Biden Era Begins

May it revitalise democracy at home and rules based order in the world

President Joe Biden has taken office in a country looking strikingly different than it did on his predecessor’s Inauguration Day. Covid-19 has killed more than 4,00,000 Americans, with a big portion of the socio-economic toll attributable to federal mismanagement. The US has also abdicated its role as leader of the free world, squabbled with democratic allies while keeping authoritarian populists everywhere chuckling at its post-truth misadventures. This month’s attack on the Capitol highlighted how much domestic polarisation has poisoned the polity. In short, the new administration really has its work cut out devising correctives at multiple levels. It is a mighty challenge.

But democracy is premised on elections making a difference. The promise of a new dawn is both powerful and credible. The diversity, sobriety and experience of the incoming cabinet strongly suggest that they have a good measure of the problems at hand, and the ambition to attempt necessary solutions. One clear aspirational target is 100 million doses of Covid-19 vaccine in the first 100 days. Then, Janet L Yellen, who will be the new treasury secretary and America’s top economic diplomat, has articulated as priorities both addressing the economic damage of the pandemic at home and repairing relationships with various allies abroad to take on China’s “illegal, unfair and abusive practices” collectively.

After the hollowing of institutions and anarchic flailings seen in the Trump years, it will indeed take solid international cooperation to revitalise the global rules based order. Incoming secretary of state Antony Blinken has indicated a welcome pragmatism in saying, “We’ll engage the world not as it was, but as it is.” Pragmatically speaking, rebukes on human rights issues for India may be part and parcel of Washington’s liberal revival, alongside the many Indian-Americans in the Biden team.

With Blinken having described India as a “bipartisan success story”, there will be overall continuity in the US view of India as balancing Chinese power in Asia. So progress on defence ties should continue apace. But as its suspension of India’s benefits under the Generalised System of Preferences showed, all too often the Trump administration took disproportionate economic swipes against friends. A more strategic and sensible approach is expected from the Biden administration. Against this economic backdrop, India should not just aim at status quo ante but a comprehensive trade agreement. We should let ambition, rather than trepidation and indecision, be our guide.

Democracy’s killjoys

Fear kills creativity, enterprise, rationality. Netas abusing power to fix filmmakers are killing OTT

The political onslaught emanating from multiple states against Tandav lay alarmingly bare the growing propensity to censor the OTT platform. Forgetting the “if you don’t like it, don’t watch it” dictum articulated often by the Supreme Court, the overdrive by offence seekers is unconvincing and hypocritical. To the subscription-based, mature OTT audience that frowns upon this babysitting by thin skinned netas, Tandav is merely a show that can be safely categorised in the political thriller genre. Hairsplitting over hurt sentiments isn’t their idea of entertainment. So why are netas writhing in faux indignation?

Since the discerning audience is too vast and can’t be schooled in what netas think is sanskar, targeting creators is the default strategy. Threats of criminal cases from UP, MP and Haryana amid ban calls have overwhelmed Tandav’s makers. With little support from the industry and no certainty of judicial respite against political might, they have been forced to engage with the Union I&B ministry, issue apologies and make corrections. This bullying of artists and creative expression doesn’t serve India well, culturally or commercially.

Cinema is a source of immense soft power for India. The Bollywood-centred OTT industry is booming, generating jobs and new experiential spaces for creators and consumers. However, censorship, harassment and governmental overreach endanger this India story too, after other India stories have come off the rails. The platform could soon relapse into mediocrity, benefiting foreign content already finding huge takers here. The power of the state expended in wrong directions recalls the initial promise of sectors like telecom, banking and aviation, now stymied. Islamised polities – where portrayals of gods get equated with blasphemy – aren’t us. We are the land where the sacred and profane have coexisted and jostled for space in art, culture and yes, religious practices for centuries

Get On With Our Data Protection Law

Facebook is accountable for many sins of omission and commission, and whether buying WhatsApp to pre-empt competition is one of them is being determined by a judicial process in the US. Compared to these, WhatsApp’s decision to change its user agreement to make it clear that it will share some data with Facebook properties is a minor infraction.Only the innocent fail to appreciate that when you get a service for free, you pay for it with your data. Google, for example, knows not only who you correspond with over mail and chat, but what your browsing habits are, where all you go, what your engagements are, as well. It targets its ads better, using this information, and makes more money.

Instead of crying about unilateral changes in the terms of service, what India needs to do is to put in place a reasonable law on protecting data. The European Union has the General Data Protection Regulation, which lays down clear-cut rules for protecting EU citizens’ data by any service provider.So, if WhatsApp’s user terms in Europe are less invasive of privacy than these are in India, the fault is in our failure, so far, to put in place a legal framework for data protection. If the rules that have to be followed are clear enough, it will be up to WhatsApp to decide whether to offer its services in India or not, instead of asking Indian users to either accept its new terms of use or sign out.In fact, WhatsApp is more rattled by mass defection of its users to rival Signal and Telegram messaging services than by legally unenforceable demands from the government. WhatsApp user groups are major sites of ideological indoctrination and this user base is confused whether to stay on or migrate, creating the uproar in social media.

As the recent publication of detailed WhatsApp messages of a celebrity journalist shows, data leaks happen not so much at the level of the messaging service as at the level of those that lay their hands on it. Yes, a data protection law is vital, but so is its rigorous enforcement beyond the realm of technology providers

Neighbour’s Pride

India stands to enhance its status as a responsible nation by supplying Covid vaccines to countries in South Asia.

Delhi’s decision to start sending vaccines to its neighbours in South Asia and other countries who have asked for it is the right step forward for India in its relations with its neighbours. It holds immense potential for a new kind of diplomacy in the region, one based on the common good and common interests of the South Asian people. As of now, India has shipped vaccines to Maldives, Bhutan, Bangladesh and Nepal, Myanmar and Seychelles, and will send them to other countries as well, including Sri Lanka and Afghanistan once approvals are available.

In doing so, Delhi is fulfilling its role as a responsible nation. With its advanced cutting-edge healthcare in the private sector, India attracts thousands of people from all countries of South Asia for medical treatment, at a fraction of what it costs in the West. Medicines manufactured in India have a good reputation across South Asia, even in Pakistan. It was natural then that governments in the region would look to vaccines manufactured in India, especially Covishield, developed by Oxford University and AstraZeneca, as a viable option. In their recent visits to neighbouring capitals, External Affairs Minister S Jaishankar and Foreign Secretary Harsh Shringla were asked about and gave assurances on the possibilities of vaccine supply from India. It is commendable that Delhi has moved quickly to deliver on commitments made to some of these countries. While the initial supplies have been sent free of cost, it is possible that countries may choose to enter into commercial agreements with the manufacturers for more quantities. The governments of Myanmar and Bangladesh are already in such negotiations.

For it to have any lasting value for Delhi’s relationships with its neighbours, it is best that India refrains from chest thumping a saviour complex. It would also be unwise to make this yet another contest between India and China. Vaccines are a global common good, and the demand for anti-COVID 19 immunisation across the world is massive. It is the responsibility of all countries with the capability to manufacture the vaccine to make it available internationally, and equitably to all. This is in every country’s interest, as building a global immunity to COVID19 is crucial to restoring the movement of people and goods across nations, to life as it was pre-pandemic. Even as they get supplies from India, expect South Asian countries to tie up part of their supplies from China, which has already entered into agreements to supply its vaccines to several countries in South East Asia and Pakistan. Eventually, it is the efficacy of each vaccine, irrespective of where it is made, that will matter.

Removing the Creases in housework Valuation

The work women perform for the family should be valued equally with men’s work during the continuance of marriage

“The wife owes service and labor to her husband as much and as absolutely as the slave does to his master. This grates harshly upon the ears of Christendom; but it is made palpably and practically true all through our statute books, despite the poetic fancy which views woman as elevated in the social estate; but a little lower than the angels,” said Antoinette Brown Blackwell, the first woman protestant minister of the United States.

We go a step ahead and glorify our women as goddesses but deny them equal rights, and under the latest Uttar Pradesh and Madhya Pradesh Ordinances, even the right to choose their spouses. Veteran actor Kamal Haasan and his Makkal Needhi Maiam party who recently promised salaries for housewives as a part of the party’s election manifesto, has revived the debate on the recognition of domestic work as work. What is the history of recognition of work by wives as work in the West? What have the legislative initiatives and judicial responses been in this regard?

The burden on women

As in the 2011 Census, while 159.85 million women stated household work as their main occupation, a mere 5.79 men referred to it as their main occupation. Justice N.V. Ramana in his crisp and authoritative concurring judgment of January 5, 2021 in Kirti and Another v. Oriental Insurance Company (https://bit.ly/35Yp3fD) has referred to the ‘Time Use in India-2019 Report’ of the National Statistical Office, Government of India (published in September 2020) which says that on an average, while Indian women spend 299 minutes a day on unpaid domestic services for household members, men spend just 97 minutes. Women also spend 134 minutes in a day on unpaid caregiving services for household members. A French government’s Commission on the Measurement of Economic Performance and Social Progress in 2009 that studied the situation in Germany, Italy, the United Kingdom, France, Finland and the U.S. drew similar conclusions. A report entitled ‘Women’s Economic Contribution through their Unpaid Work: A Case Study of India’ (2009) had estimated the economic value of services by women to be to the tune of a whopping $612.8 billion annually.

Justice Ramana not only listed the various activities women undertake but also referred to British economist Arthur Cecil Pigou who had lamented that the household work by wives is not taken into consideration in calculating national income.

Other judicial observations

In Arun Kumar Agrawal v. National Insurance Company (2010), the Supreme Court not only acknowledged the contribution of the housewives as invaluable but also observed that it cannot be computed in terms of money. Her gratuitous services rendered with true love and affection cannot be equated with services rendered by others. Similar observations were recently made in Rajendra Singh (2020). But then these cases dealt with a limited question of compensation under the Motor Vehicles Act to calculate the compensation for the death of homemakers, and not the recognition of a wife’s right in her husband’s income during the subsistence of marriage. Justice A.K. Ganguly in Arun Kumar Agrawal (2010) referred to Census 2001 that is carried out under an Act of Parliament and had categorised those who perform household duties — i.e. about 36 crore women in India — as non-workers and clubbed them together with beggars, prostitutes and prisoners (who are not engaged in economically unproductive work).

A hierarchical structure

For centuries, the English common law of marital status was starkly hierarchical. Forget the recognition of a homemaker’s work as work; she had no right even in respect of her work outside home. In fact till 1851, no country had recognised a wife’s right in earnings of any sort. If a housewife worked for pay in or out of the home, it was her husband’s prerogative to collect her wages. Strangely, seventh century Islamic law clearly mandates husbands to pay wives if they decide to suckle their children and entitle them to spend certain portions of husband’s money without his consent.

By the middle of the 19th century, some American States started reforming the common law of marital status by enacting the “Married Women’s Property Acts”. Some of these statutes exempted the wives’ real property from their husband’s debts. By 1850, the era of “earning statutes” started which granted wives property rights in earnings from their “separate” or “personal” labour. But the Census measures of the economy that appeared in the aftermath of the American Civil War characterised household work as “unproductive”, and, consistent with this gendered valuation of family labour, excluded women engaged in income-producing work in the household from the count of those “gainfully employed”. It seems that the Indian Census referred above followed this regressive precedent.

Separate spheres

Home and market for centuries were considered as two distinct spheres. The market was a male sphere of selfish competitiveness, but the home was celebrated as a female sphere, a site of spiritual uplift that offered relief from the vicissitudes of market struggle. American feminist economist Nancy Folbre rightly remarked, “the moral elevation of the home was accompanied by the economic devaluation of the work performed there”. The tendency of a “separate spheres” reasoning was thus to reinforce the legal ordering of family life and justify a husband’s control of family assets.

Subsequently, women demanded a right to own themselves, their earnings, their genius. Accordingly, in 1851, at the Worcester Convention, it was resolved: “that since the economy of the household is generally as much the source of family wealth as the labor and enterprise of man, therefore the wife should, during life, have the same control over the joint earnings as per husband, and the right to dispose at her death of the same proportion of it as he”. They finally achieved success when the equal rights of wives in the matrimonial property were recognised. The Third National Women’s Liberation conference, in England in 1972, for the first time, explicitly demanded payment of wages for the household work.

In India, the debate on joint property rights of married women is not new though we still do not have joint matrimonial property law. Veena Verma did introduce a private member Bill in 1994 entitled The Married Women (Protection of Rights) Bill, 1994. Her Bill provided that a married woman shall be entitled to have an equal share in the property of her husband from the date of her marriage and shall also be entitled to dispose of her share in the property by way of sale, gift, mortgage, will or in any other manner whatsoever. But in 2010, even registration of the National Housewives Association as a trade union was denied as domestic work was treated as neither trade nor industry.

A step and suggestion

The United Progressive Alliance government, in 2012, had proposed to make it mandatory for husbands to pay a monthly ‘salary’ to their wives. One cartoon had depicted a husband saying to his wife, “here is your salary for the month. However, ₹3355 has been deducted as you were at your parent’s home for a week.” Mr. Haasan should understand that the term ‘salary’ as monthly payment is indeed problematic as it indicates an employer-employee relationship, i.e., a relationship of subordination with the employer having disciplinary control over the employee. Wives do not deserve a master-servant relationship.

The United Nations’ Committee on the Elimination of Discrimination Against Women, in 1991, had recommended measurement and quantification of unremunerated domestic activities of women and their recognition in GDP so that the de facto economic contribution of women is highlighted. Matrimonial property laws do give women their share but only when the marital tie comes to an end. The time has come to insist that the work women perform for the family should be valued equally with men’s work during the continuance of marriage. If women become a little assertive, prenuptial marriage agreements can easily solve this problem with the insertion of the clause on wives’ right in husband’s earnings and properties being included in such agreements.

वॉट्सऐप-तांडव के विरोधाभासों के आगे देश की जीत

ऑस्ट्रेलिया के खिलाफ ऐतिहासिक जीत को लगान फिल्म के एक सीन से समझा जाए तो भारत और भी कई मोर्चों पर जीत सकता है। फिल्म में अंग्रेज टीम की बैटिंग के दौरान जब अनपढ़ ग्रामीण एक साथ गेंद का पीछा करते हैं, तब कप्तान आमिर खान सभी को अपनी जगह से कुशल फील्डिंग की प्रेरणा देकर मैच जितवा देते हैं। केशवानंद भारती मामले में 50 साल पहले इसी बात को संवैधानिक लहजे में सुप्रीम कोर्ट के जजों ने ‘शक्तियों का प्रथक्करण’ कहा था।पिछले कुछ दिनों से वेेबसीरीज ‘तांडव’ और वॉट्सऐप की डाटा चोरी पर एक्टिविस्ट, अफसर, नेता, मंत्री, संत्री, जज, संसदीय समिति, नीति आयोग सभी एक्टिव हैं। लेकिन गलत तरीके से हो रही फील्डिंग की वजह से डिजिटल कंपनियों का विजयी चौका इस बार फिर सीमा रेखा के पार हो जाएगा। ट्रम्प और उनके सहयोगियों के सोशल मीडिया अकाउंट पर एकतरफा प्रतिबंध से साफ है कि फेसबुक व ट्विटर जैसी सुपर पावर कंपनियां अब इंटरमीडियरी की कानूनी छूट की हकदार नहीं हैं। भारत तो इन कंपनियों का सबसे बड़ा बाजार है। इन कंपनियों से निपटने की रणनीति बनाने के पहले इन 9 विरोधाभासों को खत्म करना होगा:

1. ऐसी हर घटना के खुलासे के बाद संसदीय समिति इन कंपनियों के भारतीय प्रतिनिधियों से मीटिंग करती है। तो फिर उन्हीं भारतीय अधिकारियों को बुलाकर चेतावनी देने की बजाय, मंत्री द्वारा वॉट्सऐप के ग्लोबल सीईओ को पत्र लिखने का क्या औचित्य है?

2. क़ानून व आईटी मंत्री के पत्र में करोड़ों भारतीयों की डेटा सुरक्षा के अधिकार का जिक्र है। तो फिर चीनी एप्स की तर्ज पर इन कंपनियों पर भी दंडात्मक कार्रवाई हो जो करोड़ों भारतीयों का डाटा अमेरिका में नीलाम करते हैं।

3. वॉट्सऐप पेमेंट को रिजर्व बैंक ने अनुमति दी है, इसके लिए डाटा लोकलाइजेशन जरूरी है। भारत में डाटा रखने के वॉट्सएप के क्लेम सही हैं तो जवाबदेह अधिकारियों को आयरलैंड-अमेरिका में क्यों खोजना पड़ता है?

4. सरकार ने सवालों की तोप वॉट्सऐप पर दाग दी और वॉट्सऐप ने सुप्रीम कोर्ट में हलफनामा फाइल करके मामले को संविधान पीठ के हवाले कर दिया। कई मामलों में सुप्रीम कोर्ट ने कुछ महीनों में फैसला दिया है तो फिर इन मामलों में जल्द सुनवाई और फैसला क्यों नहीं होता?

5. जब सुप्रीम कोर्ट में ऐसा ही मामला तीन साल से संविधान पीठ के सम्मुख लंबित है तो फिर याचिका को ट्रांसफर करने की बजाय दिल्ली हाईकोर्ट ने याचिकाकर्ता के गले में ही डाटा के सवालों की घंटी क्यों बांध दी?

6. वॉट्सऐप के कई स्पष्टीकरण साथ मिलाकर देखें तो यह साफ़ है कि पिछले 4 सालों से फेसबुक के साथ डाटा शेयरिंग का गोरखधंधा चल रहा है। तो फिर इस मसले पर अभी तक सरकार और नियामक संस्थाएं चुप क्यों रहे?

7. नए नियमों को जल्द लागू करने के लिए सरकार ने सुप्रीम कोर्ट में कई हलफनामे दिए हैं। इसके बावजूद पिछले 2 सालों से आईटी इंटरमीडियरीज रूल्स के मसौदे को अभी तक नोटिफाई क्यों नहीं किया गया?

8. संविधान के अनुच्छेद 141 के अनुसार, सुप्रीम कोर्ट का फैसला देश का कानून बन जाता है। सुप्रीम कोर्ट के 9 जजों ने डेटा सुरक्षा और प्राइवेसी पर जो फैसला दिया था, उस पर 3 साल बाद भी प्रभावी अमल नहीं होने से सभी संस्थाओं को परेशान होना पड़ रहा है।

9. पब्लिक रिकॉर्ड्स एक्ट और सोशल मीडिया पॉलिसी के तहत सरकारी डाटा को विदेश भेजने के अपराध के लिए 3 साल की जेल हो सकती है। इसके बावजूद करोड़ों अफसर, मंत्री, जज सरकारी कामों में वॉट्सऐप, ज़ूम, गूगल, फेसबुक आदि इस्तेमाल क्यों और कैसे करते हैं?

2014 में वॉट्सऐप के 46.5 करोड़ यूजर्स से उसकी वैल्यू लगभग 19 अरब डॉलर थी। अब वॉट्सऐप में लगभग 200 करोड़ यूजर्स के साथ इसकी वैल्यू 90 अरब डॉलर मान सकते हैं। इसमें भारत के 40 करोड़ लोगों की वजह से फेसबुक को किए जा रहे डाटा ट्रांसफर की वैल्यू करीब 18 अरब डॉलर (1.4 लाख करोड़ रु.) बैठती है। एक कंपनी से दूसरी कंपनी को होने वाले डाटा ट्रांसफर पर कंपनी कानून व आयकर कानून के तहत टैक्स लगाने का नियम है। इसे लागू करने के लिए नए आम बजट में और ज्यादा सटीक प्रावधान होने चाहिए।

2020 तक भारत को वैश्विक शक्ति बनाने का पूर्व राष्ट्रपति डॉ कलाम का विजन तो साकार हुआ नहीं। अब नए दशक में अधूरे एजेंडे पूरा करने के लिए पूरे देश को मिलकर 20-20 मैच खेलना होगा। वॉट्सऐप विवाद से सबक लेकर फायर फाइटिंग की बजाय सोशल मीडिया, ओटीटी, एआई, स्टार्टअप, बिटकॉइन, गेमिंग ऐप, लोन ऐप जैसे भारी-भरकम प्रकल्पों को बढ़ावा देने के साथ उनके आर्थिक, विधिक और औपनिवेशिक पहलुओं की व्यवस्थित पड़ताल करनी होगी। गणतंत्र दिवस में रस्मी परेड के साथ संवैधानिक सिस्टम के सभी खिलाड़ी अपने कर्तव्यों के सम्यक निर्वहन के संकल्प को सार्थक बनाएं तो फिर विजय चौक की रोशनी से पूरा देश जगमगा उठेगा।

देश की सुप्रीम अदालत का कार्यपालिकीय हस्तक्षेप

किसान आंदोलन से जुड़े प्रश्नों पर सुनवाई के दौरान सुप्रीम कोर्ट से उम्मीद थी कि वह इन कानूनों की संवैधानिक पात्रता से जुड़े दो सवालों पर विचार करेगा। इनमें पहला सवाल यह है कि संविधान ने खेती के जिस विषय को राज्यों के अधिकार क्षेत्र में रखा है, उस पर केंद्र ने किस आधार पर कानून बना दिए? दूसरा सवाल है कि क्या वह विधायी प्रक्रिया कानून-कायदे के मुताबिक दुरुस्त थी, जिसके ज़रिए ये कानून संसद में पारित किए गए ? पहला मुद्दा संघात्मकता के औचित्य यानी केंद्र-राज्य संबंधों से जुड़ा था, और दूसरा विधि-निर्माण की किसी कार्रवाई के संविधान के हिसाब से सही होने या न होने से। कोर्ट ने इन दोनों पर गौर करने के बजाय कानूनों के कार्यान्वयन को स्थगित करने का आदेश दिया ताकि ‘किसानों की आहत भावनाओं पर मरहम लग सके और वे आत्मविश्वास और भरोसे के साथ बातचीत करने के लिए प्रोत्साहित हो सकें।’अदालत ने वार्ता के लिए एक कमेटी की व्यवस्था भी की। यहां सोचने की बात यह है कि कोर्ट ने संविधान के मुताबिक दायित्व का निर्वाह करने के बजाय वह काम करना क्यों तय किया जो कार्यपालिका का विषय है।

अदालत चाहती तो कृषि कानूनों को उस समय तक स्थगित कर सकती थी, जब तक वह उनकी संवैधानिकता सुनिश्चित करने पर विचार पूरा नहीं कर लेती। इसी दौरान वह सरकार को विवाद निबटाने से जुड़ी रणनीतियां भी सुझा सकती थी, लेकिन यह काम उसके लिए गौण होना चाहिए था। फिर, अगर ये दोनों चुनौतियां पहली नजर में अदालत को गौर करने काबिल न लगतीं तो वह उन्हें खारिज भी कर सकती थी। जिस तरह से कृषि-नीति पर फैसला करना सरकार का काम है, उसी तरह आंदोलन से कैसे निबटा जाए, यह सोचना भी सरकार का काम है, अदालत का नहीं।

दरअसल, आपातकाल के बाद से शुरू हुए जनहित याचिकाओं के सिलसिले के तहत देश की सर्वोच्च अदालत कार्यपालिका के काम में हाथ बंटाती हुई ज्यादा दिख रही है। जैसा कि हम जानते हैं कि सुप्रीम कोर्ट लोकतांत्रिक ढंग से निर्वाचित संस्था नहीं है। उसका प्राधिकार न्यायिका, विधायिका और कार्यपालिका के बीच संविधान द्वारा किये गए कर्तव्यों के बंटवारे की देन है। उसका काम निर्वाचित सरकारों द्वारा बनाए जाने वाले कानूनों की समीक्षा करने के साथ-साथ यह सुनिश्चित करना है कि सभी तरह की संवैधानिक शक्तियां वैधानिक सीमाओं में रहकर काम करें। केवल कृषि कानूनों की न्यायिक समीक्षा ही अदालत के पास विचारधीन नहीं है ,बल्कि कश्मीर से धारा 370 हटाए ,जाने और चुनावी बांड्स से संबंधित बेहद मह्त्वपूर्ण न्यायिक विवाद भी अदालत को सुनने है | लेकिन ,अभी तक इन पर विचार की शुरुआत भी नहीं हुई है |

उच्चतम और उच्च न्यायालयों के ऊपर पहले ही न्यायिक जिम्मेदारियों का जबरदस्त बोझ है। अब उन्हें सरकार की न सुलझाई जा सकने वाली उलझनों के हल का दायित्व भी उठाना पड़ रहा है। ऐसा अगर अपवादस्वरूप हो तो ठीक है। लेकिन, अब इस तरह के प्रकरण नियमित रूप से सामने आ रहे हैं। नागरिक समाज की शक्तियां भी सरकार से अपनी बात मनवाने में विफल होने पर तुरंत अदालत के हस्तक्षेप की मांग करती हैं। खुद केंद्र सरकार बार-बार अदालत की शरण में जाने वाली सबसे बड़ी संस्था बन चुकी है। इससे होता यह है कि न्यायपालिका की कार्य-संस्कृति पर अनौपचारिक ढंग से एक खास तरह का दबाव पड़ता है, और अदालत को ऐसे आदेश पारित करने पड़ते हैं जिनमें पहली नजर में कोई कानूनी नुक़्ता अभिव्यक्त होता हुआ नहीं दिखाई पड़ता। कृषि कानूनों पर उसका आदेश उसके इसी रुझान का ताज़ा नमूना है।

न्यूनतम समर्थन मूल्य का दुष्चक्र

सर्वोच्च न्यायालय द्वारा तीन कृषि कानूनों के अमल पर अस्थायी रोक के बावजूद किसान संगठनों का अड़ियल रवैया कायम है। यही कारण है कि किसान संगठनों के साथ सरकार की दसवें दौर की वार्ता भी बेनतीजा रही। किसान संगठन तीन नए कृषि कानूनों को रद करने और न्यूनतम समर्थन मूल्य यानी एमएसपी की गारंटी की मांग पर अड़े हैं। उनका सबसे ज्यादा जोर एमएसपी पर सरकारी खरीद की गारंटी पर है। इसमें दोराय नहीं कि कृषि उत्पादन बढ़ाने और किसानों को एक निश्चित आमदनी सुनिश्चित कराने में एमएसपी की अहम भूमिका रही है, लेकिन फिर एमएसपी वोट बैंक की राजनीति का जरिया बन गया। नेताओं में राजनीतिक हित लाभ के लिए ऊंचा एमएसपी घोषित करने की होड़ मच गई। यदि एमएसपी का सबसे ज्यादा फायदा पंजाब के किसानों को मिला तो उसके दुष्परिणाम भी उसे ही झेलने पड़े हैं। शायद इसी कारण किसान आंदोलन का केंद्र बिंदु भी पंजाब बन चुका है। एमएसपी की राजनीति को समझने के लिए पंजाब से बेहतर दूसरा उदाहरण नहीं हो सकता।

खाद्यान्न आत्मनिर्भरता हासिल करने के लिए किसानों को उन्नत बीजों के साथ रियायती दरों पर उर्वरकों, कीटनाशकों, रसायनों के इस्तेमाल के लिए प्रोत्साहित किया गया। इसके चलते पंजाब में परंपरागत फसलों को छोड़कर गेहूं-धान की खेती की जाने लगी। 1960-61 में पंजाब में गेहूं की खेती 14 लाख हेक्टेयर और धान की खेती 2.27 लाख हेक्टेयर में होती थी, जो 2019-20 में बढ़कर क्रमश: 35.08 लाख हेक्टेयर और 29.20 लाख हेक्टेयर तक पहुंच गई।रासायनिक उर्वरकों, कीटनाशकों आदि के अंधाधुंध इस्तेमाल से शुरू में तो पैदावार बढ़ी, लेकिन आगे चलकर इसमें गिरावट आनी शुरू हुई। उदाहरण के लिए पंजाब में 1972 से 1986 के बीच कृषि वृद्धि दर 5.7 फीसद रही जो 1987 से 2004 के बीच 3 फीसद और 2005 से 2014 के बीच घटकर महज 1.6 फीसद रह गई। एक ओर खेती की लागत बढ़ी तो दूसरी ओर उपज से होने वाली आमदनी घटी। परिणामस्वरूप किसान कर्ज के दुष्चक्र में फंसते चले गए। राजनीतिक दलों और सरकारों ने किसानों को कर्ज के दुष्चक्र से बाहर निकालने के लिए खेती को फायदे का सौदा बनाने के बजाय मुफ्त बिजली-पानी का पासा फेंका। इससे हानिकारक होने के बावजूद गेहूं-धान के फसल चक्र को बढ़ावा मिला। पंजाब में मुफ्त बिजली के पांसे का नतीजा 14 लाख नलकूपों के रूप में सामने आया। आज पंजाब के प्रत्येक नलकूप धारक किसान को सालाना 45,000 रुपये सब्सिडी मिलती है। इसका दुष्परिणाम यह हुआ कि पंजाब में भूजल तेजी से नीचे गिरा। भूजल की दृष्टि से आज पंजाब के 137 ब्लॉकों में से 110 ब्लॉक अति दोहित की श्रेणी में आ चुके हैं। इसके बावजूद पंजाब के किसान संगठन गेहूं-धान की सरकारी खरीद की गारंटी के लिए आंदोलन कर रहे हैं।

समर्थन मूल्य पर सरकारी खरीद ने पंजाब में जो समस्याएं पैदा की हैं, वही समस्याएं अब दूसरे राज्यों में भी फैल रही हैं, क्योंकि सरकारें गेहूं-धान की सुनिश्चित सरकारी खरीद के जरिये किसानों का वोट हासिल करना चाहती हैं। मध्य प्रदेश में गेहूं की सरकारी खरीद को मिले प्रोत्साहन का नतीजा है कि आज वह पंजाब को पीछे छोड़ते हुए पहले नंबर पर आ चुका है। 2019-20 में मध्य प्रदेश में गेहूं की रिकॉर्ड 1.27 करोड़ टन की सरकारी खरीद हुई। इसी तरह छत्तीसगढ़ सरकार ने 2020-21 के खरीफ सत्र के लिए 2500 रुपये प्रति क्विंटल के भाव से धान खरीदने का एलान किया है। गेहूं-धान को मिले सरकारी प्रोत्साहन का ही नतीजा है कि आज देश के गोदाम गेहूं-चावल से पटे पड़े हैं। 2020 के खरीफ सत्र से पहले देश में 280 लाख टन चावल का भंडार था, जो पूरी दुनिया को खिलाने के लिए पर्याप्त है।

एमएसपी पर सरकारी खरीद के चक्रव्यूह के कारण ही किसानों ने गन्ने की खेती को प्राथमिकता दी। इसका नतीजा चीनी के बंपर उत्पादन के रूप में सामने आया। इस साल सरकार ने 600 करोड़ रुपये की सब्सिडी देकर 60 लाख टन चीनी का निर्यात किया, क्योंकि अंतरराष्ट्रीय बाजार में चीनी की कीमत 22 रुपये किलो है, जबकि भारत में समर्थन मूल्य पर गन्ने की खरीद से चीनी 34 रुपये किलो पड़ रही है। गेहूं, धान और गन्ने की खेती को मिली गलत प्राथमिकता का नतीजा यह हुआ कि दलहन, तिलहन और मोटे अनाजों की खेती पिछड़ती गई, जिससे उनकी पैदावार तेजी से घटी। आज जिस देश के गोदाम गेहूं-चावल से भरे पड़े हैं, वही देश हर साल एक लाख करोड़ रुपये का खाद्य तेल और दालें आयात करता है। इसी तरह सरकार हर साल आठ लाख करोड़ रुपये का पेट्रोलियम पदार्थ आयात करती है। इस भारी भरकम आयात से बचने के लिए सरकार गेहूं, धान और गन्ने से एथनॉल उत्पादन को बढ़ावा देने की नीति पर काम कर रही है। इससे एक ओर पेट्रोलियम आयात पर निर्भरता कम होगी तो दूसरी ओर गेहूं, चावल के भंडारण में होने वाले भारी भरकम खर्च से बचा जा सकेगा।

सबसे बड़ी समस्या यह है कि छोटे किसानों के पास अपनी उपज बेचने का नेटवर्क नहीं है। इन किसानों की मंडी व्यवस्था तक पहुंच बनाने के लिए सरकार ने इलेक्ट्रॉनिक मंडी यानी ईनाम नामक पोर्टल शुरू किया है। इसके अलावा उत्पादन क्षेत्रों को खपत केंद्रों से जोड़ने के लिए किसान रेल चल रही है, जिससे बिना बिचौलिये के किसानों की उपज सीधे उपभोक्ताओं तक पहुंच रही है। केंद्र सरकार छोटे किसानों को किसान उत्पादन संगठन (एफपीओ) से भी जोड़ रही है, ताकि वे बाजार अर्थव्यवस्था से कदमताल कर सकें। इन एफपीओ को किसी कंपनी जैसी सुविधाएं मिल रही हैं। स्पष्ट है कि सरकार एक फसली खेती को बढ़ावा देने वाली एमएसपी से आगे बढ़कर बहुफसली खेती की ओर कदम बढ़ा रही है।

कमियां बरकरार

प्रधानमंत्री फसल बीमा योजना (पीएमएफबीवाई) की शुरुआत को पांच वर्ष पूरे हो चुके हैं। मौजूदा सरकार की प्रमुख योजनाओं में से एक इस योजना में फरवरी 2020 में आमूलचूल बदलाव भी किया गया लेकिन अभी भी कई गड़बडिय़ां बरकरार हैं। योजना में कई ढांचागत और प्रक्रियागत कमियां हैं और कई विशिष्ट गुण होने के बावजूद ये कमियां किसानों के लिए इसकी उपयोगिता को प्रभावित करती हैं। इसकी विशिष्टताओं में सबसे प्रमुख है जोखिम का व्यापक कवरेज। फसल बुआई के पहले से लेकर फसल कटने के बाद उपज के नुकसान तक की कवरेज रबी के लिए कुल बीमित राशि के 1.5 फीसदी प्रीमियम पर तथा खरीफ की फसल के लिए 2 फीसदी प्रीमियम पर की जाती है। प्रीमियम की शेष राशि का भार केंद्र और राज्य सरकारों द्वारा सब्सिडी के रूप में वहन किया जाता है। दुनिया में दूसरी कोई ऐसी फसल बीमा योजना नहीं है जो इस मामले में पीएमएफबीवाई का मुकाबला कर सके। इस योजना को किसान कल्याण की अनिवार्य योजना के रूप में पीएम-किसान (इस योजना में हर भूधारक को तीन किस्तों में 6,000 रुपये मिलते हैं) के समकक्ष बताने के बावजूद किसान इसे लेकर आकर्षित नहीं हुए।

बहरहाल इन चिंताओं में भी काफी दम है कि पीएमएफबीवाई योजना के तहत मिलने वाला हर्जाना आमतौर पर बहुत कम होता है और बहुत देर से मिलता है। इसकी बुनियादी वजह यह है कि राज्य योजना को चलाने के क्रम में अपने दायित्व पूरे करने में अक्षम साबित हो रहे हैं। वे अक्सर प्रीमियम सब्सिडी में अपना हिस्सा काफी देरी से और किस्तों में जारी करते हैं। इससे बीमा कंपनियों को किसानों को समय पर भुगतान करने में दिक्कत होती है। फसल कटाई प्रयोग के जरिये उत्पादन नुकसान के आंकड़े तैयार करना और रिमोट सेंसिंग और सैटेलाइट इमेजिंग तकनीक के जरिये किया जाने वाला प्रमाणन भी राज्य का दायित्व है और इसमें भी असंगत तरीके से देरी होती है। इससे दावे निपटाने में दिक्कत आती है। बीमा कंपनियों को पीएमएफबीवाई के बदले हुए स्वरूप के तहत अंतरिक्ष प्रौद्योगिकी आधारित आकलन के आधार पर दावों के निपटान की इजाजत है लेकिन यह व्यापक तौर पर अमल में नहीं लाया जा रहा है। इसके अलावा किसानों को 72 घंटे के भीतर बीमा कंपनियों को नुकसान की जानकारी देनी होती है। आमतौर पर किसी प्राकृतिक आपदा के बाद यही वह समय होता है जब किसानों को अपने खेतों में समय बिताना होता है ताकि वे फसल बचाने के लिए हरसंभव कदम उठा सकें। इसके अलावा किसानों को हर वर्ष अलग-अलग फसल के लिए अलग-अलग बीमा कंपनी से निपटना होता है। इससे बीमाकर्ताओं और उनके ग्राहकों के बीच ताल्लुकात नहीं बन पाते बल्कि एक तरह का अविश्वास उत्पन्न होता है जो बीमा कंपनियों के लिए नुकसानदेह होता है।

प्रथम दृष्ट्या ये बहुत छोटी बातें प्रतीत होती हैं लेकिन ये बीमा कंपनियों और किसानों दोनों के कामकाज में असहजता की वजह बनती हैं। कई कंपनियां जिन्होंने पहले भारी सरकारी सब्सिडी से आकर्षित होकर इस योजना के क्रियान्वयन में भागीदारी का विकल्प चुना था वे अब इससे दूरी बना चुकी हैं। इन मसलों को हल करना आवश्यक है ताकि इस योजना को किसानों के लिए एक ऐसी आकर्षक योजना के रूप में पेश किया जा सके जो सक्षम और किफायती ढंग से उनके जोखिम का संरक्षण करती है। इस हकीकत को दरकिनार नहीं किया जा सकता कि जलवायु परिवर्तन से जुड़े कारकों के कारण जहां भारतीय कृषि धीरे-धीरे संकटपूर्ण होती जा रही है, वहीं जोत का आकार घटने के साथ किसानों की जोखिम उठाने की क्षमता भी कम हो रही है। ऐसे में सही मायनों में किसानों के अनुरूप पीएमएफबीवाई उनके लिए वरदान साबित होगी।

महिला श्रम से आंख मूंदकर मुश्किल है सुधार

कोविड-19 महामारी से पहले साल 2019 में भारत के श्रम-बल में महिलाओं की भागीदारी 20.5 फीसदी थी, तो दक्षिण एशिया में 23.5 प्रतिशत। इसके मुकाबले पुरुषों की हिस्सेदारी क्रमश: 76 और 77 फीसदी थी। मध्य-पूर्व और उत्तरी अफ्रीका ही ऐसे क्षेत्र हैं, जहां श्रम-बल में महिलाओं की भागीदारी दक्षिण एशिया की तुलना में कम है। महामारी ने इस तस्वीर को और स्याह बना दिया है। महिला कामगारों पर बुरी तरह से चोट पड़ी है, क्योंकि वे उन क्षेत्रों में काम करती हैं, जो कोरोना से सबसे ज्यादा प्रभावित हुए हैं; अनौपचारिक अर्थव्यवस्था में वे पुरुषों की तुलना में अधिक काम करती हैं; या उनका प्रमुख काम घर संभालना माना जाता है। अंतरराष्ट्रीय श्रम संगठन का मानना है कि कोविड-19 के कारण दुनिया भर में पुरुषों की तुलना में महिलाओं के रोजगार पर 19 फीसदी अधिक खतरा है। चर्चिज अर्थशास्त्री अश्विनी देडपांडे ने भारत के लिए जो अनुमान लगाया है, उसके मुताबिक, अगस्त 2019 की तुलना में अगस्त 2020 में पुरुषों के बनिस्बत महिलाओं की रोजगार में वापसी 9.5 फीसदी कम हुई है। दुर्भाग्य से, बतौर मानव पूंजी लड़कियों के खोने का खतरा बढ़ गया है। भारत में विवाह संबंधी वेबसाइट पर पंजीकरण में 30 फीसदी की वृद्धि हुई है, तो दक्षिण एशिया में दो लाख अतिरिक्त लड़कियों को बाल विवाह के लिए मजबूर किया जा सकता है। जाहिर है, जेंडर की तरफ से आंखें मूंदकर आर्थिक सुधार के उपाय नहीं किए जा सकते। चार ऐसे क्षेत्र हैं, जहां सरकार की नीति लंबे समय से उलझे मुद्दों को सुलझाने में मदद कर सकती है।

पहला, शिशु देखभाल संबंधी मसलों का समाधान, क्योंकि इनसे रोजगार में स्त्रियों की हिस्सेदारी प्रभावित होती है। अनौपचारिक क्षेत्र की महिलाओं पर ध्यान दिया जाए, तो सबसे अधिक फायदा होगा। भारत, नेपाल, बांग्लादेश और पाकिस्तान में क्रमश: 76 फीसदी, 89 फीसदी, 71 फीसदी और 66 फीसदी महिलाएं घरेलू कामगार हैं या फिर छोटे-मोटे काम करती हैं। समन्वित बाल विकास योजना से उन्हें कुछ मदद जरूर मिलती है, पर दिन भर बच्चों की देखभाल इसमें संभव नहीं है। वैसे, सेल्फ इम्प्लॉयड वुमेन्स एसोसिएशन (सेवा) के ‘संगिनी केंद्रों’ पर पांच वर्ष की उम्र तक के बच्चों की देखभाल की सुविधा उपलब्ध है। इन केंद्रों पर अपने बच्चों को भेजने वाली स्त्रियों ने अपनी मासिक आमदनी में 500-1,000 रुपये वृद्धि की बात कही है। ऐसे केंद्रों का विस्तार करना चाहिए। इसी तरह, औपचारिक क्षेत्र में सरकार पितृत्व अवकाश को अनिवार्य बनाए, ताकि शिशु देखभाल के काम को पुरुष साझा कर सकें।

दूसरा, डिजिटल अंतर को दूर करना। वर्ष 2019 में भारत में कुल इंटरनेट यूजर्स में 67 प्रतिशत पुरुष थे और 33 फीसदी महिलाएं। ग्रामीण इलाकों में यह अंतर काफी ज्यादा है। यह अंतर शिक्षा, स्वास्थ्य, वित्तीय सेवाओं तक महिलाओं की पहुंच को रोकता है, या बहुत अधिक डिजिटल क्षेत्रों में उन्हें सफल नहीं होने देता। इस समस्या से पार पाने के लिए सार्वजनिक व निजी क्षेत्रों की साझीदारी जरूरी है।

तीसरा, औपचारिक क्षेत्र में महिला श्रम बल की भागीदारी बढ़ाने के लिए आयकर व्यवस्था का उपयोग करना चाहिए। पुरुषों के मुकाबले स्त्रियों में श्रम आपूर्ति अधिक लचीली होती है। स्त्रियों के लिए कम आयकर रखते हुए उनकी भागीदारी को प्रोत्साहित किया जा सकता है। इससे घर से रोजगार के प्रोत्साहन में मदद मिल सकती है। चौथा, लिंग संबंधी डाटा संग्रह और उसकी निगरानी। डाटा से ही चीजों को मापा जाता है और उस पर कार्रवाई की जाती है। आंकड़ों की कमी से किसी भी प्रगति की निगरानी करना कठिन हो जाता है। हर लड़की या महिला की गिनती जरूरी है, उनसे संबंधी जितना अच्छा डाटा उपलब्ध होगा, योजना बनाने और लागू करने में उतनी सुविधा होगी। महिला संबंधी डाटा में सुधार के लिए ही संयुक्त राष्ट्र ने ‘मेकिंग एवरी वूमन ऐंड गर्ल काउंट’ नाम से एक अभियान 2016 में शुरू किया था।

आज संकट के समय ने हमें जो मौका दिया है, उसे बेकार न जाने देने का सबसे अच्छा तरीका यह सुनिश्चित करना है कि महिलाएं मजबूत बनकर उभरें। भारत और दक्षिण एशिया के अन्य हिस्सों में महिलाएं अर्थव्यवस्था की बहाली या सुधार में निर्णायक हो सकती हैं।
