The Missing Middle

Thinking beyond poverty reduction

A UN report has highlighted how the population in India living in multidimensional poverty has almost halved from 55.1% to 27.9% between 2005-2006 and 2015-16, uplifting as many as 271 million people. Note that the measurement here is not focused on food but living standards – so it reflects an improvement in dimensions like cooking fuel and sanitation as well. India also enjoyed high economic growth in this period. The lesson here is that stronger growth reduces poverty at a faster pace. Moreover, continued growth momentum is needed to move the people lifted out of poverty into the middle class. Else people recently lifted out of poverty could fall back into poverty again, for reasons ranging from macro-economic shocks to health crises within the family.

While poverty alleviation attracts much political capital and policy focus, middle India has been neglected by successive governments. Too little is being done to grow their number. More than 90% of workers continue to be employed in the informal sector. The direct fallout of rigid labour laws and other barriers against expanding small businesses into large ones, is that the great swell of middle class jobs that prosperously moved agricultural workers into largescale manufacturing in China and east Asia still hasn’t hit our shores. One hopes we’re not waiting for Godot here.

Many Indians who are classified as middle class belong there precariously. The same is the case with many of those lifted out of poverty. As long as jobs and educational opportunities remain scarce, sliding back remains an imminent danger. The only solution is unshackling Indian enterprise, with a forceful pro-growth, pro-trade policy focus. This week the cricket World Cup vividly illustrated to India how much a crumbly middle order can hurt. It must be shored up strongly. Hit a six on reforms.

पाबंदियों को आज़ादियों की दरकार और हमारा कानून

यह देश जिसने धार्मिक सद्भाव को अपने संविधान में जगह दी है, वहां महिलाओं की पुरुषों के साथ मस्जिदों में एंट्री से जुड़ी एक हिंदू की याचिका को सुप्रीम कोर्ट ने यह कहते हुए खारिज कर दिया है कि यदि कोई मुसलमान इसकी मांग करेगा तो ही सुनवाई होगी। धर्म पर राजनीति करने का खास शगल रखने वाला हमारा देश आज़ादी के 72 सालों बाद भी यदि औरतों के लिए हक की मांग कर रहा है तो वह है मस्जिद-मंदिरों में जाने की। मस्जिद में जाने की याचिका लगाने वाले कोई और नहीं बल्कि केरल हिंदू महासभा के लोग हैं। वही केरल जहां सबरीमाला में महिलाओं के आने का विरोध हिंदू ही कर रहे थे। वैसे, देखा जाए तो अभी सबरीमाला का विवाद बस थमा ही है, सुलझा नहीं। मंदिर दोबारा खुलते ही विवादों की फाइल भी फिर खुल जाएगी। फिर कोई महिला मंदिर में घुसने की कोशिश करेगी। फिर कोई उसे रोकेगा। अफसोसजनक तो यह है कि जो महिला सबरीमाला में दर्शन कर पाई, अब उसे अपने परिवार से बेदखल कर दिया गया है। उसे जान से मारने की धमकियां मिली हैं और वह किसी शेल्टर होम में रहने को मजबूर है। हमारे देश में यह सब उसी दौरान हो रहा है, जब हज पर इस साल पहली बार 2000 से ज्यादा महिलाएं बिना किसी पुरुष रिश्तेदार के जा रही हैं। गौरतलब है कि इसी साल अकेली महिलाओं के हज पर जाने पर लगे बैन को हटाया गया है। अब तक महिलाएं किसी पुरुष रिश्तेदार के साथ ही हज पर जा पाती थीं। यह वह देश है जो हज पर अकेले जाने की पाबंदियों को हटाने पर खुश हो जाता है, जबकि ट्रिपल तलाक का मामला उठे तो अभी तक संसद में हंगामा ही होता है। क्यों देश में महिलाओं के विकास की जगह धर्म के मामलों में ही उनके हक-हुकूक अहम माने जाते हैं। क्यों नहीं हम इस बात पर ध्यान देते हैं कि देश की महिलाओं को धार्मिक हक से पहले उसके स्वास्थ्य से जुड़े हक मिलने चाहिए, संघर्ष पहले उन्हें भरपूर पोषण और बेहतर इलाज के लिए होना चाहिए। धार्मिक आजादी थोड़ी कम भी मिली तो क्या, लेकिन स्वास्थ्य सुविधाएं कम मिलने से उसकी जान को खतरा है। यह हमारी राजनीति कब समझेगी? वरना हमारा ही देश है जहां नुसरत ने मांग भरी और मंगलसूत्र पहन लिया तो मसला बन गया। राजनीति की कहानियां इसी सिंदूर जैसे लाल रंग से कही जाने लगीं, गुस्से और वैमनस्य से लबरेज।

बजट महिलाओं की उम्मीदों पर कितना खरा ?

महिला वित्तमंत्री के ‘नारी तू नारायणी’ बजट में महिला श्रमशक्ति की भागीदारी पर बात तक नहीं

भारत की पहली पूर्णकालिक महिला वित्त मंत्री निर्मला सीतारमण ने बजट पेश किया इसलिए उम्मीदें काफी ज्यादा थीं। यह बजट दो कारणों से महत्वपूर्ण था। पहला यह कि नरेंद्र मोदी सरकार को शानदार जनादेश मिला और दोबारा चुने जाने के बाद यह पहला बड़ा नीतिगत कार्य था। इस जनादेश ने सरकार को भारतीय अर्थव्यवस्था को मजबूत करने के लिए कुछ सुधार करने का अभूतपूर्व अवसर दिया। दूसरा, यह बजट बहुत कठिन परिस्थितियों में प्रस्तुत किया गया था- अर्थव्यवस्था काफी धीमी, बेरोजगारी की दर काफी अधिक, भारत की ग्रामीण अर्थव्यवस्था, विशेष रूप से कृषि आय में संकुचन हो रहा है और इसके साथ ही पेयजल समस्या भी एक बड़ी चुनौती के रूप में उभरी है।

ये सभी मुद्दे महिलाओं को प्रभावित करते हैं। बढ़ती बेरोजगारी से देश की महिलाएं काफी प्रभावित हुई हैं। हाल ही के कुछ बरसो में लेबर फोर्स में महिलाओं की भागीदारी तेजी से घटी है। अजीम प्रेमजी विश्वविद्यालय के शोधकर्ताओं ने पाया है कि लेबर फोर्स में केवल 18% महिलाएं हैं जबकि 2011-12 में 25% थीं। विश्व बैंक की एक हालिया रिपोर्ट में महिला श्रम शक्ति भागीदारी दर में भारत 131 देशों में से 121 वें स्थान पर है। साथ ही कई पड़ोसी देशों की तुलना में हमारी लेबर फोर्स में महिलाओं की भागीदारी सबसे कम है। भारत की कृषि अर्थव्यवस्था में संकट का इसमें महत्वपूर्ण योगदान है, क्योंकि यहां काम करने वाली महिलाओं की संख्या ज्यादा रही है। इसके अलावा, जल संकट का महिलाओं पर काफी असर पड़ता है। भारत के मानव विकास सर्वेक्षण के मुताबिक जिन घरों में पानी का कोई स्रोत नहीं है या नल से पानी नहीं पहुंचता, वहां महिलाएं और लड़कियां प्रतिदिन अपने 52 मिनट पानी इकट्ठा करने में खर्च करती हैं, जबकि पुरुष सिर्फ 28 मिनट प्रति दिन। जिस तरह से जल स्रोत सूख रहे हैं इससे भविष्य में महिलाओं को अपना और अधिक समय पानी इकट्ठा करने के लिए देना होगा।

सवाल यह है कि बजट में महिलाओं को क्या मिला? यह इसलिए भी प्रासंगिक हैं, क्योंकि महिला मतदाता भाजपा के लिए एक महत्वपूर्ण वोटबैंक है। इसलिए राजनीतिक रूप से भी यह उम्मीद की जा रही थी कि बजट महिलाओं पर केंद्रित होगा। वित्त मंत्री निर्मला सीतारमण ने ‘नारी तू नारायणी’ शीर्षक के साथ महिला कल्याण के लिए अपने बजट भाषण का एक हिस्सा समर्पित किया। जिसमें स्वामी विवेकानंद द्वारा स्वामी रामकृष्णानंद को भेजे गए एक पत्र का उद्धरण दिया कि महिलाओं की स्थिति में सुधार किए बिना दुनिया में कल्याण की गुंजाइश नहीं है। लेकिन बजट सिर्फ राजनीतिक भाषण नहीं होता। इसमें आवंटन और व्यय का विवरण भी शामिल होता है। अंतरिम बजट में पहले ही विभिन्न योजनाओं के लिए आवंटन कर दिया गया था और अर्थव्यवस्था की ओवरऑल हेल्थ को देखते हुए आवंटित करने के लिए बहुत कम पैसा था। मौजूदा योजनाओं को प्राथमिकता देने पर ध्यान केंद्रित किया गया था, जिनमें से कई को 2018-19 के बजट की तुलना में थोड़ा बढ़ावा मिला, लेकिन कुछ भी महत्वपूर्ण नहीं है। जैसे महिला और बाल विकास मंत्रालय के आवंटन में 17% की वृद्धि करते हुए इसे 29,164.90 करोड़ रुपए कर दिया गया। इसमें से 19,834.37 करोड़ रुपए आंगनवाड़ी सेवाओं के लिए है। इसके पहले के वित्त वर्ष में मंत्रालय के लिए 24,758.62 करोड़ रुपए आवंटित किए गए थे। राष्ट्रीय पोषण मिशन (पोषण अभियान) को 3400 करोड़ रुपए आवंटित किया गया है, जबकि 2018-19 में यह 2990 करोड़ था। प्रधानमंत्री मातृ वंदना योजना को पिछले बार की तुलना में दोगुना यानी 2500 करोड़ रुपए से 1200 करोड़ कर दिया गया।

दिलचस्प बात यह है कि 2019 के चुनाव अभियान के दौरान भाजपा द्वारा संदर्भित योजना बेटी बचाओ बेटी पढ़ाओ के आवंटन में कोई बदलाव नहीं किया गया और पिछली बार की तरह 280 करोड़ रुपए ही दिए गए। हालांकि सरकार को महिलाओं के लिए आवंटन में वृद्धि नहीं करने को नजरअंदाज किया जा सकता है, लेकिन सभी को नल से पानी उपलब्ध कराने के लक्ष्य के साथ जल शक्ति विजन शुरू करने के लिए तारीफ की जानी चाहिए। हालांकि, मौजूदा परिस्थितियों को देखते हुए महिला श्रम शक्ति की भागीदारी की कठिन चुनौती से निपटने के लिए एक रोडमैप जैसी महत्वपूर्ण चीज इस बजट से गायब थी। वास्तव में अधिक व्यापक रूप से नौकरियों और कृषि सुधारों के मुद्दे को बड़े पैमाने पर अनसुना कर दिया गया और यहीं पर बजट सबसे ज्यादा निराशाजनक रहा। महिलाओं के लिए बनी उज्ज्वला योजना पर बहुत जोर दिया गया है। माना जाता है कि इसकी लोकप्रियता भाजपा की चुनावी सफलता का एक महत्वपूर्ण कारण थी। हालांकि, अध्ययन बताते हैं कि नए उपयोग को प्रोत्साहित करना एक कठिन काम है। जलाऊ लकड़ी और गोबर के उपले काफी आसानी और सस्ते दाम में मिल जाते हैं, साथ ही पारंपरिक स्वाद को चूल्हों पर पके हुए भोजन से जोड़ा जाता है। आरआईसीई संस्थान के एक अध्ययन में पाया गया कि ग्रामीण बिहार, मध्य प्रदेश, उत्तर प्रदेश और राजस्थान में सर्वेक्षण में शामिल 85% उज्ज्वला योजना लाभार्थियों ने चूल्हों का उपयोग करना जारी रखा। यहां एलपीजी को उपयोग में लाने में कुछ बड़ी रुकावटें हैं जैसे इन्हें भराने के लिए पैसों की किल्लत, भारी सिलेंडर को खराब सड़कों पर एक जगह से दूसरी जगह तक ले जाने के लिए परिवहन की समस्या, सामाजिक-आर्थिक पहलू, जैसे कि महिलाएं ईंधन के लिए बायोमास इकट्ठा करती हैं और साथ ही घर के प्राथमिक निर्णय लेने का अधिकार उनके पास नहीं होता हैैं। अगर सरकार उज्ज्वला के निर्धारित लक्ष्यों को प्राप्त करना चाहती है, तो वास्तविक उपयोग के लिए एलपीजी की डिलीवरी पर ध्यान केंद्रित करना होगा।

वित्तमंत्री के बजट भाषण में इन बातों को शामिल नहीं किया गया था। महिलाओं के मुद्दों के दृष्टिकोण से, बजट 2019 एक मिश्रित बैग था। इसमें राजनीतिक संदेश महत्वपूर्ण था, महिलाओं से संबंधित योजनाएं प्राथमिकता रही, लेकिन महिला श्रम शक्ति की भागीदारी और एलपीजी सिलेंडरों के उपयोग से जुड़ी कठिन चुनौतियों पर कोई बात नहीं हुई। मेरे आकलन में यह एक औसत प्रदर्शन था!

सरकार के तीनों अंगों में संतुलन जरूरी

न्यायपालिका की स्वतंत्रता का मुद्दा रह-रहकर चर्चा में आता रहता है। संविधान में शतियों के पृथकरण के एक अनोखे स्वरूप की परिकल्पना की गई है। सरकार के तीनों अंगों- विधायिका, कार्यपालिका एवं न्यायपालिका के स्वतंत्र अस्तित्व एवं उनकी स्वतंत्र कार्यशैली पर ही पृथकरण सिद्धांत आधारित है। संविधान इन तीनों के बीच एक विशेष अंतरसंबंध को रेखांकित करता है।

हमारे संविधान का मूल ढांचा ब्रिटेन की तर्ज पर है, जबकि पृथकरण का सिद्धांत अमेरिकी प्रणाली से लिया गया है। इन तीनों अंगों के बीच आपसी नियंत्रण एवं संतुलन का सिद्धांत भी लागू किया गया है। इसके तहत कार्यपालिका विधायिका के प्रति पूर्ण रूप से जिम्मेदार होती है। वहीं ‘राज्य के नीति के निर्देशक तत्वों’ के तहत अनुच्छेद 50 के अनुसार न्यायपालिका को कार्यपालिका से पृथक रखने की व्यवस्था की गई है। न्यायपालिका की स्वतंत्रता के सिद्धांत का उद्गम स्थल संविधान में यहीं से है। फिर अनुच्छेद 137 के द्वारा न्यायिक पुनरावलोकन के सिद्धांत को स्थापित किया गया है जिसके तहत विधायिका और कार्यपालिका के किसी निर्णय अथवा आदेश की न्यायिक समीक्षा का अधिकार न्यायपालिका को है। तीनों अंगों के बीच इस अनोखे अंतरसंबंधों के मूल रचनाकार संविधान सभा के संवैधानिक सलाहकार बीएन राव थे। वह नौकरशाह एवं न्यायविद थे। विभिन्न समितियों के प्रतिवेदनों का अध्ययन कर उन्होंने अमेरिका, कनाडा, ब्रिटेन, आयरलैंड इत्यादि देशों का दौरा भी किया। वहां के संविधानों के अध्ययन के साथ न्यायविदों से विमर्श किया। इसमें संविधान सभा सचिवालय के संयुत सचिव एसएन मुखर्जी का नाम भी उल्लेखनीय है, जिन्होंने संविधान के प्रारूप लेखन का काम मूल रूप से किया था। डॉ.भीमराव आंबेडकर के नेतृत्व वाली प्रारूप समिति ने संविधान के जिस प्रारूप पर विमर्श किया था उसका स्वरूप राव ने तय किया था और लेखन मुखर्जी ने किया था। समिति ने व्यापक-विचार विमर्श कर आवश्यक संशोधनों के साथ उसे अंतिम रूप दिया जिसे डॉ. राजेंद्र प्रसाद की अध्यक्षता में संविधान सभा ने स्वीकृत एवं अंगीकृत किया। डॉ. प्रसाद के मुताबिक राव ही ऐसे व्यति थे जिन्होंने संविधान निर्माण योजना की परिकल्पना की एवं इसकी आधारशिला रखी। डॉ. आंबेडकर ने इन दोनों को भारतीय संविधान एवं भारत की प्रजातांत्रिक यात्रा का मुय शिल्पकार बताया और कहा कि इनके बिना संविधान को अंतिम रूप देने में न जाने कितने वर्ष और लग जाते।

संविधान में न्यायपालिका की स्वतंत्रता का आशय उसकी स्वतंत्र, अप्रभावित एवं निष्पक्ष दबावमुत कार्यशैली से है। लगता है कि संविधान निर्माताओं को ऐसी आशंका थी कि विधायिका अथवा कार्यपालिका के द्वारा इसके अधिकारों के अतिक्रमण या उसे प्रभावित करने की कोशिश हो सकती है। ऐसी स्थिति का प्रभावकारी ढंग से निषेध किया गया एवं न्यायपालिका को ऐसे विकारों से सुरक्षा प्रदान की गई। साथ ही इसे न्यायिक पुनरावलोकन का अधिकार देकर दूसरे अंगों
द्वारा नियमित पथ से विचलित होने पर उसे रोकने का अधिकार भी न्यायपालिका को दिया गया।

दूसरी तरफ संविधान का पहला तात्विक शब्द ‘संप्रभु यानी संपूर्ण प्रभुत्व संपन्न’ है। संविधान की उद्देशिका में भारत को एक संप्रभु राष्ट्र बनाना संविधान का उद्देश्य बताया गया है। विचारणीय है कि संप्रभु राष्ट्र के रूप में भारत की संप्रभुता कहां निवास करती है? संसदीय जनतांत्रिक प्रणाली में संप्रभुता निर्विवादित रूप से जनता में निहित है जो अपने द्वारा चुने गए प्रतिनिधियों के माध्यम से इसका उपयोग करती है। संविधान में जिस ‘राज्य’ की परिकल्पना है उसका प्रतिनिधित्व कौन करता है? जैसे अनुच्छेद 50 कहता है कि राज्य की लोकसेवाओं में न्यायपालिका को कार्यपालिका से पृथक करने के लिए राज्य कदम उठाएगा। इसमें वर्णित ‘राज्य’ से या आशय है? दरअसल जनता द्वारा निर्वाचित विधायिका में ही यह प्रत्यक्ष-अप्रत्यक्ष रूप से निहित हो सकता है।

संविधान सर्वाधिक महत्वपूर्ण और उच्चतर कानूनों का संग्रह है। न्यायपालिका को इन कानूनों की रक्षा करने एवं इनके अंतिम निर्वचन का अधिकार है। संविधान सभा का गठन 1937 में हुए विभिन्न प्रांतीय विधानसभाओं के चुने हुए जनप्रतिनिधियों द्वारा निर्वाचन के आधार पर किया गया था। स्पष्ट है कि जनता के द्वारा चुने हुए प्रतिनिधियों द्वारा ही संविधान का निर्माण हुआ है। संविधान सभा एवं विधायिका के अंतरसंबंध को इससे समझा जा सकता है कि संविधान के निर्माण के पश्चात संविधान सभा ही देश की पहली विधायिका (संसद) बन गई थी।

न्यायिक स्वतंत्रता भारतीय जनतंत्र की रीढ़ है और समय-समय पर न्यायपालिका ने ऐतिहासिक निर्णयों के माध्यम से जनतांत्रिक प्रणाली को दूषित एवं विचलित होने से बचाया है। न्यायिक हस्तक्षेप के कारण अनेक भ्रष्टाचार के मामले उजागर हुए और शासन व्यवस्था को दुरुस्त रखने में सहायक सिद्ध हुए, परंतु धीरे-धीरे न्यायिक स्वतंत्रता परिणत होकर न्यायिक सक्रियता का रूप ले चुकी है और न्यायिक पुनरावलोकन अब न्यायिक सर्वोच्चता एवं श्रेष्ठता के रूप में परिभाषित हो रहा है।

न्यायिक सक्रियता के तहत किसी दूसरे अंग यथा विधायिका या कार्यपालिका के कार्य में हस्तक्षेप करना न्यायिक स्वतंत्रता का मकसद नहीं हो सकता है। न्यायिक स्वतंत्रता सर्वस्वीकार्य है, परंतु विधायिका अथवा कार्यपालिका की मर्यादा का हनन करके प्रजातंत्र मजबूत नहीं हो सकता है। संविधान सभा ने न्यायपालिका के अधिकारों को रेखांकित करते समय इसके प्रति पूरी सजगता दिखाई थी। विधायिका और कार्यपालिका न्यायपालिका की स्वतंत्रता का आदर करती हैं। इसी प्रकार ‘संप्रभुता’ एवं ‘राज्य’ के प्रतीक विधायिका एवं उसकी मर्यादा का सम्मान भी उतना ही आवश्यक है। भारतीय प्रजातंत्र की सफलता के लिए सरकार के तीनों अंगों को एक-दूसरे के प्रति समान भाव रखते हुए संतुलन बनाए रखना होगा तभी अधिकतम जनहित सधेगा एवं प्रजातंत्र का भविष्य उज्ज्वल होगा। हमारे संविधान निर्माताओं का सपना भी यही था।

बच्चों की सुरक्षा

केंद्रिय मंत्रिमंडल द्वारा बाल यौन अपराध संरक्षण (पॉक्सो) कानून में संशोधन किया जाना काफी महत्त्वपूर्ण है। जिस ढंग से बाल यौनाचार की भयावह घटनाएं सामने आ रही हैं उनको देखते हुए कड़े कानून की आवश्यकता महसूस की जा रही थी। पोर्न साइटों पर बच्चों के साथ यौनाचार के वीभत्स दृश्यों ने दुनिया भर में विकृतियां बढ़ाई हैं। भारत भी इसका शिकार हुआ है। ऐसे मामले तेजी से बढ़े हैं। कुछ धनपतियों और प्रभावी लोगों द्वारा अपनी मानिसक कुंठा मिटाने के लिए बच्चों के साथ अजीबोगरीब तरीके के यौनाचार करने की बातें भी सामने आ रहीं हैं। बेचारा कमजोर बालक यौन उत्पीड़नों के सारे कष्टों को सहने के अलावा कर ही क्या सकता है। किंतु सरकार और समाज को तो इसके खिलाफ सामने आना ही होगा। वैसे तो पहले से इसके खिलाफ कानून हैं पर वे बदले यौन विकृति के माहौल में कमजोर पड़ रहे हैं।

इसलिए मोदी सरकार का बाल यौन अपराध संरक्षण (पॉक्सो) कानून को कड़ा करने के लिए संशोधनों को मंजूरी दिया जाना सही दिशा में किया जा रहा प्रयास है। प्रस्तावित संशोधनों में बच्चों का गंभीर यौन उत्पीड़न करने वालों को मृत्युदंड और नाबालिगों के खिलाफ अन्य अपराधों के लिए कठोर सजा का प्रावधान किया गया है। इसमें बाल पोनरेग्राफी पर लगाम लगाने के लिए सजा और जुर्माने का भी प्रावधान शामिल है। इसमें पोक्सो की 10 धाराओं को संशोधित किया गया है। इसे संसद की मंजूरी मिलनी शेष है। कड़ा कानून ऐसे यौन अपराधियों के लिए भय निवारक की भूमिका निभाएगा। हालांकि केवल कानून पर्याप्त नहीं हैं। इसके साथ पुलिस एवं प्रशासन के साथ समाज को भी सक्रिय भूमिका निभानी होगी। बच्चों को किसी तरह फंसा कर लाया जाता है और इसमें कई जगह गिरोहों के सक्रिय होने की भी घटनाएं सामने आई हैं। पूरे समाज का दायित्व परेशानी में फंसे असुरक्षित बच्चों को बचाना और उनकी सुरक्षा व गरिमा सुनिश्चित करना है। सभी को अपना दायित्व समझना होगा। कहीं भी बच्चे यदि संदेहास्पद परिस्थितियों में दिखें तो पुलिस को त्वरित कार्रवाई करनी चाहिए। हमें भी कहीं बच्चे परेशानी में दिखाई पड़ें तो आगे आना चाहिए और पुलिस को सूचना देनी चाहिए। बच्चे देश के भविष्य हैं। इस भविष्य को अपनी यौन कुंठा के लिए उपयोग करने वाले और उनको इसमें सहयोग देने वाले समाज के दुश्मन हैं। असल में मनुष्य के रूप में ये सब राक्षस हैं। इनके साथ कुछ भी किया जाए वह कम है।

उत्पीड़न के विरुद्ध

बाल यौन उत्पीड़न रोकने संबंधी पाक्सो कानून को और कठोर बनाने की केंद्रीय मंत्रिमंडल की मंजूरी से सुरक्षित बचपन की एक नई उम्मीद जगी है। पिछले कुछ सालों से नाबालिगों के साथ यौन उत्पीड़न और हिंसा की घटनाएं लगातार बढ़ी हैं। इसी के मद्देनजर सरकार ने यह फैसला किया है। प्रस्तावित संशोधनों में बच्चों का गंभीर यौन शोषण करने वालों को मृत्युदंड और नाबालिगों के खिलाफ अन्य अपराधों के लिए कठोर सजा का प्रावधान किया गया है। हालांकि दिल्ली में हुए निर्भया कांड के बाद यौन उत्पीड़न संबंधी कानूनों को काफी कठोर किया गया था। तब माना गया था कि इससे आपराधिक वृत्ति के लोगों में भय पैदा होगा और यौन हिंसा की घटनाओं में काफी कमी आएगी। मगर ऐसा नहीं हुआ। बल्कि उसके बाद से कम उम्र की बच्चियों के यौन उत्पीड़न और उनकी हत्या की घटनाएं बढ़ी हैं। इसलिए मांग की जा रही थी कि पाक्सो कानून को और कठोर बनाया जाए। जघन्य यौन अपराधों में मौत की सजा का भी प्रावधान किया जाए। इसलिए प्रस्तावित संशोधनों के बाद माना जा रहा है कि ऐसी घटनाओं पर काफी हद तक लगाम लगेगी। मगर देखने की बात है कि इन कानूनों पर अमल कराने वाला तंत्र कितनी मुस्तैदी दिखा पाता है।

बाल यौन उत्पीड़न की कुछ वजहें साफ हैं। एक तो यह कि बच्चों को बहला-फुसला या डरा-धमका कर कहीं ले जाना और फिर उनका यौन उत्पीड़न करना अपेक्षाकृत आसान होता है। छोटे बच्चे या बच्चियां कई बार ऐसा करने वालों को ठीक से पहचान नहीं पातीं, जिससे पुलिस को सबूत जुटाने में दिक्कत आती है। फिर कड़े कानूनों के बावजूद ऐसी हरकतें करने वालों के मन में भय इसलिए नहीं पैदा हो पा रहा कि बलात्कार जैसे मामलों में सजा की दर काफी कम है। इसके अलावा आजकल इंटरनेट पर खुलेआम यौनाचार की तस्वीरें उपलब्ध हैं। हर किसी के हाथ में मोबाइल फोन आ जाने से बहुत सारे लोग ऐसी तस्वीरें देखते रहते हैं। कई लोग ऐसी तस्वीरें साझा भी करते हैं, जिन्हें देख कर अनेक लोग बलात्कार आदि के लिए प्रवृत्त होते हैं। जब उन्हें किसी तरह की मुसीबत में फंसने का अंदेशा नजर आता है, तो पीड़ित या पीड़िता की हत्या तक कर देने में संकोच नहीं करते। इसलिए पाक्सो कानून में प्रस्तावित संशोधनों में अश्लील तस्वीरों यानी पोर्न फिल्मों पर भी नियंत्रण करने का प्रावधान किया है। अश्लील तस्वीरों के प्रसारण पर रोक की मांग भी लंबे समय से उठती रही है, मगर कुछ लोग इसे यौन शिक्षा के लिए जरूरी बता कर ऐसा करने का विरोध करते रहे हैं।

कानूनों को कड़ा बनाने के साथ-साथ पुलिस की जवाबदेही भी अनिवार्य है, क्योंकि इसके बिना कानूनों पर अमल सुनिश्चित नहीं कराया जा सकता। बलात्कार जैसी घटनाओं में पुलिस की जांच में देरी होने से कई सबूत नष्ट हो जाते हैं। फिर कई बार रसूखदार लोगों के प्रभाव में आकर भी कई मामले दबा दिए जाते या समझौते से उन्हें रफा-दफा करने का प्रयास किया जाता है। यों कई लोग अपनी बच्चियों के साथ हुई यौन उत्पीड़न की घटनाओं को इज्जत का मामला मान कर खुद चुप्पी साध लेते हैं, पर जो मामले सामने आते हैं वे पुलिस की ढिलाई की वजह से इंसाफ में न बदल पाएं, तो कानूनों का कोई अर्थ नहीं रह जाता। इसलिए उन पक्षों पर भी गंभीरता से ध्यान देने की जरूरत है कि आखिर किस वजह से यौन अपराधियों को दंड नहीं मिल पाता।

Tread with caution

The consolidated codes on labour laws need a thorough vetting and discussion in Parliament

As part of its commitment to simplify and consolidate labour rules and laws under four codes, the Union Cabinet has cleared the Occupational, Safety, Health and Working Conditions Code, a week after it approved the Code on Wages Bill. The latter seeks to include more workers under the purview of minimum wages and proposes a statutory national minimum wage for different geographic regions, to ensure that States will not fix minimum wages below those set by the Centre. These steps should be welcomed. The Code on labour safety and working conditions include regular and mandatory medical examinations for workers, issuing of appointment letters, and framing of rules on women working night shifts. Other codes that await Cabinet approval include the Code on Industrial Relations and the Code on Social Security. Unlike these pending bills, especially the one related to industrial relations that will be scrutinised by labour unions for any changes to worker rights and rules on hiring and dismissal and contract jobs, the two that have been passed should be easier to build a consensus on, in Parliament and in the public sphere. Organised unions have vociferously opposed changes proposed in the Industrial Relations code, especially the proviso to increase the limit for prior government permission for lay-off, retrenchment and closure from 100 workers as it is currently, to 300. The Economic Survey highlighted the effect of labour reforms in Rajasthan, suggesting that the growth rates of firms employing more than 100 workers increased at a higher rate than the rest of the country after labour reforms. But worker organisations claim that the implementation of such stringent labour laws in most States is generally lax. Clearly, a cross-State analysis of labour movement and increase in employment should give a better picture of the impact of these rules.

Simplification and consolidation of labour laws apart, the government must focus on the key issue of job creation. The Periodic Labour Force Survey that was finally made public in late May clearly pointed to the dire situation in job creation in recent years. While the proportion of workers in regular employment has increased, unemployment has reached a 45-year high. The worker participation rate has also declined between surveys held in 2011-12 and 2017-18. The government’s response to this question has either been denial, as was evident after the draft PLFS report was leaked last year, or silence, after it was finally released. In such a situation, the government should be better off building a broader consensus on any major rule changes to existing worker rights rather than rushing through them for the sake of simplification. The consolidated code bills should be thoroughly discussed in Parliament and also with labour unions before being enacted.

A welcome debate on electoral reforms

A number of practical and constructive proposals were raised by Opposition parties in Parliament last week

On July 3, a short-duration discussion in the Rajya Sabha on electoral reforms attracted my attention. It was initiated by Trinamool Congress (TMC) MP Derek O’Brien, with the backing of as many as 14 Opposition parties. I have been extremely passionate and vocal about the issue throughout my years in office as well as after, and it was heartening to see political parties across the ideological divide trying to push the subject of how to make elections freer, fairer and more representative.

The TMC MP touched on six major themes — appointment system for Election Commissioners and Chief Election Commissioner (CEC); money power; Electronic Voting Machines (EVMs); the idea of simultaneous elections; the role social media (which he called “cheat India platforms”); and lastly, the use of government data and surrogate advertisements to target certain sections of voters.

Appointment process

On the issue of appointments of Election Commissioners, Mr. O’Brien quoted B.R. Ambedkar’s statement to the Constituent Assembly that “the tenure can’t be made a fixed and secure tenure if there is no provision in the Constitution to prevent a fool or a naive or a person who is likely to be under the thumb of the executive.”

The demand for revisiting the issue was supported by the Communist Party of India (CPI); the Communist Party of India-Marxist (CPI-M); the Dravida Munnetra Kazhagam (DMK) and the Bahujan Samaj Party (BSP), all of whom demanded the introduction of a collegium system. As regards the chronic problem of the crippling influence of money power, Mr. O’Brien spoke about various reports and documents — a 1962 private member’s Bill by Atal Bihari Vajpayee; the Goswami committee report on electoral reforms (1990); and the Indrajit Gupta committee report on state funding of elections (1998). Congress MP Kapil Sibal, citing an independent think tank report on poll expenditure released in June, discussed at length the regressive impact of amending the Foreign Contribution (Regulation) Act (FCRA) and removing the 7.5% cap on corporate donations.

Congress MP Rajeev Gowda termed electoral bonds “a farce” and gave a proposal for state funding (of political parties) based on either a National Electoral Fund or the number of votes obtained by the respective parties. He also proposed crowdfunding in the form of small donations. He said that the current expenditure cap on candidates is unrealistic and should either be raised or removed to encourage transparency.

The Biju Janata Dal (BJD) supported capping the expenditure of political parties in accordance with a 1975 judgement of the Supreme Court on Section 77 of the Representation of the People Act (RPA), 1951. The Samajwadi Party (SP) suggested that expenditure on private planes etc. should be added to the candidates’ accounts and not to those of the party. Banning of corporate donations was passionately advocated by the CPI and the CPI (M).

The old issue of returning to ballot papers was raised by several parties. The TMC said that “when technology doesn’t guarantee perfection, you have to question technology.” On the other hand, the BJD, the Janata Dal (United) and the Bharatiya Janata Party (BJP) asserted that EVMs have reduced election-related violence in States like Bihar and Uttar Pradesh. The BJD said that to strengthen public faith in Voter-Verified Paper Audit Trails, five machines should be counted right in the beginning. The BSP added that postal ballots should be scanned before counting so as to increase transparency.

On simultaneous elections

Many BJP MPs highlighted issues linked to electoral fatigue, expenditure and governance and also reports of the Law Commission and NITI Aayog to push for simultaneous elections.

Vinay Sahasrabuddhe of the BJP said that Prime Minister Narendra Modi’s proposal should be seen with an open mind and made a suggestion that it should be understood as a call for minimum cycle of elections rather than “one nation one election”.

But the TMC said that the solution lies in consulting constitutional experts and publishing a white paper for more deliberation. Simultaneous elections were vehemently opposed by CPI MP D. Raja, who called them “unconstitutional and unrealistic.” Quoting Ambedkar, he said that accountability should hold precedence over stability. Internal democracy within political parties was also mentioned by a couple of speakers. The BJD suggested that an independent regulator should be mandated to supervise and ensure inner-party democracy.

For improving the representativeness of elections, the demand for proportional representation system was put forth by the DMK, the CPI and the CPI (M). The DMK cited the example of the BSP’s performance in 2014 Lok Sabha elections, when the party got a vote share of nearly 20% in Uttar Pradesh but zero seats. A number of MPs argued for a mixed system, where there was a provision for both First Past the Post and Proportional Representation systems.

The important issue of the “fidelity of electoral rolls” was raised by the YSR Congress Party (YSRCP). The idea of a common electoral roll for all the three tiers of democracy was supported by the BJP and the SP.

For remedying the ‘ruling party advantage’ in elections, SP MP Ram Gopal Yadav made a radical suggestion that all MPs/MLAs should resign six months before elections and a national government should be formed at the Centre. He said States should be ruled by the Governor who would have to follow the binding advice of a three-member High Court advisory board.

Advocacy over the years

I have long been an advocate of a number of these reform recommendations. Some proposals that I have elaborated upon in detail throughout the years include — reducing the number of phases in elections by raising more security forces; depoliticisation of constitutional appointments by appointing Commissioners through a broad-based collegium; state funding of political parties by means of a National Electoral Fund or on the basis of the number of votes obtained; capping the expenditure of political parties; giving the Election Commission of India (ECI) powers to de-register recalcitrant political parties; inclusion of proportional representation system; and revisiting the Information Technology Act, to strengthen social media regulations.

Hence, the parliamentary debate was music to my ears. But Indian politics has been suffering from a wide gap between thought and action. The governments should also rise above their obsession with immediate electoral gains and think of long-term national interests. The TMC MP was right in saying that Parliament must not only urgently “debate and deliberate but also legislate” on electoral reforms. The time has come to find and enact concrete solutions in the national interest. Having heard a number of practical and constructive proposals raised in the Rajya Sabha last week, I remain hopeful that Parliament will take it upon itself to enable the world’s largest democracy to become the world’s greatest.
