Cashless in India

Demonetisation should accelerate the shift to a digital financial economy

epayment2-k19b-621x414livemintAs anyone who has stood in a queue outside an ATM machine will testify, the Modi government’s audacious gamble with note-bandi or note-badli hasn’t been personally easy for most people. Whether it was thought through enough, whether the gains will outweigh the costs or whether it was an arbitrary and “morally callous” decision as the scholar Pratap Bhanu Mehta puts it, is for all practical purposes a moot point now.

By linking his personal prestige directly to demonetisation from the very start, the prime minister ensured that his government is too directly committed for it to contemplate even limited tactical retreats. Whether you think Prime Minister Narendra Modi is being far-sighted or Tughlaqi, for most people what matters now is whether the government will get its act together by the December 30 deadline for replacing old Rs 500 and Rs 1,000 notes and whether ATM queues will start clearing up.

Yes, the government could have done many things better – as the farcically frequent changes to note-bandi rules testify – but what the liberal elite has been refusing to accept is that in pure political terms, Modi has been winning the argument so far. By presenting himself as a revolutionary change agent and tapping into people’s inchoate sense of civic duty by merging notions of national revival and sacrifice with their political imaginaries, Modi has encashed his political capital to construct an intoxicating narrative that has certainly bought him time. The big question now is: can he fix the pain quickly?

Is moving faster to a digital cashless financial economy the solution – as technocrat after technocrat keeps claiming? For example Nandan Nilekani, Infosys co-founder and the creator of Aadhaar, has been unequivocal that the systemic shock of demonetisation will accelerate the digitisation of the financial economy. A shift which he originally thought would take three years will, he now estimates, be compressed into just three to six months!

The eventual ambition, as Niti Aayog CEO Amitabh Kant has declared, is clear. “Mark my words: By 2024, India will have made credit cards, debit cards and ATM machines redundant because of this move. We will have made the greatest innovation and all our transactions by 2024 will be taking place through mobile phones: every single credit and every single debit.” In a week in which, ironically, senior PMO officials including principal secretary Nripendra Misra and additional principal secretary PK Mishra themselves conducted a workshop for PMO staff on how to use mobile banking apps, it is pertinent to ask how much of this is just optimism and bravado and to what extent are these goals achievable.

On the positive side: first, a big digital shift was taking place in India even before the demonetisation move. According to RBI data, total debit cards in India went up from 623.67 million in November 2015 to 867.35 million in September 2016 (a 39% jump, even if many people have multiple cards). Similarly, payments through pre-paid instruments like m-Wallet or PPI cards went up from 62.66 million in November 2015 to 97.07 million in September 2016 (a 54.9% jump). Jan Dhan accounts and RuPay cards seem to have created a bedrock to expand beyond the traditional middle classes.

Second, over the past decade, “The backend architecture is in place in India to enable a digital transformation,” as Nilekani has argued. For the 250-300 million Indians with a smartphone, Raghuram Rajan in April 2016 inaugurated a new peer-to-peer payment app called United Payment Interface (UPI). The government now needs to spread the word on this more effectively.

What about the 300 million or so Indians who don’t have smart but only feature-phones? Nilekani insists that USSD technology backend architecture is in place for their needs and for the 300 million or so Indians who don’t have phones – Aadhaar is the key through micro-ATMs and cashless payments.While technological solutions exist, making them work on the ground will require major mindset shifts. The problem with this rosy picture is whether paanwalas, auto drivers and merchants from Delhi’s Sarojini Nagar to Mumbai’s Chawri Bazar will be willing to shift from cash to cards or mobile payments.

The stark fact is that in a country of over 1.2 billion people, we currently have only 2.12 lakh ATM machines and 1.3 million point-of-sale card machines. People may want to shift to digital methods of payment now that their faith in currency has been shaken, but outages in bandwidth and unpredictable power supply make reliability of digital systems a big challenge. Paying through phones may be attractive but phones must first be connected to the internet.

Currently, only 13 out of every 100 Indians in rural areas actually have internet access – and we are not even talking of quality yet. Getting them to log in and creating reliable networks will be a gargantuan challenge.Countries like Uruguay have put in place incentives for merchants to prefer digital payments. India may need to think about doing so too. Even after full scale-up, a fully financially digitised economy like Sweden still conducts about 20% of its money transaction in cash.

Going cashless, in digital terms, may be a good goal but if people find themselves literally cashless, over the next two to three months, the public mood can shift. Getting enough paper money back in circulation quickly will be key to PM Modi’s gambit. How this unfolds over the next few months, along with the budget, will be pivotal as we head into election season in 2017, with Punjab, Uttarakhand, Manipur, Goa and Uttar Pradesh.

Focus on reform

Demonetisation’s adverse fallout must be offset with a wave of job creation

In what was seen by many as a mini-referendum on demonetisation, BJP did well in municipal council and nagar panchayat elections in Maharashtra, cornering 47 out of the 147 councils that went to the polls. While the NDA government may well control the narrative on demonetisation at the moment, this can change as realisation of the effects of demand compression and economic slowdown triggered by it seeps in. The impact of the slowdown will be uneven across sectors, but what is certain is that the worst affected will be India’s mammoth informal sector where working conditions are already perilous.

In a country with a median age below 30, where a million people enter the work force every month, this can be devastating. The demon in demonetisation needs to be exorcised. Therefore, it should be complemented by sweeping economic reforms which will lead to a favourable environment for job creation. Prime Minister Narendra Modi has shown that he does not shy away from political gambles in pursuit of key aims. In India, the most important aim for any government ought to be reforming its counterproductive labour laws which have created a thin layer of labour aristocracy and a vast underclass restricted to the informal sector.

This is patently unfair. Labour reforms which keep bureaucracy out of business decisions to exit and provide employers flexibility in offering contracts during peak periods are two essential changes needed. This will encourage employers to hire and permit migration of workers from the informal to the formal sector, a very desirable goal. NDA has undertaken some good initiatives to promote competition among states in areas such as ease of doing business. It needs to add to them by allowing states more space to tweak central labour laws and adapt them to local conditions.

Flexibility should be a guiding principle of economic reforms. The financial sector perhaps needs it more than other sectors. Banks have simply not been nimble enough in India to either harness savings across all categories or lend to small businesses. If demonetisation’s negative effects are to be offset, the Modi government should use this opportunity to unleash a wave of reforms and change India’s narrative. NDA’s fourth budget, a little over two months away, offers another splendid platform for this. Jobs are what will determine if India enjoys a demographic dividend or suffers a demographic nightmare. Modi must leverage his political capital to launch job-creating reform.

One more chance to cough up, come clean

edit-15The government has done well to offer those who passed up the Income Declaration Scheme (IDS) one more chance to disclose unaccounted income and become legitimate citizens. Of course, they have to part with a higher share of the disclosed income as tax, penalty and cess: 50 per cent in the new scheme, compared to 45 per cent in IDS. Further, they have to park one quarter of the disclosed income in an interest-free deposit for four years, which money will go into a welfare fund. This fund would have to be an entity separate from most government-sponsored welfare schemes, which are part of the Budget, if its expenditure is not to add to the fiscal deficit.

Some might crib that the new facility to come clean is a step back from the fight against black money. The reality is that people have been buying up old notes at a discount and converting them into new currency using a variety of ways. This would leave the amount of black money intact, although a part of it would stand transferred to the entrepreneur-launderers. By allowing people with undisclosed incomes a chance to pay the government a slightly higher conversion cost, the government has the satisfaction of seeing the entire black money being converted into accounted-for funds. Non-disclosure, if detected and proven by the tax department, would lead to punitive action, taking the total liability up to 85 per cent. Some would be tempted to take the chance that they would not be detected.Some might even try to buy the kind of insurance ticketless travellers on Mumbai suburban trains buy against getting caught. The government must make sure the premium for such insurance is high enough to make it unattractive. This must be done not through random raids and coercion but through sophisticated use of data analytics.

रियल एस्टेट की असलियत

अब तो यह माना जा चुका है कि प्रधानमंत्री नरेंद्र मोदी के नोटबंदी के फैसले से मौजूदा काले धन का एक छोटा हिस्सा ही अर्थव्यवस्था के चलन में लाया जा सकेगा। लेकिन काले धन के प्रवाह का क्या होगा जो लेनदेन संबंधी संरचनात्मक खामियों के चलते पलता-बढ़ता रहता है। इस संदर्भ में देखें तो प्रधानमंत्री नरेंद्र मोदी के सलाहकारों को काला धन के संग्रह और काली पूंजी के बीच अंतर को ध्यान में रखना होगा। लोगों के पास नकदी के रूप में जमा काला धन आनुपातिक तौर पर काफी कम है जबकि रियल एस्टेट और सोने के रूप में काली पूंजी की बड़ी मात्रा है। इनमें से भी रियल एस्टेट पर निगरानी रख पाना कहीं ज्यादा आसान है। रियल एस्टेट में खपाए गए काले धन की मात्रा के बारे में कोई भी पुख्ता जानकारी मौजूद नहीं है। लेकिन नोटबंदी के बाद अगले छह से 12 महीनों में रियल एस्टेट की कीमत में करीब 30 फीसदी की गिरावट आने का अनुमान रियल एस्टेट के भीतर काले धन की मौजूदगी को बताने के लिए काफी है। रियल एस्टेट कारोबारियों के मुताबिक पांच में से केवल एक ग्राहक ही चेक से भुगतान करना चाहता है।

रियलिटी बाजार का ढांचा ही ऐसा है कि इसमें काले धन के इस्तेमाल को प्रश्रय मिलता है। इसमें सबसे बड़ी भूमिका सर्किल रेट की होती है जो कि किसी भूखंड या निर्मित परिसर का स्वामित्व हस्तांतरित करने पर लगने वाला न्यूनतम मूल्य है। अलग-अलग स्थानों के हिसाब से सर्किल रेट भी अलग होता है। असल में यह राज्य सरकार की तरफ से तय फ्लोर रेट होता है और बहुत कम मौकों पर ही इसमें कोई संशोधन होता है। इसके चलते सर्किल रेट आम तौर पर वास्तविक बाजार मूल्य से नीचे ही रहता है। मुंबई जैसे शहरों में प्रॉपर्टी का वास्तविक बाजार मूल्य तो सर्किल रेट से दोगुना पहुंच जाता है जबकि दिल्ली में यह अंतर करीब 30 फीसदी होता है।इस अनियमितता के कारण लोग प्रॉपर्टी खरीदते समय उसकी कीमत का कुछ हिस्सा नकदी में ही देना चाहते हैं क्योंकि राज्यों के राजस्व का बड़ा स्रोत माना जाने वाला स्टांप शुल्क सामान्यत: काफी अधिक होता है। स्टांप शुल्क सौदे की कुल रकम के 3 फीसदी से लेकर 10 फीसदी के बराबर होता है। इसलिए खरीदार सर्किल रेट और बाजार मूल्य में अंतर वाली रकम को नकदी में ही देना पसंद करते हैं क्योंकि उस पर उन्हें स्टांप शुल्क नहीं देना पड़ता है। इस तरह एक प्रॉपर्टी की रजिस्ट्री उसके बाजार मूल्य से कम कीमत पर कराई जाती है। बैंक भी इस रकम को फंड करने के लिए राजी हो जाते हैं।यह सच है कि आज के समय में प्रॉपर्टी का बाजार मूल्य गिर गया है और आगे चलकर इसके सर्किल रेट के आसपास आने के भी आसार हैं लेकिन इसमें किसी को संदेह नहीं होना चाहिए कि बाजार में नकदी का प्रवाह सुधरने और अर्थव्यवस्था के पटरी पर आने के बाद एक बार फिर पुरानी स्थिति लौट आएगी।

हालांकि सर्किल रेट की समय-समय समीक्षा करने और स्टांप शुल्क को कम करने का मसला राज्य सूची का विषय होने से केंद्र सरकार की भूमिका सीमित हो जाती है। लेकिन केंद्र में सत्ता पर काबिज भारतीय जनता पार्टी की 12 राज्यों में अपनी या सहयोगी दलों के साथ सरकारें बनी हुई हैं। प्रधानमंत्री मोदी के लिए इन राज्यों पर अपने प्रभाव का इस्तेमाल कर पाना संभव है। अगर ऐसा होता है तो काले धन के सृजन के लिए मददगार माने जाने वाले रियल एस्टेट कारोबार की कई गलत प्रवृत्तियों को बदला जा सकेगा जो अन्य राज्यों के लिए नजीर भी पेश करेगा। अगर प्रधानमंत्री मोदी भाजपा शासित राज्यों को इसके लिए राजी कर लेते हैं तो लोगों के बीच यह संदेश जाएगा कि वह काले धन पर नकेल कसने के लिए वास्तव में काफी उत्सुक और गंभीर हैं। इससे काला धन विरोधी  अभियान को सियासी चाल बताने वाले आलोचकों को भी चुप कराया जा सकेगा।

क्या मोदी सबको साथ लेकर चल रहे हैं?

dr-tharoorप्रधानमंत्री नरेंद्र मोदी की सरकार कार्यकाल का आधा सफर तय कर चुकी है तो यह सवाल अहम है कि वे ध्रुवीकरण करने वाले नेता हैं अथवा एकजुट करने वाले? क्या प्रधानमंत्री बांटने वाली शख्सियत हैं, जैसाकि 2014 के पूर्व का उनका अवतार बताता है? अथवा वे पिछले ढाई वर्षों में विभिन्न धर्मों व समुदायों के लोगों को एकसाथ भारतीयता के ऐसे साझे विज़न की ओर ले गए हैं, जो सभी को फायदा पहुंचाए? फैसला मिश्रित किस्म का है।
सरकार को शायद अहसास हो कि वह समाज के बड़े तबके की आशंकाओं के बावजूद सत्ता में आई है। 69 फीसदी मतदाता सोचते थे कि संघ परिवार इतना बांटने वाला है कि वह भारत जैसे बहुलतावादी समाज पर शासन करने के योग्य नहीं है। खासतौर पर मोदी के सत्ता-शीर्ष पर रहते हुई 2002 की घटनाओं व बाद के बयानों के कारण चिंता थी कि मुस्लिमों की जरूरतें भारत संबंधी उनके विचार में स्थान रखती भी हैं या नहीं।
मोदी ने घर वापसी से मोहम्मद अखलाक की हत्या तक और मुजफ्फरनगर दंगों से लेकर गोरक्षा के आक्रामक अभियान तक भारतीय समाज को बांटने वाली कई घटनाओं पर या तो असमंजस बना रहने दिया या चुप्पी बनाए रखी। उन्होंने मुस्लिम समुदाय को आश्वस्त करने के कई मौके खो दिए। उन्होंने अपने पूर्ववर्तियों की तरह रमजान के दौरान इफ्तार पार्टी आयोजित करना तो छोड़ो, किसी इफ्तार पार्टी में जाने की सादी-सी औपचारिकता भी नहीं निभाई। उन्हें मालूम होना चाहिए कि पूरे देश में काफी चिंता है खासतौर पर हमारे मुस्लिम नागरिकों में कि भाजपा और इसके सहयोगियों में देश के सारे समुदायों के लिए काम करने की इच्छा है या नहीं अथवा वे देश को समुदायों के आधार पर बांटकर फायदा उठाना चाहते हैं?
मुस्लिम समुदाय के लिए आश्वासन के कुछ शब्द उनकी बेचैनी दूर करने में बहुत उपयोगी होते। इसकी बजाय प्रधानमंत्री ने चुप्पी बनाए रखना उचित समझा फिर चाहे मुस्लिमों के प्रति अपमानजनक बातें कहीं गई हो या उन्हें पाकिस्तान जाने को कहा गया हो। मोदी ने अंतरराष्ट्रीय यात्राओं में आधिकारिक विमान में पत्रकारों को ले जाने की प्रधानमंत्रियों की परम्परा भी तोड़ दी। उन्होंने न तो कोई प्रेस कॉन्फ्रेंस संबोधित की है और न इंटरव्यू दिए हैं। ये उदाहरण बताते हैं कि चुनाव अभियान वाले मोदी से सत्ता में बैठे मोदी कितने भिन्न हैं।
दूसरी तरफ प्रधानमंत्री अपने व्यवहार व भाषणों में पार्टी सहयोगियों के पूर्वग्रहों से ऊपर उठने के प्रयास कर रहे हैं। मैं खुद इस भावनात्मक उदारता का साक्षी बना हूं। पिछले साल प्रधानमंत्री नरेंद्र मोदी के जन्मदिवस पर मैंने ट्वीट किया, ‘हैपी बर्थडे @ नरेंद्रमोदी। आप भारत की सेवा ऊर्जा व वचनबद्धता के साथ करते रहें। मैं अापकी राजनीति से असहमत रहूंगा, लेकिन सम्मान के साथ!’ करीब दो घंटे बाद उनकी प्रतिक्रिया ने मुझे चकित कर दिया, ‘धन्यवाद डॉ. थरूर। रचनात्मक आलोचना के बिना हमारा लोकतंत्र है ही क्या! बहस हमें अधिक मजबूत बनाती है।’ मैंने तो जन्मदिन के अवसर पर हमारे राजनीतिक मतभेद की याद दिलाई और फिर भी उन्होंने इसे सुलह और सहयोगात्मक संवाद के सकारात्मक संदेश में बदल दिया।
ऐसा ही कुछ 2014 में उनकी चुनावी जीत के दिन हुआ था। मैंने कुछ अनिच्छा से ट्वीट किया : अब भी अपने निर्वाचन क्षेत्र में कार्यकर्ताओं को धन्यवाद देता घूम रहा हूं, लेकिन इसके पहले कि बहुत देर हो जाए, चौंकाने वाली जीत पर बधाई।’ कुछ ही मिनटों में जवाब आया, ‘धन्यवाद। आपको भी जीत की बधाई। आइए, बेहतर भारत के लिए मिलकर काम करें।’मैं चाहूंगा कि इसी भावना के साथ मोदी काम जारी रखें।
जहां मोदी प्रधानमंत्री बनने के बाद से कोई भी बांटने वाली या सांप्रदायिक बात कहने के दोषी नहीं हैं, उनकी सरकार ने भारतीय समाज के सबसे प्रतिगामी तत्वों को पूरी आजादी दे दी है। ये हिंदू नेताओं को महिमामंडित करने वाली पाठ्यपुस्तकें लिखने, आधुनिक टेक्नोलॉजी की बजाय प्राचीन विज्ञान के गुणों की विरुदावली गाने, पहचान के राष्ट्रवाद की वकालत करने और हिंदू होने को भारत की पहचान बताने पर जोर देने में व्यस्त हैं। प्रधानमंत्री खुद उदार समावेशी स्वर में बोलते हैं, जिसमें वे सत्ता में आने के पहले नहीं बोलते थे। पर क्या उनका परिवार उनके शब्दों पर खरा उतरना चाहता है?
पंडित नेहरू ने बहुत पहले ही पहचान लिया था कि बहुसंख्यकों की सांप्रदायिकता हमारे बहुलतावादी लोकतंत्र के लिए मूलभूत खतरा है। लेकिन मोदी ने उस विश्वदृष्टि को अपना लिया है, जिसका वे प्रधानमंत्री बनने के पहले तिरस्कार करते थे। क्या वाकई वे ऐसा मानते हैं या ये केवल खोखले शब्द ही हैं? इस पृष्ठभूमि में प्रधानमंत्री की चुप्पी मुझे चिंता में डाल देती है। मैंने प्राय: उन आधारभूत विरोधाभासों की ओर ध्यान दिलाया है, जिनका सामना मोदी कर रहे हैं। प्रधानमंत्री के रूप में उदारवादी सिद्धांतों की हिमायत, जिनके लिए उन्हें उन्हीं ताकतों को त्यागना होगा, जिन्होंने उनकी चुनावी जीत पक्की की है। उनका हिंदुत्व ब्रिगेड से जुड़ाव और प्रधानमंत्री के रूप में उनकी जिम्मेदारियों के बीच का तनाव जाहिर होता जा रहा है। वे चाहे सारी सही बातें कहें, लेकिन कट्‌टरपंथियों की निंदा नहीं करेंगे। ऐसा करके वे उनके जघन्यतम कार्यों को माफ कर देते हैं।
यह विरोधाभास न सिर्फ सबके विकास के लिए प्रतिबद्ध सरकार के प्रभावी नेता के रूप में उनकी विश्वसनीयता को प्रभावित कर रहा है बल्कि सद्‌भावना और विदेशी निवेश को आकर्षित करने की उनकी क्षमता भी प्रभावित हो रही है। प्रधानमंत्री के रूप में उनके भाषण और बयान बताते हैं कि उन्होंने अपना रुख तय कर लिया है कि सरकार और विकास ही हावी रहेंगे कम से कम अल्पावधि में तो। हिंदू कट्‌टरता इंतजार कर सकती है। इसका यह मतलब नहीं कि उन्हें हिंदुत्व के लिए प्रतिबद्धता छोड़नी होगी। बल्कि इसका अर्थ यह है कि यदि हिंदुत्व को दीर्घावधि जीत हासिल करनी है तो यह ऐसी सरकार पर सवार होकर ही कर सकता है, जिसे भारतीय जनता विकास लाने वाले के रूप में देखे। अभी तो इसका अर्थ है ‘सबका साथ, सबका विकास’ के लिए ‘गर्व से कहो हम हिंदू हैं’ को भूल जाना। मेरा मानना है कि मोदी यही करने का प्रयास कर रहे हैं। लेकिन जितना हम अगले चुनाव के नजदीक जा रहे हैं, मुझे आशंका है कि राजनीतिक परिवार का ध्रुवीकरण का तर्क उस सर्वसमावेश पर भारी पड़ेगा, प्रधानमंत्री जिसे बढ़ावा देने का प्रयास कर रहे हैं।

इंसाफ की भाषा

ऊपरी अदालतों में हिंदी में बहस या इसके प्रयोग को लेकर लंबे समय से बात उठती रही है।

ng3संभव है कि अपनी कार्यवाही में हिंदी के प्रयोग की इजाजत न देने का एनजीटी यानी राष्ट्रीय हरित अधिकरण का फैसला दर्ज नियमों के मुताबिक हो। लेकिन यह एक हैरान करने वाला फरमान है। गौरतलब है कि हिंदी में दायर की गई एक याचिका को भ्रम का नतीजा बताते हुए अधिकरण ने साफ किया कि 2011 एनजीटी (चलन व प्रक्रिया) नियमों के प्रावधान 33 के मुताबिक एनजीटी के काम केवल अंग्रेजी में होंगे। यानी अगर कोई अपने कागजात अंग्रेजी में तैयार नहीं करा पाता है तो उसकी याचिका को सुनवाई के योग्य नहीं माना जाएगा। जाहिर है, ऐसे नियम की मार उन लोगों को झेलनी होगी जो किन्हीं वजहों से अंग्रेजी में अपनी बात सामने नहीं रख पाते या फिर अपने दस्तावेज कानून की जटिल गुत्थियों वाली अंग्रेजी भाषा में तैयार नहीं कर पाते।

ऊपरी अदालतों में हिंदी में बहस या इसके प्रयोग को लेकर लंबे समय से बात उठती रही है। जिस देश की एक बड़ी आबादी हिंदी जानती-समझती है और उसमें भी ज्यादातर लोग जो सिर्फ इसी भाषा में बोल और समझ सकते हैं, उनके लिए अदालतों में चलने वाली कार्यवाही और उनके आदेश एक तरह से दूसरे की मदद पर ही निर्भर होते हैं। लेकिन आजादी के करीब सात दशक के दौरान भी इस ओर ध्यान देने और हिंदी जानने-समझने वाली जनता की इस समस्या के हल के लिए शायद ही कोई पहल हुई हो। बल्कि इसी साल अप्रैल में जब देश की सभी अदालतों में संबंधित प्रांत की भाषा के प्रयोग को लेकर याचिका दाखिल की गई थी तो सुप्रीम कोर्ट ने उसे खारिज करते हुए कहा था कि इसके लिए संविधान में ही बदलाव की मांग क्यों नहीं की जाती। यानी हो सकता है कि अपने कामकाज में सिर्फ अंग्रेजी का प्रयोग करना एनजीटी के लिए भी बाध्यता हो, लेकिन अगर कोई व्यक्ति हिंदी में या किसी दूसरी भारतीय भाषा में अपनी बात रखना चाहे तो उसे सिर्फ इसलिए न्याय से कैसे वंचित किया जा सकता है कि उसने अंग्रेजी में दस्तावेज तैयार नहीं कराए? अगर एक बेतुका नियम आड़े आ रहा है, तो उस नियम को हटा दिया जाना चाहिए।

अगर मौजूदा नियम के पीछे हिंदी में तैयार दस्तावेजों को समझने में आने वाली दिक्कत को कारण बताया जा रहा है तो क्या यही दलील केवल हिंदी समझने वाला भी अंग्रेजी की बाध्यता को लेकर नहीं दे सकता? क्या यह अदालत पहुंचने वाले को अनिवार्य रूप से अंग्रेजी के जानकारों पर या अंग्रेजी जानने-लिखने वाले वकील पर ही निर्भर बना देने की व्यवस्था नहीं है? सब जानते हैं कि हमारे देश में केवल अंग्रेजी भाषी लोगों की संख्या कितनी है। लेकिन ज्यादातर शीर्ष संस्थानों में कामकाज के लिए अंग्रेजी का प्रयोग वैसे तमाम लोगों को, जो अंग्रेजी नहीं समझते, दूसरों पर निर्भर होने को मजबूर कर देता है। जहां तक न्यायपालिका का सवाल है तो निचली अदालतों में भाषा के लिहाज से थोड़ी राहत होती है, लेकिन ऊपरी अदालतों में केवल अंग्रेजी का प्रयोग मुवक्किलों को कार्यवाही से लेकर बहस के सभी संदर्भों को समझने से वंचित कर देता है। वादी-प्रतिवादी को आमतौर पर सिर्फ फैसला समझा दिया जाता है। जबकि वहां प्रांतीय भाषा में काम हो तो वे शुरू से लेकर अंत तक, समूची कार्यवाही खुद समझ सकते हैं। न्याय के तकाजे में भाषा का पहलू भी शामिल किया जाना चाहिए।

जंगलों पर अधिकार से दूर होते आदिवासी

झारखंड सरकार द्वारा ‘छोटा नागपुर टेनेन्सी ऐक्ट’ और ‘संथाल परगना टेनेन्सी ऐक्ट’ में प्रस्तावित संशोधनों को स्वीकृति दिए जाने का विरोध थम नहीं रहा है। राष्ट्रपति की मंजूरी मिलते ही इन संशोधनों के तहत सरकार को आदिवासियों की जमीन अधिग्रहण करने का अधिकार मिल जाएगा और आदिवासियों की कृषि योग्य भूमि का औद्योगिक इस्तेमाल संभव हो जाएगा। ‘नेशनल कमिशन फॉर शिड्यूल ट्राइब्स’ के अनुसार, झारखंड की कुल आबादी में अनुसूचित जनजाति समूह लगभग 32 फीसदी की भागीदारी निभाते हैं, जिनकी सभ्यता व प्रथाओं से राज्य की विशेष सांस्कृतिक पहचान भी बनी है। वैसे, झारखंड ही नहीं, वरन अन्य कई राज्य हैं, जहां आदिवासियों का अस्तित्व संकट में है। दिन-प्रतिदिन इनकी कम होती आबादी इस तथ्य को मजबूत करती है कि केंद्र व राज्य सरकारों द्वारा जनजाति विशेष के लिए बनाई गई नीति व कार्यक्रमों से इनका कायाकल्प नहीं हो पाया है।

फॉरेस्ट ऐक्ट- 1865 और 1878 के तहत बिना अनुमति के जनजातियों द्वारा वन उत्पादों के उपयोग तथा उपभोग को गैर कानूनी बनाया गया था। विभिन्न स्तरों पर लंबे समय तक संघर्ष करने के बाद आदिवासियों के अधिकारों की बात पर चर्चा संभव हो पाई। वर्ष 2006 में अनुसूचित जनजाति और वनों में रहने वाले अन्य परंपरागत निवासियों से जुड़ा कानून संसद द्वारा पारित किया गया। ‘वन अधिकार कानून’ के लागू होने के बाद पीढ़ी दर पीढ़ी जंगलों में निवास करने वाले परिवारों को मूलभूत आजीविका का अधिकार प्राप्त हुआ। इस कानून के बाद स्थानीय निवासियों को मालिकाना हक जैसे अधिकार प्राप्त करने का अवसर भी मिला। अब तक 25 लाख हेक्टेयर से ज्यादा ऐसी जमीन का मालिकाना हक आवंटित किया जा चुका है। ऐसे कदमों से जनजाति समूहों में सरकार के प्रति विश्वास का संचार तो जरूर हुआ, लेकिन यह ऐक्ट भी आदिवासियों के अधिकारों को पूरी तरह से संरक्षित कर पाने में नाकामयाब रहा। यह व्यवस्था भूमि अधिग्रहण कानून के अधीन है, जो आदिवासियों को भूमि का मालिकाना हक मात्र रखने देता है।

ज्यादातर मामलों में आदिवासियों की जमीनें अधिग्रहण कर ली जाती हैं और उन्हें इसका पता तब चलता है, जब रेंजर अफसर या फॉरेस्ट गार्ड उस पर अपना अधिकार जमाने पहुंचते हैं। इस स्थिति में आदिवासी समूहों को विस्थापन, पुनस्र्थापन, बेरोजगारी, भुखमरी, कुपोषण समेत अन्य कई तरह की चुनौतियों का सामना करना पड़ता है। परियोजना निर्माण के नाम पर आदिवासियों के विस्थापन का इतिहास भी बहुत अच्छा नहीं रहा है। दामोदर घाटी परियोजना के दौरान विस्थापित हुई आबादी अब भी पुनर्वास और मुआवजे की लड़ाई लड़ रही है।

केंद्र सरकार द्वारा पिछले सत्र में ‘कंपनसेटरी अफॉरेस्टेशन फंड मैनेजमेंट ऐंड प्लानिंग अथॉरिटी’, जो ‘कैम्पा बिल’ के नाम से प्रचलित है, पास किया गया। नए कानून का मकसद उद्योग और कारखानों के लिए काटे गए जंगलों के बदले नए पेड़ लगाकर कमजोर होते वनों को स्वस्थ व सघन बनाना है। इसके लिए कंपनियों द्वारा वन भूमि के इस्तेमाल के बदले मुआवजे के तौर पर ‘कंपनसेटरी अफॉरेस्टेशन फंड’ में पैसा जमा किए जाने का प्रावधान है। लेकिन समस्या यह है कि कानून के लागू हो जाने से वनों की अंधाधुंध कटाई को प्रोत्साहन मिलेगा, जिसका प्रतिकूल असर वहां के निवासियों पर पड़ना तय है।

इस फंड का 90 फीसदी हिस्सा राज्यों और 10 फीसदी केंद्र के पास होगा। इस कोष पर ग्राम सभाओं और स्थानीय प्रतिनिधियों का सीधा असर नहीं होने की वजह से नौकरशाहों व वन विभाग द्वारा धन के दुरुपयोग की आशंका भी बढ़ती है। एक तरफ सरकार औद्योगिकीकरण के नाम पर वनों की कटाई को प्रोत्साहित कर रही है, तो वहीं दूसरी ओर, अरबों रुपये की पूंजी से नए जंगल बसाने की योजना बना रही है। केंद्र व राज्य स्तर के कई कार्यक्रमों की मौजूदगी में भी इस समाज का भला नहीं हो पाया है। कानूनी तौर पर यह अनिवार्य है कि प्रत्येक मंत्रालय व विभाग दलितों व आदिवासियों के उत्थान के लिए क्रमश: 16 व 8 प्रतिशत फंड निर्धारित करें। इस दिशा में पिछले वर्ष फंड की 14 फीसदी राशि ही निर्धारित की गई थी। पिछले दो-तीन वर्षों के दौरान यह राशि और भी कम थी।

The New Cultural Revolution

money11Change is the law of life. Modernity is about breaking stereotypes that govern individual and institutional habits. In today’s world, technology has come to be the main driving force of change. From the steam engine to the electric bulb and internet, technology has defined the evolution of the human mind and civilisation. Should India not keep pace with this momentum?

The demonetisation of high-value currency notes announced on November 8 by Prime Minister Narendra Modi has several dimensions. Cutting off money channels to terrorists and extremist elements, weeding out counterfeit currency and driving out black money are the visible, short-term objectives. But the long-term consequences and gains include ushering in a behavioural change at all levels of society. It is a part of the grand “cultural revolution” that the PM is working on. The entrenched old order needs to make way for a new normal. This cultural revolution, impinging on all walks of public and private life amounts to shaking up the system. It ranges from attending office on time, keeping working and living environments clean, accountability, transparency, technology adoption, innovation, etc.

Instead of quibbling over the ratio of our currency to GDP vis-à-vis other economies, the moot question is how and by when can a common Indian make technology an effective tool. Logic suggests it should be as quick as it can be, given the humongous advantages. Why should one carry currency at all? A least cash society needs to be our goal. The major latent benefit highlighted by the recent demonetisation is it has driven home the point that all Indians should be prepared for a least cash ecosystem. This entails a major attitudinal change and a behavioural modification.

Let us examine demonetisation in the overall context of our institutional culture that has evolved since Independence. There may not be too many dissenting voices if I say that the prime contours of the existing decadent culture are corruption, opportunism, nepotism, greed, repression (remember Emergency?), exploitation of power, sycophancy and self-seeking behaviour. Non-Congress governments made sincere efforts to change this culture but the results fell short given their too brief interregnums. So, everyone knows which party is primarily responsible for this entrenched decadent culture.

Vested with an absolute majority in the Lok Sabha for the first time after 30 years, PM Modi has taken upon the responsibility to change this deeply entrenched system. This is an essential pre-requisite for the making of a developed India. What has PM Modi done and what will the consequences be?

One, he has given the clarion call for a “cultural revolution” against the old decadent culture, whose contours have been outlined above. Two, he set in motion a multi-pronged and comprehensive strategy to cleanse the system of all ills that have worked against the interests of the poor, the common man and the middle class, since the system nurtured by the Congress benefited only a few individuals and groups. Three, his efforts will result in a “new normal” in which the financial institutions and systems will serve the interests of the poor, the common man and the middle classes, who constitute the vast majority of the “honest” that our society is made of.

Four, the initiatives of the prime minister and the government, including the latest “remonetisation”, are aimed at a “behavioural change” that is necessary for building a new and resurgent India based on the cleanliness of thought and action. Five, the perception about India from that of being “corrupt” to “clean” will result in increased investments and enhanced economic and business activities benefiting millions of unemployed youth. Six, the new initiatives will herald a modern India on the lines of advanced countries, where financial payments and transactions will not require currency — technology will become a tool in the hands of common people. Seven, targeted behavioural modification will eventually result in the elimination of black money leading to increased revenues to Central and state governments that ultimately benefits the poor, common man and the middle classes. Finally, the new initiatives will soon transform India, erasing the legacy of the old decadent culture and Modi will emerge as the tallest leader of post-Independence India.

This prospect has obviously rattled some parties, families and individuals who stand to benefit from the status quo. This is the prime reason for their so-called aakrosh. But this anger has no justification as it does not echo with the people who have braved long queues since November 8 with patience and discipline despite the best efforts of some parties to provoke them into violence and unrest. People have raised their hands for a new Bharat. The judgement of the people is out. This, however, is not palatable to some. Their worry is how Modi finds such a resonance with the people. So, let us disrupt Parliament.

It is time that such parties stand by the change that people want and vent their aakrosh against status quo instead of seeking to block change with photo opportunities.

कहां है लोकपाल?

कानून में प्रावधान है कि लोकपाल का चयन करने के लिए बनने वाले पैनल में मान्यताप्राप्त नेता प्रतिपक्ष होना जरूरी है। चूंकि भाजपा सरकार ने किसी को नेता प्रतिपक्ष की मान्यता प्रदान नहीं की है, इसलिए यह संशोधन सुनिश्चित किया जाना जरूरी था कि सबसे बड़ी पार्टी के नेता को लोकपाल नियुक्त करने वाले पैनल में सदस्य बनाया जाएगा

प्रधानमंत्री नरेन्द्र मोदी ने भ्रष्टाचार और काले धन के खिलाफ पांच सौ और हजार रुपये के करंसी नोटों का विमुद्रीकरण करके महायुद्ध छेड़ दिया है। इस फैसले के लिए पर्याप्त तैयारी के अभाव और इससे आमजन को दरपेश असुविधाओं और रुकावटों जैसी आलोचनाओं को भ्रष्टाचार-मुक्त भारत जैसे बड़े उद्देश्य के लिए कुछतो बलिदान आवश्यक जैसी बातें कहकर खारिज किया जा रहा है। लेकिन लोकपाल कानून को लागू करने में सरकार की अनिच्छा के चलते भ्रष्टाचार के खिलाफलड़ाईकी बाबत चिंता थोथी प्रतीत हो रही है। भ्रष्ट सरकारी कर्मचारी-अधिकारियों की जांच व उनके खिलाफमामले चलाने की गरज से एक स्वतंत्र व सक्षम लोकपाल लाए जाने की मांग को लेकर बड़े स्तर पर आंदोलन चलाया गया था। लोकपाल अधिनियम को पारित हुए ढाई साल हो चुके हैं, लेकिन अभी तक इसे लागू नहीं किया गया है। कारण? कानून में प्रावधान है कि लोकपाल का चयन करने के लिए बनने वाले पैनल में मान्यताप्राप्त नेता प्रतिपक्ष होना जरूरी है। चूंकि भाजपा सरकार ने किसी को नेता प्रतिपक्ष की मान्यता प्रदान नहीं की है, इसलिए यह संशोधन सुनिश्चित किया जाना जरूरी था कि सबसे बड़ी पार्टी के नेता को लोकपाल नियुक्त करने वाले पैनल में सदस्य बनाया जाएगा।

27 जुलाई, 2016 को सरकार ने लोकपाल संशोधन बिल पेश किया जिसे संसद के दोनों सदनों ने मात्र 48 घंटों के भीतर ही पारित कर दिया। लोकपाल को लागू करने की सरकारी की अनिच्छा पूरी तरह उजागर हो गई क्योंकि संशोधनों में लोकपाल नियुक्त करने वाले पैनल के स्वरूप के बारे में कोई प्रावधान नहीं था। सच तो यह है कि संशोधनों के जरिए लोकपाल अधिनियम के महत्त्वपूर्ण प्रावधानों में से एक को खत्म कर दिया गया। यह प्रावधान सरकारी कर्मचारी-अधिकारियों द्वारा अपनी संपत्तियों की घोषणा किए जाने की बाबत था। मूल कानून की धारा-44 के तहत अनिवार्य व्यवस्था थी कि सभी सरकारी कर्मचारी-अधिकारियों को स्वयं की और अपने पति/पत्नी तथा आश्रित बच्चों की संपत्तियों और देनदारियों की घोषणा करनी होगी। इन घोषणाओं को सरकारी वेबसाइट्स पर प्रदर्शित किए जाने का भी प्रावधान था ताकि लोकपाल तक शिकायत पहुंचाने वालों के पास समुचित जानकारी उपलब्धरहे। संशोधित कानून में संपत्तियों/देनदारियों को सार्वजनिक करने संबंधी प्रावधान को हटा दिया गया है। केंद्र सरकार को अधिकार दे दिया गया है कि जिस प्रकार और जैसे चाहे यह घोषणा किए जाने के बारे में फैसला कर सकती है। ये संशोधन लोकपाल व्यवस्था लाए जाने के बुनियादी उद्देश्य को ही खारिज करने वाले हैं, जिसे भ्रष्टाचार निवारण अधिनियम (पीसीए) के तहत दंडनीय अपराधों से जुड़ी शिकायतें प्राप्त करने तथा उनकी जांच करने की गरज से लाया गया था। चूंकि पीसीए के तहत आपराधिक कदाचार का आधार उन सरकारी सेवकों से जुड़ा है, जिनके या उनकी तरफ से किसी अन्य व्यक्ति के पास आय के ज्ञात स्त्रोतों से ज्यादा वित्तीय संपत्तियां/देनदारियां हैं, इसलिए जरूरी है कि सरकारी अधिकारियों की संपत्तियों और देनदारियों की घोषणा के उच्च मानक हों।

चूंकि गैर-कानूनी तरीके से कबाड़ी गई संपत्तियां सरकारी अधिकारी अपने परिजनों के नाम कर सकते हैं, इसलिएयह जरूरी है कि सरकारी अधिकारियों के पति/पत्नी और बच्चों की संपत्तियों का विवरण भी उनके द्वारा की जाने वाली घोषणा में शामिल हो। सरकारी कर्मचारी-अधिकारियों के पति-पत्नी और बच्चों की संपत्तियों को सार्वजनिक नहीं किए जाने के पक्ष में दलील दी जा रही है कि इससे निजता और सुरक्षा संबंधी खतरे और उत्पीड़न के हालात बन सकते हैं। पीयूसीएल बनाम भारत संघ मामले (2003) में सुप्रीम कोर्ट ने तमाम पहलुओं से एक सरकारी अधिकारी की पत्नी की ओर से दायर याचिका को परखा था। याचिकाकर्ता ने दावा किया गया था कि उसके द्वारा अर्जित आय और उसके नाम संपत्तियों की सार्वजनिक घोषणा से निजता के उसके अधिकार की उल्लंघना होती है। सुप्रीम कोर्ट ने इस दलील को इस आधार पर खारिज कर दिया कि हमारे देश में जैसा सामाजिक परिदृश्य है, उसमें पति-पत्नी की संपत्ति को पारिवारिक संपत्ति के रूप में देखा जाता है। अदालत ने कहा कि चूंकि बेनामी संपत्तियों को पति-पत्नी में से किसी एक के नाम रखा जाता है, इसलिए संपत्तियों/देनदारियों का सार्वजनिक खुलासा जरूरी है।

यह भी कहा, ‘‘व्यक्तिगत निजता के अधिकार और नागरिकों के सूचना संबंधी अधिकार का सवाल उठे तो नागरिकों के अधिकार को तरजीह मिलनी चाहिए क्यों कि यह व्यापक हित का मामला होता है।’ यह दलील भी भारत के संदर्भ में कोईमतलब नहीं रखती कि संपत्तियों की सार्वजनिक घोषणा से ब्लैकमेल और उत्पीड़न जैसी बातें होने लगेंगी। भारत में संसद और विधान सभा के चुनाव लड़ने वाले उम्मीदवारों को अपनी तथा अपने पति/पत्नी और आश्रितों की संपत्तियों/देनदारियों की सार्वजनिक घोषणा करनी होती है। 2004 के बाद से ये घोषणाएं भारत निर्वाचन आयोग की वेबसाइट पर प्रदर्शित की जाने लगी हैं। इसी प्रकार 2009 से सुप्रीम कोर्ट तथा उच्च न्यायालयों के न्यायाधीशों की संपत्तियों संबंधी घोषणा भी सुप्रीम कोर्ट तथा संबद्ध न्यायालयों की वेबसाइट्स पर देखी जा सकती हैं। अभी तक किसी प्रकार के उत्पीड़न या घोषणा करने वालों की सुरक्षा को खतरे का मामला प्रकाश में नहीं आया है। सच तो यह है कि लोकपाल को लागू न किए जाने पर सुप्रीम कोर्ट खुश नहीं है। 23 नवम्बर, 2016 को लोकपाल की बाबत एक याचिका की सुनवाई करते समय सुप्रीम कोर्ट ने लोकपाल को लागू करने में सरकार की ढिलाई पर फटकार लगाई थी। सरकार की लोकपाल को लागू करने को लेकर इच्छाशक्ति पर सवाल किया था। लगता है कि सरकारी की भ्रष्टाचार-मुक्त भारत में रुचि नहीं है। (सह लेखिका अमृता जौहरी)
