Focus On Quality

RTE failed students through piecemeal non-detention. Don’t punish them again by piecemeal reform

With Parliament passing the Right to Education (RTE) Amendment Bill that scraps the controversial non-detention policy, the mistakes of the RTE Act must not be repeated. Its heavy emphasis on inputs like physical infrastructure in schools rather than on qualitative outcomes like learning levels and teaching standards was misplaced. Alongside no-detention, the original RTE Act mandated a rigorous Continuous and Comprehensive Evaluation (CCE) of children in schools. While children were casually promoted forward, CCE which would have required a comprehensive systemic overhaul fell by the wayside. And now when detention of students returns to our education policy, complacency must not set in under the cavalier assumption that the fear of failure will prompt children to study with renewed vigour.

This would be a tragedy because it penalises children for no fault of theirs. No child is a failure; it is teachers, educationists and governments that fail them. Detention must be accompanied by stricter norms of accountability demanded of teachers and schools. Unfortunately, many teachers have made their way into the education system without requisite qualifications or teaching skills and then enjoy security of tenure that doesn’t weed out non-performers. In 2016, Centre had reported that government schools faced a shortfall of 10 lakh teachers, with vacancies touching 22% and 34% respectively in pivotal states like Uttar Pradesh and Bihar. For a reset in the sector recruit the best teachers for these vacancies, especially when India now has a large army of “overqualified” jobseekers who apply desperately even for Group-D/ Class-IV jobs in government.

HRD minister Prakash Javadekar assured sceptical Rajya Sabha MPs that dropouts will not spike despite detention of failing students. The last ASER survey had found 86% of children in the 14-18 age group enrolled within the formal education system. Even as high enrolment is an important marker of education access, ASER also revealed abysmal outcomes like 25% in this age group being unable to read fluently in their mother tongue and nearly 50% having difficulty doing basic math and reading English sentences. In this context of poor skill acquisition, Javadekar’s assurance of arresting dropout rates is hardly convincing as detention will only further hit the confidence of parents and students in education raising their worldly prospects. This is where schools must show improvement in teaching and learning outcomes. The discourse must move forward from universal access to right to quality education, not backward to increasing dropouts.

Vital to Step Up Science Research

The private sector must raise its R&D game

While ludicrous claims of ancient technological feats at the Indian Science Congress elicit ridicule rather than cultural confidence that leads on to new achievement, young Indians must not dismiss India’s past contributions to science and mathematics as trivial. Ancient Indians have made sterling contributions to mathematics, astronomy and medicine but that tradition was, according to historians of science, smothered by excessive emphasis on metaphysics long before external influences made their presence felt. The university system instituted by the colonial administration was not geared for producing new knowledge and such research as did take place was carried out in specialised research institutes, mostly in the state sector, without organic linkage to teaching. The system largely carried over into independent India.

The prime minister’s call to create an ecosystem for science and research in state universities is welcome in this regard. But mere exhortation will not do. Increasing spending on R&D is critical. In real terms, the absolute expenditure had doubled in the last decade. However, as a share of GDP, the figure of 0.627% in 2015 is not just lower than the peak of 0.867% reached in 2008, but below the figure of 0.628% for 1996. The comparable figure was 2.066% for China in 2015 and 4.228% for Korea. The government is the biggest source of R&D investments in India, as also the biggest consumer of these funds—over three-fifths of the funds are utilised by key state agencies. The private sector and universities must step up their effort. Public funding must be used strategically to leverage and de-risk private funding, and focus on cutting-edge and long-haul research in which the private sector is unlikely to invest.

Science must have a robust interface with other disciplines and policy, whether in boosting farm productivity, adapting to climate change or curbing pollution. This would create new opportunities in fields ranging from engineering to wildlife preservation, and encourage more people to study science, apart from drawing in talent from the diaspora.

न्यायपालिका में खाली पदों से कैसे प्रभावित हो रहा है कारोबार

न्यायपालिका की व्यवस्था में उच्चतम न्यायालय के अधीन सैकड़ों अदालतें और पंचाट हैं जहां आर्थिक और वित्तीय मामलों पर सुनवाई होती है। कारोबार से जुड़े मामलों की संख्या बढ़ते जाने के मद्देनजर उच्च न्यायालयों में व्यावसायिक अदालतें गठित की गई हैं। आयकर, बौद्धिक संपदा अधिकार, बिजली विनियमन, उपभोक्ता कानून और दूसरे अन्य क्षेत्रों से जुड़े विवादों के लिए पंचाट हैं। कंपनी जगत में खलबली मचाने वाला राष्ट्रीय कंपनी कानून पंचाट (एनसीएलटी) हाल में इस क्लब में शामिल हुआ है। कारोबार बढऩे के साथ न्यायिक संस्थाओं की संख्या भी उसी अनुपात में बढ़ी हैं। फिर भी इन न्यायिक संस्थाओं का प्रदर्शन संतोषजनक नहीं है। कारोबार की राह आसान बनाने की दिशा में इसे एक बहुत बड़ी बाधा के रूप में देखा जाता है। इसके लिए पूरी तरह इन संस्थाओं को जिम्मेदार नहीं माना जा सकता है। उदाहरण के लिए उच्च न्यायालयों और निचली अदालतों में रिक्त पदों की संख्या चौंकाने वाली है। देश के 24 उच्च न्यायालयों में 384 पद रिक्त पड़े हैं। प्रमुख व्यावसायिक केंद्रों में तो हालत और भी खराब है। बंबई उच्च न्यायालय में 94 में से 33, दिल्ली उच्च न्यायालय ने 60 में से 21 और कलकत्ता उच्च न्यायालय में 94 में से 22 पद खाली पड़े हैं। निचली अदालतों में करीब 5,000 पद खाली पड़े हैं जो उनमें कुल मंजूर पदों की संख्या का एक चौथाई है। देश में मुकदमों की शुरुआत भी निचली अदालतों से ही होती है। इनमें मध्यस्थ पंचाटों के फैसलों को चुनौती, चेक बाउंस होने के मामले, शेयरों का हस्तांतरण और कंपनियों से जुड़े धोखाधड़ी के मामले शामिल हैं। जब अदालतों में कर्मचारी ही नहीं होंगे तो जाहिर है कि मामले कई वर्षों तक चलते रहते हैं और लोगों का व्यवस्था पर भरोसा नहीं रहता है।

कई पंचाटों में स्थिति इतनी बदतर है कि पदों को भरने के लिए उनके बार एसोसिएशनों को अक्सर मदद के लिए उच्चतम न्यायालय का दरवाजा खटखटाना पड़ता है। अदालत सरकारों को निर्देश जारी करती है जिन्हें तकनीकी आधार पर और फंड की कमी का रोना रोकर नजरअंदाज कर दिया जाता है। निचली अदालतों को धन की व्यवस्था करने की जिम्मेदारी राज्य सरकारों की है और उच्च न्यायालय न्यायाधीशों तथा कर्मचारियों की नियुक्ति करते हैं। अलबत्ता राज्य के बजट का 0.2 फीसदी या इससे भी कम न्यायपालिका को दिया जाता है। केंद्र में भी यही स्थिति है। यही वजह है कि अदालतें जीर्णशीर्ण भवनों या पट्टे पर ली गई इमारतों में काम करती हैं। उनके पास न तो पर्याप्त संख्या में कर्मचारी होते हैं और न ही स्टेशनरी होती है। हाल में बंबई उच्च न्यायालय ने महाराष्ट्र में अदालतों की दयनीय स्थिति पर एक लंबा चौड़ा फैसला दिया। अगर महाराष्ट्र में यह स्थिति है तो कम विकसित राज्यों में क्या हालत होगी, इसकी कल्पना करना मुश्किल नहीं है। इसका एक विरोधाभासी परिणाम यह है कि कुछ ही सफल वकील न्यायिक पदों को स्वीकार करते हैं और महानगरों के प्रबुद्ध वकीलों को कम जानकारी रखने वाले न्यायाधीशों के समक्ष दलीलें रखनी पड़ती है।

न्यायपालिका की मौजूदा दुर्दशा और इसे कारोबारी जगत की चिंता में कानून बनाने वालों का भी योगदान है। खामियों को दूर करने के लिए कुछ कानूनों को कुछ ही वर्षों के दौरान कई बार संशोधित करना पड़ा है। आयकर कानून में ऐसे कई प्रावधान हैं जिन्हें सैकड़ों बार संशोधित किया जा चुका है। एनसीएलटी सहित सभी पंचाटों के गठन से पूर्व इनके प्रावधानों की वैधता को लेकर उच्चतम न्यायालय में लंबी बहस चली है। इन प्रावधानों में अधिकारियों को न्यायिक सदस्यों से ज्यादा तरजीह दी गई थी। ऋणशोधन अक्षमता और दिवालिया संहिता (आईबीसी) के कई प्रावधानों को उच्चतम न्यायालय में चुनौती दी गई है और इन पर 2019 में फैसला आने की उम्मीद है। मध्यस्थता एवं सुलह कानून के प्रावधानों की कई वर्षों तक न्यायिक व्याख्या होती रही।

न्यायपालिका को रूढि़वादी संस्था माना जाता है और डिजिटल की दुनिया को अपनाने की इसकी प्रगति बहुत धीमी रही है। उच्चतम न्यायालय के गलियारे फाइलों से भरी अलमारियों से पटे पड़े हैं और जिन फाइलों को इन अलमारियों में जगह नहीं मिल पाई है, वे फर्श पर बिखरी हैं। दो साल पहले कागजरहित व्यवस्था का वादा किया गया था लेकिन न्यायपालिका को अभी उस दौर का इंतजार है। लॉ फर्मों में डिजिटल की रफ्तार न्यायपालिका से कहीं ज्यादा तेज है। अपील अदालतों में जाने वाली अपीलों के अक्सर संस्थाओं खासकर सरकारी संस्थाओं के पास भारी मात्रा में फंड उपलब्ध रहता है। दिल्ली उच्च न्यायालय ने बीते साल कई बार भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (एनएचएआई) को झिड़की दी और मध्यस्थता कानून के एक मामले में तो भारी जुर्माना भी लगाया। न्यायालय ने कहा, ‘हमने इस कानून के तहत कई याचिकाओं और अपील पर कई बार अपनी असहजता जाहिर की है। हम फिर इसे दोहराना नहीं चाहते हैं।’ विभिन्न उच्च न्यायालयों के कई कंपनियों और उनके वकीलों को नसीहत के बावजूद दूसरे कानूनों के प्रावधानों का दुरुपयोग भी धड़ल्ले से जारी है। बेकार की मुकदमेबाजी को नियंत्रित करने के लिए कोई नियामक नहीं है और कोई स्वनियमन भी नहीं है। परस्पर विरोधी मुकदमेबाजी आम है और कानूनी पेशा इसका पोषण करता है। इस पेशे से जुड़े लोग इन खामियों से अच्छी तरह वाकिफ हैं लेकिन अल्पकालिक लाभ के लिए बड़े हितों की बलि दी जाती है।

भगोड़ों पर कसता शिकंजा

अन्य कारोबारी भी विजय माल्या की जमात में खड़े नजर आएंगे

फरारी की हालत में लंदन में रह रहे कारोबारी विजय माल्या को भगोड़ा घोषित किया जाना उनके साथ-साथ अन्य अनेक ऐसे ही लोगों के लिए एक सख्त संदेश है। विजय माल्या पहले ऐसे कारोबारी बने जिन्हें प्रिवेंशन ऑफ मनी लॉन्ड्रिंग एक्ट के तहत भगोड़ा घोषित किया गया है। उम्मीद है कि जल्द ही विदेश भागे अन्य अनेक ऐसे ही कारोबारी भी विजय माल्या की जमात में खड़े दिख सकते हैैं। प्रिवेंशन ऑफ मनी लॉन्ड्रिंग एक्ट के तहत गठित अदालत द्वारा किसी को आर्थिक भगोड़ा घोषित किए जाने का सबसे बड़ा लाभ यह है कि उसकी देश के साथ-साथ विदेश की भी संपत्ति जब्त की जा सकेगी और वह किसी तरह की कानूनी बाधा नहीं डाल सकेगा। इसके अलावा उसे प्रत्यर्पित करने में भी आसानी होगी।

स्पष्ट है कि यह कानून बैंकों का पैसा डकारने अथवा अन्य किस्म की आर्थिक हेराफेरी करने वालों के विदेश भाग जाने के सिलसिले को समाप्त करने वाला साबित हो सकता है। विजय माल्या को भगोड़ा घोषित किया जाना मोदी सरकार के लिए एक बड़ी राहत की बात है, क्योंकि विपक्षी दल और खासकर कांग्रेस उस पर यह आरोप लगाने में जुटी हुई थी कि उसने उन्हें जानबूझकर देश से बाहर भाग जाने दिया। विजय माल्या के साथ नीरव मोदी और मेहुल चोकसी का उल्लेख करके भी सरकार पर ताने कसे जाते थे। बेहतर हो कि कांग्रेस यह महसूस कर सके कि विजय माल्या और नीरव मोदी जैसे कारोबारी बैैंकों के लिए इसीलिए मुसीबत बने, क्योंकि संप्रग सरकार के समय उन्हें मनमाने तरीके से कर्ज दिए गए। सच तो यह है कि ऐसे कारोबारियों की संख्या अच्छी-खासी है जिन्हें मनमोहन सरकार के समय नियम-कानूनों की अनदेखी करके कर्ज बांटे गए। इनमें से कई तो ऐसे थे जो कर्ज पाने के बिल्कुल भी पात्र नहीं थे। अगर कर्ज बांटने में जरूरी सावधानी का परिचय दिया गया होता तो शायद फंसे अथवा डूबे हुए कर्ज की समस्या इतनी गंभीर नहीं हुई होती।

यह एक विडंबना ही है कि इस समस्या को गंभीर बनाने का काम करने वाले ही बाद में ऐसे आरोपों के साथ सामने आए कि मोदी सरकार उद्योगपतियों के प्रति अनावश्यक नरमी दिखा रही है। राहुल गांधी तो अभी भी इस झूठ को दोहराने में लगे हुए हैैं कि मोदी सरकार ने अपने कथित पसंदीदा उद्यमियों का लाखो करोड़ रुपये का कर्ज माफ कर दिया। हालांकि वह तथ्यों और तर्को के बिना अपनी बात कहने में माहिर हो चुके हैैं, लेकिन इसकी अनदेखी नहीं कर सकते कि इस सरकार ने एक ओर जहां प्रिवेंशन ऑफ मनी लॉन्ड्रिंग एक्ट को मजबूत बनाया वहीं दीवालिया संहिता का भी निर्माण किया। इस संहिता ने उस सिलसिले को समाप्त करने का काम किया है जिसके तहत बैैंकों से भारी-भरकम कर्ज लेने वाले कारोबारी खुद को दीवालिया बताकर सारी जिम्मेदारी से मुक्त होे जाते थे। इनमें से कई ऐसे होते थे जो समर्थ होने के बाद भी कर्ज चुकाने से इन्कार करते थे। दीवालिया संहिता लागू होने के बाद से करीब 88,000 करोड़ रुपये वसूलने में मदद मिली है। स्पष्ट है कि इससे उन बैैंकों की हालत सुधरेगी जो कारोबारियों के छल का शिकार हुए।

जीन एडिटिंग के दावों से उठा तूफान

पिछले कुछ वर्षों में जीव विज्ञान में चमत्कृत कर देने वाले नए अनुसंधान तेजी से बढ़े हैं। इस दिशा में हैरान कर देने वाली हालिया खबर है- एक चीनी वैज्ञानिक द्वारा जुड़वां बच्चियों के पैदा होने से पहले ही उनके जींस में बदलाव करने का दावा। जीन सजीवों में सूचना की बुनियादी इकाई और डीएनए का एक हिस्सा होता है। जीन इस लिहाज से स्वार्थी होते हैं कि उनका एकमात्र उद्देश्य होता है स्वयं की ज्यादा से ज्यादा प्रतिलिपियों को अगली पीढ़ी में पहुंचाना। कह सकते हैं कि काफी हद तक हम वैसा ही दिखते हैं या वही करते हैं, जो हमारे शरीर में छिपे सूक्ष्म जीन तय करते हैं।

चूंकि शरीर में क्रियाशील जीन की स्थिति ही बीमारी विशेष को आमंत्रित करती है, इसलिए वैज्ञानिक लंबे समय से मनुष्य की जीन कुंडली को पढ़ने में जुटे हैं। इस दिशा में इतनी प्रगति हुई है कि अब जेनेटिक इंजीनियर आसानी से आणविक कैंची का इस्तेमाल करके दोषपूर्ण जीन की काट-छांट कर सकते हैं। जीन एडिटिंग की इस तकनीक को व्यावहारिक रूप से पौधों या जानवरों की किसी भी प्रजाति पर लागू किया जा सकता है। हालांकि मनुष्य के जीनोम में बदलाव करने की तकनीक बेहद विवादास्पद होने के कारण अमेरिका, ब्रिटेन और जर्मनी जैसे लोकतांत्रिक देशों में प्रतिबंधित है। चीन ही एक ऐसा देश है जहां मानव जीनोम में फेरबदल करने पर प्रतिबंध नहीं है। वहां पिछले कुछेक वर्षों में काफी तेजी से काम हुआ है। इसी कड़ी में ताजा समाचार है- चीनी शोधकर्ता हे च्यानक्वी द्वारा जुड़वां बच्चियों (लुलू और नाना) के पैदा होने से पहले ही उनके जींस में फेरबदल करने का दावा। जियानकुई ने यह दावा एक यू ट्यूब विडियो के माध्यम से किया है। हालांकि इस दावे की स्वतंत्र रूप से पुष्टि अभी तक नहीं हो सकी है और न ही किसी मानक साइंस जर्नल में इसका प्रकाशन हुआ है।

जीन एडिटिंग तकनीक आनुवंशिक बीमारियों का इलाज करने की दिशा में निश्चित रूप से एक मील का पत्थर है। यह निकट भविष्य में आणविक स्तर पर रोगों को समझने और उनसे लड़ने के लिए एक अचूक हथियार साबित हो सकता है। लेकिन यह भी सच है कि ज्ञान दुधारी तलवार होता है। इसलिए च्यानक्वी के प्रयोग पर तमाम सामाजिक संस्थाओं और बुद्धिजीवियों ने आपत्ति जतानी शुरू कर दी है तथा मानव जीन एडिटिंग पर अंतरराष्ट्रीय प्रतिबंध लगाने की मांग कर रहे हैं। विरोधियों का कहना है कि इससे समाज में बड़ी जटिलताएं और विषमताएं उत्पन्न होंगी। डिजाइनर बेबी बनाने का कारोबार शुरू हो सकता है। जो आर्थिक रूप से संपन्न लोग होंगे उन्हें अपने बच्चे के बुद्धि-चातुर्य और व्यक्तित्व को जीन एडिटिंग के जरिये संवारने-सुधारने का मौका मिलेगा। स्वाभाविक ही इससे सामाजिक भेदभाव को बढ़ावा मिलेगा।

हालांकि वैज्ञानिकों का एक तबका इस तरह के प्रयोगों को गलत नहीं मानता। उसे लगता है कि ऐसे प्रयोग लाइलाज बीमारियों के उपचार की नई संभावनाएं पैदा कर सकते हैं। इससे किसी बीमार व्यक्ति के दोषपूर्ण जीनों का पता लगाकर जीन एडिटिंग द्वारा स्वस्थ जीन आरोपित करना संभव होगा। मगर विरोधी इस तर्क से भी सहमति नहीं जताते। उनका कहना है कि अगर जीन विश्लेषण से किसी व्यक्ति को पता चल जाए कि भविष्य में उसे फलां बीमारी होने वाली है और वह जीन एडिटिंग थेरेपी करवाने में आर्थिक रूप सक्षम नहीं है तो उसकी क्या स्थिति होगी? क्या बीमा कंपनियां ऐसे भावी रोगी का बीमा करेंगी? क्या नौकरी में इस जानकारी के आधार पर उससे भेदभाव नहीं होगा? इसके अलावा जीन एडिटिंग तकनीक अगर गलत हाथों में पहुंच जाए तो इसका उपयोग विनाश के लिए भी किया जा सकता है। आतंकवादी अनुसंधानकर्ता अमानवीय मनुष्य के निर्माण की कोशिश भी कर सकते हैं। तब इन अमानवीय लोगों से आम आदमी कैसे निपट सकेगा? जाहिर है, संभावनाएं अपार हैं और चुनौतियां भी। ऐसी चुनौतियों से जूझते हुए ही मनुष्य विकास की संभावनाएं खंगालते यहां तक पहुंचा है। आगे भी उसे विकास की इसी प्रक्रिया के साथ चलना है।

भारत और बांग्लादेश बदलते-सुधरते रिश्ते

भारत के पड़ोसी देश बांग्लादेश में हाल ही में सम्पन्न हुए आम चुनावों में शेख हसीना वाजेद की पार्टी को बड़ी जीत हासिल हुई है। उनकी पार्टी ने अपने सहयोगियों के साथ मिलकर 300 सीटों में से 266 सीटों पर कब्जा कर लिया। इससे शेख हसीना को चौथी बार प्रधानमंत्री बनने का मौका मिल गया। उनकी इस जीत ने ढाका जेल में बंद अपनी चिर प्रतिद्वंद्वी और बांग्लादेश नेशनलिस्ट पार्टी (बीएनपी) की प्रमुख खालिदा जिया का भविष्य अधर में लटका दिया है। प्रथम दृष्टया शेख हसीना की जीत को भारत कूटनीतिक डिविडेंड के रूप में देख सकता है। कारण यह है कि शेख हसीना वाजेद का भारत के प्रति अधिक मैत्रीपूर्ण रवैया रहता आया है और उनका यह झुकाव भारत के लिए पूर्वोत्तर में कई चुनौतियों को आसान करने वाला रहता है। यहां जानते हैं कि दोनों देशों के संबंधों के बारे में कुछ खास बातें :

भारत-बांग्लादेश के बीच सहयोग

भारत, बांग्लादेश के साथ ट्रांस-रीजनल सहयोग अर्थात बीबीआईएन (बांग्लादेश-भूटान-भारत-नेपाल) और बिम्सटेक में क्षेत्रीय साझेदारी से जुड़ा है। बिम्स्टेक के जरिए भारत ने दक्षिण एशिया में न केवल पाकिस्तान को अलग-थलग करने में सफलता अर्जित की है, बल्कि दक्षिण एशिया में समानांतर क्षेत्रीय साझेदारी के विकल्पों का निर्माण भी किया है। इसके अलावा भारत ने बांग्लादेश के साथ लैंड बाउंड्री एग्रीमेंट (एलबीए) कर एक बड़ी समस्या को सुलझाने में सफलता अर्जित की है। इसके जरिए भारत और बांग्लादेश ने बस्तियों का आदान-प्रदान कर न केवल अपनी सीमाओं को उचित आकार दिया, बल्कि दोनों तरफ रह रहे नागरिकों को पहचान भी दी है। भारत ने बांग्लादेश के साथ परमाणु समझौता कर उसे 4.5 बिलियन डॉलर की लाइन ऑफ क्रेडिट की सुविधा देकर सहयोग को और विस्तार दिया है। वहीं शेख हसीना सरकार ने 1971 में भारत की भूमिका के महत्व का मूल्यांकन कर भारत को उचित आदर दिया है।

नेबर्स फर्स्ट की नीति

भारत ने लैंड बाउंड्री एग्रीमेंट, न्यूक्लियर एनर्जी डील, कनेक्टिविटी और सिक्युरिटी के क्षेत्र में नेबर्स फर्स्ट नीति को बखूबी निभाया है। भारत ने रक्षा सहयोग के मकसद से बांग्लादेश के साथ 25 वर्षों का व्यापक रक्षा समझौता करने का प्रयास किया जिसमें 5 वर्ष के लिए डिफेंस कोऑपरेशन फ्रेमवर्क एवं लाइन ऑफ क्रेडिट जैसे विषय होंगे, जो बांग्लादेश को रक्षा मजबूती प्रदान करेंगे। ये दोनों देशों के संबंधों को नई ऊंचाइयों तक ले जाएंगे।

समझौते का पेंच

भारत और बांग्लादेश के संबंधों में एक बड़ा पेंच तीस्ता नदी जल विभाजन संबंधी समझौता रहा है। तीस्ता गंगा, ब्रह्मपुत्र और मेघना (जीबीएम) नदी तंत्र के बाद भारत-बांग्लादेश के बीच में बहने वाली चौथी सबसे बड़ी ट्रांसबाउंड्री नदी है। 414 किमी लम्बी यह नदी सिक्किम से निकलती है जिसका 151 किमी हिस्सा सिक्किम में, 142 किमी हिस्सा पश्चिम बंगाल होते हुए सिक्किम-पश्चिम बंगाल सीमा पर और 121 किमी हिस्सा बांग्लादेश में है। हालांकि 1983 में एक तदर्थ समझौता हुआ था जिसके तहत बांग्लादेश को 36 प्रतिशत और भारत को 39 प्रतिशत पानी मिलना था जबकि शेष 25 प्रतिशत मुक्त बहाव के लिए रहना था। नई डील को पश्चिम बंगाल की मुख्यमंत्री ममता बनर्जी ने स्वीकार नहीं किया था जिसके तहत बांग्लादेश को तीस्ता का 48 प्रतिशत पानी मिलना है।

हमें बांग्लादेश की जरूरत क्यों?

यह ऐसा बड़ा सवाल है जिसके जवाब में ही दोनों दोनों के बेहतर संबंधों की बुनियाद टिकी है। बांग्लादेश वह राष्ट्र है जो संक्रमण की स्थिति से स्थायित्व की ओर बढ़ रहा है। ऐसे हालात में उसे आर्थिक, कूटनीतिक और रक्षा संबंधी सहयोग की सख्त जरूरत है। सवाल यह है कि यह सहयोग उसे कहां से मिल सकता है? क्या पाकिस्तान से? सच तो यह स्वयं पाकिस्तान की अर्थव्यवस्था ढहने के कगार पर पहुंच चुकी है। इसलिए जाहिर है कि वह बांग्लादेश को कोई आर्थिक मदद नहीं दे सकता। इसलिए बांग्लादेश उस दिशा में तो नहीं मुड़ेगा। लेकिन यहां खतरा चीन से है। चीन निरंतर इस कोशिश में लगा हुआ है कि बांग्लादेश में भारतीय हितों को काउंटर किया जाए। इसलिए वह न केवल भारत के मुकाबले बांग्लादेश को अधिक ऋण प्रदान कर रहा है, बल्कि चटगांव बंदरगाह को ग्वादर बंदरगाह की तरह ही ‘स्ट्रिंग ऑफ पर्ल्स’ का स्थायी मोती बनाना चाहता है। ऐसे में हमें यह ध्यान रखने की महती जरूरत है कि पूर्वोत्तर में चलने वाली गतिविधयों का बांग्लादेश कंट्रोलिंग प्वाइंट और पूर्वी एशिया के संबंधों के गेटवे का काम कर सकता है। ऐसी स्थिति में बांग्लादेश में शेख हसीना की विजय भारत के लिए कूटनीतिक उपलब्धि के रूप में है। लेकिन संभव है कि वे जनदबाव में भारत पर तीस्ता जल बंटवारे के लिए दबाव बनाएं। अतः भारत को इस दिशा में पहले ही उदार पहल कर देनी चाहिए।

After the inevitable exit

India must be prepared for the potential consequences of withdrawal of American troops from Afghanistan

Despite the White House’s spirited denial of reports that it has issued no orders for the pullout of U.S. troops, the course seems set for a thinning of American presence in Afghanistan. U.S. President Donald Trump had promised this during his campaign, and several advisers have said since then that he is keen to bring back most, if not all, troops before his re-election bid in 2020. If anything, Mr. Trump’s ill-judged remarks this week only underline his desire to leave: he suggested that regional players like Russia, India and Pakistan should be more involved in stabilising the situation, and mocked India for not doing enough.

As a result, the U.S. war in Afghanistan, that began as revenge for the 9/11 attacks, evolved into a mission for ensuring democracy and prosperity in Afghanistan. In recent years, challenged by the resurgence of the Taliban, it has now become a mission mainly to ensure an honourable exit. This isn’t the first time the U.S. has sought to do this: President Barack Obama had faced similar challenges in 2010, just before he announced the big drawdown. As Mr. Trump now moves to cutting American presence to a few well-guarded military bases, India must consider the consequences closely.

Shift in policy

To begin with, it is time to recognise that the U.S.’s South Asia Strategy for Afghanistan, as announced by Mr. Trump in August 2017, has been discarded. Mr. Trump had defined the strategy with three features: that U.S. troops would remain involved in the country until “conditions”, not a timeline, mandated their return; that the U.S. would put Pakistan on notice for its support to the Taliban and a political settlement with the Taliban would only follow “after an effective military effort”; and that the policy would hinge on further developing the strategic partnership with India

Sixteen months later, it is easy to see that each element of the U.S.’s policy on the ground has shifted, if not been entirely reversed. The appointment of special envoy Zalmay Khalilzad in September to lead talks with the Taliban after a particularly brutal year shows that the U.S. is no longer waiting for military operations to take effect. According to the Special Inspector General for Afghanistan Reconstruction (SIGAR) report to the U.S. Congress, casualties of Afghan National and Defence Security Forces (ANDSF) in May-September 2018 were the “greatest it has ever been” compared to corresponding periods since 2001, and the United Nations Assistance Mission in Afghanistan “documented more civilian deaths in the first nine months of 2018 than they had during the same nine-month reporting period since 2014”.

Mr. Khalilzad’s direct talks with the Taliban that cut out the National Unity government (NUG) in Kabul reportedly didn’t even have President Ashraf Ghani in the loop until after the first talks were held in Qatar — this reversed the previous U.S. position not to engage the Taliban until it engages the NUG. Far from the tough talk on Pakistan for support to the Taliban, Mr. Trump wrote a letter to Pakistan Prime Minister Imran Khan thanking him for his efforts. Afghanistan’s High Peace Council members also disclosed that Mr. Khalilzad was on a deadline: Mr. Trump has reportedly given him six months to show results with the talks process, failing which the pullout may be speeded up.

The departure from the avowed U.S. position on an “Afghan-owned, Afghan-led” process has clearly ruffled feathers in Kabul. In December, Mr. Ghani appointed two aides of former President Hamid Karzai known for their hardline position on the Taliban and Pakistan as his Defence and Interior Ministers. Putting the seal on the clear drift in the U.S. Afghanistan and South Asia policy from the past was the exit of Defence Secretary James Mattis, author of the South Asia policy. Mr. Mattis had pushed most strenuously to keep India in the Afghan game by swinging a waiver for India on Chabahar and Iran oil purchases. It remains to be seen whether Mr. Trump will continue those waivers past May this year.

The internal situation in Afghanistan is aggravated now by the uncertainty of the democratic process. Parliamentary elections were held in October after being delayed by more than two years, but even their preliminary results haven’t yet been declared, casting doubt on the government’s ability to conduct elections. Presidential elections have been postponed till July, despite the constitutional clause that they were to be completed by April 22, 2019. Meanwhile, Mr. Ghani has been unable to keep his commitment to hold a Loya Jirga (grand council of representatives) to turn Chief Executive Abdullah Abdullah’s post in the NUG into an executive Prime Ministership.

The way forward for India

For India, these developments may appear discouraging, but a more pragmatic view is necessary to deal with all possible outcomes. The U.S.’s eventual pullout as Afghanistan’s peacekeeper is inevitable, and it would make more sense to prepare for it than to deny it will happen. New Delhi was caught off guard in 2010 when Mr. Obama planned the drawdown and discouraged India from a stake in projects there in an effort to placate Pakistan.

Mr. Trump’s administration has no doubt been much more welcoming of Indian investment in Afghanistan, but that itself is symptomatic of his desire to pare down “Pax Americana” in every part of the world. The removal or reduction of the U.S. presence from most theatres of action has created space for regional players: leaving Syria to Iran and its allies; Yemen to Saudi Arabia; Afghanistan to players like Russia, Pakistan and Iran; and Pakistan to China.

Some other hard truths must be faced: India cannot replace Pakistan’s position geographically, nor can it ever offer the U.S. or any other force what Pakistan has offered in the past, including bases and permission for U.S. forces to bomb its own territory. The decision to abandon the SAARC in favour of groupings like BIMSTEC (Bay of Bengal Initiative for Multi-Sectoral Technical and Economic Cooperation), BBIN (Bangladesh, Bhutan, India, Nepal) and IORA (Indian Ocean Rim Association) may have provided some short-term returns in “isolating Pakistan”, but it has had the effect of cutting Afghanistan loose from Indian leadership of South Asia as well. India’s best course with Afghanistan remains its own regional strategy, not becoming a part of any other country’s strategy. Close bilateral consultations like this week’s visit to Delhi of National Security Advisor Hamdullah Mohib may not always yield dramatic headlines, but are the basis of India’s ability to help Afghanistan according to its needs, not India’s ambitions, and the reason for the immense popularity and goodwill India continues to enjoy in Afghanistan.

Finally, it is necessary to recognise the cyclical nature of interventions in Afghanistan, which has been called the “graveyard of empires” for forcing all world powers to retreat at some point or the other. The words of Rev. George Gleig, a soldier who survived the First Anglo-Afghan War (1839-42), are worth remembering: “A war begun for no wise purpose, carried on with a strange mixture of rashness and timidity, brought to a close after suffering and disaster, without much glory attached either to the government which directed, or the great body of troops which waged it.” Greig’s description of the British retreat could ring true for Soviet forces in the 1980s, and American forces post-9/11 as well.

Citizens And Them

Amendments to citizenship act threaten to open new faultlines and deepen old ones in Assam.

The very idea of citizenship in India may be at stake as a joint parliamentary committee set up to examine the NDA government’s Citizenship (Amendment) Bill has cleared proposed changes to it. The amendments seek to introduce a religious criterion in the process of acquiring Indian citizenship, which is against the letter and spirit of the Constitution. These changes may have far-reaching repercussions, especially in Assam, where citizenship has always been a contested issue.

The amended Act would make it easier for minority communities from Afghanistan, Bangladesh and Pakistan — Hindus, Sikhs, Buddhists, Jains, Parsis and Christians — to get Indian citizenship: They would be deemed eligible for citizenship after residing in India for six years, instead of 12, even if they lack the necessary papers. The implied discrimination against Muslims while granting citizenship stems from the misguided and dangerous notion that India is primarily a country for the Hindus. It follows the logic of the advocates of the two-nation theory — which was rightly rejected by the founders of the republic. The Indian Constitution proposes an inclusive idea of citizenship and does not allow any discrimination on the basis of the applicant’s religious identity. The immediate context of the move to amend the citizenship act is the contingency in Assam, where nearly 30 lakh people face exclusion from the National Register of Citizenship (NRC) — the proposed amendment will make it easy for the Hindus among them to acquire citizenship.

Expectedly, this has revived an old linguistic faultline in Assam, with the Brahmaputra Valley opposing the amendment and the Barak Valley welcoming it. The Centre has sought to address the concerns in Assam by reviving the debate on Clause 6 of the 1985 Assam Accord. Clause 6 talks about “constitutional, legislative and administrative safeguards” to “protect, preserve and promote the cultural, social, linguistic identity and heritage of the Assamese people”. Organisations like the AASU have consistently spoken about implementing Clause 6 and seek reservation of electoral seats, land and other resources for indigenous Assamese people. In essence, these arguments perceive indigeneity and identity as strict and non-negotiable categories. In reality, the Assamese identity needs to be understood as a fluid category shaped by migrations and the vagaries of state-building. Undue emphasis on ethnicity, linguistic or racist purity can only produce an unseemly and perilous politics of exclusion.
