Write Laws For Bharat

Bills discussed by Parliament and court judgments must be simply written and easily translatable

In 2021, the Indian Parliament enacted or amended 41 laws. These ranged from laws which regulate having children through surrogacy to those that promote transportation of cargo via rivers. During the same time, the Supreme Court, according to its website, gave 866 judgments. These included judgments on bitterly contested issues – whether governments should have any role in constituting specialised tribunals, as well as decisions of wide public import – striking down antibuyer clauses that building developers insert into contracts.

Despite laws shaping nearly every aspect of our lives, in 2021, like every other year before it, public discussion around laws and judgments remained confined to “experts”. With the notable exception of the three farm bills, laws remained far removed from public debate and discussion. Even when it came to the farm bills, the actual content of the laws themselves were secondary – the rushed manner in which Parliament enacted them together with the perception that they marked the retreat of the state from agriculture cornered public attention.

This non-engagement with laws is not accidental – it is a matter of design. Laws in colonial India were written in English, using language that even ordinary English speakers in India could not easily understand. Archaic words (“hereinunder”, “notwithstanding”), over-use of Latin expressions (“mutatis mutandis”, “ipso facto”) and unpardonably long sentences were all justified in the name of drafting precision. Needless to say, the fact that only a priestly class of lawyers and judges (mostly British) could grasp the content of these laws was not an unintended consequence.

What is unfortunate is that in India’s 75th year of independence, we continue to draft laws in this outdated manner. So defunct are such drafting practices that even the United Kingdom, from where we derived them in the first place, has itself switched to drafting laws in plain English so that its citizens understand them.

In 2022, my wish for laws in India is a simple one. Let them be SARAL – simple, actionable, reasoned and accessible laws. Let a law be drafted in simple language, capable of easy, automated translation and summary into any language spoken in India; let its provisions be actionable with necessary teeth to make them meaningful; let its mandates be reasoned, based on evidence and data rather than guesswork; and above all, let it be accessible, machine readable and visually impaired friendly.

Imagine if a provision in one of the farm laws instead of starting with the words “the provisions of this Act shall have effect, notwithstanding anything inconsistent therewith contained in any State APMC Act or any other law for time being in force …” said that “any minimum support price provided for paddy and wheat cultivation will not be taken away in any manner whatsoever by this Act”. This would have aided understanding, dispelled confusion, and may even have obviated the largest mass protest of 2021.

The SARAL framework is not limited to legislation alone. The reason why laws are generally perceived as inaccessible is because judgments that interpret laws are, at most times, unreadable. Primarily, this is a function of length. A cursory glance at SC judgments over the decades demonstrates how much longer judgments have become. Long judgments are more often than not a function of habit, rather than judicial rigour or necessity. Unedited quoting of case law, unnecessary detours into foreign law, copy-pasted reproduction of arguments made by lawyers, are all bad practices that have crept into Indian judgment writing.

Consider a simple comparison – the judgment of seven judges of the Supreme Court in 1951in Champakam Dorairajan’s case, the first judgment on the constitutionality of reservation in medical and engineering colleges, was a mere four pages. In comparison, the judgment of nine judges of the Supreme Court in Indra Sawhney’s case in 1992 on the constitutionality of OBC reservation ran to a whopping 556 pages. This is not because the issue was significantly more complex than in Champakam. It is primarily because, over the decades, little to no efforts were made to keep judgments succinct.

Apart from the length of its judgments, for the Supreme Court to remain relevant in 2022, its judgments must be actionable. Key to actionability is speed, so that disputes do not become redundant by the time judgments are pronounced. Over the course of 2021, the number of pending cases has increased from 65,086 to 69,855. Amongst these pending cases are matters of grave constitutional significance – the nullification of Article 370, the minority status of Aligarh Muslim University and the Pegasus spyware case.

But equally important are the scores of unnamed cases – bail petitions, property disputes, criminal appeals that languish in the Supreme Court along with the destinies of the parties before it. There is little point in getting justice if it’s too late to matter. The task of the Supreme Court in 2022 is really quite simple – clear up its backlog quickly so that its decisions continue to have meaning. Writing shorter judgments might help this task immensely!

Speaking on the eve of India’s first Independence Day, Jawaharlal Nehru had said: “To the people of India, whose representatives we are, we make appeal to join us with faith and confidence in this great adventure.” The great adventure is now 75 years and running. It is high time our representatives (and judges) redeem the Prime Minister’s pledge, cast off our colonial detritus of complexity and give the people their due – a SARAL law and justice framework.

Is it right to increase the age of marriage of women to 21?

Empowerment of women through education should be a priority irrespective of the law

In the recent session of Parliament, the government introduced the Prohibition of Child Marriage (Amendment) Bill, 2021, to raise the age of marriage for women from 18 years to 21 years. After Opposition MPs demanded greater scrutiny of the Bill, it was referred to the Parliamentary Standing Committee on Education, Women, Children, Youth and Sports. The government says the proposed law will ensure equal chance for women in higher education and access to jobs and help improve maternal mortality rate and nutrition levels. In a conversation moderated by Jagriti Chandra, Mary E. John and Noorjehan Safia Niaz discuss whether the Bill is welcome. Edited excerpts:

Mary E. John & Noorjehan Safia Niaz, [ Safia Niaz is co-founder of the Bharatiya Muslim Mahila Andolan; Mary E. John is former Professor and Acting Director at the Centre for Women’s Development Studies ]

Do you welcome the move to raise the age of marriage for women to 21 years in order to make it equal to the age of marriage for men?

Mary E. John: The minimum age of marriage could well be the same as the age of majority, which is 18 years. If the question of equality is so critical, the age of marriage for boys should also be 18 years. But we really need to put focus on what should be the minimum age, not the right age. When I look at the government’s pronouncements, the talk is about the right age for marriage. There has almost never been a reference to a minimum age. The law should prescribe a minimum age and I think 18 years is as good as any. It should continue to be a legal presumption, and there is no reason, therefore, to raise it to 21 years.

Noorjehan Safia Niaz: The main concern of this law is not so much about equality but to raise the age of marriage for women to 21 years. The law shows the way to society, right? When [the] 18 years [rule] also came in, there was some resentment to that. Whenever a law which is a little ahead of its time comes in, there will be some people who won’t like it. But the job of the law is also to show where we are moving as a society. If you look at urban metro cities, where girls are getting educated, that is one section of society that has moved ahead. And that section of society also needs certain protection by the law. But the issue here is of effective implementation of the law. Unless that improves, we are going to have problems of whether the age of marriage for girls is 18 years or 21 years.

Some Muslim MPs in Parliament have called the Bill an attack on personal laws because it proposes that it will override the personal laws of Muslims, Parsis, Hindus and Christians. It also says that some personal laws will be amended, though the Muslim Personal Law is not one of them. Do you then not see this as an attempt to encroach on religious laws?

Noorjehan Safia Niaz: If you have to really use the word ‘encroachment’ for personal laws, I would say that has been happening for the Muslim community for a long time, even before Independence. The British government brought the Shariat Application Act way back in 1937, and two years later, we had the Dissolution of Muslim Marriages Act, which codified the divorce law and gave the right to Muslim women for divorce. Then came the 1986 Act [Muslim Women (Protection of Rights on Divorce) Act]. Because we don’t have fully codified laws, we have had piecemeal legislation. In the 1986 Act, which came after the Shah Bano case, Parliament intervened on the demand of these very religious groups who don’t want parliamentary intervention now. The groups asked Parliament to override the Supreme Court judgment, which was in favour of Shah Bano. And then we have the triple talaq legislation where again Muslim women demanded an intervention by the state to end this practice. Look at the Hindu Marriage Act, which was codified in 1955. It includes the Sikhs and the Buddhists, who are religious minorities. So, the state recognises that each community is to be governed by their personal laws and if there are problems with the personal laws, then it steps in. The state has to be there to listen to grievances. The state has to play its role whether you are a majority or a minority. So, I don’t think this is encroachment. And if there’s a progressive law in the country, why should I be deprived of it just because I am a Muslim woman? There are laws for the Hindu community, which includes Sikhs, Buddhists and the Jains who are otherwise a religious minority. All aspects of the personal law such as marriage, divorce and custody are already codified, i.e. passed by Parliament. Christians are governed by their own personal law, and so are the Parsis. But because of the kind of politics that played out at the time of Partition, and the communalisation and the violence that Muslims faced as a minority, the issue of family law reform always took a back seat. The process of codification of laws began in 1937 [for Muslims], and had Partition not happened, I’m sure Muslims would have had a codified law probably earlier than the Hindu community. But after India gained Independence, there was absolutely no movement towards codifying the Muslim family law till Shah Bano went to court demanding maintenance. Then, too, the legislation went against the Supreme Court judgment. So, Muslim women were again deprived of the provisions of Section 125 of the Code of Criminal Procedure. Of course, later on, with the Danial Latifi judgment, the damage that that law caused was subverted. But the fact remains that this law [1986 Act] was an attempt to get Muslim women out of the ambit of all legislative protections and constitutional safeguards. And till date, we don’t have a codified family law.

We are in the 75th year of Independence and Muslims [constitute] 15% of the population of this country. But Muslims are deprived of the legal security which everybody else has. Our tragedy is that even 18 years as the year of marriage for girls is not fully implemented in the Muslim community. There have been contradictory High Court judgments: while some have held that the Prohibition of Child Marriage Act applies to the Muslim community, others have held that it does not. The Shariat law, which is again not codified, says the age of marriage is puberty or age 15. So, where is the protection even for the 18 years of marriage that everybody else has had for so many years? And that is why we are insisting that within this current Bill, a special mention has to be made that the Muslim community will also come under its ambit. Even if tomorrow 21 years is not implemented and even if the law is as it exists today, it should be made applicable to Muslims. To that extent, an amendment is necessary.

Mary E. John: Noorjehan has raised very important points about the sharp differences post-Partition which have been the subject of considerable debate in the women’s movement. Let us, therefore, take on board that it is not the same kind of question [for Muslim women]. But I just want to point out that if you look at the data on underage marriage, there is no difference between Hindus and Muslims. There are similar proportions of 26.6% in the National Family Health Survey-4 (2015-2016) data. If anything, there’s a slightly better picture on the part of the Muslims compared to the Hindus. So, the popular conception that Muslims are always backward compared to Hindus is not true here. As far as our underage marriage data goes, the pattern is much the same.

Noorjehan Safia Niaz: The Muslim community may be better on some of the parameters that we are discussing but the question is here of legal parity. Why are Muslims not on par with the rest of the citizens? If 18 is the age of marriage for the entire country, why should Muslim women be left behind? If polygamy is not allowed and if Section 494 of the Indian Penal Code governs Christians and Parsis, why should it be not applicable to Muslims as well? How long are Muslim women going to be suffering this, because we have been told time and again that our minority status is in danger. We have the provision of codifying our personal law to bring it on par with the society we are living in, and bring the best of provisions of the Quran. But if we don’t reform, the state will step in. The part of the community [that resists reform] will allow the state to step in.

The Bill says that it aims to reduce maternal mortality rates, improve nutrition indicators and ensure access to education and jobs for women. Will a law help achieve these goals?

Mary E. John: The claims that are being made that the nutritional status of the mother and child and maternal mortality rates will improve with the increase in the age of marriage simply do not hold up. If you look at higher ages at marriage, you will look at better data sets because higher ages at marriage correspond with better-off people with better health indicators. People who are wealthier marry at later ages. However, if you control for all these factors, and only concentrate on the factor of age, then you find that age plays the least significant role in any of these indicators. Anaemia is not affected by age at marriage and it is the cause for our terrible maternal mortality rates. Similarly, a poorly nourished woman does not become better nourished because she’s being married off three years later. And sex ratio is particularly off because States with the worst sex ratio, such as Punjab and Haryana, have higher-than-average ages at marriage. So, there is a lot of confusion here and the so-called scientific basis that is being put out by the government does not hold up.

Noorjehan Safia Niaz: The law is necessary, but it’s not sufficient. If the commercialisation of education continues, how are the poor, especially women and girls, going to access education? If our districts, villages and smaller towns don’t have health facilities, how are women going to access various schemes and programmes? So, these need to simultaneously get addressed.

Many have concerns over the manner in which the Prohibition of Child Marriage Act, 2006, is implemented and used mostly to criminalise young adults who elope to marry against the wishes of their parents, and have inter-faith or inter-caste marriages.

Noorjehan Safia Niaz: I understand there are issues. There are going to be problems. Any law when it comes into being does not play out equally for different sections of society. We are a huge country. We have different economic strata, different religions and caste compositions. And maybe that is where the courts come in and judges decide.

Mary E. John: Existing studies show that the Prohibition of Child Marriage Act is not being used to stop communities from holding underage marriages. It is being used by parents of a girl who is in a so-called elopement or love marriage that they are opposed to. So, please imagine what will happen tomorrow if the age is raised to 21. These women are not children. By the laws of the land, they are young adults who will find themselves at cross purposes with this new law whereby other adults will be able to render their relationships null and void and leave them in a complete legal limbo if not in a criminalised situation. In Nepal where the age of marriage was recently raised to 20 for both men and women, there are large numbers of young women in shelter homes simply because they’re in this legal limbo. Is this the kind of future we want the law to create for us?

जजों की इंटेलिजेंस को इस साल मिल सकती है एआई की तेजी

कोरोना के पिछले दो सालों में जिला अदालतों में 3.2 से 4 करोड़, हाईकोर्ट में 47 से 56 लाख और सुप्रीम कोर्ट में लंबित मामलों की संख्या 60 से बढ़कर 70 हजार हो गई है। अदालतों की कार्रवाई पहले बंद कमरों में होती थी, लेकिन अब ऑनलाइन सुनवाई के सूक्ष्म विवरण सोशल मीडिया के माध्यम से वायरल होने लगे हैं। जजों की बातों से साफ है कि लंबित मामलों के बारूदी ढेर से न्यायपालिका में भारी बेचैनी है। कानून मंत्री और राष्ट्रपति के अनेक बयानों से जाहिर है कि अदालतों में बदलाव का शंखनाद हो चुका है-

1. आर्टिफीशियल इंटेलिजेंस का इस्तेमाल- साल के अंत में जस्टिस चंद्रचूड़ नए चीफ जस्टिस बनेंगे जो ई-कमेटी के चेयरमैन हैं। उनके कार्यकाल में न्यायपालिका में तकनीकी व एआई के संस्थागत इस्तेमाल से सुधारों का नया दौर शुरू होने की उम्मीद है। मुकदमों का फैसला तो जजों की इंटेलिजेंस से ही होगा। लेकिन एआई से समान मामलों के वर्गीकरण के साथ तथ्यों व कानूनी प्रावधानों की समरी बन सकेगी। इससे मुकदमे के जल्द निपटारे, प्रशासनिक प्रक्रिया में कार्यकुशलता व पारदर्शिता बढ़ाने में मदद मिलेगी।

2. इंफ्रास्ट्रक्चर न्यायिक सुधार, जजों की नियुक्ति- अदालतों में इंटरनेट, सुरक्षा व इंफ्रास्ट्रक्चर बेहतर करने के साथ जजों की नियुक्ति प्रक्रिया में सुधार और अखिल भारतीय न्यायिक सेवा पर तेजी से बात बढ़ रही है। नए साल में रिटायर हुए सुप्रीम कोर्ट के जज सुभाष रेड्डी ने कहा है कि अंग्रेजी जमाने के कानूनी तंत्र से 21वीं सदी की अदालतों को नहीं चलाया जा सकता। इसके लिए संसद से कानूनी सुधार लागू करने के साथ अदालतों को भी अपनी प्रक्रिया दुरुस्त करने की जरूरत है। जज लोग अपने अपने घरों से बैठकर मामलों की सुनवाई कर रहे हैं, जिसके बारे में कोई नियम नहीं है. तो फिर जनता के हित में कानूनी प्रक्रियाओं को सरल करने की पहल भी नए साल में जजों को करनी ही होगी।

3. पुराने मामलों पर पहले फैसले का सिस्टम- रेलवे में कंप्यूटर के बाद ‘पहले आओ पहले पाओ’ के अनुसार जनता को पारदर्शी तरीके से रिजर्वेशन मिलने लगा। लेकिन न्यायपालिका में कंप्यूटराइजेशन के बावजूद पुराने मामलों को दरकिनार कर नए मामलों की मनमाफिक सुनवाई का कल्चर खत्म नहीं हुआ। आपराधिक मामलों में जब कई दशक लग जाएं तो पीड़ित व्यक्ति के लिए अदालती प्रक्रिया दर्दनाक बन जाती है। अजमेर में 30 साल पुराने सामूहिक दुष्कर्म कांड में पीड़ितों को अभी भी गवाही के लिए बुलाकर, उन्हें न्यायिक यातना ही दी जा रही है। जब तक पुराने मामलों में फैसला नहीं हो जाए तब तक नए मामलों को प्राथमिकता के आधार पर वीआईपी ट्रीटमेंट देना गलत, अनैतिक, गैर कानूनी है।

4. बेवजह के नोटिस बंद होने के साथ लोक अदालत का अभियान- चीफ जस्टिस रमना ने मुकदमेबाजी कम करने के लिए मध्यस्थता का रिवाज बढ़ाने की बात कही है। पिछले कई सालों से लोक अदालतों के माध्यम से बड़े पैमाने पर मुकदमे खत्म हो रहे हैं। लेकिन भारत में मुकदमेबाजी शातिर लोगों की कुचाल का संगठित तंत्र बन गया है। इसकी वजह से सही और पात्र लोगों को समय पर न्याय नहीं मिल पाता। कानून से देखें तो सिविल और पीआईएल के अधिकांश मामले फिजूल के होते हैं। उन मामलों में नोटिस जारी करने की बजाय शुरुआती कठोर आदेश और जुर्माने से मुकदमेबाजी के मर्ज़ को जड़ में खत्म किया जा सकता है। छोटी सजा, जुर्मानों के आपराधिक मामलों में भी लंबी तारीखों में सुनवाई टालने की बजाय, जल्द फैसला होने से लाखों लोगों को राहत मिलेगी।

5. शिकायत निवारण के लिए सोशल मीडिया में तंत्र बने- हाईकोर्ट और सुप्रीम कोर्ट में पत्र याचिका के आधार पर कई बार मामले दर्ज होते हैं। लेकिन मुकदमेबाजी से पीड़ित गांव-देहात की निरीह जनता के लिए शिकायत दर्ज कराने का कारगर तंत्र अभी तक नहीं बना। अदालतों से जुड़े मामलों में दुखी लोग व्हाट्सएप और सोशल मीडिया के माध्यम से अपनी शिकायतें दर्ज करा सकें, जिसपर समयबद्ध तरीके से कार्रवाई हो। ऐसा सिस्टम बनने पर जनता का न्यायपालिका पर भरोसा बढ़ेगा और नए साल में मुकदमों के अंबार से मुक्ति का अभियान सार्थक मुकाम तक पहुंचेगा।

संवैधानिक दायित्वों की भी अनदेखी

पांच जनवरी को प्रधानमंत्री नरेन्द्र मोदी का पंजाब के बठिंडा, हुसैनीवाला और फिरोजपुर में पूर्व निर्धारित कार्यक्रम था। इस कार्यक्रम की रूपरेखा भी पहले ही तैयार हो चुकी थी। इसका अर्थ है कि प्रधानमंत्री के दौरे की व्यवस्था कम से कम कागजों पर तो तैयार कर ही दी गई थी। दिल्ली से बठिंडा प्रधानमंत्री वायुयान से पहुंचे। वहां से उन्हें हेलीकाप्टर द्वारा हुसैनीवाला जाना था। फिर उन्हें फिरोजपुर जनसभा में सम्मिलित होना था। इस बीच मौसम की खराबी के कारण फैसला किया गया कि प्रधानमंत्री हेलीकाप्टर के बजाय सड़क मार्ग से जाएंगे। बठिंडा से हुसैनीवाला की दूरी करीब 110 किमी है। इसी दौरान वह अप्रत्याशित घटना घटी, जिसमें लगभग 30 किमी आगे बढ़ने पर प्रधानमंत्री का काफिला एक फ्लाईओवर पर अटक गया। इस अटकाव का कारण वहां बड़ी संख्या में प्रदर्शनकारियों का जमावड़ा था। इससे एक बड़ा जोखिम उत्पन्न हो गया। चिंतित करने वाला एक पहलू यह था कि उक्त स्थान पाकिस्तान सीमा से 15-20 किलोमीटर दूर है।

पंजाब सरकार का दावा है कि प्रधानमंत्री के कार्यक्रम को देखते हुए उसने 10,000 सुरक्षाकर्मी तैनात किए थे, परंतु उपलब्ध साक्ष्य यही इंगित करते हैं कि न केवल मार्ग, बल्कि छतों पर भी ड्यूटी नगण्य थी। सुरक्षा का सारा दारोमदार एसपीजी पर डालने का भी प्रयास हो रहा है। इससे ज्यादा भ्रामक तो कुछ और हो ही नहीं सकता, क्योंकि एसपीजी पर समीप की सुरक्षा का जिम्मा होता है। वह स्थानीय पुलिस से समन्वय बनाकर विशिष्ट व्यक्ति के जीवन पर जोखिम का आकलन कर आवश्यक कार्रवाई करती है। पंजाब के पुलिसकर्मी अपने कर्तव्य की पूर्ति करते नहीं दिखे। खराब हालात का अनुमान इसी से लगाया जा सकता है कि कई प्रदर्शनकारी प्रधानमंत्री के काफिले के सात-आठ फीट नजदीक तक पहुंच गए। उन्होंने रास्ता अवरुद्ध कर दिया। ऐसे में तत्काल यू-टर्न संभव नहीं था। इस कारण पीएम का काफिला 20 मिनट फंसा रहा। यह बहुत लंबी अवधि है। एक ग्रेनेड 36 सेकंड में फट जाता है। स्नाइपर राइफल और क्लोज क्वार्टर वेपन का इस्तेमाल कर विशिष्ट व्यक्ति को क्षति पहुंचाई जा सकती थी। यह भी सर्वविदित है कि पाकिस्तान से ड्रोन के माध्यम से विस्फोटक और अन्य सामग्री यहां भेजी जाती रही है। कदाचित यही कारण था कि प्रधानमंत्री जब ब¨ठडा वापस आए तो उन्होंने एयरपोर्ट पर अधिकारियों से यह कहा कि अपने मुख्यमंत्री को धन्यवाद कहिएगा कि मैं यहां तक जीवित लौट सका।

प्रधानमंत्री की सुरक्षा में सेंध से ज्यादा दुर्भाग्यपूर्ण और शर्मनाक घटना हो ही नहीं सकती, लेकिन इस पर आरोप-प्रत्यारोप का दौर जोरों पर है और गैर-जिम्मेदाराना बयानों की भरमार है। पंजाब सरकार द्वारा अपने बचाव में यह तक कहा जा रहा कि वीआइपी की सकुशल यात्र सुनिश्चित कराने का दायित्व एसपीजी का था। इससे अधिक अनर्गल आरोप संभव नहीं है। ऐसे आरोप लगाने वाले पहले एसपीजी एक्ट, 1988 और एसपीजी एक्ट (संशोधन), 2019 का अध्ययन कर लें तो चीजें स्पष्ट हो जाएंगी। यह भी कहा गया कि हेलीकाप्टर से न जाकर सड़क मार्ग से जाने का निर्णय अचानक से लिया गया। ऐसे निर्णय अचानक ही लिए जाते हैं। बेहतर होता कि इस संबंध में पुलिस महानिदेशक मुख्यालय द्वारा जो परिपत्र निर्गत किए गए थे, उनका अनुपालन सुनिश्चित किया जाता। वैकल्पिक मार्ग, जो पहले से ही सुनिश्चित था, पर प्रभावी पुलिस व्यवस्था सुनिश्चित की जानी चाहिए थी। वे जो तथाकथित 10,000 पुलिसकर्मी तैनात थे, उनके बारे में आडिट होना चाहिए कि वे कहां पर तैनात थे और उनका मार्गदर्शन कौन कर रहा था? वे जिस भाव-भंगिमा में दिखाई पड़े और बेपरवाह तरीके से प्रदर्शनकारियों के साथ चाय पीते दिखे, वह कतई अस्वीकार्य है। पंजाब पुलिस देश की मानी हुई पुलिस है। उसकी प्रतिष्ठा है, पर अपरिपक्व मार्गदर्शन और नेतृत्व में जो घटना घटित हुई, वह निंदनीय होने के साथ-साथ दंडनीय भी है।

यह समझ से परे है कि राज्य के मुख्य सचिव और पुलिस महानिदेशक प्रधानमंत्री की अगवानी में क्यों नहीं गए? ऐसा व्यवहार अप्रत्याशित और असामान्य है। यह प्रकट हो रहा है कि प्रदर्शनकारियों को वैकल्पिक मार्ग का पता चल गया था और इसी कारण उन्होंने पीएम के काफिले को अवरुद्ध किया। प्रधानमंत्री के काफिले की सुरक्षा की जिम्मेदारी एसपीजी और बीएसएफ पर डालने की बात भी अनुचित है। विशिष्ट व्यक्ति की सुरक्षा में बीएसएफ का कोई योगदान नहीं होता। एसपीजी की भूमिका एसपीजी एक्ट और ब्लू बुक के अंतर्गत आती है। एडवांस सिक्योरिटी संबंधी बैठकों में यह पहले ही स्पष्ट हो जाता है कि किसकी क्या भूमिका और उत्तरदायित्व रहने वाला है? अपनी जिम्मेदारियों से भागना और दोषारोपण करने से दुर्भाग्यपूर्ण और कुछ नहीं। मैंने अपने 36 साल के सेवाकाल में अनेक विशिष्ट व्यक्तियों का आगमन सुनिश्चित कराया है, लेकिन ऐसी र्दुव्‍यवस्था कभी नहीं देखी। उन 15-20 मिनटों में प्रधानमंत्री के साथ किसी भी प्रकार की दुर्घटना हो सकती थी। यह समझा जाना चाहिए कि इस प्रकरण से देश के संवैधानिक ताने-बाने को भी क्षति पहुंची है। राज्य सरकार द्वारा अपने संवैधानिक उत्तरदायित्व का निर्वहन करने के बजाय उलटे आरोप लगाए जा रहे हैं। प्रधानमंत्री की सुरक्षा के साथ खिलवाड़ का यह मामला सर्वोच्च न्यायालय की देहरी तक भी पहुंच गया है। इतने गंभीर प्रकरण की जांच या तो सुप्रीम कोर्ट की निगरानी में हो या फिर सीबीआइ यह जांच करे। यह घटना स्वस्थ संकेत नहीं। केंद्र सरकार को एक श्वेत पत्र निर्गत करना चाहिए कि कहां किस प्रकार की त्रुटियां हुईं? उसमें जवाबदेही भी तय की जाए। इसके साथ ही जो दोषी हैं उनके विरुद्ध कार्रवाई भी सुनिश्चित करनी होगी। हम एक लोकतंत्र हैं और संवैधानिक उत्तरदायित्वों से बंधे हुए हैं। स्वस्थ राजनीति में प्रतिद्वंद्विता होती ही है और राजनीतिक मतभेद भी, परंतु उनके चलते कर्तव्य की अनदेखी नहीं होनी चाहिए। राजनीतिक महत्वाकांक्षा इतनी बेलगाम न हो कि वह संवैधानिक उत्तरदायित्व से ही विमुख कर दे।

प्रधानमंत्री की सुरक्षा से जो खिलवाड़ हुआ वह अत्यंत दुर्भाग्यपूर्ण है। इस पर गंभीर मंथन होना चाहिए कि जो हुआ, क्या वह होना चाहिए था और यदि नहीं तो इसकी पुनरावृत्ति रोकने के लिए क्या किया जाए? यह इसलिए आवश्यक है, क्योंकि ऐसी घटना की पुनरावृत्ति किसी राज्य, किसी दल की नहीं, बल्कि देश का अहित करेगी।

रोजगार सृजन की चुनौती से जूझ रहा भारत

दिसंबर 2021 में बेरोजगारी दर बढ़कर 9.7 प्रतिशत हो गई। नवंबर में यह दर 7 प्रतिशत रही थी। एक वर्ष पहले दिसंबर 2020 में बेरोजगारी दर 9.1 प्रतिशत के ऊंचे स्तर पर थी। विगत कुछ दिनों की तुलना में भारत में इस समय बेरोजगारी दर ऊंचे स्तर पर है। वर्ष 2018-19 में यह दर 6.3 प्रतिशत रही थी जबकि 2017-18 में यह 4.7 प्रतिशत दर्ज की गई थी।

अक्टूबर, नवंबर और दिसंबर इन तीनों महीनों में प्रत्येक में बेरोजगारी दर 7 प्रतिशत या इससे अधिक रही है। दिसंबर 2021 में समाप्त तिमाही में बेरोजगारी दर 7.6 प्रतिशत थी। इससे पहले सितंबर 2021 तिमाही में यह दर 7.3 प्रतिशत रही थी। देश में इस समय बेरोजगारी दर 7 प्रतिशत से अधिक है और महंगाई दर भी सहज स्तर यानी 4 प्रतिशत से अधिक (5 प्रतिशत) हो गई है। ये दोनों परिस्थितियां भारत के लिए एक के बाद एक चुनौती पेश कर रही हैं। निकट भविष्य में महंगाई में इजाफा होने का अंदेशा है, वहीं इस बात का भी कोई संकेत नहीं है कि बेरोजगारी दर में बहुत कमी आ सकेगी। इस वजह से मौजूदा स्थिति की तुलना में आने वाला समय आर्थिक परिदृश्य के लिहाज से और बदतर लगता है।

दो और स्थितियां बनती दिख रही हैं। पहली बात तो भारतीय रिजर्व बैंक (आरबीआई) द्वारा नीतिगत दरें नहीं बढ़ाने के बावजूद दरें बढ़ रही हैं। बैंकों की उधारी दर तो कमोबेश स्थिर लग रही है मगर बाजार दरें बढ़ रही हैं। आधार दर और एमसीएलआर (बैंकों की उधारी दरें परिलक्षित करने वाली दरें) सभी लगभग स्थिर हैं या हाल के दिनों में कम हो रही हैं। मगर विभिन्न परिपक्वता अवधि वाले ‘एएए’ रेटिंग वाले कॉर्पोरेट बॉन्ड पर प्रतिफल बढ़ रहे हैं। इस बात की गुंजाइश कम ही है कि बैंक अब लंबे समय तक मौजूदा ब्याज दर बरकरार रख पाएंगे। दिसंबर मध्य में एसबीआई ने पिछले दो वर्षों में पहली बार आधार दर बढ़ा दी थी। दूसरी बात यह है कि 2021 में अधिकांश समय डॉलर की तुलना में रुपये में गिरावट देखी गई। दिसंबर 2021 तक डॉलर की तुलना में रुपया 75.5 प्रतिशत के स्तर तक पहुंच चुका था। जनवरी 2021 से यह 3 प्रतिशत लुढ़क चुका था।

घरेलू उपभोक्ताओं के स्तर पर मांग में कमी और क्षमता का इस्तेमाल कम रहने से भारत में निवेश पर प्रतिकूल असर हुआ है। अब ब्याज दरों में तेजी और रुपये के मूल्य में ह्रास हालात और कठिन बना सकते हैं। नए उद्यमों में निवेश में तेजी आने तक रोजगार में वृद्धि कमतर रहेगी। ढांचागत क्षेत्र में नए निवेश निर्माण खंड में रोजगार सृजन में मदद कर सकती है मगर यह मध्यम वर्ग के वेतनभोगी लोगों के लिए पर्याप्त रोजगार नहीं ला पाएगा।

कोविड-19 महामारी से उत्पन्न हालात के बाद अर्थव्यवस्था कमजोर हो गई थी। अब 18 महीने बीतने के बाद भी उपलब्ध रोजगार इस महामारी से पूर्व के स्तरों तक नहीं पहुंच पाए हैं। 2019-20 में भारत में 40.89 करोड़ लोग रोजगार में थे। मगर उस समय से देश में कुछ ही समय के लिए 40.6 करोड़ लोग रोजगार से जुड़े रहे हैं। भारत में कार्य करने लायक आबादी बढ़ी है मगर कोविड-19 महामारी के बाद यहां रोजगार के अवसर कम हुए हैं। यह एक मात्र त्रासदी नहीं है। हालात में सुधार तो जरूर हुए हैं मगर इससे रोजगार की संरचना ही बिगड़ गई है। 2019-20 में वेतनभोगी कर्मचाारियों की संख्या रोजगार में लगे कुल लोगों की संख्या की 21.2 प्रतिशत थी। दिसंबर 2021 में इनकी हिस्सेदारी केवल 19 प्रतिशत थी।

दिसंबर 2021 में रोजगार में लगे लोगों की संख्या 40.6 करोड़ थी। यह 2019-20 की संख्या से 29 लाख कम थी। रोजगार में कमी का कुछ खास खंडों पर अधिक असर देखा गया। सबसे अधिक कमी वेतनभोगी कर्मचारियों की संख्या में आई थी। इस खंड में 95 लाख नौकरियां गई थीं। उद्यमियों के खंड में 10 लाख नौकरियां चली गईं। इन 1.05 करोड़ रोजगारों की कमी की भरपाई दैनिक मजदूरी करने वाले श्रमिकों और कृषि क्षेत्रों में बढ़े रोजगारों से तो गई मगर गुणवत्ता प्रभावित हो गई।

विभिन्न उद्योगों में दिसंबर 2021 और 2019-20 के बीच रोजगार में अंतर दर्शाता है कि विनिर्माण क्षेत्र में 98 लाख नौकरियां गई हैं। मगर निर्माण क्षेत्र में नौकरियां 38 लाख और कृषि क्षेत्र में रोजगार 74 लाख बढ़ गए। सेवा क्षेत्र में 18 लाख लोगों की नौकरियां चली गईं। सेवा उद्योगों में होटल एवं पर्यटन में 50 लाख नौकरियां गईं और शिक्षा क्षेत्र में 40 लाख रोजगार छिन गए मगर खुदरा कारोबार में 78 लाख रोजगार सृजित हुए। वैसे तो सभी नौकरियां अपने आप में खास होती हैं मगर यह कहा जा सकता है कि विनिर्माण क्षेत्र की नौकरियां निर्माण एवं कृषि क्षेत्रों में रोजगारों की तुलना में अधिक गुणवत्तापूर्ण होती हैं। सेवा क्षेत्र में होटल पर्यटन या शिक्षा में रोजगार खुदरा कारोबार की तुलना में बेहतर गुणवत्ता वाले होते हैं। खुदरा कारोबार में लोग ज्यादातर डिलिवरी एजेंट के रूप में काम करते हैं। भारत तभी बेहतर गुणवत्ता वाले रोजगार सृजित कर पाएगा जब रोजगार सीधे सरकार या बड़ी निजी कंपनियों की तरफ से आएंगे।

बढ़ती महंगाई, ब्याज दरों में तेजी और रुपये में कमजोरी के साथ उपभोक्ताओं की तरफ से मांग में कमी बड़ी कंपनियों को निवेश के लिए आकर्षित करने की राह में सबसे बड़ी बाधा हैं। बड़ी कंपनियां निवेश नहीं करेंगी तो रोजगार की गुणवत्ता भी प्रभावित होगी। वेतनभोगी नौकरियों में लगातार कमी चिंता का विषय है। ऐसी नौकरियां सितंबर और अक्टूबर 2021 में बढ़कर 8.4 करोड़ हो गई थीं मगर तब से नवंबर और दिसंबर में कम होकर 7.7 करोड़ रह गईं। दिसंबर 2021 में भारत में 39 लाख नए रोजगार सृजित हुए मगर वेतनभोगी नौकरियों में कोई इजाफा नहीं हुआ। इनमें गिरावट थामना और कुल रोजगार में इनकी हिस्सेदारी बढ़ाना जरूरी है। केवल रोजागर में मामूली बढ़ोतरी से काम नहीं चलेगा।

विषमता भरे समाज की दुश्वारियां

फ्रांसीसी अर्थशास्त्री थामस पिकेटी ने अपनी पुस्तक कैपिटल ऐंड आइडियोलाजी में सहभागी समाजवाद की अवधारणा प्रस्तुत करते हुए कहा कि अर्थव्यवस्था में भाग लेने की शक्ति हर किसी के पास है। वह यह भी तर्क देते हैं कि श्रमिकों को अपनी कंपनियों के संचालन में अधिक सहभागिता करने में सक्षम होना चाहिए, चाहे उनका पूंजी में हिस्सा हो या नहीं। पर हम एक ऐसे विश्व में रहते हैं, जहां नीचे की आधी आबादी को विरासत में कोई संपत्ति नहीं मिलती, जबकि कुछ आबादी को लाखों या अरबों की संपत्ति मिलती है। इतिहास साक्षी है कि आर्थिक समृद्धि के लिए शिक्षा में निवेश और असमानताओं में कमी करना महत्त्वपूर्ण कदम हैं। ऐसे किसी भी देश/ समाज में जहां धन, संसाधन और शक्ति का असमान वितरण हो, वहां से संस्थागत असमानता को मिटाने के लिए आमूलचूल परिवर्तन की आवश्यकता होती है। भारत जैसे देश में तो यह और भी जटिल हो जाता है, जहां जाति, धर्म, भाषा, लैंगिक, क्षेत्रीय असमानता पहले से ही व्याप्त है।

दिसंबर में जारी विश्व असमानता रिपोर्ट में कहा गया है कि भारत एक गरीब और असमानताओं वाला देश है। इस रिपोर्ट में यह भी दावा किया गया है कि देश की आय बेहद निचले स्तर पर पहुंच गई है। एक तरफ भारत में शीर्ष दस फीसद आबादी के पास राष्ट्रीय आय का सत्तावन फीसद है, निचले पचास प्रतिशत वर्ग के पास केवल तेरह फीसद हिस्सेदारी है और चालीस प्रतिशत आबादी या कहें कि मध्यवर्ग के पास कुल आय का साढ़े उनतीस प्रतिशत है। अकेले एक प्रतिशत अमीरों की आय देश की कुल आय के बाईस प्रतिशत के बराबर है। इतनी अधिक आर्थिक असमानता समाज में अनेक सामाजिक, सांस्कृतिक और राजनीतिक समस्याएं उत्पन्न करती है। जब तक विकास का माडल शिक्षा, स्वास्थ्य और संसाधनों के पुनर्वितरण पर केंद्रित नहीं होगा, तब तक गैर-बराबरी को समाप्त या कम करना असंभव है।

रिपोर्ट में यह संकेत भी है कि भारत में महिला श्रमिकों की आय का हिस्सा मात्र अठारह प्रतिशत है। यह एक तथ्य है कि समानता, शिक्षा और स्वास्थ्य के क्षेत्र में निवेश करके ही देश को समृद्ध बनाया जा सकता है, न कि कुछ व्यक्तियों के हाथ में आर्थिक शक्ति केंद्रित होने देकर। इस रिपोर्ट को तैयार करने में महत्त्वपूर्ण भूमिका निभाने वाले अर्थशास्त्री थामस पिकेटी तर्क देते हैं कि निजी संपत्ति और बाजार शक्तियों का अधिक से अधिक उपयोग विकास प्रारूप और अर्थव्यवस्था को समृद्ध करने में सहायक हो सकता है। उनका दावा है कि भारत के लिए उद्योग जगत को करों में छूट देना काफी नहीं है, बल्कि कोरोना महामारी के कारण उपजे आर्थिक संकट से निपटने के लिए गरीब परिवारों को आय की गारंटी देनी होगी। साथ ही सरकार को सार्वजनिक अधोसंरचना में भी निवेश करना होगा। जबकि हर नागरिक विकास में योगदान करने की क्षमता रखता है, तो फिर क्यों न उसकी क्षमता का उपयोग किया जाए। अगर हम ऐसा कर पाए तो भारत को दुनिया में सबसे अधिक असमानता वाले देशों की सूची से बाहर निकालने के प्रयास में सफल हो सकते हैं।

सवाल है कि यह गैर-बराबरी प्रकृति प्रदत्त है या मानव निर्मित? और यह गैर-बराबरी क्यों और किसलिए है? अगर गैर-बराबरी विकास के लिए जरूरी है तो कई दशकों से असमानता का सामना कर रहे देशों को तो अब तक विकसित देशों की सूची में शामिल हो जाना चाहिए था! यह एक तथ्य है कि असमानता कभी विकास की पूर्व शर्त नहीं हो सकती। जैसे एक मनुष्य शरीर और मस्तिष्क दोनों के साथ जन्म लेता है, दोनों का साथ-साथ विकसित होना प्रकृति का नियम है। दोनों में से एक भी भाग के कम या अधिक विकसित होने पर उसे असामान्य व्यक्तित्व की श्रेणी में रख दिया जाता है। यानी शरीर तो विकसित हो गया, पर दिमाग नहीं या दिमाग तो विकसित हो गया पर शरीर वहीं ठहर गया, तो भी समाज उन्हें अविकसित/ असामान्य के रूप में देखता है। इसी तरह समाज या देश का समग्र विकास प्रत्येक नागरिक को प्राप्त समान अवसरों पर निर्भर करता है। चाहे शिक्षा हो, राजनीति, स्वास्थ्य, संसाधन, आर्थिक संपन्नता या कुछ और। अगर ऐसा नहीं होता और केवल कुछ लोगों की संपन्नता या विकास पर ही देश का विकास निर्भर करता, तो विश्व असमानता रिपोर्ट या मानव विकास सूचकांक में हमारा स्थान इतना नीचे नहीं होता। केवल दस फीसद अमीर लोगों को ध्यान में रख कर विकास सूचकांक तय कर दिया जाता। इस बात से भी इंकार नहीं किया जा सकता कि असमानता में वृद्धि अनेक सामाजिक समस्याओं में वृद्धि के लिए जिम्मेदार है, जैसे निर्धनता, बेरोजगारी, अपराध, पारिवारिक तनाव आदि। इसलिए इस दिशा में सकारात्मक कदम उठाए जाने की आवश्यकता है।

समाज वैज्ञानिक पीटर सांडर्स का मत है कि कोई भी समाज कभी पूर्णरूपेण समाजवादी नहीं हो सकता, पर प्रत्येक समाज कुछ ऐसी व्यवस्थाएं विकसित कर सकता है, जिससे सभी समूहों को कुछ लाभ प्राप्त हो। सांडर्स इस दृष्टि से तीन प्रकार की समानताओं की चर्चा करते हैं। पहली औपचारिक या विधिक समानता यानी समाज का प्रत्येक सदस्य समान प्रकार के कानून से निर्देशित हो। दूसरा, अवसरों की समानता यानी प्रत्येक व्यक्ति को समान अवसर प्राप्त हों, वह अन्य लोगों से प्रतियोगिता कर सके, सफल हो सके। तीसरा, परिणामों की समानता यानी अगर प्रत्येक को अपने को सिद्ध करने का समान अवसर प्राप्त हो, तो आगे चल कर इसके परिणाम समाज में समान प्रकार के आने लगेंगे। उनके इस तर्क से सहमत हुआ जा सकता है कि ऐसा करके कुछ हद तक एक सममूलक समाज की स्थापना की जा सकती है।

वे यह तर्क भी देते हैं कि शासक वर्ग का एक बहुत बड़ा हिस्सा पूंजी के निजी स्वामित्व के आधार पर अस्तित्व में आया है। इसके साथ ही सफेदपोश श्रमिकों की संख्या में तेजी से वृद्धि हुई है। किसी भी समाज में धन की असमानता का एक महत्त्वपूर्ण कारण शासक वर्ग की शक्ति है। और यह वर्ग पांच से लेकर दस प्रतिशत तक किसी भी समाज में पाया जाता है। यह भी सच है कि शासक वर्ग के अनेक सदस्य अपनी संपत्ति को अपने परिजनों या मित्रों को हस्तांतरित कर देते हैं और इस प्रकार यह संपत्ति एक समूह विशेष का एकाधिकार बन जाती है। जबकि अधीनस्थ वर्ग में मजदूरी और वेतन प्राप्त करने वाली जनसंख्या सम्मिलित होती है। एक बड़ा समूह मध्यवर्ग के रूप में भी उभरा, जो अपने वेतन के एक बड़े हिस्से को बाजार में लगा कर लाभ प्राप्त करने की कोशिश करता है। इस तरह संपत्ति और शक्ति की असमानता का यह दुष्चक्र निरंतर बना रहता है। साथ ही लोकतांत्रिक मूल्यों के ह्रास की संभावना से भी इंकार नहीं किया जा सकता। जब लोकतंत्र को चुनौती मिलती है, तो किस तरह का समाज उभरता है, यह आज के परिप्रेक्ष्य को देख कर समझा जा सकता है।

हालांकि आंकड़े मात्रात्मक परिणामों को व्यक्त करते हैं, गुणात्मक विश्लेषण नहीं करते। यानी औसत आधार पर आंकड़े दिए जाते हैं और औसत के आधार पर किसी भी प्रकार के विकास की सही तस्वीर प्राप्त नहीं की जा सकती, क्योंकि आंकड़ों के आधार पर ही नागरिकों के कल्याण के लिए नीतियां बनाई जाती हैं। पर अगर आंकड़े ही भ्रामक हों, तो नीतियों की सफलता पर प्रश्नचिह्न लगना स्वाभाविक है। इसलिए समाज में बढ़ती असमानता को कम करने की दिशा में राज्य, अर्थशास्त्रियों और बौद्धिक वर्ग को कुछ ठोस कदम उठाने चाहिए, जो वास्तव में एक न्यायसंगत और बराबरी के समाज को मूर्त रूप दे सके।
