Bail must be the rule rather than the exception

The Law Commission has done well to recommend a complete overhaul in the way courts grant bail. Bail must be the rule rather than the exception, given that every person charged with a crime is presumed innocent until proven guilty. Reform in bail jurisprudence that includes fast disposal of bail applications, easier surety requirements and minimising pretrial detention is overdue.

Inconsistency in the bail system is one of the main reasons for crowding of prisons — it is appalling that 67 per cent of the prison population is awaiting trial in India. Rightly, the Supreme Court has frowned upon the mechanical attitude towards detention.Courts must deny bail only under three conditions. One, the person charged with the crime is likely to flee. Two, the accused is likely to tamper with evidence or influence witnesses. Three, the person is likely to repeat the same crime if granted bail. The need is to protect a citizen’s right against arbitrary detention in sync with international norms.

The Law Commission has proposed a strict approach towards economic offences, saying such offences hurt the economy, growth and global competitiveness of the country.This is correct. The Supreme Court had also said that the entire society is aggrieved if economic offenders are let off the hook. There are economic offences that merit only financial penalties but those that cause major harm to other people or to the state have to be treated with gravity. Cheating widows and orphans of their lives’ savings and pushing them into penury must be treated as serious crime, for example.

Ideally, the verdict on criminal and civil cases beyond final appeal should be delivered within two years. This calls for significant reform, quantitative and qualitative.India has just 13 judicial posts per million people, though the Law Commission had recommended 50 judges per million of the population, based on the ratio prevalent in the US in 1981. Surely, the need is to significantly increase the number of judges and courtrooms and deploy information technology-assisted, reformed procedure to deliver speedy justice.

लोकतांत्रिक समाज बनाने के लिए राष्ट्रपति का मंत्र

 राष्ट्रपति प्रणब मुखर्जी ने अपने एक व्याख्यान में उचित ही कहा है कि मीडिया को सत्ता के बारे में सवाल पूछने चाहिए और शोर मचाकर उन लोगों की आवाज नहीं दबानी चाहिए जो असहमत हैं। उनका यह कहना मीडिया का सिद्धांत होना चाहिए कि हम इसी प्रकार से राष्ट्र को बचा सकते हैं और एक लोकतांत्रिक समाज को कायम रख सकते हैं। मीडिया खासतौर पर इलेक्ट्रिॉनिक मीडिया उनके संकेत को समझे और दायित्व के निर्वाह में लोकतांत्रिक मान्यताओं का पालन करे।

यह अधिकार किसी भी राजनीतिक दल को है कि वह अपनी खास विचारधारा में यकीन करे और सरकार की नीतियों का उस आधार पर निर्माण करे। लेकिन, उसका यह भी कर्तव्य है कि वह विचारधारा लोकतांत्रिक मान्यताओं को खंडित करने वाली न हों और नीतियां संविधान सम्मत हों। राष्ट्र एक गतिशील अवधारणा है और वह हर युग में जरूरतों के लिहाज से बदलती है और उसमें प्रतीकों और आख्यानों के साथ उन नागरिकों के सम्मान और सुरक्षा की अहमियत होती है, जिनके लिए वे गढ़े जाते हैं। आज के मीडिया के साथ दिक्कत यह हुई है कि उसने सत्तारूढ़ पार्टी और मौजूदा सरकार की मान्यताओं और नीतियों को ही राष्ट्र और लोकतंत्र मान लिया है और उस पर सवाल करना और उससे असहमत होने वालों को डांटना-फटकारना शुरू कर दिया है।
सरकार से सवाल पूछने और उसे कटघरे में खड़ा करने की बजाय हमेशा विपक्ष को दोषी ठहराना और सरकार से असहमत संगठन और व्यक्ति पर टूट पड़ना मीडिया का स्वभाव बन रहा है, जो चिंताजनक है। अगर देश में कश्मीर से लेकर सुकमा तक हिंसा का वातावरण है तो मीडिया अपनी प्रस्तुतियों में उसे ठंडा करने की बजाय आग में घी डालने का काम करने लगता है। यह स्थिति तथ्यों को झुठलाने और उन्हें एक खास अवधारणा के लिहाज से पेश करने का माहौल बनाती है और उससे विविधता और बहुलता आहत होती है। सत्य की इसी एकतरफा व्याख्या के प्रति सचेत करते हुए गांधी ने अपने सत्याग्रह के सिद्धांत में कहा था कि हमें अपने सत्य को रखते हुए यह जरूर ख्याल रखना चाहिए कि वह गलत भी हो सकता है। भारतीय लोकतंत्र की नींव में सत्याग्रह का वही सिद्धांत है और मीडिया अगर सत्य के विविध रूपों में यकीन करके चलेगा तो वह एक लोकतांत्रिक समाज का निर्माण करेगा वरना हिंसा और तानाशाही को जन्म देगा।

भारत की ऊर्जा सुरक्षा के लिए सहयोग के बुनियादी सिद्धांत

भारत दूसरे देशों के साथ अपने ऊर्जा संबंधों को किस तरह से साधे कि उसके दीर्घावधि हितों के भी अनुकूल रहे? इसके लिए पांच सिद्धांत पथप्रदर्शक हो सकते हैं। बता रहे हैं अरुणाभ घोष 

दुनिया के सबसे बड़े ऊर्जा उपभोक्ता देशों में शामिल भारत ने ऊर्जा के क्षेत्र में अपनी अंतरराष्ट्रीय गतिविधियां बढ़ा दी हैं। विदेश में तेल और गैस परिसंपत्तियां हासिल करने, नाभिकीय रिएक्टरों के आयात को लेकर लगातार दूसरे देशों के संपर्क में बने रहने, ऊर्जा सक्षमता बढ़ाने के लिए लंबी चर्चाओं का हिस्सा बनने और नवीकरणीय ऊर्जा पर ध्यान देने को लेकर भारत लगातार रुचि दिखाता रहा है। भारत दूसरे देशों के साथ अपने ऊर्जा संबंधों को किस तरह से साधे कि उसके दीर्घावधि हितों के भी अनुकूल रहे? इसके लिए पांच सिद्धांत पथप्रदर्शक हो सकते हैं:
कीमत मायने रखती है : ऊर्जा की दुनिया बड़ी तेजी से बदल रही है और तमाम राष्ट्रीय एवं वैश्विक बाजारों को प्रभावित कर रही है। ऊर्जा क्षेत्र में किए गए अधिकांश निवेशों की उत्पादन-पूर्व अवधि काफी लंबी होती है। नाभिकीय रिएक्टरों जैसे कुछ मामलों में तो संयंत्र बनाने में लंबा वक्त लग जाता है। कोयला-आधारित परियोजनाएं पांच दशक तक चल सकती हैं। तेल एवं गैस आयात के लिए दिए गए लंबे समय के अनुबंध होने से कीमतों में स्थिरता आती है लेकिन कीमतों में अनुकूल बदलाव होने पर भी उपभोक्ताओं को उसका फायदा उठाने से रोकती है। अगर संबंधित पक्ष अनुबंध की शर्तों को लेकर बार-बार चर्चा और बदलाव की मांग उठाते रहते हैं तो फिर ऊर्जा सहयोग कामयाब नहीं हो सकता है। इसी तरह अगर नागरिकों को यह लगने लगता है कि सरकार ने बदलती तकनीक और कारोबारी मॉडल के चलते कीमतों में होने वाले बदलाव के दौर में भी उन्हें एक खास ढांचे में बांधकर रख दिया है तो भी लोगों के बीच उसे वैधता नहीं मिल पाएगी।
द्रवीकृत प्राकृतिक गैस (एलएनजी) और परमाणु ऊर्जा के आयात को लेकर भारत ऐसी ही दुविधा का सामना कर रहा है। मसलन, अमेरिका से मंगाई जाने वाली एलएनजी की लागत 8.5 डॉलर प्रति मिलियन बीटीयू पड़ती है। अगर पश्चिम एशिया या अफ्रीका से इसे मंगाया जाता है तो एलएनजी की लागत कम हो सकती है। गेल ने अमेरिका के दो टर्मिनलों से एलएनजी आयात करने के लिए करार किया है लेकिन घरेलू स्तर पर अभी तक इसका कोई खरीदार नहीं मिला है। करीब 16,000 मेगावाट क्षमता की गैस-आधारित परियोजनाएं मांग नहीं होने से लटकी हुई हैं। फूकुशिमा रिएक्टर हादसे के बाद से ही नाभिकीय ऊर्जा कारोबार में वैश्विक स्तर पर एक गतिरोध देखा जा रहा है। इसके चलते विदेश से आयातित परमाणु रिएक्टरों में पैदा बिजली घरेलू रिएक्टरों में उत्पादित बिजली से करीब दोगुनी महंगी हो सकती है। इस बीच सौर बिजली की दरें वर्ष 2010 के 10.95 रुपये प्रति इकाई से गिरकर इस महीने 2.44 रुपये प्रति इकाई पर लुढ़क चुकी हैं। गैस और परमाणु बिजली की कीमतें अगर कोयला या सौर बिजली के अनुपात में नहीं आती हैं तो उनके लिए लंबी अवधि के आपूर्ति करार और विदेशी निवेश जुटा पाना चुनौती का सबब होगा। हालांकि समग्र मांग बढऩे पर अधिक महंगी दर पर बिजली मंगाने की स्थिति पैदा सकती है।
ऊर्जा उपलब्धता बनेगी प्राथमिक चालक : ग्रामीण विद्युतीकरण के मोर्चे पर काम में आई तेजी के बावजूद लाखों घरों तक बिजली नहीं पहुंचाई जा सकी है। इसके अलावा अधिकांश ग्रामीण घरों में खाना पकाने के लिए उन्नत ईंधन विकल्पों का भी अभाव है। ऊर्जा उपलब्धता से इन घरों में ऊर्जा के इस्तेमाल की आदतों को बदला जा सकता है जिससे वे ऊर्जा के लिए स्थायी भुगतान करने वाले ग्राहक के रूप में तब्दील हो सकें। इसके अलावा ऊर्जा कारोबार से जुड़ी कंपनियों की वित्तीय सेहत और तकनीकी क्षमताओं का आपूर्ति की जाने वाली बिजली की गुणवत्ता पर भी असर पड़ता है। ऊर्जा उपलब्धता सुधारने के लिए द्विपक्षीय सहयोग बढ़ाने के वास्ते सहयोगी इकाइयां अहम सहारा बन सकती हैं।
भारत के औद्योगिक और शहरी विकास के लिए ऊर्जा सक्षमता अहम है: हमारी ऊर्जा मांग का रुझान अगड़ी अर्थव्यवस्थाओं के तालमेल में नजर आता है। जब इन देशों की प्रति व्यक्ति आय भारत के बराबर हुआ करती थी तब उनकी ऊर्जा मांग भारत के ही बराबर हुआ करती थी। (भारत में फिलहाल प्रति व्यक्ति 25 गीगा जूल बिजली की सालाना मांग बनी हुई है।) लेकिन भारत को ऊर्जा का अपव्यय किए बगैर विकसित देशों की आय के स्तर तक पहुंचने की जरूरत है।भारत का औद्योगिक क्षेत्र करीब एक चौथाई ग्रीनहाउस गैसों का उत्सर्जन करने के लिए जिम्मेदार है। ऊर्जा इस्तेमाल में सटीकता की दरकार है क्योंकि उत्सर्जन का स्तर काफी बढ़ चुका है। (सीईईडब्ल्यू के शोधकर्ताओं के मुताबिक ग्रीनहाउस गैस का उत्सर्जन 2 लाख इकाई तक जा पहुंचा है) फिलहाल तो केवल बड़ी इकाइयों के स्तर पर ऊर्जा सक्षमता की योजनाएं लागू की जा रही हैं जबकि अधिकांश छोटी इकाइयों को लेकर सुस्त रवैया अपनाया जा रहा है। इसके चलते निम्न ऊर्जा उत्पादकता और उच्च ऊर्जा लागत की स्थिति पैदा हो रही है। औद्योगिक प्रगति को स्थायी बनाए रखने के लिए छोटे एवं मझोले उपक्रमों को सहयोग दिया जाना जरूरी होगा। इसी तरह तेजी से शहरीकृत होती जा रही अर्थव्यवस्था के लिए वैकल्पिक परिवहन साधनों और ईंधन विकल्पों पर अंतरराष्ट्रीय मदद और भागीदारी लगातार अहम होती जाएगी। भारत में अगले दो दशकों में वातानुकूलन की जरूरत करीब पांच गुनी हो जाएगी जो कि चीन के शहरों से भी अधिक होगा। लिहाजा इस क्षेत्र में भी तकनीकी सहयोग, भवन निर्माण डिजाइन और ऊर्जा उपभोग की आदत के स्तर पर भी काफी कुछ करने की संभावना बनेगी।
भारत की शर्तों पर ऊर्जा सुरक्षा:  भारत के लिए ऊर्जा सुरक्षा जरूरी संसाधनों की उपलब्धता, पहले से अंदाजा लगाई जा सकने वाली कीमतों और न्यूनतम आपूर्ति व्यवधानों के साथ ही पर्यावरणीय पहलुओं का भी ख्याल रखने पर निर्भर करती है। परंपरागत तौर पर भारत ने द्विपक्षीय तरीके से ऊर्जा संसाधनों को सुरक्षित करने की कोशिश की है। इसके अलावा संयुक्त अरब अमीरात, कतर, ईरान, सऊदी अरब और मोजाम्बिक जैसे देशों के साथ ऊर्जा संबंधों को भी गहरा किया जा रहा है। इसके साथ ही आपूर्ति शृंखलाओं को सुरक्षित रखने के लिए समुद्री नौवहन सुरक्षा सहयोग को भी आश्वस्त करने की जरूरत है। चीन, जापान और दक्षिण कोरिया ने एलएनजी खरीद के अधिक अनुकूल और लचीले सौदों के लिए मिलकर बातचीत करने के वास्ते मार्च में एक गठजोड़ किया है। भारत को भी एलएनजी की बढ़ती मांग को देखते हुए आपूर्ति सुरक्षा सुनिश्चित करने के लिए इस तरह के गठबंधन के बारे में विचार करना चाहिए।
अर्थव्यवस्था को चलाने वाले दो ईंधन:  ऊर्जा और वित्त किसी भी अर्थव्यवस्था में ईंधन का काम करते हैं। वित्त के अभाव में ऊर्जा आर्थिक प्रगति को रफ्तार नहीं दे सकती है। नवीकरणीय ऊर्जा और ऊर्जा सक्षमता को बड़े पैमाने पर पूंजी निवेश की जरूरत होती है। इस तरह की ढांचागत आवश्यकताओं की पूर्ति के लिए बड़े पैमाने पर बिना जोखिम वाली संस्थागत पूंजी की दरकार होती है। इसके अलावा ऊर्जा से संबंधित शोध एवं विकास कार्यों में भी लगातार निवेश की जरूरत होती है। भारत में ऊर्जा क्षेत्र का रूपांतरण अंतरराष्ट्रीय सहयोग के बगैर मुमकिन नहीं हो पाएगा। दरअसल भारत को पूंजी की आसान उपलब्धता के साथ ही नई तकनीक के स्तर पर भी अंतरराष्ट्रीय सहयोग की जरूरत होगी। भारत ने दूसरे देशों के साथ मिलकर ऊर्जा के क्षेत्र में शोध एवं विकास कार्य शुरू किए हैं और छोटे स्तर के द्विपक्षीय क्रेडिट भी मिलने लगे हैं। ऊर्जा के भंडारण की तकनीकें, विभिन्न वित्तीय जोखिमों को कम करने और बॉन्ड बाजार को सशक्त करने जैसे असली गेम चेंजर तो अभी तक नदारद ही हैं। इस दिशा में अवसर मौजूद हैं जिन्हें आजमाने की जरूरत है।

सुधारों के सिलसिले ने बदली तस्वीर

भारत की व्यापक और जटिल प्रशासनिक व्यवस्था में सुधार को लेकर आजादी के बाद साठ के दशक से ही चर्चा होती रही है। हाल के समय में देश में दो प्रशासनिक सुधार आयोग 1996 और 2005 में गठित किए गए। दोनों आयोगों ने अपनी रिपोर्ट पेश कीं, लेकिन उनकी कई सिफारिशों पर अभी तक अमल नहीं हो सका है, किंतु पिछले तीन वर्षों में ऐसी कई नई पहल की गई हैं जिनसे पता चलता है कि सरकार प्रशासन में सुधार की गति को तेज करना चाहती है और प्रशासनिक व्यवस्था को अधिक कुशल, निर्णायक एवं समावेशी बनाना चाहती है। इनमें योजनाओं की परिणाम आधारित निगरानी, उच्चतम स्तर पर परियोजनाओं में तेजी लाना, राज्यों में प्रतिस्पर्धा की भावना पैदा करना, मंत्रालयों के एकांगी रूप से काम करने की प्रवृत्ति को तोड़ना और सरकार में प्रतिभाओं का समावेश करना शामिल है। पिछले तीन सालों में पहला महत्वपूर्ण सुधार यह हुआ है कि प्रशासनिक ध्यान इनपुट और आउटपुट से हटकर परिणाम पर केंद्रित हो गया है और उसकी समीक्षा और निगरानी स्वयं प्रधानमंत्री द्वारा की जा रही है। आम आदमी को प्रक्रिया, कार्यप्रणाली, समितियों के गठन आदि से कोई लेना-देना नहीं होता, उसे तो बस परिणाम चाहिए। स्वाभाविक तौर से नागरिक केंद्रित और सहभागितापूर्ण शासन व्यवस्था सृजित करने के लिए पहला कदम यही हो सकता है कि व्यवस्था को परिणामोन्मुख बनाया जाए। जहां सड़क परियोजनाओं का आकलन क्षमता, गतिशीलता, गुणवत्ता और सुरक्षा के पैमाने से किया जा रहा है वहीं रेलवे के मामले में परिचालन अनुपात, यात्री और माल ढुलाई से होने वाली प्राप्ति, पूंजीगत व्यय, रेलवे स्टेशनों का पुनर्विकास और सुरक्षा उपायों को मुख्य पैमाना माना गया है। सुधारों के तहत ही पहली बार नीति आयोग द्वारा तैयार किया गया परिणाम आधारित बजट मुख्य बजट के साथ संसद में प्रस्तुत किया गया।
परिणाम आधारित समीक्षाएं कई क्षेत्रों में की जा रही हैं। कुल बजट परिव्यय में 72 प्रतिशत की हिस्सेदारी रखने वाले 15 बुनियादी ढांचा और सामाजिक क्षेत्रों की परियोजनाओं की समीक्षा की गई है। समीक्षा के बाद कई निर्णय भी लिए गए। जैसे वित्त वर्ष 2017 में रेलवे के शेयर को 33 प्रतिशत से बढ़ाकर 35 प्रतिशत करने का निर्णय लिया गया ताकि 2032 तक इसे 50 प्रतिशत करने का लक्ष्य प्राप्त किया जा सके। सांस्थानिक सुधार के तहत भारतीय चिकित्सा परिषद की भी समीक्षा की गई है। समिति ने काफी बदलावों की सिफारिश करते हुए एमसीआइ की जगह राष्ट्रीय चिकित्सा आयोग बनाने का प्रस्ताव किया है ताकि इंस्पेक्टर राज की पुरानी व्यवस्था समाप्त हो और चिकित्सा शिक्षा में बड़े सुधार किए जा सकें।
दूसरी महत्वपूर्ण पहल है ‘प्रगति’ यानी सक्रिय शासन और समयबद्ध कार्यान्वयन। यह एक ऐसी पहल है जिसके तहत बुनियादी ढांचा और सामाजिक क्षेत्र की ऐसी महत्वपूर्ण परियोजनाओं पर प्रधानमंत्री के स्तर पर चर्चा और समीक्षा की जा रही है जिनके अमल में दिक्कतें आ रही हैं अथवा जिनके पूरा होने में देरी हो रही है। ‘प्रगति’ की कई महत्वपूर्ण विशेषताएं हैं, जैसे यह चुनिंदा परियोजनाओं के सभी पक्षों को अपने विचार रखने और मुद्दों के समाधान के लिए मंच उपलब्ध कराता है, अधिकारियों को स्पष्ट और निश्चित समय-सीमा के भीतर पूरा किए जाने के लिए जिम्मेदारियां सौंपता है, केंद्र और राज्यों को एक ही मंच पर लाकर विकास परियोजनाओं में तेजी लाता है।
इससे मुख्य परियोजनाओं पर देश के सर्वोच्च अधिकारियों की निगरानी बनी रहती है। यह विभिन्न सरकारी एजेंसियों के बीच के गतिरोध को भी खत्म करता है। इसके जरिये सर्वोत्तम कार्यशैलियों को साझा करना भी संभव हो पाता है। अब तक 18 ‘प्रगति’ बैठकें हो चुकी हैं और 8.31 लाख करोड़ रुपये से अधिक की राज्य परियोजनाओं की गति को तेज किया गया है। रेलवे, राष्ट्रीय राजमार्ग, बिजली, कोयला, नागर विमानन से जुड़ी ये परियोजनाएं पिछले कई वर्षों से देरी से चल रही थीं। इस पहल से विभिन्न राज्यों की परियोजनाओं की गति में तेजी आई है। परियोजनाओं के अलावा, 16 मंत्रालयों/विभागों के 38 अग्रणी कार्यक्रमों, योजनाओं और शिकायतों की भी समीक्षा की गई है। उदाहरण के लिए नांगल बांधतलवाड़ा रेलवे लाइन 1981 से ही लंबित थी, लेकिन अब इसमें तेजी लाई गई है। ‘प्रगति’ के लागू होने के बाद से अफगानिस्तान में सलमा बांध, पटना में गंगा पर रेल-सह-सड़क सेतु, भारतीय विशिष्ट पहचान प्राधिकरण और भारतीय महापंजीयक के आधार नामांकन में काफी तेजी आई है। ‘प्रगति’ कई अर्थों में एक अनूठी व्यवस्था साबित हुई है। इसने केंद्र और राज्य के बीच दीवारों को तोड़ा है, परिणाम और लक्ष्य की ओर ध्यान केंद्रित किया है और कार्यान्वयन की निगरानी करने के लिए एक पारदर्शी मंच उपलब्ध कराया है।
तीसरा प्रमुख प्रशासनिक सुधार रैंकिंग के जरिये राज्यों और जिलों के बीच प्रतिस्पर्धा की भावना जगाने का है। व्यवसाय करने की सुगमता की दृष्टि से राज्यों की रैंकिंग के फलस्वरूप राज्य सरकारों ने मूलभूत सुधार करने शुरू कर दिए हैं। प्रतिस्पद्र्धा के दबाव ने तेलंगाना, झारखंड और छत्तीसगढ़ जैसे नए राज्यों को तेजी से आगे बढ़ने के लिए प्रेरित किया है। स्वच्छ भारत पहल के तहत स्वच्छता की दृष्टि से जिलों की रैंकिंग का भी बड़ा प्रभाव पड़ा है। इसने नगर निकायों के स्तर पर बदलाव को प्रोत्साहित किया है।
चौथा मुख्य सुधार सचिवों के समूहों का गठन करना रहा है। पिछले वर्ष विभिन्न विषयों पर आठ ‘सचिव समूहों’ का गठन किया गया था। इन समूहों को संयुक्त सचिवों के इसी प्रकार के समूहों द्वारा सहायता प्रदान की गई। इन समूहों का एक अनूठा पहलू यह था कि इनमें ऐसे वरिष्ठ अधिकारियों को शामिल किया गया जिनके विभाग इन विषयों से सीधे संबंधित नहीं थे। इसने रचनात्मक विचारों को प्रोत्साहित किया। इस वर्ष इन समूहों को अपनी सिफारिशों को कार्यान्वित कराने का दायित्व सौंपा गया है।
जब तक मनोवृत्तियां नहीं बदलतीं तब तक सुधार संभव नहीं होता। नए चिंतन और नवोन्मेषी विचारों को लाने के लिए अनेक पहल की रूपरेखा तैयार की गई है। संसाधनों के आवंटन पर ध्यान केंद्रित करने वाले योजना आयोग को समाप्त करने, 1175 पुराने कानूनों को समाप्त करने, रेल और संघीय बजट को मिलाने जैसे सभी कदम भारत को व्यवसाय करने की दृष्टि से सरल और सुगम स्थान बनाने और शासन की गुणवत्ता को बढ़ाने के लिए उठाए गए हैं।
वार्षिक बजट में योजना और गैर-योजना व्यय के बीच भेद को समाप्त करने जैसे उपायों से राजस्व घाटे को कम करने की बजाय पूंजीगत व्यय को बढ़ाने पर ध्यान केंद्रित करने में मदद मिलेगी और इसके परिणामस्वरूप राजकोषीय घाटे को कम करने की प्रक्रिया में तेजी आएगी। सुधारों के तहत ही निजी क्षेत्र के प्रतिभाशाली युवाओं को सरकार के माध्यम से सार्थक बदलाव लाने का मौका देने की भी शुरुआत की गई है। ऐसे अनेक युवाओं ने डीजिधन मेलों में अपना योगदान दिया था। हालांकि इन सभी सुधारों का प्रभाव स्पष्ट रूप से दिखाई देने में समय लग सकता है, लेकिन उनकी दिशा सही और गति तेज है। प्रशासनिक सुधारों की इस सतत प्रक्रिया का ही यह परिणाम है कि पिछले तीन वर्षों में बिना किसी आडंबर के काफी कुछ हासिल किया गया है। स्पष्ट है कि इस प्रक्रिया को जारी रखना होगा।

Beyond triple talaq

Central issue is not finality and manner of divorce, but inability of law, society to support women after it

Triple talaq unilaterally pronounced in one sitting by the husband giving finality to the divorce is an emotive issue. This practice is not referred to in the Quran. Even Hadith, which legitimises this practice, says that it is sinful. It is referred to as valid in law, bad in theology. Now that the hearing in the Supreme Court is over and the judgment reserved, it would be inappropriate for me to comment on the merits of the issue.

What is of concern, however, is that there is no data available suggesting the frequency of triple talaqs pronounced in one sitting. IndiaSpend.org, quoting Census 2011 data, states that “among divorced Indian women, 68 per cent are Hindus whereas 23.3 per cent are Muslims”. Of the 23.3 per cent, we have no data to find out the percentage of Muslim women divorced because of the pronouncement of triple talaq in one sitting.The census also puts the divorce rate among Muslims at 0.56 per cent as opposed to 0.76 per cent amongst Hindus. Neither the government nor the Law Commission has conducted any survey on the extent of triple talaq among Indian Muslims pronounced in one sitting.

A recent survey conducted by the secretary of the Sachar Committee found that of all the divorces amongst the Muslim community, the ones attributed to triple talaq pronounced at one sitting represented only 0.44 per cent. The survey concludes that the incidence of triple talaq is trivial with only one out of a total of 331 instances of reports of talaq both by men and women. It is, therefore, clear that the constitutional issue was being addressed without the necessary data.For centuries, women have not been equal partners in a marriage. Even today in India, barring a very small percentage of empowered women, they are neither part of the mainstream of national life, nor are their genuine concerns addressed. At the heart of it is the iniquitous nature of a patriarchal society. The fact that 50 per cent of mankind owns less than 2 per cent of its assets demonstrates the stark reality.If two people cannot live together, both should have the right to opt out of the marriage. In an ideal world, that would be an acceptable solution. In India, by and large, women are not educated enough to be bread winners, and within the moorings of traditional cultures, do not have the courage and the capacity to leave the matrimonial home. Given the inequality prevalent in family structures, the woman’s right to opt out is suicidal.

For the husband, that option is less daunting. This does not mean that men, in most cases, opt out of the marriage without reason. Barring some exceptions, it is only when incompatibility cannot be resolved that men opt out. Given the patriarchal environment, they are better placed to do so, being the dominant partner.

The central issue, therefore, is not the finality and the manner in which women are divorced, but the inability of both law and society to protect women after divorce. Court proceedings are dilatory, delaying quick resolution. Unless the issue of the empowerment of women is addressed, the practice of women being unfairly treated will remain unresolved.Neither the government nor the Law Commission has conducted any survey on the extent of triple talaq among Indian Muslims pronounced in one sitting.

We have statutes in place which give women the right to seek or deny divorce. Absent divorce by consent, the wife has neither the wherewithal nor the capacity to defend herself in prolonged court proceedings. There is no light at the end of the tunnel. Most often women just abandon legal options and live a life of misery thereafter. Most of the time, they suffer ignominy throughout their life, not having the courage and financial capacity to seek divorce.

What the government and we in society need to do is to address the issue of gender justice. A legal proceeding in the Supreme Court may pay political dividends outside court but it does not address the real issue. The government should conduct a study about the effectiveness of divorce proceedings in family courts and bring about changes, both through legislation and other measures, to provide a support system for women in such a predicament.

A fund at the level of state governments to enable destitute and disempowered women to support them in legal proceedings may help. In many situations, the husband may not also have the wherewithal to support women adequately during the course of litigation because of other family responsibilities. The domestic financial pie is often too small to distribute equitably. There are provisions in the law under the Protection of Women from Domestic Violence Act, 2005, which entitle the wife to share the household where the couple resided. But that does not deal with all possible situations. Not everyone has a house big enough for sharing or a house capable of partition, given the levels of poverty in our country.Systems of law may differ. Methods of divorce may differ. The procedure of resolution of disputes pending litigation may also differ. Whether a particular procedure which prolongs the agony of the couple for years without resolution is better than a quick divorce after which issues relating to the security and the future of women are addressed is debatable.

Furore and uninformed debates in the media only help to obfuscate the issue. An attempt by the political dispensation to empathise with women when their record in treating women is suspect will not serve their cause. Constitutional morality can only serve the cause of women if constitutional values in Part III of the Constitution are respected. The record of all governments in this regard is abysmal.Mouthing platitudes in court is not enough. This battle is not to be fought in the court room alone. The real challenge is to fight this battle outside. What needs to be changed is the patriarchal mindset and social prejudice. What is needed is a government that does not shed crocodile tears.

Bail or jail: on bail law reforms

The Law Commission’s report on bail law reforms deserves urgent attention

That bail is the norm and jail the exception is a principle that is limited in its application to the affluent, the powerful and the influential. The Law Commission, in its 268th Report, highlights this problem once again by remarking that it has become the norm for the rich and powerful to get bail with ease, while others languish in prison. While making recommendations to make it easier for all those awaiting trial to obtain bail, the Commission, headed by former Supreme Court judge B.S. Chauhan, grimly observes that “the existing system of bail in India is inadequate and inefficient to accomplish its purpose.” One of the first duties of those administering criminal justice must be that bail practices are “fair and evidence-based”. “Decisions about custody or release should not be influenced to the detriment of the person accused of an offence by factors such as gender, race, ethnicity, financial conditions or social status,” the report says. The main reason that 67% of the current prison population is made up of undertrials is the great inconsistency in the grant of bail. Even when given bail, most are unable to meet the onerous financial conditions to avail it. The Supreme Court had noticed this in the past, and bemoaned the fact that poverty appears to be the main reason for the incarceration of many prisoners, as they are unable to afford bail bonds or provide sureties. The Commission’s report recommending a set of significant changes to the law on bail deserves urgent attention.

 The Commission seeks to improve on a provision introduced in 2005 to grant relief to thousands of prisoners languishing without trial and to decongest India’s overcrowded prisons. Section 436A of the Code of Criminal Procedure stipulates that a prisoner shall be released on bail on personal bond if he or she has undergone detention of half the maximum period of imprisonment specified for that offence. The Law Commission recommends that those detained for an offence that would attract up to seven years’ imprisonment be released on completing one-third of that period, and those charged with offences attracting a longer jail term, after they complete half of that period. For those who had spent the whole period as undertrials, the period undergone may be considered for remission. In general terms, the Commission cautions the police against needless arrests and magistrates against mechanical remand orders. It gives an illustrative list of conditions that could be imposed in lieu of sureties or financial bonds. It advocates the need to impose the “least restrictive conditions”. However, as the report warns, bail law reform is not the panacea for all problems of the criminal justice system. Be it overcrowded prisons or unjust incarceration of the poor, the solution lies in expediting the trial process. For, in our justice system, delay remains the primary source of injustice.
