Justice Chandrachud takes a compelling look at the heart of our dialogue-based democracy

As the chief guest of the 10th convocation of the Gujarat National Law University on Saturday, Justice DY Chandrachud of the Supreme Court had notable advice for the students: “It is important to stand up and be dissenters. It is only through your power of expressing views and courage of stating contrary positions that you will make others stop and think.” Coming at a time when student protests, such as those against CAA-NRC, have been labelled anti-national, Justice Chandrachud’s comments on Saturday both at the above event and at the Gujarat HC auditorium were a timely, lucid and powerful reminder of how the right to dissent is at the very heart of a dialogue-based democratic society.

Over the weekend disturbing video footage has also come to light, where police can be seen entering Jamia Millia Islamia’s library and lathicharging students who were just studying there. This is blatant abuse of state machinery to instil fear. And as Justice Chandrachud says, creating a chilling atmosphere for free speech really distracts from the constitutional vision of a free and pluralist society. Political detentions under PSA in Kashmir, sweeping use of Section 144 across Uttar Pradesh, repeated internet shutdowns in several parts of the country, broad spectrum use of the colonial sedition law … all these draconian attempts to quell peaceful protests are fundamentally at odds with the fact that “homogeneity is not the defining feature of Indianness.”

Plurality of opinion is furthermore the basis of all growth – political, economic, cultural and social. Only asking questions and challenging the status quo lead to change and progress. So respect for diversity and freedom of expression is not only the essence of Indian democracy, it is also the guarantor of a better future.

A better democracy by fiat? No chance

he Supreme Court has directed all political parties to justify, on their websites, social media and a national newspaper and a regional newspaper, their choice of candidates with criminal cases against them, explaining the reasons for selecting such candidates over non-tainted ones. Since 43% of all members of Parliament in the present House have criminal cases against them, this should take up quite a bit of advertising space. This is good for the media and does little to enrich democracy.

Does the Supreme Court think voters know nothing about the candidates vying for their support, that strongmen leaders keep their record a secret that only a Supreme Court order mandating transparency can unveil? Indian society is complex and the distribution of power across it is not just unequal but also tiered.

Often a person becomes a leader of a subaltern community by violently taking on the entrenched social order and giving that community a voice that had long been suppressed. A rival strongman could be fielded against him because he represents the muscle-power needed to resist this challenge to established social order. Politics cannot abstract away from such social forces, but rather tries to shape them to its advantage.

Some criminal charges are the result of political vendetta or sloppy use of the legal system to suppress Opposition. Is it the Supreme Court’s case that all those in Uttar Pradesh who face assorted criminal charges in the wake of the agitation against the Citizenship (Amendment) Act are actually potential threats to social peace and harmony? In some cases, voters might elect a strongman out of fear: he might feed them to pet crocodiles if they defied his will. In such cases, the court should demand swift completion of prosecution and appeals, so that the culprits can be convicted and rendered ineligible to contest.

Ultimate sovereignty lies, in a democracy, with the people. If the people wish to elect leaders who would harm society at large, can institutions of the State stop them? The challenge is to steadily improve democratic discourse.

सुधार की लंबी राह

सर्वोच्च न्यायालय ने दूरसंचार कंपनियों की उन याचिकाओं को खारिज कर दिया है जिनके माध्यम से कंपनियों ने समायोजित सकल राजस्व (एजीआर) से संबद्ध बकाये के भुगतान के लिए और अधिक समय चाहा था। यह इस बात का एक और उदाहरण है कि न्यायपालिका हकीकत के बजाय रीति को लेकर किस कदर आसक्त है। यह दूसरा मौका है जब दूरसंचार उद्योग ऐसी असाधारण आसक्ति का शिकार हुआ है। आठ वर्ष पहले फरवरी 2012 में शीर्ष न्यायालय ने 122 एकीकृत पहुंच सेवा लाइसेंस रद्द कर दिए थे। लाइसेंस रद्द करने का विचार इस अनुमान पर आधारित था कि लाइसेंसियों को 2जी स्पेक्ट्रम आवंटन गलत तरीके से किया गया था। करीब छह वर्ष पश्चात एक विशेष अदालत ने कहा कि ऐसा कोई प्रमाण नहीं मिला जिससे लगे कि 2008 का 2जी स्पेक्ट्रम आवंटन घोटाला था। यदि वर्ष 2012 में जीवंत दूरसंचार क्षेत्र को उसके चरम आकार के एक हिस्से के रूप में समेट दिया गया था तो ताजा अदालती निर्णय द्वयाधिकार का परिदृश्य स्थापित कर सकता है।

यह स्थिति न केवल उद्योग जगत बल्कि उपभोक्ताओं के लिए भी चिंताजनक है। यदि आठ वर्ष पहले विदेशी दूरसंचार कंपनियों मसलन टेलीनॉर, सिस्तेमा और एतिसलात आदि को विपरीत अदालती निर्णय के कारण बाजार से बाहर होना पड़ा था तो आज वोडाफोन के सामने वही परिस्थितियां हैं। आदित्य बिड़ला समूह की कंपनी आइडिया के साथ संयुक्त उपक्रम चला रही ब्रिटेन की यह दूरसंचार कंपनी जहां बकाये का आकलन कर रही है, वहीं उसने यह स्पष्ट कर दिया है कि यदि 50,000 करोड़ रुपये से अधिक के अनुमानित एजीआर बकाये पर सर्वोच्च न्यायालय से राहत नहीं मिलती है तो कंपनी का संचालन जारी रखना मुश्किल होगा। एक अन्य दूरसंचार कंपनी भारती एयरटेल पर करीब 35,000 करोड़ रुपये का एजीआर बकाया है। वह शायद यह राशि चुका ले लेकिन उसका भविष्य का निवेश, खासकर 5जी नीलामी प्रभावित हो सकती है। एजीआर का मुद्दा सन 1999 का है जब दूरसंचार सेवा प्रदाता कंपनियां तयशुदा लाइसेंस की व्यवस्था से राजस्व साझेदारी के मॉडल पर स्थानांतरित हो रही थीं जो अब संकटपूर्ण स्थिति में पहुंच चुका है।

सन 2003 से ही विभिन्न अदालतों और पंचाटों में चले आ रहे एजीआर के कानूनी विवाद को अंतिम तौर पर निपटाने की आवश्यकता है। वह भी इस तरह कि दूरसंचार क्षेत्र और उपभोक्ताओं पर सकारात्मक असर हो। उसके लिए दूरसंचार विभाग को निर्णायक तरीके से काम करना होगा। उसे नियंत्रक एवं महालेखा परीक्षक की विपरीत रिपोर्ट या जांच एजेंसियों के डर से खुद को इस संकट से दूर नहीं करना चाहिए। शीर्ष राजनीतिक नेतृत्व को भी विभाग का समर्थन करना चाहिए ताकि वित्तीय संकट से गुजर रहा दूरसंचार क्षेत्र वापस पटरी पर आ सके। सहयोग एकदम स्पष्ट होना चाहिए ताकि सरकार को शुक्रवार की तरह पुन: शर्मिंदगी का सामना न करना पड़े।

ऐसा नहीं होना चाहिए कि विभाग के एक अधिकारी को अपना बचाव करना पड़े जबकि मंत्री कहें कि उन्हें या शीर्ष अफसरशाहों को विभाग के उस परिपत्र के बारे में कोई जानकारी नहीं थी जिसके तहत कंपनियों से कहा गया कि बकाया चुकाने की सर्वोच्च न्यायालय की समय सीमा का पालन नहीं करने पर उनके खिलाफ कदम उठाए जाएंगे। सरकार ने काफी कीमती समय गंवा दिया है लेकिन वह अभी भी दखल देकर ऐसा रास्ता निकाल सकती है जो 1.47 लाख करोड़ रुपये के एजीआर बकाये को चुकाने के लिए जूझ रहे दूरसंचार क्षेत्र को बचा सके। यह बात देश की वैश्विक प्रतिष्ठा पर अलग असर डालेगी। इसके अतिरिक्त उसे सार्वजनिक क्षेत्र की उन कंपनियों का भी साथ देना होगा जिनके पास दूरसंचार लाइसेंस है लेकिन जो तीसरे पक्ष को सेवाएं नहीं देतीं। ऐसा होने पर कोई अदालत अतार्किक भुगतान की मांग नहीं करेगी और कंपनियां दिवालिया होने के कगार पर नहीं पहुंचेंगी।

‘खिलाफत’ में अटके एर्दोगन

कश्मीर मुद्दे पर अलग–थलग पड़े़ पाकिस्तान को तुर्की के रूप में एक ढाढ़स बंधाने वाला मित्र देश मिल गया है। तुर्की के राष्ट्रपति रेसेप तैयप एर्दोगन ने अपनी पाकिस्तान यात्रा के दौरान वह सभी बातें कही जो इमरान खान और पाकिस्तानी अवाम को खुश करने वाली थीं। उन्होंने पाकिस्तान की संसद में जो संबोधन दिया‚ वह केवल कश्मीर मामले में पाकिस्तान को समर्थन देने तक ही सीमित नहीं था। उन्होंने पैन–इस्लामाबाद की विचारधारा और आंदोलन का भी जिक्र किया‚ जिसके आधार पर भारत का विभाजन हुआ था। पाकिस्तान का जन्म हआ था। उनका संबोधन तुर्की और यूरोपीय देशों के बीच प्रथम विश्व युद्ध में हुए संघर्ष के साथ ही भारत में मुस्लिम आक्रमण और आधिपत्य से भी जुड़़ा था। एर्दोगन की यह सोच भारत के लिए विशेष चिंता का विषय है। ॥ तुर्की के राष्ट्रपति ने जम्मू–कश्मीर से अनुच्छेद ३७० हटाने के फैसले को भारत की ओर से उठाया गया एकतरफा कदम बताया। कश्मीर में कथित मानवाधिकार के उल्लंघन की दुहाई देते हुए वहां के बहनों और भाइयों के प्रति हमदर्दी भी जताई। आश्चर्यजनक रूप से उन्होंने कश्मीर की तुलना प्रथम विश्व युद्ध के दौरान गैलीपोली में हुए सैन्य संघर्ष से की। विश्व युद्ध के प्रारंभिक दौर में गैलीपोली में यूरोपीय देशों की मित्र सेनाओं को तुर्की के ऑटोमन साम्राज्य की सेनाओं ने शिकस्त दी थी। इस युद्ध में तुर्की के समर्थन में भारतीय उपमहाद्वीप में खिलाफत आंदोलन चला था‚ जिसके साथ कांग्रेस पार्टी भी जुड़़ गई थी। एर्दोगन ने इसकी चर्चा करते हुए भारतीय उपमहाद्वीप के लोगों द्वारा तुर्की को दिए गए समर्थन के प्रति आभार व्यक्त किया। प्रकारांतर से उन्होंने पाकिस्तान को भरोसा दिलाया कि भारतीय उपमहाद्वीप के लोगों ने जिस तरह खिलाफत आंदोलन के जरिए तुर्की को समर्थन दिया था‚ वैसा ही समर्थन तुर्की भी कश्मीर मुद्दे पर पाकिस्तान को देगा। एर्दोगन और इमरान के संयुक्त वक्तव्य में भी कश्मीर मुद्दे को उछाला गया। ॥ भारत ने एर्दोगन के संबोधन और संयुक्त वक्तव्य में कश्मीर के उल्लेख पर तुर्की को आगाह किया है कि वह भारत के आंतरिक मामले में हस्तक्षेप करने से बाज आए। प्रवक्ता ने एर्दोगन को सलाह दी कि वह कश्मीर की हकीकत जान लें। ॥ एर्दोगन ने अपने संबोधन में मध्यकालीन इतिहास का भी उल्लेख किया। उन्होंने मशहूर गजनवी और बाबर द्वारा भारत पर आधिपत्य हासिल करने को भी एक उपलब्धि के रूप में प्रचारित किया। उनके अनुसार तुर्की की पृष्ठभूमि वाले इन बादशाहों की जीत और शासन भारतीय उपमहाद्वीप के साथतुर्की के ऐतिहासिक संबंधों की निशानदेही कराता है। कह सकते हैं कि एर्दोगन का संबोधन ऑटोमन साम्राज्य की स्मृतियों को ताजा करता है‚ और साथ ही उनकी इस महत्वकांक्षा को भी प्रकट करता है कि वह इस्लामी देशों के नेता के रूप में उभरें। वह सऊदी अरब के स्थान पर तुर्की के इस्लामी देशों के नेता के रूप में उभरने का सपना देख रहे हैं। अपनी इस कवायद में वह पाकिस्तान को अपना सहयोगी देश मानते हैं। पाकिस्तान एक परमाणु शक्ति है‚ और सैन्य दृष्टि से भी ताकतवर है। तुर्की ने आतंकवाद को धन मुहैया कराने से रोकने वाली एफएटीएफ में पाकिस्तान को समर्थन देने का आश्वासन दिया‚ जिसकी बैठक शीघ्र ही पेरिस में होने वाली है‚ जिसमें पाकिस्तान पर फैसला होना है। पाक एफटीएएफ की चेतावनी सूची में है‚ और उसके काली सूची में ड़ाले जाने की तलवार लटकी हुई है। ॥ कश्मीर मुद्दे पर पाकिस्तान को केवल तुर्की और मलयेशिया से ही समर्थन मिल रहा है। ये तीनों देश इस्लामी आतंकवाद के खतरे को नजरअंदाज कर रहे हैं तथा अन्य देशों पर अंध–इस्लाम विरोध फैलाने का आरोप लगा रहे हैं। जहां तक भारत का सवाल है‚ उसने अपनी सक्रिय कूटनीति के जरिए कश्मीर मुद्दे पर विश्व बिरादरी को काफी हद तक आश्वस्त किया है। हाल में यूरोपीय संघ के राजदूतों ने अपनी जम्मू–कश्मीर यात्रा के बाद कहा था कि भारत सरकार ने वहां सामान्य स्थिति कायम करने के लिए सकरात्मक कदम उठाए हैं। कश्मीर के सामान्य हो रहे हालात से अंतरराष्ट्रीय स्तर पर भारत के पक्ष में माहौल बना है। तुर्की और मलयेशिया जैसे देशों के प्रलाप को भारत आसानी से नजरअंदाज कर सकता है। ॥ एर्दोगन का संबोधन ऑटोमन साम्राज्य की स्मृतियों को ताजा करता है‚ और साथ ही उनकी इस महत्वकांक्षा को भी प्रकट करता है कि वह इस्लामी देशों के नेता के रूप में उभरें। वह सऊदी अरब के स्थान पर तुर्की के इस्लामी देशों के नेता के रूप में उभरने का सपना देख रहे हैं। अपनी इस कवायद में वह पाकिस्तान को अपना सहयोगी देश मानते हैं

बुराई का अंत कैसे ॽ

इस हफ्ते दो मह्त्वपूर्ण घटनाएं घटीं। एक थी दिल्ली असेंबली के चुनावी नतीजे। नतीजों पर कुछ लोग प्रसन्न थे‚ तो कुछ नहीं‚ लेकिन बहुलांश से देखें तो दिल्ली के ज्यादातर लोग नतीजों से खुश हैं। लेकिन एक नई बात पर ज्यादा ध्यान नहीं जा पाया। चुनकर आने वाले विधायकों में आपराधिक अतीत रखने वाले विधायकों की संख्या बढ़ कर पचास प्रतिशत पर पहुंच गई है। यह संख्या लोक सभा में चुन कर आने वाले अपराधी छवि वाले सांसदों (४३ प्रतिशत) से कहीं ज्यादा है। ॥ अपराधी छवि वालों का चुनकर आने का सिलसिला कोई एक दशक पहले शुरू हुआ था जब यह आंकड़़ा ३३ प्रतिशत के आसपास था। दूसरी घटना १३ फरवरी‚ २०२० को घटी जब सुप्रीम कोर्ट ने अपराधी रिकॉर्ड़ रखने वाले उम्मीदवारों‚ इनमें कुछ तो जघन्य अपराधों के आरोपित हैं‚ के चुनाव लड़़ने पर प्रतिबंध लगाने से इनकार कर दिया। अलबत्ता‚ शीर्ष अदालत ने इतना जरूर कहा कि राजनीतिक दलों को अपराधी छवि वाले अपने सभी प्रत्याशियों के नामांकन के ४८ घंटे के भीतर नाम सार्वजनिक करने होंगे। नेता का आपराधिक रिकार्ड़ पार्टी की वेबसाइट‚ सोशल मीडि़या अकाउंट और समाचार पत्रकों में प्रकाशित करना होगा। नामांकन के ७२ घंटे के भीतर इस आदेश की अनुपालना संबंधी रिपोर्ट चुनाव आयोग को देनी होगी वरना अवमानना की कार्रवाई होगी। राजनीतिक दलों को यह भी बताना होगा कि उन्हें पार्टी टिकट किन कारणों से दिया गयाॽ ॥ पहले प्रत्याशियों को अपने से इस बाबत घोषणा करनी पड़़ती थी। एक अन्य फैसला था कि निर्वाचित जनप्रतिनिधि के खिलाफ आपराधिक मामलों का निबटारा एक साल के भीतर होना चाहिए। इस फैसले को आए कई साल गुजर चुके हैं‚ लेकिन विभिन्न अदालतों में राजनेताओं के खिलाफ तमाम मामले आज भी लंबित पड़े़ हैं। इस विषय में अनेक विचार हैं। एक विचार इस मसले को वैधानिक और संवैधानिक चश्मे से देखता है। यह विचार रखने वाले कहते हैं कि अदालत के समक्ष आरोप लगाने भर से किसी को अपराधी ठहराया जाना उचित नहीं है। इसलिए प्रतिबंध लगाया जाना कानून और संविधान के खिलाफ है। अपराधी साबित होने से पहले तक हर व्यक्ति निर्दोष होता है। शीर्ष अदालत भी जब–तब अपने अनेक फैसलों में यह बात कह चुकी है। एक और विचार है जो कहता है कि ऐसे मामले या तो झूठे बनाए जाते हैं‚ या राजनेताओं को द्वेष भाव से आरोपी बना दिया जाता है। इसलिए उन पर प्रतिबंध लगाया जाना अनुचित है। तीसरा विचार कहता है कि उन्हें प्रतिबंधित किया जाना चाहिए–इस आशय की अनेक याचिकाएं तक दायर की जा चुकी हैं। अनेक राजनेता निजी बातचीत में इस विचार का समर्थन करते हैं‚ लेकिन यहां भी कुछ झोल हैं। निर्वाचन आयोग स्वविवेक से अपनी शक्तियों का इस्तेमाल करते हुए छह साल का प्रतिबंध लगा सकता है। अनेक मौकों पर उसने ऐसा किया भी है‚ लेकिन कोई नहीं जान पाया कि किन कारणों सेॽ ॥ राजनीतिक जमात को छोड़़कर हर कोई सहमत है कि यह एक गंभीर समस्या है। वैधानिक एवं पारंपरिक सोच तो कहती है कि संसद में कानून बनाकर ऐसे लोगों पर प्रतिबंध लगाया जाना चाहिए। हम जानते हैं‚ ऐसा कभी नहीं होगा। इसलिए कि ऐसे लोगों का प्रतिशत तेजी से बढ़ा है‚ और वे अपने हितों के खिलाफ कुछ नहीं होने देंगे। इस विचार को मानने वाले भी हैं कि अपराधी छवि के लोगों को तो सरकार का चतुर्थ श्रेणी कर्मचारी तक नियुक्त नहीं किया जा सकता। न ही उन्हें कोई निजी उद्यम नियोजित करना चाहेगा। तो उन्हें चुनाव लड़़ने की छूट क्योंॽ इसके जवाब में कहा जाता है कि एक चयन है‚ तो दूसरा चुनाव और हमें बहुमत का सम्मान करना चाहिए। विवेकशील भारतीय इसका भी जवाब देते हैंः जब आरोपियों को सुनवाई के दौरान वर्षों जेल में रखा जा सकता है‚ देशद्रोह के आरोपी को‚ पब्लिक एंटी–सोशल एक्टीविटीज लॉज (पासा) और कश्मीर में पीएसए के तहत बिना सुनवाई साल भर जेल में ड़ाला जा सकता है‚ तो राजनेताओं को क्यों नहीं कुछ ऐसे ही कानून के दायरे में लाया जाताॽ जब नागरिक स्वतंत्रता की बात इन कानूनों के तहत राज्य के नियंत्रण में है‚ तो फिर प्रत्याशियों के चुनाव लड़़ने की स्वतंत्रता को कानून के दायरे में क्यों नहीं लाया जा सकताॽ ॥ कुछ लोगों का तर्क है कि ऐसे मामले झूठे या राजनीतिक हिसाब बराबर करने के लिए दायर किए जाते हैं। यदि हम आपराधिक मामलों में घिरे उम्मीदवारों पर प्रतिबंध लगाते हैं तो उनकी पार्टियां उनके विरोधियों के खिलाफमामले दर्ज कराकर उन पर भी बदले की भावना से प्रेरित होकर प्रतिबंध लगवा सकती हैं। कहना यह कि पुलिस सत्ताधारियों के आदेशों का पालन करेगी न कि कानून का। इससे न्यायपालिका को भी प्रभावित किया जा सकता है। बेशक‚ ऐसा हो भी सकता है। लेकिन इस सबके लिए जिम्मेवार कौन है‚ उम्मीदवारों को पार्टियां चुनाव मैदान में उतारती हैं‚ न कि लोग। लोग विभिन्न कारणों के चलते मतदान करते हैं‚ भले ही वे उम्मीदवार को पसंद न भी करते हों‚ लेकिन पार्टी को पसंद करने के कारण उसे वोट कर देते हैं। यदि हमें सुशासन का लIय हासिल करना है तो अनेक सुधारात्मक उपाय करने होंगे। आज जब ज्यादातर लोग दिल्ली में सुशासन की जीत से उत्साहित हैं‚ तो हमें यह सवाल उठाना ही होगाःक्या इससे भी बेहतर कुछ हो सकता है जिससे कि हमें अच्छे‚ ईमानदार और क्षमतावान विधायक मिल सकें। क्या हमारी आकांक्षाएं इस कदर हल्की हैं कि कोई थोड़़ा–सा भी कुछ अच्छा कर दे तो उत्साह और खुशी हिलोरें लेने लगें। ॥ हम वैधानिक‚ संवैधानिक सुधारों तथा पुलिस और न्यायिक सुधारों पर चर्चा करते हैं‚ तो क्यों न कुछ सरल से उपाय ही कर लें! पहला तो यह कि लोगों को दागी छवि वाले उम्मीदवारों को वोट नहीं करना चाहिए। इस प्रकार उन्हें चुनाव मैदान में उतारने वाली पार्टियों पर दबाव बनाना चाहिए कि वे क्षमतावान और ईमानदार उम्मीदवारों को ही टिकट दें। दूसरा यह करें कि दागी छवि वालों को प्रत्याशी बनाने वाले राजनीतिक दलों को जवाबदेह बनाया जाए। उनके वित्त पोषण–पार्टीगत और निजीगत दोनों–को सार्वजनिक करना अनिवार्य बनाया जाए। उन दलों के धन–स्रोतों पर गहराई से नजर रखी जाए। वैधानिक रूप से आज कोई भी निर्वाचित हो सकता है। लेकिन निर्वाचन के खिलाफ कोई आपराधिक मामला है‚ तो उसे मंत्री पद नहीं सौंपा जाना चाहिए। होना तो यह चाहिए कि उन्हें विधायक या सांसद पद की शपथ ग्रहण की अनुमति ही नहीं दी जानी चाहिए। न ही उन्हें आरोपमुक्त होने तक संसद की कार्यवाही में शिरकत करने की अनुमति मिले।

Auditors must do better to prevent fraud, financial crime

The word “audit” is derived from the Latin word “audire”, which means to hear. In the process of an audit, fraud risk will be one of several risks that are evaluated. In 1986, in the case of Kingston Cotton Mills company, it was stated that the auditor is a watchdog, not a blood hound. His responsibility is to find the true and fair value of the business and provide details of errors and fraud. The duty of an auditor is not to harm. The remedial action has to come from the owner of the entity in question.

Recent scams in various large entities have displayed the inability of auditors to report fraud to the owner/shareholders. In most of the cases, the magnitude of the fraud is in the thousands of crores. In the NSEL scam, a default to the tune of Rs 5,600 crore exists. Around 13,000 trading clients were affected and their money was stuck for more than six years. The failure of the auditor to detect the fraud and report it is the main cause for these losses. The auditors, Shravan Jalan and Amit Kabra have been arrested six years after the fraud was committed.

More recently, in the IL&FS case, lenders and shareholders lost about Rs 3 lakh crore. In the PMC bank scam more than Rs 4,300 crore worth of loans were extended to HDIL through bogus accounts. The auditors could not detect — or detected but did not report — fraud committed in earlier years. The PMC scam is a painful incident as middle-class people lost their hard earned money and retirement funds deposited with the bank. About 10 people died/committed suicide as they lost their life savings. All the auditors of the bank have been arrested.

But there are number of companies where the market capitalisation lost is much less, in lakhs of rupees. No auditors were arrested in most of these cases. Then there are frauds committed in the nationalised banks and not reported in time by the auditor. For such scams, the onus is on RBI auditors as well.

Is the most commonly performed annual financial audit to be relied upon to detect fraud? Or is total negligence on the part of the auditor the culprit? Or is she/he also a party to the fraud? These questions need to be answered before designing the new system of audit reporting.

SEBI recently issued a circular to discourage the auditor from resigning midway through an audit, instead of reporting the lapses. There is a government plan to revise the company auditor regulation order 2016 (CARO 2016). There are various steps being taken to improve the reporting, especially about the use of borrowed funds and to report on critical financial ratios. These may help to some extent but will not solve the problem entirely.

The Institute of Chartered Accountants (ICAI) has its own disciplinary committee and the power of a civil court to try professional misconduct. The ICAI has failed completely in controlling the misconduct of its members. Some elements involved in misconduct and fraud are ruining the ICAI’s reputation. The National Financial Reporting Authority (NERA) has largely taken over the powers of ICAI to regulate auditors. It will make stricter rules for the audit firms, increasing compliance and reporting. The time has come to review the entire reporting system and introduce stringent provisions before it is too late. Arresting the auditor is only part of the remedy. For the depositors, this will not help recover their lost money.

The ICAI should make stringent provisions and rules for reporting by the auditors. Merely increasing compliance is not going to help. Auditors have failed in their basic duties. The law should be more stringent. Auditors should not only be arrested but their assets confiscated and they should be treated as party to the fraud along with the management. There needs to be a separate provision in the Indian Penal Code for maximum punishment and speedy disposal for such financial crimes.

The government should think of a better alternative to the ICAI and SEBI. There should be an entirely new regulatory body to protect against frauds of the sort we have been discussing. It is well said that prevention is better than cure. There is no use of crying over spilt milk. In the current system, actions are often taken after the investors suffer huge losses. It’s time to think about preventive measures.

A step too far

Supreme Court is rightly concerned about growing criminality in politics. But its strategy for containment is problematic

The Supreme Court is the conscience-keeper of democracy, but it must take care not to infringe upon other democratic institutions, or appear to be well-meaning but ineffective, for this would reduce its stature. In trying to contain the growing presence in legislatures of members accused of serious crimes, it is in danger of overstepping limits and boundaries that it has, by and large, respected. Undoubtedly, criminality in politics exists, and that it flourishes so many decades after Independence is certainly a disgrace. In 2004, about one in four members of Parliament had criminal cases against them, but between 2009 and 2014, the frequency grew to about one in three, and in 2019, it was much closer to one in two. If almost every other MP stands accused of a serious crime, something is very wrong with the choice of candidates by political parties. The Supreme Court does well to reiterate its concern about this development, but it could have drawn the line there, limiting itself to exerting moral force on political parties, which are clearly in error.

But the court has proceeded, not just to make it mandatory for parties to publicise the number of serious cases which their candidates face, but also to justify their choice over other hopefuls who may be legally unencumbered. Further, the court has dictated that “winnability” cannot be the sole criterion for selection. Had these been framed as guidelines for parties, they would be unexceptionable. But making them enforceable under Article 142 of the Constitution — which empowers the court to demand the production of documents, and makes failure to do so a display of contempt — is problematic and threatens to undermine the autonomy of the system of elections and elected legislatures. Candidates are already required to file their details in affidavits with the Election Commission. This order could infringe upon the role of the poll watchdog.

Even more problematic is the requirement to justify the choice of candidates. An election is an issue to be decided between parties, candidates and the voters. The courts should have no say in the matter, except in particular cases where the Representation of the People Act is violated. Besides, the suitability of candidates is a subjective matter, and the justification required by the Supreme Court can only be an opinion, and not an objective fact, making the court’s order effectively unenforceable. Perhaps the SC has ventured too far beyond its remit, and while its goal is obviously in the public interest, it could ponder the means further.
