A Neutral Net Will Set the Internet Free

GOI embracing net neutrality is good news

For an administration that believes in levelling playing fields, the Government of India (GoI) has acted according to form by accepting the telecom regulator’s fairly stringent norms on net neutrality. These norms are based on the principle that internet service providers (ISPs) must treat all traffic equally. Free and open access to the internet’s infrastructure is vital for an accelerated, creative and vibrant growth of applications (apps) and services, and to unlock the full potential of a digital economy. In this impending Gold Rush, regulation must ensure non-discriminatory pricing in the carrier-content universe.

For example, if a telecom carrier also owns a streaming app, the latter should be priced exactly the same — free, if that be the case — for consumers no matter where it is housed, whether in the network of the carrier that owns the app, or in other carriers’ networks. Similarly, app developers mustn’t face discriminatory pricing. If an app owned by a carrier is housed for free in that network, no other app should be charged for access. That is, to mix one’s metaphors, a level-playing sea for leviathans, big fish and small fish. A net neutrality-enabled and protected ecosystem will engender a healthy growth for both business and ‘art’ the digital universe holds. Our policymakers have drawn the right lessons from the US Federal Communications Commission’s (FCC) reckless decision to roll back net neutrality, and carve up the web into ‘slow and fast’ lanes, jacking up costs for consumers.

India’s rules bar telecom service providers from blocking or slowing down access to content, or charging consumers more for certain content, giving every net user equal access to all lawful content online at the same speed and cost. Quite rightly, companies can’t buy privileged access to their own sites, or pay networks to hold back consumer access to their competitors’ sites, and thwart new competition. There must be penalties for violation of rules. Over time, as the regulatory regime evolves,ownership of carriers should be divorced from content. Ideally, those owning carriers should not be allowed to own content, that being the best guarantee of neutrality.

Make Consensual Sex Legal, It’s That Simple

It’s extremely simple: people having same-sex relationships cannot be denied the rights, including that of privacy, available to every citizen of India. It is downright tragic — and the shame lies firmly here — that in circa 2018, the Government of India (GoI), as the representative of the Indian State, is caught prevaricating on abolishing the anachronistic, humiliating Section 377 of the Indian Penal Code (IPC) that continues to make consensual same-sex sex illegal. It can’t even afford the excuse of ignorance for its sad ho-humming. Laws are like firm nudges to those — whether out of ignorance or out of spite — bigots who dig their heels into social regression. Demolishing regressive laws sends out the same strong signal. It’s GoI’s ‘yes-no-but’ in taking the right stand, even as it conducted a painful Pontius Pilate act with the Supreme Court regarding Section 377, that is unfortunate, no matter how soon the law is unmade.

The humiliation and the emotional scarring of many homosexuals in this country is real. The government’s worries — a reflection of the worries of many sections in society — are not. Muddying the matter at hand — decriminalising homosexuality — with ‘concerns’ about ‘issues like bestiality and incest’ is ridiculous, and mala fide. It is akin to worrying about a law that seeks to legalise eating as it may proactively encourage forcefeeding, food poisoning, obesity and other horrors. The fundamental notion that those ‘nervous’ about legalising homosexuality are choosing to miss is ‘consensual’. Non-consensual sex —rape — is hardly confined to homosexuality. It is this crime, this illegality, that needs to be cracked down upon. Not having sleepless nights about ‘nice, normal folks’ having lurid nightmares of a Sodom-Gomorrah being unleashed with the legalisation of consensual sex — between persons of any sexuality.

India’s whimsical police force

Its command and control style dates to colonial times, it must look within and reform

When the intriguing news of 119 of 122 IPS probationers failing exams in the National Police Academy – the alma mater that trains IPS officers – broke, it became a talking point not only for the public but even within the IPS fraternity. Many, including non-IPS ranks in the department, are curious what were these exams that failed the ‘to-be police leaders’. Of the 10 lakh people who apply for UPSC civil services exam about 400-1,500 people make it. Of these the IPS officers are about 30-150, and they have higher ranks than those getting other services. How can the cream of the crop that passed such a tough examination as UPSC, fail the academy exams?

IPS training has grown from a handful of subjects into a mega curriculum with almost everything conceivable added to it over the years, with the thought that a police officer must be prepared for any given circumstance. Probationers are trained from assembling/ dismantling weapons (all the latest guns included) to firing, rock climbing, scuba diving, horse riding and gymnastic physical training. Though some of us cannot fathom the relevance of all these, we are taught they make us capable of facing any challenge – whether underground, on the ground, in air or in water! Nevertheless IPS training can be most refreshing and challenging, even world class.Which makes me wonder, though, why do IPS officers bend and falter in the field despite this training? Why aren’t they able to stand up against illegal orders of political masters, the corruption and nepotism that ails the country? How are the brilliant, physically and mentally fit probationers rendered ineffectual in the field?

That is because despite clear cut laws and rules telling the police what to do, policing in India is largely officer-centric and not system-centric. Depending on the officer who heads the district or a city commissionerate, priorities of policing change. A simple example from my experience is – one boss allotted motor bikes to the constables on night rounds, instructing them that they should be continuously mobile on their beats. He thought with motorcycles, they would not waste time on the pretext of being tired. His next incumbent reversed the whole process and went back to the traditional patrol on foot, thinking it ensured the policeman would know each and every house in his beat area and could observe minute details on the street. Both the bosses had the best of intentions, but both failed to put their ideas to the test.

They believed that as their intentions were bona fide, they couldn’t go wrong. Police officers think they cannot go wrong, which is why you will wake up one morning to find that the road you travel everyday has suddenly become ‘one way’. There’s no evidence gathered of the impact or workability of ideas; and no accountability. As a result their ideas, no matter how well intentioned, tend to be no more than whims and fancies. National Police Academy is not an exception. I remember one director placing emphasis on drill with all its variants – foot drill, arms drill, lathi drill – and increasing the drill periods considerably. His belief was that drill was the best way to inculcate ‘discipline’ – the mainstay of the police force; the IPS ought to know the nuances of every drill movement like the salute, the march, etc.  His successor who didn’t see good in it, reversed it. Impact evaluation of different subjects taught in the academy, methodology of teaching, number of hours dedicated to that subject and finally its relevance to field policing is the utmost need of the hour.

But this is realised only by those who have an open mind. Over the years, thousands of IPS officers have visited developed countries at government expense. They have witnessed how in the US, UK and elsewhere police have done away with the superfluous ostentation of raw power. But the Indian police are stuck in time where the British left us. Many in this country join police simply because of the raw power of a colonial/ feudal type that it confers on one vis-a-vis the powerless common man. Some policemen suggest with pride that in this country their survival would have been difficult had they not been in police! If this is the mindset and motivation to join the police, then God save the police. A normal police meeting is one where the boss speaks 90% of the time and juniors only 10%, that too to nod in agreement or pitch thoughts in conformity with the boss’s ideas.

Any other idea is unwelcome and looked down upon as a sign of indiscipline. When IPS officers get together their favourite topic is not policing but comparing their lot with IAS and whining about it. Victimisation of police at the hands of media, human rights commissions, judiciary, social activists, RTI activists is another hot topic at the informal forums. They embrace a defeatist attitude, rationalising that unless society changes, the police cannot change. But whatsoever might be the truth behind the narrative of victimisation of police and deplorable working conditions, that still cannot be the pretext for not embracing reforms. It is time the IPS gave up double standards and began to look within. Most young IPS will agree that whenever they call on their seniors, they are bombarded with stories beginning “In the year so and so, I did this …” What we need, instead, is research and evidence based policing – which tests and thinks through current ways and means of policing.

महानगरों पर दबाव घटाने का यही वक्त है

प्रत्यक्ष करों को केंद्र व राज्य के हिस्से में बांटकर राज्यों को दरें तय करने की रियायत से निकलेगा हल

भारत की फॉर्च्यून 500 कंपनियों में से अधिकांश के कॉर्पोरेट हेडक्वार्टर दिल्ली और मुंबई में हैं। कुछ बेंगलुरू, चेन्नई और हैदराबाद जैसे शहरों में भी हैं। करीब आधा दर्जन भारतीय शहरों में हमारी लगभग सभी शीर्ष कंपनियां स्थित हैं। यही हालत विदेशी कंपनियों के भारतीय मुख्यालयों की है। दूसरी तरफ अमेरिका में फार्चुन 500 कंपनियां समान रूप से पूरे देश में फैली हुई हैं। न्यूयॉर्क, लॉस एंजिलिस, सीएटल और सैन फ्रांसिस्को जैसे मुख्य महानगर होने के बावजूद बड़ी वैश्विक कंपनियों के मुख्यालय कई दर्जन अमेरिकी शहरों जैसे अटलांटा, ह्यूस्टन, ओमहा, रोचेस्टर और डेट्रॉइट में स्थित हैं। इसके विपरीत आपको शायद ही कोई देशी या विदेशी कंपनी ऐसी मिलेगी, जिसका मुख्यालय इंदौर, जयपुर, भुवनेश्वर अथवा गुवाहाटी में हो। कॉर्पोरेट मुखिया ऐसे शहरों में न जाने के कई कारण गिना देंगे। कनेक्टिविटी का अभाव, प्रतिभाओं का उपलब्ध न होना (या वहां जाने में प्रतिभाशाली लोगों की उदासीनता), बच्चों के लिए अच्छे स्कूलों का अभाव और एक्शन की दुनिया से दूर होने का आम अहसास।

जहां पर सारी गहमागहमी हो वहां होने की इस इच्छा और गहमागहमी सिर्फ मुट्‌ठीभर शहरों तक सीमित होने का मतलब है हमारे महानगरों का दम घुटना। पिछले दिनों मुंबई के अंधेरी में पुल ध्वस्त होने से पूरा महानगर ठप पड़ गया। यदि आप मानसून में मुंबई जाएं तो यह ऐसा महानगर लगता है, जैसे विश्वयुद्ध हाल ही में समाप्त हुआ है। दिल्ली और मुंबई में ट्रैफिक अराजक है। घर से दफ्तर जाने में अक्सर दो घंटे से ज्यादा लग जाते हैं। तुलनात्मक रूप से नया मुंबई एयरपोर्ट खचाखच भर चुका है। महानगरों में किसी अच्छे स्कूल में प्रवेश लेना एवरेस्ट चढ़ने जैसा है। दिल्ली का प्रदूषण तो आपकी जान भी ले सकता है। मुंबई में रियल एस्टेट की कीमतें घातक हो सकती हैं। बुनियादी नागरिक सुविधाएं, रियल एस्टेट की उपलब्धता, शिक्षा और ट्रैफिक सब एक ही कहानी कहते हैं- शहरों का दम घुट रहा है। वक्त आ गया है कि हमें वाकई इसके बारे में कुछ करना होगा। इस समस्या का समाधान तो यही है कि 10, 20 या 50 ऐसे शहर सामने आएं, जो इन फट पड़ रहे महानगरों का सच्चा विकल्प दे सकें।

यह कैसे होगा? इन शहरों में जो भी चीज नदारद है- कनेक्टिविटी, शिक्षा के विकल्प या एक्शन न होना वह सब आखिरकार एक ही तथ्य से निकलते हैं और वह है नौकरियों का गुलजार माहौल न होना। जब किसी शहर में उच्च स्तर से लेकर निम्न स्तर तक के ढेर सारे जॉब हों और लोगों के जेब में पैसा आ रहा हो तो शहर अपने आप ऊपर उठने लगता है। 1990 के दशक के उनींदे से बेंगलुरू का उदय संयोगवश कुछ आईटी कंपनियों के शुरू होने से हुआ, जो तेजी से बढ़कर विशालकाय कंपनियां बन गईं। बेशक, बेंगलुरू जैसे संयोग बार-बार नहीं होते। हमें ऐसे प्रयास करने होंगे कि रोजगार पैदा करने वाली दिग्गज कंपनियां खुद ही अन्य छोटे शहरों का रुख करें। हमें बड़ी भारतीय कंपनियों को अपने मुख्यालय अन्य जगहों पर ले जाने के लिए आर्थिक प्रोत्साहन देना होगा। इसी तरह स्टार्टअप या नई आने वाली विदेशी कंपनियों को भी प्रोत्साहित करना होगा कि वे किसी अन्य शहर को भी आजमाए।

एक अच्छा तरीका तो डायरेक्ट टैक्स (आयकर एवं कॉर्पोरेट कर) में सुधार करके उन्हें अधिक संघीय प्रकृति का बनाना होगा। अभी तो केंद्र सरकार व्यक्तियों से आयकर और कंपनियों से कॉर्पोरेट टैक्स वसूलती है। केंद्र सरकार की इस आमदनी का एक हिस्सा फिर राज्यों को बांटा जाता है। यदि आप आयकर और कॉर्पोरेट कर को केंद्र और राज्यों के भाग में बांट लें (काफी कुछ मौजूदा सीजीएसटी और एसजीएसटी की तरह) और राज्यों को यह छूट दें कि वे करों के राज्य के हिस्से की दरें खुद तय करें। यह भारत के लिए गेम चेंजर साबित हो सकता है। न सिर्फ इससे हमारे महानगरों पर दबाव घट सकता है बल्कि रोजगार भी बेहतर तरीके से देशभर में फैल सकता है। उदाहरण के लिए मान लें कि कॉर्पोरेट टैक्स की दर 30 फीसदी है। आइए, इसे 15 फीसदी सेंट्रल कॉर्पोरेट टैक्स और 15 फीसदी राज्य कॉर्पोरेट टैक्स में विभाजित करें। फिर मान लें कि छत्तीसगढ़ और ओडिशा अपने यहां कंपनियों को आमंत्रित करना चाहते हैं। वे 5 फीसदी स्टेट कॉर्पोरेट टैक्स का प्रस्ताव रख सकते हैं, जिससे कंपनी के लिए कर की दर 20 फीसदी हो जाएगी (15 फीसदी केंद्र, 5 फीसदी राज्य)।

इस तरह 10,000 करोड़ रुपए मुनाफे वाली कंपनी हर साल 3,000 करोड़ रुपए टैक्स देती थी, वह यदि इन शहरों में जाने का फैसला करते है तो 2,000 करोड़ रुपए टैक्स देगी। सालाना 1,000 करोड़ रुपए की यह बचत किसी कंपनी को अन्य स्थान पर जाने को प्रोत्साहित करेगी। एक बार कंपनी वहां चली जाए तो उसके साथ हजारों जॉब वहां जाएंगे। इन नए आने वाले लोगों को सेवा देने के लिए कई और जॉब निर्मित होंगे जैसे मनोरंजन, शिक्षा, रियल एस्टेट और अन्य सेवाएं। जिस महानगर से कंपनी आएगी, उसे राहत मिलेगी। नए शहर की अर्थव्यवस्था को बढ़ावा मिलेगा। हां राज्य को कर की कुछ आमदनी खोनी पड़ेगी लेकिन, राज्य की अर्थव्यवस्था में जो उछाल आएगा उससे इस घाटे का औचित्य सिद्ध हो जाएगा।

सच तो यह है कि कुछ स्थानों के लिए तो केंद्र भी करों की अपनी हिस्सेदारी में डिस्काउंट दे सकता है। कल्पना कीजिए कि यदि कंपनियां जम्मू-कश्मीर और पूर्वोत्तर में जाएं और 30 फीसदी की बजाय सिर्फ कुल 5 फीसदी टैक्स ही दें। शुरुआती कठिनाइयों के बावजूद कंपनियां वहां जाएंगी, क्योंकि उनकी स्प्रेडशीट एक दशक में बचत की विशाल राशि दिखाएगी। क्या इससे इन क्षेत्रों को बहुत बड़ा बूस्ट नहीं मिलेगा? क्या इससे कश्मीर में स्थिति सुधारने में मदद नहीं मिलेगी, जब पत्थर फेंकने वालों को अपने ही क्षेत्र में अच्छे जॉब मिल जाएंगे? आमदनी पैदा करने के अलावा सरकार के पास टैक्स नीति भी ढेर सारी समस्याएं सुलझाने के लिए अच्छा औजार है- महानगरों का खचाखच भर जाना, भीतरी क्षेत्रों में रोजगार ले जाना और उपद्रवग्रस्त क्षेत्रों को मदद पहुंचाने जैसी समस्याएं। यदि हम अपने प्रत्यक्ष करों की प्रकृति अधिक संघीय बना दें और राज्यों को कॉर्पोरेट गतिविधियां आमंत्रित करने के लिए टैक्स घटाने की अनुमति दें तो हमारे महानगरों पर से दबाव कम करने और नए चमकते महानगर बनाने में बहुत मदद मिल सकती है।

तेल पर निर्भरता घटाने का वक्त

भारत ने देर से ही सही, तेल निर्यातक देशों के संगठन ओपेक पर कच्चे तेल की कीमतों में कटौती के लिए दबाव डालते हुए उचित कदम उठाया है। यद्यपि 1 जुलाई से ओपेक ने कच्चे तेल के उत्पादन में लगभग 10 लाख बैरल प्रतिदिन (बीपीडी) की बढ़ोतरी की है, लेकिन हकीकत यह है कि कीमतें अब भी कम नहीं हो पाई हैं। नि:संदेह बीते कुछ वक्त से तेल की लगातार बढ़ती कीमतें भारत के लिए चिंता का सबब बनी हुई हैं। भारत अपनी जरूरत का अस्सी फीसदी कच्चा तेल आयात करता है। जाहिर है, तेल की बढ़ती कीमतों से देश का आयात बिल भी बढ़ रहा है। इससे देश में डॉलर की मांग बढ़ गई है और इस कारण विदेशी मुद्रा कोष में तेजी से गिरावट आ रही है। गौरतलब है कि11 जुलाई को देश के विदेशी मुद्रा कोष का स्तर 405 अरब डॉलर रह गया, जो एक माह पहले 425 अरब डॉलर के स्तर पर था। डॉलर की मांग बढ़ने से भारतीय रुपए के मूल्य में भी गिरावट आ रही है।हाल ही में दुनिया की ख्यात क्रेडिट रेटिंग एजेंसी मूडीज ने कहा है कि अमेरिका और चीन के बीच छिड़े ट्रेड वार, अंतरराष्ट्रीय स्तर पर कच्चे तेल के बढ़ती कीमतों और रुपए की कीमत में ऐतिहासिक गिरावट से अब पेट्रोल और डीजल में आ रही तेजी भारतीय अर्थव्यवस्था के लिए बड़ा खतरा है।

दुनिया के मशहूर निवेश बैंकों- बैंक ऑफ अमेरिका मेरिल लिंच, मार्गन स्टेनले और ग्लोबल ब्रोकरेज फर्म सीएलएसए द्वारा भी कुछ ऐसी ही आशंकाएं जाहिर की गई हैं। अर्थ विशेषज्ञों का कहना है कि कोई एक-दो दशक पहले मानसून का बिगड़ना भारतीय अर्थव्यवस्था के लिए आर्थिक-सामाजिक चिंता का कारण बन जाया करता था, लेकिन अब मानसून के धोखा देने पर भी अर्थव्यवस्था पर पड़ने वाले प्रतिकूल प्रभावों को काफी कुछ नियंत्रित कर लिया जाता है। जबकि कच्चे तेल की कीमतें अंतरराष्ट्र्रीय हलचलों और तेल उत्पादक देशों की नीतियों से प्रभावित होती हैं, जिस पर भारत का नियंत्रण नहीं है। यहां पर तेल आयात को लेकर भारत के समक्ष एक और बड़ी चिंता सामने है। पिछले दिनों अमेरिका ने भारत और चीन सहित सभी देशों को ईरान से कच्चे तेल का आयात 4 नवंबर तक बंद करने के लिए कहा है। उसका यह फरमान न मानने वाले देशों पर उसने सख्त आर्थिक प्रतिबंध लगाने की धमकी दी है। जाहिर है, इससेे भारत के समक्ष एक तरह की विकट स्थिति पैदा हो गई है। भारत में इराक और सऊदी अरब के बाद सबसे ज्यादा कच्चा तेल ईरान से मंगाया जाता है।

ईरान को भारत के द्वारा यूरोपीय बैंकों के माध्यम से यूरो में भुगतान किया जाता है। डॉलर की तुलना में यूरो में भुगतान भारत के लिए लाभप्रद है।  इसके अलावा ईरान से किया जाने वाला कच्चे तेल का आयात सस्ते परिवहन के चलते भी भारत के लिए फायदेमंद है। इतना ही नहीं, ईरान भारत को भुगतान के लिए 60 दिनों की क्रेडिट देता है, जबकि दूसरे देश सिर्फ 30 दिन की ही क्रेडिट देते हैं। यद्यपि भारत के लिए कच्चे तेल के आयात हेतु ईरान का विकल्प तलाशना मुश्किल नहीं होगा, लेकिन उस नए विकल्प के साथ हमें ऐसी तमाम सहूलियतें शायद न मिलें, जो फिलहाल ईरान हमें देता है। इन तमाम परिस्थितियों को देखते बेहतर यही होगा कि भारत जहां एक ओर तेल की कीमतों में कटौती के लिए ओपेक पर लगातार दबाव बनाए रखे, वहीं अपनी ऊर्जा संबंधी जरूरतों की पूर्ति के लिए तेल के बजाय अन्य विकल्पों को बढ़ावा देने की नीति अख्तियार करे।  पिछले महीने दुनिया के तीन में से दो सबसे बड़े तेल उपभोक्ता देश चीन और भारत ने साथ मिलकर तेल उत्पादक देशों पर कच्चे तेल की कीमतें वाजिब किए जाने का दबाव बनाने हेतु संयुक्त रणनीति को अंतिम रूप दिया। इसके तहत सबसे पहले ओपेक संगठन पर कच्चे तेल का उत्पादन बढ़ाने हेतु दबाव बनाया गया, जो सफल रहा।

ज्ञातव्य है कि एशियाई देशों के लिए तेल आपूर्तियां दुबई या ओमान के कच्चे तेल बाजारों से संबंधित होती हैं, नतीजतन उनसे यूरोप व उत्तरी अमेरिका के देशों की तुलना में कुछ अधिक कीमतें ली जाती हैं। कीमतों के इस आधिक्य को ‘एशियाई प्रीमियम की संज्ञा दी गई है।  यह एशियाई प्रीमियम अमेरिका या यूरोपीय देशों की तुलना में प्रति बैरल करीब छह डॉलर अधिक है। इस संदर्भ में भारत और चीन का तर्क है कि चूंकि वे दुनिया में बड़े तेल आयातक देश हैं, अतएव उनसे एशियाई प्रीमियम वसूल करने के बजाय उन्हें बड़ी मात्रा में तेल खरीदी का विशेष डिस्काउंट दिया जाना चाहिए। यदि भारत व चीन अपने गठजोड़ का विस्तार करते हुए इसमें दो और बड़े तेल उपभोक्ता देश दक्षिण कोरिया व जापान को भी भागीदार बना लें तो ये चारों संगठित रूप से तेल उत्पादक देशों से कीमतों को लेकर ज्यादा प्रभावी ढंग से मोलभाव कर सकेंगे। इसके साथ-साथ देशवासियों को पेट्रोल और डीजल की महंगाई से बचाने के लिए सरकार अपनी ऊर्जा नीति को नए सिरे से तैयार करने पर ध्यान केंद्रित करे तो बेहतर होगा।

हमारा देश इस वक्त तेजी से विकास पथ पर अग्रसर है और ऐसा अनुमान है कि वर्ष 2030 तक देश की ऊर्जा संबंधी मांग बहुत तेजी से बढ़ेगी। इस अवधि में यह मांग दुनिया के किसी भी अन्य देश की तुलना में तेज हो सकती है। कच्चे तेल के आयात पर इसकी निर्भरता में भी इजाफा होगा।  ऐसे में यह आवश्यक है कि सरकार एक एकीकृत ऊर्जा नीति तैयार करे। अब ऐसे उपाय करना अपरिहार्य हो गया है, जिससे तेल पर हमारी निर्भरता घटे।  इस हेतु सरकार इलेक्ट्रिक से चलने वाले वाहनों को बढ़ावा दे। ऐसे वाहनों पर टैक्स की दरें कम रखी जाएं और यदि जरूरी लगे तो सबसिडी भी दी जाए। इस संदर्भ में केंद्र सरकार जून में नीति आयोग द्वारा दिए गए उस महत्वपूर्ण सुझाव पर भी गौर करे, जिसमें कहा गया है कि राज्य परिवहन निगमों को यह लक्ष्य दिया जाए कि वे अपने परिवहन बेड़े में एक निश्चित प्रतिशत में इलेक्ट्रिक वाहनों को शामिल करें। इसके साथ-साथ केंद्र व राज्य सरकारें लोक परिवहन सेवा को सरल और कारगर बनाने के भी उपाय करें, ताकि ज्यादा से ज्यादा लोग इसे अपनाने के लिए प्रोत्साहित हों।

यह भी उपयुक्त होगा कि तेल की कीमतों में राहत देने के लिए पेट्रोल और डीजल को जीएसटी के दायरे में लाया जाए। इसके साथ-साथ राज्य सरकारों को भी एक न्यूनतम दर पर वैट लगाने की अनुमति दी जाए, ताकि उनकी आमदनी में एकदम कमी न आए और लोगों को भी कम दर पर पेट्रोल व डीजल प्राप्त हो सके। सरकार द्वारा तेल बाजार में समय और मूल्य आधारित नीतिगत हस्तक्षेप के मद्देनजर तेल कीमतों को एक मानक स्तर से नीचे रखकर अर्थव्यवस्था में वस्तुओं एवं सेवाओं की खपत को बढ़ावा दिया जाना चाहिए। हम आशा करें कि भारत तेल कीमतों पर नियंत्रण और ओपेक संगठन से सस्ते कच्चे तेल के मोलभाव के लिए चीन के साथ-साथ दक्षिण कोरिया और जापान से गठजोड़ बनाने की डगर पर आगे बढ़ेगा और यह गठजोड़ कच्चे तेल की कुछ कीमत घटाने में कामयाब होगा। इसके साथ-साथ भारत पेट्रोल और डीजल के उपयोग में कमी लाने के लिए सार्वजनिक परिवहन प्रणाली और इलेक्ट्रिक वाहनों के प्रयोग की दिशा में भी तेजी से आगे बढ़ेगा। ऐसे प्रयासों से ही देश की अर्थव्यवस्था कच्चे तेल की बढ़ती कीमतों के नकारात्मक असर से निपट सकती है।

इंटरनेट समानता

दूरसंचार आयोग ने नेट निरपेक्षता के नियमों को स्वीकार कर लिया है। इसका देश में इंटरनेट के भविष्य पर दूरगामी प्रभाव होगा। यह एक खुला मंच बना रहेगा और इंटरनेट सेवा प्रदाता (आईएसपी) सामग्री को ब्लॉक करने, इंटरनेट की गति कम करने, किसी खास सामग्री को धीमी गति से दिखाने अथवा अलग-अलग सामग्री के लिए अलग-अलग गति देने जैसे काम नहीं कर पाएंगे। नेट निरपेक्ष व्यवस्था में छोटे कारोबारियों और व्यक्तियों को अपनी सामग्री बनाने और प्रस्तुत करने की सुविधा रहेगी। उन्हें यह आशंका नहीं रहेगी कि बड़े प्रतिस्पर्धी उनकी सामग्री को दबा देंगे या आईएसपी उसका दम घोंट देंगे। उस दृष्टि से देखें तो नेट निरपेक्षता समूची डिजिटल व्यवस्था में नवाचार को बढ़ावा देने में मददगार होगी। नेट निरपेक्षता सुनिश्चित करने की जरूरत उन क्षेत्रों में अधिक है जहां सीमित आईएसपी काम कर रहे हैं। देश के ग्रामीण इलाकों में कई ऐसी जगहें हैं जहां कवरेज बहुत सीमित है। यह निर्णय अमेरिका द्वारा अपने नेट निरपेक्षता नियमों को रद्द करने के एक महीने के भीतर आया है। यह बिना गैर भेदभाव वाली नेट व्यवस्था को लेकर भारत की प्रतिबद्घता को दोहराता है।

तकनीकी ढंग से देखें तो इसके लिए अनुपालन की निगरानी करनी होगी तथा उपभोक्ताओं की शिकायतों को स्वीकार करना और नियम उल्लंघन करने वालों को दंडित करना होगा। अतीत में दूरसंचार कंपनियों ने अक्सर यह दलील दी है कि सख्ती वाली नेट निरपेक्षता व्यवस्था से नवाचार की राह बाधित हो सकती है। परंतु इस दलील को स्वीकार करना मुश्किल है क्योंकि बीते दो दशक से अधिक वक्त से इंटरनेट निरपेक्ष रहा है और इस दौरान हमें ढेरों नवाचार देखने को मिले हैं। बहरहाल नेट निरपेक्ष व्यवस्था निश्चित तौर पर दूरसंचार सेवा प्रदाताओं की उस आजादी को बाधित करता है जिसके तहत वे खास सामग्री प्रस्तुत करने वालों या ऐप डेवलपर के लिए अनुकूल परिस्थितियां बना सकते थे। यह राजस्व कमाने के नए जरियों की भी राह रोकने वाली बात है। भारत एक अत्यधिक प्रतिस्पर्धी बाजार है। यहां दूरसंचार सेवा प्रदाता अपने कर्ज चुकाने की खातिर राजस्व जुटाने के फेर में रहते हैं। नेट निरपेक्षता की सख्ती को प्रतिबंधात्मक रुख माना जा सकता है। उदाहरण के लिए नेट निरपेक्षता के अधीन दूरसंचार सेवा प्रदाता जीरो रेटिंग सेवाओं की पेशकश नहीं कर सकते। इन सेवाओं के लिए वे उपभोक्ताओं से अपने साझेदारों द्वारा प्रस्तुत वेबसाइट या सामग्री की सर्फिंग के लिए कम शुल्क वसूल करते हैं।

वे अपने डिजिटल भुगतान बैंक को अन्य प्रतिस्पर्धियों पर तरजीह भी नहीं दे सकते। अब फेसबुक के फ्री बेसिक्स जैसी कोई चीज भी नहीं पेश कर सकते। सोशल मीडिया की इस दिग्गज कंपनी ने विभिन्न दूरसंचार सेवा प्रदाताओं के साथ मिलकर फेसबुक तक नि:शुल्क पहुंच मुहैया कराई गई थी।  नेट निरपेक्षता का एक अन्य प्रमुख तत्व यह है कि कुछ अहम सेवाओं को इससे रियायत दी जा सकती है। अब यह सरकार को तय करना है कि किन सेवाओं को नियामक अपवाद स्वरूप प्राथमिकता दे सकता है। ऐसे में यह जरूरी है कि अपवादों का इस्तेमाल बड़ी इंटरनेट कंपनियों द्वारा अपने फायदे के लिए न किया जाए। कुछ मामलों में ये अपवाद उचित हो सकते हैं। उदाहरण के लिए आपातकालीन दूरवर्ती इलाज और टेलीमेडिकल सेवाओं को तेज गति की आवश्यकता हो सकती है। यही बात आपदा प्रबंधन पर या श्रद्घालुओं आदि की भीड़ के प्रबंधन पर भी लागू हो सकती है। स्मार्ट पावर ग्रिड के प्रबंधन जैसी हाई टेक सेवाओं को भी प्राथमिकता की जरूरत हो सकती है। इसके अलावा स्वायत्त कार संचार या ड्रोन परिचालन को भी प्राथमिकता की जरूरत हो सकती है। कुल मिलाकर इस नीति से नवाचार को बढ़ावा ही मिलना चाहिए। यह छोटे कारोबारियों से लेकर कलाकारों तक सबको बिना भय के अपनी सामग्री प्रस्तुत करने का अवसर देगी।

न हो उपेक्षा और उत्पीड़न

हाल ही में 8 जुलाई को संयुक्त राष्ट्र संघ के लिए एजवेल रिसर्च एंड एडवोकेसी सेंटर द्वारा भारत में बुजुर्गों की स्थिति पर किए गए सर्वेक्षण पर आधारित प्रस्तुत की गई चिंताजनक रिपोर्ट को देश और दुनिया में गंभीरतापूर्वक पढ़ा जा रहा है। इस रिपोर्ट में कहा गया है कि भारत में 60 वर्ष से अधिक उम्र के 52.4 फीसदी वृद्धजन उपेक्षा और उत्पीड़न का सामना करते हैं। रिपोर्ट में कहा गया है कि देश के 88.5 फीसदी बुजुर्ग स्वास्थ संबंधी सुविधाओं की अपेक्षा कर रहे हैं। साथ ही, उनकी सरकार से भी अपेक्षा है कि सरकार आर्थिक-सामाजिक कल्याण के लिए और अधिक व्यावहारिक सुविधाएं उपलब्ध कराए। रिपोर्ट में यह भी कहा गया है कि वृद्धजनों को आर्थिक तर पर आत्मनिर्भर बनाने के रणनीतिक प्रयास जरूरी हैं। इसी प्रकार पिछले माह जून में देश के प्रमुख गैर-सरकारी संगठन हेल्पेज इंडिया द्वारा देश के प्रमुख 23 शहरों में वरिष्ठ नागरिकों के जीवन की मुश्किलों पर प्रकाशित सर्वेक्षण रिपोर्ट के अनुसार वरिष्ठ नागरिकों के साथ दुर्व्यवहार की चिंताएं लगातार बढ़ती जा रही हैं। इन 23 शहरों में मेंगलुरू में सबसे अधिक दुर्व्यवहार के मामले सामने आए हैं। यहां 47 फीसदी वरिष्ठ नागरिकों के साथ दुर्व्यवहार के मामले पाए गए हैं।  इसके बाद अहमदाबाद और भोपाल के क्रम हैं, जहां 39-39 फीसदी वरिष्ठ नागरिकों के साथ दुर्व्यवहार हुआ।

इस शोध से यह भी मालूम हुआ है कि भारतीय वरिष्ठ नागरिकों के साथ दुर्व्यवहार के कारण क्या हैं? सर्वेक्षण में पाया गया कि देश के करीब एक-चौथाई वरिष्ठ नागरिकों के साथ बदसलूकी का व्यवहार हुआ है। वरिष्ठ नागरिकों के साथ सबसे अधिक दुर्व्यवहार करने वाले उनके बेटे और बहुएं हैं। 52 फीसदी बेटों ने और 34 फीसदी बहुओं ने अपने वरिष्ठ नागरिकों के साथ दुर्व्यवहार किया। हेल्पेज इंडिया ने वरिष्ठ नागरिकों के लिए देशव्यापी कैंपेन हैशटैग डिसकनेक्ट 2 कनेक्ट शुरू किया है। इसके तहत युवाओं और वयस्कों से आग्रह किया जा रहा है कि खुद को मोबाइल और कंप्यूटर से अलग करें और घर में बुजुर्गों की मौजूदगी को महसूस करके उन्हें सम्मान दें। गौरतलब है कि देश में वरिष्ठ नागरिकों के लिए आर्थिक-सामाजिक कल्याण की तेजी से बढ़ती हुई जरूरत से संबंधित कई रिपोर्टे लगातार प्रकाशित हो रही हैं। संयुक्त राष्ट्र की वरिष्ठ नागरिकों की स्थिति से संबंधित एक ताजा रिपोर्ट में खुलासा हुआ है कि भारतीय समाज में वरिष्ठ नागरिकों को परिवार से अपेक्षित सम्मान में कमी आती जा रही है।

अधिकांश भारतीय वरिष्ठ नागरिक अपने ही घर में उपेक्षित और एकाकी जीवन जीने को अभिशप्त हैं। वरिष्ठ नागरिकों में अस्वस्थ होने का अनुपात तेजी से बढ़ा है। विश्व जनसंख्या रिपोर्ट के अनुसार भारत में 2018 में वरिष्ठ नागरिकों की आबादी 15 करोड़ के पार पहुंच गई है। पिछली जनगणना 2011 में भारत में 10.38 करोड़ लोग 60 वर्ष से अधिक आयु के बताए गए थे । रिसर्च एंड एडवोकेसी सेंटर ऑफ एजवेल फाउंडेशन के एक सर्वेक्षण में शामिल भारत के 60 फीसदी लोगों ने कहा है कि युवा पीढ़ी बुजुर्गों की समस्याओं के प्रति जागरूक नहीं है। वरिष्ठ नागरिकों के प्रति अपराध बढ़ने की प्रवृत्ति लगातार बढ़ती जा रही है। 20 मार्च, 2018 को केंद्रीय गृह मंत्रालय द्वारा प्रकाशित ‘‘भारत में अपराध’ नामक रिपोर्ट में कहा गया है कि वरिष्ठ नागरिकों के प्रति अपराध वर्ष प्रतिवर्ष बढ़ रहे हैं। कहा गया है कि वर्ष 2014 में वरिष्ठ नागरिकों के प्रति अपराध के 18,714 मामले दर्ज किए गए थे। इन दर्ज मामलों की संख्या वर्ष 2015 में 20,532 तथा वर्ष 2016 में 21,410 हो गई। वरिष्ठ नागरिकों के प्रति दर्ज ऐसे अपराधों में पहले क्रम पर महाराष्ट्र है। फिर मध्य प्रदेश, तमिलनाडु, आंध्र प्रदेश और तेलंगाना हैं। निस्संदेह तेजी से बढ़ती हुई वरिष्ठ नागरिकों की सामाजिक-आर्थिक मुश्किलों को कम करने के लिए केंद्र सरकार एक के बाद एक कदम उठाते हुए दिखाई दे रही है।

हाल में केंद्र सरकार के सामाजिक न्याय एवं अधिकारिता मंत्रालय ने माता-पिता और वरिष्ठ नागरिकों की देखभाल और कल्याण कानून, 2007 की समीक्षा करने के बाद इसकी कमियों को दूर करते हुए एक नया ड्राफ्ट तैयार किया है। इसे माता-पिता और वरिष्ठ नागरिकों की देखभाल और कल्याण कानून, 2018 नाम दिया गया है। यह मसौदा शीघ्र ही नये कानून का रूप लेगा। इस कानून के तहत बूढ़े माता-पिता को बेसहारा छड़ने या तंग करने वालों को छह महीने तक जेल काटनी पड़ सकती है। अभी इसके लिए तीन महीने तक की जेल का प्रावधान है। नये ड्राफ्ट में मासिक देखभाल भत्ते की 10 हजार रुपये की अधिकतम सीमा भी समाप्त कर दी गई है। जहां वरिष्ठ नागरिकों को कानूनी सहारा देने के लिए नये कानून का मसौदा महत्वपूर्ण दिखाई दे रहा है, वहीं सरकार ने वरिष्ठ नागरिकों के आर्थिक कल्याण के लिए भी कुछ महत्वपूर्ण योजनाएं प्रस्तुत की हैं। पिछले दिनों वरिष्ठ नागरिकों के लिए सरकार ने प्रधानमंत्री वय वंदना योजना (पीएमवीवीवाई) के तहत निवेश सीमा को वर्तमान 7.5 लाख रुपये से दोगुना कर 15 लाख रुपये करने को मंजूरी दे दी है। पीएमवीवीवाई 60 साल और उससे अधिक उम्र के नागरिकों के लिए है। इस योजना में निवेश की समय सीमा 4 मई, 2017 से 3 मई, 2018 थी।

अब इसे बढ़ाकर 31 मार्च, 2020 कर दिया गया है। योजना के तहत लाभार्थी को दस साल की अवधि के लिए न्यूनतम 1,000 रु. पेंशन प्रति माह की गारंटी है। निश्चित रूप से अब सरकार द्वारा माता-पिता को सहारा देने और वरिष्ठ नागरिकों के कल्याण से संबंधित वरिष्ठ नागरिक कल्याण अधिनियम, 2018 के नये ड्राफ्ट के तहत बूढ़े माता-पिता को बेसहारा छोड़ने या तंग करने वालों को छह माह तक जेल काटने जैसे कठोर प्रावधानों को जल्दी ही अंतिम रूप दिया जाना चाहिए। साथ ही, व्यावहारिक जीवन में इस कानून का अधिकतम उपयोग सुनिश्चित किया जाना होगा। निश्चित रूप से संयुक्त राष्ट्र संघ के लिए एजवेल रिसर्च एवं एडवोकेसी सेंटर द्वारा प्रस्तुत की गई रिपोर्ट, 2018 के मद्देनजर हम हमारे वरिष्ठ नागरिकों के आर्थिक-सामाजिक कल्याण पर उपयुक्त ध्यान देंगे तो इससे केवल उनके चेहरे पर खुशियों की नई मुस्कराहट आ सकेगी वरन् इससे भारत खुशहाल देश बनने की डगर पर भी आगे बढ़ेगा।

अफवाह पर शिकंजा

पिछले कुछ समय से लगातार ऐसी घटनाएं सामने आ रही हैं जिनमें बच्चा चोरी या किसी अन्य अफवाह के असर में लोगों की भीड़ जमा हो गई और किसी निर्दोष व्यक्ति को पीट-पीट कर मार डाला। आमतौर पर ऐसी अफवाहें फैलाने के लिए आज हर हाथ में मौजूद स्मार्टफोन के वाट्सऐप का सहारा लिया गया। फेसबुक या ट्विटर जैसे सोशल मीडिया के अलग-अलग मंचों से भी ऐसे ऑडियो या वीडियो संदेश प्रसारित कर दिए गए, जिनका कोई आधार नहीं था, लेकिन अपने असर में उसने संवेदनशील हालात खड़े कर दिए। कई बार इस तरह के फर्जी संदेश या भड़काऊ वीडियो बिना किसी पुष्टि के जारी कर दिए जाते हैं जिससे लोगों के बीच उन्माद का माहौल बन जाता है। जबकि जिस घटना के संदर्भ में उसका हवाला दिया जाता है, वह पूरी तरह गलत होती है और किसी के लिए भी जानलेवा साबित हो जाती है। निश्चित रूप से यह स्थिति चिंताजनक है और इस पर लगाम लगाने की जरूरत है। इसी के मद्देनजर हाल ही में भारत सरकार ने फर्जी खबरें फैलाने के लिए किसी मंच का उपयोग किए जाने पर कड़ी कार्रवाई करने की चेतावनी जारी की थी।

अच्छा यह है कि अब यू-ट्यूब, वाट्सऐप और ट्विटर ने भी यह कहा है कि भ्रामक सूचनाओं, संदेशों और विवादित वीडियो पर शिकंजा कसा जाएगा। गौरतलब है कि पिछले दिनों ऐसे सवाल उठे थे कि फेसबुक और उसके स्वामित्व वाले वाट्सऐप के जरिए ऐसी फर्जी खबरें धड़ल्ले से फैलाई जा रही हैं, जिनका कोई आधार नहीं होता। लेकिन ये खबरें एक बार जब लोगों के बीच चली जाती हैं तो उसकी सच्चाई की पुष्टि करना लोग जरूरी नहीं समझते और उसके असर में अपना और दूसरों का बड़ा नुकसान कर डालते हैं। मुश्किल यह है कि हमारे यहां ज्यादातर लोग ऐसे सामाजिक प्रशिक्षण से नहीं गुजरते जिनमें अपने पास आई किसी सूचना के सही और गलत के बीच फर्क करने के बाद ही उस पर अपनी राय बनाने की समझ पैदा की जाती हो। सुनी-सुनाई बातों पर पहले भी लोगों के आवेश में आने और किसी दुखद घटना को अंजाम देने की खबरें आती रही हैं। लेकिन जब से इंटरनेट और स्मार्टफोन का प्रसार व्यापक हुआ है, तब से इस प्रवृत्ति ने ज्यादा नकारात्मक रुख अख्तियार कर लिया है।

इसमें कोई संदेह नहीं कि विज्ञान के हिस्से के तौर पर कोई भी तकनीक अपने आप में एक निरपेक्ष औजार है। लेकिन यह इसे इस्तेमाल करने वाले व्यक्ति पर निर्भर है कि वह इसका उपयोग सकारात्मक काम के लिए करता है या नकारात्मक के लिए। अपनी शुरुआत के बाद से अब तक इंटरनेट ने इस दुनिया को बहुत कुछ अच्छा दिया है। लेकिन यह भी हकीकत है कि स्मार्टफोन या इंटरनेट का इस्तेमाल आज सूचना और ज्ञान हासिल करने से अलावा ऐसे संदेशों को फैलाने में भी हो रहा है, जिनकी जद में आने के बाद लोग किसी खबर के सही या गलत होने का अंदाजा लगा पाने में सक्षम नहीं रह जाते हैं। यह स्थिति बहुत सारे लोगों को एक हिंसक भीड़ में तब्दील कर रही है। सोशल मीडिया के जरिए फैलाए गए कई संदेशों को देख कर साफ लगता है कि नफरत या हिंसा फैलाने के एजंडे के तहत उन्हें संगठित और सुनियोजित तरीके से तैयार किया गया है। जाहिर है, वाट्सऐप, फेसबुक या ट्विटर जैसे सोशल मीडिया के मंचों पर अफवाह के संदेशों पर नजर रखने की जरूरत है। लेकिन नफरत, उन्माद या हिंसा फैलाने के मकसद से फर्जी संदेश या वीडियो को तैयार करने वालों तक पहुंचना और उनके खिलाफ सख्त कार्यवाही ज्यादा जरूरी है।

छोटी बचत योजनाओं में निवेश बढ़ने के मायने

यह सोना, रियल एस्टेट व बैंक जमा की जगह म्युचुअल फंड, शेयर बाजार और छोटी बचत योजनाओं में निवेश का दौर है। वर्ष 2011-12 में छोटी बचत योजनाओं पर कुल निवेश सिर्फ 31 अरब रुपये था, मगर 2017-18 में 50 गुना बढ़कर यह1,550 अरब रुपये हो गया। नेशनल सेविंग्स इंस्टीट्यूट (एनएसआई) ने भारत में बदलते हुए निवेश की प्रवृत्ति रिपोर्ट-2018 में कहा गया है कि लोग अब सोना खरीदने, रियल एस्टेट में निवेश और बैंकों के बचत खातों में रुपया जमा करने की जगह म्युचुअल फंडों, शेयर बाजार और छोटी बचत योजनाओं में तुलनात्मक रूप में बड़ा निवेश कर रहे हैं। रिपोर्ट के अनुसार हालांकि देश में छोटी बचत योजनाओं के ब्याज दर में कमी आई है, फिर भी डाकघर बचत जमा, राष्ट्रीय बचत पत्र, सार्वजनिक भविष्य निधि (पीपीएफ), किसान विकास पत्र, वरिष्ठ नागरिक लघु बचत योजना व सुकन्या समृद्धि योजना जैसी छोटी बचत योजनाएं आम लोगों के बीच निवेश का आकर्षक विकल्प बनकर उभरी हैं। बचत खातों के रुझान में आई कमी का कारण बैंकों से आकर्षक रिटर्न न मिलना है। यह रुझान बताता है कि डूबते कर्ज (एनपीए) व घोटालों के दौर ने बैंकों पर लोगों का भरोसा डिगा दिया है।

यद्यपि सोने व संपत्ति की खरीदी में निवेश हमेशा से सुरक्षित व विश्वसनीय माना जाता रहा है, लेकिन अब टैक्स संबंधी नियमों से इन दोनों क्षेत्रों में इसका आकर्षण कम हुआ है। नए सरकारी नियमों की सख्ती ने बेनामी संपत्तियों की खरीदी-बिक्री पर असर डाला ही, रियल एस्टेट में 4-5 साल पहले की तरह अब कीमतें भी नहीं बढ़ रहीं। इसी तरह पिछले कुछ वर्षों में सोने पर निवेश भी पहले जितना लाभप्रद नहीं रहा है। अच्छी कमाई करने वाले तथा आधुनिक जीवनशैली वाले नौकरी पेशा तथा उद्यमी युवाओं का सोने की खरीद से लगातार मोहभंग हो रहा है और वे अच्छा लाभ देने वाले म्युचुअल फंड व शेयर बाजार की ओर आगे बढ़ रहे हैंं।  इधर 2014-15 से म्युचुअल फंड पर औसतन 15 फीसदी सालाना रिटर्न मिल रहा है, जबकि इस अवधि में सोने से मिलने वाला औसतन रिटर्न करीब 8.5 फीसदी ही रहा। भारतीय प्रतिभूति एवं विनिमय बोर्ड (सेबी) के मुताबिक, वर्ष 2017-18 में म्युचुअल फंडों में 2016-17 के मुकाबले निवेश में करीब 60 फीसदी की वृद्धि हुई है। लगातार अच्छे रिटर्न के कारण म्युचुअल फंड व शेयर बाजार तेजी से बढ़ रहे हैं। निश्चित रूप से संपत्तियां और सोना खरीदने की बजाय छोटी बचत योजनाओं, म्युचुअल फंड और शेयर बाजार में बढ़ता निवेश अर्थव्यवस्था के लिए शुभ संकेत है। ऐसे में आम आदमी को इनसे जोड़ने के नए कारगर प्रयास करने होंगे।

ध्यान देना होगा कि भारत क्रय शक्ति के आधार पर दुनिया में तीसरी सबसे बड़ी अर्थव्यवस्था बन चुका है और उसकी अर्थव्यवस्था एक खरब डॉलर की है। ऐसे में कुल जनसंख्या के करीब तीन फीसदी लोगों का ही बतौर निवेशक शेयर बाजार से जुड़ना पर्याप्त नहीं है। इस समय भारतीय कारोबारियों के पास बड़ी संख्या में नए उद्यम शुरू करने या चालू उद्यमों को पूरा करने के लिए पर्याप्त धन नहीं है और बैंक भी फंसे कर्ज के मामले देखते हुए नए ऋण देने में काफी सतर्कता बरत रहे हैं। ऐसे में उद्यमियों के लिए पूंजी उपलब्ध कराने हेतु शेयर बाजार को और अधिक अनुकूल व स्वस्थ बनाने के साथ सेबी की भूमिका को भी और प्रभावी बनाना होगा।  सेबी ने पूंजी जुटाने की गतिविधियां तेज करने और निवेश सुरक्षित बनाने के लिए जो नए नियम लागू किए हैं,उनसे शेयर बाजार में निवेश संभावनाएं बढ़ेंगी। नए कदमों के साथ-साथ इस बात पर भी ध्यान देना होगा कि इस समय जब पेट्रोल-डीजल की कीमतों में वृद्धि हो रही है और वैश्विक व्यापार युद्ध के मद्देनजर महंगाई बढ़ रही है तब छोटी बचत योजनाओं पर ब्याज दर बढ़ाकर इस पर मिलने वाले रिटर्न को कैसे लाभप्रद बनाया जाए। ऐसे समय में जब तेजी से बढ़ती भारतीय अर्थव्यवस्था को बड़ी मात्रा में निवेश की जरूरत है तब हमें नेशनल सेविंग्स इंस्टीट्यूट की रिपोर्ट पर विशेष ध्यान देते हुए कुछ नए रणनीतिक कदम उठाने होंगे।

Unnatural section

As government declines to oppose striking down of Section 377, SC must seize opportunity to right a shameful wrong

The Supreme Court is hearing what could be the last petitions against Section 377 of the Indian Penal Code, which criminalises “unnatural offences” or sexual acts “against the order of nature”. On the second day of the hearings, Additional Solicitor General Tushar Mehta filed an affidavit declaring that the government would leave the validity of the law entirely in the hands of the court. Now, the Supreme Court has an opportunity to end the matter conclusively, and to right a dreadful historical wrong, in whose persistence the court has been instrumental. In 2009, a landmark judgment by Justices A P Shah and S Muralidhar of the Delhi High Court had found Section 377 in violation of Articles 14, 15 and 21 of the Constitution, and a curb on the right to life itself. Three years later, the Supreme Court overturned the decision and left it to Parliament to amend the law. Historically, governments have been reluctant to withdraw Section 377.

But now, in an admirable change of stance, it has lobbed the ball back to the court, where it belongs. The Supreme Court is the proper guardian of the rights of minorities like the LGBT community — in Parliament, majoritarian opinion may prevail. Besides, the validity of Section 377 is a question of right and wrong, which is best addressed legally. However, the government’s affidavit urges the court to restrict itself to that question, suggesting that it would prefer political solutions to issues that would flow from decriminalisation, such as the right to form civil unions and inherit property. Looking back, Section 377 should have been automatically rendered void by the recognition of the right to privacy, since sexuality is a private issue. Looking ahead, it will raise a host of questions relating to parenting and adoption, housing, military service, employment and inheritance.

Following decriminalisation, denial or restriction in such matters would invite legal action, since the right to equal access would be violated. Though the Supreme Court has declined to examine these while dealing with the present set of petitions, the judiciary will eventually have to ponder them, even if Parliament legislates in the interim. For the present, Chief Justice of India Dipak Misra has observed that the court only needs to be persuaded that “if Section 377 were legislated today, it would be struck down for violating fundamental rights”. That is hardly difficult, and it is high time that India, which is clubbed with nations like Saudi Arabia and Somalia for criminalising same-sex relationships, may be freed of a shameful legacy of the Empire.

Punjab’s drug menace demands an all-out war that goes beyond empty gestures

It has taken Punjab Chief Minister Captain Amarinder Singh over a year and a half to launch his much-anticipated war on drugs. This he did on July 4 by ordering mandatory drug tests for all government employees, including the police. While this is welcome, even if belated, it is a very small and insubstantial measure towards curbing the pervasive drug menace. For someone who promised to wipe out drugs from the State within a month of being elected, the conduct of annual drug tests on some 3.25 lakh employees is a piece of tokenism. More steps are needed; less missteps, too. The decision of the Punjab Cabinet to recommend the death penalty to drug-peddlers is an example of the latter. Capital punishment is abhorrent. Given that there is evidence that suggests it is also no guarantee of deterring crime, this is more of an empty signal. What is required is a comprehensive war on drugs fought on several fronts, including interventions in the community to spread awareness and foster a culture against the use of drugs.

The challenges faced by the State are huge. Estimates vary but by some accounts as many as two-thirds of all households in Punjab have a drug addict in their midst. Punjab’s prisons are overcrowded with drug-users and peddlers, and its streets and farms witness the easy availability of narcotics and opiates. Last year the government arrested 18,977 peddlers and treated some two lakh addicts. The sheer extent of the problem suggests it is more than just a few profiteers that have been responsible for causing this menace or helping to sustain it. Something of this scale required a wide network, a well-oiled and smoothly run machinery that has the secret support and collaboration of at least a few of those who work in government. Given the geography, the drugs, whether it is opium or heroin, make an easy and assisted entrance into Punjab from the Golden Crescent (Iran, Afghanistan, Pakistan), and synthetic drugs are thought to come in via Himachal Pradesh.

That means those guarding Punjab’s 553-km border with Pakistan must take serious steps to plug the inflow. The Central security forces are obviously beyond the control of Amarinder Singh. Therefore, security-planners in New Delhi have to make sure that the border is properly barred to the flow of narcotic substances. This is a national problem as a substantial portion of the drugs that land in Punjab make their way to the rest of the country. Given the links between drugs and terror, this poses a national security threat. Then there are the politicians. The previous Akali Dal-BJP alliance had also promised to drain Punjab’s vast drug swamp. The political class has a critical role to play in winning the war on drugs. It is not enough that politicians merely line up to have themselves tested for drugs to win political brownie points. They need to put the State and the nation above self-serving political ends and agree that this battle must be fought in concrete ways, going beyond photo-ops and sound-bites.

Mercenary conservation

Allowing for private forests can lead to illegal activities and change the natural behaviour of wildlife

Karnataka recently drafted Private Conservancy Rules in a bid to increase forest area through private land. Under the rules, anyone who has a minimum of 100 acres of land bordering a national park can convert it to a “Wildlife Private Conservancy”. Of this land, 5% can be used to construct buildings for ecotourism; the rest has to be kept for flora and fauna. The move has received criticism, with activists and retired forest officers concerned that this could lead to illegal activities in private spaces. Though policies are different in India and South Africa, there has been much talk about how we are going down the Africa way with this new approach. In South Africa, agricultural land can be converted into wildlife reserves. The government specifies how much land is required for each animal, purchases are then made, and wildlife is introduced.

Some game reserves allow hunting, which is legal. Hunting rights for specific animals are auctioned regularly. The highest bidder may gun down the animal and carry its head as a “trophy”. Each species has a minimum bid with the Big Five — namely, the cape buffalo, rhino, elephant, leopard and lion — being the most expensive. The locals wholeheartedly support hunting as it brings in foreign exchange and thus motivates the management to run the game reserve better, in turn leading to more hunting bids. Private reserve owners treat wildlife in any way they deem fit. In one game reserve, an elephant recently went rogue and broke the fence. It was shot down and the carcass was left rotting inside the reserve for months. In another instance, a red hartebeest with a tumour was shot down and thrown to lions.  On inspection, the “tumour” was found to be a deposit of grass that happened probably due to a redirection of food through a cavity or hole. A veterinarian could have easily solved this, but that was not to be.

Though these wildlife spaces are massive, they are private and hence fenced. This constantly challenges and changes the natural behaviour of wildlife. Some reserves have two sections: one with lions and one without. However, predators ensure survival of the fittest, and as a corollary, their absence leads to overgrazing and excess population. There is also a territorial issue: in enclosed spaces, an alpha cannot be established easily as the non-alphas are unable to find new ground. This leads to more infighting and behavioural disturbances. Also, the rules for poaching are still in the grey. Rhinos are regularly poached for their horns. Reserves urge people not to geo-tag their location, for example on social media, in fear of poachers noticing. Even though South African game reserves claim to respect wildlife, it is a business for them as their animals are bred and gunned down for money. If money weren’t a motivating factor, the spaces would have continued being agricultural lands.

Traffickers, peddlers, mules or users?

The law on drugs needs some amendments

At a Cabinet meeting on July 2, the Punjab government recommended to the Union government the death penalty for first time offenders convicted for drug trafficking and smuggling. But the assumption that harsher measures can help deal with the State’s drug problem is flawed. Deterrence by harsh punishments has consistently failed, especially in the context of the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act).

High rate of conviction

The law on drugs is covered by the NDPS Act. The Act’s primary objective is to deter drug trafficking. It uses every trick in the book to achieve this: strict liability offences, mandatory minimum sentences, even the death penalty for certain repeat offences, to name a few. The system has responded to the law by maintaining a high rate of conviction and imprisonment. In 2015, 41.7% of all prisoners in Punjab were in jail for various offences related to this law. The conviction rate recorded for NDPS cases in Patiala for the same year was 90.7%. The comparative conviction rate under the Indian Penal Code was 30.7%. But Punjab continues to be plagued by drug-related deaths, as recently as June when 23 persons died of drug-related causes.

The death penalty was introduced in the Act in 1989, to deter narco-terrorism. The legislators even at that time believed that the only way to tackle the growing drug menace was to incorporate the harshest possible punishments in the law. The law also provides a mandatory minimum sentence of 10 years for offences involving commercial quantities of drugs. This determination is based on the assumption that people found with commercial quantities of drugs are drug traffickers. But there’s a catch. An executive notification passed by the Department of Revenue in 2009 led to a major change in how commercial quantities under the Act were determined, creating a situation where many offences involving commercial quantity were, in fact, not trafficking offences at all. This notification assigns punishment based on the weight of the whole drug and not just pure content.

As a result, sentencing in pharmaceutical drug cases changed drastically across Punjab. A case in Patiala where unauthorised possession of 20 bottles of cough syrup led to a 10-year prison sentence drives home this claim. Thus, given how the law in interpreted, it is hard to say whether the people imprisoned are traffickers, peddlers, mules or users. The law also seeks deterrence through strict liability provisions. Under the law, proving possession alone is sufficient, the prosecution does not have to prove intent to lead to conviction. Since intent is harder to prove than a criminal act alone, strict liability ensures higher convictions. This has, predictably, led to another predicament. The police in Punjab follow a template charge-sheet format, just to prove possession. They rarely, if ever, examine the intent of the criminal act. The way investigation is conducted right now, it is impossible to tell whether the person is a peddler or smuggler, or an addict feeding his habit.

Playing to the gallery

The Cabinet’s proposal to make the law even harsher is an attempt to play to the gallery. It may alleviate people’s concerns for the time being, but it will not yield the results the state as well as its people so desperately seek. Instead, the law and the state need to take the opposite approach. To begin with, to ensure that traffickers are caught instead of users, the law must make intent an ingredient of offences under the NDPS Act. The burden of proof should be on the prosecution to prove that the accused possessed the drug for a particular purpose. Possession alone should not be sufficient to constitute an offence under the Act.

The Act is also blatantly unforgiving of anyone found in possession of any drug. Section 27 of the Act makes consuming any narcotic drug or psychotropic substance a criminal offence. Criminalising addiction stigmatises it, which automatically inhibits addicts from coming forward for treatment. The state should consider decriminalising addiction and developing an effective treatment strategy by consulting experts, partner agencies and users, and allocating adequate resources. The Punjab government must assess its infrastructural needs and ensure that they are met.
