Wrong Cut

Disbanding appellate tribunal is another blow for filmmakers

Government’s decision to scrap the Film Certification Appellate Tribunal – an appellate authority that filmmakers approach to challenge the decisions of the Central Board of Film Certification (CBFC) – is another blow for the country’s film fraternity. In an ordinance notified earlier this month, government amended the Cinematograph Act, 1952, to clarify that filmmakers aggrieved by the decisions of the CBFC – also known as the censor board – will now have to approach the high courts. This is truly problematic given the huge backlog of cases high courts are already grappling with – they have 57 lakh cases pending.

Thus, it’s difficult to see high courts paying attention to film certification issues with consequent delays mounting costs for film producers. The move also needs to be seen in the context of the film industry’s circumstances since last year. The post-Covid lockdown and restrictions on theatres hit the industry hard. A further jolt was dealt by the Narcotics Control Bureau investigations against certain Bollywood personalities.

All of this is seriously undermining the biggest film industry in the world. Add to this right-wing elements in society frequently filing FIRs for so-called objectionable content – even with respect to content on OTT platforms – and an impression has been created that authorities today take a dim view of the film and entertainment industry as a whole. This is unfortunate because the industry is India’s biggest soft power asset. And at a time of increasingly competitive geopolitics, with the China-Pakistan axis getting increasingly assertive and confronting India with the prospect of a two-front war, soft power can be India’s trump card. Hence, government should be helping the film industry’s creative capabilities to flourish. Rescinding the ordinance disbanding the appellate tribunal would put everybody at ease.

Better Policing, Better Governance

It is welcome that the Maoists have released the lone CoBRA force commando they had taken captive after an ambush in Chhattisgarh’s Bastar region that left 22 members of the paramilitary Central Reserve Police Force dead. But that does not mean that there is room for any compromise with the Maoists’ rejection of democratic politics and resort to force. What it does show is that there could be non-lethal solutions to left-wing extremism, in the form of surrender by the armed insurgents and adoption of democratic forms of politics.

A villager, it is speculated, tipped off the Maoists about the presence of the security forces, enabling them to strike and kill trained security personnel. At the same time, relations between villagers and security personnel are often fraught. These reflect deficiencies in governance and scope for reform. While romantic notions of the Maoists as liberators of oppressed villagers have little basis, villagers themselves being often at the receiving end of Maoist violence, oppression of villagers is part of India’s sordid reality. This is one reason why Maoists are able to mobilise some support among tribal villagers. It is imperative to address the governance deficit that serves as grist to the Maoist propaganda mill. Similarly, policing should ideally be perceived as an extension of normal governance. In states such as Andhra Pradesh and Telangana that have successfully combated Maoists, their police force, rather than the paramilitary, took on the task. State police forces speak the language of the local people, know their culture and customs, and are better placed to win their trust and elicit their cooperation.

When mines are opened, roads and pipelines laid or power plants set up in forests, traditional forest dwellers can either be given a stake in the new prosperity coming up on their erstwhile land or they can be cast aside as collateral damage. This is where the democratic imagination had failed in the past and created victims of development. This calls for a paradigm shift, one that also combats left-wing extremism.

Welcome Move for Pre-Packed Resolution

The government has done well to allow pre-packaged insolvency resolution plans for micro, small and medium enterprises (MSMEs) with defaults up to ₹1 crore. This debtor-initiated reorganisation plan in advance with creditors on board will give MSMEs a chance to rehabilitate themselves, rather than get liquidated. And those that cannot be restored would have their assets efficiently redeployed. Essentially, pre-packs underline the fundamental purpose of the Insolvency and Bankruptcy Code (IBC): swiftly bring back into a productive framework assets trapped in failing companies, rather than help banks and vendors recover their dues. Speed is vital when a company goes into distress to better the chances of its turnaround as a going concern. So, the time limit of 120 days for completion of a pre-packaged resolution plan is in order. It will help reduce the load on the National Company Law Tribunals. When the pre-pack process is underway, the management and control will continue with the promoters and directors of the MSME. This will cause minimal disruption in the operations and is, therefore, welcome. However, the Committee of Creditors (CoC), by a 66% vote, can vest the management with the resolution professional (RP) after seeking court approval. If the plan proposed by the MSME is rejected by the CoC or where operational creditors’ dues are impaired, the RP can invite applications for a competing plan (read: akin to Swiss challenge). So, the CoC will be in the driver’s seat. Also, a pre-pack process initiated with an intent to defraud will attract a penalty.

Hardwiring pre-packs into the IBC (through an amendment) to prevent any misuse is fine. This is the first step, and pre-packs should be opened up to bigger MSMEs once the process stabilises.

Allahabad High Court’s quashing of NSA orders underlines failure of institutional safeguards — and how to secure them.

When a law is used to curtail individual freedoms in a constitutional democracy, crucial checks and balances must kick in to draw the red lines that protect against state arbitrariness. This is especially so when the state wields a law as harsh as the National Security Act, which gives it powers to arrest without formal charge or trial. In Uttar Pradesh, over the last three years, this newspaper has investigated and found, out of the 120 habeas corpus petitions that came before it under the NSA, more than half of them citing cow slaughter and communal incidents, the preventive detentions of 94 individuals were struck down by the Allahabad High Court. Behind those statistics lies a story of the disturbing failure of systemic safeguards, of constitutional protections not kicking in when and where they should have — while quashing NSA orders across 32 districts, and calling for the release of the petitioners, the court’s orders showed that there were cut-and-paste police FIRs in multiple locations, “non application of mind” by the district magistrates, denial of due process to the accused and repeated use of the law to block bail. There is a dismal pattern here. At the same time, however, the pushback by the Allahabad HC also frames the one important check that did work — that did come to the rescue of the individual against the transgressing state.

In asking questions, in pointing to the questions not asked by the detaining authorities, the high court was upholding, in letter and spirit, constitutional guarantees and the promise made by the higher judiciary — that preventive detention under NSA must be strictly construed keeping in mind the “delicate balance between social security and citizen freedom”. The Supreme Court has called for “meticulous compliance with the procedural safeguards”. In case after case, and especially in those related to cow slaughter and communal incidents — issues that have often been politically weaponised to target members of the minority community in the state — the balance was abandoned, and available safeguards given the go-by. “… slaughtering and consumption of beef per se cannot attract the provisions of the National Security Act… It would be an offence under the provisions of the Cow Slaughter Act”, the HC observed in the detention of Shahid Qureshi, on April 4, 2019. How was the act a disturbance of public order, there is “no reference of petitioner being involved in any serious or any anti-national activity”, it said in another case.

The overall message underlined by the Allahabad High Court — “the individual liberty granted to the petitioner by the Constitution of India cannot be taken away without proper application of mind” — must be heeded. By the district magistrates who passed orders in a mechanical manner, in some cases only on the basis of police reports, in others showing signs of being swayed by political pressures. The court orders should also be read carefully by the state government. The people’s mandate casts a responsibility to make the institutional safeguards stronger and better, it does not give any government the licence to bypass them.

Layers of counter-insurgency

Taking on left-wing extremism requires, simultaneously, coordinated tactical and military response from states, dialogue and development

The killing of 22 security personnel by Maoists in Bijapur district of Chhattisgarh serves as a grim reminder that left-wing insurgency continues to be one of the biggest internal security threats for the country. Initial reports suggest that security forces in Chhattisgarh had launched a massive operation on April 4, after there were intelligence reports about the presence of top Maoist commander Hidma along with 60-70 Maoists in and around Tekulugudam Hill in Bijapur. As the forces reached the top of the hill and were combing through the intended “target” (Tekulugudam Hill), they came under heavy fire. It was then the forces realised that they had walked into a trap. The initial assessment indicates that there were around 300 Maoists, which included men and women belonging to the local tribal militia.

In the past few years, Maoist violence seemed to have been on a downward spiral. The government has, in fact, had some major successes in the form of arrests and surrender of important Maoist leaders. The figures associated with the key indicators of violence like the number of incidents also support the contention that “insurgency is on the downward spiral”. However, some experts believed that it was too early to sound the last post and cautioned that this drop could be the result of a “tactical withdrawal” by the Maoists, something which they have done in the past as well. The attack should thus serve as a wake-up call to those who had begun to get complacent about the Maoist threat. It appears that Maoists continue to hold on to their key strengths which include: (i) a robust and efficient intelligence network; (ii) the devolution of authority to local commanders; (iii) an ability to quickly readjust their strategy; (iv) extensive support from local tribes and the ability to organise them into a tribal militia for short-term tactical purposes and (v) domination of the local landscape.

This brings us to the most important question about the nature of the Counterinsurgency (hereafter COIN) strategy, which governments both in the states and at the Centre are adopting or should adopt. Debates about the utility of different COIN models in the Indian scenario have continued since India began dealing with its first full-blown insurgency in Nagaland in the 1950s. One school believes that given the Maoist insurgency posturing itself as a “people’s war”, the mandate is for a people-centric approach of “winning hearts and minds” that is built on the notions of competitive state-building to address economic and governance deficiencies.

The other school argues that an enemy-centric approach predicated on kinetic operations is best suited for the Maoist insurgency, where the fear of the population seceding from India is remote. The success of the erstwhile state of Andhra Pradesh in curbing the Maoist problem is often attributed to this enemy-centric approach. However, there is robust scholarly work available that shows that the Andhra government based its COIN strategy on a judicious mix of the enemy-centric and population-centric approaches. The successes achieved by the Greyhounds, Andhra’s elite special forces, could only be consolidated through the robust implementation of short-gestation-period developmental works in the Maoist-affected rural areas. Moreover, the erstwhile state is also the first state to have a comprehensive surrender-cum-rehabilitation policy.

After the 2014 guidelines of the central government were brought out, many states have crafted attractive surrender and rehabilitation policies. Odisha, for one, seems to have achieved fair success in its surrender policy but this was possible only after successful kinetic operations against Maoists. It is fair to say that a surrender and rehabilitation policy only works when there is sustained military pressure on the Maoists.

Another important question is whether the government should keep the option of talking to Maoists open. Debates about negotiating with insurgents and terrorists are often met with anger and, at times, disgust, at the possibility of sitting across a table from individuals who were responsible for some horrific violent acts. The US government had to share a table with the Taliban, which played host to al Qaeda as the latter prepared to kill thousands of innocent Americans. The willingness to talk to rebel groups seems to incentivise insurgents and may demonstrate that violence pays. Yet, time and again, governments face the distasteful reality of engaging with groups that have been involved in violent attacks against their forces and citizens. History is replete with examples that show the goal of ending terrorist violence or bringing an end to civil war invariably involves negotiating with the enemy, even the worst ones. And Maoists may not fall under the “worst” category, as successive governments have labelled them as “misguided” youth. Even the present central government’s surrender policy guidelines are aimed at bringing these “misguided” youth into the mainstream.

In the last decade or so, insurgency-affected states have started to undertake serious efforts to defeat the Maoist insurgency. Most of these states have raised special forces on the lines of Greyhounds, and are being given rigorous training in “counter-guerrilla” tactics and jungle warfare. A Maoist guerrilla can only be countered by a state guerrilla. The operating environment of these special forces has to demonstrate the employment of superior tactics to defeat the insurgents, something which at times seems lacking. Besides, the Maoists have mastered the art of exploiting the grey zone areas. The jungles around the interstate borders have always been the preferred hiding spaces for the Maoists. Soon after decimating the top state Congress leadership in Darbha in Chhattisgarh in 2013, the assault group moved to the Chhattisgarh-Odisha border to avoid any kind of kinetic response from the Chhattisgarh police. States must do more to synergise their efforts by launching coordinated operations, thereby denying Maoists any space for manoeuvrability. These efforts need to be supplemented by well-crafted development schemes. Proper implementation and timely disbursal of benefits add to the credibility of the government policies. It is also important to segregate the population from the insurgents both operationally and ideologically. The hawks and the doves need to be viewed and treated differently.

Indian counterinsurgency has to work with a dual objective of defeating the insurgents militarily and fully quell the insurgent impulses. This will need institutional overhauls. The conflict over the distribution of resources can be mended with economic development, but the bigger challenge would be to create a system where the tribal population feels that the government is representative, not repressive. Opening negotiation channels and policies like surrender and rehabilitation can give such a representative sense to the rebels that the government cares for them if they (rebels) are willing to shun the violent path. Lastly, the asymmetry in the distribution of power cannot solely be ironed out by just economic policies, it is critically important to create a system where the distribution of power is not controlled by the traditional elite.

Beyond zero sum

Rich countries must commit technology and funds to move to net zero carbon emissions

The visit of the U.S. Special Presidential Envoy for Climate, John Kerry, ahead of a leaders’ summit convened by President Joe Biden later this month on the climate challenge, has prompted a review of India’s long-term policy course. To the developed world, India presents a study in contrasts, with carbon dioxide emissions that rank in the top five globally, while millions of its citizens remain mired in energy poverty and underdevelopment. Ironically, to many smaller countries, including island nations hit by intense storms, lost farm productivity, droughts and heat waves linked to a changing climate, India contributes to the problem with its total annual emissions. It is unsurprising, therefore, that the clamour is growing for India to join many other big economies and commit itself to net zero emissions: to balance carbon emissions with their removal from the atmosphere, by a specific date. Evidently, Mr. Kerry sought to explore the possibility of raising national ambition, with the assurance that the U.S., pursuing major green technology initiatives in the post-Donald Trump era, would support such a road map. His meeting with Prime Minister Narendra Modi has been positive. It would, of course, reassure not just India but other emerging nations as well, if the climate diplomacy of the North under the Paris Agreement is underpinned by funding and technology transfer guarantees to reduce emissions. If climate change is the biggest crisis today, the solutions require the U.S, the U.K., Europe and others who occupied the bulk of the world’s carbon budget to give up further emissions in favour of the developing world and fund the transition.

Even if India does not commit itself to a net zero deadline, and prefers to wait for the post-pandemic development pathways to become clear, it cannot afford to ignore the impact that its project decisions — such as deforestation — will have on the climate. At the peak of COVID-19 last year, the Centre saw it fit to press ahead with environmental clearances that would have a serious negative impact. It extended the deadline for coal plants to adopt strict pollution control, and proposed gross dilution of norms to assess environmental impact of projects. Fuel prices, at historic highs due to taxation, pay no specific environmental dividend, and the poorest are worst hit by its inflationary effects. What India should be doing in the run-up to the UN Convention on Climate Change in Glasgow, scheduled later this year, is to come up with a domestic climate plan that explains to the citizen how it will bring green development in this decade, specifying a target by sector for each year. This would align internal policies with the justifiable demand that rich countries uphold the principle enshrined in the UN Framework Convention on Climate Change, of common but differentiated responsibilities to build equity. Taxing luxury emissions, whether it is cars, air-conditioners, big properties or aviation, for specified green development outcomes, will send out a convincing message.

मौतों की कीमत पर छवि निर्माण की ‘डोज’ कितनी होनी चाहिए

‘वो बाहर कैजुअल्टी में कोई मरने की हालत में रहा, तो उसे फॉर्म भरना जरूरी है क्या?’ मुन्नाभाई के इस सवाल की तरह ही एक सवाल- ‘मेरे देश में एक दिन में सात सौ लोग मर रहे हैं। 76 देशों को टीका भेजना जरूरी है क्या? ’

वसुधैव कुटुम्बकम की पवित्र भावना के बीच अब कोविड की ज्यादा जानलेवा नई लहर में उपरोक्त सवाल पूछना अपराध नहीं होना चाहिए।

इटली ने ऑस्ट्रेलिया भेजे जा रहे ऑक्सफोर्ड-एस्ट्राजेनेका टीके अचानक रोक दिए। ऑस्ट्रेलिया के प्रधानमंत्री स्कॉट मॉरिसन ने कहा-‘इटली में रोजाना करीब 300 लोग मर रहे हैं। इसलिए मैं इसे अच्छी तरह से समझ सकता हूं कि इटली ने यह फैसला क्यों लिया होगा।’ अमेरिका में ‘नेशन फर्स्ट’ का नारा राष्ट्रपति ट्रम्प का था, लेकिन टीके के मामले में इस पर अमल किया बाइडेन ने। मार्च तक 16.4 करोड़ डोज तैयार की गई, जिनमें से एक भी बाहर नहीं भेजी गई। वायरस से सबसे बुरी तरह प्रभावित देशों में से एक ब्रिटेन ने भी अपने यहां तैयार 1.6 करोड़ टीके पूरी तरह अपने नागरिकों के लिए सुरक्षित रखे।

हमारे देश में केवल 6 प्रतिशत आबादी को ही वैक्सीन लग पाई है, जबकि अमेरिका और ब्रिटेन में 50 फीसदी आबादी को पहली डोज दी जा चुकी है। कुछ हफ्ते पहले तक हमने जितने डोज अपने नागरिकों को लगाए थे उससे ज्यादा दूसरे देशों को भेज दिए थे।

महाराष्ट्र, राजस्थान जैसे प्रदेशों के अलावा इंडियन मेडिकल एसोसिएशन ने भी केन्द्र सरकार से कम उम्र वालों को टीका लगाने का अनुरोध किया है। देश के 50 फीसदी कोरोना केस महाराष्ट्र में आ रहे हैं। वहां के लिए तो टीकाकरण की अलग नीति ही बननी चाहिए और युद्ध स्तर पर टीके लगाए जाने चाहिए।

डब्ल्यूएचओ के अनुसार संक्रमण की दर 5 फीसदी से ज्यादा हो तो महामारी नियंत्रण से बाहर मानी जाती है। देश में यह आज नौ फीसदी के करीब है। पहली लहर में कोरोना कंट्रोल से बाहर हुआ तो सरकार को इसका उपाय लॉकडाउन ही समझ आया था। उन हालातों में सड़क पर आ चुके इंसान की मदद के लिए लाखों हाथ उठे थे। अस्पतालों में अपनी जान पर खेलकर डॉक्टर इलाज कर रहे थे। परिवार बचा रहे इसके लिए कुछ ने तो अपनी कार में ही घर बना लिया था। वह सब अद्भुत-अभूतपूर्व प्रयास दूसरे लॉकडाउन में कहां से आएंगे। उस शिद्दत से कितना आ पाएंगे?

सबसे कम लागत पर उत्पादन और बड़ी आबादी को सुगमता से टीका लगाने की हमारी खासियत का फायदा दुनिया को दिया जा सकता है, लेकिन युद्धकाल में सबसे बड़ी कोशिश तो अपने लोगों की जान बचाना होना चाहिए। एक बार घर संभल जाए तब तो पड़ोसी की मदद के लिए बाहर कदम रखेंगे?

अंतरराष्ट्रीय छवि निर्माण के लाखों मौके आएंगे। जरूरतमंद गरीब देशों को मदद की भी जानी चाहिए लेकिन देश में अति विशेष स्थितियां हैं। कहीं ऐसा तो नहीं कि कोरोना से मौतें, श्मशान में एक साथ जलती चिताएं, आईसीयू की भीड़ के हम आदी हो चुके हैं?

मुंबई की मेयर का बयान था कि शहर में सिर्फ तीन दिन का स्टॉक, एक लाख 85 हजार डोज ही बची हैं। ऐसी ही खबरें दूसरी जगहों से भी आ रही हैं। सरकार 45 वर्ष से कम उम्र वालों को टीके की फिलहाल बात ही नहीं कर रही है। ऐसे में उसकी वैक्सीन डिप्लोमैसी पर सवाल पूछा जाएगा। मौतों की कीमत पर छवि निर्माण की कितनी डोज या मात्रा हितकर है यह बताना होगा।

भारत को नीचा दिखाने की साजिश

यदा-कदा कई अंतरराष्ट्रीय संस्थाएं भारत के खिलाफ विमर्श खड़ा करने का काम करती हैं। बीते दिनों यही कुत्सित प्रयास किया स्वीडन की वी-डेम नामक संस्था ने। गोथेनबर्ग विश्वविद्यालय से संबद्ध यह संस्था हर साल एक डेमोक्रेसी रिपोर्ट जारी करती है। वर्ष 2021 की अपनी रिपोर्ट में उसने लोकतंत्र को लेकर भारत की रैंकिंग घटा दी। वी-डेम के अनुसार 2010 में भारत एक चुनावी लोकतंत्र था, जो अब चुनावी अधिनायकवाद में तब्दील हो गया है। इस रिपोर्ट में भारत पर कुछ अतिरंजित आरोप लगाए गए। वह देश में चुनावी प्रक्रिया की निष्पक्षता पर सवाल उठाते हुए कहती है कि पिछले लोकसभा चुनाव के दौरान स्वतंत्र एवं निष्पक्ष चुनाव के सिद्धांत की धज्जियां उड़ीं, जिससे देश चुनावी अधिनायकवाद की गर्त में चला गया। वी-डेम के अनुसार भारत अब पाकिस्तान जितना ही निरंकुश है, जबकि पाकिस्तान एक इस्लामिक गणतंत्र है, जहां कोई गैर- मुस्लिम राष्ट्रपति और प्रधानमंत्री जैसे पदों पर नहीं पहुंच सकता। इतना ही नहीं, इस रिपोर्ट में भारत को बांग्लादेश से भी खराब बताया गया है।

पिछले लोकसभा चुनाव के विशेष संदर्भ मे देश की चुनावी प्रक्रिया को कठघरे में खड़ा करना इस रिपोर्ट का सबसे आपत्तिजनक पहलू है। देश के संविधान और चुनावी इतिहास का सम्मान करने वाले प्रत्येक भारतीय को कई कारणों के आधार पर इस निष्कर्ष की कड़ी निंदा करनी चाहिए। वी-डेम को लगता है कि भारत में केवल एक ही दल है और अन्य दल कोई मायने नहीं रखते। यह बिल्कुल हास्यास्पद है, क्योंकि देश में भाजपा के अलावा करीब 44 राजनीतिक दल सत्ता में भागीदार हैं। तृणमूल कांग्रेस, द्रमुक, तेलंगाना राष्ट्र समिति, बीजू जनता दल और वाइएसआर कांग्रेस ने गत लोकसभा चुनाव के दौरान अपने-अपने राज्यों की अधिकांश सीटों पर जीत हासिल की थी। वर्ष 2014 में नरेंद्र मोदी के प्रधानमंत्री बनने के बाद अगले ही साल हुए दिल्ली विधानसभा चुनाव में आम आदमी पार्टी ने 70 में से 67 सीटें जीती थीं। वामपंथी केरल में जीते। बंगाल में ममता की तृणमूल को भारी जीत हासिल हुई। राजस्थान, मध्य प्रदेश और छत्तीसगढ़ में कांग्रेस का परचम लहराया। कई राज्यों का जनादेश भाजपा के खिलाफ गया। ऐसे में जब कोई हमारी चुनावी प्रक्रिया पर प्रश्न उठाए तो भारतीयों को ऐसा करने वालों की ईमानदारी पर सवाल अवश्य उठाने चाहिए।

वी-डेम की रिपोर्ट यह अजीबोगरीब दावा भी करती है कि भारतीय नागरिकों के हाथ से ‘आजादी’ फिसल रही है। फ्रीडम हाउस नामक एक अमेरिकी संस्था की रिपोर्ट ‘फ्रीडम इन द वर्ल्ड’ भी उसके सुर से सुर मिलाती है। उसके अनुसार भारत में राजनीतिक अधिकारों और नागरिक स्वतंत्रता का क्षरण हो रहा है। यदि ऐसा है तो भाजपा विरोधी दर्जनों पार्टियां, जिनमें मुस्लिम और ईसाई केंद्रित राजनीतिक दल भी शामिल हैं, को चुनावों में इतनी सीटें कैसे मिल रही हैं? राजनीतिक बंदिशों से यह कैसे संभव होता? अगर आपको ऐसे दावों के खोखले होने के सुबूत चाहिए तो दिल्ली सीमा से सटे गाजीपुर जाइए, जहां कुछ किसान महीनों से विरोध-प्रदर्शन जारी रख एक बड़े हाईवे को बाधित किए हुए हैं।

पिछले वर्ष की तरह इस साल भी डेनमार्क, स्वीडन और नॉर्वे वी-डेम के लोकतंत्र सूचकांक में शीर्ष पर विराजमान हैं। ऐसे में जरा इन देशों के संविधान की पड़ताल कर भारत के साथ उनकी तुलना की जाए। डेनमार्क का संविधान चर्च को महत्ता देते हुए सुनिश्चित करता है कि राज्य उसे हरसंभव सहयोग दे। यानी यह राज्य का दायित्व है कि वह डेनमार्क में चर्च की वित्तीय और अन्य प्रकार से मदद करे। इस सूची में स्वीडन दूसरे पायदान पर है। यहां का संविधान राजा द्वारा सदैव ईसाई मत को प्रोत्साहित करने की वकालत करता है। यहां तक कि राजकुमार और राजकुमारी को विवाह के लिए सरकारी अनुमति आवश्यक होती है। वी-डेम ने नॉर्वे को तीसरा स्थान दिया है। यहां का संविधान भी कहता है कि राजा को धार्मिक मत को सदैव वरीयता देनी होगी। इनके उलट भारत, जो प्राचीन सभ्यता से ही पंथनिरपेक्ष रहा है और जिसके संविधान की प्रस्तावना में ही इसका उल्लेख है, वह इस संस्था की दृष्टि में लोकतंत्र ही नहीं है और उसे 97वें स्थान पर रखा गया है। पंथनिरपेक्षता के अतिरिक्त धर्म एवं राज्य के बीच विभाजन और विधि के समक्ष समता जैसे सिद्धांत भी उपरोक्त तीनों देशों के संविधान से नदारद हैं। वे भारत की तरह गणतंत्र भी नहीं, जहां राष्ट्रप्रमुख निर्वाचित होता है। अद्र्ध लोकतंत्र सेनेगल, ईसाई सिद्धांतों को आधार मानने वाला पापुआ न्यू गिनी और रोमन कैथोलिक धर्म को संवैधानिक रूप से सहयोग देने वाले अर्जेंटीना जैसे देश इस सूची में भारत से ऊपर हैं। इस रिपोर्ट के हास्यास्पद होने की कल्पना इसी तथ्य से की जा सकती है कि इसमें उस मालदीव को भारत से ऊपर स्थान दिया गया है, जिसका संविधान कहता है कि केवल मुस्लिम ही देश के नागरिक बन सकते हैं।

वी-डेम और फ्रीडम हाउस की तरह फ्रांसीसी एनजीओ रिपोर्टर्स विदाउट फ्रीडम (आरएसएफ) ने प्रेस की स्वतंत्रता के पैमाने पर अफ्रीकी राष्ट्र बुर्किनाफासो को 36वें स्थान पर रखा है, जबकि भारत को 142वां स्थान दिया है। यह तब है जब अमेरिकी विदेश विभाग यह कह चुका है कि बुर्किनाफासो में अभी भी दास प्रथा जारी है, जिसके सबसे बड़े शिकार वहां के बच्चे होते हैं।

भारत से कथित बेहतर इन देशों के संविधानों की पड़ताल कर मैं इस नतीजे पर पहुंचा हूं कि एक आदर्श लोकतंत्र में आठ आधारभूत अवयव अवश्य होने चाहिए अभिव्यक्ति एवं अंत:करण की स्वतंत्रता से जुड़ी अक्षुण्ण प्रतिबद्धता, पंथनिरपेक्षता को लेकर असंदिग्ध प्रतिबद्धता, धर्म एवं राज्य में पृथक्करण, सरकार का गणतांत्रिक स्वरूप, विधि के समक्ष समता का अधिकार (जो भारतीय संविधान के अनु. 14 में है), प्राण एवं दैहिक स्वतंत्रता का अधिकार (जो हमें अनु. 21 के तहत प्राप्त है), लैंगिक समानता और सार्वभौमिक वयस्क मताधिकार। भारत में ये सभी आठ तत्व विद्यमान हैं, परंतु भारत से ऊपर रखे गए तमाम कथित लोकतंत्रों में इनका अभाव है।

भारत दुनिया का सबसे बड़ा और सबसे गतिशील एवं जीवंत लोकतंत्र है। यह विश्व का सबसे विविधता भरा और उदार देश भी है। ऐसे में भारतीय नागरिकों के लिए आवश्यक है कि वे ऐसी हास्यास्पद एवं भ्रामक रपटों का उसी भाव से तिरस्कार करें, जिसकी वे हकदार हैं।

राजनीति की गिरफ्त से निकले पुलिस

इन दिनों मुंबई पुलिस तमाम गलत कारणों से पूरे देश में चर्चा का विषय बनी हुई है। आज से कुछ दशक पहले मुंबई पुलिस देश की सर्वश्रेष्ठ पुलिस में गिनी जाती थी। मुझे याद है कि एक समय उत्तर प्रदेश में श्रीप्रकाश शुक्ला का आतंक अपने चरम पर था। एक दिन शाम साढे़ सात बजे के करीब उसने लखनऊ के मुख्य थाने हजरतगंज के एसएचओ को सरेआम गोलियों से भून दिया। तब मुझे पुलिस विभाग द्वारा ‘बांबे क्राइम ब्रांच’ का अध्ययन कर उत्तर प्रदेश पुलिस में तदनुसार सुधार कर कुछ नई व्यवस्था बनाने का प्रस्ताव देने को कहा गया, जिसकी परिणति आज की एसटीएफ है। इसका नियंत्रण सीधे डीजीपी (पुलिस महानिदेशक) के अंतर्गत रखा गया, ताकि इसकी हर गतिविधि से मुख्यमंत्री भी अवगत रहें। आज भी यह फोर्स आशा के अनुरूप परिणाम दे रही है और उत्तर प्रदेश पुलिस की शान है। उधर मुंबई पुलिस की दुर्गति होती गई। इसका एक फौरी कारण तो यह जान पड़ता है कि मुंबई पुलिस आयुक्त यानी सीपी और मुख्यमंत्री के बीच एक ऐसे गृहमंत्री आ गए, जो सहयोगी पार्टी-एनसीपी यानी राष्ट्रवादी कांग्रेस पार्टी के सदस्य थे। उनकी निष्ठा अपने नेता के प्रति थी, न कि मुख्यमंत्री के प्रति। शरद पवार जैसे अनुभवी नेता और मुख्यमंत्री उद्धव ठाकरे को सोच समझकर यह जिम्मेदारी किसी संजीदा व्यक्ति को देनी चाहिए थी। गृहमंत्री पद से इस्तीफा देने को बाध्य हुए अनिल देशमुख में वैसी संजीदगी बिल्कुल नहीं झलकती। यह भी हैरान करता है कि उन पर सहायक पुलिस इंस्पेक्टर सचिन वाझे के जरिये सौ करोड़ रुपये महीने की वसूली कराने के आरोप लगे और फिर भी उन्होंने पद छोड़ने की जरूरत नहीं समझी। न मुख्यमंत्री ने उनसे इस्तीफा मांगा और न ही शरद पवार ने उन्हें इस्तीफे की सलाह दी। उलटे उन्होंने देशमुख का बचाव किया।

यदि बंबई उच्च न्यायालय ने सौ करोड़ वसूली मामले की सीबीआइ जांच के आदेश नहीं दिए होते तो शायद देशमुख अभी भी अपने पद पर बने रहते। मुंबई पुलिस की फजीहत यह बताती है कि जब कई पार्टियों को मिलाकर सरकारें बनें तो गृह विभाग हर हाल में मुख्यमंत्री को अपने पास रखना चाहिए। प्रशासन की रीढ़ पुलिस ही है। इसीलिए विपक्ष हमेशा कानून-व्यवस्था के मुद्दों पर ही हमला करता है, क्योंकि ये ही मुद्दे जनता को आसानी से समझ में आते हैं। मीडिया का भी यह मुख्य मुद्दा होता है। कल्पना करें कि यदि उत्तर प्रदेश जैसे बड़े राज्य में मुख्यमंत्री गृह विभाग अपने पास नहीं रखते या फिर किसी अन्य को गृहमंत्री बनाते तो क्या होता? शायद तब यहां भी स्थिति भिन्न होती। गृह विभाग खुद मुख्यमंत्री के पास होने का असर पूरे पुलिस विभाग में दिखता है। अपराध हों या आपदा, पुलिस अपना शत प्रतिशत योगदान देती दिखती है। पुलिस अफसरों को मालूम है कि जब तक वे सही हैं, तभी तक सुरक्षित हैं, वरना उन्हें कोई नहीं बचा सकता। कानपुर में हुए बिकरू कांड में अपनी गलत भूमिका को लेकर कई पुलिस अधिकारी निलंबित हैं। एक पुलिस अफसर को भ्रष्टाचार में संलिप्तता के कारण रिटायर होने से दो दिन पहले जेल जाना पड़ा। आधे दर्जन आइपीएस अधिकारी या तो निलंबित हैं या मुख्यालय से संबद्ध हैं। अब तो अनुपयोगी दागी अधिकारियों को समय से पहले ही सरकार रिटायर कर रही है। यह काम हर राज्य में होना चाहिए।

मुंबई में पुलिस आयुक्त परमबीर सिंह की नियुक्ति की आलोचना जूलियो रिबेरो जैसे ख्याति प्राप्त पुलिस अधिकारी ने भी की है। पिछले दिनों पद से हटाए जाने के बाद परमबीर सिंह ने मुख्यमंत्री को पत्र लिखकर बताया कि गृहमंत्री अनिल देशमुख ने निलंबित सहायक पुलिस इंस्पेक्टर सचिन वाझे को प्रतिमाह सौ करोड़ रुपये की उगाही का आदेश दिया था। अच्छा होता कि उन्हें जिस दिन यह बात मालूम हुई थी, उसी दिन मुख्यमंत्री से मिलकर पूरी बात बताते। अब वाझे की करतूतों का पर्दाफाश धीरे-धीरे हो रहा है। जिस तरह से उसने सब कुछ किया, संभव है, उसमें कुछ संगठित अपराधी गिरोह भी शामिल हों। एक पुलिस इंस्पेक्टर ऐसा कर सकता है या करने की सोच सकता है, यह सामान्य कल्पना के परे है। अब सचिन वाझे ने यह चिट्ठी लिखकर सनसनी मचा दी है कि एक और मंत्री ने 50 करोड़ रुपये लेकर किसी मामले की जांच बंद करने और बीएमसी के ठेकेदारों से सौ करोड़ रुपये वसूलने को कहा था। पता नहीं, सच क्या है, लेकिन ऐसी चिट्ठियों से पुलिस के साथ सरकार की भी फजीहत होती है।

सुशांत सिंह राजपूत के मामले में अनिल देशमुख की रोज प्रेस कांफ्रेंस होती थी, जबकि ऐसा पुलिस कमिश्नर को नियमित रूप से करना चाहिए था। गृहमंत्री के रूप में देशमुख की अनावश्यक सक्रियता से ऐसा आभास होता था, जैसे वही सब कुछ हों, मुख्यमंत्री, डीजीपी और सीपी कुछ नहीं। दरअसल सर्वोच्च स्तर पर बड़े पुलिस बल को नियंत्रित रखते हुए उसे अभिप्रेरित कर वांछित कार्य करा लेना एक पेशेवर अनुभवी अधिकारी के बूते की ही बात है। इसमें उसकी सामान्य विभागीय छवि, कार्यकुशलता और विश्वसनीयता जैसे गुण सम्मिलित रहते हैं। ऐसे अधिकारी के चयन में विशेष सावधानी बरती जानी चाहिए। चयन के बाद उसका निर्धारित कार्यकाल होना चाहिए और उसके काम में राजनीतिक हस्तक्षेप कम से कम होना चाहिए। इस संबंध में सितंबर 2006 में वरिष्ठ पुलिस अधिकारी प्रकाश सिंह की याचिका पर सुप्रीम कोर्ट ने दिशा-निर्देश जारी किए थे, परंतु राज्यों ने अब तक उन्हें पूर्णत: लागू नहीं किया है। इसी कारण राजनीतिज्ञ, पुलिस और अपराधी गठजोड़ टूट नहीं पा रहा है और जब-तब हास्यास्पद एवं शर्मनाक स्थितियां पैदा हो जा रही हैं। व्यापक प्रशासनिक हित में यही है कि सुप्रीम कोर्ट के दिशा-निर्देशों को संस्थागत रूप दिया जाए, ताकि सभी प्रदेशों में सरकारें चाहे जिसकी और जैसी भी हों पुलिस-प्रशासनिक व्यवस्था उच्चकोटि की बनी रहे।

भारत और सऊदी अरब के बीच कच्चे तेल की कीमतों को लेकर लंबे समय से चली आ रही असहमति हाल के सप्ताहों में खुलकर सामने आ गई। फरवरी में सऊदी अरब भारत को कच्चे तेल का निर्यात करने के मामले में शीर्ष चार देशों से बाहर हो गया और वहां से केवल 18 लाख टन तेल भारत आया। यानी फरवरी में इराक, संयुक्त अरब अमीरात, अमेरिका और नाइजीरिया ने सऊदी अरब की तुलना में भारत को अधिक तेल निर्यात किया। ऐसी खबरें भी सामने आई हैं कि भारत की सरकारी रिफाइनरी मई में सऊदी अरब से होने वाले तेल आयात में एक तिहाई से अधिक की कटौती करेंगी। आमतौर पर रिफाइनर हर महीने सऊदी अरब से 1.5 करोड़ बैरल कच्चा तेल खरीदती हैं जो मई में घटकर 95 लाख बैरल रह जाएगा। भारत पहले ही पेट्रोलियम निर्यातक देशों के संगठन (ओपेक) से उत्पादन कटौती को लेकर शिकायत कर चुका है। कटौती का उद्देश्य कच्चे तेल की कीमतों को कम से कम इतना बढ़ाना था जिस स्तर पर वह इन देशों को आर्थिक रूप से व्यावहारिक नजर आए। सऊदी अरब मनमाने ढंग से कहीं और अधिक कटौती की योजना बना चुका था।

हालांकि सऊदी अरब ने गत सप्ताह ओपेक बैठक में कहा कि वह कटौती को धीरे-धीरे कम होगा। भारत लगातार प्रयास कर रहा है कि कच्चे तेल के क्षेत्र में खाड़ी देशों पर उसकी निर्भरता कम हो जाए। ओपेक देशों, खासकर उसके अनाधिकारिक नेता सऊदी अरब और भारत के बीच लंबे विवाद की जड़ें एशियाई प्रीमियम की धारणा में निहित हैं जिसके तहत यह माना जाता है कि भारत, चीन, जापान और कोरिया जैसे एशियाई देशों को प्रति बैरल तेल के लिए यूरोप और उत्तरी अमेरिका के ग्राहकों की तुलना में से अधिक कीमत चुकानी चाहिए। भारत के पेट्रोलियम मंत्री छह वर्ष से ओपेक देशों के साथ यह मुद्दा उठा रहे हैं और उनका दावा है कि प्रति बैरल दो से तीन डॉलर प्रीमियम राशि वसूली जा रही है। इस विषय पर हुआ अकादमिक शोध इतने अंतर का समर्थन नहीं करता लेकिन यह भी संभव है कि ज्यादातर समय समूह उत्तरी अमेरिका और कुछ यूरोपीय उपभोक्ताओं को मामूली रियायत देता है। हाल ही में जब सऊदी अरब की सरकारी तेल कंपनी सऊदी अरामको ने अन्य बाजारों के लिए तेल के दाम कम किए और एशियाई देशों के लिए उसके दाम बढ़ाए तब भी भारत ने नाराजगी जताई थी। भारत के लिए दिक्कत यह है कि यदि वह ओपेक समूह से भिडऩा चाहता है तो उसे चीन और जापान समेत अन्य बड़े एशियाई आयातकों के साथ गठजोड़ बनाना होगा। इस दिशा में कुछ प्रयास किए गए हैं लेकिन साफ है कि बड़े एशियाई खरीदारों के बीच इतनी एकता नहीं है कि वे अभी ओपेक को प्रभावित कर सकें।

भारत सरकार को पेट्रोल और डीजल के ऊंचे दामों के लिए आलोचना का सामना करना पड़ रहा है और बढ़ते घाटे की भरपाई के लिए वह ईंधन करों पर निर्भर है। ऐसे में उसका यह सोचना स्वाभाविक है बड़ा और बढ़ती खपत वाला आयातक होने के नाते उसे उचित कीमत पर कच्चा तेल मिले। फिर भी अभी यह स्पष्ट नहीं है कि क्या किसी अन्य मुल्क से निपटने के लिए ऐसा कूटनीतिक विवाद उचित है। विदेश नीति बनाने का काम पेट्रोलियम मंत्रालय का नहीं है। पाकिस्तान के प्रबंधन, आतंकवाद विरोधी सहयोग और प्रत्यक्ष विदेशी निवेश की आवक जैसे मामलों में सऊदी अरब भारत का अहम साझेदार है। बड़ी तादाद में भारतीय प्रवासी भी वहां रहते हैं। उनके रोजगार से भारत को जरूरी विदेशी मुद्रा मिलती है। भारत और सऊदी अरब के व्यापक रिश्ते कीमतों को लेकर गैर कूटनीतिक लड़ाई से प्रभावित नहीं होने चाहिए।
