत्पादों का बाजार विनिर्मित उत्पादों के बाजार से काफी अलग है।

1. कृषि बाजारों में विक्रेता लाखों की संख्या में हैं जबकि थोक खरीदारों की संख्या सीमित है। वहीं विनिर्मित उत्पादों के आम बाजार में खरीदारों की संख्या लाखों में है और विक्रेताओं की संख्या सीमित है।

2. कृषि बाजारों में आपूर्ति फसली मौसम पर काफी निर्भर है जबकि मांग में इस मौसम के हिसाब से फर्क नहीं आता है। ऐसे में भंडारण की क्षमता रखने वाले बड़े खरीदारों को बढ़त मिल जाती है क्योंकि उनके पास अधिक खरीद के लिए वित्तीय संसाधन भी होते हैं।

3. कृषि उत्पादों की मांग के वक्र में लोच नहीं होती है और इसमें तीखी ढलान भी होती है, लिहाजा बंपर फसल होने पर कीमतें तेजी से गिरती हैं। वहीं फसल कम होने पर मांग रहने से इनकी कीमतों में तेजी से उछाल भी आती है।

मांग एवं आपूर्ति के इस मौसमी पहलू में असंतुलन के चलते कृषि उत्पादों खासकर जल्दी खराब होने वाले खाद्य उत्पादों की कीमतों में साल भर में बड़ी उठापटक होती है। मार्च 2020 से पहले के 10 वर्षों के मासिक औसत पर नजर डालें तो उफान एवं गर्त के बीच मूल्य अंतर दिखाई देता है। सब्जियों के मामले में यह अंतर 23 फीसदी है और टमाटर, प्याज एवं आलू की कीमतों में यह फर्क क्रमश: 65.6 फीसदी, 40.4 फीसदी और 35.6 फीसदी तक देखने को मिला है। (स्रोत: भारत के प्रमुख आर्थिक संकेतकों में सीजन का असर, आरबीआई बुलेटिन, दिसंबर 2020)।

किसानों एवं थोक खरीदारों की बाजार ताकत में असंतुलन एक उपभोक्ता के चुकाए हुए मूल्य एवं उत्पादक को मिलने वाली कीमत के बीच के बड़े फासले से साफ नजर आता है। आरबीआई के सर्वे में यह फर्क 28 फीसदी से लेकर 78 फीसदी तक दिखा है। कृषि बाजारों में हस्तक्षेप न केवल विक्रेताओं बल्कि उपभोक्ताओं के हितों को संरक्षित करने के लिए भी जरूरी है। (भारत में आपूर्ति शृंखला गतिकी एवं खाद्य मुद्रास्फीति, आरबीआई बुलेटिन, अक्टूबर 2019)।

मुक्त बाजारों से इतर देखें तो बुनियादी तौर पर हरेक कृषि उत्पाद बाजार के लिए तीन विकल्प मौजूद हैं…

– थोक खरीद एवं वितरण में सार्वजनिक क्षेत्र की सीधी एवं बड़ी भागीदारी

– निजी क्षेत्र के थोक विक्रेताओं एवं वितरकों पर निर्भरता के साथ ही जरूरी होने पर सार्वजनिक इकाइयां बाजार निगरानी एवं हस्तक्षेप भी करें। और

– किसानों की सहकारी समितियों या उत्पादक कंपनियों को उपभोक्ता तक वैल्यू चेन में हिस्सेदारी मिले।

वर्तमान में कृषि उत्पादों की सार्वजनिक खरीद कमोबेश धान एवं गेहूं तक ही सीमित है जो फसली उपज के कुल मूल्य का महज 23 फीसदी ही है। इसमें बड़ा हिस्सा पंजाब, हरियाणा एवं पश्चिमी उत्तर प्रदेश का है। हालांकि विकेंद्रीकरण की कोशिश से थोड़ा लाभ हुआ है और धान की सरकारी खरीद में ओडिशा, मध्य प्रदेश एवं छत्तीसगढ़ का भी हिस्सा बढ़ा है। विकेंद्रीकरण के सिद्धांत का विस्तार करते हुए गारंटी कीमत पर फसलों की खरीद में राज्यों को मदद देना भी विकल्प हो सकता है।

निजी खरीद पहले से ही खाद्य तेल, फल एवं सब्जियां, मसाले और कपास जैसी कई कृषि जिंसों की विपणन का प्रमुख जरिया बनी हुई है। यहां पर असली जरूरत कीमतों की बड़ी उठापटक वाले बाजारों में संगठित एवं नियमित दखल देने की है। आलू, प्याज एवं टमाटर जैसे उत्पादों के बाजार में तो यह बेहद जरूरी है।

न तो सार्वजनिक और न ही निजी खरीद का विकल्प किसानों को उपभोक्ता तक पहुंचने वाली वैल्यू चेन में हिस्सेदारी देता है। इस काम को केवल सहकारी समितियों एवं किसान उत्पादन कंपनियों के माध्यम से ही अंजाम दिया जा सकता है। यह तीसरा तरीका कृषि क्षेत्र का सबसे जरूरी काम पूरा कर सकता है जो कि किसानों को प्रमुख अनाजों के बजाय अधिक मूल्य वाली फसलों की खेती की तरफ प्रोत्साहित करने का है। देश में इन फसलों की मांग तेजी से बढ़ रही है।

दुग्ध सहकारी समितियों की भारतीय व्यवस्था इस तीसरे तरीके का बेहतरीन उदाहरण है। यह तीन स्तरों- खरीद के लिए ग्रामीण स्तरीय सहकारी समितियां, प्रसंस्करण के लिए जिला स्तरीय दुग्धपालक संगठन और दूध एवं दुग्ध उत्पादों के विपणन के लिए राज्य स्तरीय महासंघ पर काम करता है। यह ढांचा किसानों को समूची मूल्य शृंखला में हिस्सेदारी देता है। इसकी जड़ें गुजरात में खेडा के किसानों और एक एकाधिकारवादी निजी कंपनी के बीच 1940 के दशक में कीमतों को हुए टकराव में निहित हैं।

आज भारत दुनिया में सबसे बड़ा दुग्ध उत्पादक बन चुका है और डेरी क्षेत्र के कुल उत्पादन का मूल्य चावल एवं गेहूं के सम्मिलित मूल्य से करीब 50 फीसदी अधिक है। दूध की प्रति व्यक्ति प्रतिदिन उपलब्धता 1968-69 के 112 ग्राम से बढ़कर 2018-19 में 394 ग्राम तक पहुंच चुकी है। दूध एवं दुग्ध उत्पादों का बाजार स्थिर है जो बदलते मौसम के साथ कीमतों में पडऩे वाले महज 0.6 फीसदी फर्क से जाहिर भी होता है। दुग्ध सहकारी समितियां एवं उनके राज्य स्तरीय महासंघ (गुजरात का अमूल एक स्थापित ब्रांड बन चुका है) आज बाजार के अगुआ हैं और बहुराष्ट्रीय कंपनियों की तुलना में प्रसंस्कृत दुग्ध उत्पादों के बाजार की बड़ी हिस्सेदारी रखते हैं।

भारत जैसे विविधतापूर्ण देश के लिए कोई भी एक विकल्प आदर्श नहीं हो सकता है। सार्वजनिक क्षेत्र की खरीद करने वाली एजेंसियां, निजी क्षेत्र के थोक विक्रेता खरीदार और सहकारी एवं किसान उत्पादक कंपनियों तीनों की ही जरूरत है। सार्वजनिक खरीद व्यवस्था फसली पैटर्न में बदलाव या तकनीकी उन्नति के मकसद से हरेक राज्य में कीमत की गारंटी देने के लिए अलग-अलग रूपों में चलाई जा सकती है। जल्द खराब होने वाले उत्पादों के लिए सहकारी समितियों या किसान उत्पादक कंपनियों को बढ़ावा दिया जा सकता है ताकि प्रसंस्करण कर कचरे को कम किया जा सके। निजी थोक विक्रेता अभी की तरह बाकी क्षेत्रों में काम जारी रख सकते हैं।

तीनों विकल्पों की प्रासंगिकता का मतलब है कि केंद्र को यह मानना होगा कि कृषि उत्पादों के विपणन का तरीका संविधान एवं व्यावहारिक कारणों से राज्यों पर ही छोड़ देना चाहिए। भारत में कृषि अर्थशास्त्र की विविधताओं को ध्यान में रखते हुए ऐसा करना जरूरी भी है।

केंद्र कृषि उत्पादों के अंतरराष्ट्रीय व्यापार संबंधी नीति के मामले में प्रभावी भूमिका निभा सकता है। हालांकि इस मामले में उसका अब तक का प्रदर्शन बहुत उत्साह नहीं जगाता है। वह कई बार निर्यात पाबंदियों में ढील देने या आयात को मंजूरी देने में गलती कर जाता है। कृषि उत्पादों में मुक्त व्यापार बंदिशों वाले मौजूदा वैश्विक परिवेश में मुमकिन नहीं दिखता है। लेकिन ऐसी नीति संभव है जो कृषि उत्पाद निर्यात के लिए मुक्त व्यापार की इजाजत दे और केवल अपवाद रूप में ही बंदिशें लगाए।

भारतीय कृषि अर्थव्यवस्था की विविधता दर्शाने वाली और छोटे किसानों एवं कम आय वाले उपभोक्ताओं के हितों को ध्यान में रखते वाली कृषि विपणन व्यवस्था बनती है तो वह सक्षमता, समता एवं राष्ट्रीय सुरक्षा के लिहाज से कारगर भी होगी।

कोविड टीकाकरण शुरू होने के बाद न्याय क्षेत्र का परिदृश्य ?

कोरोनावायरस के कारण जो अनिश्चितता पैदा हुई, उसके चलते महीनों तक अर्थशास्त्रियों, चुनाव नतीजों का पूर्वानुमान जताने वालों और भविष्य बताने वालों को खूब तवज्जो मिली। यह बात तो निश्चित है कि निकट भविष्य में हालात सुधरने वाले नहीं हैं और उनकी मांग बरकरार रहेगी। इस संदर्भ में न्यायपालिका की बात करें तो वह अपेक्षाकृत बेहतर स्थिति में रहेगी। यह अच्छा होगा या बुरा, वह बाद की बात है। उदाहरण के लिए यह निश्चित है कि तीन महीनों में सर्वोच्च न्यायालय को नया मुख्य न्यायाधीश मिलेगा और शायद एक ऐसा दौर आएगा जहां परेशानियां कम होंगी।

लॉकडाउन के 11 महीने बाद धीरे-धीरे अदालतों में भौतिक रूप से कामकाज आरंभ हो जाएगा। मुंबई और उत्तराखंड जैसे कुछ उच्च न्यायालय पहले ही इस दिशा में आगे बढ़ चुके हैं। अधिकांश अदालतों ने आभासी सुनवाई के साथ काम करना सीख लिया है। हालांकि पिछले सप्ताह सर्वोच्च न्यायालय के कुछ न्यायाधीश सुनवाई में तकनीकी बाधाओं से इतने नाराज हुए कि उन्होंने अपने आदेश में भी इसे दर्ज किया।

गत वर्ष मार्च में लॉकडाउन के बाद विधिक पेशे के एक बड़े तबके और वादियों ने यह पाया कि आभासी अदालतें लाभदायक हैं और उन्हें व्यवस्थित करने की आवश्यकता है। अधिवक्ता एक ही दिन दुनिया की कई अदालतों में बहस कर सकते हैं और वादियों को समय और पैसा खर्च करके अदालतों में नहीं पहुंचना होता है। ऐसे में एक सुरक्षित पूर्वानुमान यह है कि सामान्य अदालतों के साथ-साथ आभासी अदालतें भी बरकरार रहेंगी।

अदालतों और पंचाटों ने महामारी के दौरान यथास्थिति बरकरार रखने और स्थगन आदेश जैसे अंतरिम आदेश देना जारी रखा। उन्होंने प्रतिबंधात्मक नियमों को भी शिथिल किया था। अब वे धीरे-धीरे मानकों को ऊंचा कर रहे हैं, जैसा कि इलाहाबाद उच्च न्यायालय ने गत सप्ताह किया। दूसरी ओर जिन लोगों को नियमों की शिथिलता का लाभ मिला उनके इर्दगिर्द घेरा अब तंग होगा।

अतीत के प्रदर्शन पर नजर डालें तो यह माना जा सकता है कि वित्त मंत्री निर्मला सीतारमण का बजट न्यायपालिका के लिए बहुत मामूली खुशियां लेकर आएगा। न्यायाधीश लंबे समय से यह कहते रहे हैं कि अदालतों और न्यायालयों का बुनियादी ढांचा फंड की कमी से जूझ रहा है। न्यायपालिका को दशकों से 2 फीसदी की हिस्सेदारी मिल रही है। चूंकि वीडियो कॉन्फ्रेंस और लाइव स्ट्रीमिंग में अधिक निवेश की आवश्यकता है इसलिए हालात का खराब से खराब होना तय है। ऐसे में एक और बात बिल्कुल तय है कि सैकड़ों कैदी बिना जमानत या परीक्षण के जेलों में बंद रहेंगे। देश की जेलों में क्षमता से 14 प्रतिशत अधिक कैदी बंद हैं। हर तीन में से दो कैदी परीक्षणाधीन हैं। इसके अलावा सर्वोच्च न्यायालय का वह हालिया आदेश भी फलीभूत नहीं हो पाएगा जिसमें उसने कहा है कि सांसदों और विधायकों (कुल 4,442) के ऊपर चल रहे आपराधिक प्रकरणों को छह महीने में निपटाया जाए। इसके अलावा यह अनुमान भी उचित ही जताया जा सकता है कि लॉकडाउन के महीनों के दौरान सामने नहीं आए मामले अब तेजी से उभरेंगे।

इस बात की काफी संभावना है कि सर्वोच्च न्यायालय में सरकार को जीत मिलने का सिलसिला जारी रहेगा। अयोध्या, आधार, जम्मू कश्मीर में संचार सेवाओं को ठप करना और सेंट्रल विस्टा परियोजना आदि इस बात का संकेत हैं। अनुच्छेद 370 का प्रश्न, चुनावी बॉन्ड और नोटबंदी आदि मामले भी ऐसा ही संकेत देते हैं। देश के इतिहास मेंं इससे पहले कभी न्यायाधीशों से इतने संवेदनशील मामलों का निर्णय करने को नहीं कहा गया। मिसाल के तौर पर कश्मीर (140 याचिकाएं लंबित), नागरिकता (संशोधन) अधिनियम, आरक्षण में आरक्षण, लव जिहाद आदि इसके उदाहरण हैं। उच्च न्यायालयों के समक्ष सुर्खियों वाले मामलों का पेश होना जारी रहेगा। न्यायिक निर्णयों में मानवाधिकारों को लेकर बातें लंबी होती जाएंगी, हालांकि याचिकाओं में राहत मिलने की आशा कम है।

सरकार को मिलने वाले न्यायिक लाभ ने एक नया रुझान शुरू किया है जिसमें सामान्य लोगों ने न्यायाधीशों के बारे में अपनी राय बनानी शुरू कर दी है। इसका असर न्यायपालिका को लेकर लोगों के मन में बनी पारंपरिक छवि और आदर को नुकसान पहुंचाया है। इससे पहले न्यायाधीशों की आलोचना कानूनविदों और ऐसे टीकाकारों तक सीमित थी जो भाषा के इस्तेमाल में सावधानी बरतते थे। अब तो कार्टून बनाने वाले और ट्विटर पर भी उनकी आलोचना शुरू हो गई है। आने वाले सप्ताह में उनमें से कुछ को न्यायिक अवमानना के लिए न्यायालय में हाजिर भी होना पड़ेगा। आशा करनी चाहिए कि न्यायाधीश और महान्यायवादी हंसी-मजाक को लेकर भी लक्ष्मण रेखा तय करेंगे।

कुल मिलाकर देखा जाए तो देश उच्च न्यायपालिका में बदलाव की उत्सुकता से प्रतीक्षा कर रहा है। सर्वोच्च न्यायालय के मुख्य न्यायाधीश बनने के वरीयता क्रम में शीर्ष पर मौजूद न्यायमूर्ति एन वी रमण ने हाल ही में कहा कि एक न्यायमूर्ति को निर्भीक, साहसी और दबाव का सामना करने में सक्षम होना चाहिए। अब यह उन निर्भर होगा कि वे जनता के मन में बनी गलत धारणाओं को खत्म करें। जनता चाहती है कि सर्वोच्च न्यायालय एक बार फिर महान बने।

अभिव्यक्ति के सामने

हाल ही में डिजिटल माध्यम के एक मंच पर आई वेब शृंखला ‘तांडव’ पर विवाद अब भी थमने के आसार नहीं नजर आ रहे हैं। हालांकि इस शृंखला से उन दृश्यों को हटा दिया गया है, जिन्हें लेकर हंगामा चल रहा है। उसके निर्देशक ने इसके लिए माफी मांगी। इस मामले में निर्देशक और अन्य कुछ लोगों को अदालत से अग्रिम जमानत लेनी पड़ी। हालांकि इसके बाद भी कुछ संगठन सिरीज और उसके निर्माताओं के खिलाफ अदालत में जाने की बात कह रहे हैं।

गुरुवार को कई जगहों से इस मसले पर प्राथमिकी दर्ज कराने की खबरें आर्इं। बल्कि उत्तर प्रदेश की पुलिस सिरीज के निर्देशक और लेखक के घर पूछताछ के लिए पहुंची और नहीं मिलने पर नोटिस चिपका दिया। गौरतलब है कि ‘तांडव’ के कुछ दृश्यों को लेकर कुछ संगठनों ने यह आपत्ति जताई कि इससे उनकी धार्मिक भावनाओं को चोट पहुंची है। इसके बाद कई अन्य संगठन भी इसमें कूद पड़े।

दरअसल, किसी फिल्म के कुछ दृश्यों से आस्था के आहत होने या धार्मिक भावना के चोट पहुंचने का यह कोई नया मामला नहीं है। लेकिन हर बार इस तरह के मौके पर यह सोचने की जरूरत महसूस होती है कि कला माध्यमों में किसी विषय की अभिव्यक्ति की सीमा क्या है और क्या उसे नियंत्रित किया जाना चाहिए। अगर किसी फिल्म में धार्मिक भावनाओं के आहत करने के मकसद से कोई दृश्य परोसा गया है तब उसकी व्याख्या होनी चाहिए और उसे उसके दर्शकों के विवेक पर छोड़ दिया जाना चाहिए कि वे फिल्म के बारे में क्या राय रखते हैं।

इस तरह से कोई समाज अपनी लोकतांत्रिकता भी बचा लेता है और अपनी समझ को और ज्यादा स्पष्ट बनाता है। मगर विडंबना यह है कि इस तरह के विश्लेषण से गुजरने के बजाय कुछ संगठन सीधे ही आपत्ति और विरोध का झंडा उठा लेते हैं, हिंसक रुख अख्तियार कर लेते हैं और इस तरह विचार और विश्लेषण की किसी भी प्रक्रिया में लोगों के जाने की गुंजाइश खत्म कर देते हैं। जबकि यह प्रक्रिया किसी भी व्यक्ति और समाज को परिपक्व बनने में मददगार होती है।

बहरहाल, इस विवाद के बाद अब संभव है कि सरकार इस तर्क पर फिल्में और दूसरी सामग्री डिजिटल मंचों पर लोगों को मुहैया कराने वाले माध्यम में दखल दे कि किसी को अराजक तरीके से कोई चीज दिखाने की एक सीमा है। मगर सवाल है कि अगर यह रास्ता आगे बढ़ा तो नियंत्रण की यह सीमा कहां तक जा सकती है। जहां तक अदालत का सवाल है, तो करीब तीन दशक पहले ही एक फिल्म ‘ओरे ओरु ग्रामाथिले’ के मसले पर सुप्रीम कोर्ट ने अभिव्यक्ति की आजादी के पक्ष में अपना फैसला दिया था। अफसोस की बात यह है कि हमारा जो समाज अब तक अलग-अलग विचारों का संगम रहा है और यही हमारे लोकतंत्र की खूबसूरती रही है, उसमें अब अभिव्यक्तियों के सामने कई तरह की चुनौतियां खड़ी हो रही हैं।

कला-माध्यमों में किसी विषय-वस्तु को संप्रेषित करने के लिए जिन बिंबों और प्रतीकों का सहारा लिया जाता है, उसका मकसद आमतौर पर आस्था या धार्मिक भावनाओं को चोट पहुंचाना नहीं होता है। लेकिन अगर कभी किसी को ऐसा महसूस होता भी है तो इसका सबसे बेहतर समाधान विवेक और समझदारी के साथ विषय पर बहस और विचार करना है। यह एक दीर्घकालिक विचार-प्रक्रिया की भी शुरुआत करता है। विडंबना यह है कि इसके बजाय बहुत सारी जरूरी बातें हंगामे और शोर में दब कर रह जाती हैं और उन पर लोगों को सोचने और अपने विवेक के आधार पर राय बनाने में मदद नहीं मिलती है।

सामाजिक गठन और वृधावस्था की चुनौतियां

वृद्धावस्था की चुनौतियों को लेकर अनेक प्रश्न उठते हैं। कैसे हो उनकी देखभाल, सेवा और उपचार? यों विकास की अवस्थाओं में वृद्धि और ह्रासात्मक दोनों प्रकार के परिवर्तन होते हैं, पर वृद्धावस्था वह अवस्था है, जिसमें ह्रासात्मक परिवर्तनों का प्रभाव ही प्रमुखता से परिलक्षित होता है। इसमें व्यक्ति के शारीरिक एवं मानसिक दोनों प्रकार के कार्यों पर प्रभाव पड़ता है। नतीजतन, व्यक्ति को वृद्धावस्था में अनेक प्रकार की चुनौतियों और समस्याओं का सामना करना पड़ता है। भारत के कुछ परिवारों में निश्चित तौर पर प्रेमचंद की बूढ़ी काकी आज भी रहती हैं। ये अमूमन ऐसे मध्यवर्गीय परिवार होते हैं जो आगे की ओर देखते हुए अपनी संतानों के लिए हर सुख-सुविधा उपलब्ध कराने के लिए प्रयासरत रहते हैं। अपनी संतानों पर निवेश करते हैं और बूढ़ी काकी के अंत का इंतजार करते हैं, चाहे इस उपेक्षा से वे मानसिक रोगी या अवसादग्रस्त ही क्यों न हो जाएं। इन बूढ़ी काकियों की पुत्रियां अगर आत्मनिर्भर हुईं और सही मायने में शिक्षित-दीक्षित हुईं, तो रूढ़िवादी सोच और परंपरा से ऊपर उठ कर अपने दायित्वों को अवश्य पूरा करती हैं। उल्लेखनीय है कि हिंदू उत्तराधिकार संशोधन अधिनियम के तहत बेटियों को पैतृक संपत्ति में इस शर्त के साथ अधिकार दिया गया है कि बेटियां भी बेटों की तरह ही अपने वृद्ध माता-पिता की देखभाल करेंगी।

समाज का सूक्ष्म विश्लेषण करते हुए एक अन्य स्थिति का भी हवाला दिया जा सकता है, जहां एक नौकरी-पेशा अविवाहित लड़की स्वेच्छा से अपनी जमा पूंजी अपने वृद्ध माता-पिता की देखभाल में लगा देती है, पैतृक संपत्ति में अधिकार का दावा भी नहीं करती और अपने भाई-भतीजों के नाम अपनी संपत्ति की वसीयत तक कर देती है। ऐसी लड़कियों की इच्छा होती है कि जिस प्रकार सरकार ने बच्चों की देखभाल के लिए सवैतनिक अवकाश की व्यवस्था की है उसी प्रकार ऐसे माता-पिता की देखभाल के लिए भी सवैतनिक अवकाश का कानूनी प्रावधान किया जाना चाहिए। आंकड़ों के मुताबिक भारत में एक करोड़ से ज्यादा वृद्ध आबादी है, जिसमें विवाहित, अविवाहित, तलाकशुदा, विधवा, विधुर एवं एकल वृद्ध के अपने अलग-अलग आंकड़े हो सकते हैं। अगर राष्ट्रीय स्तर पर बने कानूनों की बात करें तो सर्वप्रथम संविधान की चर्चा प्रासंगिक है, जिसमें अनुच्छेद 41 के तहत राज्य के नीति निर्देशक तत्त्व राज्य के ऊपर यह कर्तव्य अधिरोपित करते हैं कि वह अपनी आर्थिक क्षमता और विकास की सीमाओं के भीतर ऐसे प्रभावी उपायों को अपनाएगा, जिसमें वृद्धावस्था, बीमारी और निर्योग्यता जैसे मामलों का सार्थक समाधान निकाला जा सकेगा।

दंड प्रक्रिया संहिता 1973 की धारा 125 (1)(2) के अंतर्गत प्रावधान है कि अगर माता-पिता स्वयं अपनी देखभाल करने में सक्षम नहीं हैं, तो उनके बेटा-बेटी उनकी देखभाल करेंगे। हिंदू दत्तक ग्रहण एवं भरण-पोषण अधिनियम भी बेटे और बेटियों पर अपने माता-पिता के भरण-पोषण का दायित्व अधिरोपित करता है। इसके अलावा वर्ष 2007 में माता-पिता एवं वरिष्ठ नागरिकों की देखभाल और भरण-पोषण के लिए एक विशेष अधिनियम बनाया गया, जिसके माध्यम से उनका कल्याण सुनिश्चित करने का प्रयास किया गया। इस अधिनियम के अनुसार वरिष्ठ नागरिक वह है जिसकी उम्र साठ वर्ष से अधिक है। पर एक अभिभावक, अभिभावक है, भले वह साठ की उम्र का न हो। यानी बच्चे अपने अभिभावकों के भरण-पोषण के लिए उसी प्रकार जिम्मेदार होंगे चाहे उनकी उम्र कितनी भी हो।

ऐसा न करने पर इस अधिनियम के अंतर्गत दंड और जुर्माने की भी व्यवस्था की गई है। पर अन्य अधिनियमों की तरह इसकी भी अपनी कुछ सीमाएं हैं, जैसे यह सिद्ध करना कि कौन लोग जानबूझ कर अपने माता-पिता का भरण-पोषण नहीं कर रहे हैं? इसको कैसे सिद्ध किया जाएगा? और यह कि अगर बच्चों को अभियुक्त माना जा रहा है, तो क्या आपराधिक विधि के वे सिद्धांत जो अभियुक्त की निर्दोषिता, संदेह से परे दोष की सिद्धि, और संदेह का लाभ अभियुक्त को दिए जाने की बात करते हैं, वे भी लागू किए जाएंगे? यह अधिनियम एक तरफ तो कहता है कि जो माता-पिता या वरिष्ठ नागरिक अपने स्वयं की आय से अपना भरण-पोषण नहीं कर पा रहे हैं, उनके भरण-पोषण की जिम्मेदारी उनके बच्चों पर होगी और दूसरी तरफ वृद्धजनों के जीवन और संपत्ति के संरक्षण के लिए उपयुक्त प्रावधान की बात भी की गई है। एक सर्वाधिक महत्त्वपूर्ण बात, जिसकी अनदेखी इस अधिनियम में की गई है, वह यह कि ऐसे भी वरिष्ठ नागरिकों की संख्या बहुत ज्यादा है, जो साठ वर्ष की उम्र पर सेवानिवृत्त होकर अपने कार्यस्थल को छोड़ कर घर आते हैं, जहां उनके वृद्ध माता-पिता रह रहे होते हैं।

ऐसे में प्रश्न उठता है कि ऐसे वरिष्ठ नागरिक अपने वृद्ध माता-पिता का भरण पोषण कैसे करेंगे? किन विधिक दायित्वों के अधीन होंगे? क्या उन्हें भी जेल भेज दिया जाएगा? ऐसे में सवाल है कि जब समाज में परिवर्तन अत्यंत तीव्र गति से होने लगे, दुर्खीम का यांत्रिक समाज सावयवी समाज में बदलने लगे और संयुक्त परिवारों का मजबूरन विघटन होने लगे, छोटे परिवार की संकल्पना में वृद्ध माता-पिता की अवधारणा ही समाप्त होने लगे तो संवेदनाओं के क्षरण पर कानूनों का लेपन काम नहीं करता। यहां यह भी उल्लेखनीय है कि छोटे परिवार या हम दो हमारे दो की संकल्पना परिवार नियोजन से संबंधित है, परिवार कल्याण से नहीं। परिवार कल्याण में कम से कम तीन पीढ़ियों का समावेशन अपरिहार्य है, जिसमें माता-पिता, पति-पत्नी और बच्चों की इकाई अनिवार्य रूप से शामिल हो। इसके अलावा प्रिंट मीडिया, इलेक्ट्रॉनिक मीडिया, सिनेमा और कहानियों के साथ छोटे-छोटे समूहों में वृद्ध जनों को भी यह समझाने की आवश्यकता है कि उन्हें अपने बच्चों की नौकरी की दशाओं और शर्तों को समझते हुए उनके साथ उनके कार्यस्थल पर जाकर रहने में भी गुरेज न हो। कई बार समस्याएं केवल इसलिए उत्पन्न हो जाती हैं कि दो अलग-अलग जगहों पर परिवार रहने लगते हैं, जिसकी वजह से देखभाल में परेशानी आती है। इसके अलावा आवश्यकता इस बात की भी है कि चाहे संपत्ति हो या न हो, माता-पिता तो माता-पिता ही होते हैं, वे न जीवन भर साथ रहेंगे, न दुबारा मिलेंगे, और न उनका कभी कोई विकल्प होगा। भारतीय परंपरा में माता-पिता और सास-ससुर, बेटे, दामाद और बेटी, बहू जैसे रिश्ते दो परिवारों को जोड़ने के लिए, उनके सुख-दुख को साझा करने के लिए, और एक-दूसरे का संबल बनने के लिए बनाए गए हैं। उसमें इस वैचारिक गिरावट को कतई जगह नहीं दी जानी चाहिए कि बेटा-बहू ही अपने माता-पिता की जिम्मेदारी उठाएंगे।

सांपत्तिक उत्तराधिकार के अपने दायरे हैं, और रिश्तों की डोर थामने के अपने भाव हैं। जब समाज अपने सामाजिक और नैतिक दायित्वों से विमुख होता है, तो विधिक दायित्व अधिरोपित किए जाते हैं, जिसमें सदैव कुछ न कुछ कमियां बनी रहती हैं, इसलिए वृद्धजनों के उम्र के मनोवैज्ञानिक विभाजन के आधार पर कानूनों में यथोचित परिवर्तन किए जाने की आवश्यकता है। जिस प्रकार बच्चों की देखभाल के लिए केंद्र बनाए जा रहे हैं उसी प्रकार वृद्धजनों की देखभाल हेतु केंद्र बनाए जाने की आवश्यकता है, ताकि नौकरी-पेशे वाले दंपत्ति भी अपने बच्चों को या माता-पिता को जैसी स्थिति हो वहां रख सकें। इसके अलावा संवादहीनता को खत्म करने की पहल होनी चाहिए। सामंजस्य स्थापित करने की समझ सभी के अंदर विकसित होनी चाहिए, ताकि भारतीय समाज की सर्वाधिक महत्त्वपूर्ण संस्था परिवार पूरे दमखम के साथ चिर नवीन बनी रहे, इसमें न कभी कोई घुन लगे, न कोई दीमक। और भारत अपनी भारतीयता के साथ अपने संस्कारों के साथ अपने कल और आज के साथ नित नई ऊंचाइयों को प्राप्त कर सके।
