Vetting the Parliament

Government’s legislative pace overwhelms opposition but haste should not be at cost of scrutiny

After five years of adopting the consensus and money bill route to negotiate opposition majority in Rajya Sabha, government’s success in passing several key bills in the same House marks a decisive turn in BJP’s parliamentary strategy. On Friday, NDA moved closer to halfway mark in the Upper House with a second SP MP resigning, taking to three the opposition MPs quitting house membership besides the five defections to BJP, four from TDP and one from INLD.

BJP’s successful wooing of non-allied parties like BJD, TRS, YSRCP on various bills accompanied by a heavy legislative agenda this budget session – 30 bills passed so far in Lok Sabha and 25 in RS – have left the opposition gasping for breath. But it is important that Parliament gets to dissect with a fine comb legislations that governments table. This catches potential constitutional violations and even drafting errors besides throwing up alternative viewpoints. Several poorly drafted legislations enacted without scrutiny have backfired like the Information Technology Act amendments of 2008 that introduced Section 66A, which Supreme Court later struck down as unconstitutional. Even this budget session offers potential candidates for such judicial review, like the RTI Act amendment that undermines the autonomy of central and state information commissions and also the UAPA amendment allowing the Centre to designate individuals as “terrorists”.

Parliamentary standing (and select) committees to which bills and demand for grants are sent for review haven’t been constituted. PRS Research has noted a declining trend in sending bills to committees: 72% of bills in 15th LS were referred against just 25% in 16th LS. These committees are necessary pit stops on the road to framing better laws and for Parliament to function as a meaningful check on executive authority. The quality of legislation is as important as the pace of legislating.

CSR Should Not Be Source of Harassment

Rethink penal provisions for non-compliance

n one additional step back towards the good old days of socialism and control raj, the government has amended the companies law to prescribe a jail term of up to three years for company executives who fail to obey the mandate to spend 2% of average profits of the past three years on corporate social responsibility (CSR), in addition to a fine of up to Rs 25 lakh on the company.

Time was when CSR was a voluntary activity, carried out by companies that wanted to engage the public imagination in ways at one remove from business. Then, the UPA government made it mandatory for any company with a net worth of Rs 500 crore, turnover of Rs 1,000 crore or net profits of Rs 5 crore to spend 2% of profits on society in activities that would not add to the company’s bottom line. Now, penal rigour has been added to that mandate.

By generating jobs and incomes, meeting social wants and needs, paying taxes, allowing people’s savings to be converted into capital that generates returns for the suppliers of that capital and by carrying out research and development that produces new technology, companies do a lot for society, just by being companies.

Many companies go beyond such existential virtue to address problems of the environment and of social underdevelopment. Others go beyond mere rehabilitation of those displaced for their sake. Ethical investors and conscientious consumers favour them. The government should have left it at that.

Mandating CSR is like levying an additional tax and asking the companies to spend the proceeds themselves. There is a lot of waste and scale diseconomies. Companies that are good at doing CSR would do it on their own, in any case.

The UPA’s mandated CSR was bad, but non-compliance only called for a formal explanation. Now, it will fetch punishment. Mere abdication of State responsibility now morphs into outsourcing of State responsibility to companies.

This is wrong at the level of principle and bothersome at the level of practice. It gives the inspector raj one more dimension on which to harass companies. This should be reversed.

Gotta Grow, Grow Up, Go

To pull ahead, the economy needs to be geared to a single-minded pursuit of growth

India needs to transition towards a $5 trillion economy, taking it fromlower-middleincomestatus toupper-middleincome.Thepath of this transition can only be paved with reforms.

The introduction of goods and services tax (GST), the Insolvency and Bankruptcy Code (IBC), Real Estate (Regulation and Development) Act (Rera), the Monetary Policy Framework, a focus on ease of doing business, and formalisation of the economy, enhanced foreign direct investment (FDI) limits, recognition of the scale of the non-performing asset (NPA) problem, and subsequent recapitalisation of public sector banks (PSBs) are some of the measures undertaken in the past five years.

Structural reforms of this magnitudeal way sbring with the mtransien the adwinds. Demand, both internal and external, is subdued and private investments are yet to take off. Keynesian economics would tell us that expansionarymonetaryand fiscal policies are needed to bring aggregate demand out of its slump. However, with both fiscal deficit and inflation targets, the extent of monetary and fiscal expansion to stimulate aggregate demand is limited.

Thefocusof second-generationreforms should be a single-minded pursuit of growth that is investment- and exportled. In 1965, South Korea’s income level was around $700. By1996, it had risen to $16,230 thanks to the annual average growth of 10.7% over 31 years. China’s per-capita income in 1993 was $530. In 2008, it had reached around $2,720 with average annual growth at 11.5%.

So what does India need to do to drive a $5 trillion economy?

A slew of recent events have triggered a liquidity crunch. Banks and mutual funds are reluctant to lend to nonbanking financial companies (NBFCs), andbanklendinggrowthismeagre.Giventhe undercapitalised nature of PSBs, the liquidity crunch is further compounded. Ensuring sufficient credit flows is the need of the hour.

The Indian financial sector is overly reliant on banks as source of funding. Here, the bond market represents only 20%of total corporatedebtascompared to 80% in the US. India needs to deepen the corporate bond market stolessenthe load on banks as drivers of credit in the financial system.

A direct Keynesian fiscal expansion may be limited owing to fiscal deficit targets. But innovative ideas such as asset monetisation and recycling need to be vigorously pursued to fund government capital expenditure. Reverse BOT (build-operate-transfer) and TOT (tolloperate-transfer) for airports, roads, infrastructure investment trusts (InvITs) of power transmission grids and gas pipelines, along with monetising land lying idle with public sector enterprises, canraisesignificantfunds.Strategicdisinvestmentcanraisefurthernon-taxrevenues for GoI.

NITI Aayog has recommended strategic disinvestment of 46 central public sector enterprises (CPSEs). These need to be expeditiously taken forward for disinvestment. There is no rationale for governmentbeinginbusiness.It must get out of business enterprises and become a facilitator and catalyst.

Reserve Bank of India (RBI)mustalsorecognise that the real cost of borrowing in India is inordinately high when compared to peer nations. The imperfect monetary transmission mechanism implies that successive and large rate cuts from RBI are needed to bring down the cost of capital. Liquidity needs to be infused into the system, increasing the pool of loanable funds available in the market.

Several sectors remain unreformed, agriculture, perhaps, being the biggest example. We need to unleash the productive spirit of our farmers by eliminating outdated laws such as the Essential Commodities Act,the Agricultural Produce Market Committee (APMC) Act, and replace them with modern regulations such as the Agricultural Produce and Livestock Marketing (APLM) Act, theContractFarmingAct,andtheLand Leasing Act.

Along with marketing reforms, investments in the value chain are needed. This will boost both exports and the domestic food processing industry. Dependence on agriculture as a source of livelihood also needs to be reduced.

80% of global economic production happens in cities, lifting vast segments above poverty lines. They are centres of growth, innovation and creativity. We must focus on making Indian cities smart, sustainable and innovative. They hold the key to growth and job creation.

Manufacturing will play an important role in this regard. Export-led growth needs to be targeted, particularly in labour-intensivesectors.Tocapturelarger shares of export markets, our firms must be globally competitive. Rationalising electricity tariffs, labour and land laws are critical enablers of firm competitiveness.

Get the Wheels Moving

Reviving demand, especially in the automobile sector, is a critical and necessary short-term intervention. A special six-month programme for the auto sector should include lowering GST for automobiles and auto parts, an incentive-based vehicle-scrapping policy and a scheme like the Jawaharlal Nehru National Urban Renewal Mission (JNNURM) for subsidising States to procure BS-VI buses.

We need vibrant and dynamic power and railway sectors. This needs radical reforms, including direct benefit transfer(DBT)fortargetingsubsidies,bringing in franchise and public-private partnership (PPP) modes in distribution, separating carriage and content, permitting open access and freeing renewable from licensing requirement for generation and supply.

Railway reforms can add 1% to India’sGDP.Passenger fare shavenot increased for over two decades, and there is high cross-subsidisation of passenger service by freight service. We need to rationalise passenger fares, and projects like dedicated freight corridors to be completed. Private sector play in train operations and station redevelopment will fast-track infrastructure to global standards and bring efficiency.

The textiles and apparel sector presents significant employment opportunities, especially to the labour force exiting agriculture. A focus on man-made fibres, through removal of the inverted duty structure, is a first step. India also needs to focus on scale. Nearly 95% of our fabric is produced in small-scale industries, leading to a loss in competitiveness in destination markets. Largescale textile parks, providing common infrastructure and plug-and-play facilities to entrepreneurs, would make this sector competitive.

Mining needs urgent reforms. Opening up the coal sector for commercial mining, along with enhancing domestic oil and gas production and exploration, will reduce India’s dependence on imports of fossil fuels. In allocating these blocks,the focus should be on production,rather than revenue maximisation. India must also continue its thrust towards renewable energy, especially in the area of storage and batteries. Breakthroughs are likely to aid India in driving size and scale in electric mobility.

Tourism is an area where significant growth and employment opportunities emerge. While India has many destinations, we do not have many circuits. Developing the ‘Buddhist Circuit’, by providing air connectivity through UDAN (Ude Desh ka Aam Naagrik) to destinations such as Kushinagar and Bodh Gaya, will help us capture the burgeoning East Asian tourist market. India needs to bring down GST on hotel rooms from 28% to 18%, and reduce visa fees to $25, so that we can offer attractive and competitive packages.

For India to grow at 8-9% overthecoming years, the structural reforms need to aim at boosting domestic investment and savings levels, especially from the private and household sectors.Domestic infrastructure creation,funded through non-tax revenues, can ‘crowd-in’ private investment.

Similarly, stability, predictability and consistency in policies can boost and maintain investor confidence. Reforms in ease of doing business must continue with the aim of making India one of the easiest places in the world to do business. Tax laws need to be simplified, the processes fully digitised, and the tax research unit needs to be manned by professional tax experts.

Finally, we need to do everything possible to unleash the animal spirits of the private sector. Wealth creation on a sustained basis requires the private sector to play a key and significant role.

जीन में उत्परिवर्तन को नाकाम करने वाली एएसओ तकनीक

सैन फ्रांसिस्को स्थित कंप्यूटर वैज्ञानिक रोहन सेठ की एक पोस्ट इन दिनों सोशल मीडिया पर काफी चर्चा में है। सेठ और उनकी साथी जेन को करीब छह महीने पहले एक बच्ची हुई थी जिसका नाम उन्होंने लीडिया रखा। जन्म के कुछ समय बाद ही उस बच्ची को दौरे आने शुरू हो गए। इस दंपती को कई सघन परीक्षणों के बाद पता चला कि ‘एक अहम जीन में हुआ छोटा-सा उत्परिवर्तन बच्ची के मस्तिष्क की कार्यप्रणाली को प्रभावित कर रहा है जिससे वह गहरी अक्षमता और पीड़ा की चपेट में है।’

जेन और रोहन ने अपने स्तर पर गहन छानबीन की और अपनी बच्ची जैसे लाखों बच्चों को बचाने की उम्मीद में इस पड़ताल को ‘ओपन सोर्स’ करने का मन बना लिया। उन्होंने एक गैर-लाभकारी संस्था (एनजीओ) का गठन किया और इस बीमारी पर शोध के लिए 15 लाख डॉलर का फंड जुटाया। एक नई प्रक्रिया पर उम्मीद टिकी है और माता-पिता को उम्मीद है कि कुछ महीनों में ही कारगर इलाज खोज लिया जाएगा। सेठ दंपती को पता चला कि जीन में एकदम ऐसी उत्परिवर्तन स्थिति वाले महज दो लोग ही हैं। डीएनए के न्यूक्लियोटाइड क्षार एडीनिन, थायमिन, साइटोसिन और गुएनिन (एटीसीजी) होते हैं। लेकिन लीडिया के डीएनए के केसीएनक्यू2 नामक जीन में एडीनिन की जगह गुएनिन मौजूद है। किसी भी इंसान के डीएनए में करीब छह अरब संरचनाएं होती हैं और लीडिया जैसा जीन उत्परिवर्तन उस शृंखला में कहीं भी घटित हो सकता है। इस वजह से परंपरागत परीक्षणों में यह खामी पकड़ में नहीं आती है। भले ही नकारात्मक उत्परिवर्तन दुनिया भर में करोड़ों लोगों पर असर डालते हैं लेकिन जीन उत्परिवर्तन इतना असामान्य है कि कोई भी दवा कंपनी इसका इलाज तलाशने के लिए शोध करने में शायद ही फिक्रमंद होंगी।

सेठ दंपती ने पाया कि एंटीसेंस ओलिगोन्यूक्लियोटाइड्स (एएसओ) तकनीक के जरिये इन उत्परिवर्तनों को निष्प्रभावी किया जा सकता है। पहली स्वीकृत एएसओ दवा वर्ष 2016 में ही वाणिज्यिक रूप से उपलब्ध हो पाई थी। एक खास उत्परिवर्तन को निशाना बनाने वाली एएसओ दवा बनाना संभव है। सेठ दंपती के एनजीओ ‘लीडियन एक्सलरेटर’ का मकसद एएसओ अनुसंधान का एक मुक्त डेटाबेस तैयार करना है। आनुवांशिक अभिव्यक्ति एक ऐसी प्रक्रिया के जरिये होती है जिसमें डीएनए मेसेंजर आरएनए (एमआरएनए) के माध्यम से राइबोसोम को सूचना भेजता है। राइबोसोम एक विशाल आणविक कारखाने जैसा होता है और यह सभी जीवित कोशिकाओं में पाया जाता है। यह प्रोटीन बनाने के लिए एमआरएनए से मिली सूचना का इस्तेमाल करता है। एंटीसेंस पद्धति इस एमआरएनए को ही निशाना बनाती है ताकि एक उत्परिवर्तित जीन से आने वाली सूचना को रोका जा सके।

ओलिगोन्यूक्लियोटाइड्स न्यूक्लिक एसिड के छोटे अवयव हैं। एंटीसेंस पद्धति में गलत बरताव करने वाले जीन की पहले पहचान की जाती है और फिर एक ओलिगोन्यूक्लियोटाइड को रासायनिक तौर पर संश्लेषित किया जाता है कि उस उत्परिवर्तित जीन के जरिये एमआरएनए को सूचना प्रेषित किए जाने पर रोक लगाई जा सके। यह अत्यंत विशिष्ट एवं सटीक निशाना होता है जिससे केवल एक व्यक्ति के लिए एक डिजाइनर दवा बनाई जा सके। डीएनए के मामले में एमआरएनए की आनुवांशिक सूचना न्यूक्लियोटाइड्स के क्रम में छिपी होती है। न्यू्क्लियोटाइड्स तीन क्षार युग्मों के कूट में समायोजित होते हैं। ओलिगोन्यूक्लियोटाइड्स भौतिक रूप से एमआरएनए को जोड़ते हैं और एक खास प्रोटीन बनाने के लिए मिलने वाले निर्देशों को रोक सकते हैं। इस तरीके से थैलेसीमिया, रेटिनिट्स, मस्क्यूलर डिस्ट्रॉफी, कैंसर, एचआईवी और एड्स जैसी कई बीमारियों का इलाज किया जा चुका है।

प्रोटीन प्रसंस्करण में आरएनए को प्रभावित करने में एएसओ की भूमिका का पता दो दशक पहले चला था। एक कृत्रिम ओलिगोन्यूक्लियोटाइड संरचना के एंटीसेंस प्रभाव का पहली बार प्रदर्शन जैमेनिक एवं स्टीफेंसन ने सत्तर के दशक के आखिरी वर्षों में किया था। लेकिन इन तकनीकों के इस्तेमाल में प्रगति की दर धीमी रही है। अमेरिकी खाद्य एवं औषधि प्रशासन (एफडीए) ने पहली एएसओ दवा विट्रावीन के वाणिज्यिक इस्तेमाल की इजाजत वर्ष 2016 में दी थी। पिछले साल जाकर बोस्टन चिल्ड्रन्स हॉस्पिटल के डॉ टिमोथी यू ने एक खास मरीज की आनुवांशिक समस्या के निदान के लिए पहली डिजाइनर एंटीसेंस दवा विकसित की थी। लेकिन रीढ़ की मांसपेशी में कमजोरी और डकेन मस्क्यूलर डिस्ट्रॉफी जैसी गंभीर बीमारी के इलाज के लिए बनी एएसओ दवाओं को अभी मंजूरी मिलनी बाकी है।

यह तकनीक स्नायु एवं गैर-स्नायु संबंधी कई परिस्थितियों के इलाज में भविष्य में बदलाव लाने की क्षमता रखती है। लेकिन इसके महंगे एवं संभावित नकारात्मक प्रभावों का भी अध्ययन किया जाना चाहिए। कंप्यूटर वैज्ञानिक कहते हैं कि वे गंभीर बीमारियों के इलाज संबंधी शोध में खुले मंचों का हिस्सा बनने में यकीन करते हैं। उनका कहना है, ‘शोध प्रक्रिया में खुलापन लाकर हम किसी भी संस्थान को एएसओ दवा के विकास में सक्षम बना सकते हैं। उसके आधार पर हम प्रभावोत्पादकता और सुरक्षा आंकड़ों का एक साझा डेटाबेस बना सकते हैं। किसी खास मरीज के लिए डिजाइनर दवा विकसित करने वाले वैज्ञानिक भी अपने डेटा को इस कोष का हिस्सा बनाकर अपना अंशदान कर सकते हैं। अधिक सूचनाएं इकट्ठा कर हम एक गणना-पद्धति तैयार कर सकते हैं जिससे प्रयोगशाला के स्तर पर होने वाली काफी मेहनत में कमी लाई जा सकती है।’ वैज्ञानिकों का मानना है कि हरेक इलाज के साथ हम अगले इलाज की लागत एवं समय दोनों में ही कटौती कर सकेंगे। नवीनतम तकनीक को एक सूत्र में पिरोने का यह असामान्य तरीका होगा।

अमेरिका का गंदा खेल

अमेरिका जिस तरह के प्रयासों में लगा हुआ है, उससे क्या नहीं लगता कि वह इतिहास के किसी खेल को दोहराना चाहता है, जिसमें पाकिस्तान उसके मुख्य सिपहसालार की भूमिका में हो? पिछले दिनों डोनाल्ड ट्रंप प्रेस को संबोधित करते समय जम्मू-कश्मीर तक पहुंच गए

पूरब में भारत तथा चीन और पश्चिम में फारस व मध्यसागरीय दुनिया के बीच एक जंक्शन के रूप में स्थापित अफगानिस्तान इतिहास का कई सदियों तक व्यापार के लिए ‘‘क्रॉस रोड्स’, तमाम संस्कृतियों एवं पड़ोसियों के ‘‘मीटिंग प्लेस’ के साथ-साथ प्रवास व आक्रमण के लिहाज से ‘‘फोकल प्वाइंट’ रहा है। इस दृष्टि से तो अफगानिस्तान नियंतण्र धरोहर के रूप में तमाम दस्तावेज में दर्ज होना चाहिए, लेकिन आधुनिक इतिहास के बहुत से पन्ने इसे ‘‘प्लेस ऑफ कॉन्फ्लिक्ट’ के रूप में पेश करते हैं। कारण यह है कि अफगानिस्तान औपनिवेशिककाल से शीतयुद्ध व शीतयुद्धोत्तर काल तक कभी सोवियत संघ, कभी अमेरिका और कभी चीन की चालों का शिकार होता रहा। फलत: उसकी मौलिक विशेषताएं नेपय में चली गई। सामने आया वर्तमान स्वरूप जहां आतंकवाद और ध्वंस के नीचे दबी मानवता कराह रही है।

इसे क्या माना जाए ? नियंतण्र शक्तियों का डर्टी गेम या अफगानिस्तान की किस्मत? इस समय अमेरिका जिस तरह के प्रयासों में लगा हुआ है, उससे क्या नहीं लगता कि वह इतिहास के किसी खेल को दोहराना चाहता है, जिसमें पाकिस्तान उसके मुख्य सिपहसालार की भूमिका में हो? पिछले दिनों पाकिस्तान के प्रधानमंत्री इमरान खान जब अमेरिकी यात्रा पर गए तो दोनों राष्ट्रों के बीच बात होनी थी अफगानिस्तान पर लेकिन अमेरिकी राष्ट्रपति डोनाल्ड ट्रंप प्रेस को संबोधित करते समय जम्मू-कश्मीर तक पहुंच गए, तभी समझ में आ गया था कि अमेरिका कोई नई चाल चलने की तैयारी में है क्योंकि ट्रंप ने यह सोची-समझी रणनीति के तहत कहा था। इस रणनीति के कुछ बिंदु इस प्रकार हो सकते हैं। प्रथम-ट्रंप संदेश तो नहीं देना चाह रहे हैं कि दक्षिण एशिया में अशांति और आतंकवाद की वजह जम्मू-कश्मीर मुद्दा है। द्वितीय-पाकिस्तान इस समय आर्थिक संकट से गुजर रहा है। इसलिए उसे अमेरिकी सिपहसालार बनाना आसान है बशत्रे उसका प्रिय मुद्दा उठा दिया जाए। तृतीय-अफगानिस्तान संकट को किसी और मुद्दे में विस्थापित कर नया ग्लोबल नैरेटिव तैयार करना जिसका सरोकार दक्षिण एशिया और भारत-पाकिस्तान से हो।

लेकिन सवाल उठता है कि तालिबान इस अमेरिकी खेल का हिस्सा बनेंगे? यदि हां तो उस स्थिति में अफगान सरकार की पोजीशन क्या होगी? दूसरा सवाल है कि वे तालिबान, जो अफगानिस्तान के चुनाव की प्रक्रिया को फिजूल की हरकत मानते हैं, अफगान व्यवस्था में किस तरह से शामिल होना चाहेंगे? क्या सीधे अफगानिस्तान की व्यवस्था में हिस्सा लेंगे या फिर चुनाव के जरिए व्यवस्था तक पहुंचने का रास्ता अपनाएंगे ?

कुछ समय पूर्व अमेरिकी सीनेट की कमेटी के समक्ष संघीय जांच ब्यूरो (एफबीआई) ने कहा था कि सैन्य प्रयासों के बावजूद अफगानिस्तान में तालिबान अपनी स्थिति मजबूत कर रहा है। इस स्थिति को देखते हुए डिफेंस डायरेक्टर ले. जनरल विन्सेंट स्टीवर्ट ने ट्रंप प्रशासन से अपील की थी कि क्षेत्र में मौजूदा दौर में सक्रिय 20 आतंकी संगठनों से निपटने के लिए अफगानिस्तान के पड़ोसी देशों के साथ मिलकर काम करे क्योंकि इन संगठनों से न केवल अफगानिस्तान और पाकिस्तान पर, बल्कि पूरे क्षेत्र को खतरा है। ध्यान रहे कि ये स्थितियां आज भी न केवल बरकरार हैं, बल्कि और बदतर हुई हैं यानी इन स्थितियों पर काबू न पा सकने के कारण ट्रंप प्रशासन अब नई रणनीति अपना रहा है। इसके दो पहलू हैं। पहला-पाकिस्तान के जरिए तालिबान को मनाना; और दूसरा जम्मू-कश्मीर को ऐसे मुद्दे में तब्दील करना जिससे ग्लोबल डिप्लोमैसी काबुल से श्रीनगर की ओर विचलित हो जाए। सभी जानते हैं कि तालिबान अमेरिकी दिमाग और पाकिस्तानी गर्भ की उपज हैं। इसलिए ट्रंप प्रशासन को लगता है कि पाकिस्तान अफगान-तालिबान शांति वार्ता में निर्णायक भूमिका निभा सकता है। लेकिन ऐसा है नहीं।

फिलहाल, तालिबान इतने दिन तक अमेरिका से लड़कर और अफगानिस्तान में अमेरिकी सांसें फुलाकर वह हैसियत प्राप्त कर चुके हैं कि सौदेबाजी से समर्पण की मुद्रा में नहीं आएंगे। तो संभव है कि अमेरिका ऐसी चालें चलेगा जो दक्षिण एशिया के हित में नहीं होंगी। जो भी हो भारतीय राजनय को आंख-कान खुले रखने होंगे ताकि न केवल अमेरिकी चालों का समझा जा सके, बल्कि उन्हें काउंटर करने के तरीके भी ढूंढे जा सकें।

मैंने 28 फरवरी, 1997 को अपने बजट भाषण में ‘सहकारी संघीय राजव्यवस्था’ वाक्य का प्रयोग किया था। मैं यह दावा तो नहीं करता कि सबसे पहले मैंने ही इस वाक्य का प्रयोग किया था, लेकिन मुझे खुशी इस बात की है कि ‘सहकारी संघीय राजव्यवस्था’ का प्रयोग बजट भाषणों और अन्य मौकों पर बार-बार किया जाता रहा है।

 

राज्य संप्रभु हैं

‘सहकारी संघवाद’ का मतलब क्या होता है? यह वाक्य बताता और पुष्टि करता है कि भारत एक संघीय राज्य है। इसमें एक केंद्र सरकार है और राज्य सरकारें हैं। हर सरकार के अपने निश्चित विधायी क्षेत्र हैं। केंद्र सरकार (संसद के द्वारा) राज्य सरकारों के तय अधिकार क्षेत्र पर अतिक्रमण नहीं कर सकती। राज्य सरकार भी (विधानसभा के द्वारा) केंद्र सरकार के लिए तय अधिकार क्षेत्रों का अतिक्रमण नहीं कर सकती। कुछ ऐसे भी अधिकार क्षेत्र हैं जिसमें दोनों सरकारें कानून बना सकती हैं। विधायी क्षेत्रों का बंटवारा ही संघवाद की विशेषता है। संवैधानिक योजना का आदर करना ही सहकारी संघवाद है।

फिर भी, भारत के संविधान में अपवादस्वरूप ऐसे विशेष प्रावधान हैं जो संसद को किसी भी मामले पर (धारा 248), यदि जरूरी हो तो राज्य सूची के विषय सहित सीमित अवधि के लिए ऐसे किसी भी विषय पर जो ‘राष्ट्रहित के लिहाज से जरूरी या उचित हो’ (धारा 249) और आपातकाल लागू कर दिए जाने पर किसी भी विषय पर (धारा 250) कानून बनाने का अधिकार देते हैं। धारा 258(2) एक महत्त्वपूर्ण धारा है। संसद द्वारा बनाया गया कानून राज्य सरकार या इसके अधिकारियों को शक्तियां प्रदान कर सकता है और शुल्क लगा सकता है, लेकिन केंद्र राज्य को पैसा उसी के अनुरूप देगा, जैसा कि तय किया हुआ है। यह प्रावधान राज्यों की संप्रभुता, अधिकारों और शक्तियों की पुष्टि करता है।

जबर्दस्ती विधेयक पास

भाजपा की सरकार एक अलग तरह की सरकार है। यह न तो राज्यों के अधिकारों का सम्मान करती है, न ही संवैधानिक सीमाओं और बारीकियों पर गौर करती है। भाजपा सरकार ने जिस तरह से राज्यसभा में विधेयक पास कराए हैं उससे उसकी संघवाद के प्रति प्रतिबद्धता का पता चलता है। लोकसभा जनता का सदन है, जबकि राज्यसभा राज्यों की परिषद है। राज्यसभा के सदस्यों का पहला कर्तव्य राज्यों के हितों का संरक्षण करना और उन्हें आगे बढ़ाना है। दो अगस्त तक, लोकसभा ने इस सत्र में अट्ठाईस विधेयक पास किए और राज्यसभा ने छब्बीस। और इनमें से एक भी विधेयक पर विपक्षी दलों के साथ सलाह-मशविरा नहीं किया गया। एक विधेयक भी विस्तृत छानबीन के लिए स्थायी समिति या प्रवर समिति को नहीं भेजा गया। किसी भी विधेयक पर राज्य सरकारों से कोई राय-मशविरा नहीं किया गया, उन विषयों पर भी, जो संविधान की समवर्ती सूची (सूची 3) में शामिल हैं और जिनसे राज्यों के अधिकार प्रभावित होते हैं। सरकार ने विपक्ष द्वारा रखे गए संशोधनों में एक को भी नहीं माना।

कुछ उदाहरण पर्याप्त होंगे। जस्टिस पुट्टास्वामी मामले में सुप्रीम कोर्ट ने संविधान की धारा 110 के दायरे को स्पष्ट किया है और सरकार उस फैसले से बंधी है। राज्यसभा धन विधेयक में संशोधन नहीं कर सकती, यह सुझाव दे सकती है और लोकसभा को लौटा सकती है। राष्ट्रपति धन विधेयक पर मंजूरी को रोक नहीं सकते हैं और न ही इसे पुनर्विचार के लिए संसद को लौटा सकते हैं। इन सीमाओं का फायदा उठाते हुए और धारा 110 का निर्लज्जतापूर्ण उल्लंघन करते हुए सरकार ने कम से कम दस गैर-वित्तीय कानूनों को वित्त (क्रमांक 2) विधेयक के जरिए संशोधित करा लिया और इस तरह सरकार राज्यसभा द्वारा होने वाली छानबीन या पुनर्विचार के राष्ट्रपति के निर्देश को टाल गई।
सूचना का अधिकार कानून 2005 का शुरुआती कानून के रूप में सबने स्वागत किया था। इस कानून की धारा 15 सभी राज्य सरकारों को राज्य सूचना आयोग के गठन के लिए अधिकृत करती है। राज्य सरकार ही राज्य सूचना आयुक्तों का चयन और उनकी नियुक्ति करेगी। शुरुआती कार्यकाल पांच साल का रखा गया था। अब तक वेतन, भत्ते और सेवा से संबंधित अन्य शर्तें तय करने का अधिकार (धारा 16) राज्य सरकार के पास ही था। अब, शुरुआती कार्यकाल, वेतन और सेवा संबंधी शर्तें तय करने का अधिकार केंद्र सरकार ने अपने हाथ में ले लिया है! हमने पूछा, क्यों? इसका कोई जवाब नहीं था।

राष्ट्रीय चिकित्सा आयोग विधेयक कुल मिला कर राज्यों को अपमानित करने जैसा है। चिकित्सा शिक्षा को संचालित करने के लिए राज्य सरकार की हर शक्ति छीन ली गई है और हर राज्य को चार साल में सिर्फ दो साल के लिए आयोग में अपना सदस्य भेजने का अधिकार दिया गया है! यह वैसा ही अच्छा है जैसे चिकित्सा शिक्षा के विषय को तीसरी सूची से पहली में कर दिया जाए। फिर भी यह राज्यों के बिना किसी विरोध के राज्यों की परिषद में पारित हो गया!

हर तरह से छल

राज्यसभा में विधेयकों को पास कराने के लिए सरकार वोटों का जुगाड़ कर कैसे लेती है? मुसलिम महिला (विवाह में अधिकारों का संरक्षण) विधेयक, जिसे तीन तलाक विधेयक के रूप में भी जाना जाता है, को ही लें। सरकार चौरासी के मुकाबले निन्यानवे वोटों से इसलिए जीत गई, क्योंकि इस विधेयक पर मतदान के वक्त विपक्ष के छियालीस सदस्य गैरहाजिर थे! बसपा का कोई सदस्य मौजूद नहीं था, सपा के छह सदस्य गैरहाजिर थे, एनसीपी के चार में से दो सदस्य मौजूद नहीं थे, उसी दिन कांग्रेस के एक सदस्य ने इस्तीफा दे दिया (और अगले दिन भाजपा में शामिल हो गया) और कांग्रेस के भी चार सदस्य गैरहाजिर रहे। अन्नाद्रमुक, जद (एकी), टीआरएस और पीडीपी जो इस विधेयक के खिलाफ बोलते रहे थे, विधेयक पर मतदान के वक्त गायब हो गए!

कानूनों को पास कराने के लिए भाजपा ने बांटने, फुसलाने, डराने, धमकाने या गुप्त ‘सौदेबाजी’ करने जैसे हर तरीके का इस्तेमाल किया है, जो राज्यों को नगर निगमों में तब्दील करके रख देंगे और एकत्व के अनर्थकारी विचार में एक और आयाम जुड़ जाएगा- हर चीज के लिए एक सरकार।
