Confront The Harsh Reality

The only way we can really help farmers is to take most of them out of farming

Today, we give farmers 2.2 trillion rupees in subsidies on fertiliser, power, crop insurance, seeds, credit, irrigation and a myriad other items. We have a massive programme of procurement of grains at above market prices; we give highly subsidised food grains to 75% of rural population; and we offer guaranteed employment for 100 days to one adult in each rural household. We run schemes that provide houses and LPG connections to rural poor and free primary education and free primary health care to rural households. Finally, substantial resources have been invested in bringing roads, digital connectivity and electricity to rural areas.

Yet, after seven decades of development effort, stories of widespread farmer distress remain a daily feature of our television programmes. Why? It is tempting to hypothesise that since stories of distress capture viewer attention more readily than those emphasising positive achievements, media has a vested interest in focussing on them disproportionately. Given the vastness of India, there is always farmer distress in one or another of its corners, providing fodder for primetime television on a regular basis.

Given the human tendency to generalise from anecdotes, especially when they are presented in visual form, isolated incidents of suffering then get translated into generalised distress across the length and breadth of the nation. In contrast, hard data is costly to collect, difficult to digest and often loses to vivid images offered by specific stories even if they represent an exception rather than the rule. While there is some truth in this hypothesis, in all likelihood, there is enough evidence to suggest that the stories of distress are real. Because India lost nearly four decades following the independence to poorly conceived policies, it remains a relatively low per capita income country. Within this broad scenario, agriculture has seen far slower progress than industry and services.

Over the 65 year period spanning 1951-52 to 2016-17, industry has grown at the annual average rate of 6.1%, services 6.2% and agriculture only 2.9%. The result of this asymmetry in growth rates has been that the share of agriculture in GDP has fallen from a hefty 53.1% in 1950-51 to just 15.2% in 2016-17.

By itself, this decline in share is neither unusual nor a reason for despair. It is an established stylised fact of growth that industry and services grow faster than agriculture with the result that the share of the latter sector in the GDP dwindles as the country grows rich in per capita terms. Today, the share of agriculture in the GDP is tiny in every country that has achieved high per capita income: 2% in South Korea, 1.6% in Taiwan, 1.5% in France, 1% in Japan and the United States, and 0.5% in the United Kingdom. India’s tragedy is that, unlike these countries, it has not achieved a commensurate decline in the share of agriculture in employment. Today, employment share of agriculture stands at 5% in South Korea and Taiwan, 3.5% in Japan, 3% in France, 2% in the United States, and 1% in the United Kingdom. In contrast, the share of agriculture in employment in India remains stubbornly high at around 45%.

As a result, per worker output in agriculture today is just one-third that of the nationwide GDP per worker, which is itself low. On top, a gigantic 68.5% of operational holdings are smaller than one hectare. Per worker output on these tiny holdings is lower than per worker output within agriculture, itself one-third of the GDP per worker. These facts imply that while the government can make improvements on the margin, it can do almost nothing within agriculture to create even a semblance of prosperity among farmers. Marketing reform, even if successfully implemented – and this is a big if – cannot go far. With the low per worker output, the scope for redistribution from a few rich traders to the vast numbers of farmers is quite small.

Increases in productivity cannot go very far either. India is already self-sufficient in food grains. Therefore, any increase in food grain output would pose a marketing challenge. Selling the extra output at home would depress prices while exporting it would attract countervailing duties due to WTO illegal subsidies via the MSP. Diversification is seen as an option. But with fruits and vegetables accounting for just 5% of cultivated area and animal husbandry for just 5% of workforce, even doubling the output of these commodities within a short period would bring benefit to only a small proportion of the farmers while harming many others by sending prices into a tailspin. Processing and exporting the produce may help but only a small fraction of the associated benefit would accrue to farmers.

It is delusional to think that the next farm loan waiver or yet another clever government scheme aimed at farmer welfare would magically turn the situation around. The harsh reality is that with too little output and too many to share it, no solution within agriculture would drastically improve the situation. We need to systematically remove obstacles – many of them erected by past policies – to the exit of the large number of marginal farmers from agriculture. Simultaneously, we must unshackle labour intensive sectors in industry and services to create good jobs for them.

Refuge, Citizenship Sans Denomination

Citizenship Bill does not go the whole hog

The amendment to the Citizenship Act will enable non-Muslim minorities facing persecution in Afghanistan, Bangladesh and Pakistan to acquire legal status in India. This is welcome. However, the amendment fails to take into account that those at risk in these countries are not just religious minorities but also any group that is considered to be at odds with the strain of Islam practised by the state. This needs to be remedied.

The Citizenship Act, 1955, makes illegal immigrants ineligible to apply for Indian citizenship. The current amendment removes this obstacle for Hindus, Sikhs, Buddhists, Jains, Parsis and Christians from Afghanistan, Bangladesh and Pakistan. Even without valid travel documents, their status would cease to be illegal, and they would be eligible for Indian citizenship. However, Indian citizenship is not based on religion. It is in this context that the amendment strikes a discordant note. All Muslims are not treated equally in Afghanistan, Bangladesh and Pakistan. Many sects and sub-sects of Islam, as well as those of a secular bent, face disabilities and persecution in these countries: for example, the Ahmadiyas, treated as apostates in Pakistan, or the likes of Taslima Nasreen. Ahmadiyas cross over illegally for the same reasons that drive out Hindus or Christians. Even after the latest amendment, the Ahmadiyas who enter and stay on in India illegally will be ineligible to apply for Indian citizenship. India cannot foreclosethe citizenship option on the grounds that these victims of persecution are Muslim.

At the same time, it cannot take in just about anyone from these Islamic countries. One option is to create a pathway to citizenship with higher level of checks. As a corollary to this amendment, the government must introduce alegal framework for asylum and a pathway to citizenship for asylum seekers, in compliance with the UN Refugee Convention of 1951. The government could set a higher bar for these asylum seekers who would like Indian citizenship. Such a system would be fair, humane and non discriminatory.

हर बूंद कीमती

केंद्रीय भूजल प्राधिकरण (सीजीडब्ल्यूए) ने जल दोहन को लेकर जो नए दिशानिर्देश जारी किए हैं वे आगामी 1 जून से लागू हो जाएंगे परंतु ऐसा लगता नहीं कि ये नए नियम तेजी से समाप्त हो रहे जल संसाधन की फिजूलखर्ची रोक पाएंगे। ऐसा मानने की वजह यह है कि इन नियमों में कई खामियां मौजूद हैं। पहली बात तो यह कि इनमें सिंचाई के पानी के किफायती और जरूरत के अनुसार इस्तेमाल को सुनिश्चित करने का कोई प्रयास नहीं किया गया है। गौरतलब है कि भूजल निकासी का 90 प्रतिशत हिस्सा सिंचाई के काम में प्रयोग किया जाता है। घरेलू क्षेत्र में इसका 5 फीसदी इस्तेमाल किया जाता है लेकिन उसे भी किसी भी तरह की रोक-टोक से छूट प्रदान की गई है। ऐसे में वह 5 फीसदी जल बचता है जिसका इस्तेमाल औद्योगिक इकाइयों द्वारा किया जाता है। इसी पानी का सावधानीपूर्ण इस्तेमाल सुनिश्चित करने के लिए नियम बनाए जा सकते हैं। परंतु इस क्षेत्र में भी कुछ ऐसे सुचिंतित प्रावधानों को शिथिल किया गया है जो पहले से अस्तित्व में हैं।

कई वाणिज्यिक उपक्रम मसलन पेय पदार्थ और बोतलबंद पेयजल के उद्यम न केवल ढेर सारा पानी लेते हैं बल्कि बहुत बड़ी मात्रा में पानी बरबाद भी करते हैं। कई तरह की औद्योगिक इकाइयों को अनापत्ति प्रमाण पत्र जारी करने का अधिकार अब सीजीडब्ल्यूए के स्थान पर जिलाधिकारियों को सौंप दिया गया है। जल संसाधन की स्थिति को लेकर कोई व्यापक नजरिया न होने के कारण यह माना जा सकता है कि नगर निकाय इसके वाणिज्यिक उपयोग को लेकर शिथिलता बरतेंगे। भारी उपयोगकर्ताओं द्वारा भूजल के रीचार्ज की अनिवार्यता के मौजूदा प्रावधान को भी शिथिल कर दिया गया है। अब वे केवल छत पर जलसंरक्षण करेंगे और उनको बड़े पैमाने पर जमीनी वर्षा जल संरक्षण करने की आवश्यकता से निजात दे दी गई है।

हालांकि नए दिशानिर्देश यह प्रस्ताव रखते हैं कि राज्य सरकार की जल संरक्षण योजनाओं के लिए कोष जुटाने के उद्देश्य से भूजल के इस्तेमाल पर जल संरक्षण शुल्क लगाया जाए। इस बात की कोई गारंटी नहीं है कि ये फंड वास्तव में इसी उद्देश्य में इस्तेमाल किए जाएंगे। इसमें दो राय नहीं है कि जल पर लगने वाले शुल्क को जलदायी स्तर, उद्योग के प्रकार और जल निष्कर्षण की मात्रा से जोड़ा गया है। लेकिन पानी की निकासी को लेकर कोई सीमा नहीं तय किए जाने से यह कदम भी पैसे वाले उपभोक्ताओं द्वारा पानी बरबाद करने की प्रवृत्ति पर कोई अंकुश नहीं लगा पाएगा। इतना ही नहीं, नए नियमों में अज्ञात वजहों से निकाले गए पानी के पुनप्र्रयोग का दायित्व भी समाप्त कर दिया गया है। इस मोर्चे पर शिथिलता की वजह से पानी की अंधाधुंध निकासी हुई है और कई क्षेत्रों में भूजल स्तर चौंकाने वाले स्तर तक गिर गया है। भारत पहले से ही दुनिया में भूजल के प्रयोग के मामले में शीर्ष पर है। हमारे यहां सालाना करीब 253 अरब घन मीटर पानी निकाला जाता है। यह दुनिया भर की वार्षिक जल निकासी के 25 फीसदी के बराबर है।

देश के कुल 6,584 भूजल ब्लॉक में से 1,034 को पहले ही अत्यधिक दोहन वाला घोषित किया जा चुका है। शेष में से 253 ब्लॉक गंभीर और 681 ब्लॉक अद्र्घ गंभीर स्थिति में पहुंच चुके हैं। करीब 96 ब्लॉकों में तो केवल खारा पानी ही है जिसका बहुत अधिक इस्तेमाल नहीं किया जा सकता है। इन क्षेत्रों में पानी के इस्तेमाल को सालाना रीचार्ज की तुलना में नीचे स्तर पर रखने की आवश्यकता है। रीचार्ज के लिए प्राकृतिक और कृत्रिम दोनों तरीके इस्तेमाल किये जा सकते हैं। इन हालात में जल संसाधन की अत्यधिक देखरेख की आवश्यकता है। साथ ही वर्षा जल से इसे दोबारा भरने को भी प्रोत्साहन देने की आवश्यकता है। अगर ऐसा नहीं किया गया तो देश का बड़ा हिस्सा जल्दी ही पीने और घरेलू इस्तेमाल के लिए पानी के गंभीर संकट का शिकार हो जाएगा।

साइकिल से हो सकता है परिवहन समस्या का हल

साइकिल का इस्तेमाल करने से ईंधन की बचत से लेकर स्वास्थ्य में सुधार, प्रदूषण में कमी और आर्थिक गतिविधियों में तेजी संभव है और करोड़ों रुपये का लाभ भी मुमकिन है।

क्या एक दिन ऐसा भी आएगा जब कार चलाना धूम्रपान की तरह अस्वीकार्य हो जाएगा? ऐसा लगता तो नहीं लेकिन पिछले दिनों न्यूयॉर्क टाइम्स के साथ बातचीत में ओस्लो की वाइस-मेयर हन्ना एलीस मार्सेन ने कमोबेश ऐसी ही तुलना की। योजना के मुताबिक ओस्लो के सिटी सेंटर को 2019 तक पूरी तरह कारों से मुक्त करने की है। सिटी सेंटर में पार्किंग की जगह अब कमोबेश खत्म हो चुकी है। मार्सेन ने न्यूयॉर्क टाइम्स से कहा था, ‘कुछ दशक पहले घरों के भीतर सिगरेट पीना सामान्य माना जाता था। आज बहुत कम लोग ऐसा करेंगे। मुझे लगता है कि सिटी सेंटर में कारों पर भी यह बात लागू होती है।’ संभव है कि ओस्लो कार से मुक्ति की अपनी नीतियों के प्रति कुछ ज्यादा गंभीर हो लेकिन वह अपवाद भी नहीं है। पूरे यूरोप में मुख्य शहरों के प्रमुख इलाकों में कारों का प्रवेश सीमित किया जा रहा है। मैड्रिड के सिटी सेंटर में तमाम अनिवासियों के कार ले जाने पर रोक लगा दी गई है। माना जा रहा है कि शीघ्र ही समूचे स्पेन में यह नीति लागू की जाएगी। अन्य शहरों में भी प्रदूषण मानकों का उल्लंघन करने वाले वाहनों के विरुद्ध ऐसे कदम उठाए जा रहे हैं जो यूरोपीय संघ के दिशानिर्देशों से भी कड़े हैं।

इस परिदृश्य को देखते हुए अगर साइकिल की बात करें तो उसके अनेक लाभ हैं। पहली बात तो यह कि साइकिल जीवाश्म ईंधन पर निर्भर नहीं है और न ही वह किसी तरह का प्रदूषण फैलाती है। इसके तमाम सामाजिक लाभ भी हैं। सरकारी कार्यक्रमों के माध्यम से बच्चियों को नि:शुल्क साइकिल वितरित करने का न केवल भारत बल्कि दुनिया भर में उनकी शिक्षा पर अच्छा असर हुआ है। बिहार में स्कूली छात्राओं को साइकिल देने की योजना को खासी चर्चा मिली तो वहीं पश्चिम बंगाल ने एक कदम आगे बढ़कर सरकारी विद्यालयों में कक्षा 10 से 12 तक के सभी बच्चों को नि:शुल्क साइकिल देने की पेशकश की।  साइकिल के इस्तेमाल को बढ़ावा देने के आर्थिक लाभ भी कम नहीं हैं। जो लोग दूरदराज इलाकों में रहते हैं वे आसानी से बाजार तथा अन्य जगहों पर अपनी कृषि उपज बेचने या अन्य कारोबार करने के लिए जा सकते हैं। अब वे केवल स्थानीय बाजारों तक सीमित नहीं हैं। इसके बावजूद भारत में परिवहन के माध्यम के रूप में साइकिल का महत्त्व कम होता जा रहा है। टेरी द्वारा 2018 में जारी की गई एक रिपोर्ट के मुताबिक परिवहन के माध्यम के रूप में साइकिल का इस्तेमाल तेजी से गरीब परिवारों तक सीमित होता जा रहा है। ये वे परिवार हैं जिनके पास परिवहन का कोई अन्य साधन नहीं है।

वर्ष 2001 से 2011 के बीच साइकिल रखने वाले घरों की तादाद में केवल एक फीसदी का इजाफा हुआ और इनकी तादाद बढ़कर 45 फीसदी हो गई। शहरी क्षेत्रों में इनमें कमी आई। कई अल्प आय वाले परिवारों ने भी दोपहिया वाहनों का इस्तेमाल शुरू कर दिया। साइकिल का इस्तेमाल बढ़ाने के दो तरीके हैं। पहला-अभी दोपहिया वाहनों का इस्तेमाल कर रहे लोगों को साइकिल का इस्तेमाल करने के लिए प्रेरित करना तथा पैदल चलने वालों को साइकिल का इस्तेमाल करने के लिए कहना। ग्रामीण इलाकों में आज भी करीब 49 फीसदी कामगार जब काम करने जाते हैं तो वे 10 किलोमीटर तक की दूरी पैदल पूरी करते हैं। शहरी इलाकों में यह आंकड़ा 39 फीसदी है। टेरी की रिपोर्ट जिसे अखिल भारतीय साइकिल निर्माता महासंघ का समर्थन हासिल है, में कहा गया है कि अगर इनमें से आधे कामगार भी साइकिल का इस्तेमाल शुरू कर दें तो अर्थव्यवस्था को 11,200 करोड़ रुपये वार्षिक का लाभ हो सकता है। अगर दोपहिया और तिपहिया वाहन चलाने वाले भी साइकिल का इस्तेमाल करने लगें तो अर्थव्यवस्था को 1.43 लाख करोड़ रुपये का अतिरिक्त लाभ होने लगेगा। टेरी के मुताबिक अगर ऐसा हुआ तो ईंधन की बचत से लेकर स्वास्थ्य में सुधार, प्रदूषण में कमी और आर्थिक गतिविधियों में सुधार तक कुल मिलाकर 1.8 लाख करोड़ रुपये का लाभ होगा। यह जीडीपी के 1.6 फीसदी के बराबर है।

परंतु लोगों के व्यवहार में इतना बड़ा बदलाव लाना आसान नहीं है। टेरी की रिपोर्ट में इससे जुड़ी समस्याओं को भी उजागर किया गया है। उदाहरण के लिए शहरों में साइकिल चलाने के लिए अलग लेन की कमी है और वाहन से होने वाले परिवहन पर जोर दिया जाता है। इसका नकारात्मक असर साइकिल चालकों पर पड़ता है। ग्रामीण इलाकों में समस्या कहीं अधिक गहरी है। मारुति एक पूर्व प्रबंध निदेशक जगदीश खट्टर हाल ही में साइकिल के प्रशंसकों में शामिल हुए हैं। उन्होंने अपने एक हालिया साक्षात्कार में कहा कि भले ही एक साइकिल 3,000 से 5,000 रुपये मूल्य में आ जाए लेकिन 100 रुपये रोजाना कमाने वाले व्यक्ति के लिए इतना खर्च भी बहुत अधिक है। बैंक भी दोपहिया वाहनों के लिए ऋण देने को तैयार रहते हैं लेकिन साइकिल के लिए ऐसा कोई ऋण नहीं मिलता। अगर साइकिल खरीदने के लिए सस्ता ऋण या सब्सिडी दी जाए तो बड़ी तादाद में लोगों को साइकिल से जोड़ा जा सकता है।

लागत का अवरोध खत्म करने का एक और भी तरीका है। यह काम बाइक किराये पर देकर या बाइक साझा करके भी किया जा सकता है। भारत समेत दुनिया भर के शहरों में ऐसी योजनाएं कारगर ढंग से चल रही हैं। परंतु ऐसा चुनिंदा बड़े शहरों के सीमित इलाके में ही हो रहा है। यही वजह है कि उनकी उपयोगिता भी सीमित है। ऐसे में अगर कोई दूरदर्शी सरकार या उद्यमी यह सिलसिला दूरदराज इलाके के जरूरतमंद लोगों के लिए शुरू करे तो यह सफल साबित हो सकता है। अगर ऐसी योजनाएं चलाई जाएं तो आगे चलकर ये स्थानीय ग्रामीण अर्थव्यवस्था का अनिवार्य अंग बन सकती हैं।  उबर और एयरबीएनबी इस बात का उदाहरण हैं कि ‘साझेदारी’ का यह कारोबारी मॉडल किस कदर सफल साबित हो सकता है। कहा जा सकता है कि बाइक साझा करने से उपजी अर्थव्यवस्था देश की अर्थव्यवस्था पर बहुत लंबा स्वस्थ असर डाल सकती है।

आरक्षण और सामाजिक न्याय के सिद्धांत का शीर्षासन

राजनीतिक दलों और विभिन्न जातियों के आरक्षण-आरक्षण खेलने की चाल के चलते एनडीए की सरकार ने सामाजिक न्याय के सिद्धांत को शीर्षासन करा दिया है। सामान्य वर्ग को आर्थिक आधार पर नौकरियों और उच्च शिक्षा में 10 प्रतिशत आरक्षण देकर सरकार ने 50 प्रतिशत के उस तटबंध को तोड़ दिया है जो इंदिरा साहनी बनाम भारत सरकार के फैसले में सुप्रीम कोर्ट की नौ सदस्यीय संविधान पीठ ने खड़ा किया था। प्रधानमंत्री नरेंद्र मोदी ने इसे सबका साथ और सबका विकास कहा है। उनकी पार्टी प्रसन्न है कि तीन सांसदों को छोड़कर कोई भी विपक्षी दल इसका विरोध करने का साहस नहीं जुटा पाया है और अगर अयोध्या पर संघ परिवार के अनुकूल सुप्रीम कोर्ट का निर्णय आ गया तो यह दोनों ब्रह्मास्त्र 2019 के चुनाव में उसकी नैया पार लगा देंगे। स्पष्ट तौर पर सरकार का यह पैंतरा एक चुनावी दांव है जिसके पास अपने फैसले के औचित्य के लिए मंडल आयोग की तरह कोई रिपोर्ट भी नहीं है। यही वजह है कि मंडल आयोग का फैसला देने वाली संविधान पीठ के सदस्य रहे भारत के पूर्व मुख्य न्यायाधीश एएम अहमदी ने इसे सुप्रीम कोर्ट के फैसले का उल्लंघन करार दिया है। उनका कहना है कि 50 प्रतिशत की सीमा इसीलिए लगाई गई थी ताकि कोई भी पार्टी महज चुनाव जीतने के लिए आरक्षण की सीमा बढ़ाने का फैसला न ले सके। इन्हीं संवैधानिक अड़चनों के कारण सरकार ने इसके लिए 124 वां संविधान संशोधन पेश किया है और उसे उम्मीद है कि उसका निर्णय पीवी नरसिंह राव के 9 प्रतिशत आर्थिक आरक्षण की तरह असंवैधानिक नहीं होगा। सरकार के इस निर्णय में आय की सीमा 8 लाख रखकर बहुत ऊंची श्रेणी बनाई गई है और यह गरीबी रेखा और आयकर की सीमा का मजाक ही है। सबसे खास बात यह है कि सामान्य श्रेणी को 40 प्रतिशत तक सीमित कर दिए जाने की यह रणनीति यहीं नहीं रुकने वाली है। आरक्षण एक तरह की प्रतिस्पर्धा और ईर्ष्या भी पैदा करता है। केंद्रीय मंत्री रामदास आठवले ने ओबीसी के लिए 54 प्रतिशत और कुल आरक्षण 90 प्रतिशत करने की मांग शुरू कर दी है। भारत में जातीय संरचना के बारे में 2011 की रिपोर्ट भी अभी उजागर होनी है। उसके बाहर आने के बाद विभिन्न जातियों की अपने प्रतिशत के हिसाब से सरकारी और निजी क्षेत्रों में आरक्षण की मांग उठनी ही है। उसके बाद जो घमासान मचेगा, वह आसानी से नहीं रुकेगा।

क्या कहती है सबरीमाला की राजनीति

आखिरकार नए साल में 10 से 50 साल की उम्र की महिलाओं ने सबरीमाला में प्रवेश करके अपने भगवान अयप्पा की पूजा-अर्चना करने में कामयाबी हासिल कर ली। उन्हें यह सफलता सुप्रीम कोर्ट के आदेश के तीन महीने बाद मिल पाई है। ऐसा लगता है कि केरल की वाम मोर्चा सरकार औरतों को इस मंदिर में प्रवेश दिलाने के लिए माकूल वक्त का इंतजार कर रही थी। जिन दो महिलाओं ने भगवान अयप्पा की पूजा-अर्चना की, वे अब 24 घंटे राज्य पुलिस की सुरक्षा में हैं। इसी से इस मसले की जटिलता का संकेत मिल जाता है।

इस घटना के विरुद्ध दक्षिणपंथी संगठनों की हिंसक प्रतिक्रियाएं पूरे राज्य में दर्ज की जा रही हैं। खासकर कन्नूर जिला इन दिनों उबल रहा है, जो वामपंथी और दक्षिणपंथी संगठनों की हिंंसक टकराव के लिए कुख्यात रहा है। बीते रविवार तक पुलिस ने 3,000 से अधिक लोगों को उपद्रव फैलाने के आरोपों में घेरे में लिया है। दिल्ली स्थित भाजपा प्रवक्ता की धमकियों पर टिप्पणी करते हुए केरल के मुख्यमंत्री पी विजयन ने केंद्र को चुनौती दे डाली कि वह उनकी सरकार को बर्खास्त करकेे दिखाए। विजयन ने संघ परिवार पर आरोप लगाया कि वह सांप्रदायिकता की लहर पैदा करने की कोशिश कर रहा है और राज्य सरकार ऐसा करने वाले तत्वों से सख्ती ने निपटेगी।

मुख्यमंत्री ने जैसे ही आधिकारिक रूप से दो महिलाओं के सबरीमाला मंदिर में प्रवेश कर पूजा-अर्चना करने का एलान किया, मंदिर के पुजारियों ने गर्भगृह के द्वार बंद कर दिए, ताकि ‘शुद्धिकरण’ के कर्मकांड किए जा सकें। बहरहाल, सड़कों पर हो रही हिंसा और भाजपा व वामपंथी नेताओं में छिड़ी जुबानी जंग के बीच इस महीने के मध्य में प्रधानमंत्री नरेंद्र मोदी केरल के दौरे पर जा रहे हैं। जाहिर है, इसके बाद इस सूबे का सियासी पारा और चढे़गा। मुख्यमंत्री का आरोप है कि ‘संघ परिवार’ केरल में सांप्रदायिक दंगे भड़काना चाहता है। ‘भाजपा ने उत्तर भारत में सफलता के साथ अपनी इस रणनीति को लागू किया है… लेकिन केरल में उसकी यह चाल सफल नहीं होगी।’ वाम मोर्चा सरकार की दलील है कि उसने सिर्फ सुप्रीम कोर्ट के आदेश का पालन किया है, जिसमें महिलाओं के एक खास वर्ग के लिए मंदिर में प्रवेश पर लगी रोक को खत्म करने का आदेश दिया गया है। वाम दलों का सवाल है कि आखिर केंद्र सरकार राज्य सरकार के संविधान-सम्मत कदमों का समर्थन करने की बजाय विरोधी रुख कैसे अपना सकती है?

दरअसल, मासिक धर्म की उम्र अवधि वाली महिलाओं के भगवान अयप्पा के मंदिर में प्रवेश पर पाबंदी थी। दक्षिणपंथी लोग, खासकर संघ-भाजपा समर्थक इन महिलाओं के मंदिर प्रवेश का मुखर विरोध कर रहे हैं कि यह हिंदुओं की आस्था और परंपरा से छेड़छाड़ है। साफ है, भाजपा का इरादा केरल की सियासत में खुद को स्थापित करना है। पिछले विधानसभा चुनाव में उसने केरल में शानदार प्रदर्शन किया था। उसने न सिर्फ विधानसभा में अपना खाता खोला, बल्कि 15 फीसदी से भी ज्यादा वोट हासिल किए थे। केरल वासियों के अलावा सबरीमाला मंदिर के प्रति पूरे दक्षिण भारत के लोगों में गहरी श्रद्धा है। श्रद्धालु तेलंगाना, आंध्र प्रदेश, कर्नाटक और तमिलनाडु के कोने-कोने से यहां भगवान अयप्पा की पूजा-अर्चना के लिए आते हैं। ऐसे में, अनेक श्रद्धालुओं के लिए यह बेहद कठिन वक्त है, क्योंकि वे परंपरा और स्त्री-उद्धार व स्त्रियों के सांविधानिक हक के बीच संतुलन साधने की दुविधा में फंस गए हैं। भाजपा इसे दक्षिण भारत में अपने प्रभाव के विस्तार के एक मौके के तौर पर देख रही है।

महाराष्ट्र के शनि शिंगणापुर मंदिर में पिछले 400 से भी अधिक वर्षों से महिलाओं के प्रवेश पर रोक लगी थी, लेकिन दो साल पूर्व जब हाईकोर्ट ने प्रतिबंध हटाने का आदेश दिया था, तब भाजपा की राज्य सरकार ने वहां महिलाओं का प्रवेश सुनिश्चित कराया था। ऐसे ही, सवाल तीन तलाक के मसले से जुडे़ हैं। सुप्रीम कोर्ट ने इसे असांविधानिक घोषित किया था। कोर्ट के फैसले के अनुरूप केंद्र सरकार ने संसद में विधेयक पेश किया। उस समय प्रधानमंत्री ने समस्त राजनीतिक पार्टियों से गुजारिश की थी कि इस मुद्दे का राजनीतिकरण न किया जाए और लैंगिक न्याय सुनिश्चित किया जाए। विपक्ष ने इस विधेयक को राज्यसभा में यह कहते हुए रोक दिया कि इस विधेयक को काफी जल्दबाजी में लाया गया है, इसलिए इसे सेलेक्ट कमेटी को भेजा जाना चाहिए। उस समय भाजपा ने विपक्ष पर ‘वोट बैंक की राजनीति’ करने का आरोप लगाया था। सच तो यह है कि दोनों ही पक्ष ‘वोट बैंक की राजनीति’ में जुटा है।

चाहे सत्ता पक्ष की पार्टियां हों या विपक्ष की, उनके लिए महाराष्ट्र के शनि शिंगणापुर का मसला या केरल के सबरीमाला मंदिर का मुद्दा या फिर तीन तलाक का मसला कोई लैंगिक समानता का विषय नहीं है, जबकि यही होना चाहिए; वे तो बेशर्मी से अपने ‘वोट बैंक’ के लिहाज से ही इनका इस्तेमाल कर रही हैं। सामाजिक रीति-रिवाजों और परंपराओं में बदलाव लाना हमेशा ही बहुत मुश्किल काम होता है, खासकर भारत जैसे मजबूत पितृसत्तात्मक समाज में तो और भी। मंदिरों में दलितों के प्रवेश के लिए पहली कठिन लड़ाई तो देश की आजादी से भी पहले केरल और महाराष्ट्र के कुछ हिस्सों में समाज सुधारकों को लड़नी पड़ी थी। आजादी के बाद कानूनों में संशोधन हुआ और सबको आस्था, पूजा करने और उपदेश की आजादी व समानता की गारंटी मिली। लेकिन कानूनी अनुमति के बावजूद दशकों बाद भी कुछ संवेदनशील वर्गों को सामाजिक मान्यता नहीं मिल सकी है। लैंगिक समानता की बातें अब भी खोखली हैं। हमारी आधी आबादी को अब भी उसके पूरे हक-हुकूक नहीं मिल सके हैं। सामाजिक रवायतें अड़चन बनी हुई हैं। पितृसत्ता अब भी जिंदा है, बल्कि राजनीतिक व्यवस्था में अपनी पकड़ मजबूत बनाए हुए हैै और इसका सबसे बड़ा उदाहरण है- महिला आरक्षण विधेयक को पारित करने में संसद की असमर्थता।

Slipping on Quota

Why reservation for economically backward classes may not pass judicial scrutiny

The Narendra Modi government started its innings in 2014 with a constitutional amendment giving the government a vital say in the appointment of judges. But the apex court struck it down as unconstitutional in 2016 as the amendment undermined the primacy of the opinion of the Chief Justice of India in judicial appointments, which the Court said was part of the basic structure of the Constitution. Now, the government is ending its term with another major constitutional amendment, whose chances of being struck down by the SC are even greater. Strangely, the government that overemphasised “merit” in judicial appointments has now taken reservation to 59 per cent with almost 95 per cent of the population of economically backward classes covered. Moreover, a pro-private sector government has extended the proposed quota to private educational institutions as well, though the SC in Ashok Thakur (2008) had left this question unanswered.

The proposal to give 10 per cent reservation to the economically backward classes, like several other schemes of the Modi government, is neither novel nor innovative. The Congress government under P V Narasimha Rao did provide for similar reservation, but a nine-judge bench in Indra Sawhney (1992) struck it down. There have been similar efforts in states as well — Kerala under the left government (2008) in admissions to a few courses, the Congress government in Rajasthan (2008) and the BJP regime in Gujarat (2016). Even Mayawati has been in favour of such a reservation and has welcomed the government’s move.

The BJP as a party has not been a great votary of social justice through reservations. In fact, the RSS chief, Mohan Bhagwat, in 2015 called for a review of the reservation policy. But anticipating its political fallout in the Bihar assembly elections, the BJP disowned Bhagwat’s remark. Likewise, the government implemented the apex court’s directive to take the department instead of university as the unit of reservation, a decision that drastically reduced the number of reserved seats for SCs and STs in universities. Similarly, the government lawyer did not effectively defend the SC/ST Act in the Supreme Court and almost admitted its misuse, leading to the dilution of the Act.

Historically, most reservation schemes have been announced on the eve of general or assembly elections. The political leadership treats Indian voters as stupid and forgets that in the past, such populist moves have not paid electoral dividends. Rajiv Gandhi did not win in 1989 despite overturning the Shah Bano verdict and opening the locks of the Babri Masjid. Socialist leader Karpoori Thakur and V P Singh too failed to get the anticipated support from the masses for their reservation policies.

In any case, the legality of the Modi government’s move is suspect. The apex court has said in categorical terms that reservation solely on the basis of economic backwardness, that is without evidence of historical discrimination, finds no justification in the Constitution. A nine-judge bench in Indra Sawhney had ruled that reservation is a remedy for historical discrimination and its continuing ill-effects. The court also said that reservation is not aimed at economic uplift or poverty alleviation. Economic backwardness is to be on account of social backwardness.

The backwardness mentioned under Article 16(1) must be the backwardness that is both the cause and consequence of non-representation in the state administration. It has to be backwardness of the whole class, not of some individuals. The economic criterion will thus lead, in effect, to the virtual deletion of Article 16(4) from the Constitution. Hence, economic backwardness has to be on account of social backwardness under Article 16(4).

Moreover, the move upsets the 50 per cent cap imposed by the SC on reservation. Justice Thommen in Indra Sawhney said that “any attempt to over-emphasise its compensatory aspect and widen the scope of reservation beyond ‘minority of posts’ is to practice excessive and invidious reverse discrimination”. B R Ambedkar in his speech in the Constituent Assembly on November 30, 1948, explicitly said that equality of opportunity would require that reservation should be for the “minority of the seats” and only in favour of “backward classes who had not so far had representation in the state”.

The weaker sections as mentioned in Article 46 are a genus of which the backward class of citizens mentioned in Article 16(4) constitute a species. Thus, only backward classes, and not all the weaker sections, are entitled to reservation. Caste and class are not synonymous. Class is not antithetical to caste, caste is an enclosed class. Ambedkar, at the time of the first amendment, which inserted clause 4 in Article 15, told Parliament that “backward classes are nothing else but a collection of castes”. Class here is social class. Thus, economic backwardness must be the result of social backwardness.

A constitutional amendment in the matter will be subject to the basic structure theory. There is no definition of the basic structure and in each case, the court decides what features of the Constitution constitutes the basic structure. The Modi government must be hoping that since there is some controversy about the right to equality being a part of the basic structure, it can pass judicial scrutiny. Justice K K Mathew in Indira Gandhi (1975) had not accepted Article 14 as part of the basic structure because equality is a multi-coloured concept incapable of a single definition. Moreover, the government may argue that reservation will widen the ideals of equality by including even the economically backward. But equality as a principle is part of the basic structure and with equality of status and opportunity in the preamble also as basic structure, the Court may agree to the economic criterion for reservation.

In any case, only an 11-member bench can overrule Indra Sawhney and a decision is unlikely in six months. The most likely scenario is that the Modi government’s move will be stayed by the apex court till the final decision on the constitutionality of the Bill is delivered. The validity of reservation on the basis of economic backwardness in the absence of social backwardness, will depend on how many of the 11 yardsticks of backwardness laid down in Indra Sawhney for OBC reservation is satisfied by the Bill.
