भारत में स्वाभिमान की यात्रा-कथा

शब्दों की अपनी एक लंबी यात्रा होती है। शब्द एक बीज से प्रस्फुटित होकर अर्थों के विभिन्न पड़ावों को पार करते हुए वर्तमान में किसी विचार को अभिव्यक्त करते हैं, लेकिन इस संभावना के साथ कि भविष्य में वे इसे छोड़कर किसी अन्य अर्थ को व्यक्त कर रहे होंगे।

जहां तक ‘स्वाभिमान’ शब्द के बीज-रूप का प्रश्न है, भारतीय दर्शन के आरंभिक चरण में यह इसी रूप में दिखाई नहीं देता, लेकिन इसका मर्म हमें दूसरे कथनों से स्पष्ट हो जाता है। इसके लिए मैं सबसे पहले ऋग्वेद में इंद्र की प्रार्थना में रचा एक श्लोक प्रस्तुत करना चाहूंगा। इसमें प्रार्थना है कि ‘इंद्र! हमें अमरत्व और आनंद दें । शत्रुओं का नाश करने के लिए हमें आवश्यक बल दें । हमें समृद्धि दो और संरक्षण प्रदान करें । विद्वानों की रक्षा करें । हमें अच्छी संतानें और बहुत-सा अन्न दें। आगे बढ़ो, साहसी बनो और लड़े । तुम्हारा प्रयास निरर्थक नहीं हो सकता। हे इंद्र! पौरुष तुम्हारा बल है। बुरी शक्तियों का नाश करें, अपना राजसी बल घोषित करें ।’

ऊपर से अत्यंत सामान्य दिखाई देने वाले इस सूक्त में हमें साफ तौर पर शक्ति, स्वाभिमान और स्वावलंबन की झलक दिखाई देती है। इंद्र को उसकी जिस पौरुष शक्ति की स्मृति दिलाई गई है, उसे ही हम मूलत: महाभारत की गीता में ‘स्वभाव’ और ‘स्वधर्म’ के रूप में पाते हैं। अपने स्वभाव के अनुकूल समुचित आचरण करना ही धर्म है।

वेदों का ही एक बहुत प्रसिद्ध और लोकप्रिय वाक्य है – ‘अहम ब्रह्मस्मि’, यानी कि मैं ही ब्रह्म हूं। किसी जीव के द्वारा स्वयं को ब्रह्म घोषित किए जाने की चेतना में आपको स्पष्ट रूप से स्वाभिमान के दर्शन हो सकते हैं, लेकिन यहां हमें समझना होगा कि ऐसा कहने का अर्थ क्या था । आठवीं शताब्दी में शंकराचार्य के अद्वैतवाद के केंद्र में ‘अहम ब्रह्मस्मि’ का यही वाक्य रहा है। उनके अनुसार जीव में ईश्वर का ही अंश है ,किन्तु अज्ञानता के कारण वह अपनी इस पहचान को भूल जाता है। अज्ञानता क्या है? शंकाराचार्य इसे ‘माया’ कहते हैं और हम इसे वर्तमान संदर्भों में ‘स्व की चेतना का भटकाव’ कहना चाहेंगे। ऐसा इसलिए होता है, क्योंकि जब हम अपने स्वभाव को भूल जाते हैं, तो हमारा केंद्र बिखर जाता है। ऐसे में भटकना हमारी नियति बन जाती है। इसलिए भारतीय दर्शन में ‘आत्म-साक्षात्कार’ करने की बात कही गई, जो की स्वाभिमान का समधर्मी जान पड़ता है।

‘आत्म-साक्षात्कार’ में ‘आत्म’ शब्द बहुत ही महत्व का है। यूनान में प्लेटो-अरस्तू आदि विचारकों ने इस शब्द का प्रयोग चेतना के रूप में किया है। हमारे यहां उपनिषदों ने इसे ‘प्राण’ (वायु) के रूप में देखा। ‘वृहदारण्यक उपनिषद’ में राजा जनक के द्वारा पूछे गये एक प्रश्न का उत्तर देते हुए याज्ञवल्क्य ने भी इसे चेतना के रूप में बताया। याज्ञवल्क्य के शब्द हैं – ‘आत्म ही वास्तव में उसका प्रकाश है, क्योंकि आत्म के प्रकाश से ही मनुष्य बैठता है, चलता-फिरता है, अपने कार्य करता है और लौटता है।’

इस प्रकार हम देखते हैं कि प्राचीन दर्शन में स्वाभिमान का मंतव्य स्पष्ट रूप से ‘स्व’ के ज्ञान से जुड़ा हुआ था, लेकिन उपनिषद काल के बाद से यह ‘स्व’ का ज्ञान ‘स्व’ के अभिमान में परिवर्तित होता चला गया। जैसे ही यह हुआ, वैसे ही इसके अर्थ का केंद्र हमारी अंतश्चेतना (मनोविज्ञान) से छिटककर समाज और राजनीति के संदर्भों में होने लगा। भारत के दो महाग्रंथ ‘रामायण’ और ‘महाभारत’ इसके सर्वोत्तम उदाहरण हैं। यहां से इस शब्द ने फ्रायड के ‘इगो’ के निकट मंडराना शुरू कर दिया। ‘रामायण’ में अभिमान शब्द का प्रयोग रावण के चरित्र को व्याख्यायित करने के लिए किया गया। इसे बोलचाल की भाषा में घमंड कहा जाता है। इसे ‘गर्व’ का पर्याय कदापि नहीं मानना चाहिए। रावण जहां अभिमान का मूर्तिमान रूप था, वहीं हम उसके प्रतिद्वंद्वी राम के अंदर इस भाव को तनिक भी नहीं पाते। अभिमानरहित राम अंतत: अभिमानयुक्त रावण का मर्दन करके ईश्वरत्व के उच्चतम स्तर को प्राप्त करते हैं। वहीं ‘महाभारत’ की कथा जहां एक ओर लालच की कथा है, वहीं इससे भी कहीं अधिक यह ‘स्वाभिमान की रक्षा की कथा’ है। महाभारत के तीन मुख्य चरित्र अपने स्वाभिमान की रक्षा के लिए महायुद्ध तक छेडऩे में परहेज नहीं करते। दुर्योधन के ‘अहं ‘ को ठेस तब लगी थी, जब द्रौपदी ने उन्हें अंधे का पुत्र अंधा कहा था। स्वयं द्रौपदी का स्वाभिमान भरे दरबार में चीरहरण के द्वारा कुचला गया। सूतपुत्र का संबोधन कर्ण के स्वाभिमान को ठेस पहुंचाता था। अंतत: इसका परिणाम क्या हुआ, हम सब अच्छी तरह जानते हैं।

भारत में चौथी शताब्दी में गुप्त काल से सामंती व्यवस्था ने आकार लेना शुरू किया और यह शब्द राजनैतिक सत्ता के लिए एक अनिवार्य तत्व बन गया। सामंती वर्ग के लिये जहां यह उसकी अपनी वर्गीय पहचान थी, वहीं राजनैतिक सत्ता अपने लोगों में राष्ट्र के प्रति अभिमान की भावना की बात कहकर अपनी रक्षा के लिए उन्हें तैयार करतीं थीं । धीरे-धीरे इसका यह अर्थ सामान्यजन की भी चेतना का हिस्सा बनता चला गया।

यहां हम इस स्वाभिमान को आत्मसम्मान के रूप में पाते हैं। साथ ही यहां स्वावलंबन की वह प्रबल भावना भी दिखाई देती है, जिसकी झलक शुरुआत में ही ऋग्वेद की श्लोक में मिलती है। बाद में स्वाभिमान के विभिन्न रूप हमें ब्रिटिश हुकूमत को उखाड़ फेंकने के मनोवैज्ञानिक अस्त्र के रूप में देखने को मिलते है । महर्षि अरविंद, स्वामी विवेकानंद और बाल गंगाधर तिलक जैसे तात्कालिक विचारकों ने स्वाभिमान को गीता के स्वधर्म से जोड़कर अपनी पहचान पुनस्थापित करने की बात कही। यह तभी संभव हो सकता है, जब हम स्वावलंबी हों और स्वावलंबी होना तभी संभव हो है, जब हम स्वयं हों। इस प्रकार ये शब्द एक ही मंजिल के तीन रास्ते बन जाते हैं।

Year Of The Unicorn

The explosion of unicorns is a salute to Indian entrepreneurship, and investor fear of China

Arcane financial market terms rarely enter popular consciousness. However, 2021 is different. Unicorn, a term to describe a privately-held startup that’s valued at over $1 billion, has come to represent the promise of India’s economic potential. In January, Nasscom said India added 12 unicorns last year to take the total to 39, the third largest globally. In a mere six months of 2021, records have been broken. Around $12.1 billion of private capital was raised by startups, exceeding last year’s fund-raising by more than $1 billion. The unicorn count at the end of year will be well past 50.

What’s driving this boom? Mainly, a combination of three factors. Fast-paced internet penetration, a smooth transition of retail transactions from offline to online and the phenomenon RBI’s called ‘fomo’ (fear of missing out). The fomo factor for foreign investors loomed large following the Chinese government’s crackdown on its technology companies. Chinese firms may have raised about $26 billion in new listings in the US since the start of 2020, but recent events have heightened risks and made Indian firms relatively more attractive. There are other reasons too.

China’s technology ecosystem is a product of a state industrial policy. Recent policies have emphasised artificial intelligence (AI), the domain where the strategic rivalry with the US is being played out. America’s National Security Commission on AI said in a report released in March that China is an AI peer in many areas and a leader in some applications. Given this background, the technology ecosystems of China and India are not strictly comparable. But what is a cause for cheer is the backing India’s young entrepreneurs have received and its positive impact on jobs. Perhaps, economic historians in future will look back and dub 2021 the year of the unicorn.

America’s Asia policy

The U.S. must push for a rules-based international order despite Afghan debacle

President Joe Biden has found himself in the uncomfortable position of facing not only the expected criticism from Republicans for his country’s hasty, botched exit from Afghanistan but also brickbats from within the Democratic Party and among the broader American public. The killing of at least 13 U.S. troops and dozens of Afghan civilians in the bomb blasts last week underscored the apparent lack of planning behind the withdrawal despite prior knowledge of its approaching deadline. The chaotic, violent scenes at Kabul airport, undergirded by the deep irony of the Taliban’s unchallenged takeover of Kabul and other Afghan territories, have also no doubt stung U.S. policymakers, especially over comparisons to Saigon in 1975. How can Mr. Biden now hope to sell the big picture of Washington’s engagement in the South Asia region to his domestic political constituents in a way that limits the reputational damage to the White House? The first step will be, at long last, to shift the American policy paradigm on Afghanistan from a boilerplate approach toward institution-building to recognising the political complexities of governing a society where tribal and ethnic loyalties supersede western norms of rational decision-making by government. In part, this means not demonising or cutting ties with the Taliban before they have had an opportunity to settle into power and announce intentions for governing Afghanistan. There must also be a recognition of the role that third parties are going to play, for better or worse. That must include everything from the Pakistani ISI’s shadowy dealings through proxies such as the Haqqani Network, China’s relentless push for access to economic projects, and India’s civilisational and ‘soft power’ links.

In the big picture, there is an unsettling question for Washington to answer, on whether in persisting with the Trump-era promise to pull U.S. troops out of Afghanistan, Mr. Biden will be able to reassure Asian allies and partners that the U.S. will not also play a diminished strategic role in the broader Asia region. To an extent, U.S. Vice President Kamala Harris’s Singapore and Vietnam trip was aimed at assuaging such concerns and shoring up enthusiasm for the rules-based international order that has taken a beating. Yet, unless Washington follows up such summit meetings with ground-level engagement, for example through the Quad or deeper bilateral initiatives with friendly democracies including India, Asian powers will be hard pressed to assume anything other than Washington’s indifference toward their interests. The danger for the West of considerable blowback that could emerge thus are at least two-fold: first, Afghanistan’s cyclical transitions from western-occupied territory to abandoned nation and ultimately a breeding ground for global terror outfits is well-documented; and second, China will be only too glad to step into the breach should any new spaces be ceded in the pecking order of regional hegemony in Asia.

Marital rape: an indignity to women

The marital rape exception is antithetical to women’s dignity, equality and autonomy

The High Court of Chhattisgarh recently decided a criminal revision petition challenging the charges framed against the applicant husband. Based on the allegations of his wife, charges were framed by a trial court under Section 376 (rape), Section 377 (carnal intercourse against the order of nature) and Section 498A (cruelty towards wife by husband or his relatives) of the Indian Penal Code (IPC). The High Court upheld charges under Sections 498A and 377 but discharged the husband under Section 376 on the ground that by virtue of Exception 2 to Section 375 (the definition of rape), sexual intercourse by a man with his own wife (provided she is over the age of 18) would not amount to the offence of rape.

Since the High Court was bound by the law, which exempts husbands from being tried or punished for raping their wives by creating the legal fiction that all sex within marriage is consensual, no other conclusion was open to the Court. Notwithstanding this, the discrepancies and failings of Indian criminal law, highlighted by the judgment, deserve scrutiny.

Inconsistent provisions

First, the marital rape exception is inconsistent with other sexual offences, which make no such exemption for marriage. Thus, a husband may be tried for offences such as sexual harassment, molestation, voyeurism, and forcible disrobing in the same way as any other man. A husband separated from his wife (though not divorced) may even be tried for rape (Section 376B). A husband may be charged and tried for non-consensual penetrative sexual interactions other than penile-vaginal penetration with his wife under Section 377 (prior to the decision of the Supreme Court in Navtej Singh Johar v. Union of India, 2018, consent or lack thereof was not relevant to Section 377, but it is now). As a result, penetrative intercourse that is penile-vaginal is protected from criminal prosecution when performed by a husband with his wife, even when done forcibly or without consent. If there is an underlying rationale to this extremely limited exemption, it is not immediately clear.

Patriarchal beliefs

Second, the marital rape exception is an insult to the constitutional goals of individual autonomy, dignity and of gender equality enshrined in fundamental rights such as Article 21 (the right to life) and Article 14 (the right to equality). In Joseph Shine v. Union of India (2018), the Supreme Court held that the offence of adultery was unconstitutional because it was founded on the principle that a woman is her husband’s property after marriage. The marital rape exception betrays a similar patriarchal belief: that upon marriage, a wife’s right to personal and sexual autonomy, bodily integrity and human dignity are surrendered. Her husband is her sexual master and his right to rape her is legally protected.

A commonly cited rationale for preserving the marital rape exemption is that recognising marital rape as a criminal offence would ‘destroy the institution of marriage’. This was the government’s defence in Independent Thought v. Union of India (2017). Rejecting this claim, the Supreme Court astutely observed, “Marriage is not institutional but personal – nothing can destroy the ‘institution’ of marriage except a statute that makes marriage illegal and punishable.” If it is true, however, that criminalising marital rape will destroy the institution of marriage, what does that tell us about this so-called institution? If its very existence depends on husbands’ right to rape their wives, and on the legally sanctioned violation of wives’ sexual autonomy, is this institution worth saving? Does this kind of marriage deserve to be the cornerstone of our society? Surely, we can do better.

Another argument frequently raised against the criminalisation of marital rape is that since marriage is a sexual relationship, determining the validity of marital rape allegations would be difficult. Even if we accept, arguendo, that marriage is necessarily a sexual relationship, this argument does not hold water. It is not marriage that creates a problem in adjudication, but the dangerously erroneous belief that consent may simply be assumed from a woman’s clothes, her sexual history, or indeed, her relationship status. While the current law seems to operate under this misconception, marriage does not signify perpetual sexual consent. Therefore, the determination of consent or lack thereof in the context of a sexual interaction within marriage would be the same as in any other context (especially in other ongoing sexual relationships): through physical evidence, through the prosecutrix’s testimony and through the defence of the accused.

Underlining subordination

It is shocking that Exception 2 to Section 375 of the IPC survives to this day. Antithetical to the liberal and progressive values of our Constitution, and violative of India’s international obligations under instruments such as the Convention on the Elimination of All Forms of Discrimination against Women, the provision underlines women’s subordination to men, especially within marriage. In 2017, the Supreme Court, in Independent Thought, had read down the exception so that husbands who raped their minor wives could no longer hide behind it. It is high time adult women are afforded the same protection and dignity in marriage.

तालिबान शासन अब सच्चाई हे, पर भारत के लिए खतरा है

अफगानिस्तान में तालिबानी शासन को सच मानना दुनिया की अनचाही मजबूरी है। यूएन सुरक्षा परिषद की ओर से भारत के स्थाई प्रतिनिधि ने तालिबान के काबुल कब्जे के एक दिन बाद एक बयान जारी किया, जिसमें तालिबान सहित अन्य संगठनों को ताकीद की थी कि वे दुनिया के अन्य देशों में भी किसी आतंकी संगठनों को अपनी जमीन से मदद न करें। भारत इस परिषद्‌ का अध्यक्ष है। ग्यारह दिन बाद काबुल एयरपोर्ट में हुए धमाकों के 24 घंटे बाद ही परिषद्‌ का सुर बदला और नए बयान में अन्य संगठनों के पहले का शब्द- तालिबान हटा दिया गया। यानी तालिबान को अब स्टेट-एक्टर का दर्जा दिया जाने लगा है। शायद दुनिया की यह मजबूरी हो लेकिन भारत को आतंकवाद के नए खतरे के लिए ज्यादा तैयार होना पड़ेगा। पाकिस्तान द्वारा तालिबान को मदद की पहली और आखिरी शर्त होगी- भारत में आतंक का नया दौर शुरू करना। उधर, खुफिया रिपोर्ट है कि आइएस-केपी (खुरासान प्रांत) जो काबुल एयरपोर्ट ब्लास्ट का जिम्मेदार है, भारत के कई प्रान्तों खासकर केरल, कर्नाटक और कश्मीर के युवाओं को र्क्रूट कर रहा है। इस रिक्रूटमेंट का तरीका इंटरनेट और कोडेड संदेशों के जरिये है। इसे डिकोड कर तेलंगाना की एसआईटी एनआईए तथा आईबी को इनपुट देती रही है। उसके इनपुट पर पिछले कई वर्षों में आतंकवादी गैंग और उनके कई बड़े प्लान ध्वस्त किए गए। खुफिया दुनिया में इस संस्था का साइबर स्किल सर्वमान्य है। भारत एक उदार प्रजातंत्र है, लिहाजा खतरा ज्यादा है। ऐसे में जब दो पड़ोसी देश- पाकिस्तान और अफगानिस्तान आतंक की पौध को बहलाने-फुसलाने के साथ ट्रेनिंग और हथियार देना एक-सूत्री कार्यक्रम बना लेंगे तो भारत को एक नई समस्या से रू-ब-रू होना पड़ेगा। ये न भूलें कि अमेरिका हथियारों का बड़ा जखीरा अफगानिस्तान में छोड़ गया है।

भारतीय भाषाओं में उच्च शिक्षा की कितनी तैयारी ?

मुझसे कई बार पूछा जा चुका है कि भारत को अंग्रेज़ी के वर्चस्व से मुक्ति कैसे मिलेगी? हर बार मैं यही कहता हूं कि जिस दिन देश के प्रधानमंत्री लाल किले की प्राचीर से सिर्फ एक वाक्य बोलेंगे कि आज के बाद हर क्षेत्र में उच्च शिक्षा का माध्यम अंग्रेज़ी नहीं रहेगी, उसी दिन अंग्रेज़ी का दबदबा खत्म हो जाएगा। लोग अंग्रेज़ी बोलते-लिखते-पढ़ते रहेंगे। उसके लिए एक कोना सुरक्षित रहेगा, जिसका आकार फ्रेंच और जर्मन जैसी यूरोपीय भाषाओं के मुकाबले बड़ा होगा। अंग्रेज़ी के साथ हमारा लेन-देन जारी रहेगा, लेकिन ज्ञान-विज्ञान के अध्ययन और निर्माण के लिए उसकी अनिवार्यता खत्म हो जाएगी। हालांकि ऐसा ऐतिहासिक वाक्य बोलने से पहले प्रधानमंत्री को एक बेहद विराट योजनाबद्ध तैयारी करनी होगी। पाठ्यक्रम भारतीय भाषाओं में तैयार कर लिए जाएंगे, अनुवाद के ज़रिये बहुत-सी सामग्री उपलब्ध हो चुकी होगी, भारतीय भाषाओं में पढ़ाने वाले अध्यापकों की कतार खड़ी हो चुकेगी।

इस 15 अगस्त पर प्रधानमंत्री ने लाल किले से भारतीय भाषाओं में शिक्षा देने की आवश्यकता रेखांकित की और इस तरह उस ऐतिहासिक वाक्य को बोलने की पूर्वपीठिका तैयार कर दी। पूछा जा सकता है कि क्या उनकी सरकार उस विराट योजना पर काम कर रही है, जिसके बिना ऐसी घोषणा बेमतलब रहेगी? प्रधानमंत्री ने जो बोला, वह बात नई शिक्षा नीति में पहले से है। लेकिन यह नीतिगत दस्तावेज़ ऐसी कोई पूर्व-योजना पेश नहीं करता और ऐसे किसी भविष्य की तस्वीर नहीं खींचता जो भारतीय भाषाओं में ज्ञान-विज्ञान के अध्ययन-अध्यापन का नज़ारा दिखाए। न तो शिक्षा नीति और न ही प्रधानमंत्री के वक्तव्य से भारतीय प्रौद्योगिकी संस्थानों (आईआईटी) के कानों पर कोई जूं रेंगी है। 14 इंजीनियरिंग कॉलेजों ने 5 भारतीय भाषाओं में तकनीकी शिक्षा के कोर्स जारी किए हैं, लेकिन इन पाठ्यक्रमों को पढ़ाने के लिए अध्ययन-सामग्री उपलब्ध नहीं है। कृत्रिम बुद्धि के ज़रिये पुस्तकों, अकादमीय पत्रिकाओं और वीडियो वगैरह के अनुवाद हेतु कुछ उपकरण तैयार अवश्य किए गए हैं लेकिन इन अनुवादों की गुणवत्ता की गारंटी करने का कोई इंतज़ाम नहीं दिख रहा। स्थानीय भाषाओं में पढ़ा सकने वाले अच्छे अध्यापकों का बेहद अभाव है। दिल्ली विश्वविद्यालय में राजनीतिशास्त्र विभाग में 60% से ज्यादा छात्र अंग्रेज़ी माध्यम के नहीं हैं। फिर भी यहां पिछले कई वर्षों में ऐसी कोई गारंटी नहीं कर पाया जिसके तहत इन छात्रों को हिंदी में पढ़ाया जा सके और इम्तहानों में उनकी उत्तर-पुस्तिकाओं की ठीक से जांच करने की काबिलियत रखने वाले अध्यापकों का इंतज़ाम हो सके।

उच्च शिक्षा पूरी तरह से अंग्रेज़ी के हाथों में है। इस दायरे में भारतीय भाषाओं की उपस्थिति हाशियाग्रस्त है। इस परिस्थिति को उलटने के लिए जैसी कल्पनाशीलता, नियोजन और राजनीतिक इच्छाशक्ति की ज़रूरत है, वह दूर-दूर तक गायब है।ऊपर से दलीलें ये दी जा रही हैं कि भारत में ज्ञान-विज्ञान स्थानीय भाषाओं में पढ़ा भी दिया जाएगा तो भूमंडलीय बाज़ार में अंग्रेज़ी बोले बिना कैसे काम चलेगा। ऐसी दलीलें विश्व-बाज़ार पर अपना दबदबा कर चुकने वाले चीन-जापान ने कभी स्वीकार नहीं कीं। भारतवासियों की अंग्रेज़ी अन्य एशियायी देशों से बहुत अच्छी है। अगर अंग्रेज़ी के दम पर दुनिया जीती जा सकती, तो हमने पिछले 75 वर्ष में जीत ली होती।

गत सप्ताह राष्ट्रीय मुद्रीकरण पाइपलाइन (एनएमपी) को लेकर कुछ उचित आलोचना सामने आई क्योंकि विनिवेश को लेकर सरकार का प्रदर्शन कमजोर रहा है। इस समाचार पत्र ने पहले भी दलील दी है कि इसके क्रियान्वयन को लेकर तमाम जटिल सवाल उठेंगे। एनएमपी को पारदर्शी, लाभकारी और निजी क्षेत्र के निवेशकों के लिए आकर्षक बनाना होगा। मौजूदा हालात में यह आसान नहीं है। सार्वजनिक-निजी भागीदारी (पीपीपी) को लेकर विगत 15 वर्षों में जो दिक्कतदेह अनुभव हुए हैं उनसे यही पता चलता है कि देश में सरकारी और निजी क्षेत्र के बीच संपर्क निष्क्रिय सा है। परिसंपत्ति का निजीकरण करने से कम से कम सरकार पूरी तरह बाहर हो जाएगी और शायद निष्क्रियता की समस्या भी कम होगी। लेकिन मुद्रीकरण पीपीपी के समान ही है जहां सरकार बहुलांश हिस्सेदार बनी रहेगी और निजी क्षेत्र संबंधित परिसंपत्ति का परिचालन करेगा।

ऐसे में एनएमपी को कारगर करने के लिए सरकार को अपने स्तर पर संस्थागत और नियामकीय क्षमता में निवेश करने होंगे। यहां सरकार के वरिष्ठ अधिकारियों का दावा है कि एनएमपी को पेश करने की प्रेरणा सरकारी परिसंपत्तियों का किफायती इस्तेमाल है और इसमें राजस्व को लेकर कोई परख नहीं होगी। मुद्रीकरण प्रशासन किफायत लाने की कोई आसान राह नहीं मुहैया कराता। बल्कि इसके बजाय यह प्रशासनिक सुधारों और संस्थागत नवीनीकरण को और जरूरी कर देता है। क्षमता विस्तार की यह कवायद टाली भी नहीं जा सकती: एनएमपी को लेकर समझौते तैयार होने के पहले समुचित विशेषज्ञता स्थापित होनी चाहिए।

यदि इन समझौतों को स्थायी और कल्याणकारी बनाना है तो इनमें कुछ सिद्धांतों को शामिल करना होगा। पहली बात, इन्हें इस प्रकार बनाना होगा कि आर्थिक शक्ति का केंद्रीकरण न हो या एकाधिकार न हो पाए। यह बात खासतौर पर प्रासंगिक है क्योंकि जिन परिसंपत्तियों की पेशकश की गई है उनमें से कुछ स्वाभाविक एकाधिकार को बढ़ावा दे सकती हैं। ढेर सारे हवाई अड्डे एक ही औद्योगिक समूह को देने की जो गलती हुई है उसे दोहराया नहीं जा सकता। दूसरी बात, मुद्रीकरण के प्रस्ताव की दीर्घावधि की प्रकृति का अर्थ यह है कि अनुबंध की अवधि के दौरान शर्तों पर दोबारा बातचीत अवश्य होगी। परंतु अतीत में राजनीतिक संपर्क वाले रसूखदार कारोबारियों ने जिस प्रकार इस प्रक्रिया को ठेस पहुंचाई और जहां नीलामी या अन्य लाइसेंस हासिल करने वालों ने अपने राजनीतिक संपर्क का इस्तेमाल सौदों को अपने लिए बेहतर बनाने में किया उसे देखते हुए नीलामी के डिजाइन में ही इसकी गुंजाइश समाप्त की जानी चाहिए।

अंत में, विवाद निस्तारण का सवाल आता है। यह सार्वजनिक-निजी समझौतों की नाकामी की प्रमुख वजह रही है। हाल के वर्षों में संबंधित मंत्रालयों के सत्ता की चाह रखने वाले अफसरशाहों के चलते नियामकीय स्वायत्तता खो सी गई है। यदि एनएमपी को कारगर बनाना है तो परिसंपत्ति मुद्रीकरण वाले हर क्षेत्र में स्वतंत्र और सशक्त नियामकों की आवश्यकता होगी जिनका अफसरशाही से कोई लेनादेना न हो। न्यायिक क्षमता का विस्तार, खासतौर पर उच्च न्यायालय के स्तर पर ऐसा करना भी टाला नहीं जा सकता। अगर नियमन की स्वतंत्रता और विवाद निस्तारण की तेज गति सुनिश्चित नहीं की गई तो निवेशक इसमें रुचि नहीं लेंगे। तब यह सांठगांठ वालों और संभावित कुलीनों की रुचि का क्षेत्र बनकर रह जाएगा। हाल के वर्षों में सरकार के प्रशासनिक सुधार करने के प्रयासों में बल नहीं रहा। शायद वह परिस्थितियों के दबाव में आ गई। अब उनमें दोबारा तेजी पैदा करने का वक्तआ गया है। इस बार इसकी वजह हैं 6 लाख करोड़ रुपये।
