US steps up

India’s Covid fight gets a much needed shot in the arm with American support

With fresh Covid cases exceeding 3 lakh for the sixth day in a row, and more than 2,000 deaths for the seventh consecutive day, India’s health infrastructure is gasping for oxygen. It’s therefore welcome that the US has sprung into action with President Biden pledging full support for India’s Covid fight, in a phone conversation with PM Modi. In fact, the full spectrum of the American machinery has been mobilised, with defence secretary Lloyd Austin saying that he had directed the Pentagon to use all available resources to support the US inter-agency effort to assist India.

Similarly, US secretary of state Antony Blinken met with leaders of the US business community and the US India Business Council to mobilise support for India. In fact, around 40 top American companies have come together to create a first-of-its-kind global task force for India to provide it with critical medical supplies, vaccines, oxygen and other life-saving assistance. Meanwhile, raw materials are being shipped from America to the Serum Institute to ramp up vaccine production.

All of this indicates the strength and durability of the US-India relationship – after an initially slow response in India’s grave hour of crisis when US messaging was off. Those bilateral and institutional connections need to be leveraged at this hour of crisis. And if the US wants to work with states and other institutions across the country instead of channelling all aid through the PMO, New Delhi shouldn’t make it a sticking point in negotiations. Indeed, given India’s size, decentralised disbursement is likely the quickest and broadest way to channel aid across the country.

India and the US can, as a matter of fact, work together for the benefit of the Indo-Pacific region as a whole – as was envisaged during the Quad summit – where US capital, technology and logistics capabilities are married to Indian vaccine production capacities. The Hyderabad-based vaccine manufacturer Biological E getting US funding to manufacture the Johnson & Johnson vaccine is a good example of such cooperation. The case for such cooperation isn’t just moral but also practical – if the US focusses on fighting Covid within its borders alone while the disease rages unchecked in India and other parts of the developing world, sooner or later disease variants will make their way back to the US and the Western world. Let’s allow Indian and American institutions to directly work together in tackling Covid instead of permitting red tape to bog them down.

No Country For Women

The pandemic could be an inflection point for gender norms in india

India is amongst the most unequal countries in the world to be a woman. The latest annual Global Gender Gap Index released by the World Economic Forum places India 17th from the bottom, with Afghanistan being the lowest. But unlike most nations in this dismal league, in India discrimination starts in the embryo. With the misuse of ultrasound technology for sex-selective abortion, each year India euphemistically has, as per UNFPA estimates, more than 46 million “missing women”.

But why has India’s rank slipped 28 places in the last year? Despite a string of state elections, the share of women ministers has declined sharply from 23 to 9 per cent. Further, Indian women’s labour force participation has plummeted in the last decade to a mere 21 per cent. Before the pandemic, Indian boardrooms had only 15 per cent of women, even as the #MeToo movement exposed the iceberg of sexual harassment in the workplace. Now there are fewer Indian women in the workforce than even Saudi Arabia. Workplace crèches, though legally mandatory in all offices with more than 50 employees and MNREGA worksites, are rare. Anganwadis, too, have yet to be expanded into crèches. On the other hand, the East Asian growth “miracle” was associated with large increases in working women.

Patriarchy is largely instilled at home. Indian women’s daily work is almost 10 times more than men on unpaid domestic chores as per the 2019 NSSO time-use survey. There is now a wealth of new data from the first phase of the 2019-20 National Family Health Survey. Preliminary population weighted averages from 17 states reveals that even before the pandemic, child marriages have marginally increased since the previous survey in 2015-16. While education is now more inclusive, with three-fourths of women literate, only 37 per cent complete Class 10. Beyond the classroom too, opportunities for women often dry up. Less than a third of Indian women earn an income. Compounded with the lack of economic independence, more than a quarter of married women also report spousal violence. However, four out of every five women now operate their own bank accounts, more than two-thirds of young women use menstrual hygiene products, more than half of married women use modern contraceptives and almost half have a mobile phone, though less than a third have ever been on the internet. The National Crime Records Bureau enumerated nearly 88 rapes daily in 2019, with Dalit women in Rajasthan and Uttar Pradesh the most vulnerable.

Within South Asia, however, 83 per cent of post-conflict Nepali women now work outside the home. Women’s quotas also flourish from parliament to local governments. Bangladesh has also raced ahead as the only country where women have reigned as heads-of-state for longer than men.

Rwanda is also one of the few developing countries which has surprisingly closed the gender gap, on several fronts. The turning point was the 1994 horrific genocide and mass rapes, which altered the country’s demographics. With quotas in the 2003 Constitution, women now dominate two-thirds of parliamentary seats.

In India, on the other hand, as a new generation of dynamic women from Disha Ravi to Nodeep Kaur and Hidme Markam face arrest and sedition charges, there is little doubt that women are now inadvertently on the frontlines of a pitched battle against the toxic masculinity of muscular nationalism and extractive corporate plunder. The women of Shaheen Bagh also embody this new wave of intersectional feminist movements.

Every day, we are reminded in no uncertain terms that India is no country for women — within or outside the home. But could the crisis of the pandemic be an inflection point for Indian gender norms?

A patently wrong regime

Over the last few decades, intellectual property rules have served as a lethal barrier to the right to access healthcare

Even an unprecedented pandemic can do little, it appears, to upset the existing global regime governing monopoly rights over the production and distribution of life-saving drugs. If anything, since the onset of COVID-19, we’ve only seen a reaffirmation of intellectual property rules that have served as a lethal barrier to the right to access healthcare over the last few decades. The neo-liberal order, under which these laws exist, is so intractable today that a matter as seemingly simple as a request for a waiver on patent protections is seen as a claim unworthy of exception.

Request for waiver

On October 2 last year, India and South Africa submitted a joint petition to the World Trade Organization (WTO), requesting a temporary suspension of rules under the 1995 Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). A waiver was sought to the extent that the protections offered by TRIPS impinged on the containment and treatment of COVID-19. As we now know, quick and efficient vaccination is the surest route to achieving global herd immunity against the virus. Should the appeal for waiver be allowed, countries will be in a position, among other things, to facilitate a free exchange of know-how and technology surrounding the production of vaccines.

The request for waiver has, since, found support from more than 100 nations. But a small group of states — the U.S., the European Union, the U.K. and Canada among them — continues to block the move. Their reluctance comes despite these countries having already secured the majority of available vaccines, with the stocks that they hold far exceeding the amounts necessary to inoculate the whole of their populations. Their decision is all the more galling when one considers the fact that for the rest of the world mass immunisation is a distant dream. Reports suggest that for most poor countries it would take until at least 2024 before widespread vaccination is achieved.

A patent is a conferral by the state of an exclusive right to make, use and sell an inventive product or process. Patent laws are usually justified on three distinct grounds: on the idea that people have something of a natural and moral right to claim control over their inventions; on the utilitarian premise that exclusive licenses promote invention and therefore benefit society as a whole; and on the belief that individuals must be allowed to benefit from the fruits of their labour and merit, that when a person toils to produce an object, the toil and the object become inseparable. Each of these justifications has long been a matter of contest, especially in the application of claims of monopoly over pharmaceutical drugs and technologies.

A new world order

In India, the question of marrying the idea of promoting invention and offering exclusive rights over medicines on the one hand with the state’s obligation of ensuring that every person has equal access to basic healthcare on the other has been a source of constant tension. The colonial-era laws that the country inherited expressly allowed for pharmaceutical patents. But in 1959, a committee chaired by Justice N. Rajagopala Ayyangar objected to this on ethical grounds. It noted that access to drugs at affordable prices suffered severely on account of the existing regime. The committee found that foreign corporations used patents, and injunctions secured from courts, to suppress competition from Indian entities, and thus, medicines were priced at exorbitant rates. To counter this trend, the committee suggested, and Parliament put this into law through the Patents Act, 1970, that monopolies over pharmaceutical drugs be altogether removed, with protections offered only over claims to processes.

This change in rule allowed generic manufacturers in India to grow. As a result, life-saving drugs were made available to people at more affordable prices. The ink had barely dried on the new law, though, when negotiations had begun to create a WTO that would write into its constitution a binding set of rules governing intellectual property. In the proposal’s vision, countries which fail to subscribe to the common laws prescribed by the WTO would be barred from entry into the global trading circuit. It was believed that a threat of sanctions, to be enforced through a dispute resolution mechanism, would dissuade states from reneging on their promises. With the advent in 1995 of the TRIPS agreement this belief proved true.

As the Yale Law School professor Amy Kapczynski has written, compelling signatories to introduce intellectual property laws like those in the global north was nothing short of a scandal. The follies in this new world order became quickly apparent when drugs that reduced AIDS deaths in developed nations were placed out of reach for the rest of the world. It was only when Indian companies began to manufacture generic versions of these medicines, which was made possible because obligations under TRIPS hadn’t yet kicked in against India, that the prices came down. But lessons from that debacle remain unlearned.

Refuting objections

Instead, two common arguments are made in response to objections against the prevailing patent regime. One, that unless corporations are rewarded for their inventions, they would be unable to recoup amounts invested by them in research and development. Two, that without the right to monopolise production there will be no incentive to innovate. Both of these claims have been refuted time and again.

Most recently, it has been reported that the technology involved in producing the Moderna vaccine in the U.S. emanated out of basic research conducted by the National Institutes of Health, a federal government agency, and other publicly funded universities and organisations. Similarly, public money accounted for more than 97% of the funding towards the development of the Oxford/AstraZeneca vaccine. Big pharma has never been forthright about the quantum of monies funnelled by it into research and development. It’s also been clear for some time now that its research is usually driven towards diseases that afflict people in the developed world. Therefore, the claim that a removal of patents would somehow invade on a company’s ability to recoup costs is simply untrue.

The second objection — the idea that patents are the only means available to promote innovation — has become something of a dogma. But other appealing alternatives have been mooted. The economist Joseph Stiglitz is one of many who has proposed a prize fund for medical research in place of patents. Under the current system, “those unfortunate enough to have the disease are forced to pay the price… and that means the very poor in the developing world are condemned to death,” he wrote. A system that replaces patents with prizes will be “more efficient and more equitable”, in that incentives for research will flow from public funds while ensuring that the biases associated with monopolies are removed.

The unequal vaccine policy put in place by the Indian state is indefensible. But at the same time, we cannot overlook the need for global collective action. If nation states are to act as a force of good, they must each attend to the demands of global justice. The pandemic has demonstrated to us just how iniquitous the existing world order is. We cannot continue to persist with rules granting monopolies which place the right to access basic healthcare in a position of constant peril. In its present form, the TRIPS regime, to borrow the law professor Katharina Pistor’s words, represents nothing but a new form of “feudal calculus”.

Marking the beginning of a green era

To combat climate change, Saudi Arabia has launched the Saudi Green Initiative and Middle East Green Initiative

One of the lessons learned from the ongoing COVID-19 pandemic is the need for collective action among members of the international community to effectively address global challenges such as pandemics and climate change. The pandemic has created an unprecedented crisis that demands an exceptional global response. Even as countries rightly continue to focus on tackling the immediate health emergency, the need is to have a long-term vision to build a climate-resilient global economy for the future.

Progress towards goals

Ambition alone cannot attain goals. Good results depend on our ability to act. That is precisely what defines the two recent initiatives launched by Crown Prince Mohammed bin Salman bin Abdulaziz, Deputy Prime Minister of the Kingdom of Saudi Arabia, to combat the threat of climate change — the ‘Saudi Green Initiative’ and the ‘Middle East Green Initiative’.

In fact, one of the main pillars of the Saudi G20 presidency was to “safeguard the planet”. The Saudi leadership of the summit highlighted how climate change had negatively impacted the planet, people’s lives and their well-being. The G20 introduced initiatives like establishing a Global Coral Reef Research and Development Accelerator Platform to accelerate scientific knowledge and technology development in support of coral reef survival, conservation, resilience, adaptation and restoration. G20 leaders also acknowledged the Circular Carbon Economy (CCE) Platform as a tool towards affordable, reliable, and secure energy and economic growth.

Saudi Arabia is committed to lead regional efforts to address climate change and has been making steady progress in this direction.

The Saudi Green Initiative aims to raise the vegetation cover, reduce carbon emissions, combat pollution and land degradation, and preserve marine life. As part of the initiative, 10 billion trees will be planted in the Kingdom. It aims to reduce carbon emissions by more than 4% of global contributions, through a renewable energy programme that will generate 50% of Saudi’s energy from renewables by 2030. With the understanding that the need of the hour is to do more than enough, Saudi Arabia is working towards raising the percentage of its protected areas to more than 30% of its total land area, representing roughly 6,00,000 sq km, exceeding the global target of 17%.

As part of the Middle East Green initiative, Saudi Arabia will work with the Gulf Cooperation Council countries and regional partners to plant an additional 40 billion trees in the West Asian region. It represents 5% of the global target of planting one trillion trees and reducing 2.5% of global carbon levels. Saudi Arabia has been sharing its expertise and know-how with its neighbouring countries to reduce carbon emissions resulting from hydrocarbon production in the region by 60% and globally by 10%.

Saudi Arabia currently operates the largest carbon capture and utilisation plant in the world, turning half a million tonnes of CO2 annually into products such as fertilizers and methanol. It also operates one of the region’s most advanced CO2-enhanced oil recovery plants that captures and stores 8,00,000 tonnes of CO2 annually. Plans are afoot to deploy additional carbon capture, utilisation and storage infrastructure. Saudia Arabia believes that nature-based solutions will play an important role in removing carbon as part of the CCE. We have already joined hands in February 2019 with India when Saudi Arabia joined the International Solar Alliance during the Crown Prince’s state visit to the country, hence promoting cooperation in the renewable energy sector. Later that year, when the Indian Prime Minister visited Saudi Arabia, several MoUs and agreements in key sectors including renewable energy were signed.

To ensure momentum and continuity, Saudi Arabia will convene an annual summit called the Middle East Green Initiative which will host leaders from the government, scientists and environmentalists to discuss the details of implementation. The aim is start implementing the plan in the fourth quarter of this year and continue for the next two decades. Saudi Arabia also recognises the scarcity of financial resources to irrigate the terrain. Therefore, in partnership with participating countries, innovative methods will be researched to irrigate from treated water, cloud seeding and other purpose-driven solutions such as planting native trees which requires support for three years to grow and will then be able to survive on their own with natural irrigation.

Working towards Vision 2030

In 2016, the Crown Prince unveiled Vision 2030, a comprehensive road map to improve the quality of life of the citizens of the country. As part of this, Saudi Arabia carried out a comprehensive restructuring of the environmental sector and established the Environmental Special Forces in 2019. With NEOM and The Line, Saudi Arabia has already redefined the idea of sustainable habitats. NEOM’s location also gives Saudi Arabia many advantages in the field of hydrogen production. According to the World Bank, for every dollar invested in resilient infrastructure, $4 in benefits are generated. With the Public Investment Fund recently pumping in $15 billion in the NEOM project and another $10 billion in renewable and solar energy projects, it is clear that the pandemic has only strengthened Saudi Arabia’s resolve to realise the goals of Vision 2030 and become one of the major producers of renewable energy with a capacity to generate 9.5 GW by 2023.

Our close friend and strategic partner India has also made remarkable commitments to tackle climate change and is on track to achieve its Paris Agreement targets. India’s renewable energy capacity is the fourth largest in the world. India has an ambitious target of achieving 450 gigawatts of renewable energy capacity by 2030. We admire India’s endeavour to build a safe and clean environment for future generations.

Saudi Arabia hopes that the launch of the Saudi Green Initiative and the Middle East Green Initiative marks the beginning of a green era and that these initiatives provide momentum to other countries to unify their efforts to save our planet.

संदेह जगाने वाला अमेरिकी आचरण

आखिरकार कुछ ना-नुकुर के बाद अमेरिका ने भारत को वैक्सीन निर्माण के लिए कच्चे माल की आपूर्ति करने का फैसला तो कर लिया, लेकिन इसमें टालमटोल से जो नुकसान होना था, वह तो हो ही गया। बीते दो दशकों से भी अधिक समय से दोनों देशों के जो रिश्ते लगातार प्रगाढ़ हो रहे थे, उस पर बाइडन प्रशासन ने दो दिनों में ही पानी फेरने का काम कर दिया। फिलहाल भारत कोरोना संक्रमण की दूसरी लहर के जिस अप्रत्याशित एवं अभूतपूर्व संकट से दो-चार है, उसमें पाकिस्तान जैसे बिगड़ैल पड़ोसी तक कम से कम प्रतीकात्मक ही सही, लेकिन साथ में खड़े होने की बात तो कर रहे हैं। इसकी तुलना में खुद को भारत का सबसे बड़ा हितैषी और सहयोगी बताने वाले अमेरिका का रवैया देखिए। भारत द्वारा वैक्सीन के लिए कच्चे माल की मांग पर अमेरिकी विदेश विभाग के प्रवक्ता ने कहा कि हम पहले अपने लोगों की जान बचाने के लिए प्रतिबद्ध हैं। अमेरिका का यह रवैया न केवल द्विपक्षीय संबंधों पर आघात करने वाला, बल्कि एक वैश्विक नेतृत्वकर्ता के रूप में उसकी भूमिका पर भी सवाल खड़े करता है। वह भी तब जब अमेरिका चीन के मुकाबले अपनी नई छवि गढ़ने में जुटा है। अमेरिका ने यह बयान तब दिया, जब वहां वैक्सीन के भंडार लबालब भरे हैं और एक बड़ी संख्या में अमेरिकियों को कोरोना रोधी टीका लगाया भी जा चुका है। जब अपनी जरूरत की पूर्ति के लिए पर्याप्त वैक्सीन उपलब्ध हो तो दूसरे देशों की मदद न करना एक तरह से मानवता के प्रति अपराध ही है। अमेरिका के मुकाबले कहीं बड़ी आबादी वाले भारत में अभी टीकाकरण की प्रक्रिया जारी है और इसी बीच कोरोना संक्रमण की दूसरी लहर बेलगाम होती जा रही है, फिर भी अमेरिका तत्काल सहयोग के बजाय भारत को टरकाता रहा। यह स्थिति तब बनी, जब गत वर्ष भारत ने संकट के समय अमेरिका की भरपूर मदद की थी।

जहां हमारी मुसीबत के समय अमेरिका ने एक तरह से हाथ खड़े करके हीलाहवाली का परिचय दिया वहीं फ्रांस, ब्रिटेन और संयुक्त अरब अमीरात जैसे कई देशों के शीर्ष नेताओं ने न केवल भारतीय नेतृत्व के साथ संवाद स्थापित किया, बल्कि हरसंभव मदद का आश्वासन भी दिया। भारत को मिलते ऐसे वैश्विक समर्थन से ही शायद अमेरिका की आंखें खुली हों और कुछ सोच-विचार के बाद वह वैक्सीन निर्माण के लिए आर्पूित सुनिश्चित करने पर सहमत हुआ। हालांकि केवल इसी कारण बाइडन प्रशासन भारत की मदद के लिए तैयार नहीं हुआ। अमेरिका में घरेलू स्तर पर भी भारत के पक्ष में बड़ा दबाव पड़ा। वहां सार्वजनिक जीवन से जुड़ी कई हस्तियां और सांसद तक इसके पक्ष में आवाज उठा चुके थे। अमेरिका में प्रभावशाली भारतीय मूल के लोग भी लामबंद हुए। यूएस चैंबर्स ऑफ कॉमर्स को आशंका थी कि इससे अमेरिका-भारत के बीच परवान चढ़ रहे व्यापारिक रिश्ते पटरी से उतर सकते हैं। इन सभी पहलुओं का आकलन करने के बाद ही बाइडन प्रशासन ने भारत की मदद के लिए हाथ बढ़ाया। हालांकि यह हाथ अभी भी आधा-अधूरा ही बढ़ा है, क्योंकि अमेरिका ने कोरोना वैक्सीन के पेटेंट को लेकर रियायत के मसले पर कोई निर्णय नहीं लिया है, जिसके लिए भारत मुहिम चला रहा है।

इस पूरे प्रकरण में एक अहम प्रश्न यही उठता है कि भारत की मदद के लिए अमेरिका ने पहले हिचक क्यों दिखाई? अमेरिकी सत्ता प्रतिष्ठान से जुड़े सूत्रों का कहना है कि इसके पीछे वैचारिक पूर्वाग्रह हावी रहे। कहा जा रहा है कि बाइडन प्रशासन निजी तौर पर मोदी सरकार को लेकर बहुत सहज नहीं है। यदि ऐसा है तो यह और भी शर्मनाक है। कोरोना संकट सरीखी वैश्विक आपदा में अगर अमेरिका जैसा उदार एवं लोकतांत्रिक देश भी मदद के लिए वैचारिक पूर्वाग्रह से ग्रस्त हो तो यह उसके माथे पर किसी कलंक से कम नहीं। फिर जिस मोदी सरकार पर कथित रूप से हिंदू राष्ट्रवादी सरकार होने के आरोप लगाए जाते हैं, क्या कोरोना काल में उसके कामकाज को देखकर ऐसा कहा जा सकता है? इस कथित हिंदू राष्ट्रवादी सरकार ने अपने नागरिकों की जरूरतों की परवाह न कर दुनिया के 90 से अधिक देशों में कोरोना वैक्सीन के करोड़ों टीके पहुंचाए। उनमें कैथोलिक चर्च को मानने वाले ईसाई देशों से लेकर शरीयत से चलने वाले इस्लामिक मुल्क तक शामिल हैं। भारत ने टीके पहुंचाने में कोई पक्षपात नहीं किया। इतना ही नहीं कोरोना की पहली लहर के दौरान तमाम जरूरी दवाएं और उपकरण मुहैया कराए। कुल मिलाकर भारत ने अपेक्षाकृत कम संसाधनों वाला देश होने के बावजूद अपनी हैसियत से अधिक मदद पहुंचाई। भारत के इन प्रयासों की बिल गेट्स से लेकर विश्व स्वास्थ्य संगठन तक ने मुक्तकंठ से प्रशंसा की।

इसी महीने सात अप्रैल को भारतीय विशिष्ट आर्थिक क्षेत्र में अमेरिकी जंगी जहाज की गश्त को कुछ दिन बीते ही थे कि अमेरिका ने भारत को वैक्सीन के लिए सामग्री देने में आनाकानी कर एक गलत संदेश दिया। इससे यही जाहिर होता है कि बाइडन प्रशासन भारत की संवेदनाओं को लेकर असंवेदनशील है। भले ही अमेरिकी मदद के बाद तात्कालिक रूप से इस प्रकरण का पटाक्षेप हो गया है, लेकिन इसके गहरे निहितार्थ होंगे। कोरोना काल में चीन केंद्रित आपूर्ति शृंखला का विकल्प बनाने की पहल को इससे आघात पहुंचेगा। एक आपूर्तिकर्ता के रूप में अमेरिका की साख को बड़ा झटका लगेगा कि उस पर भरोसा नहीं किया जा सकता। पिछले कुछ अरसे से भारतीय विदेश नीति के अमेरिका के पक्ष में हद से ज्यादा झुकने का आरोप लगाने वाले खेमे को भी इससे ताकत मिलेगी कि भारत उस पर अधिक भरोसा करने करने का जोखिम न मोल ले। भारतीयों के मन में भी अमेरिका को लेकर एक नकारात्मक धारणा बनेगी। साथ ही क्वाड, हिंद-प्रशांत भागीदारी, द्विपक्षीय व्यापार और अवसंरचना के स्तर पर दोनों देशों के बीच जुड़ाव पर भी ग्रहण लग सकता है। कुल मिलाकर अमेरिका के साथ संबंधों में पुरानी हिचकिचाहट वापस लौटेगी। इस मामले का एक सबक यह भी है कि भारत को सोचना होगा कि उसे अपनी अन्य लड़ाइयों की तरह कोरोना के खिलाफ जंग भी खुद ही जीतनी होगी। इतिहास साक्षी है कि अमेरिका ने अतीत में जब भी खाद्य, परमाणु और अंतरिक्ष के मामले में भारत को आंखें दिखाई हैं तो भारत ने अपनी क्षमताएं निखारकर आत्मनिर्भरता हासिल करने में सफलता हासिल की है। यह पड़ाव भी कुछ ऐसा ही है।

समुद्री क्षेत्र में मिले संदेश को समझना आवश्यक

हाल ही में अमेरिका का गाइडेड मिसाइल डिस्ट्रॉयर, यूएसएस जॉन पॉल जोंस, लक्षद्वीप क्षेत्र में भारतीय विशिष्ट आर्थिक क्षेत्र (ईईजेड) से होकर गुजरा। यह पोत फारस की खाड़ी से मलक्का जलडमरुमध्य की ओर जा रहा था लेकिन इस जिस सातवें बेड़े का यह हिस्सा था उसने इसे फ्रीडम ऑफ नेविगेशन ऑपरेशन (एफओएओपीएस) का नाम दिया। ऐसा लगता नहीं कि बेड़े का मुख्यालय बिना उच्चाधिकारियों की इजाजत के ऐसी घोषणा करेगा।

भारत सरकार ने औपचारिक आपत्ति जताते हुए कहा कि इसकी पूर्व अनुमति नहीं ली गई थी। अमेरिकी सरकार की ओर से इस पर बड़ी संक्षिप्त और रूखी प्रतिक्रिया आई। कहा गया कि उसका जहाज ‘अंतरराष्ट्रीय जल सीमा’ से गुजर रहा था जहां उसे आवागमन का पूरा अधिकार है। यह देखना दिलचस्प है कि आखिर अमेरिका ने ऐसा व्यवहार क्यों किया और हमारी प्रतिक्रिया ऐसी क्यों रही?

अधिकारों की बात करें तो समुद्री तटवाले हर देश को समुद्र में एक निश्चित सीमा तक अधिकार होता है। यह सीमा तट से 12 मील तक होती है। इसके बाद ईईजेड का क्षेत्र शुरू होता है जो तटीय इलाके से 200 मील तक होता है। यह वह इलाका है जहां समुद्र के नीचे आर्थिक खनन के तमाम अधिकार उस देश को हासिल होते हैं। परंतु आवागमन के मामले में यह क्षेत्र ईईजेड का हिस्सा होता है जो अंतरराष्ट्रीय जल क्षेत्र होता है और जहां सभी देशों के पोत अबाध भ्रमण कर सकते हैं। उन्हें इसके लिए तटीय इलाके की इजाजत की आवश्यकता नहीं होती। इस मामले में पूर्व सूचना देना भी बस शिष्टाचार का हिस्सा है। इस बात का संयुक्त राष्ट्र के समुद्री कानूनों (यूएनसीएलओएस) 1982 में समुचित उल्लेख है। हमने इस पर हस्ताक्षर किए हैं लेकिन अमेरिका ने नहीं। हालांकि यह व्यवस्था जरूर है कि ईईजेड से पोत के गुजरते समय समुचित सूचना दी जाएगी। अन्य देशों ने अपने स्तर पर संशोधन किए हैं लेकिन उनकी प्रासंगिकता इस बात पर निर्भर है कि उनका कितना पालन होता है।

यह पहला मौका नहीं है जब कोई विदेशी युद्घपोत बिना हमें सूचना दिए या मंजूरी लिए ईईजेड से गुजरा है। यहां मसला यह नहीं है कि अमेरिकी विध्वंसक ने यह रास्ता चुना, बल्कि मुद्दा है अमेरिकी उच्चाधिकारियों का इस पर प्रतिक्रिया देने का रुखा अंदाज।

ऐसी भी घटनाएं घटी हैं जब अमेरिकी विमानवाहक पोतों और परमाणु क्षमता संपन्न पनडुब्बियों वाले कार्य बल ने हमारे ईईजेड में अभ्यास किया है। लेकिन वह शीतयुद्घ का दौर था जब दोनों देशों के रिश्ते तनावपूर्ण थे। उदाहरण के लिए सन 1982 में अमेरिकी विमानवाहक पोत यूएसएस जॉन एफ केनेडी के नेतृत्व में एक कार्यबल ने दीव से 100 मील दूर अभ्यास किया था और भारतीय नौसैनिक विमानों ने उसकी निगरानी की थी। परंतु इस तथाकथित एफओएनओपीएस का मामला तब हुआ है जब दोनों देश हिंद-प्रशांत क्षेत्र में करीबी सामरिक साझेदार हैं। ऐसे में चर्चा करना उचित है।

पहली बात, हमारी समुद्री सैन्य शक्ति की सराहना करनी होगी कि उसने ईईजेड की समुचित निगरानी बरकरार रखी। यही वजह थी कि अमेरिकी युद्घपोत का पता लगाया जा सका। कुछ समय पहले नौसेना प्रमुख ने कहा था कि मलक्का जलडमरूमध्य के जरिये हिंद महासागर क्षेत्र में आने और जाने वाले हर चीनी युद्घपोत पर नजर रखी जा रही थी। इस हालिया घटना से उनके दावे की पुष्टि होती है।

उपग्रह के जरिये टोह लेकर या विमानों की मदद से हम अपने क्षेत्र में पोतों के आवागमन की निगरानी कर पा रहे हैं। इस क्षमता में वृद्घि करना एकदम आवश्यक है। इसके साथ ही हमें यह क्षमता भी विकसित करनी होगी कि ऐसी घुसपैठ का पता लगने पर कूटनीतिक कदम उठाने के अलावा अन्य तरह से भी प्रतिक्रिया दी जा सके। अतीत में हमारे पोतों ने घुसपैठ करने वाले जहाजों को न केवल रोका बल्कि हमारे ईईजेड से बाहर भी निकाला। इस समुद्रीय शक्ति को हासिल करना हमारे सैन्य शक्ति बनने की अनिवार्य शर्त है। इसमें विमानवाहक पोतों की अहम भूमिका है। फिलहाल ऐसे कम से कम तीन पोतों की आवश्यकता है। आशा करनी चाहिए कि भारतीय नौसेना और सरकार इससे अवगत होंगे।

इस घटना का दूसरा पहलू एक राजनीतिक संदेश देने की कोशिश हो सकती है। भारत को शायद एकदम निचले स्तर से संदेश देने की कोशिश की गई ताकि किसी देश को नुकसान भी न पहुंचे। इसके बावजूद अमेरिका ने सुर्खी बना दिया और भारत में इसे लेकर नकारात्मक प्रतिक्रिया सामने आई। यह अनुमान से परे नहीं रहा होगा। भारतीय प्रतिक्रिया का अनुमान तो था लेकिन संभावित लाभ कहीं अधिक महत्त्वपूर्ण थे।

यह सवाल पूछा जा सकता है कि इसकी वजह क्या हो सकती है? एक, शायद चीन को यह संदेश देने की कोशिश की गई कि अमेरिका केवल उसके इलाके में ही नहीं बल्कि दुनिया के अन्य हिस्सों में भी एफओएनओपीएस के जरिये ऐसा कर सकता है। उसने जताया कि वह भारत जैसे देश के साथ भी ऐसा कर सकता है जो मित्र राष्ट्र हैं। ऐसे में चीन की खुशी बिना वजह नहीं है। रूसी विदेश मंत्री की हालिया भारत यात्रा और एस 400 एएमडी सिस्टम को लेकर दिया गया संकेत भी वजह हो सकता है।

अभी यह भी स्पष्ट नहीं है कि उक्त सिस्टम की आपूर्ति शुरू होने पर कहीं अमेरिका भारत पर किसी तरह के प्रतिबंध न लगा दे। एक और वजह यह जताना हो सकती है कि क्वाड जैसे समूह अपनी जगह हैं लेकिन ऐसे किसी गठजोड़ में अमेरिका की शीर्ष भूमिका को भूलना नहीं चाहिए। इन सवालों के जवाब सामने आने में अभी कुछ वक्त लगेगा।

लब्बोलुआब यह है कि अपने युद्घपोत को भारतीय ईईजेड से गुजारना अमेरिका का एक सुविचारित कदम था और उसने ऐसा करने के पहले तमाम पहलुओं पर विचार किया होगा। यह कोई अचानक घटी हुई घटना नहीं है। हमें इसका सावधानीपूर्वक विश्लेषण करना होगा। समुद्र में नौसैनिक बलों की गतिविधियां केवल असावधानी नहीं होतीं। उनके द्वारा दिए गए संदेश को समझना महत्त्वपूर्ण है।

मदद के हाथ

महामारी संकट में भारत के लिए दुनिया के कई देश आगे आए हैं।ऑक्सीजन सिलेंडर और टैंकरों से लेकर जरूरी दवाइयां, उपकरण और दूसरा सामान भारत पहुंचने लगा है। जो अमेरिका चार दिन पहले तक मदद देने को तैयार नहीं था, अब वही सबसे बड़ा मददगार बना है। इससे अमेरिका के लिए भारत की अहमियत का भी पता चलता है। अमेरिका की दोस्ती की परीक्षा तब हुई जब हाल में भारत की प्रमुख टीका निर्माता कंपनी सीरम इंस्टीट्यूट आॅफ इंडिया ने कोविड टीके के निर्माण के लिए उससे कच्चा माल मुहैया कराने की अपील की। इस पर बाइडेन प्रशासन ने जिस तरह की बेरुखी दिखाई, वह हैरान करने वाली थी। इससे जाहिर हो गया कि अमेरिका सिर्फ जुबानी सहानुभूति और छोटी-मोटी मदद के अलावा कुछ नहीं करने वाला। बाइडेन प्रशासन के इस रुख का अमेरिका के भारतीय समाज और राजनीतिकों के बीच अच्छा संदेश नहीं गया। भारत समर्थकों ने बाइडेन प्रशासन पर भारी दबाव बनाया। भारत के राष्ट्रीय सुरक्षा सलाहकार ने भी अपने अमेरिकी समकक्ष से बात की। इसके बाद अमेरिकी राष्ट्रपति ने भारत के प्रधानमंत्री से बात की और आखिरकार मदद का रास्ता निकला। अब अमेरिका भारत को ऑक्सीजन बनाने वाली मशीनें, जीवन रक्षक प्रणाली तो देगा ही, टीका बनाने के लिए जरूरी कच्चा माल भी देगा और अपने विशेषज्ञों का दल भी भारत भेजेगा।

गौरतलब है कि बदलते वैश्विक परिदृश्य में भारत और अमेरिका के रिश्ते नए आयाम ले रहे हैं। अमेरिका के लिए भारत एक बड़ा बाजार है। दोनों देशों के बीच रणनीतिक भागीदारी, सैन्य समझौते और हथियार खरीद समझौतों ने रिश्तों को नया अर्थ दिया है। चीन से निपटने के लिए अमेरिका ने चार देशों का जो क्वाड समूह बनाया है, भारत भी उसका सदस्य है। इतना सब होने के बाद भी अगर अमेरिका कोरोना से जूझ रहे भारत को बेचारगी में छोड़ देता तो क्या वह मित्र कहने का अधिकार रख पाता? इस मामले में दूसरे देश उससे बाजी मार जाते। ऐसे में उसकी कम बदनामी नहीं होती। भारत जिस तरह के मुश्किल हालात का सामना करना रहा है, उससे अमेरिका, ब्रिटेन जैसे देश पहले गुजर चुके हैं। हालात संभालने के लिए भारत को अभी ऑक्सीजन बनाने और उसकी आपूर्ति के लिए उपकरण, टैंकरों की भारी जरूरत है। थाईलैंड, सिंगापुर और संयुक्त अरब अमीरात जैसे देशों ने भारत को खाली टैंकर भेजे हैं। आयरलैंड जैसे छोटे से देश ने ऑक्सीजन कंसंट्रेटर दिए हैं। ब्रिटेन ने भी कुछ दवाइयां और उपकरण पहुंचाए हैं। ऑस्ट्रेलिया और कनाडा सहित यूरोपीय देशों ने भी मदद का भरोसा दिया है।

यह नहीं भूलना चाहिए कि कई देश अभी भी महामारी से जूझ रहे हैं। संसाधन सीमित होने की वजह से दूसरों की मदद की सीमाएं हैं। कुछ देश संकट से काफी हद तक उबर चुके हैं, जबकि भारत में हालात हद से ज्यादा गंभीर होते जा रहे हैं। जाहिर है, इस वक्त भारत को हर तरह की सहायता चाहिए। भारत में केंद्र और राज्य सरकारें पहली बार ऐसे हालात से रूबरू हो रही हैं। फिर हमारा स्वास्थ्य सेवाओं का ढांचा भी दयनीय ही है। ऐसे में जो देश जो भी मदद दे, वह मामूली नहीं है। मौजूदा हालात में दुनिया के सभी देश एक दूसरे की जो मदद कर रहे हैं, उसे कूटनीति से कहीं आगे जाकर देखने की जरूरत है। पिछले एक साल के कोरोनाकाल में भारत ने भी अमेरिका सहित कई देशों को मदद दी है। दवाइयों, पीपीई किट और टीकों से लेकर दूसरी चीजें पहुंचाई हैं। इस मुश्किल घड़ी में एक दूसरे की मदद न सिर्फ नैतिक दायित्व है, बल्कि यही वक्त की जरूरत है।

दागदार हुई छवि

देश के पांच राज्यों के विधानसभा चुनावों में मतदाताओं का आदेश ईवीएम में बंद हो जाने के बाद भी इस दौरान चुनाव आयोग की भूमिका पर उठे सवालों का पिटारा शायद ही बंद हो। दरअसल‚ ये सवाल इतने गम्भीर हैं कि जब भी आयोग की विफलताओं का जिक्र होगा‚ ये चर्चा में आएंगे। इस कारण और कि इनमें से ज्यादातर सवाल पश्चिम बंगाल व असम जैसे राज्यों से जुड़े हुए हैं‚ जहां केंद्र में सत्तारूढ़ भारतीय जनता पार्टी के सपनों व मंसूबों के साथ उसका बहुत कुछ दांव पर लगा है। अकारण नहीं कि मद्रास हाईकोर्ट ने कहा है कि कोरोना प्रोटोकाल चुनावी रैलियों की अनुमति देने के लिए उसके अधिकारियों पर हत्या की एफआईआर दर्ज की जानी चाहिए।

निस्संदेह‚ भाजपा ने चुनाव प्रचार के दौरान ये सपने व मंसूबे पूरे करने के लिए अपने प्रतिद्वंद्वियों को बौना करने का आक्रामक अभियान शुरू किया तो उसे इसका अधिकार था‚ लेकिन उसके नेता इस अधिकार के इस्तेमाल में एक के बाद एक सीमाएं तोड़ने लगे तो आयोग से निष्पक्षता की कसौटी पर खरे उतरने और हर प्रत्याशी को समान अवसर सुनिश्चित करने की अपेक्षा थी। दुःखद है कि उसने शुरू से आखिर तक इस अपेक्षा को धता बताये रखी। चुनाव कार्यकमों की घोषणा से पहले उसने केंद्रीय सत्ता की सुविधाओं व संभावनाओं का भरपूर ध्यान रखा। इंतजार किया कि प्रधानमंत्री नरेन्द्र मोदी राज्य में अपनी रैलियों की श्रृंखला सुभीते से पूरी कर लें।

हम जानते हैं कि तमिलनाडु तथा पश्चिम बंगाल में मतदाताओं की संख्या लगभग बराबर है‚ तमिलनाडु से लोक सभा के 39 सदस्य चुने जाते हैं तथा पश्चिम बंगाल से 42‚ लेकिन आयोग ने तमिलनाडु विधानसभा का चुनाव एक चरण में कराया और पश्चिम बंगाल विधानसभा का आठ चरणों में। कारणॽ तमिलनाडु में भाजपा के पास खोने के लिए कुछ खास नहीं है‚ जबकि पश्चिम बंगाल में वह सत्तारूढ़ तृणमूल कांग्रेस की मुख्य प्रतिद्वंद्वी है और वहां प्रधानमंत्री समेत उसके केंद्रीय नेताओं को गहन चुनाव प्रचार का मौका चाहिए था। इसी प्रकार केरल में लोक सभा की 20 सीटें हैं और असम में चौदह। केरल में विधानसभा की 140 सीटें हैं और असम में एक सौ छब्बीस लेकिन केरल विधानसभा का चुनाव एक चरण में और असम का तीन चरणों में कराया गया। कारण यहां भी वही कि केरल में भाजपा सत्ता की प्रतिद्वंद्वी नहीं है‚ जबकि असम में उसके समक्ष अपनी सत्ता बचाने की चुनौती है‚ लेकिन क्या कीजिएगा‚ नरेन्द्र मोदी के प्रधानमंत्री बनने के बाद के लोक सभा व विधानसभाओं के प्रायः सारे चुनावों में उसका रवैया ऐसा ही रहा है। यह भी महज संयोग नहीं कि कोरोना प्रोटाकाल तोड़कर की जा रही बड़ी–बड़ी रैलियों को रोकने की चौतरफा अपीलों का उसने तब तक संज्ञान नहीं लिया‚ जब तक प्रधानमंत्री नरेन्द्र मोदी ने खुद अपनी रैलियां रद्द करने का एलान नहीं कर दिया। हालांकि मद्रास उच्च न्यायालय के अनुसार यह इतना बड़ा अपराध है कि आयोग के अधिकारियों को हत्या के आरोप में बुक किया जाना चाहिए। इस अपराध के बाद 22 अप्रैल को जैसे ही प्रधानमंत्री ने अपनी रैलियां रद्द कीं‚ आयोग ने राज्य में पैदल मार्च व रोड शो पर रोक लगा दी और रैलियों में पांच सौ लोगों की भागीदारी की सीमा तय कर दी।

क्या अर्थ है इसकाॽ यही तो कि देश में संवैधानिक संस्थाओं के क्षरण के 2014 के बाद से खासे तेज हो गए सिलसिले को उसने अपनी ‘कर्तव्यपरायणता’ की मार्फत ऐसी जगह ला खड़ा किया है‚ जहां दिखाने के लिए भी अपना अम्पायर होना याद रखने की जरूरत नहीं समझता और बार–बार खिलाड़ी की भूमिका में उतर आता है। यहां याद किया जा सकता है कि मुख्य चुनाव आयुक्तों में सर्वाधिक चर्चित टीएन शेषन के कार्यकाल को छोड़ दें तो आयोग का प्रदेशों में सत्तारूढ़ दलों को परेशान और केंद्र में सत्तारूढ़ दलों को अभय किए रखने का इतिहास रहा है। उत्तर प्रदेश के 2012 के विधानसभा चुनाव में उसने तत्कालीन मायावती सरकार द्वारा निर्मित पार्कों व स्मारकों में लगी हाथियों की मुर्तिया इस तर्क पर ढकवा दी थीं कि हाथी बसपा का चुनाव निशान है। इसी तरह 2017 में उसने अखिलेश सरकार की एंबुलेंसों पर लिखा ‘समाजवादी’ शब्द भी हटवा दिया था। केंद्र में सत्तासीन किसी दल को उसने शायद ही कभी ऐसी परेशानियों में डाला हो। प्रसंगवश‚ संविधान सभा के कई सदस्यों को आयोग के गठन के वक्त ही इस सबकी आशंका थी‚ जिससे बचने के लिए पं.ह्रदयनारायण कंजरू ने ऐसे प्रावधानों पर जोर दिया था‚ जिनसे चुनाव व्यवस्था केवल प्रान्तीय राजनीतिक प्रभावों से ही नहीं वरन केंद्रीय राजनीतिक प्रभावों से भी स्वतंत्र रहे।

15 एवं 16 जून‚1949 को संविधान सभा में हुई इस संबंधी बहस में बाबा साहब डॉ. भीमराव आंबेडकर ने मान लिया था कि उनके उपबन्ध में कोई ऐसी व्यवस्था नहीं है‚ जिससे मुख्य चुनाव आयुक्त तथा अन्य चुनाव आयुक्तों के पदों पर किसी अनुपयुक्त व्यक्ति की नियुक्ति रोकी जा सके। इसका उन्हें बहुत सिरदर्द भी रहा था। दरअसल‚ संविधान के मसौदे के अनुच्छेद 289 में व्यवस्था थी कि संसद के दोनों सदनों के चुनाव के लिए एक आयोग हो‚ जिसकी नियुक्ति राष्ट्रपति द्वारा हो। डॉ. आंबेडकर का तर्क था कि प्रांतों में अलग और स्वतंत्र ढंग से काम करने वाले चुनाव आयोग होंगे तथा वे प्रांतीय सरकारों की अधीनता में काम करेंगे‚ तो प्रांतीय सरकारें अपनी स्थिति का दुरु पयोग कर उन्हें प्रभावित व इस्तेमाल कर सकती हैं। संविधान सभा में अनेक सदस्यों को इस संशोधन पर आपत्ति थी। उनका सवाल था कि प्रांतीय सरकारें प्रांतीय निर्वाचन आयोग के माध्यम से मनमानी कर सकती हैं तो क्या गारंटी है कि केंद्र सरकार केंद्रीय चुनाव आयोग के माध्यम से वैसा नहीं करेगीॽ

यह भी तो संभव है कि केंद्र में सत्तारूढ़ कोई दल अपने प्रति पक्की निष्ठा रखने वाले किसी व्यक्ति को मुख्य चुनाव आयुक्त नियुक्त कर दे। तब क्या होगाॽ बहुत गम्भीर आरोप लगने पर ही उसे दोनों सदनों के दो तिहाई बहुमत से पदच्युत किया जा सकेगा जो लगभग असंभव होगा। इस सिलसिले में एक सुझाव यह भी था कि संविधान में ऐसी व्यवस्था कर दी जाए कि राष्ट्रपति जिसको मुख्य चुनाव आयुक्त नियुक्त करें‚ उसे संसद के दोनों सदनों के संयुक्त सत्र में उपस्थित तथा मत देने वाले सदस्यों के दो तिहाई का समर्थन प्राप्त हो‚ लेकिन डॉ. आंबेडकर ने इस सुझाव को स्वीकार नहीं किया। इसका नतीजा हमारे सामने है। केंद्र सरकारें प्रायः अपने अनुकूल चुनाव आयुक्त नियुक्त कर उसका लाभ उठाने की स्थिति में रहती हैं।

आखिर मद्रास हाईकोर्ट ने चुनाव आयोग पर उंगली उठा ही दी। पहले भी इस देश ने कई चरणों वाले चुनाव कार्यक्रम देखे हैं। लेकिन कोरोना के बाद के हालात में चुनाव कार्यक्रम तैयार करते समय अतिरिक्त संवेदनशीलता और समझदारी की जरूरत थी, लेकिन आयोग ने ऐसा नहीं किया। कोरोना की एक लहर से देश संभल ही रहा था कि पांच राज्यों के चुनाव घोषित कर दिए गए। पश्चिम बंगाल में तो आठ चरणों के लंबे चुनाव कार्यक्रम की घोषणा की गई जबकि राज्य सरकार लगातार इस पर आपत्ति जता रही थी। विपक्ष भी लगातार सवाल उठा रहा था, लेकिन कोई सुनवाई नहीं हुई। चुनावी रैलियों को लेकर आम से दिशा-निर्देश जारी कर दिए गए, जबकि जरूरत बेहद कड़ी निगरानी और सख्त कार्रवाइयों की थी। इस असंवेदनशीलता पर तो कोर्ट की फटकार लगनी ही थी। जब पांचों राज्यों में बड़ी बड़ी चुनावी रैलियां और रोड शो होने लगे तो ऐसा लगा कि जैसे देश से कोरोना की विदाई हो चुकी है, जबकि कोरोना का बम फटने का इंतजार कर रहा था और दूसरी लहर के रूप मे ऐसा फटा कि पूरे देश में हाहाकार मच गया। अब मद्रास हाईकोर्ट ने आयोग को कोरोना की दूसरी लहर के लिए सीधे जिम्मेदार ठहराया है और चेतावनी दी है कि इस लापरवाही के लिए उसके अफसरों पर हत्या का केस चलाया जा सकता है क्योंकि आयोग ने राजनीतिक पार्टियों को रैलियां और सभाएं करने की इजाजत देकर महामारी को फैलने का मौका दिया है। कोर्ट ने मतगणना को लेकर स्पष्ट कार्यक्रम की मांग करते हुए दो मई को मतगणना रोकने की चेतावनी दी है। इसका असर यह हुआ कि आयोग ने मंगलवार को कड़ा कदम उठाते हुए दो मई को मतगणना के बाद विजय जुलूस निकालने पर रोक लगा दी है। इससे कोरोना के खतरे पर डर तो लगाम लगने की उम्मीद है। इस बीच पीड़ितों की मौतें लगातार जारी है और राहत के तमाम उपाय फीके पड़ते जा रहे हैं। दिल्‍ली सरकार ने अब एक माह में दिल्‍ली में 44 ऑक्सीजन प्लांट लगाने की घोषणा की है। इनमें से 36 प्लांट राज्य सरकार और आठ प्लांट केंद्र सरकार लगाएगी। मंगलवार को दिल्ली हाईकोर्ट ने केंद्र और राज्य के बीच खींचतान पर कड़ा कदम उठाते हुए एक ऑक्सीजन प्लांट के अधिग्रहण का आदेश दे दिया और कहा कि अब ऑक्सीजन के अभाव में एक भी मौत हई तो दोषी को “लटका’ देंगे।
