Delaying Marriage

Focus on education. Girls and women will gain agency to make their choices

Government appears to be mulling an upward revision in minimum marriage age of women from 18 to 21, to address concerns of malnutrition and maternal mortality. Well-intentioned like most laws, such a change is unnecessary and disruptive. Eighteen is the age of attainment of adulthood in India by most legal yardsticks. It is the age of consent for boys and girls, age when they attain voting rights, licence to drive, and even register a company. That men have to wait till 21 to lawfully marry has its share of critics.

Two decades of comparatively rapid economic growth have dramatically altered gender indicators like marriage age and total fertility rate (TFR). National Family Health Survey indicates that women aged 20-24, who married before turning 18, fell sharply from 47.4% to 26% from 2005-06 to 2015-16. Sample Registration System (SRS) statistical report for 2018 reveals that an incredibly low 2.3% females were effectively married before turning 18 and 33.2% between 18 and 20. Women’s agency is rising organically with educational levels. SRS 2018 report reveals that TFR for illiterate women is 3.0, with primary education is 2.5, Class 10 is 1.9 and graduates is 1.7.

Quality education for girl children, preventing dropouts, ensuring nutritious midday meals and college education should be the pathway to 21, not artificial marriage barriers. The bureaucratic tendency to over-legislate is counterproductive. This newspaper has reported on Monday how the pandemic is producing worrying sociological responses where some out-of-work parents marry off school going minor daughters – with school closures producing a double whammy. A violation of the Prohibition of Child Marriage Act, 2006, prescribing non-bailable offences and jail terms, this is testimony to the limitations of laws in the absence of enabling socio-economic conditions. More jobs and education, not laws, please.

Bullying Tactics On The Left

Facebook is not biased to the Right, the Right has equal right to free speech

Just a month ago, the resignation letter of Bari Weiss at the New York Times put the spotlight on a growing phenomenon – a Twitter led bullying by Left liberal journalists of all those in media who tended to hold a contrary view – be it journalists or platforms.

In her letter Weiss said, “It has become that truth isn’t a process of collective discovery, but an orthodoxy already known to an enlightened few whose job it is to inform everyone else.” Talking of her own paper she said, “Stories are chosen and told in a way to satisfy the narrowest audiences, rather than to allow a curious public to read about the world and draw their own conclusions.”

It used to be, in the past, that the Left would oppose the views of the Right or the centrists and vice versa, and that there would be healthy competition to win the hearts and minds of the media consumer. But in the last few years, something has changed about the Left’s strategy. It’s increasingly resorting to strident “anything goes” and bullying tactics, to deny space on platforms to any contrary view.

The recent article in the Wall Street Journal about Facebook in India and its alleged bias for the Right can only be described as a hatchet job by some Left elements in Facebook against Facebook. It’s incomplete to say the least, because it either ignores or overlooks the reality that alleged objectionable political content emerges from all sides of the political spectrum. The real story the article represents – using as it does internal leaks – is more about an attempted coup by Facebook insiders to influence Facebook’s content takedown policies, than about anything else. And the intent of the leaks was to get the possibly well-intentioned journalist to only look in one direction – to the Right.

It’s a relatively easy way of gaslighting or doxxing those who speak from the Right or those who support the Right’s right to be equally heard. It is what it is – some left liberal forces in Facebook pressuring it to take down more and more content of the Right – on a totally subjective basis. It’s consistent with the way Left leaning politicians in US Congress took on Mark Zuckerberg, the founder of Facebook in a recent hearing at Capitol Hill. All part of a plan to browbeat and bully as many platforms as possible to deny space and access to views from the Right.

I noticed that post the WSJ article, Facebook India has immediately taken down the content relating to only two BJP MPs, whilst leaving many others on the other end of political spectrum, like Owaisi and some Congress names, untouched – pretty clearly proving that this wasn’t about setting of any new equitable standard but a way of muting the Right. That Congress and some other opposition political leaders are tomtomming this proves that this was the desired outcome all along. Deeply ironic and hypocritical given that it was the same Congress party and leadership that engaged the infamous (and now dissolved) Cambridge Analytica, using private consumer data from Facebook consumers, to run its political campaign.

There are serious problems with this kind of approach – both for Facebook and any other social media platform that tries to do this subjective censoring, coerced or pressured by Left elements. First the test of law – Article 19 of Constitution of India guarantees freedom of speech. Article 19(2) also lays out the reasonable restrictions to that free speech. That any cabal can cause a platform to selectively apply 19(2) or censor/ take down content that is not expressly restricted is violative of law. This is not a test that can be easily sidestepped.

Second, there is this need for social media platforms to prevent Twitter from becoming their editors. A few self-styled intellectuals and their tweets don’t make up free speech. Attacks camouflaged as activism – on platforms and journalists – is a pattern that has played out in India and the US, with Left gaslighting or doxxing many leaning to the Right. We saw this happen during the CAA campaign when many Indians in the Middle East were put at risk of violence, through a careful targeted campaign by Left elements in India, who feared no consequence or costs of such actions.

By the way, I tend to think every time there’s a healthy discussion on freedom of expression – that’s a good thing. It’s the essence of our democracy and any open society. It’s not the first time the issue of free speech on the internet has come up for discussion. Not that long ago, I fought hard and long in Parliament and all the way to the Supreme Court, to ensure that UPA government enacted IT Act’s Section 66A was struck down. Section 66A was a sword used to curb free speech on the internet. The Left was conspicuously silent when the bill and Section 66A were passed in 2008.

In today’s internet world, the challenge is real – of balancing free speech with the responsibility of internet platforms to regulate hateful and inciteful content. But to use this power of the platform to attempt to silence or mute the Right is not just wrong, it cannot be permitted. Leftist ideologies and socialism are failed ideas that couldn’t compete in a world that values openness, democracy and free thought. Such ideas can’t be allowed to use bullying, intimidation and half truths to block the ideas of BJP and its followers.

Face it

Social media platforms need to work with government but they must be seen to be agnostic to ideology

With great power comes great responsibility, and social networking giant Facebook will need shoulders broad enough to bear the burden. A week ago, after US intelligence agencies warned of foreign interference in the impending polls and President Donald Trump grumbled about rigged postal ballots, Facebook joined Alphabet and Twitter in discussions with federal officials about cleansing platforms of misinformation which could influence the popular will. But in India, the Wall Street Journal reported, action against hate speech by at least four individuals or groups linked to the BJP was opposed on the plea that it would harm Facebook’s business prospects. India is the platform’s biggest market. Since it cannot operate in China, India is crucial for its future prospects.

Apart from Anantkumar Hegde and Kapil Mishra, Telangana BJP MLA T Raja Singh was reported internally for crossing the line and his posts were flagged as “promoting or participating in violence.” Apparently, employees policing the network suggested that action should be taken against Singh under the company’s Dangerous Individuals and Organisations policy, under which content can be banned, but Facebook declined to invoke hate speech rules against these individuals and groups, the WSJ reported. In the communal violence in Delhi in February, it has been alleged that a video of Kapil Mishra of the BJP played a role, which Facebook took down after it went viral, but which continued to spread nevertheless on WhatsApp, also a Facebook property.

Mark Zuckerberg has argued that politicians need to be heard, but he has also said that Facebook must draw a line on hate speech. It must do so even-handedly, and irrespective of geography and business interests. Last year, just before elections, when it cracked down on fake accounts, it took down over 700 pages that were found linked to both the Congress and the BJP. As the digital technology hailed for giving voice to all turns into an echo-chamber in which dangerous voices, amplified by the power they wield, carry further than others, platforms cannot be seen to be playing favourites, anywhere. Facebook must be seen to be agnostic to ideology, and not succumb to the urge to reduce business risk in certain locations by shifting the goalpost or lowering the bar. If it acts against white supremacists and militant black organisations in Trump’s America, it must do so with the equivalent of such groups in India, too. One of the problems seems to be that the people responsible for platform integrity also interface with governments and have to nurture relationships with the establishment. Stung by poll-related scandals in the US and UK, and by a recent advertisers’ boycott, Facebook should resolve this obvious conflict of interest, or risk losing brand value globally.

Striking too hard

Judiciary has great power, including power to punish for contempt. It must use it sparingly, softly

The “strong arm of the law must strike a blow”. With these words, in a judgment by Justices Arun Mishra, B R Gavai, and Krishna Murari, two tweets by senior counsel Prashant Bhushan, a veteran social action jurisprudence exponent, were found to be based on “distorted facts”, and making “undoubtedly false, malicious and scandalous” allegations. Counsel was bound, as a “responsible officer of the court”, to protect “the majesty of law”, not to indulge in an act that “tends to bring disrepute to the institution of administration of justice.”

In the first tweet, which included a photograph of the chief justice on a motorcycle, Bhushan is held guilty of making a knowingly “false statement” about the denial of the citizens’ right to access justice, which obscured the fact that the court in trying times had conducted “a total of 879 sittings and heard over 12,700 matters” (in some of which Bhushan had vigorously participated). The second tweet was critical of the role allegedly played by the judiciary and the last four chief justices in weakening democracy. The court found that these tweets undermine the “dignity and authority of the institution of the Supreme Court and the CJI” and the statement “directly affronts the majesty of law”.

A further ground is now added. Contempt proceedings must also consider the “effects upon national honour and prestige in the comity of nations”. This enhancement of the chilling effect is worrisome as any and every call for judicial accountability may be thus indicted. Will the stock-in-trade predictions of judicial outcome, an aspect of practising appellate law and doing legal science, now constitute a criminal contempt? Did the then incumbent four senior justices — Justices Jasti Chelameswar, Ranjan Gogoi, Madan Lokur and Kurian Joseph — lower the “majesty of law” by holding the press conference on January 13, 2018, commonly called a “judicial revolt”?

Many people believe that the right to free speech is near-absolute, accountability of justices is sacrosanct and even that the offence of criminal contempt should be banished. Many others believe that such a power should exist and be fully exercised in apt cases. India-wide empirical studies are indispensable to prove/disprove these views; but available only are the judicial statements about the tendency to lower the image of the judiciary in the public mind or activist assumptions of the “chilling effect”. The 274th report of the Law Commission (2018) recommended continuance of the offence, but all it cited was the high incidence of 586 pending cases between July 1, 2016 and June 30, 2017. Certainly, amidst divided public opinion, the apex court was right in 1974: “Contempt action should be substantial and mala fide interference with fearless judicial action, not fair comment or trivial reflections on the judicial process and personnel.”

No doubt, many ironies lurk in the judicial discourse which endorses “gainfully… the observations of Justice Wilmot… made as early as in 1765.” He stressed a need for “a more rapid and immediate redress” whenever “men’s allegiance to the law is… fundamentally shaken”; because justices are “the channels by which the King’s justice is conveyed to the people.”

The country of origin of these words was then on the verge of becoming a world empire, and yet a leading postcolonial court invokes these in 2020. While furthering the swadeshi jurisprudence, the court evokes phrases from 1765 on the eve of the 74th Indian Independence Day! However, students of the judicial process know that the courts regard the loom of law as a seamless web and the stern message of criminal scandalisation does not worry too much about the sun setting on the British Empire and law reform altogether abolishing the offences.

The swadeshi jurisprudence, the court says, is clear and compelling. Did not Chief Justice Mohammad Hidayatullah (1970) convict the then chief minister of Kerala for making derogatory remarks on justices and overrule the decision of the Kerala High Court? Did it not convict even the Chairperson of the Bar Council of India (1975), awarding him a jail sentence for six weeks and incapacity to practise law for a period of three years? Did it not then say that the “right to continue to practise is subject to the law of contempt” and ask: “Can the legal profession be practised by committing the contempt of courts”?

Further, Article 129 declares the Supreme Court to be a “court of record” and bestows upon it “all the powers… including the power to punish for contempt of itself.” But if the “power to punish for contempt… itself” is a “constitutional power which cannot be taken away or… abridged by statute”, even the constituent power or the judiciary itself may not do so lest the basic structure be offended.

Only judicial wisdom may determine the quantum of punishment. The court normally imposes the most minimal sentences — such as a small fine (slashed, in the Namboodiripad case by the apex court to Rs 50 from the Kerala High Court award of Rs 1,000), a minimal sentence of incarceration till the rising of the court, or minor prison sentence now subject to bail in the COVID-19 situation as so ordered suo motu by the court itself. It has yet to decide an appeal by Yatin Oza, against the Gujarat High Court sentence depriving him of the status of a “senior” counsel.

Do the tasks of magnanimous justice end or begin when conviction has been recorded, is a difficult question that the court will now have to consider. However, a mere recall of Shakespeare may not cause any interference with the course of justice: “O, it is excellent/ To have a giant’s strength, but it is tyrannous to use it like a giant.”

Own the disruption

Greatest challenge for successful rollout of new education policy is teacher training

“If we teach students today, as we taught yesterday, we rob them of tomorrow.” These words of John Dewey resonate across time. For decades, the education we received was different from what we needed. The realisation that school curriculum was focused on equipping students for the last century has been the driving force behind the changes reflected in the National Policy of Education (NEP). The policy has come at a time when schools have to adjust to new societal demands and expectations by transforming themselves. Much of the energy that will drive the economy will be generated in the classrooms. It is clear that without a skilled workforce, no community will prosper and no industry will thrive. Despite the best efforts of educationists, governments and other stakeholders, schools are struggling to meet the evolving needs of students and their future employers. This policy will help change the landscape of employment opportunities.

The school curriculum and pedagogy have been reconstructed for the foundational years — preschool, nursery, kindergarten, class one and two. Learning will take place through activities and the play-way method. In the preparatory stages of classes three, four and five, experiential learning will be transacted across disciplines. In the middle-level of classes six to eight, there will be an emphasis on subject-oriented pedagogy. In the secondary stages for classes nine to 12, innumerable aspects of flexibility for subject selection, student choices, break-out options for vocational training along with a gap year will help in developing various aspects of critical thinking, problem-solving, and decision making.

The NEP clearly states that the importance of school curriculum is inextricable from human wellbeing. For the first time, 21st-century skills will run like a thread through the curriculum and be woven across disciplines, crafts, practices and teaching strategies. Collaborative, innovative, critical thinking, problem-solving, decision-making will be coupled with digital literacy and information technology. Social and emotional skills will be embedded in the curriculum. Empathy, resilience, conflict resolution and relationship building are skills which offer the key to success in a rapidly changing world. The educational model envisaged in NEP will refine and re-engineer classroom transactions.

Students in senior schools have always grappled with the problem of selecting subjects across streams. With increased flexibility across arts and humanities, their choices have increased manifold. However, changes at this level will have to dovetail into decisions and admission processes at the university level, else the NEP will be an exercise in futility.

The assessment pattern is a welcome change. The shift to customised models of assessment will compel educators to make pedagogical practices more child-centred and policy-makers to review curricula and make them more skill-based. Such an approach will allow students to make mistakes, take risks, be creative and move away from rote learning. If we want our children to participate in PISA assessments and succeed, we have to change the way we teach and evaluate because the PISA does not test students on their memory. It attempts to assess if students can apply the knowledge they have gained. These tests affirm if countries have effective and inclusive education systems.

The greatest challenge facing us is teacher training. Teachers need to have an understanding of the method in which this extremely creative curriculum has to be transacted. At the grass roots level, the quality of education leaves much to be desired. A large number of in-service teachers have no professional qualifications and are tasked with innumerable administrative and social responsibilities, leaving them with little time for hands-on teaching, let alone training. There are pockets of excellence and expertise, but they are few and far between. The fundamental pedagogical structures of how we organise education have proved to be deeply resistant to change. This is one of the reasons that led to the failure and withdrawal of the continuous comprehensive evaluation (CCE) initiative.

If we want the NEP to succeed, we have to be careful to disrupt established norms. Every stakeholder at the state, district, sub-district, and block level has to take ownership of the NEP. Principals have to be trained in advance. Many of them — even in the urban areas — do not have the skills required for such changes. It is important to plan the mapping of resources and skillsets of teachers before the policy is actually rolled out. Standalone workshops will not suffice. Consistent inter and intra school training is needed.

The CBSE is the country’s most progressive board. It can start with pilot programmes to ensure the efficacy of this policy. It already has integrated many of the concepts mentioned in the NEP in its schools and has been involved in writing manuals and had conducted programmes and launched initiatives on competency-based education, joyful and experiential learning, art education, school quality assessments and a variety of other innovative pedagogies

The Board can train master instructors, who, in turn, can train principals and teachers. A scalable and sustainable model can be created. Transformation will take place only if we collaborate and create communities of teacher training and provide them with real-time feedback on their levels of readiness.

The entire education system will need to have an adaptive approach to ensure that our children succeed and find their place under the sun, nationally and globally.

Jurisdictional conflict in the running of Delhi

In the prosecutors’ issue, the Lt. Governor’s acts have not been in consonance with the Supreme Court’s 2018 ruling

“The exercise of establishing a democratic and representative form of government for NCT of Delhi by insertion of Articles 239AA and 239AB would turn futile if the Government of Delhi that enjoys the confidence of the people of Delhi is not able to usher in policies and laws over which the Delhi Legislative Assembly has powers to legislate for the NCT of Delhi.” So said the Constitution Bench of the Supreme Court in Government of NCT of Delhi vs. Union of India (2018). The issue before the Supreme Court was the jurisdictional conflicts between the government of NCT and the Union Government and its representative, the Lieutenant Governor.

Issues and possible solutions

The judgment which runs into more than 1,000 pages analyses the contentious issues which hobbled the State government and attempts to resolve them. Very lofty principles concerning constitutional morality, co-operative federalism, constitutional conscience, pragmatic federalism, etc., have been enunciated in this judgment. It reminds the Lt. Governor what his real functions are. It tells the State government that it should remember that Delhi is a special category Union Territory and lays down the parameters to enabling the harmonious functioning of the government and the Lt. Governor.

The judgment clarified and settled many contentious issues such as the powers of the Lt. Governor vis-à-vis the elected government, his discretionary powers, the extent of the executive powers of the State government, etc. On the face of it, it did not very clearly delineate the issues in respect of which the Lt. Governor can refer a decision taken by the Council of Ministers to the President in the event of a difference of opinion between the Lt. Governor and the State government. Nevertheless, the Supreme Court has settled the law in regard to the ‘aid and advice’ of the Council of Ministers by affirming that the Lt. Governor is bound to act on the aid and advice except in respect of ‘Land’, ‘Public Order’ and the ‘Police’.

The Court has also made it clear that there is no requirement of the concurrence of the Lt. Governor and that he has no power to overrule the decisions of the State government. However, there is a catch here — in the operationalisation of Article 239AA (4) (proviso) which says that in the case of a difference of opinion between the Lt. Governor and his Ministers on any matter, the Lt. Governor shall refer it to the President for decision and act according to that decision.

In the meantime, if the Lt. Governor thinks that the matter is urgent he can take immediate action on his own. So, ultimately things are back to square one. If a Lt. Governor, for example, wants to frustrate the efforts of the government, he can declare that there is a difference of opinion on any issue decided by the elected government and refer it to the President which in reality means the Union Home Ministry. The Lt. Governor being its representative, it is easier for him to secure a decision in his favour. The State government will be totally helpless in such a situation.

Delhi riot cases

The recent appointment of prosecutors for conducting the Delhi riot cases in the High Court is a case in point. As per the High Court and the Supreme Court, the appointment of prosecutors is exclusively within the purview of the State government. When the government decided to appoint them, the Lt. Governor referred it under proviso to Article 239AA (4) to the President stating that there is a difference of opinion between him and the government over this matter. In the meantime the Lt. Governor appointed all the prosecutors whose names were submitted by the Delhi Police and thus the State government’s list was rejected.

This episode clearly points to the fault lines which still exist in the power equations in the capital’s administrative structure. The key question is whether the Lt. Governor can refer a routine administrative matter such as the appointment of prosecutors to the President.

A close reading of the Supreme Court judgment in the NCT Delhi case (supra) would reveal that he cannot. Just take a look at what the Supreme Court says. “The words ‘any matter’ employed in the proviso to Article 239AA (4) cannot be inferred to mean ‘every matter’. The power of the Lieutenant Governor under the said proviso represents the exception and not the general rule which has to be exercised in exceptional circumstances by the Lt. Governor. Keeping in mind the standards of Constitutional trust and morality, the principles of collaborative federalism and the concept of Constitutional balance….”

Matters of jurisdiction

The Court further says, “the Lieutenant Governor should not act in a mechanical manner without due application of mind so as to refer every decision of the Council of Ministers to the President.” The highest judicial forum in the country in its own majestic style directs the Lt. Governor not to refer to the President normal administrative matters as that would disturb the concept of Constitutional governance, principles of collaborative federalism and the standards of Constitutional morality. Reference of the appointment of Prosecutors by the Lt. Governor to the President seems to be a negation of these principles.

There is another point which emerges from the judgment and attention needs to be paid to it. That is that the executive power of the Union does not extend to any of the matters which come within the jurisdiction of the Delhi Assembly. Parliament can legislate for Delhi on any matter in the State List and the Concurrent List but the executive power in relation to Delhi except the ‘Police’, ‘Land’ and ‘Public Orders’ vests only in the State government headed by the Chief Minister.

The Supreme Court says, “Article 239AA (3)(a) reserves the Parliament’s legislative power on all matters in the State List and Concurrent List but clause (4) explicitly grants to the Government of Delhi executive powers in relation to matters for which the Legislative Assembly has powers to legislate.” This statement of law by the Supreme Court implies that the Union Government is not empowered to exercise executive authority on a matter which comes within the exclusive jurisdiction of the State government like the appointment of Prosecutors. The only occasion when the Union Government can overrule the decision of the State government is when the Lt. Governor refers a matter to the President under the proviso to clause (4). But this proviso cannot totally override the executive decisions of the State government under clause (4).

The judgment of the Supreme Court resolves this apparent contradiction by enjoining the Lt. Governor to keep in mind while making a reference to the President the constitutional morality, principles of collaborative federalism, concept of constitutional governance, objectivity, etc. Although the Court did not specify the matters which can be referred by the Lt. Governor to the President, the high principles described above broadly indicate what can be referred and what cannot. In any case it is unambiguously clear that the executive decisions of the State government cannot be referred to the President merely because the Lt. Governor has a different personal opinion about some of them. The top court wants the Lt. Governor and the Council of Ministers to use in full the mechanism provided in the Government of NCT of Delhi Act and the Transaction of Business Rules to thrash out differences. The Court seems to elevate to a higher level the issues that can be referred to the President as distinct from the normal decisions taken in exercise of the executive powers of the State. The President is the highest Constitutional authority and his decision should be sought only on constitutionally important issues.

The last word

Finally, the Supreme Court gives wise advice to the Lt. Governor: “We may reiterate that the Constitutional scheme adopted for the NCT of Delhi conceives of the Council of Ministers as the representatives of the people on the one hand and the Lt. Governor as the nominee of the President on the other who are required to function in harmony within the Constitutional parameters. In the said scheme of things, the Lt. Governor should not emerge as an adversary having a hostile attitude towards the Council of Ministers of Delhi; rather, he should act as a facilitator.”

So, when we analyse the reference by the Lt. Governor to the President the issue of appointment of prosecutors within the parameters laid down by the Supreme Court, we find that it is not in consonance with these principles enunciated by the Court. It is against constitutional morality which requires strict adherence to the constitutional principles of collaborative federalism, constitutional balance and the concept of constitutional governance. All these principles act as bulwark against the usurpation of powers of the State by the Union. When the Court declares the law and requires the constitutional authorities to follow it, they have to act in compliance and not in defiance.

What is criticism and what is contempt?

Whether a comment constitutes criminal contempt would necessarily be decided on the facts of each case

A recent order of the Supreme Court found advocate Prashant Bhushan guilty of contempt for two tweets — one relating to the Chief Justice of India astride an expensive motorcycle and the other a comment that the Supreme Court, in his opinion, played a role in the destruction of democracy in India over the last six years.

Criminal contempt

For the purpose of the topic at hand we are concerned only with criminal contempt and not those wilfully disobedient litigants who ignore the orders of the courts. Section 2(c) of the Contempt of Courts Act, 1971 defines criminal contempt as the publication of any matter or the doing of any other act which scandalises or lowers the authority of any court; or prejudices or interferes with the due course of any judicial proceeding; or obstructs the administration of justice.

Does this mean that one can never voice any criticism of the judiciary? No. What the law permits you to say regarding the functioning of Indian courts forms the basis of this particular article, i.e., there is a thin line separating criticism and contempt.

Freedom of speech is a fundamental right guaranteed to every Indian citizen under Article 19(1)(a) of the Constitution, albeit subject to reasonable restrictions under Article 19(2). In C.K. Daphtary v. O.P. Gupta (1971), the Supreme Court held that the existing law of criminal contempt is one such reasonable restriction. That does not mean that one cannot express one’s ire against the judiciary for fear of contempt.

As long back as in 1968, Lord Denning M.R. set out guidelines in matters of contempt of court. He stated that contempt is not the means to uphold the court’s dignity. He said its jurisdiction is to be exercised sparingly and that protection of freedom of speech is paramount. While welcoming criticism, Lord Denning only requested that it be fair since judges, owing to their status, are not in a position to refute the comments so levelled against them.

What does the Indian judiciary deem permissible and impermissible? The Supreme Court has held that if a comment is made against the functioning of a judge, it would have to be seen whether the comment is fair or malicious. If the comment is made against the judge as an individual, the Court would consider whether the comment seeks to interfere with the judge’s administration or is simply in the nature of libel or defamation. The Court would have to determine whether the statement is fair, bona fide, defamatory or contemptuous.

A statement would not constitute criminal contempt if it is only against the judge in his or her individual capacity and not in discharge of his or her judicial function. Criminal contempt does not seek to afford protection to judges from statements which they may be exposed to as individuals. Such statements would only leave the individual liable for defamation. Statements which affect the administration of justice or functioning of courts amount to criminal contempt since public perception of the judiciary plays a vital role in the rule of law. An attack on a judge in his or her official capacity denigrates the judiciary as a whole and the law of criminal contempt would come down upon such a person unless it is a fair critique of a judgment.

Various examples

Sections 4 and 5 of the Contempt of Courts Act are akin to a defense a person may take in a case of defamation i.e., fair comment. In Re: S.Mugolkar v. Unknown (1978), the Supreme Court held that the judiciary cannot be immune from fair criticism, and contempt action is to be used only when an obvious misstatement with malicious intent seeks to bring down public confidence in the courts or seeks to influence the courts. In this judgment, Chief Justice M.H. Beg opined that at times the judiciary adopts a “magnanimously charitable attitude even when utterly uncharitable and unfair criticism of its operations is made out of bona fide concern for improvement.”

The same Justice Beg remarked post-retirement that Justice H.R. Khanna’s famous dissent in the ADM Jabalpur case (1976) made no contribution to law but only to his popularity. The Allahabad High Court citing Brahma Prakash Sharma (1953) did not find Justice Beg guilty of contempt.

Former Law Minister of India, P. Shiv Shankar, referring to landmark judgments of the Supreme Court, said once: “Mahadhipatis like Keshavananda and Zamindars like Golaknath evoked a sympathetic chord nowhere in the whole country except the Supreme Court of India. And the bank magnates… got higher compensation by the intervention of the Supreme Court in Cooper’s case.” He also said: “Antisocial elements i.e. FERA violators, bride burners and a whole horde of reactionaries have found their heaven in the Supreme Court.”

Speaking for the Supreme Court in 1988, Justice Sabyasachi Mukherjee found that these statements did not impair the administration of justice. He only opined that the language could have been milder given the Minister’s own legal background. He also said: “If antisocial elements and criminals have benefited by decisions of the Supreme Court, the fault rests with the laws and the loopholes in the legislation. The Courts are not deterred by such criticisms.”

Truth is also a defence in matters of criminal contempt if it is bona fide and made in public interest, as held by the Supreme Court in Indirect Tax Practitioners’ Association v. R.K. Jain (2010).

However, all these precedents did not come to the aid of activist Arundhati Roy when the Supreme Court found her guilty of contempt. A petition was filed against Ms. Roy, which was dismissed by the apex court. However, it was Ms. Roy’s reply to the petition which was held to be in contempt. In that, Ms. Roy had admonished the Supreme Court for acting with undue haste in a frivolous petition and attributed it to her strong critique of the apex court’s decision in the Sardar Sarovar Dam case. The Supreme Court held that a statement that the Court willingly issued notice on an unsubstantiated petition affected the reputation and credibility of the Court before the public and therefore found Ms. Roy guilty of contempt.

The above cases would show that whether a comment would constitute criminal contempt or not depends entirely on the facts and circumstances of each case. In conclusion, tweets or remarks by conscientious citizens certainly do not affect the dignity of the Indian judiciary, to quote Lord Denning “that must rest on surer foundations”.

खुशहाली लाने वाली किसान रेल

भारतीय कृषि की बदहाली की एक बड़ी वजह यह रही कि यहां सभी फसलों के उत्पादन पर ध्यान नहीं दिया गया। इसके अलावा कृषि उपज के भंडारण, विपणन, प्रसंस्करण की एकीकृत नीति भी नहीं बनी। यही कारण है कि कभी आलू, प्याज, टमाटर सड़कों पर फेंके जाते हैं तो कभी वे उपभोक्ताओं के आंसू निकाल देते हैं, लेकिन अब यह समस्या खत्म होने वाली है। भारतीय रेलवे ने देश में एक छोर से दूसरे छोर तक ताजी सब्जी, फल, फूल और मछली पहुंचाने के लिए किसान रेल सेवा शुरू की है। गत दिनों पहली किसान पार्सल रेल महाराष्ट्र के देवलाली से बिहार के दानापुर के बीच चली। यह रेल पूरी तरह वातानुकूलित है। एक तरह से यह पटरी पर दौड़ता हुआ कोल्ड स्टोरेज है। यह रेल मध्य प्रदेश और उत्तर प्रदेश से होकर गुजरेगी और 14 स्टेशनों पर रुकेगी जहां छोटे-बड़े सभी किसान अपनी सब्जियों, फलों एवं अन्य खाद्य सामग्री की बुकिंग करा सकेंगे। जैसे-जैसे देश के दूसरे हिस्सों से किसान रेल की मांग आएगी वैसे-वैसे उनकी संख्या बढ़ाई जाएगी। दूसरी किसान रेल बरौनी से टाटानगर के बीच शुरू की गई है।अगले साल डेडिकेटेड फ्रेट कॉरिडोर के शुरू हो जाने के बाद इस तरह की किसान रेल दिल्ली, मुंबई, कोलकाता, चेन्नई जैसे देश के बड़े खपत केंद्रों और बंदरगाहों तक फल, फूल, सब्जी आदि पहुंचाने लगेंगी। इसका सबसे बड़ा फायदा यह होगा कि जहां शहर के लोगों को ताजी वस्तुएं मिलेंगी वहीं किसानों को अपनी फसल स्थानीय मंडियों में बेचने की मजबूरी नहीं रहेगी। सबसे बढ़कर फलों-सब्जियों की बनावटी कमी पैदा करके कीमत घटाने-बढ़ाने वाले बिचौलियों का खेल खत्म हो जाएगा।

मोदी सरकार द्वारा एपीएमसी एक्ट में संशोधन करने से अब किसान अपनी उपज कहीं भी बेचने के लिए आजाद हैं। दरअसल सरकार इंटरनेट के जरिये कृषि उत्पादों के लिए राष्ट्रीय स्तर पर एक बाजार बना रही है, ताकि किसान अपनी उपज कहीं भी बेच सकें। इसी के तहत राष्ट्रीय कृषि बाजार योजना (ई-नाम) शुरू की गई है। इससे किसानों को उनकी उपज की वाजिब कीमत मिलेगी और 2022 तक किसानों की आमदनी दोगुनी करने का लक्ष्य हासिल होगा।
उल्लेखनीय है कि फलों-सब्जियों आदि को संरक्षित करने के लिए प्रोसेसिंग, पैकेजिंग और कोल्ड स्टोरेज जैसे बुनियादी ढांचे की कमी के कारण कुल पैदावार का एक-चौथाई हिस्सा हर साल सड़ जाता है। इससे किसानों का मुनाफा मारा जाता है और उनके पास निवेश करने के लिए पर्याप्त संसाधन नहीं बचते। किसान रेल सेवा से न केवल फल-सब्जी खराब होने से बचेंगे, बल्कि किसानों की आमदनी में भी इजाफा होगा। इसका दूरगामी नतीजा यह होगा कि किसान गेहूं-धान के बजाय बागवानी फसलों को प्राथमिकता देंगे जिससे फसल चक्र में बदलाव आएगा।

देश के 8.5 फीसद फसली क्षेत्र पर बागवानी फसलों की खेती की जाती है, लेकिन इनसे कृषिगत सकल घरेलू उत्पाद का 30 फीसद हिस्सा प्राप्त होता है। फलों एवं सब्जियों की खेती अन्य फसलों के मुकाबले चार से दस गुना ज्यादा रिटर्न देती है। शहरीकरण, मध्य वर्ग का विस्तार, बढ़ती आमदनी, खान-पान की आदतों में बदलाव के चलते दुनिया भर में अनाज के बजाय फलों-सब्जियों की मांग में तेजी से इजाफा हो रहा है। प्रति व्यक्ति आय में एक फीसद की बढ़ोतरी से सब्जी की खपत 1.02 फीसद और फलों की 1.9 फीसद बढ़ जाती है। स्पष्ट है आने वाले वर्षों में फल एवं सब्जी की खपत में तेजी से इजाफा होना तय है, लेकिन समस्या यह है कि चीन के बाद दुनिया का दूसरा सबसे बड़ा फल एवं सब्जी उत्पादक होने के बावजूद भारत इस बाजार में भरपूर हिस्सेदारी नहीं बना पाया है। भारत विश्व का 12.6 फीसद फल और 14 फीसद सब्जी उत्पादित करता है, लेकिन फलों, सब्जियों के कुल वैश्विक बाजार में उसकी हिस्सेदारी महज 0.5 तथा 1.7 फीसद ही है। गहराई से देखें तो इसके लिए महंगी ढुलाई, प्रोसेसिंग, पैकेजिंग और क्वालिटी निर्धारण सुविधाओं की कमी जिम्मेदार है। उदाहरण के लिए कम लागत पर पैदा होने के बावजूद महंगी ढुलाई के कारण नीदरलैंड के फल-सब्जी आयात में भारत की हिस्सेदारी महज तीन फीसद है, जबकि सुदूर लैटिन अमेरिकी देश चिली की हिस्सेदारी 23 फीसद है।

वैश्विक तापवृद्धि और जलवायु परिवर्तन के कारण मौसम चक्र गड़बड़ा गया है जिससे किसानों का जोखिम बढ़ा है। इसीलिए कृषि विशेषज्ञ अब ऐसी खेती का सुझाव दे रहे हैं जो न केवल मौसमी उतार-चढ़ाव झेल ले, बल्कि उसकी बिक्री से किसानों को लगातार लाभ भी हो। यह फलों-सब्जियों की खेती से ही संभव है, लेकिन प्रसंस्करण, भंडारण, कोल्ड स्टोरेज और शीघ्र परिवहन संबंधी कमजोरियों के कारण फलों-सब्जियों की खेती जोखिम भरी रही है। मोदी सरकार के पिछले छह साल के कार्यकाल में सड़क, बिजली, फ्रीजर जैसी बुनियादी सुविधाओं के देशव्यापी विस्तार ने फलों तथा सब्जियों की खेती के लिए सुनहरा मौका दिया है। यहां श्वेत क्रांति के पहले की परिस्थितियों का उल्लेख प्रासंगिक है। तब पशुपालकों के पास दूध तो था, लेकिन विपणन ढांचा न होने के कारण दूध उत्पादन घाटे का सौदा था। सरकार ने दूध उत्पादन को एपीएमसी के दायरे से बाहर किया और दूध की खरीद-बिक्री पर लगे सभी प्रतिबंध हटा दिए। देश भर में दळ्ग्ध संग्रह केंद्र खुले और पशुपालकों को आजादी दी गई कि वे केंद्र पर जितना दूध लाएंगे उसे खरीदा जाएगा। इसका नतीजा श्वेत क्रांति के रूप में सामने आया। किसान रेल के देश भर में चलने से दूध की तरह जल्दी खराब होने वाली कृषि उपजों के लिए वातानुकूलित संग्रह केंद्र खुलेंगे जहां इनकी लोडिंग-अनलोडिंग होगी। इससे न केवल किसानों की बदहाली दूर होगी, बल्कि भारतीय कृषि उत्पाद विश्व में अपनी धाक जमा सकेंगे। स्पष्ट है किसान रेल गांवों के साथ-साथ शहरों के लिए भी खुशहाली लाने वाली साबित होगी।

फेसबुक की जवाबदेही

सोशल मीडिया प्लेटफॉर्म अब दुनिया के लोकतांत्रिक देशों के सार्वजनिक मंच की भूमिका निभा रहे हैं। राजनेता इन्हीं के माध्यम से नागरिकों से बातचीत करते हैं, मतदाता एक दूसरे से संपर्क में रहते हैं और विभिन्न प्रकार की धारणा तैयार करने का काम किया जाता है। ऐसे में अधिकांश लोकतांत्रिक देशों में इस बात को लेकर खुली बहस हो रही है कि इन प्लेटफॉर्म का स्वयं का आचरण किस प्रकार का हो। जाहिर है भारत में भी ऐसी चर्चा लंबे समय से लंबित है। हालांकि फेसबुक ने कहा है कि उसकी एक नीति है जिसके तहत किसी भी तरह के राजनीतिक कदम या राजनीतिक दल से संबद्धता से दूर ही रहा जाता है लेकिन हाल ही में वॉल स्ट्रीट जर्नल में प्रकाशित एक रिपोर्ट के अनुसार भारत में फेसबुक की एक वरिष्ठ अधिकारी ने बार-बार हस्तक्षेप करके सत्ताधारी दल के नेताओं की उन पोस्ट को बचाया जो अन्यथा फेसबुक के घृणा फैलाने वाले भाषणों के आंतरिक मानक पर खरी नहीं उतर पाती। ऐसा तब है जब फेसबुक के चेयरमैन मार्क जुकरबर्ग स्वयं अपने कर्मचारियों को यह बताने के लिए दिल्ली दंगों के संदर्भ का उदाहरण दे चुके हैं कि कब फेसबुक को दखल देना चाहिए और अपने मंच पर अभिव्यक्ति को नियंत्रित करना चाहिए।

सोशल मीडिया प्लेटफॉर्मों के संचालन में राजनीतिक पूर्वग्रह का होना स्वाभाविक है। इसे पूरी तरह समाप्त कर पाना बहुत मुश्किल है। फिर भी यह स्पष्ट है कि कम से कम भारत में वे तमाम संरक्षणात्मक उपाय पूरी तरह लागू नहीं किए जा रहे हैं जिन्हें लागू करने का वादा इन प्लेटफॉर्म ने दुनिया के अन्य लोकतांत्रिक देशों में किया है। फेसबुक जैसी कंपनियों को भारत जैसे भौगोलिक संवेदनशीलता वाले देशों में राजनीतिक भाषणों के प्रबंधन में अधिक पारदर्शी होना होगा और कम स्वेच्छाचारिता का परिचय देना होगा। वॉल स्ट्रीट जर्नल में प्रकाशित रिपोर्ट से यही पता चलता है कि केवल एक कर्मचारी भी अपने स्तर पर फेसबुक की आंतरिक प्रबंधन एवं नियमन प्रक्रिया को बेपटरी कर सकता है। यानी ये प्रक्रियाएं मजबूत नहीं हैं और ऐसा कोई भी व्यक्ति उसे क्षति पहुंचा सकता है जिसका काम संस्थान को राजनीतिक सत्ता के करीब रखना हो, बजाय कि विषयवस्तु का औचित्य तय करने के। फेसबुक को भारत में अपनी विषयवस्तु को लेकर आंतरिक तंत्र में बदलाव करना होगा। उसे इन बदलावों का प्रचार करने के साथ-साथ इसे क्षति पहुंचाने वाले कर्मचारी या कर्मचाारियों की जवाबदेही भी तय करनी होगी। यदि ये प्लेटफॉर्म ऐसे सुधार नहीं करेंगे तो इसकी उन्हें और उन देशों को भारी कीमत चुकानी होगी जहां ये काम करते हैं। नफरत फैलाने वाले भाषण को हल्के में नहीं लिया जा सकता। पहले ही तनाव और हिंसा से जूझ रहे देशों में और हिंसा भड़काने को मंच नहीं मिलना चाहिए। यह भी स्पष्ट होना चाहिए कि लोकतांत्रिक देशों में इनका संचालन ऐसे सुधारों पर निर्भर हो। लोकतांत्रिक देशों में बतौर मंच उनकी विश्वसनीयता और परिचालन की सुरक्षा इस बात पर निर्भर करती है वे सत्ता को लेकर कितने निष्पक्ष दिखते हैं। यदि ऐसा नहीं होता तो उन्हें राजनीतिक जोखिम का सामना करना होगा जो उनके अंशधारकों और मालिकों को प्रभावित करेगा।

राजनेताओं को भी यह प्रोत्साहन मिल सकता है कि वे मांग करें कि सोशल मीडिया प्लेटफॉर्म के विषयवस्तु प्रबंधन में उन्हें भी दखल का मौका मिले। इससे न केवल इन कंपनियों का परिचालन प्रभावित होगा बल्कि अभिव्यक्ति की आजादी भी प्रभावित होगी। फेसबुक ने अमेरिका और यूरोप में चुनाव जैसी लोकतांत्रिक प्रक्रियाओं के साथ छेड़छाड़ के आरोपों से उपजे क्रोध के बाद ऐसी ताकतों को शांत करने का प्रयास किया है। भारत में भी वह तथा ऐसे अन्य मंच यदि सार्वजनिक रूप से संशोधन नहीं करते उनके लिए जगह नहीं रहेगी।

महाकाव्यों के सबक और दक्षिणपूर्व एशियाई देश

अयोध्या में गत 5 अगस्त को राम मंदिर भूमि पूजन कार्यक्रम के दौरान प्रधानमंत्री नरेंद्र मोदी ने विविध क्षेत्रों में रामायण की लोकप्रियता का उल्लेख किया। उन्होंने खासतौर पर इंडोनेशिया और मलेशिया जैसे मुस्लिम देशों तथा दक्षिण और दक्षिणपूर्वी एशिया के अन्य देशों का जिक्र किया। शायद उनका ध्यान इस बात पर नहीं गया कि राम मंदिर का निर्माण उस स्थान पर हो रहा है जहां एक मस्जिद को तोडऩे का आपराधिक काम किया गया था। क्या इस्लाम को मानने वाले देश वाकई राम मंदिर निर्माण के अवसर पर भारत के हिंदुओं की आस्था का उत्सव मनाने को तैयार रहे होंगे?

दूरदराज और अलग-अलग आस्था वाले देशों में रामायण की लोकप्रियता इस बात का प्रमाण है कि कैसे मानवता की नैतिक दुविधा की सार्वभौमिक अपील है। रामायण और महाभारत जैसे भारतीय महाकाव्य उन्हें ही काव्यात्मक ढंग से दर्शाते हैं। ये दोनों महाकाव्य ऐसी कथा कहते हैं जो धर्म, राजनीति और दार्शनिक विचारों से परे इंसानों को एकदम अपने आसपास की लगती हैं। राम को एक सुनहरी चमकदार इमारत में कैद करना, मर्यादा पुरुषोत्तम के रूप में नैतिक नायक की उनकी सार्वभौमिक अपील को एक स्थानीय देवता के रूप में सीमित करना है जिसके संदेशों का प्रसार करने के लिए पारंपरिक तौर तरीकों की जरूरत होगी। यदि संदेश को प्रसारित करने के लिए ऐसा करना पड़ा तो उसकी सारी आध्यात्मिक विषय वस्तु खो जाएगी। ऐसा लगता है कि प्रधानमंत्री विभिन्न संस्कृतियों में राम का उल्लेख करते समय भी इस बात से अनभिज्ञ थे।

मैं खुशकिस्मत था कि मुझे इंडोनेशिया में भारत के राजदूत के रूप में काम करने का अवसर मिला। मुझे जोगजकार्ता और बाली में कई अवसरों पर रामायण और महाभारत के प्रकरणों का अद्भुत मंचन देखने को मिला। जोगजकार्ता में रामायण का मंचन नौवीं सदी में बने सुप्रसिद्ध प्रंबनन मंदिर के निकट स्थित मंच पर हुआ। यह मंदिर ब्रह्मा, विष्णु और शिव की त्रिमूर्ति को समर्पित है। मुझे ग्रीन रूम में जाने का अवसर भी मिला जहां कलाकार रामायण पर आधारित नृत्य नाटिका की प्रस्तुति के पहले अपनी भूमिकाओं को परख रहे थे और वस्त्र आदि धारण कर रहे थे। जब प्रमुख कलाकारों से मेरा परिचय कराया जा रहा था तब मैं इस बात को लेकर सचेत था कि नमाज का वक्त हो रहा है। इसलिए क्योंकि कई कलाकार उस समय अल्लाह की इबादत कर रहे थे।

आखिरकार मुझे उस स्थान पर ले जाया गया जहां उस शाम के सितारे हनुमान तैयार हो रहे थे। मैं यह देखकर दरवाजे पर ही रुक गया कि मझोली उम्र का वह कलाकार भगवान हनुमान की विशालकाय तस्वीर के समक्ष प्रार्थना कर रहा है। तस्वीर में हनुमान संजीवनी बूटी के लिए द्रोणागिरि पर्वत लेकर श्रीलंका की ओर जा रहे थे ताकि लक्ष्मण को जीवन प्रदान किया जा सके। वह कलाकार गहरे ध्यान में लग रहा था लेकिन शायद उसे हम आगंतुकों के आने का आभास हो गया और उसने ध्यान समाप्त करते हुए हनुमान के समक्ष झुककर अपनी श्रद्धा प्रकट की और फिर मुस्कराते हुए हमारा अभिवादन किया। मैंने उससे पूछा कि वह भगवान हनुमान की तस्वीर के समक्ष क्यों ध्यान लगा रहा था? उसका उत्तर सीधा और सहज था। वह हनुमान का आह्वान कर रहा था कि अपनी आत्मा को उससे एकाकार करे ताकि वह अपनी भूमिका के साथ न्याय कर सके। मुस्लिम होने के बावजूद उसके मन में कोई दुविधा नहीं थी जबकि कुछ कुंद जेहन लोग इसे अपना धर्म छोडऩा बताएंगे।

हम इस बात को समझने में चूक गए कि हमारे महाकाव्यों मेंं दर्ज मानवीय गाथाओं की जो भावना है, उसे इन सुदूर देशों में हमारी तुलना में कहीं अधिक बेहतर समझा गया है। इंडोनेशिया में ही नहीं बल्कि म्यांमार और नेपाल में भी अपने कार्यकाल के दौरान मुझे इस बात ने प्रभावित नहीं किया कि भारत दक्षिणी और दक्षिणपूर्वी एशियाई देशों में सभ्यता का जरिया था बल्कि प्रभावित करने वाली चीज वह प्रेरक शक्ति थी जिसने इन इलाकों में सांस्कृतिक प्रफुल्लता पैदा की। उन्होंने पीढिय़ों से भारतीय व्यापारियों, पुजारियों और जिज्ञासु यात्रियों से अर्जित ज्ञान का प्रयोग किया। उन्होंने यह सब अपनी बुद्धिमता, सौंदर्य की समझ और परिकल्पना से हासिल किया। भारत को इस विरासत पर गर्व करना चाहिए लेकिन इसके साथ ही विनम्रता का भाव भी रहना चाहिए। दूर देशों में रामायण और महाभारत का इतिहास हमारे लिए सबक छिपाए हुए है। इसके अनुसार राम को संकीर्ण धार्मिक क्रियाकलापों और आस्थाओं में समेटकर भारत की धार्मिक और सांस्कृतिक विरासत का उत्सव मनाने के बजाय हमें इंडोनेशिया के हनुमान से यह सीखना चाहिए कि मूल्यों को किस तरह विनम्रतापूर्वक अपनाया जाता है।

प्रधानमंत्री मोदी ने राम मंदिर निर्माण के आंदोलन की तुलना देश की आजादी की लड़ाई से की। यह राम और आजादी की लड़ाई दोनों की अवमानना करने के समान है। जब उन्होंने कहा कि राम हमेशा भक्तों के दिलों में निवास करते हैं तो वह सही थे लेकिन तब राम को एक मानव निर्मित मंदिर की क्या आवश्यकता थी?

कुछ लोग कह सकते हैं कि मंदिर लोगों को उनके अतीत से जोड़ता है। वह एक निरंतरता, एक पहचान देता है। लेकिन भारतीयों के पास पहचान का संकट नहीं है। आस्था, जातीयता, भाषा और संस्कृति के मामले में यहां अनेक पहचान हैं। स्वतंत्रता संघर्ष की बात करें तो उसने इन तमाम पहचानों को एक सूत्र में बांधने का काम किया और हममें नागरिकता की साझा भावना पैदा की। गांधी का राम राज्य भारत के इसी विचार पर आधारित था। जिस राम राज्य के लिए एक भव्य राम मंदिर की आवश्यकता हो वह अपने आप में बहुत सीमित अवधारणा वाला राम राज्य होगा। महात्मा गांधी के नेतृत्व में देश की आजादी के लिए लडऩे वालों को, बाबरी मस्जिद ढहाने का आपराधिक कृत्य करने वालों के साथ एक ही तराजू पर तौलना वैसा ही है जैसे आजादी की लड़ाई को एक हिंसक और अश्लील झड़प के समकक्ष बताना।

इसमें दो राय नहीं कि इतिहास दोबारा लिखा जा रहा है। परंतु इरादा यही है हमें उस नियति से बहुत दूर ले जाया जाए जो 14-15 अगस्त 1947 की मध्य रात्रि को संभव नजर आ रही थी। फिलहाल घटनाक्रम जिस तरह घट रहा है, उसमें भारत के बुनियादी विचार का ह्रास होता नजर आ रहा है।

बेटियों का हक और समाज

पिछले दिनों आए उच्चतम न्यायालय के ऐतिहासिक फैसले के मुताबिक अब बेटों की तरह बेटियां भी जन्म के साथ पैतृक संपत्ति में बराबरी की हकदार होंगीं। गौरतलब है कि इस विषय में 2005 में हिंदू उत्तराधिकार संशोधन अधिनियम बनाया गया था। अब सुप्रीम कोर्ट ने इस मामले में व्यवस्था दी है कि पहले के मामले में भी यह कानून लागू होगा। इसका सीधा अर्थ यह है कि सर्वोच्च अदालत ने अपने फैसले के माध्यम से इस कानून में मौजूद इस विरोधाभास को खत्म कर स्पष्ट कर दिया है कि नौ सितंबर 2005 से पहले अगर पिता की मृत्यु हो गई हो तो भी बेटियों को संपत्ति में बेटों के बराबर हिस्सेदारी मिलेगी। यह प्रावधान अब वैधानिक रूप से बेटियों के जन्म के समय से ही उन्हें संपत्ति में बेटों के समान अधिकारों को मान्यता देता है। इसलिए यह स्पष्ट होना चाहिए कि पैतृक संपत्ति पाने वाले बेटों और बेटियों दोनों को जन्म से ही उत्तराधिकारी बनने का अधिकार प्रदान किया गया है।

सर्वोच्च अदालत का यह निर्णय महिलाओं के प्रति लैंगिक भेदभाव की मौजूदगी वाले हमारे समाज में बड़ा बदलाव लाने वाला साबित होगा। अधिकतर परिवारों में आज भी आर्थिक मोर्चे पर महिलाएं अपनों पर निर्भर हैं। ऐसे सामाजिक ढांचे में यह न्यायिक निर्णय आधी आबादी के लिए समानता और आर्थिक सुरक्षा को पुख्ता करने की ओर एक बड़ा कदम है। यह एक कटु सत्य है कि अपनों के लिए हर परिस्थति में स्नेह और संबल की बुनियाद बनने वाली बेटियां हमेशा एक परायेपन के भाव को जीती रही हैं। इतना ही नहीं, शादी के बाद उनके हिस्से आने वाले कई समझौते और शोषण के हालात की एक अहम वजह उनके पास कोई संपत्ति या आर्थिक संबल नहीं होना रहा है। इसके चलते ‘औरतों का अपना कोई घर नहीं होता’ जैसी बातें किस्से-कहानियों में ही नहीं, असल जिंदगी में भी देखने-सुनने को मिलती रहीं हैं। संविधान द्वारा दिए गए समान नागरिक अधिकारों के बावजूद इस मामले में अधिकारहीन और अपनों पर निर्भर रहना जाने कितनी ही महिलाओं को असहनीय परिस्थतियों में जीने को विवश करता रहा है। ऐसे में बेटियों के लिए समानता के परिवेश और आर्थिक रूप से सशक्त बनने की सोच की शुरुआत अपने ही आंगन से हो, इससे अच्छा क्या हो सकता है? यकीनन संपत्ति में अधिकार मिलना इस दिशा में पहला बड़ा है।

हमारे पारिवारिक ढांचे में बेटियों को लेकर एक परंपरागत सोच हावी रही है। इसके चलते उनके साथ किया जाने वाला व्यवहार भी कहीं न कहीं एक तयशुदा भाव के अनुसार ही किया गया। अफसोस कि अपने ही घर में पनपे और पोषित हुए ऐसे विचार और बर्ताव ने उनके जीवन के हर पहलू पर असमानता और प्रताड़ना की स्थितियां पैदा कर दीं। नतीजतन आधी आबादी के साथ दोयम दर्जे का व्यवहार हर मोर्चे पर देखने को मिल रहा है। जन्म लेने के मानवीय हक से लेकर शिक्षा पाने के अधिकार तक गैर-बराबरी के हालात बन गए। इस भेदभाव के कारण कई कुरीतियों और रूढ़ियों का बोझ भी उनके ही हिस्से आया। ऐसी पक्षपाती सोच का ही नतीजा है कि कई घरों में महिलाओं की राय और भागीदारी का कोई अर्थ नहीं रहता।

महिला हो या पुरुष, घर-परिवार चलाने में दोनों की अहम भूमिका होती है। लेकिन महिलाओं की भागीदारी को न तो सराहा जाता है और न ही सम्मान दिया जाता है। यह फर्क उस भेदभाव भरी सोच के चलते ही बना है जिसमें उन्हें अपने ही घर में हकदार नहीं माना गया। आर्थिक रूप से आत्मनिर्भर न होने के कारण अपनी पसंद-नापसंद बताने-चुनने के मामले में उन्हें अकसर आने कदम पीछे लेने पड़ जाते हैं। ऐसे में व्यापक रूप से देखा जाए तो सुप्रीम कोर्ट के इस फैसले से महिलाएं मजबूत होंगी। भारतीय सामाजिक परिवेश में पैतृक संपत्ति में हक दिलाने वाले इस फैसले के दूरगामी परिणाम बेटियों को मन-जीवन से जुड़े हर मोर्चे पर सशक्त बनाने वाले साबित होंगें।

समानता के बिना सम्मान और सहजता दोनों ही मोर्चों पर कुछ कमी-सी रहती है। हमारे समाज में महिलाओं के साथ होने वाला भेदभाव ही उनके जीवन से बहुत कुछ कम हो जाने की बड़ी वजह है। निस्संदेह, अपने ही घर संपत्ति का हक न पा सकना उनके जीवन में आने वाले हर अधूरेपन की शुरुआती कड़ी माना जा सकता है। यही वजह है कि लंबे समय से महिलाओं के संपत्ति के अधिकार को लेकर कानून में बदलाव की बात होती रही है। समाज का जागरूक वर्ग भी बेटियों को पुश्तैनी जायदाद में उनका हक दिए जाने की चर्चा काफी समय से करता रहा है। इसी के चलते समय-समय पर इससे संबंधित कानून में बदलाव और संशोधन हुए भी हैं। लेकिन बेटियों के लिए पैतृक संपत्ति के समान उत्तराधिकार के मामले में कई उलझनें बनी हुईं थीं।

सुखद है कि कानूनी ही नहीं, मानवीय मोर्चे पर भी यह एक सराहनीय फैसला है। बराबरी के इस हक के बिना अपने आंगन से मन से जुड़ाव रखने वाली बेटियां जीवन में अलग-थलग सी पड़ जातीं थीं। यही कारण रहा कि इस फैसले को सुनाते हुए न्यायालय ने टिप्पणी की कि ‘बेटियों को बेटों के समान अधिकार दिया जाना चाहिए। बेटी जीवन भर एक प्यार करने वाली बेटी बनी रहती है, भले ही उसके पिता जीवित हों या नहीं।’ साथ यह भी कहा गया कि ‘एक बार एक बेटी हमेशा एक बेटी .. बेटा तब तक बेटा होता है, जब तक उसकी शादी नहीं हो जाती। इसीलिए बेटियों को भी बेटे की तरह संपत्ति के बंटवारे में बराबर हिस्सा दिया जाना चाहिए।’ यह जरूरी भी है, क्योंकि यह केवल आर्थिक स्थिति की बेहतरी से जुड़ा मसला नहीं है। यह विवाहित बेटियों को पैतृक धन दिए जाने भर की बात नहीं है, बल्कि सही मायने में उनके स्वतंत्र अस्तित्व को स्वीकार्यता देने की बात है। अक्सर देखने में आता है कि माता-पिता के दुनिया से जाने के बाद अविवाहित बेटियों का अपने ही घर में जीना दूभर हो जाता है। कोई बेटी विधवा हो जाए या शादीशुदा जीवन में अलगाव के हालात बनें, तो भी वह अपने घर नहीं लौट पाती। हमारे यहां परंपरागत रूप से शादी बाद बेटियों को परिवार का सदस्य नहीं माना जाता। अब जब वे जन्म के साथ ही पिता की पैतृक संपत्ति की अधिकारी मानी जाएंगी, तो जीवन के प्रतिकूल हालात में यह पुश्तैनी जायदाद उनके लिए मददगार साबित हो सकेगी। महिलाएं सिर्फ इसलिए शोषण और प्रताड़ना झेलने को मजबूर नहीं होगी कि उनके पास गुजारे के लिए कोई सहारा नहीं, रहने के लिए कोई घर नहीं होता।

शिक्षित, सजग और सशक्त बेटियां किसी भी राष्ट्र का वर्तमान और भविष्य सुदृढ़ बनाती हैं। मायके-ससुराल का पुल कही जाने वाली लाडलियां समग्र समाज में संवेदनाओं और सहअस्तित्व को पोषित करती हैं। आज तो हर क्षेत्र में बेटियां बेटों के बराबर अपनी भागीदारी पुख्ता कर रही हैं। माता-पिता का सहारा भी बनती हैं। बावजूद इसके संपत्ति के बंटवारे के मसले में बंधी-बंधाई लीक पर चलने वाली भारतीय समाज की यह मनमानी वाकई तकलीफदेह थी। सुखद है कि ऐसे कानूनी फैसलों से उनके अधिकारों से जुड़ी जटिलताएं दूर हो रही हैं। इस तरह के फैसलों का असर सामाजिक-पारिवारिक सोच की दिशा तय करने में भी महत्त्वपूर्ण भूमिका निभाएगा। पुश्तैनी संपत्ति के बंटवारे से जुड़ा यह ताजा न्यायिक फैसला स्त्रियों के जीवन के लिए दंश बनी लैंगिक असमानता के हर पक्ष पर सकारात्मक असर डालेगा, जिससे बेटियों के प्रति हमारे समाज-परिवार में विचार और व्यवहार के स्तर पर मौजूद कई दोहरे मानक टूटेंगे।

विवादों में फेसबुक

सोशल मीडिया के जिस मंच को दुनिया भर में अभिव्यक्ति की आजादी का सबसे बड़ा अलंबरदार माना जाता रहा है, उस ‘फेसबुक’ पर इन दिनों जैसी तोहमतें लग रही हैं, वे यकीनन स्वतंत्र अभिव्यक्ति के पैरोकारों को निराश करने वाली हैं। लेकिन उतनी ही चिंताजनक बात यह भी है कि इस कंपनी की एक वरिष्ठ अधिकारी को धमकाने की कोशिश की गई है। फेसबुक की क्षेत्रीय पब्लिक पॉलिसी डायरेक्टर अंखी दास ने दिल्ली पुलिस में इस बाबत शिकायत दर्ज कराई है। विडंबना देखिए, जिस नफरती प्रवृत्ति के खिलाफ कथित नरमी बरतने के आरोपों पर फेसबुक को सफाई देनी पड़ रही है, उसकी अधिकारी अब दूसरी तरफ के असहिष्णु लोगों के निशाने पर हैं। दरअसल, पिछले दिनों एक बड़े अमेरिकी अखबार ने खबर छापी थी कि फेसबुक कंपनी भारत में पक्षपाती भूमिका अपना रही है और सत्ताधारी नेताओं की घोर सांप्रदायिक टिप्पणियों को भी प्रतिबंधित नहीं कर रही। जाहिर है, विपक्ष को एक मौका हाथ लग गया है और वह इसे यूं ही नहीं छोड़ना चाहता।

‘हेट स्पीच’ और नुकसानदेह सामग्रियों के खिलाफ फेसबुक में बाकायदा एक बड़ा विभाग है और उसका काम ही है ऐसी सामग्रियों की निगरानी करना और उन्हें प्रकाशित-प्रसारित होने से रोकना, जो न सिर्फ नस्लीय घृणा, सांप्रदायिक विद्वेष को बढ़ावा देने वाली हों, बल्कि जो मानव स्वास्थ्य को किसी भी रूप में नुकसान पहुंचाने वाली हों। मौजूदा कोरोना काल में हमने देखा और महसूस भी किया कि इसके इलाज के तरह-तरह के टोटकों और फर्जी तजवीजों के खिलाफ फेसबुक ने तत्परता से कदम उठाया। इसमें कोई दोराय नहीं कि यह बेहद मुश्किल काम है, क्योंकि दुनिया भर में हर सेकंड छह नए यूजर इस माध्यम से जुड़ रहे हैं और रोजाना लाखों तस्वीरें व टिप्पणियां इस पर पोस्ट की जा रही हैं। ऐसे में, इस माध्यम की बुनियादी खूबी की रक्षा करते हुए इसके दुरुपयोग को रोकना एक बहुत बड़ी चुनौती है। कंपनी ने प्रकारांतर से स्वीकार भी किया है कि उसे अभी इस दिशा में काम करने की जरूरत है।

लेकिन फेसबुक एक कारोबारी कंपनी है और व्यावसायिक हित-अहित से संचालित उसकी नीतियां तभी तक मान्य हैं, जब तक उसकी पहुंच वाले देशों के आंतरिक मामलों में वे कोई बाधा नहीं खड़ी करतीं। भारत में जो ताजा विवाद खड़ा हुआ है, वह राजनीतिक पक्षधरता से जुड़ा है, इसीलिए इसे गंभीरता से लिया जा रहा है। हालांकि, फेसबुक ने अपनी सफाई पेश की है कि उसकी नीतियां तटस्थता पर आधारित हैं और वे किसी देश की किसी पार्टी से प्रभावित नहीं हैं। लेकिन दुर्योग से कई अन्य देशों में ऐसे ही आरोप उस पर पहले भी लग चुके हैं। तुर्की में तो इस पर प्रतिबंध लगाने के लिए सांसद बाकायदा एक कानूनी मसौदा तैयार कर रहे हैं। हमारे यहां फेसबुक यूजर्स की संख्या 34 करोड़ से भी अधिक है। इतने बड़े बाजार को कंपनी नजरअंदाज नहीं कर सकती, क्योंकि किसी भी कंपनी की तरक्की में साख का बड़ा योगदान होता है। बहरहाल, हमें यह तो देखना ही पडे़गा कि कोर्ई भी बाहरी तत्व हमारी लोकतांत्रिक प्रक्रिया को किसी रूप में प्रभावित न करने पाए। अपनी सुरक्षा के मद्देनजर हमने चीन के दर्जनों एप को अभी हाल में ही प्रतिबंधित किया है, तो फेसबुक और ट्विटर जैसे जन-प्रभावशाली माध्यमों पर भी हमें हर पल नजर रखनी होगी।
