Scrap Sedition

At worst, laws pertaining to a campus brawl are applicable to the JNU fracas

The Delhi police chargesheet against JNU student leaders Kanhaiya Kumar, Umar Khalid and some other students accusing them of sedition and sundry other charges exemplifies why the colonial era sedition law must be scrapped. A provision in the Indian Penal Code relied upon by our erstwhile British rulers to put away troublesome Indian nationalists in jail for life has now become a weapon in the hands of governments to silence dissent. Dubbing sloganeering by a few people on a college campus as an insurrection against the Indian republic is certainly questionable.

To prevent such misuse of the sedition law, the Supreme Court in its Kedar Nath Singh judgment (1962) had defined and circumscribed its applicability – stating that it only applies when there is violence or explicit incitement to such violence. This principle was reiterated by the apex court in 2016, when it directed all authorities concerned to follow the 1962 judgment by a constitutional bench. The chargesheet filed by Delhi police after a lengthy delay of three years, when compelling video evidence about the alleged act of sedition is said to be available, does not appear convincing. Moreover, Kanhaiya has repeatedly asserted his loyalty to the Constitution and to the integrity of India.

Meanwhile, in UP, three Muslims arrested under the cow slaughter prohibition law in Bulandshahr have been booked under the stringent National Security Act that is entirely irrelevant in this case – even as nobody sees the killing of a cop by Bulandshahr rioters (an actual act of violence) as seditious. This clearly demonstrates the use of the sedition law as a political tool – even as authorities do not pay heed to how SC has limited and circumscribed its meaning. Laws prone to such misuse must be scrapped altogether.

Anti-Sedition Law Needs the Bin

On January 11, 80-year-old writer Hiren Gohain, activist Akhil Gogoi and journalist Manjit Mahanta were arrestedin Assam for ‘sedition’. It was perceived as an attempt to stifle protest against GoI’s proposed amendments to India’s citizenship law. On Monday, Delhi Police charged ex-Jawaharlal Nehru University (JNU) Students’ Union president Kanhaiya Kumar and nine others with the same crime, allegedly committed during a campus protest three years ago. The crackdown in Assam and on JNU students, some of whom have meanwhile become political activists, is a clumsy attempt to muzzle dissent. Four months before general elections, it also shows extreme testiness of the political establishment towards any criticism.

The survival of anti-sedition law, in the form of Section 124A of the Indian Penal Code (IPC), is an abomination that should have been scrapped while adopting the Constitution in 1950. Dissent was criminalised by the British in 1870, who wrote the penal code 10 years earlier, quaking after the uprising/mutiny of 1857. Sedition seeks to punish, “Whoever by words, spoken or written, or by signs…excites or attempts to excite disaffection towards the government….” The suspicion of dissent, however defined, is enough to trigger arrest under sedition.

Unsurprisingly, Mohandas Gandhi, Bal Gangadhar Tilak and Annie Besant were booked as seditionists. Between 2014 and 2017, 165 people were arrested for sedition, including patidar activist Hardik Patel. Thankfully, in almost every case, courts have rubbished the charge and the accused walked free — but after suffering the discomfort of arrest, imprisonment and trial.

In 1959, the Allahabad High Court said that sedition struck at the root of free speech and was unconstitutional. The Indian State fought this ruling, till in 1962, the Supreme Court said speeches or protests against parties or governments was no offence; attempts to break up India by force or persuasion was. Independent India should have the confidence to scrap the anachronistic sedition law suited for the police State that existed before 1947, and let free speech flourish without fearing its own citizens so much.

आर्थिक आधार पर आरक्षण से ही दूर हो पाएगी समस्या?

आर्थिक रूप से कमजोर अगड़ों के लिए आरक्षण संबंधी विधेयक संसद में पारित होने से पैदा हुई आशंकाओं ने नौकरियों और शिक्षा में आरक्षण पर होने वाली बहस में अंतर्निहित विरोधाभास को फिर से उजागर कर दिया है। सामाजिक अन्याय से आक्रांत रहे देश में एक सकारात्मक कदम के तौर पर आरक्षण की अहमियत निरपवाद है। लेकिन इस पर गौर करने की पर्याप्त वजहें हैं कि क्या आरक्षण देने में लंबे समय से अपनाया जाता रहा ‘टॉप-डाउन’ दृष्टिकोण ही इस दिशा में आगे बढऩे का व्यावहारिक तरीका है? टॉप-डाउन दृष्टिकोण में सरकारी नौकरियों और सरकारी नियंत्रण वाले एवं उसकी आर्थिक मदद से चलने वाले शिक्षण संस्थानों में आरक्षण का दायरा लगातार बढ़ता रहा है।

इस सकारात्मक कार्रवाई के तहत लाभान्वित होने वाले व्यक्ति के लिए जाति, समुदाय या अब आर्थिक हालात में से कोई भी उद्गम सही मायनों में सशक्तीकरण या सामाजिक रूपांतरण करने वाला नहीं है। अन्य पिछड़ी जातियों (ओबीसी) के अधिक संपन्न एवं शिक्षित परिवारों को ‘क्रीमी लेयर’ प्रावधान से घेरने और निचली जातियों को आरक्षण से होने वाले फायदों को लेकर सार्वजनिक विमर्श और न्यायपालिका के भीतर भी तगड़ा विवाद रहा है। इससे जुड़े एक असहज सच की तरफ नितिन गडकरी ने कुछ समय पहले ही इशारा किया था। गडकरी ने कहा था कि जब केंद्र और राज्यों में सरकारें अब नौकरी नहीं दे पा रही हैं लिहाजा किसी के लिए भी नौकरी में आरक्षण देना असल में एक निरर्थक प्रयास ही है।

गडकरी ने अनजाने में ही समस्या की जड़ को उजागर कर दिया। वोट दिलाने वाली कलाबाजी से आगे बढ़कर भारत में व्यापक सामाजिक इक्विटी के निर्माण की चिंता करने वाले किसी भी राजनेता के लिए यह महत्त्वपूर्ण है। बड़ी संख्या में नौकरियां निजी क्षेत्र में सृजित हो रही हैं (इसमें पकौड़े बेचने वाले शामिल नहीं हैं) और यह क्षेत्र ही शिक्षा सेवाओं का सबसे बड़ा आपूर्तिकर्ता भी है। ऐसे में असली पहेली यह है कि कॉर्पोरेट क्षेत्र को सामाजिक रूप से हाशिये पर मौजूद लोगों के लिए समान अवसर मुहैया कराने के लिए किस तरह तैयार किया जाए? साफ है कि निजी क्षेत्र में आरक्षण को अनिवार्य करना इस दिशा में आगे बढऩे का गलत तरीका होगा। आखिरकार निजी कंपनियां वाणिज्यिक संगठन हैं।

इसका जवाब ‘बॉटम-अप’ दृष्टिकोण में छिपा हुआ है जिससे क्षमता निर्माण किया जा सके। अगर हम 21वीं सदी में भी भारत की रगों में प्रवाहित होने वाले जातिवाद को अलग रख दें तो रोजगार और शिक्षण संस्थाओं में प्रवेश के आरक्षण पर सामान्य आपत्ति का आधार यही होता है कि इनकी वजह से पहले से ही अपर्याप्त नौकरियां निम्न चयन मानक होने से गैर-लाभान्वित लोगों के लिए और कम हो जाती हैं। यह आरक्षण से लाभान्वित होने वाले लोगों के खिलाफ असंतोष एवं पूर्वग्रह को और भी बढ़ाने का काम करता है जो सकारात्मक कार्रवाई के मकसद को ही धराशायी कर देती है।

हालांकि वंचित समुदायों को मिलने वाला आरक्षण उच्च शिक्षण संस्थानों में प्रवेश और नौकरियों तक ही सीमित है। कानून-निर्माताओं ने शायद प्राथमिक एवं माध्यमिक स्कूलों के स्तर पर कभी ध्यान नहीं दिया है जबकि अलग-अलग चयन मानक बताते हैं कि इन बच्चों की बुनियादी शिक्षा सबसे अच्छी नहीं रहती है। इस पहलू को ध्यान में रखें तो क्या यह सरकार के लिए अपनी सार्वभौम शिक्षा नीति को तिलांजलि देने और निजी एवं सरकारी सभी स्कूलों में स्कूली स्तर पर आरक्षण को अनिवार्य बनाने और इस मद में अपनी शिक्षण सब्सिडी प्रवाहित करने का वाजिब कारण नहीं बनता है? इसे लागू करने का रास्ता गरीब छात्रों के लिए स्कूल वाउचर प्रणाली में कुछ हद तक नजर आया है। सेंटर फॉर सिविल सोसाइटी ने सबसे पहले इसकी अवधारणा दी थी और दिल्ली में कुछ हद तक सफलता के साथ यह व्यवस्था लागू होती नजर आ रही है।

वाउचर व्यवस्था वंचित परिवारों के बच्चों को अपनी पसंद के गुणवत्तापरक स्कूलों में पढ़ाई की सुविधा देता है और उन स्कूलों को भी कोई राजस्व क्षति नहीं होती है। अमेरिका समेत कई देशों में यह व्यवस्था कारगर रही है। इस व्यवस्था में सामाजिक समता एवं अखंडता बनाए रखने और आबादी के बड़े हिस्से के लिए बेहतर शैक्षणिक परिणाम हासिल करने का दोहरा लाभ है। अवसर की समानता से लैस होने पर सामाजिक रूप से वंचित छात्र विश्वविद्यालय या अग्रणी संस्थानों में मिलने वाली उच्च शिक्षा का पूरी तरह लाभ उठा पाने की स्थिति में होगा।

नौकरी इस उच्च शिक्षा से ही मिलती है। शिक्षा के क्षेत्र में समानता लाने वाली कानूनी अनिवार्यता होने से कंपनियों के लिए अपनी चयन प्रक्रिया में किसी तरह का भेदभाव कर पाना न केवल मुश्किल बल्कि गैर-जरूरी भी हो जाएगा। सदियों पुरानी पूर्वग्रहों को खत्म करने के लिए सरकार के सामने एक कारगर उपकरण अमेरिका का न्यू डील प्रोग्राम हो सकता है जो नस्लभेदी अलगाव के असर को खत्म करने के लिए अमेरिकी सरकार ने असरदार तरीके से लागू किया था। ऐसे कार्यक्रम में यह अनिवार्य किया जा सकता है कि सभी सरकारी ठेकेदार कर्मचारियों के चयन में न्यूनतम सामाजिक विविधता सुनिश्चित करें। यह बिग गवर्नमेंट के लिए उपयोगी है। लेकिन ऐसे बदलाव भारत को वह न्यायपरक समाज नहीं बना पाएंगे जिसकी संकल्पना संविधान निर्माताओं ने की थी। सकारात्मक सामाजिक बदलाव होने में दशकों लग सकते हैं लेकिन जमीनी स्तर पर इसकी शुरुआत होने से उम्मीद की किरण तो दिखती ही है।

समाप्त हो नियंत्रण

देश की निजी क्षेत्र की सबसे बड़ी पूर्णकालिक सेवा देने वाली विमानन कंपनी जेट एयरवेज कर्ज के बोझ तले दबी हुई है। कंपनी पर बैंकों के एक समूह तथा अन्य कर्जदारों की 8,000 करोड़ रुपये से अधिक की राशि बकाया है। इसमें से 6,000 करोड़ रुपये की राशि अगले दो वर्ष में चुकानी है। यह संकट उस समय गंभीर हो गया जब विमानन कंपनी पिछले दिनों अपना कुछ पुनर्भुगतान करने से चूक गई। इसके बाद इसके कर्ज की स्थिति और खराब हो गई। कंपनी को पिछली तीन तिमाहियों में लगातार घाटा हुआ है जो 1,000 करोड़ रुपये से अधिक हो चुका है। ऐसे में बिना नए फंड या पुनर्गठन के पुराने कर्ज का चुकता होना मुश्किल नजर आ रहा है। केवल वित्तीय कर्जदाता ही अपने पैसे की प्रतीक्षा नहीं कर रहे हैं, भारतीय विमानन प्राधिकरण और तेल विपणन कंपनियों को भी भुगतान की प्रतीक्षा है।

कर्मचारियों को भी उनका पूरा वेतन समय पर नहीं मिल पा रहा है। किसी विमानन कंपनी के लिए यह केवल वित्तीय संकट नहीं है बल्कि यह सुरक्षा का मसला भी पैदा करता है। उदाहरण के लिए सिंगापुर में नियामकों ने विमानन कंपनी के खिलाफ कदम उठाए हैं। लागत बचाने के लिए किए गए समझौते एक ऐसी विमानन कंपनी के लिए दिक्कत पैदा कर सकते हैं जिसके लिए सुरक्षा निगरानी को अद्यतन रखना जरूरी है। जेट के भविष्य को लेकर आ रही तमाम खबरों के कारण उसकी शेयर कीमतों में लगातार उतार-चढ़ाव आ रहा है। हाल ही में उस समय कंपनी के शेयरों की कीमत में इजाफा हुआ जब वह पुरानी उम्मीद जगी कि कंपनी में अल्पांश हिस्सेदारी रखने वाली अबूधाबी की एतिहाद एयरलाइंस, जेट में अपनी हिस्सेदारी को बढ़ाकर 49 फीसदी कर सकती है। एतिहाद खुद बहुत अच्छी स्थिति में नहीं है और उसे अपनी विस्तार की अन्य योजनाओं में कटौती करनी पड़ी है। जानकारी के मुताबिक कंपनी अब एमिरेट्स एयरवेज या कतर एयरवेज के साथ अंतरराष्ट्रीय उड़ान मार्गों पर नए सिरे से प्रतिस्पर्धा नहीं करेगी। ये दोनों कंपनियां बड़ी हैं और इनके पास पर्याप्त फंड है। अहम बात यह है कि अब कर्जदारों को जेट के मौजूदा प्रबंधन और स्वामित्व को लेकर अधिक नरमी का परिचय नहीं देना चाहिए। किंगफिशर एयरलाइंस का उदाहरण हमारे सामने है। बैंकों को खासतौर पर किंगफिशर प्रकरण से सबक लेना चाहिए। जेट एयरवेज का परिचालन होना चाहिए लेकिन उसकी उचित कीमत वसूली जानी चाहिए।

खासतौर पर किसी भी तरह के पुनर्गठन के बाद जेट के दीर्घकालिक प्रवर्तक नरेश गोयल अथवा उनके नामितों की उसके परिचालन में निर्णायक भूमिका नहीं होनी चाहिए। माना जा रहा है कि एतिहाद ने ऐसी मांग की है और गोयल इसका प्रतिरोध करते रहे हैं। परंतु कर्जदारों के समूह को भी यह बात उठानी चाहिए। इसमें दो राय नहीं कि गोयल ने सन 1993 में जेट एयरवेज की शुरुआत उस वक्त की थी जब देश में हवाई यात्रा शुरुआती अवस्था में थी। उन्होंने इस क्षेत्र को गति दी और देश को विमानन जगत के मानचित्र पर स्थापित किया। परंतु 25 वर्ष बाद उनकी स्थिति ठीक नहीं है। बैंकों को भी अपने कर्ज के बदले बहुत अधिक हिस्सेदारी लेने में सावधानी बरतनी चाहिए। इसके बजाय उन्हें विमानन नियामक और सरकार के साथ मिलकर यह सुनिश्चित करना चाहिए कि अगर एतिहाद समेत कोई इस कंपनी को घाटे से उबारना चाहता है तो नियामकीय और वित्तीय प्रक्रियाओं को जल्दी निपटाया जाना चाहिए। जेट के पास अभी भी काफी मूल्यवान संपत्तियां हैं। इसमें उसके नियमित उड़ान करने वाले ग्राहक भी शामिल हैं। इसलिए इसकी बंदी के साथ जुड़े पूंजीगत नुकसान से बचा जाना चाहिए। परंतु निश्चित तौर पर गोयल, उनके परिजन या मित्रों के पास कंपनी के परिचालन अधिकार नहीं होने चाहिए।

अफगान मसले को उलझाते ट्रंप

इसमें कोई संदेह नहीं कि अमेरिकी राष्ट्रपति डोनाल्ड ट्रंप अफगानिस्तान में अमेरिकी सेना की मौजूदगी और भूमिका में कटौती करना चाहते हैं। यह विदेश नीति में उनकी एक बड़ी प्राथमिकता बन गई है और इसके लिए वह काफी अधीर हो रहे हैं। इस मकसद के लिए अमेरिका ने पिछले वर्ष अक्टूबर में जालमी खलीलजाद को अफगानिस्तान के पुनर्निर्माण के लिए अपना विशेष दूत नियुक्त कर उन्हें तालिबान से वार्ता करने की जिम्मेदारी भी सौंपी, ताकि तालिबान हिंसा छोड़कर अफगानिस्तान में राष्ट्रपति अशरफ गनी और मुख्य कार्यकारी अब्दुल्ला के साथ संवाद शुरू करे। किंतु तीन दौर की वार्ता के बावजूद खलीलजाद अभी तक तालिबान को अफगानिस्तान सरकार के प्रतिनिधियों से बातचीत के लिए राजी नहीं कर पाए हैं। 9 जनवरी को कतर में जो वार्ता होनी थी, वह भी तालिबान के रवैये के कारण स्थगित हो गई।

दरअसल तालिबान अमेरिका के साथ धींगामुश्ती में लगा है और अपने उसी अड़ियल रुख पर कायम है कि अमेरिका सहित अन्य सभी फौजें अफगानिस्तान से चली जाएं। वह अफगानिस्तान सरकार को भी अमेरिका की कठपुतली मानता है, लिहाजा उससे बात करने का भी अनिच्छुक है। अपनी अनर्गल टिप्पणियों से ट्रंप खलीलजाद की राह और मुश्किल बना रहे हैं। एक संवाददाता सम्मेलन के दौरान ट्रंप ने अफगानिस्तान में भारतीय मदद एवं सहयोग को लेकर अपमानजनक टिप्पणियां कीं। उन्होंने कहा कि भारत वहां पुस्तकालय बना रहा है, लेकिन क्या वहां कोई पढ़ता भी है? उन्होंने यह भी कहा कि भारत वहां जो मदद कर रहा है, अमेरिका वहां उतना पांच घंटे में खर्च कर देता है। तालिबान से लड़ने में कुछ देशों के सैन्य सहयोग पर भी ट्रंप ने अपमानजनक बातें कहीं। उनके ऐसे असंवेदनशील बयानों पर भारतीय बौद्धिक वर्ग के एक तबके में नाराजगी स्वाभाविक ही है। यह अच्छा रहा कि नई दिल्ली और काबुल ने भारत की मदद के स्वरूप से जुड़े तथ्यों को सामने रखा। भारतीय मदद को अफगान जनता की स्वीकार्यता भी मिली है, क्योंकि यह उन्हीं क्षेत्रों में हो रही है जिनमें अफगान सरकार उससे अपेक्षा करती है।

मीडिया से बातचीत में ट्रंप ने अमेरिकी जनरलों की भूमिका को भी आड़े हाथों लिया। उन्होंने उलाहना देते हुए कहा कि उन्होंने अफगानिस्तान में अच्छे नतीजे नहीं दिए हैं और इसी कारण यह लड़ाई 17 साल लंबी खिंच गई। ट्रंप का यह मानना स्वाभाविक है कि अपने इतिहास की सबसे लंबी लड़ाई में अमेरिकी सैन्य बल नाकाम रहे हैं, लेकिन इस पहलू को भी नजरअंदाज नहीं किया जा सकता कि इस नाकामी में अमेरिकी नेताओं की वह हिचक भी जिम्मेदार है जिसके चलते पाकिस्तान में मौजूद तालिबान के सुरक्षित ठिकानों को निशाना बनाने की अनिच्छा दिखाई गई। ट्रंप के बयान की यही व्याख्या की जाएगी कि तालिबान के खिलाफ बढ़त बनाने में उन्हें अमेरिकी सैन्य बलों पर भरोसा नहीं। ऐसी लाचारी से केवल तालिबान का दुस्साहस ही बढ़ेगा और वह अपने अड़ियल रवैये पर कायम रह सकता है। ट्रंप के रुख-रवैये से अफगानिस्तान सरकार के साथ वहां की जनता का मनोबल भी कमजोर होगा।

मीडिया के समक्ष ट्रंप ने एक और महत्वपूर्ण पहलू का उल्लेख किया। उन्होंने कहा कि अमेरिका जहां अफगानिस्तान से छह हजार मील दूर है और फिर भी वह वहां संघर्ष में जुटा है, वहीं भारत, पाकिस्तान और रूस जैसे देश, जिनके अफगानिस्तान से क्षेत्रीय हित सीधे जुड़े हुए हैं, इस लड़ाई से दूर हैं। स्पष्ट है कि वह चाहते हैं कि अफगानिस्तान में अमेरिका के धन और बल पर बोझ को इन देशों द्वारा भी साझा किया जाना चाहिए। इसमें कुछ देशों का उन्होंने जिक्र किया, तो कुछ का नहीं किया। यह उनके भीतर की कारोबारी प्रवृत्ति का ही परिचायक है। द्वितीय विश्वयुद्ध के बाद वह पहले अमेरिकी राष्ट्रपति हैं, जिनकी कारोबारी पृष्ठभूमि है। शायद इसी कारण अपने 12 पूर्ववर्तियों के उलट अन्य देशों के वित्तीय योगदान को लेकर उनका रवैया ज्यादा स्पष्ट और मुखर है, लेकिन अमेरिका इससे बेपरवाह दिखता है कि अफगानी जनता रूसी या पाकिस्तानी फौज को अपनी जमीन पर कभी नहीं उतरने देगी, क्योंकि वह उन्हें अपनी अधिकांश समस्याओं का जिम्मेदार मानती है। भारत भी स्पष्ट कर चुका है कि वह अफगानिस्तान में अपने सैनिक नहीं भेजेगा, लेकिन भारत-अफगान सामरिक साझेदारी समझौते को देखते हुए सैन्य उपकरण और प्रशिक्षण देने के साथ ही अफगान सुरक्षा बलों को चिकित्सा सहायता देने से पीछे नहीं हटेगा।

अफगानिस्तान में भारत के योगदान पर ट्रंप के बयान के बाद उनके और प्रधानमंत्री मोदी के बीच फोन पर बात हुई। बातचीत के दौरान अफगानिस्तान के हालात पर भी चर्चा हुई। इस बातचीत के तुरंत बाद खलीलजाद ने भारत का दौरा किया। उन्होंने विदेश मंत्री सुषमा स्वराज व राष्ट्रीय सुरक्षा सलाहकार अजीत डोभाल से मुलाकात की। इससे इनकार नहीं किया जा सकता कि तीन महीनों से खलीलजाद भारत आने से कतरा रहे थे, जबकि उन्होंने अफगानिस्तान के लिहाज से कई अहम देशों के दौरे किए। इसके पीछे एक वजह यह भी थी कि भारत का दौरा कर वह पाकिस्तान को नाराज नहीं करना चाहते थे, जिसकी अफगानिस्तान में शांति स्थापित करने में अहम भूमिका है। तमाम सकारात्मक बयानों के बावजूद पाकिस्तान अफगानिस्तान में स्थिरता लाने के लिहाज से कोई ठोस कदम नहीं उठा रहा, क्योंकि वह अफगानिस्तान की भारत नीति को नियंत्रित करना चाहता है। अभी तक किसी भी अफगान सरकार ने उसे यह छूट देने के संकेत भी नहीं दिए हैं। भारी अस्थिरता के दौर से जूझ रहे अफगानिस्तान में जहां गनी-अब्दुल्ला सरकार पाकिस्तान समर्थित नई ताकत और मनोबल से लैस तालिबान से मोर्चा ले रही है, तो भारत को उसे हरसंभव मदद मुहैया करानी चाहिए। अफगानिस्तान सरकार ने अपनी खुफिया एजेंसी के दो पूर्व प्रमुखों अमरुल्ला सालेह और असदुल्ला खालिद को आंतरिक और रक्षा मंत्रालय का दायित्व सौंपा है।

इन दोनों काबिल, अनुभवी अफसरों की कैबिनेट में मौजूदगी से अफगान लोगों के साथ ही तालिबान और पाकिस्तान के साथ मसलों के सुलझने की उम्मीद बंधी है। अफगानिस्तान को तमाम मोर्चों पर मदद के साथ ही भारत को तालिबान के साथ वार्ता का विकल्प भी खुला रखना चाहिए, क्योंकि सभी बड़े देश ऐसा कर रहे हैं। इसी के साथ ही यह भी स्पष्ट किया जाना चाहिए कि भारत न तो तालिबान को पसंद करता है और न उसकी विचारधारा को। अंतरराष्ट्रीय कूटनीति ऐसे ही काम करती है। इसके तहत कई ऐसे समूहों से भी बात करनी पड़ती है जो आपकी आंखों में खटकते हों। यह भी ध्यान दिया जाना चाहिए कि विदेश मंत्री ही इस मामले में कोई पक्ष रखें, न कि सेना प्रमुख। कूटनीति की कमान विदेश मंत्री के हाथ में होती है, सेना प्रमुख के काम का दायरा दूसरा है। दोनों को अपनी भूमिकाओं को लेकर दुविधा नहीं होनी चाहिए, क्योंकि इससे केवल गफलत ही पैदा होगी।

आर्टिफिशियल इंटेलीजेंस और भविष्य की आशंकाएं

रोजगार के अवसरों को लेकर आज दुनिया उसी मुकाम पर खड़ी है, जहां 80 के दशक में तब थी, जब कंप्यूटरीकरण शुरू हुआ था। या 60 के दशक में, जब स्वचालित मशीनों का प्रचलन बढ़ा था। और पीछे जाएं, तो अमेरिका-यूरोप में जब 19वीं सदी में कृषि कार्य में मशीनों का इस्तेमाल शुरू हुआ, तो कृषि से जुड़े रोजगारों में भारी गिरावट आई थी। कहा जा रहा है कि आने वाले समय में ज्यादातर काम कृत्रिम बुद्धिमता वाली मशीनों से होने लगेंगे और इंसानों के लिए रोजगार के अवसर सीमित हो जाएंगे। इन्हीं चिंताओं के बीच बोस्टन यूनिवर्सिटी के प्रोफेसर जेम्स बेसेन का शोध उम्मीदें जगाता है। वह कहते हैं कि आर्टिफिशियल इंटेलीजेंस का इस्तेमाल बढ़ने से नई सेवाएं और नए किस्म के रोजगार भी बढ़ेंगे। ऐसी ही सोच टेस्ला के सीईओ एलोन मुश्क की भी है।

वह कहते हैं कि इंसान की भूमिका कभी खत्म नहीं हो सकती। पिछले दिनों मैकिन्से ग्लोबल इंस्टीट्यूट ने अपने अध्ययन में कहा था कि कृत्रिम बुद्धिमता के कारण 2030 तक दुनिया में 80 करोड़ नौकरियां खत्म हो जाएंगी और 37 करोड़ पेशेवरों को नए सिरे से प्रशिक्षण लेना होगा, क्योंकि जो कार्य वे कर रहे हैं, उसकी अहमियत नहीं रह जाएगी। उन्हें अपने कौशल को नए सिरे से साधना होगा। इन अध्ययनों के बाद भारत समेत दुनिया के 25 बड़े देशों ने इस चुनौती के प्रभावों का आकलन करना शुरू कर दिया है। भारत में जहां रोजगार सबसे बड़ी जरूरत है और यह राजनीतिक मुद्दा भी बनता है, वहीं रोजगार के घटने के संकेत बेहद चिंताजनक और डराने वाले हैं।  आर्टिफिशियल इंटेलीजेंस का इस्तेमाल बढ़ने से कई अहम बदलाव होंगे।

कारखानों में मशीनों को चलाने के लिए इंसानों की जरूरत न्यूनतम हो जाएगी। मशीनें अपनी जरूरत के हिसाब से खुद ही काम करने लगेंगी। जिन कामों में ज्यादा श्रम की जरूरत है, उसके लिए रोबोट का इस्तेमाल होने लगा है। रोबोट इंसान से ज्यादा काम करेगा और उसकी लागत कम आएगी। इसी प्रकार, आईटी क्षेत्र में आर्टिफिशियल इंटेलीजेंस से सॉफ्टवेयर सारे दिशा-निर्देश खुद ही देने लगेंगे, जबकि अभी तक उसके संचालन के लिए इंसान की जरूरत होती थी। साइबर हमलों का जवाब भी सॉफ्टवेयर खुद दे देंगे, जबकि अभी साइबर विशेषज्ञ तैनात किए जाते हैं। मशीनों से किए जाने वाले काम की लागत कम होती है, काम जल्दी पूरा होता है तथा उसमें गलतियों की गुंजाइश कम होती है, इसलिए इसे अपनाना उद्योग जगत के लिए फायदेमंद होगा। आने वाले दिनों का नजारा यह होगा कि यदि कोई कंपनी इंसान संचालित मशीनों से कार बना रही है, तो उसकी कारें उस स्टैंडर्ड की नहीं मानी जाएंगी, जो रोबोट के द्वारा तैयार की जा रही हैं। यानी उद्योग जगत के लिए इसे अपनाना एक बाध्यता भी होगी। ऐसे में इंसान क्या करेगा?

यहां बोस्टन यूनिवर्सिटी के प्रोफेसर जेम्स बेसेन की टिप्पणी राहत देती है। वह कहते हैं कि आर्टिफिशियल इंटेलीजेंस से भले मौजूदा रोजगार कम हो जाएं, लेकिन नए रोजगार भी सृजित होंगे। ये रोजगार किस प्रकार के होंगे, यह बता पाना अभी मुश्किल है, मगर निश्चित रूप से रोजगार का परिदृश्य बदलेगा। कई ऐसे रोजगार आ सकते हैं, जिसके बारे में हम आज सोच भी नहीं सकते। वैसे ही, जैसे कंप्यूटराइजेशन के बाद आईटी क्षेत्र का सृजन हुआ। टेस्ला कंपनी के सीईओ एलोन मुश्क की सोच भी राहत देती है। वह कहते हैं, मनुष्य की क्षमताओं को मशीन के आगे कम करके आंका जा रहा है। चीजों को अंगीकार करने की जो क्षमता मनुष्य में है, वह मशीन में नहीं आ सकती। इसलिए घबराने की जरूरत नहीं है। शोध बताते हैं कि कृत्रिम बुद्धिमता के इस्तेमाल से सबसे ज्यादा असर कम कौशल वाले रोजगारों पर पड़ने की संभावना है। ब्लू कॉलर और ह्वाइट कॉलर रोजगार घट सकते हैं। आकलन बताते हैं कि उच्च कौशल वाले रोजगारों की मांग बनी रहेगी। आईटी और इलेक्ट्रॉनिक क्षेत्र में प्रोग्रामिंग और रोबोटिक्स में रोजगार तेजी से बढ़ेंगे। पर सबसे बड़ी चुनौती यह होगी कि पेशेवरों की जो फौज अभी संस्थानों से निकल रही है, उसे अपने कौशल को नए सिरे से साधना होगा, वरना वे पेशेवर रोजगार के बाजार में टिक नहीं पाएंगे।

संकट जो अपनों ने पैदा किया

सीबीआई डायरेक्टर आलोक वर्मा की चौबीस घंटों की हालिया बहाली और फिर तबादले ने जो यक्ष प्रश्न खड़ा किया है, उसे एक राष्ट्रीय दैनिक में छपे कार्टून से बेहतर समझा जा सकता है। इस कार्टून में प्रधानमंत्री मोदी के हाथ में एक पिंजड़ा है और उसमें बंद तोते के बारे में कार्टूनिस्ट की जिज्ञासा है कि क्या यह भी फीनिक्स की तरह अपनी राख से पुनर्जीवित हो सकता है? फीनिक्स सिर्फ मिथकों में पुनर्जीवन प्राप्त करता है, वास्तविकता कल्पना से बहुत भिन्न होती है। सीबीआई जैसी किसी संस्था की जान तो उसकी साख में बसती है और पिछले दिनों जिस तरह से उसकी साख पर आघात लगा है, उससे नहीं लगता कि यह संस्था आसानी से उबर पाएगी। एक महीने के दौरान शीर्ष पर परिवर्तन होते ही जैसे अधीनस्थों के तबादले किए गए और फिर उन्हें रद्द किया गया, उनसे यह तो स्पष्ट हो ही गया कि इस प्रतिष्ठित संस्था में गुटबंदी बहुत गहरे पैठ गई है। इसी तरह, अफसरों के सार्वजनिक रूप से एक-दूसरे पर कीचड़ उछालने से भी साफ है कि संस्था में सब कुछ ठीक नहीं चल रहा।

कुछ साल पहले जब सर्वोच्च न्यायालय ने सीबीआई को पिंजड़े में बंद तोते की संज्ञा दी थी, तब किसी को आश्चर्य नहीं हुआ था। लंबे अरसे से वह अपने मालिकों की हां में हां मिलाती आ रही थी और देश इसका अभ्यस्त हो गया था। एक लंबे राष्ट्रीय विमर्श और न्यायिक सक्रियता से सरकार को सीबीआई डायरेक्टर या मुख्य सतर्कता आयुक्त (सीवीसी) की नियुक्ति से संबंधित सांविधानिक प्रक्रिया में ऐसे परिवर्तन करने पड़े, जिनसे यह अधिक पारदर्शी या समावेशी बन सके। अब सीबीआई डायरेक्टर की नियुक्ति एक कमेटी करती है, जिसके सदस्य प्रधानमंत्री, लोकसभा में विरोधी दल का नेता व प्रधान न्यायाधीश होते हैं। पेच यह है कि सीबीआई के पर्यवेक्षण का जिम्मा केंद्रीय सतर्कता आयोग को मिला हुआ है और उसके मुखिया सीवीसी की नियुक्ति जो कमेटी करती है, उसके सदस्य होते हैं- प्रधानमंत्री, गृह मंत्री और नेता, विरोधी दल अर्थात इसमें बहुमत सत्ता दल का ही होता है। स्वाभाविक है कि सीवीसी सरकार की पसंद का अफसर होगा, यानी सरकार का नियंत्रण इस महत्वपूर्ण जांच एजेंसी पर बना रहता है।

पूरे प्रकरण में सबसे दुखद यह था कि जिस बागवान को उपवन की देखभाल करनी होती है, वही उसकी बर्बादी का बायस भी बनता रहा है। हालांकि इसके लिए सिर्फ मौजूदा सरकार को दोषी नहीं ठहरा सकते। पहले भी सरकारें भी इस बात का खास ध्यान रखती रही हैं कि आने वाला उनके कितने काम का है? इस बार कुछ ज्यादा छीछालेदर इसलिए हुई कि ज्यादा आत्मविश्वास से लबरेज सरकार ने सांविधानिक मर्यादाओं या मीडिया की बहुत परवाह नहीं की। खुद के बनाए डायरेक्टर आलोक वर्मा से जल्दी ही उसका मन भर गया और उसने उनके उत्तराधिकारी के रूप में जिसे चुना, वह इस पद के लिए सर्वथा अयोग्य था। राकेश अस्थाना की छवि अपने काडर में ही काफी विवादास्पद थी। न सिर्फ उनकी ईमानदारी पर प्रश्न चिह्न थे, उनके विरुद्ध खुद सीबीआई में प्रकरण लंबित थे। अखबारी खबरों के मुताबिक, उन्हें सीबीआई में लिए जाने का विरोध आलोक वर्मा ने भी किया था। इसे नजरंदाज करके न सिर्फ राकेश अस्थाना को प्रतिनियुक्ति दी गई, बल्कि उनसे वरिष्ठ अधिकारियों को भी संस्था से बाहर भेज दिया गया। मकसद साफ था, जनवरी 2019 में आलोक वर्मा के रिटायर होने के बाद वरिष्ठतम अधिकारी के रूप में अस्थाना की सीबीआई डायरेक्टर के पद की दावेदारी सबसे प्रबल होती और सरकार उन्हें इस पद पर नियुक्त कराने में सफल भी हो जाती। यह न हो सका, तो सिर्फ इसलिए कि सरकार और शासक दल के महत्वपूर्ण लोगों के समर्थन के प्रति आश्वस्त अस्थाना अपने बॉस से ही भिड़ गए। ज्यादा गरम आलू की तरह सरकार को उन्हें उगलना पड़ रहा है।

इस मामले में जिस सतर्कता आयोग की रिपोर्ट पर आधी रात को सीबीआई में तख्ता पलट हुआ और बाद में जिसे सर्वोच्च न्यायालय ने भी जांच करके रिपोर्ट देने को कहा, उसके मुखिया की विश्वसनीयता तो पहले से ही संदिग्ध थी। आलोक वर्मा ने खुलेआम आरोप भी लगाया है कि सीवीसी के वी चौधरी उनसे राकेश अस्थाना को रियायत देने की सिफारिश लेकर उनके घर पर मिलने आए थे। के वी चौधरी की सर्वोच्च न्यायालय में दाखिल लिफाफा बंद रपट अब तो अखबारों को भी उपलब्ध हो चुकी है और उसे पढ़कर अधिकांश जन निराश ही होंगे। इस जांच पर नजर रखने के लिए जिन जस्टिस पटनायक को नियुक्त किया था, खुद उन्हें बहुत से तथ्य नहीं बताए गए थे। उनका कहना है कि वर्मा के विरुद्ध भ्रष्टाचार के आरोप सिद्ध नहीं हैं और सीवीसी की रपट को अंतिम नहीं माना जा सकता।

देश के प्रतिष्ठित न्यायविदों की सर्वोच्च न्यायालय के इस फैसले पर जो प्रतिक्रियाएं आई हैं, वे कोई बहुत सुखद नहीं हैं। जिन जस्टिस सीकरी को प्रधान न्यायाधीश के स्थान पर आलोक वर्मा के भविष्य पर फैसला लेने वाली कमेटी में भेजा गया था, उन्हें सरकार ने कुछ ही दिनों पहले लंदन के एक ट्रिब्यूनल में नामित किया था, जहां वह मार्च में रिटायर होने के बाद पदभार ग्रहण करते। हालांकि अब खबर है कि जस्टिस सीकरी ने इस पद पर जाने से इनकार कर दिया है।

अपनी सारी कमियों के बावजूद सीबीआई एक ऐसी विवेचना एजेंसी थी, जिस पर नागरिकों का कुछ विश्वास शेष था। जिन अदालतों ने उसे तोता कहा, वे भी जरूरत पड़ने पर उसी को गंभीर मसले सौंपती थीं। कानून-व्यवस्था राज्य का विषय होने और पुलिस के बेशर्म इस्तेमाल पर पीड़ित पक्ष की तरफ से आम तौर पर मांग की जाती है कि उसका मसला सीबीआई को सौंप दिया जाए। यदि साख ही नहीं बची, तो किस विश्वास से लोग सीबीआई के पास जाएंगे? 1940 के दशक में विश्व युद्धों के परिप्रेक्ष्य में सरकारी विभागों में व्याप्त भ्रष्टाचार से निपटने के लिए दिल्ली स्पेशल पुलिस इस्टैब्लिश्मेंट के रूप में स्थापित और 1960 के दशक में सीबीआई बनने से लेकर आज तक के सफर में इस संस्था ने बड़े उतार-चढ़ाव झेले हैं, पर इस बार जैसा संकट इसके समक्ष आया है, वह अभूतपूर्व है। यह साख का संकट है और दुर्भाग्य से इसे उसके अपनों ने पैदा किया है।

Elusive Employment

The comatose state of the job market is worrying. It could impact the general election more than the promise of quotas

Even as governments, including the current one at the Centre, want more and more sections of society to benefit from reservations in public sector jobs, the truth is the size of the cake itself is becoming smaller. As a report in this newspaper has shown, annual Central government recruitment (including in the Railways) has fallen from 1,13,524 to 1,00,933 between 2014-15 and 2016-17. The same period has also seen the outstanding workforce shrink from 16.91 lakh to 15.23 lakh in Central public sector undertakings, and from 9.47 lakh to 8.97 lakh in public sector banks (including regional rural banks). It raises the obvious question: Do quotas, whether based on social or economic backwardness, have any meaning today when the government and its various departmental/non-departmental enterprises are themselves hardly generating any new employment?

Isn’t the latest 10 per cent reservation for economically weaker sections not falling under the Scheduled Castes, Scheduled Tribes and Other Backward Classes categories — which already having a combined 49.5 per cent quota — then just a tall promise? The answer to this is both yes and no. In a liberalised economy, the responsibility for creation of jobs is and should be with the private sector. The government’s job, so to speak, should be to create an environment that not only facilitates employment generation, but also create jobs that are productive and reasonably well-paying. That requires removing “regulatory cholesterol”, which comes in the way of firms hiring workers on formal, even if fixed-time employment, contracts. India needs a third such wave of formalised employment — the first was in the public sector during the post-Independence period till the 1980s and the second via the IT industry in the first two post-reform decades — in sectors such as manufacturing, agro-processing, construction, logistics, healthcare, tourism and other high-value services.

Where reservations have a role is in preparing job-seekers. The country is short of, both in quantity and quality terms, higher educational institutions offering professional courses. The enrolment numbers in the private sector is over thrice that in government institutions. There is a good case to expand seats in the latter — which are more affordable to the sections that are also deserving of reservations — while simultaneously upgrading the quality of courses and teaching standards to equip the future labour force-cum-job creators. The immediate worry, though, is neither government jobs nor reservations, but the comatose state of the overall job market itself. According to Centre for Monitoring Indian Economy, the country’s total number of employed persons fell from 407.9 million in December 2017 to 397 million in December 2018, with the salaried job losses alone for this period estimated at 3.7 million. And that could have more implications for the coming elections than the promise or chimera of quotas.

Science and reason in India

The history of science in India must be treated as a serious subject rather than a matter of speculation
Another edition of the Indian Science Congress, another gift to the news cycle. The Congress, which is meant to be a premier forum for scientists to present and discuss their research, has in recent years become the stage for a series of blissfully evidence-free claims about Indian achievements in science through the ages. Added to the list in this year’s edition (January 3-7, in Jalandhar, Punjab), were claims about the existence of stem cell technology, test-tube babies, and fleets of aircraft in ancient India and Sri Lanka. The reaction was reassuringly swift. The organisers distanced themselves from the claims, prominent scientists denounced them, and protest marches were taken out.

We should, however, be asking a more fundamental question. What motivates speakers to say these things? If, as seems plausible in many cases, it is wilful demagoguery or an attempt to curry political favour, it is irresponsible and deplorable. But let us be charitable and assume for a moment that those who make these statements actually believe them. At the very least, it is clear that there exists a sizeable constituency which wants to believe such claims. What does this tell us about our relationship — as Indians — to science and to history?

Rooted in colonialism

A glance at the past confirms that this is a deep-seated anxiety rooted in the experience of being colonised. In his presidential address to the Institution of Engineers (India) in the early 1930s, Jwala Prasad, a top irrigation engineer in the United Provinces, referred to ‘the construction of the famous bridge over the sea at Cape Comorin’ and ‘the cutting of the Gangotri from a wonderful glacier through disinfecting rocks and land by [Rama’s] ancestor Bhagirath, before men knew how to dig a well.’ Prasad’s statements (unsupported as they were) may be read as a defiant assertion at a time when colonial stereotypes of Indians as unscientific were still prevalent. They were also made in the context of a time when Indian engineers were fighting to be recognised as competent members of a profession hitherto dominated by expatriate Britons.

Other Indian scientists went further, undertaking a serious study of the past. Indeed, historians have shown how the colonial encounter prompted among Indian intellectuals a project of ‘revivalism’, a quest to show that Indian traditions were not devoid of rationality, objectivity, and other characteristics of modern science. The pioneering chemist and industrialist P.C. Ray (who presided over the Indian Science Congress in 1920) wrote a two-volume History of Hindu Chemistry (1902, 1908), while the philosopher Brajendranath Seal contributed a study titled The Positive Sciences of the Ancient Hindus (1915). Although they were criticised at the time, both went through the hard slog of examining primary sources and were careful in the conclusions they drew.

Ray studied 14th century texts such as the Rasa prakasha-sudhakara, noting that they were based on experiment and observation. Seal (as quoted by historian David Arnold) cautioned that while the sages of antiquity may have had ideas compatible with the atomic theory of matter, they had depended upon a ‘felicitous intuition [resulting from] intense meditation and guided by intelligent observation’. This was a step removed from the modern scientific method, which relied on sophisticated experiments.

Stop the labels

More than a century later, there is little reason for us Indians to harbour an inferiority complex, and no excuse for tackling it through rash and unfounded claims. Science has never developed exclusively within national boundaries. Recent research speaks of the ‘circulation’ of scientific ideas, practices, instruments and personnel across regions and continents in different periods of history, while acknowledging that there were unequal power relations between those regions. What we often call ‘western’ science builds on the contributions of scientists from all over the world today, and draws upon sources ranging from the ancient Greeks to the West Asian civilisations of a millennium ago. Once we rid ourselves of the need to label science as western or eastern and shake off the obsession with priority (i.e. which society was the first to discover or invent something), we will liberate ourselves to think about the further development, practice, and application of science.

None of this should imply that exploring the history of science in ancient, medieval and non-European contexts is not worthwhile or legitimate. The solution is not to shut our eyes to the past but to engage in careful historical inquiry. This involves an emphasis on primary sources, on learning the relevant languages and preparing critical editions of texts, on peer review, and on viewing the past on its own terms, avoiding the pitfalls of what historians call ‘present-centredness’. It involves working with the insights of archaeologists, epigraphists, Sanskritists, Persianists, and metallurgists. It requires an open mind and a healthy scepticism. Such works have been undertaken, but many more are needed. The history of science, thus far woefully neglected in Indian institutions and university programmes, must be treated as a serious subject rather than a matter of speculation.

As for the Indian Science Congress, a venerable institution, measures are already being discussed to restore to it a sense of gravitas. One hopes they will succeed. For those who make motivated claims not only tarnish the institution’s reputation but also take the focus away from the legitimate efforts of other delegates. A body which has among its past presidents such personages as Ashutosh Mukherjee, M. Visvesvaraya, C.V. Raman, Birbal Sahni and M.S. Swaminathan surely deserves better.

Sedition, once more

Invoking it against those opposed to changes in citizenship law is reprehensible

The slapping of sedition charges against noted Assamese scholar Hiren Gohain and two others for remarks made against the proposed citizenship law is a textbook case of misuse of the law relating to sedition. The FIR against Mr. Gohain, peasant rights activist Akhil Gogoi and journalist Manjit Mahanta relates to speeches at a recent rally that alluded to the possibility of a demand for independence and sovereignty if the Citizenship (Amendment) Bill was pushed through Parliament. Mr. Gohain and others have obtained interim bail from the Gauhati High Court. The registration of the case has caused much public outrage in Assam. In addition to Section 124A (sedition), they have been accused of entering into a criminal conspiracy to “wage war against the government of India” (Section 121) and “concealing a design to facilitate” such a war (Section 123).

The action of the police in charging them with “offences against the state” under the Indian Penal Code is quite reprehensible. It is possible that speeches at the rally organised by the Forum Against the Citizenship Amendment Bill contained strident opposition to the legislative changes that would allow persecuted non-Muslims from three neighbouring countries to obtain Indian citizenship. The thrust of the protest, therefore, would be squarely covered by the exception to the sedition clause, which says comments expressing disapprobation of government measures with a view to obtaining their alteration do not constitute an offence, as long as there is no incitement to violence or disaffection. Mr. Gohain, a Sahitya Akademi awardee, and one of Assam’s best known public intellectuals, has explained that he had intervened more than once to silence some youth who had talked about invoking their sovereignty if the Centre continued to ignore their demand.

In recent years, there have been many instances of State governments seeking to silence political dissent by accusing dissenters of promoting disaffection. It is precisely to prevent such a heavy-handed response to strident political criticism that courts have often pointed out that the essential ingredient of any offence of sedition is an imminent threat to public order. Unless there is actual incitement to take up arms or resort to violence, even demands that go against the legal or constitutional scheme of things would not amount to sedition. Mere expression of critical views, howsoever scathing, cannot be an excuse for accusing someone of planning to wage war or promote disaffection against the government. It is against such a backdrop that the Law Commission, in a consultation paper released last year, had called for a reconsideration of the sedition section in the IPC. While the provision, which is couched in broad terms, needs a much narrower definition, the right course is to scrap Section 124A, a relic of the colonial era, altogether.
