Enforcement is key

Intent of Motor Vehicles Act changes is good, but Gujarat shows that it needs finessing

Into the second week of the amendments to Motor Vehicles Act kicking in, the step to sharply increase fines for violations remains controversial. Gujarat this week reduced some of the fines set by the Centre on humanitarian grounds. The overarching aim of the amendments has wide support. Given that India has a shameful record of fatalities on account of road accidents, even when compared to other developing countries, some of the measures in the amendments, particularly the one relating to encouraging good Samaritans, are welcome. The debate is over a steep hike in fines. For example, the penalty for jumping a traffic light has gone from Rs 100 to Rs 5,000. Will a harsh measure be the game changer?

The record across the world is decidedly mixed but fine remains a popular tool, with Finland going so far as to link it to a violator’s disposable income. What is unambiguous is that the problem of fatalities is more pronounced in the developing world, which WHO says accounts for 93% of fatalities with around 60% of vehicles. Richer countries have created safer roads over the last four decades. There are two solutions and both are needed. One, is to strengthen the regulatory and enforcement framework. Two, significantly improve road design in India which is also a cause of fatalities.

Will stiff fines improve driving habits? Yes, if the violator is fairly sure that it’s difficult to escape. However, enforcement has been India’s weakness. Once the current fuss dies, our record suggests it will be business as usual. It may also encourage petty corruption. Therefore, instead of fixing fines at a level where even a relatively wealthy BJP-administered state feels pressured to lower it, focus on consistent enforcement. A model where most fines escalate with repeat offences with the possibility of flying below the radar minimised is the way forward.

Technology today provides a cost effective solution to implement this model. For example, with a higher density of working CCTVs states can automate enforcement. If such solutions start in the biggest urban centres and key highways of every state, there will be an early impact and fatalities will reduce. No one condones violations. But a solution shouldn’t be so draconian that a chief minister’s compassion is triggered when the law is broken. The intent underpinning the amendments is good. But the inadequate attention to unforeseen consequences of high fines, and to enforcement, are a problem.

Nepal connect

Bilateral fuel pipeline exemplifies the turnaround in New Delhi-Kathmandu ties

In a big development for India-Nepal ties, the two countries inaugurated South Asia’s first cross-border fuel pipeline, helping Kathmandu cut fuel prices by Rs 2 per litre on account of reduced transportation cost. The 69 km Motihari-Amlekhganj pipeline project was completed 15 months ahead of schedule and can transport two million tonnes of petro-products annually to the landlocked Himalayan nation. This holds out three positives for the bilateral relationship.

First, India is finally taking its development commitments to Nepal seriously. An impression had taken hold in Nepal that Indian projects are marred by inordinate delays. But the before-time completion of the transnational pipeline raises hopes that other pending bilateral projects too will be expedited. Second, the disastrous 2015 blockade had led to massive fuel shortages in Nepal and soured relations between New Delhi and Kathmandu. The pipeline will help ensure that such shortages don’t recur. Hence, it is a permanent symbol of India-Nepal cooperation that is bound to generate much goodwill in Kathmandu. Third, that the pipeline was inaugurated just as Chinese foreign minister Wang Yi was wrapping up his visit there shows that India has changed tack in its Nepal policy and is focussing on deliverables.

This is smart because forcing Kathmandu to choose between New Delhi and Beijing will likely drive Nepal into China’s corner. Instead, the Indian leadership should be confident about the deep cultural and people-to-people relations that India and Nepal share, and focus on growing these natural synergies. The Modi government has made India’s neighbourhood a foreign policy priority. Given that India’s relations with Pakistan are currently hostile, moving ahead with sub-regional cooperation as in the BBIN (Bangladesh, Bhutan, India, Nepal) format makes sense. The India-Nepal partnership has to be a key pillar of this approach.

जीएसटी, नोटबंदी के असर ने पीछा नहीं छोड़ा है

देश में उदार आर्थिक नीतियों के सूत्रधार , दस साल तक प्रधानमंत्री रहे विश्व विख्यात अर्थशास्त्री डॉ. मनमोहन सिंह भारत में आर्थिक मंदी के मौजूदा माहौल से खास चिंतित है। दैनिक भास्कर के राजनीतिक संपादक हेमंत अत्री से बेबाक सलवा जवाब में डॉ. सिंह ने मौजूदा हालत के लिए पूरी तरह मोदी सरकार की गलती आर्थिक नीतियों को दोषी ठहराते हुए इससे निपटने का रोडमैप भी साझा किया है। पेश है डॉ. सिंह से सवाल जवाब के सम्पादित अंश –

एक और हम मोदी – 2 शासन के पहले 100 दिनों की उपलब्धियों का प्रचार अभियान देख रहे है तो दूसरी और अपने देश की अर्थव्यवस्था को गहरी चिंता का विषय बताया है। क्या स्थिति वास्तव में इतनी गंभीर है ? इस आर्थिक मंदी से भर आने में कितना समय लगेगा ?

-अपने काम पर बात करना मोदी सरकार का विशेषाधिकार है, लेकिन सरकार अब अर्थव्यवस्था के बारे में इनकार की मुद्रा में नहीं रह सकती। भारत बहुत चिंताजनक आर्थिक मंदी में है। पिछली तिमाही की 5% जीडीपी विकास दर 6 वर्षों में सबसे कम है। नॉमिनल जीडीपी ग्रोथ भी 15 साल के निचले स्तर पर है। अर्थव्यवस्था के कई प्रमुख क्षेत्रों को प्रभावित हुए हैं। ऑटोमोटिव सेक्टर उत्पादन में भारी गिरावट से संकट में है। साढ़े तीन लाख से ज्यादा नौकरियां जा चुकी हैं। मानेसर, पिंपरी-चिंचवड़ और चेन्नई जैसे ऑटोमोटिव हबों में इस दर्द को महसूस किया जा सकता है। असर इससे संबंधित उद्योगों पर भी है। अधिक चिंता ट्रक उत्पादन में मंदी से है, जो माल और आवश्यक वस्तुओं की धीमी मांग का स्पष्ट संकेत है। समग्र मंदी ने सेवा क्षेत्र को भी प्रभावित किया है। पिछले कुछ समय से रियल एस्टेट सेक्टर अच्छा प्रदर्शन नहीं कर पा रहा है, जिससे ईंट, स्टील व इलेक्ट्रिकल्स जैसे संबद्ध उद्योग भी प्रभावित हो रहे हैं। कोयला, कच्चे तेल और प्राकृतिक गैस के उत्पादन में गिरावट के बाद कोर सेक्टर धीमा हो गया है। ग्रामीण अर्थव्यवस्था फसल की अपर्याप्त कीमतों से ग्रस्त है। 2017-18 में बेरोजगारी 45 साल के उच्च स्तर पर रही। आर्थिक विकास बढ़ाने का विश्वसनीय इंजन रही खपत, 18 महीने के निचले स्तर तक पहुंच गई है। बिस्कुट के पांच रुपए के पैकेट की बिक्री में गिरावट ने सारी कहानी खुद बयां कर दी हैा। उपभोक्ता ऋण की सीमित उपलब्धता और घरेलू बचत में गिरावट से खपत भी प्रभावित होती है।

मेरे अनुमान में, इस मंदी से बाहर आने में कुछ साल लगेंगे बशर्ते सरकार अभी समझदारी से काम ले। हालांकि हम यह न भूलें कि नोटबंदी की भयंकर गलती के बाद जीएसटी के दोषपूर्ण अमल ने इस मंदी को जन्म दिया। आरबीआई ने हाल ही में ऐसे आंकड़े पेश किए हैं, जिनसे पता चलता है कि उपभोक्ता वस्तुओं के ऋणों के लिए सकल बैंक जोखिम में 2016 के अंत अर्थात नोटबंदी के बाद से लगातार गिरावट हुई है। इस डेटा से अर्थव्यवस्था की मांग संबंधी समस्याएं प्रदर्शित होती हैं।

आप लगातार कहते रहे हैं की नोटबांदी व त्रुटिपूर्ण जीएसटी मौजूदा संकट के मुख्य स्टैटिस्टशियन प्रणब सेन भी एक साक्षात्कार में इससे सहमत थे।
आपकी नज़र में नोटबंदी व जीएसटी का अर्थव्यवस्था पर कुल प्रभाव क्या रहा ? दोनों ने उधमिता व रोजगार को किस तरह प्रभावित किया ?

-हां, वे सही है। यह नकदी की कमी के कारण उत्पन्न संकट है। भारत में पर्याप्त अनौपचारिक अर्थव्यवस्था है जो नकदी पर चलती है। इसके बड़े हिस्से में वैध गतिविधियां शामिल हैं, जो कर सीमा के दायरे से बाहर हैं और इसलिए इन्हें ‘काली’ अर्थव्यवस्था का हिस्सा नहीं मानना चाहिए। मसलन, कृषि क्षेत्र सकल घरेलू उत्पाद का लगभग 15% है, जो मुख्य रूप से नकदी पर चलती है और ज्यादातर कर-मुक्त है। यह नोटबंदी के दौरान सिस्टम से नकदी गायब होने से प्रभावित हुई थी। सेंटर फॉर मॉनिटरिंग इंडियन इकोनॉमी (सीएमआईई) ने बताया कि नोटबंदी के ठीक बाद जनवरी-अप्रैल 2017 के दौरान असंगठित क्षेत्र में डेढ करोड़ नौकरियां खत्म हो गईं। इसके बड़ी संख्या में लोग गांवों में लौट गए और मनरेगा के काम की मांग में काफी वृद्धि हुई। जब तत्कालीन वित्त मंत्री ने मनरेगा को रिकॉर्ड बजट आवंटन की बात की, तो यह गहरे ग्रामीण संकट की स्वीकृति थी। हमने हाल ही में देखा कि कार्पोरेट निवेश जीडीपी के 7.5% से गिरकर सकल घरेलू उत्पाद का केवल 2.7% हो गया। यह 2010-11 में सकल घरेलू उत्पाद के 15% के रूप में उच्च स्तर पर था। जाहिर है नोटबंदी के प्रभाव से संगठित क्षेत्र भी नहीं बचे। एक तरफ जहां नोटबंदी असर काफी वक्त तक कायम था, वहीं सरकार ने जीएसटी को इतनी जल्दबाजी में पेश किया कि इसने अर्थव्यवस्था को एक और बड़ा झटका दे दिया। हम जीएसटी के समर्थक हैं। हालांकि, इसे खराब तरीके से लागू किया गया। उदाहरण के लिए, एमएसएमई से सोर्सिंग भी प्रभावित हुई क्योंकि बड़ी कंपनियां उन आपूर्तिकर्ताओं से खरीद करना पसंद करती थीं, जो जीएसटी रसीद प्रदान कर सकते थे। अन्य मामलों में, आयात को उन छोटी भारतीय कंपनियों से सोर्सिंग पर प्राथमिकता दी गई, जो जीएसटी के दायरे में मुश्किल से ही आ पा रहीं थीं। इससे पूरी आपूर्ति शृंखला बाधित हो गई और चीनी आयातों की हमारे बाजारों में बाढ़ आ गई है। कई स्लैब वाले जीएसटी ढांचे, दरों में लगातार कटौती और नियमों के बदलने ने छोटे और मध्यम व्यवसायों को भी चोट पहुंचाई है।

एक तरफ सरकार ने बैंको से उपभोगताओं और उधमियों को विकास को बढ़ावा देने के लिए ऋण देने का आग्रह किया है दूसरी और इसने बैंक विलय को मंजूरी दे दी है। के बैंक विलय से बैंकिंग क्षेत्र की समस्याओं का समाधान होगा ?

-सार्वजनिक क्षेत्र के बैंकों का विलय, बैंकिंग क्षेत्र को सुव्यवस्थित और मजबूत बनाने में मदद कर सकता है। लेकिन क्या इसके लिए यह सही समय है? समय की जरूरत है कि नकदी के प्रवाह को सुगम बनाया जाए और नॉन-परफॉर्मिंग एसेट्स की चुनौती को दूर किया जाए। इन पर अपना ध्यान केंद्रित करने के बजाय केवल विलय से बैंकरों का ध्यान एकीकरण की चुनौतियों पर ही केंद्रित हो सकता है। विलय की प्रक्रिया काफी जटिल होती है। हमारे बैंकों को उनके संक्रमण काल के दौरान सहायता करने के लिए किसी भी रणनीतिक योजना की कमी इस समस्या को और बढ़ाएगी। सरकार इस धारणा पर भी भरोसा कर रही है कि कमज़ोर बैंकों का मज़बूत बैंकों में विलय करके कमियां दूर करके बड़े और मज़बूत बैंक बनाएंगे। लेकिन यह उतना ही संभव है कि कमजोर बैंक, मजबूत बैंकों को भी अपनी ओर खींच लें, क्योंकि उनके पास कमजोर बैलेंस शीट हैं। वास्तव में कुछ बड़े बैंक खुद एक कमजोर क्रेडिट प्रोफाइल का अनुभव कर रहे हैं। विलय के लिए चुने गए बैंकों में से एक वर्तमान में प्रॉम्प्ट करेक्टिव एक्शन फ्रेमवर्क के अंतर्गत है और एक अन्य को हाल ही में इस साल फरवरी में हटा दिया गया था। इन बैंकों की कमजोरियां अब एंकर बैंक तक बढ़ जाएंगी। हमने अभी तक 2008 के वैश्विक वित्तीय संकट के सभी सबकों को नहीं सीखा है। सरकार उन संरचनात्मक मुद्दों के समाधान की पहल में भी विफल रही है जो सार्वजनिक बैंकिंग क्षेत्र में समस्याओं का सामना कर रहे हैं।

क्या कांग्रेस रचनात्मक विपक्ष की भूमिका निभा पाई ?

-बिल्कुल, पूर्ण रूप से। हम जहां तक भी जरूरत है, वहां तक पहुंचने और सहायता प्रदान करने की नीति पर चल रहे हैं। राहुल गांधी ने सरकार से अनुरोध किया कि सरकार जल्दबाजी में जीएसटी लागू न करे। हमने सरकार से टैक्स स्लैब और जीएसटी संरचना को तर्कसंगत बनाने का अनुरोध किया। हर मंच से, आर्थिक वास्तविकता से सरकार को अवगत कराने और रचनात्मक समाधान पेश करने का हमारा निरंतर प्रयास था। आखिरकार सरकार ने हमारे कई सुझावों को मान भी लिया। जब सरकार ने भूमि अधिग्रहण कानून जैसे महत्वपूर्ण जन-हितैषी उपायों को उलटने की कोशिश की, तो हम अपने कड़े स्टैंड पर अडिग हो गए और सरकार को आखिरकार हमारे रुख का लाभ समझ में आया। यह भी याद रखना चाहिए कि जीएसटी जैसे कई कार्यक्रम हमारे विचार थे जिनका पहले भाजपा द्वारा विरोध किया गया था। इनमें गुजरात के तत्कालीन मुख्यमंत्री मोदी भी शामिल थे। प्रधानमंत्री ने संसद में मनरेगा की भी जमकर आलोचना की, लेकिन अब, यह देखते हुए कि सामाजिक सुरक्षा जाल के रूप में यह कितना महत्वपूर्ण है, सरकार ने इसके लिए काफी रकम आवंटित की है।

अपनी वित्तीय नीति और आर्थिक प्रबंधन के सन्दर्भ में आप भारतीय जनता पार्टी सरकार का पहला कार्यकाल कैसे देखते है।

-भाजपा सरकार के पहले कार्यकाल की स्थायी विरासतें नोटबंदी और जीएसटी हैं, जिसने अर्थव्यवस्था का दूसरे कार्यकाल में भी पीछा नहीं छोड़ा है। मोदी सरकार का अन्य प्रमुख फोकस मुद्रास्फीति पर नियंत्रण था। यह हमारे कृषि क्षेत्र की कीमत पर आया है। कृषि आय 14 साल के निचले स्तर पर गिर गई है, कृषि-निर्यात सिकुड़ गया है, और आयात तेजी से बढ़ रहा है। इसने स्थिर मजदूरी और खपत में गिरावट में भी योगदान दिया, विशेष रूप से हमारे ग्रामीण क्षेत्रों में। मोदी सरकार एनपीए संकट से निपटने में धीमी थी, जिसने अब एनबीएफसी क्षेत्र को भी प्रभावित किया है। इसके परिणामस्वरूप बैंकों को ऋण देने में दिक्कत हो रही है और उद्यमियों को ऋण लेने और निवेश करने में अनिच्छा हो रही है। अब बैंक फ्रॉड भी बढ़ गए हैं। इस मोर्चे पर मोदी सरकार की देरी से की गई कार्रवाई, देश के लिए महंगी साबित हुई है। जबकि इन्सॉल्वेंसी एंड बैंकरप्सी प्रक्रिया एक महत्वपूर्ण संरचनात्मक सुधार है, वर्तमान स्थिति में यह विशाल एमएसएमई क्षेत्र में मदद नहीं कर सकता। आर्थिक रूप से, सरकार ने राजकोषीय उत्तरदायित्व और बजट प्रबंधन अधिनियम द्वारा निर्धारित लक्ष्यों को पूरा करने की कोशिश पर बहुत जोर दिया। लेकिन इससे सरकार को पेट्रोलियम उत्पादों पर करों और उपकरों को आक्रामक रूप से लागू करना पड़ा जबकि अंतरराष्ट्रीय बााजार में कच्चे तेल की कीमतें कम थीं। अगर उपभोक्ताओं को कम कीमतों का लाभ दिया जाता तो शायद हम, उस मंदी से बच सकते हैं जो अब हम अनुभव कर रहे हैं।

कैसे कोई राज्य केंद्र का अविवेकपूर्ण कानून माने

गुजरात सरकार ने अन्य राज्यों के लिए रास्ता दिखाया है। केंद्र सरकार द्वारा पारित नया मोटर वेहिकल्स एक्ट असंवेदनशील, गैर-जिम्मेदाराना और नामुमकिन-उल-अमल माना गया। एक उदाहरण लें। अगर किसी गाड़ी पर एम्बुलेंस या अग्निशमन वाहन को अवरुद्ध करने का आरोप है तो जुर्माना 10,000 रुपए। जाहिर है यह उल्लंघन पहले तो किस स्थिति में ‘अवरोध’ माना जाएगा और क्या यह मात्र दोनों किस्म के वाहनों की ओर से शिकायत या ट्रैफिक पुलिस की स्वेच्छा पर निर्भर करेगा, यह स्पष्ट नहीं है। फिर क्या यह ट्रैफिक पुलिस की कमाई का जरिया नहीं बन जाएगा? कानून को सख्त करना भारत जैसे देश में जरूरी है, क्योंकि बाकी कोई भय या नैतिकता समाज के एक बड़े भाग की डिक्शनरी से आदतन गायब है। ऐसे में उल्टी दिशा से या शराब पीकर गाड़ी चलाने या लालबत्ती पार करने की सजा सख्त होनी ही चाहिए और राज्यों को इनमें बदलाव की छूट इस कानून ने नहीं दी है (हालांकि, गुजरात सरकार ने उल्टी दिशा में गाड़ी चलाने के जुर्माने को भी काफी कम कर दिया है, जो उचित नहीं है)। अक्सर खबरों में आता है कि 26 साल का रईसजादा रातभर शराब-पार्टी में नशे के बाद रफ्तार से महंगी गाड़ी चलाते हुए फुटपाथ पर सोये मजदूरों या अल-सुबह टहलने गए बुजुर्ग दंपति को कुचलता हुआ निकल गया। लिहाजा इस कानून की जरूरत काफी समय से थी, लेकिन अगर कोई दंपति बगैर हेलमेट पहने स्कूटर पर बच्चे को लेकर पास के स्कूल में छोड़ने गया है या भूलवश प्रदूषण प्रमाण-पत्र एक या दो दिन न लेने पर 10,000 रुपए जुर्माना निम्न और मध्यम वर्ग के लिए दहशत पैदा करने वाला है और पुलिस के लिए धन-उगाही का अच्छा साधन भी। उत्तरप्रदेश, बिहार, कर्नाटक और ओडिशा ने इसे यथावत स्वीकार करते हुए अधिसूचना ही नहीं जारी की बल्कि कुछ राज्य जरूरत से ज्यादा सक्रियता दिखाने लगे जिससे लोगों में आक्रोश है। न्यायशास्त्र की दुनिया में वह कानून सबसे बुरा माना जाता है जो बने, लेकिन जिसका पालन मुश्किल हो या जिससे भ्रष्टाचार को बढ़ावा मिले। कुछ किस्म के उल्लंघन पर इस कानून की सख्ती स्वागत-योग्य है, लेकिन कम से कम कम्पाउंडेबल श्रेणी के उल्लंघन (जिसमें राज्यों के बदलाव के अधिकार हैं) में राज्य सरकारों को जुर्माना कम करना होगा और पुलिस के भ्रष्टाचार के खिलाफ भी सतर्क रहना होगा अन्यथा यह कानून क्रूर मजाक बनकर रह जाएगा।

कौशल विकास की योजना

शिक्षा संस्थानों के साथ कौशल विकास संस्थानों को वैसे युवा तैयार करने पर गंभीरता से ध्यान देना होगा जो तेजी से बदलते उद्योग जगत की जरूरत को पूरा कर सकें ।

उद्योग जगत की आवश्यकता के अनुरूप कार्यबल तैयार करने के उद्देश्य से देश के पहले कौशल विकास संस्थान की मुंबई में आधारशिला रखते हुए केंद्रीय कौशल विकास एवं उद्यमशीलता मंत्री महेंद्रनाथ पांडेय ने जानकारी दी कि ऐसे दो और संस्थान कानपुर और अहमदाबाद में खोले जाएंगे। चूंकि ये संस्थान निजी क्षेत्र की भागीदारी से खोले जाने हैैं इसलिए यह आशा की जाती है कि वे जल्द स्थापित होकर अपना काम शुरू कर देंगे। अच्छा होता कि इस तरह के संस्थान अब तक अस्तित्व में आ जाते, क्योंकि कौशल विकास की योजना जुलाई 2015 में ही शुरू कर दी गई थी। चूंकि इसे मोदी सरकार की महत्वाकांक्षी योजनाओं में से एक माना गया था इसलिए उसके बेहतर क्रियान्वयन की उम्मीद की जा रही थी। यह मानने के अच्छे-भले कारण हैैं कि ऐसा नहीं हो सका।इस योजना के तहत बीते चार सालों में देश भर में जो तमाम कौशल विकास केंद्र खुले वे अभीष्ट की पूर्ति में कठिनाई से ही सहायक साबित हो सके। शायद यही कारण रहा कि उद्योग जगत इस तरह की शिकायत लगातार करता रहा कि उसे जैसे युवा चाहिए वैसे उपलब्ध नहीं हो पा रहे हैैं। वास्तव में यह शिकायत अभी भी नहीं दूर हो सकी है। देश के विभिन्न औद्योगिक क्षेत्रों में स्थापित कल-कारखानों के बाहर इस तरह की तख्तियां सहज ही देखने को मिल जाती हैैं कि अमुक-अमुक कार्य में दक्ष कामगारों की आवश्यकता है। ये तख्तियां कौशल विकास योजना के साथ ही हमारी शिक्षा प्रणाली पर भी सवाल खड़े करती हैैं।

क्या यह समय की मांग नहीं कि हमारे शिक्षा संस्थान डिग्री धारकों की फौज तैयार करने के बजाय हुनरमंद युवाओं को तैयार करें? कम से कम अब तो यह मांग प्राथमिकता के आधार पूरी की जानी चाहिए। इस दौरान यह भी ध्यान रखा जाना आवश्यक ही नहीं, अनिवार्य है कि मशीनीकरण के अलावा आधुनिक तकनीक और खासकर आर्टिफिशियल इंटेलीजेंस के बढ़ते चलन के कारण काम की प्रकृति बदल रही है। इसी कारण परंपरागत नौकरियां तेजी से कम होती जा रही हैैं।स्पष्ट है कि शिक्षा संस्थानों के साथ कौशल विकास संस्थानों को वैसे युवा तैयार करने पर गंभीरता से ध्यान देना होगा जो तेजी से बदलते उद्योग जगत की जरूरत को पूरा कर सकें। बेहतर हो कि मुंबई के साथ कानपुर और अहमदाबाद में कौशल विकास संस्थान की स्थापना के लिए सक्रिय सरकार इसकी भी चिंता करे कि आइटीआइ और पॉलीटेक्निक सरीखे संस्थान कौशल की बदलती हुई प्रकृति को सही तरह समझें। यह इसलिए और भी आवश्यक है, क्योंकि इतने बड़े देश में केवल तीन कौशल विकास संस्थान उद्योग जगत की जरूरतों को पूरा करने में समर्थ नहीं हो सकते।

The recent nomination of Governors calls for a review of the gubernatorial appointments process

The recent appointment of five Governors by the President must be viewed with grave scepticism. By nominating persons who are deeply embedded within the Bharatiya Janata Party ecosystem, the Union Government has sent the clear and ominous signal that constitutional principles and judicial diktats are secondary to the propagation of the party’s ideology. This places the entire edifice of the Constitution in an extremely precarious position and calls for a review of the process of gubernatorial appointments.

The President appointed Bhagat Singh Koshyari, Bandaru Dattatreya, Arif Mohammed Khan and Tamilisai Soundararajan as Governors, and transferred Kalraj Mishra from Himachal Pradesh to Rajasthan. Mr. Mishra had assumed office at the Raj Bhavan in Shimla as recently as July 22, 2019. Seen as a whole, all these appointees have recent, strong and uncompromising links with the BJP. Mr. Koshiyari is a former Chief Minister of Uttarakhand and was a member of the 16th Lok Sabha; Mr. Mishra and Mr. Dattatreya served in the Council of Ministers under Prime Minister Narendra Modi; and Mr. Khan and Ms. Soundararajan unsuccessfully contested the 2004 and 2019 elections, respectively, on BJP tickets.

Constitutional position

The process of gubernatorial appointments is anything but transparent. We know little more than the fact that the President has appointed a person as Governor “by warrant under his hand and seal”. The Constituent Assembly debates on this issue reveal divergent views and considerable deliberation. On May 30 1949, Sardar Hukam Singh had argued in favour of providing a panel of names, elected by the State Legislature, for the President to choose from. Fellow member, Alladi Krishnsaswami Ayyar backed the appointment of a Governor by the President with the hope that the “Cabinet at the Centre would also be guided by the advice” of the State Cabinet.

Adding to the debate, G. Durgai Bai spoke in favour of an appointment mechanism in order to “place the Governor above party politics, above factions and not to subject him to the party affairs”. Supporting this proposition, Prime Minister Jawaharlal Nehru indicated his preference for a Governor who would be “acceptable to the Government of the province and yet he must not be known to be a part of the party machine of that province”. A cursory look at the Governors who have been appointed since 1950, under the Constitution, tells us that the fear expressed by the various members of the Constituent Assembly was not imaginary.

Law on appointments

A five-judge Bench of the Supreme Court looked at the scope of the Union’s power to remove Governors in the landmark case of B.P. Singhal v. Union of India (2010). In this case, the Supreme Court spoke about the dual role of the Governor — as the constitutional head of the State government and as a vital link between the State and Union governments. Elucidating the specific functions of the Governor, the Supreme Court, speaking through Justice R.V. Raveendran, said that the Governor is “not an employee of the Union Government, nor the agent of the party in power nor required to act under the dictates of political parties”. The Court further anticipated that there “may be occasions when he may have to be an impartial or neutral Umpire where the views of the Union Government and State Governments are in conflict”.

Over the years, the Sarkaria Commission on Centre-State Relations and the National Commission to Review the Working of the Constitution have reiterated that the Governor appointee “should be a person who has not taken too great a part in politics generally, and particularly in the recent past”. Unfortunately, the President has overlooked this important recommendation which is critical to the existence of a federal and constitutional democracy. As such, this reignites the debate around the office of the Governor, its appointments and processes involved.
