IPCC report focues on emission from land

What we eat has a direct bearing on worsening or easing climate stress. More meat means more stress. This must inform policy and personal conduct, according to a new report by the UN-backed science body, Intergovernmental Panel on Climate Change (IPCC). Growing human pressure has been eroding the capacity of land to provide food, fresh water and other ecosystem services, and thereby sustain human life and livelihoods. Land is a source of greenhouse gas emissions — agriculture, forestry and other land use account for 23% of the global greenhouse gas emissions. At the same time, land acts as a sink and sequester carbon — almost a third of all human-induced carbon dioxide emission. The report shows that better land management can make a critical contribution to achieving the Paris Agreement goal of restricting global temperature increases to well below 2° Celsius.

The increase of 1.5° Celsius, between 1850-1900 and 2006-15, over land has been about 75% faster than the rate of increase of the global average temperature. This warming has already had devastating impacts — heatwaves, increased droughts and changes in rainfall patterns — and has altered growing seasons, depressed crop yields, reduced freshwater availability, increased tree mortality and put biodiversity under increased stress. Urgent action is required to prevent further impairment of land’s ability to act as a carbon sink. The Intergovernmental Panel on Climate Change report finds that there is a window of opportunity in which significant change can be made. This will require changing the way food is produced, a shift to more plant-based diets, a greater stress on coarse grains, and better ways to manage land, particularly forests. The biggest potential for reducing emissions from land is in curbing deforestation and forest degradation. Reducing food waste and loss is another key area. Matching crops to agro-climatic zones is part of the deal.

The report found that afforestation and reforestation have the greatest carbon-removal potential, followed by enhancing soil carbon and using biomass for energy, combined with carbon capture and storage (BECCS).

सुस्त मांग का असर

अर्थव्यवस्था में पिछले कुछ समय से मांग में आई अनदेखी सुस्ती के बीच कई विशेषज्ञ इसके कारण एवं समाधान बता रहे होंगे। इस चर्चा में यह भी छोटा सा योगदान है।

भारतीय उपभोक्ता कर्ज में आकंठ डूबे हुए हैं। कटौतियों के बाद हाथ में आने वाले वेतन का एक बड़ा हिस्सा कर्ज भुगतान की मासिक किस्त (ईएमआई) में चला जाता है क्योंकि उपभोग का एक बड़ा हिस्सा उधार की रकम से ही जोर पकड़ता है। इससे भी बुरी बात है कि कई लोग उन घरों या फ्लैटों के लिए उठाए कर्ज की भी किस्त भर रहे हैं जिनका निर्माण अभी तक पूरा नहीं हुआ है।

दूसरा, निम्न मुद्रास्फीति के प्रभावों पर सोचें। वेतन वृद्धि कम होती जा रही है लिहाजा समय के साथ किस्त के बोझ में मिलने वाली राहत नदारद हो चुकी है। ब्याज दरों के भी नीचे आ जाने से लोग अपनी वृद्धावस्था के लिए अधिक बचत करने और फिलहाल कम खर्च करने को मजबूर हैं। तीसरा कारण नकारात्मक धन प्रभाव है। रियल एस्टेट की कीमतें 25 फीसदी से भी अधिक गिर चुकी हैं। शेयर बाजार सूचकांक भी एक साल पहले की तुलना में निचले स्तर पर हैं और कई म्युचुअल फंडों ने नकारात्मक नहीं तो खराब प्रतिफल दिया है। जब लोग खुद को गरीब महसूस करने लगते हैं तो वे कम खर्च करते हैं।

चौथा, श्रमशक्ति में पहले से कम महिलाएं होने से रोजगार ढांचा भी बदला है। महिलाओं के अधिक समय तक पढऩे, कुलीनता का भाव आने, आते-जाते समय सुरक्षा की कमी और उपलब्ध कार्य न होने जैसे कारणों से एक औसत परिवार में कामकाजी वयस्कों की संख्या कम हो गई है। निश्चित रूप से इसका असर परिवार की आय पर होगा। पांचवां कारण लोगों के अधिक समय तक जीवित रहने से जुड़े प्रभाव हैं। साठ साल से अधिक उम्र वाली आबादी जनसंख्या की समग्र वृद्धि दर से करीब दोगुनी दर से बढ़ रही है। बुजुर्गों की देखभाल करने से परिवारों पर स्वास्थ्य संबंधी खर्चों का बोझ बढ़ता है। आवास, वाहन, टिकाऊ उपभोक्ता उत्पादों एवं शिक्षा को छोड़कर अन्य कारणों से लिए जाने वाले घरेलू कर्ज में तीव्र वृद्धि हुई है। इनमें से कुछ हिस्सा निश्चित रूप से इलाज पर हुए खर्चों की भरपाई के लिए होगा।

छठे कारण का उल्लेख रथिन रॉय अपने लेख में कर चुके हैं। उत्पादों एवं सेवाओं की मांग का बड़ा हिस्सा एक पतली ऊपरी परत से ढका हुआ है। हालांकि यह आवरण उतना पतला भी नहीं है क्योंकि कुल आबादी का 30-35 हिस्सा उपभोग करने वाले दस्ते में शामिल है। मसलन, 2011 की जनगणना बताती है कि 24.6 करोड़ में से 21 फीसदी परिवारों के पास दोपहिया वाहन थे। आज के समय में यह अनुपात अधिक ही होगा क्योंकि करीब छह फीसदी परिवार हर साल दोपहिया वाहन खरीद रहे हैं। फिर भी रॉय इस मामले में सही हैं कि खर्च करने वाला तबका उतनी तेजी से नहीं बढ़ रहा है। एक कारण यह होगा कि श्रम-आधिक्य वाले विनिर्माण की वृद्धि निम्न-मध्य वर्ग के स्तर पर बड़ी व्यय श्रेणी बनाने में सफल नहीं हो पाई है। निम्न उत्पादकता और उसकी वजह से आय भी कम होने से ‘गिग इकॉनमी’ भी विकल्प नहीं रह गई है।

आखिर में, कृषि क्षेत्र में बदलाव का दौर है। किसान अब घरेलू बाजार की खपत से अधिक पैदावार करते हैं। लेकिन अधिक उपज का निर्यात नहीं हो पाने से घरेलू मांग एवं आपूर्ति के बदलते संतुलन ने कीमत संबंधी दबाव पैदा किए हैं जो कृषि आय को सीमित कर देता है। अगर श्रम अधिकता वाली विनिर्माण गतिविधियां सफल हुई रहतीं और लोग खेतों से निकलकर कारखानों में पहुंचे रहते तो खेती में लगे कम लोगों का ही पेट भरना पड़ता।

मजदूरी की सघनता वाले विनिर्माण को बढ़ावा देने के लिए श्रम सुधार, प्रतिस्पद्र्धी कीमत वाले रुपये, सक्षम ढांचागत आधार और आपूर्ति शृंखला विकास जैसे बदलावों की जरूरत है। कुछ मुद्दे सरकार के एजेंडे में हैं लेकिन कई श्रम कानूनों को मिलाकर चार श्रम संहिता बनाना ही काफी नहीं है। केवल कानूनों की संख्या घटने से कोई फर्क नहीं पड़ेगा। अर्थव्यवस्था में नई जान फूंकने के दबाव में आकर सरकार तात्कालिक समाधानों का रुख कर सकती है। इसे समझा जा सकता है लेकिन किसी को भी भ्रम में नहीं रहना चाहिए। संरचनात्मक बदलावों के बगैर टिकाऊ आर्थिक वृद्धि का रुझान नीचे की तरफ ही बना रहेगा।

मुख्यधारा से क्यों कटे हैं ?

आज भारत को हम भले ही समृद्ध विकासशील देश और निरंतर बढ़ती अर्थव्यवस्था की श्रेणी में मान लें, लेकिन आदिवासी अब भी समाज की मुख्य धारा से कटे नजर आते हैं। देश में अभी भी आदिवासी दोयम दर्जे के नागरिक जैसा जीवन-यापन कर रहे हैं। कुछ राज्य सरकारें आदिवासियों को लाभ पहुंचाने के लिए उनकी संस्कृति और जीवन शैली को समझे बिना ही योजना बना लेती हैं। ऐसी योजनाओं का आदिवासियों को लाभ नहीं होता, अलबत्ता योजना बनाने वाले जरूर लाखों में खेलने लगते हैं।

महंगाई के चलते आज आदिवासी दैनिक उपयोग की वस्तुएं भी नहीं खरीद पा रहे हैं। वे कुपोषण के शिकार हैं। इस नाते देश की करीब आठ फीसद आबादी (आदिवासियों की) पर विशेष ध्यान देने की जरूरत है। ऋणग्रस्तता, भूमि हस्तांतरण, गरीबी, बेरोजगारी, स्वास्य, मदिरापान, शिक्षा, और संचार जैसी उनकी प्रमुख समस्याओं पर गंभीरता से विचार करना आवश्यक है। भारतीय जनजातियों एवं आदिवासी समूहों का यदि हम इनकी भूभागीय भिन्नता के आधार पर विश्लेषण करें तो हम पाएंगे कि इनका प्रवासन अथवा देशांतरण दुनिया के विभिन्न स्थानों से विभिन्न कालखंडों में होता रहा है। प्रजातीय दृष्टि से इन समूहों में नीग्रिटो, प्रोटो-आस्ट्रेलायड और मंगोलायड तत्व मुख्यत: पाए जाते हैं, यद्यपि कतिपय नृतत्ववेत्ताओं ने नीग्रिटो तत्व के संबंध में शंकाएं पैदा की हैं। भौगोलिक दृष्टि से आदिवासी भारत का विभाजन चार प्रमुख क्षेत्रों में किया जा सकता है : उत्तर पूर्वी क्षेत्र, मध्य क्षेत्र, पश्चिमी क्षेत्र और दक्षिणी क्षेत्र। भारतीय समाजशास्त्री भली भांति यह जानते हैं कि भारत में हजारों वर्ष पूर्व आदिवासी समुदाय ने ही जंगल, पहाड़ एवं पहाड़ की कन्दराओं और गुफाओं मे आश्रय लेने के बाद जंगलों को साफ कर खेती करना सीखा, बनैले पशुओं को पालतू बनाया और एक स्थायी सामाजिक जीवन की शुरुआात की। प्रथम भारतीय ग्रामीण सभ्यता की नींव डालने वाले आदिवासी समुदाय ही थे।

यही कारण है कि भारत का आदिवासी समुदाय अपने जल, जंगल और जमीन से पृथक नहीं रह पाए। भारत का पूर्वोत्तर, मध्य प्रदेश, गुजरात, महाराष्ट्र, राजस्थान, झारखंड, बिहार, ओडिशा, छत्तीसगढ़ एवं प. बंगाल आदि राज्यों में कई आदिवासी समुदायों ने अपनी भाषा संस्कृति और सामाजिक परम्पराओं का विकास किया। यद्यपि प्राचीन काल में आदिवासियों ने भारतीय परंपरा के विकास में महत्त्वपूर्ण योगदान किया था और उनके कतिपय रीति-रिवाज और विास आज भी थोड़े-बहुत परिवर्तित रूप में आधुनिक हिंदू समाज में देखे जा सकते हैं, तथापि वे बहुत पहले ही भारतीय समाज और संस्कृति के विकास की प्रमुख धारा से पृथक हो गए थे। आदिवासी समूह हिंदू समाज से न केवल अनेक अहम पक्षों में भिन्न है, वरन उनके इन समूहों में भी कई महत्त्वपूर्ण अंतर हैं। समसामयिक आर्थिक शक्तियों और सामाजिक प्रभावों के कारण भारतीय समाज के इन विभिन्न अंगों की दूरी अब क्रमश: कम हो रही है। आदिवासियों की सांस्कृतिक भिन्नता को बनाए रखने में कई कारणों का योग रहा है। मनोवैज्ञानिक धरातल पर उनमें से अनेक में प्रबल ‘‘जनजाति-भावना’ है। सामाजिक-सांस्कृतिक-धरातल पर उनकी संस्कृतियों के गठन में केंद्रीय महत्त्व है। असम के नगा आदिवासियों की नरमुंड प्राप्ति प्रथा बस्तर के मुरियों की घोटुल संस्था, टोडा समूह में बहुपतित्व, कोया समूह में गो बलि की प्रथा आदि का उन समूहों की संस्कृति में बड़ा ही महत्त्वपूर्ण स्थान है। परंतु ये संस्थाएं-प्रथाएं भारतीय समाज की प्रमुख प्रवृत्तियों के अनुकूल नहीं हैं। आदिवासियों की संकलन-आखेटक-अर्थव्यवस्था और उससे कुछ अधिक विकसित अस्थिर और स्थिर कृषि की अर्थव्यवस्थाएं अभी भी परंपरा स्वीकृत पण्राली द्वारा लाई जाती हैं। परंपरा का प्रभाव उन पर नये आर्थिक मूल्यों के प्रभाव की अपेक्षा अधिक है।

धर्म के क्षेत्र में जीववाद, पितृपूजा आदि हिंदू धर्म के समीप लाकर भी उन्हें भिन्न रखते हैं। आज के आदिवासी भारत में पर-संस्कृति-प्रभावों की दृष्टि से आदिवासियों के चार प्रमुख वर्ग दिख पड़ते हैं। प्रथम वर्ग में पर-संस्कृति-प्रभावहीन समूह हैं, दूसरे में पर-संस्कृतियों द्वारा अल्पप्रभावित समूह, तीसरे में पर-संस्कृतियों द्वारा प्रभावित, किंतु स्वतंत्र सांस्कृतिक अस्तित्व वाले समूह और चौथे वर्ग में ऐसे आदिवासी समूह आते हैं, जिन्होंने पर-संस्कृतियों का स्वीकरण इस मात्रा में कर लिया है कि अब वे केवल नाममात्र के लिए आदिवासी रह गए हैं। हजारों वर्षो से शोषित रहे इस समाज के लिए परिस्थितियां आज भी कष्टप्रद हैं। इसे समझ कर समाधान की जरूरत है।

अन्य राज्यों को मिले विशेष अधिकारों का क्या होगा?

पहले से ही लग रहा था कि भाजपा के नेतृत्व वाली केंद्र सरकार ऐसा कोई कदम उठा सकती है। सितंबर 2016 में आतंकी बुरहान वानी की मौत के बाद प्रदर्शन हुए थे और जून 2018 में भाजपा ने पीडीपी से समर्थन वापस ले लिया था, तब भी मैंने यह चर्चा की थी। अनुच्छेद 370 और 35-ए पर जिस तरह से झकझोर देने वाला फैसला हुआ है, उसके कारण भाजपा व पीडीपी के बीच हुआ सुविधा का गठबंधन और अविश्वसनीय लगने लगा है।

इस मामले में पृष्ठभूमि को देखना उचित होगा। संसदीय बहस के हो-हल्ले और राष्ट्रवादियों की गौरवान्वित मुद्राओं ने राज्य-विभाजन के मसले को बहुत पीछे धकेल दिया है। वर्ष 2002 में जम्मू-कश्मीर विधानसभा चुनावों के समय राष्ट्रीय स्वयंसेवक संघ ने छोटे दलों और स्वतंत्र उम्मीदवारों के गठबंधन- जम्मू राज्य मोर्चा को निर्देशित किया था कि वह जम्मू क्षेत्र को अलग राज्य बनाने की मांग करे। उस समय चुनावी कवरेज के लिए मैं जम्मू में आरएसएस के एक वरिष्ठ पदाधिकारी इंद्रेश कुमार से मिला था, जिन्होंने इस कदम के तार्किक होने का दावा किया था।

वैसे यहां यह मांग कई वर्षों से दक्षिणपंथी दायरे से परे भी मौजूद रही है। जम्मू-कश्मीर के विभाजन की वकालत की जाती रही है। जम्मू और लद्दाख को कश्मीर घाटी से अलग करने के प्रयास चलते रहे हैं। अब वाकई जम्मू-कश्मीर और लद्दाख अलग-अलग केंद्रशासित क्षेत्र के रूप में बदल दिए गए हैं। इसके लिए भाजपा ने पहले ही गैर-भाजपा राष्ट्रवादियों और भाजपा के धुर समर्थकों का समर्थन समान रूप से जुटा रखा था।

राज्य का दो भागों में विभाजन जहां लोगों में विखंडन पैदा कर सकता है, वहीं इसे विकास के लिए जरूरी भी माना जा रहा है। भाजपा के अनुसार, विशेष रूप से जम्मू-कश्मीर के अस्थाई निवासियों और महिलाओं के साथ भेदभाव के कारण अनुच्छेद 35-ए को रद्द कर दिया गया है, यह अनुच्छेद विकास में एक बाधा था। कुछ विश्लेषकों ने संकेत दिए हैं कि अनुच्छेद 370 का अंत कुछ राज्यों के लिए चिंता का विषय बन गया है। विशेष रूप से पूर्वोत्तर भारत के लिए यह चिंता का विषय है। अनुच्छेद 370 के प्रावधान नहीं, बल्कि अनुच्छेद 35 -ए के तहत मिलने वाले प्रावधान चिंता के कारण बन गए हैं। दरअसल, 35-ए से मिलते-जुलते प्रावधानों का लाभ अनेक राज्य ले रहे हैं। अनुच्छेद 35-ए में विभिन्न प्रावधानों के तहत जम्मू-कश्मीर के स्थाई निवासियों को कुछ विशेष अधिकार दिए गए थे : राज्य सरकार के तहत रोजगार का अधिकार, राज्य में अचल संपत्ति अधिग्रहण का अधिकार, राज्य में बसावट का अधिकार। अनुच्छेद 35-ए से मिलते-जुलते प्रावधान अनुच्छेद 371-ए में हैं, जिसके तहत नगाओं को अपनी धार्मिक या सामाजिक प्रथाओं को बनाए रखने का अधिकार प्राप्त है। न्याय संबंधी प्रशासन में भी नगा प्रथा के कानूनों को तरजीह देना है। नगाओं को अपनी भूमि व संसाधनों पर स्वामित्व और हस्तांतरण के अधिकार भी मिले हुए हैं, इसके अलावा सरकारी रोजगार व अन्य अधिकार भी हैं।

ऐसे ही अनुच्छेद 371-सी मणिपुर के आदिवासी पहाड़ी क्षेत्रों को प्रशासनिक सुरक्षा प्रदान करता है। आदिवासी लोक की भूमि और प्रथागत अधिकारों की रक्षा करता है। मिजोरम पर लागू अनुच्छेद 371-जी नगालैंड के प्रावधानों का ही एक दर्पण है।

अरुणाचल प्रदेश भी बाहरी लोगों की राज्य में पहुंच, प्रवास और संपत्ति पर स्वामित्व को नियंत्रित करता है। विशेष प्रावधानों द्वारा आदिवासियों और वनवासियों के अधिकारों की रक्षा होती है। वर्तमान केंद्र सरकार की नीतियों के कारण असम व मेघालय जैसे पूर्वोत्तर राज्यों के वनवासी भी बहुत दबाव में हैं। हिमाचल प्रदेश और उत्तराखंड में भी संपत्ति पर स्वामित्व आरक्षित है। झारखंड व छत्तीसगढ़ के कुछ इलाकों में भी ऐसा ही संरक्षण है।

यदि अनुच्छेद 35-ए जम्मू-कश्मीर के विकास को रोक रहा था, तो ऐसे ही प्रावधान कुछ दूसरे राज्यों में विकास को कैसे बल दे सकते हैं? पूर्वोत्तर भारत में ऐसे मामलों में चिंताएं पहले से ही मुखर रही हैं। वहां स्वायत्तता, संपत्ति और आजीविका में कमी आ रही है। आव्रजन संबंधी मुद्दे अपनी जगह हैं, और अनेक विद्रोही समूहों के साथ शांति-वार्ताएं भी प्रगति पर हैं। ऐसे में, जवाब केंद्र सरकार को देना होगा।

Our notions of motherhood

Bill to promote altruistic surrogacy gives short shrift to women’s agency.

The Lok Sabha passed the Surrogacy (Regulation) Bill 2019 on Tuesday. The Billl aims to regulate the practice of surrogacy in India and allow only “ethical altruistic surrogacy”. The Bill was first introduced in the lower house in November 2016, then referred to the Parliamentary Standing Committee on Health and Family Welfare. It was introduced and passed by the Lok Sabha again in December 2018 without incorporating most of the recommendations of the Committee, but lapsed. The 2019 Bill is identical to the Bill of 2018.

It showcases the state’s heavy reliance on criminal law for managing social issues, criminalisation of choice and prejudiced ideas of what constitutes a family. The Bill disallows single, divorced or widowed persons, unmarried couples and homosexual couples from pursuing surrogacy to have children. It stipulates that only a man and woman married for at least five years, where either or both are proven infertile, can avail of surrogacy. This is blatantly discriminatory and arbitrary.

India’s jurisprudence recognises the reproductive autonomy of single persons, the rights of persons in live-in relationships and fundamental rights of transgenders. In Navtej Singh Johar vs Union of India, Supreme Court, having decriminalised consensual same-sex between consenting adults, held that the law cannot discriminate against same-sex partnerships and that it must “take positive steps to achieve equal protection”. Single persons have the right to adopt children in India. The Bill is out of step with these developments.

The Bill and its immediate ancestors significantly diverge from earlier, more rational policy positions. Guidelines issued by Indian Council of Medical Research in 2002 and the draft Assisted Reproductive Technologies (Regulation) Bills 2010 and 2014 had permitted commercial surrogacy. The shift to altruistic-only surrogacy was made in the context of sensational news reports about cases of surrogate babies being abandoned and exploited — surrogate mothers being kept in “surrogacy brothels” and rich foreigners using the bodies of poor Indian women to have children. In 2015, a public interest litigation, Jayshree Wad vs Union of India,was filed in the Supreme Court which cited these media reports and sought to end commercial surrogacy in India. Prompted by the court, the government declared in October 2015 that it did not support commercial surrogacy and would allow only infertile Indian couples to avail of altruistic surrogacy. The Surrogacy Bill of 2016 was a result of this change of intentions.

There is undoubtedly a danger of exploitation and abuse in commercial surrogacy. The cases that have come up establish that possibility. But formulating a law on the basis of exceptions is ultimately counterproductive. Exploitation takes place because of the unequal bargaining power between the surrogate mother and the surrogacy clinics, agents and intending parents. This can be addressed by a strong regulatory mechanism that introduces transparency and mandates fair work and pay for the surrogate mothers. Viewing commercial surrogacy as inherently exploitative and banning it only expands the potential for exploitation as it would force the business underground.

Further, criminalisation of commercial surrogacy is a refusal by the state to actually consider the exercise of agency that leads a woman to become a surrogate mother. Interviews with women who chose to provide gestational services for a fee have shown that it is a well-considered decision made in constrained economic conditions. A ban on commercial surrogacy stigmatises this choice and reinforces the notion of the vulnerable “poor” woman who does not understand the consequences of her decisions and needs the protection of a paternalistic State.

As per the Bill, the surrogate mother must be a “close relative” of the couple. This is premised on the mistaken belief that exploitation and vulnerability do not exist within the family. Knowing the reality of patriarchal families in India, the stigma of infertility, the pressure of producing children to maintain lineage and the low bargaining power of women, it can be expected that young mothers will be coerced into becoming surrogates for their relatives. The Bill moves the site of exploitation into the private and opaque sphere of the home and family. One cannot but question the ethics of this.

The severance of commerce from pregnancy is also tied in to the notion of motherhood being something natural, sacrosanct and above considerations. To be paid for the reproductive labour evokes unease and claims of “dehumanisation” and “commodification” in certain opponents of commercial surrogacy.

The Bill mandates the commissioning couple to only pay for the medical expenses and an insurance cover of sixteen months for the surrogate mother. The Standing Committee had recommended a model of compensated surrogacy which would cover psychological counselling of the surrogate mother and/or her children, lost wages for the duration of pregnancy, child care support, dietary supplements and medication, maternity clothing and post-delivery care. The Bill should, at the very least, incorporate these provisions.

The Bill, as it stands, is a poor attempt at regulating reproductive technologies and preventing exploitation of women. Surrogacy is an important avenue for persons to have a child through a willing surrogate mother who can also benefit monetarily from the process. The Bill, that gives short shrift to women’s agency, does little to extend this possibility.
