Transparency needed

RBI & EC’s concerns about the opaqueness of electoral bonds should be addressed

The government opened up a controversial route for political funding in 2017, with the introduction of electoral bonds. Their genesis is back in the news, following a two-year effort of an RTI activist to ferret out documents relating to these instruments. Electoral bonds allow a potential donor to fund a chosen political party under the cloak of anonymity, to facilitate which changes were made to relevant sections of the Companies Act. The bonds are to be issued only through State Bank of India, which is aware of the identity of the donor. Given the weak institutional checks and balances in India, this does decidedly tilt the field in favour of the ruling party of the day.

Note that anonymity of the donor applies only from the perspective of the voter, not necessarily from that of the government. This renders the government’s justification of electoral bonds – that the secrecy is necessary to encourage companies to donate without the fear of political retribution – suspect. An analysis of 2017-18 data by the Association of Democratic Reforms has shown that 95% of all the funding through these bonds went to BJP. Another defence is that electoral bonds come through the banking system. Although other parties, especially the regional ones, have also benefited from bonds, the government’s defence is not fully convincing.

The documents obtained through RTI reveal that electoral bonds met with the disapproval of both Reserve Bank of India and Election Commission. They were worried about the implications of the inherent secrecy. There is another insidious danger in the electoral bonds system. Around the time it was introduced the government also amended provisions of Foreign Contribution Regulation Act, creating a pathway for foreign funding of political parties. When juxtaposed with electoral bonds, there is a danger to sovereignty in decision-making.

With significant policy decisions in areas such as telecom ahead, the existing legislative framework raises fears of public policy being captured by anonymous private interests. In this environment, crony capitalism can flourish and even foreign interests anonymously hold sway over policy making. Hopefully, the ongoing Supreme Court hearing on bonds will remedy matters. Better still NDA government should do it on its own, in the larger national interest.

FinComm extension not a problem

If the Finance Commission takes one more year to submit its report, the heavens are unlikely to come crashing down. Yet, it is troublesome that such delay is being introduced into the working of an agency with a predictable, constitutionally mandated periodicity and tenure that derives from it. Creation of new Union territories out of Jammu and Kashmir does not really warrant any major reworking of the commission’s proposals: there would be one less state, to which to devolve funds from the divisible pool, and the funds so saved would need to be diverted to the Centre’s share, to be passed on to the two new Union territories. That is straightforward enough.

What is troubling is the commission’s mandate to explore the possibility of lowering the states’ share in the divisible pool from 42%. True, the previous commission had sharply raised the states’ share from 32% to 42%, crimping the Centre’s fiscal space. But that recommendation had also envisaged a sharp reduction in the flow of funds from the Centre to the states through assorted centrally sponsored schemes (CSPs), alongside and as part of ending transfers of Plan support. Planning came to an end and states stopped receiving Plan transfers. The number of CSPs did come down, but more by agglomeration of disparate schemes into umbrella schemes rather than by actual elimination. In addition, central schemes sprouted, to which the states must contribute their own funds to receive resources under them. These centralised fiscal control, even as the share of the states in the total taxes, cesses and levies collected by the Centre came down to around 32%, with the rise of non-shareable cesses and surcharges in the Centre’s revenues.

The right way for the Centre to acquire the fiscal space it needs to adequately fund defence and other exclusive central subjects is to restrict its activities to the Centre’s list of subjects in the Constitution. Health is a state subject, for example. The Centre’s role should be to promote sensible and coherent policy among the states, not to directly take on health expenditure.

आर्थिक सफलता के स्विस मॉडल से लें सबक

वामपंथी झुकाव वाले कई विद्वान कहते हैं कि उनका आर्थिक पैराडाइज का विजन वाम तानशाही वाले वेनेजुएला पर आधारित नहीं है, बल्कि यह स्कैंडिनेविया से प्रेरित है, जो अमेरिका के समान ही संपन्न और लोकतांत्रिक होने के साथ ही अधिक समानता वाला, सस्ती स्वास्थ्य सुविधा और सबके लिए शिक्षा उपलब्ध कराने वाला क्षेत्र है। लेकिन, एक देश और है जो स्कैंडिनेविया प्रायद्वीप के चार देशों स्वीडन, डेनमार्क, नॉर्वे और फिनलैंड से कहीं अधिक अमीर और इनके समान ही समतावादी भी है। वह 700 अरब डॉलर (करीब 49000 अरब रुपए) की अर्थव्यवस्था है। दुनिया की 20 सबसे बड़ी अर्थव्यवस्थाओं में शामिल है। निरंतर ग्रोथ की वजह से दुनिया के सबसे अमीर देशों की सूची में वह नॉर्वे के बाद तीसरे स्थान पर है। उसकी प्रति व्यक्ति आय 82,000 डॉलर (58.62 लाख रुपए) है। वह दुनिया के सबसे खुश देशों में भी शामिल है और वह स्कैंडिनेविया के समान ही व्यापक रूप से कल्याणकारी लाभ देता है। वहां छोटी सरकार, अधिक खुली और स्थायी अर्थव्यवस्था है। इस कम समाजवादी और अधिक सफल आदर्शलोक का नाम है स्विट्जरलैंड।

हाल के दशकों में स्विट्जरलैंड ने स्कैंडिनेविया के मुकाबले अपनी आर्थिक बढ़त को बहुत अधिक और असमानता के अंतर को बहुत कम कर लिया है। आज स्विट्जलैंड और स्कैंडिनेविया दोनों में मध्यम वर्ग के पास 70 फीसदी संपत्ति है। लेकिन बड़ा अंतर यह है कि एक स्विस परिवार के पास औसत 5,40,000 डॉलर (3.86 करोड़ रुपए) की संपत्ति है, जो स्कैंडिनेविया की तुलना में दोगुना है। एक टैक्स हैवन की पुरानी और मामूली दागदार छवि की वजह से अधिकतर विद्वान स्विट्जरलैंड को मॉडल के रूप में नजरअंदाज करते हैं। 2015 में दबाव में आकर स्विट्जरलैंड ने विभिन्न देशों के टैक्स प्राधिकरणों के साथ बैंक में जमा धन की जानकारी को साझा करने पर सहमति दे दी, लेकिन इसने अर्थव्यवस्था को जरा भी धीमा नहीं किया। स्विट्जरलैंड हमेशा से ही एक गुप्त बैंक से अधिक कुछ और रहा है। पूंजीवाद इसका कोर है। स्विट्जरलैंड में अधिकतम व्यक्तिगत टैक्स 36 फीसदी है, जो यूरोप में सबसे कम है। सरकारी व्यय कुल जीडीपी का एक तिहाई है, जो स्कैंडिनेविया की तुलना में आधा है। सात स्विस लोगों में केवल एक ही सरकारी नौकरी करता है, यह भी स्कैंडिनेविया के औसत का आधा है। स्विट्जरलैंड व्यापार के लिए अधिक खुला है और इसका निर्यात किसी भी स्कैंडिनेविया देश की तुलना में दोगुना है।

एक सुगठित सरकार और खुली सीमाओं ने इस पहाड़ी देश को बायोटेक से लेकर इंजीनियरिंग के क्षेत्र की कंपनियों का हब बना दिया। यूरोप की 100 टॉप कंपनियों में से 13 यहां की हैं। यह संख्या चारों स्कैंडिनेविया देशों को मिलाकर भी दोगुनी है। यद्यपि, बहुराष्ट्रीय कंपनियां बड़े शहरों तक ही केंद्रित हैं, लेकिन अर्थव्यवस्था ऐसी ही विकेंद्रित है, जैसा कि राजनीतिक सिस्टम। हाल ही में मैं जब ज्यूरिख से जेनेवा की ओर गया तो देखा कि कितनी ही दुनियाभर में निर्यात होने वाली चीजों का उद्गम यहां के राज्याें से है। स्विस आर्मी नाइफ श्विज से, स्विस घड़ियां बर्न से और सेंट बनार्ड पपी वालाइस से संबंध रखते हैं।

हाल के वर्षों में स्विस मुद्रा फ्रैंक तेजी से बढ़ी है, लेकिन इसके बावजूद यहां से निर्यात में कोई कमी नहीं आई है। स्विट्जरलैंड दुनिया के कुछ अमीर देशों में शामिल है, जिसका निर्यात लगातार बढ़ रहा है। यह है स्विस उत्पादों की उत्कृष्टता कि ग्राहक अधिक दाम देने को भी तैयार रहता है। यही मांग बताती है कि उसकी अर्थव्यवस्था इतनी स्थिर क्यों है। स्विट्जरलैंड ने 1970 से कभी भी घरेलू मंदी का सामना नहीं किया, जबकि स्कैंडिनेविया देश 1990 में इसका सामना कर चुके हैं। 2008 के वैश्विक संकट के समय भी स्कैंडिनेविया देश स्विट्जरलैंड की तुलना में ज्यादा बुरी तरह प्रभावित हुए थे। अगर कोई मुश्किल दिखती है तो वह है फ्रैंक की बढ़त को धीमा करने की कोशिश। स्विट्जरलैंड ने ब्याज दरों को बहुत ही कम कर दिया है। इससे वहां पर कर्ज लेने में इतनी तेजी आ गई है कि कॉरपोरेट और घरेलू कर्ज कुल जीडीपी का 250 फीसदी हो गया है। यह खतरनाक है।

दुनिया के लिए स्विट्जरलैंड का आकर्षण बहुत अधिक है। स्विस आबादी में जर्मन, फ्रेंच और इतालवी बोलने वाले बहुभाषी लोग शामिल हैं। इनमें कई लोग तो कई भाषाएं भी जानते हैं। एक सदी से यहां पर विदेशों में पैदा हुए लोगाें की संख्या बढ़ रही है। किसी भी स्कैंडिनेविया देश की तुलना मंे स्विट्जरलैंड 1950 से ही अधिक प्रवासियों को जगह दे रहा है। यह 2015 से 2020 के बीच कुल 2,60,000 प्रवासियों को स्वीकार करेगा, जिससे यहां की जनसंख्या में तीन फीसदी की वृद्धि हो जाएगी। स्विस कर्मचारियों को वहां के मेरिट आधारित पब्लिक स्कूल सिस्टम से बहुत मदद मिलती है। ये 12 साल की उम्र से ही बच्चों को तराशने लगते हैं। यहां के विश्वस्तरीय विश्विद्यालयों में औसत सालाना फीस सिर्फ 1000 डॉलर है, जो स्कैंडिनेविया देशों से कम है।

स्कैंडिनेविया समाजवाद के समर्थक स्वीडन जैसे देशों में होने वाले बदलावों को नजरअंदाज कर देते हैं। जब भारी सरकारी खर्च की वजह से 1990 का आर्थिक संकट सामने आया था तो स्वीडन को आयकर की अधिकतम सीमा को 90 फीसदी से घटाकर 50 फीसदी करना पड़ा था। उसकी ग्रोथ लौट आई थी, क्योंकि उसने बहुत कुछ स्विट्जरलैंड की तरह करना शुरू कर दिया था। एक सुगठित सरकार और व्यापार को बढ़ने के लिए अधिक मौके देने से फायदा हुआ।

स्विट्जरलैंड की सफलता का वास्तविक सबक यह है कि निजी एंटरप्राइजेज व सामाजिक कल्याण में से किसी एक को चुनने का जो प्रस्ताव कई राजनेता देते हैं, वह गलत है। एक व्यावहारिक देश में सामाजिक समानता के साथ ही बिजनेस फ्रेंडली माहौल भी हो सकता है, जरूरत सही संतुलन की है। स्विट्जरलैंड इसी सही संतुलन की वजह से दुनिया का सबसे अमीर देश बन गया और सरसरी नजर से यह दिख नहीं रहा है।

बढ़ती आशंकाएं

वित्त मंत्री निर्मला सीतारमण ने सरकार के आर्थिक प्रदर्शन का बुधवार को जोरदार बचाव किया लेकिन केंद्र और राज्य दोनों स्तरों पर राजकोषीय स्थिति लगातार चिंताजनक होती जा रही है। अब तक समस्या का कोई हल भी नजर नहीं आ रहा है। गत सोमवार को संसद में पेश किए गए आंकड़े बताते हैं कि अक्टूबर माह में प्रत्यक्ष कर संग्रह में 17 फीसदी की गिरावट आई। इसका अर्थ यह हुआ कि वित्त वर्ष की पहली छमाही में कर संग्रह की वृद्धि दर 4.7 फीसदी से नीचे आ गई जबकि पूरे वर्ष के दौरान इसके 17 फीसदी रहने का अनुमान लगाया गया था। फिलहाल यह स्पष्ट नहीं है कि कॉर्पोरेशन कर दर में कटौती ने इस संग्रह को किस हद तक प्रभावित किया है। चूंकि वस्तु एवं सेवा कर (जीएसटी) के मोर्चे पर भी प्रदर्शन उत्साहजनक नहीं है इसलिए केंद्र सरकार के राजस्व संग्रह में भारी कमी आ सकती है। ऐसे में यह भी स्पष्ट नहीं है कि केंद्र सरकार चालू वर्ष के राजकोषीय घाटे के लक्ष्य को कैसे पूरा करेगी। व्यय को कम करना या उसे टालना भी एक विकल्प है लेकिन इसका मध्यम अवधि में देश की अर्थव्यवस्था पर बुरा असर होगा।

इस बीच राज्यों की शिकायत है कि जीएसटी क्षतिपूर्ति जारी करने में देर की जा रही है। जानकारी के मुताबिक इसकी बकाया राशि 20,000 करोड़ रुपये से अधिक है। यदि जीएसटी राजस्व की वृद्धि 14 फीसदी से कम रहती है तो केंद्र को राज्यों की क्षतिपूर्ति करनी होगी। इसका केंद्र की वित्तीय स्थिति पर बुरा असर होगा। जीएसटी के मोर्चे पर हर्जाने की गारंटी के बावजूद राज्य सरकारों की वित्तीय स्थिति खराब है क्योंकि मंदी ने उत्पाद और बिक्री कर संग्रह को भी प्रभावित किया है। परिणामस्वरूप एक अनुमान के मुताबिक राज्य सरकारों की उधारी चालू वर्ष में 20 फीसदी तक बढ़ सकती है। ऐसे में काफी संभावना है कि राज्यों का बढ़ा हुआ राजकोषीय घाटा सकल घरेलू उत्पाद के 2.6 फीसदी के बजट अनुमान से अधिक हो जाए। साथ ही राज्य सरकार के व्यय की गुणवत्ता में हाल के वर्षों में गिरावट आई है क्योंकि राजस्व व्यय बढ़ा है। ऐसा आंशिक तौर पर कृषि ऋण माफी जैसी लोकलुभावन योजनाओं के कारण हुआ। राज्य सरकारों की वित्तीय स्थिति बताती है कि निकट भविष्य में इस रुझान में कोई बदलाव नहीं आने वाला। राज्य सरकारों की वित्तीय स्थिति पर पडऩे वाले दबाव का असर व्यापक अर्थव्यवस्था पर पड़ सकता है क्योंकि सरकार के पूंजीगत व्यय के दो तिहाई के लिए राज्य उत्तरदायी होते हैं। चालू वर्ष में राज्यों के पूंजीगत व्यय में भी काफी गिरावट आने की बात देखी गई है। इसका असर निकट भविष्य में मांग और संभावित वृद्धि दोनों पर होगा। इतना ही नहीं उच्च सरकारी ऋण भी कम ब्याज दरों के पारेषण को प्रभावित करेगा। बल्कि सरकारी घाटे में अहम वृद्धि मौद्रिक समायोजन की संभावनाओं को वैसे भी सीमित करती है।

चूंकि निकट भविष्य में अर्थव्यवस्था के स्थायी रूप से उच्च वृद्धि दर के मार्ग पर लौटने की संभावना नहीं है इसलिए सरकार को राजकोषीय स्थिति की व्यापक समीक्षा करनी चाहिए। केंद्र और राज्य दोनों स्तरों पर अगले कुछ सप्ताह में ऐसा किया जाना चाहिए और इसमें विशेषज्ञ समूह की सहायता ली जानी चाहिए। इससे न केवल सरकार की वित्तीय स्थिति का सही आकलन होगा बल्कि नीति निर्माताओं को राजकोषीय खाका नये सिरे से खींचने का अवसर भी मिलेगा। सरकार को जीएसटी व्यवस्था के तमाम लंबित मसलों को हल करना चाहिए ताकि कर संग्रह में सुधार हो सके। यह स्वीकार करना होगा कि व्यय को स्थगित रखने और जवाबदेहियों को सरकारी उपक्रमों पर टालने से समस्या हल नहीं होगी। इससे केवल भ्रम पैदा होगा और सरकार की विश्वसनीयता पर सवाल उठेगा।

भ्रष्टाचार के खिलाफ

इस साल पांचवी बार सख्त कदम उठाते हुए केंद्र सरकार ने इक्कीस और आयकर अधिकारियों की नौकरी से छुट्टी कर दी। इससे यह साफ हो गया है कि भ्रष्ट अफसरों की अब खैर नहीं है। सरकारी विभागों को भ्रष्टाचार मुक्त बनाने की कवायद में अब तक पिच्यासी अधिकारियों की सेवा खत्म की जा चुकी है, जिनमें चौंसठ अधिकारी कर विभाग के हैं। ये सारे अधिकारी वे हैं जिनके खिलाफ घूसखोरी, जबरिया वसूली, पद के दुरुपयोग, आय से अधिक संपत्ति अर्जित करने सहित भ्रष्टाचार के दूसरे संगीन मामले दर्ज हैं। यों तो सरकार का शायद ही कोई ऐसा महकमा होगा जहां भ्रष्टाचार न हो, लेकिन कर विभाग में भ्रष्टाचार सीधे-सीधे आम लोगों से जुड़ा है और कर संग्रह का जिम्मा संभालने वाले अधिकारी किस कदर लोगों को धमकाते हुए लूटते हैं, यह किसी से छिपा नहीं है। खासतौर से कारोबार करने वाले व्यापारी आयकर विभाग की लूट से आतंकित रहते हैं। इसीलिए प्रधानमंत्री ने स्वतंत्रता दिवस के मौके पर लालकिले से अपने भाषण में कहा भी था कि कर विभाग में कुछ काली भेड़ें हैं जो अपनी ताकत का गलत इस्तेमाल करके ईमानदार करदाताओं को परेशान करती हैं। घूसखोर अधिकारी आयकरदाताओं को इस हद तक परेशान कर देते हैं कि कई बार तो लोग मौत को गला लेते हैं। पांच महीने पहले कॉफी डे के मालिक वीजी सिद्धार्थ ने भी आयकर विभाग की प्रताड़ना से परेशान होकर खुदकुशी कर ली थी।

सरकार भ्रष्टाचार के खिलाफ भले कितने अभियान चला ले, लेकिन इसे जड़ से खत्म कर पाना बहुत ही दुष्कर काम है। ऐसा इसलिए है कि हमने भ्रष्टाचार को एक तरह से आत्मसात कर लिया है और मान बैठे हैं कि यह हमारे समाज, प्रशासन और सरकारों का अभिन्न हिस्सा बन चुका है। ट्रांसपेरेंसी इंटरनेशनल इंडिया ने इस साल भारत में भ्रष्टाचार को लेकर बड़ा सर्वे कराया था। इस सर्वे के नतीजे बताते हैं कि साल भर में इक्यावन फीसद लोगों ने घूस देकर अपने काम करवाए। सबसे ज्यादा यानी छब्बीस फीसद लोगों को संपत्ति और भूमि संबंधी कामों के लिए घूस देनी पड़ी। बीस फीसद लोगों को पुलिस में पैसे खिलाने पड़े। इसी तरह नगर निगम, बिजली विभाग, जल विभाग, आरटीओ दफ्तर और अस्पताल ऐसे ठिकाने हैं जहां बिना लेन-देन के काम करा पाना संभव नहीं है और इन महकमों से आमजन का सीधा साबका पड़ता है। इससे अंदाजा लगाया जा सकता है कि देश में निचले स्तर पर किस कदर भ्रष्टाचार पसरा है और लोग पैसे देकर काम कराने को मजबूर होते हैं।

कहने को ज्यादातर सेवाएं ऑनलाइन कर दी गई हैं और इसका मकसद भी यह है कि लोगों को भ्रष्टाचार से मुक्ति मिल सके। लेकिन व्यावहारिक रूप से यह संभव नहीं हो पा रहा है। बड़ी समस्या यह है कि घूसखोरी और भ्रष्टाचार से संबंधित शिकायतों के लिए हमारे पास पुख्ता तंत्र का अभाव है। ज्यादातर लोगों को यह पता नहीं होता कि ऐसे मामलों की शिकायतें कहां की जाएं। जहां जांच होती भी है, वहां इसकी प्रक्रिया इतनी लंबी और जटिल है कि शिकायतकर्ता को इस तरह का कदम उठाना महंगा पड़ा जाता है। सरकारी दफ्तरों के चक्कर न काटने पड़ें और काम न रुके, इस डर के मारे लोग भी छोटे-मोटे कामों के लिए घूस देकर पिंड छुड़ाना बेहतर समझते हैं। पुलिस थाने और अदालतों में भ्रष्टाचार के किस्से कौन नहीं जानता? भ्रष्टाचार से लड़ने के लिए सरकार को तो अपने स्तर पर कड़े कदम उठाने ही होंगे, साथ ही समाज को भी जागरूक बनने की जरूरत है।

जिसकी मंजिल आसमान

उसकी ऐसी कामयाबियां अब रोजमर्रा की बात लगती हैं। भारतीय अंतरिक्ष अनुसंधान संगठन, यानी इसरो के लिए पीएसएलवी रॉकेट छोड़ना और उसके जरिए अंतरिक्ष में एक बड़े व 13 नन्हे सैटेलाइट को स्थापित करना अब कोई बड़ी बात नहीं लगती। ऐसा संगठन, जो अपने यान को मंगल ग्रह तक भेज चुका हो और अपने यान को चांद तक पर उतारा हो, उसके लिए अंतरिक्ष में उपग्रह स्थापित करना कोई बड़ी बात नहीं है। इसरो की ऐसी रोजमर्रा की कामयाबियां हमारे गौरव बोध को नया विस्तार भले ही न देती हों, लेकिन ये उसकी नींव जरूर मजबूत करती हैं। दुनिया के अंतरिक्ष बाजार में इसरो की विश्वसनीयता लगातार बढ़ी है। बुधवार को उसने जो 14 सैटेलाइट अंतरिक्ष में स्थापित किए, उनमें 13 तो अमेरिकी हैं। अमेरिका जैसे अंतरिक्ष कारोबार के अग्रणी और अति विकसित देश की कंपनियां अगर अपने उपग्रहों को अंतरिक्ष में स्थापित कराने के लिए इसरो पर भरोसा कर रही हैं, तो यह कोई छोटी बात नहीं है। इसरो की यह साख इसलिए बनी है, क्योंकि दुनिया भर की अंतरिक्ष कंपनियों में असफलता की सबसे कम दर इसरो की है। अंतरिक्ष बाजार में सफलता की दर से भी ज्यादा मायने असफलता की दर रखती है। जिसकी असफलता की दर जितनी कम होगी, वह उतनी ही भरोसे के लायक अंतरिक्ष एजेंसी है। कोई भी उपग्रह बरसों के शोध और मेहनत का नतीजा होता है, इसमें सिर्फ अत्याधुनिक तकनीक ही नहीं होती, भारी निवेश भी होता है। ऐसे उपग्रह के लिए भरोसा वहीं किया जा सकता है, जहां जोखिम सबसे कम हो। देश का निजी क्षेत्र भी चाहे तो इसरो की इस कामयाबी से बहुत कुछ सीख सकता है।

बुधवार को इसरो ने जिस भारतीय उपग्रह को लॉन्च किया, उसका जिक्र भी यहां जरूरी है। कार्टोसैट-3 नाम का यह उपग्रह संचार और निगरानी का काम करेगा। हर पल धरती की तस्वीरें भेजने वाला यह उपग्रह हमारी सामरिक और नागरिक, कई तरह की जरूरतों में काम आएगा। इसमें लगे कैमरों की नजर इतनी विकसित है कि वे धरती पर दस इंच से छोटी वस्तु या जगह की तस्वीर अच्छी तरह ले सकते हैं, और अंधेरे में भी निगरानी कर सकते हैं। जाहिर है, वे सीमा पर किसी भी घुसपैठ की सूचना वक्त रहते दे सकेंगे और देश के भीतर भी आतंकियों की सक्रियता को रिकॉर्ड कर सकेंगे। इनसे देश के वनों पर भी नजर रखी जा सकेगी और शहरीकरण को भी ठीक से समझा-देखा जा सकेगा। सबसे बड़ी बात यह है कि देश को इसके बाद बहुत सी सूचनाओं के लिए विदेशी एजेंसियों का मोहताज नहीं होना पड़ेगा। प्राकृतिक आपदाओें के समय भी यह हमारी मदद करेगा और तब भी, जब कहीं प्रदूषण बढ़ रहा होगा।

इसरो ऐसे कामों को अंजाम देने वाला सफल संगठन भर नहीं है। वह बहुत अच्छा रोल मॉडल भी है, हसरतों के संग्रहालय में सबसे ऊपर सजाकर रखने लायक एक नाम, जिससे सब प्रेरणा लें और उसकी तरह बनने की कोशिश करें। देश के निजी और सार्वजनिक क्षेत्र से सबसे बड़ी शिकायत यही है कि उन्होंने कभी इसरो को अपना रोल मॉडल नहीं बनाया और न ही उससे प्रेरणा लेने की कोशिश की। अपनी कामयाबियों से इसरो ने जो आत्मविश्वास हासिल किया है, काश! देश के बाकी संगठन उसका एक छोटा सा हिस्सा भी हासिल कर पाते।

ISRO should collaborate with the private sector to aid high-technology manufacturing

The Indian Space Research Organisation’s successful launch on Wednesday of Cartosat-3, along with 13 other small U.S. satellites, marks a major technological milestone for India. Cartosat-3 is capable of unprecedented image resolution of nearly 25 cm on the ground as against the best global military-grade satellites that can provide a 10 cm resolution. The best satellite images commercially available are between 25-30 cm. Thus, as a commercial satellite, Cartosat-3 creates a wealth of applications. Military espionage is the lowest hanging fruit. It is believed that surveillance by the earlier Cartosat-2 satellite series — with a resolution, though coarser, of about 65 cm — was used to plan and execute military operations such as ‘surgical strikes’ across the Line of Control in 2016 and the Manipur-Myanmar border in 2015. For the government, such resolution can help monitor progress of road construction, coastal land-erosion, forest conservation, oceanic changes and infrastructure development. Image resolution is good to have but secondary to image processing. That means unless and until there is sophisticated technology available to analyse the generated images, it will forever be inferior, and less valued, than coarser images scanned by better processing-software.

While satellite launches make for a good spectacle, they are meaningful only in so far as they aid commerce and generate revenue and jobs. Indian regulations restrict access to satellite images sharper than one metre to the government. Other than for transponders, there is a long way to go for Indian private companies sending innovative payloads aboard ISRO launch vehicles. ISRO recently launched a company called New Space India Limited (NSIL), a competitor to Antrix, but like it, is another public enterprise meant to commercialise space products and satellite development deals with private entities. The deal for the U.S. satellites launched along with Cartosat-3 was formally inked by the NSIL. A good beginning, it should not be shackled by bureaucratic encumbrances, à la Antrix. The host of interesting electronics aboard Cartosat-3 should ideally inspire ISRO to explore collaboration with the private sector in improving high-technology manufacturing. While ISRO’s key capability still lies in developing and launching small- and medium-sized satellites, it ought to be able to market the technology aboard Cartosat-3 globally and induce the farming out of satellite development projects to ISRO or its subsidiaries. While ISRO’s credentials as a poster child for India’s technological abilities have been fortified, it still has a long way to go in terms of its reputation as an enabler of local business.

Gubernatorial restructuring

The appointment and tenure of Governors need to undergo radical reform

The actions of the Maharashtra Governor over the last few days have invited scrutiny. From the early morning swearing-in ceremony to the unceremonious pre-floor test resignation of Devendra Fadnavis and Ajit Pawar, Raj Bhavan has found itself in the centre of controversy.

Soon after the Karnataka Assembly elections earlier this year, the actions of the Karnataka Governor were also subjected to judicial scrutiny on aspects of the discretionary powers of the Governor with regard to formation of government. Nevertheless, this week, the Supreme Court had another occasion to reaffirm the law. However, it is unlikely that these controversies will be resolved until there is a constitutional restructuring of the office of the Governor.

The Centre and its Governor

In April 1948, the Drafting Committee of the Constitution insisted on omitting all references to the discretionary powers of the Governor. On May 31, 1949, B.R. Ambedkar said in unequivocal terms that the Governor “is required to follow the advice of his Ministry in all matters”. However, it is trite that the Governor is required to exercise discretion in deciding the formation of government when there is no clear post-poll majority. Here, the cases of S.R. Bommai v. Union of India, Rameshwar Prasad v. Union of India, and Nabam Rebia v. Deputy Speaker provide unambiguous judicial guidance to how the office of the Governor must encounter tricky post-poll claims to form government and stay immune to political bias.

Unfortunately, the appointment process of Governors has made the office vulnerable to the influence of the Union government. Over the years, occupants of this office have continued to look towards New Delhi for guidance. The dangers of this habit are cautioned by lawyer and constitutional expert A.G. Noorani, who argued that a “state’s autonomy comes to naught if its people’s mandate can be defied or ignored by a central appointee.”

In the Karnataka and Maharashtra cases, it is evident that the Governors invited the leader of the BJP when they did not have the support of the majority in the respective Legislative Assemblies. It begs the question what claims of support were made by the BJP leaders to the Governors and how the Governors satisfied themselves of these claims when there was verifiable, adverse information available in public. The Raj Bhavan in Mumbai also witnessed a curious swearing-in ceremony which happened with little or no public notice. Such actions create a reasonable apprehension that the office of the Governor is open to be manipulated and misused in furtherance of political partisanship. This strengthens a call to review and restructure the office of the Governor if its constitutional values are to be safeguarded.

Constitutional correction

There is little doubt that the appointment and tenure of Governors need to undergo radical reform. The Justice P.V. Rajamannar Committee, which was tasked by the Tamil Nadu government to look into Centre-State relations in 1969, recommended that State governments be included in the appointment process of Governors to drastically reduce their discretionary powers. The call to rectify the imbalance in Centre-State equations must begin with such a reform.

Furthermore, for too long, Governors have enjoyed a legal immunity, granted by the Constitution, on account of their sovereign functions. Over the years, the Supreme Court has confirmed its powers to review the actions of the Governors. Any decision of the Governor can be subjected to judicial scrutiny, including the materials placed to arrive at that decision. However, there is a compelling case that the Westminster model of sovereign and symbolic head of state is past its expiry date. The powers and privileges that are attached to the office of the Governor must be accompanied by answerability, transparency and accountability. Governors and their offices must be scrutinised as much as any other public office. The court must lay down guidelines in this regard.
