India must integrate with EU’s renewables supply chain, with access to its technology

Prime Minister Narendra Modi’s visit to Germany, the first leg of his three-nation European tour, set the stage for an essential aspect of India’s development pathway. One of the three strands of the bilateral talks was on climate and energy. Following talks, foreign secretary Vinay Kwatra identified the joint declaration of intent on green and sustainable development partnership as perhaps the most important one. It will play out initially through two channels. Both countries will create a Green Hydrogen Task Force and Germany will support India’s green growth plans with an additional development assistance of €10 billion by 2030.

These developments need to be located in a larger context. The urgency of mitigating climate change is stark. IPCC’s report in 2021 said that the global surface temperature was 1. 09 degrees higher in 2011-20 than the 1850-1900 baseline. Its consequences are already evident. India has contributed only 4% of cumulative greenhouse gas emissions between 1850 and 2017. However, with a coastline of about 7,516 km and 17% of the world’s population, it is already at the frontline of the fallout of climate change. Therefore, it’s in our interest to enhance the use of non-fossil fuel sources for incremental economic growth.

Modi last year outlined a net-zero commitment by 2070 as India’s overarching aim. It is to be realised through two interrelated steps by 2030. India is to reduce its projected carbon emissions by 1 billion tonnes and 50% of its energy needs are to be sourced through renewables. This is where India’s goals tie in with the EU’s vision. Having set a net-zero target by 2050, the EU is in the midst of a transition to sourcing most of its energy needs from renewables. Denmark, for example, has already sourced about 32% of its energy consumption in 2020 from renewables.

Renewables represent a menu of energy options. In the EU, wind and water provide most of the renewable electricity. This is being complemented by solar. Advances in R&D are opening up more options which also allows countries to de-risk their sourcing of renewable energy. It is in this context that PM Modi’s three-nation tour holds significant long-term potential. Despite the current scramble for securing fossil fuel supplies following Russia’s invasion of Ukraine, the long-term trends won’t change. India needs more than development assistance. It also has to be a part of the EU’s renewables supply chain with access to technology. This trip will lay the foundation.

Inflation Is Also Contagious

Why an RBI-led rise in borrowing costs is both imminent and imperative

Consumer price inflation in India almost touched 7% in March. It is likely to climb up further as the full effect of the global shortages in crude oil, metals and farm products (like oilseeds and wheat) on the back of the Ukraine war kicks in.

Forecasters are predicting inflation rates of 7% or more for at least seven more months with a peak of around 8% in June. Wholesale price inflation that measures factory and farm gate prices looks even more grim, printing at 14. 55% for March.

Why fret over a 7-8% inflation rate when the economy has seen much higher inflation rates in the past? In 2013, for instance, consumer inflation crossed 12%. For one thing, the period of high inflation in the early 2010s brought considerable agony to both households and businesses. The objective of current inflationmanagement policy is to ensure that we do not revisit this period in history.

In fact, the experience of the early 2010s forced a complete rethink on the ways to keep prices in check. A key outcome was the government’s decision to mandate RBI to keep CPI inflation in a range of 2-6% and ideally target the midpoint or 4%. Current inflation has busted the upper limit of this range. Does this call for urgent action by RBI?

In normal circumstances, central banks have a ready formula for taming inflation. This assumes that price increases reflect excess demand for goods and services riding on high economic growth and low unemployment. The logical response is to tamp demand down through higher interest rates.

How does this work? A household planning to take a car loan might think twice and often jettison the plan of buying a car if EMIs were to rise with interest rate increases. If a lot of households think this way, the aggregate demand for cars will decline and car producers will find it difficult to hike prices. Replace cars with all goods and services in the economy and you should get a rough sense of how interest rates impact aggregate inflation.

A related strategy is to reduce the amount of money in the economy. Inflation, as elementary economics texts point out, is a situation of too much money chasing too few goods. If RBI, the sole creator of money in the economy, reduces the pace of money supply, fewer rupees chase the same basket of goods. This helps to control inflation and increase the purchasing power of the rupee.

Things become tricky when instead of demand, sudden and sharp supply shortages push prices up – think of factories producing less because of Covid lockdowns or Russian oil going off the market. These shortages cause both economic stagnation and inflation, leading to the dreaded syndrome called stagflation. Hiking rates in such a situation could backfire, hurting growth further without denting inflation.

When inflation is primarily supplydriven, central banks prefer to wait awhile for shortages to abate. Thus, despite some upward pressure on inflation during the pandemic period (inflation crossed the 6% mark in May and June 2021), RBI (and other central banks) held back from hiking interest rates.

However, it now seems ready to change its stance and start hiking. Is it doing the right thing? The answer is perhaps ‘yes’. Even if inflation is primarily driven by supply bottlenecks, there are a few warning signs that a central bank must heed and be seen to be doing something in response. For them, the sharpest instrument in their toolbox is the interest rate.

Past experience shows that persistently high headline inflation (even if confined to a couple of categories like food and fuel) pushes up inflation expectations of households and firms. Elevated inflation expectations are known to feed inflation and keep it alive. That is certainly the case in India.

The second factor in deciding monetary action is the likely persistence of supply shortages. The impact of the Ukraine war is unlikely to die down in a hurry and the consequent elevation in food and fuel prices among others will keep inflation high.

Besides China’s zero-Covid policy has meant that the mother factory of the world is operating at much less than full capacity. This could result in shortages, often unexpected, in a vast range of items.

Finally, high and persistent inflation has an annoying habit of spreading to other items in the consumer basket. Thus, not only do consumers pay more at the petrol pump or for a bag of atta, they face (quickly enough) inflation in a whole bunch of other goods and services as well.

Economists like to strip out food and fuel, the volatile components of the consumer basket, and look at core inflation. The core basket covers all other goods and services and gauges how broad-based inflation is. Core inflation has in India remained high for an extended period and going by most forecasts, will remain so.

Central banks across most of the world seem to differ in their intensity of response. The US Federal Reserve has taken its gloves off and is expected to hike rates by at least two whole percentage points this year. RBI is likely to follow a milder approach, careful not to derail the economic recovery. However, one can be certain that a rise in borrowing costs is both imminent and imperative.

Make Our Courts More Accessible

India’s judicial system is characterised by a high pendency rate. In September 2021, there were 70,000 cases pending in the Supreme Court, 5. 6 million in the high courts, and 40 million in the lower courts. The courts are understaffed and proceedings incomprehensible to most justice-seekers. Filling judicial vacancies, preventing the executive from transferring decision-making to courts and ensuring legislatures enact laws diligently can only make things better.

Vacancies plague the judicial system, leading to delays. 37% of high court posts have been vacant as of November 2021, and nearly a quarter of subordinate court posts are yet to be filled. These are the courts where the bulk of judicial activity is conducted. Staffing judicial posts through an open system is critical to speedy delivery of justice.

Language is, indeed, a barrier. Article 348 of the Constitution mandates the use of English in the Supreme Court and high courts. It is also the language of district courts. The governor can, with the president’s consent, allow the use of non-English Indian languages. But orders and judicial outcomes are still recorded only in English. This barrier — along with the archaic Latinate jargon strewn in documents — makes it very difficult for the vast majority to follow their cases, leaving them vulnerable to touts and other mala fide characters. The prime minister’s recent suggestion to use local languages can resolve this issue. But it could create problems for lawyers to access case law from different jurisdictions. The courts should make the proceedings, observations and orders available in local non-English languages as well as in English. An understaffed judiciary incomprehensible to most does not an effective system make.

The court’s burden

A national body may be better placed to plan upgradation of judicial infrastructure

It is unfortunate that the proposal by the Chief Justice of India (CJI) for a national judicial infrastructure corporation with corresponding bodies at the State level, did not find favour with many Chief Ministers at the recent joint conference of Chief Justices and Chief Ministers. A special purpose vehicle, vested with statutory powers to plan and implement infrastructure projects for the judiciary, would have been immensely helpful in augmenting facilities for the judiciary, given the inadequacies in court complexes across the country. However, it is a matter of relief that there was agreement on the idea of State-level bodies for the same purpose, with representation to the Chief Ministers so that they are fully involved in the implementation. The CJI, N.V. Ramana, who had mooted the proposal some months ago, sought to dispel the impression that a national body would usurp the powers of the executive, and underscored that it could have adequate representation of the Union/States. He had flagged the gulf between the available infrastructure and the justice needs of the people. If his proposal had been accepted, the available funding as a centrally sponsored scheme, with the Centre and States sharing the burden on a 60:40 ratio, could have been gone to the national authority, which would allocate the funds through high courts based on need. It is likely that Chief Ministers did not favour the idea as they wanted a greater say in the matter.

Given the experience of allocated funds for judicial infrastructure going unspent in many States, it remains to be seen how far the proposed State-level bodies would be successful in identifying needs and speeding up implementation. It will naturally require greater coordination between States and the respective High Courts. Union Law Minister Kiren Rijiju has promised assistance from the Centre to the States for creating the required infrastructure, especially for the lower judiciary. While it is a welcome sign that the focus is on infrastructure, unmitigated pendency, chronic shortage of judges and the burgeoning docket size remain major challenges. CJI Ramana flagged some aspects of the Government’s contribution to the burden of the judiciary — the failure or unwillingness to implement court orders, leaving crucial questions to be decided by the courts and the absence of forethought and broad-based consultation before passing legislation. While this may be unpalatable to the executive, it is quite true that litigation spawned by government action or inaction constitutes a huge part of the courts’ case burden. The conversation between the judiciary and the executive at the level of Chief Justices and Chief Ministers may help bring about an atmosphere of cooperation so that judicial appointments, infrastructure upgradation and downsizing pendency are seen as common concerns.

Bill assent, a delay and the Governor’s options

With its provision for definite choices, the Constitution makes it obligatory for the Governor to act without a wait

The State of Tamil Nadu has been witnessing a confrontation between the elected government and the State Governor on the question of giving assent to the National Eligibility cum Entrance Test (NEET) Bill (linked to an all India pre-medical entrance test) passed by the State Assembly. Giving assent to a Bill passed by the legislature is a normal constitutional act performed by the Governor. But of late, even such normal acts have become a source of confrontation between State governments and the Governors. The conduct of Governors in certain States follows a definite pattern which causes a great deal of disquiet to elected governments as well as to those who have faith in the constitutional order.

On the advice of Ministers

The position of a Governor in the constitutional setup in India needs to be clearly understood in order to grasp the significance of the actions as well as responses of Governors in the politico-administrative contexts emerging from time to time in States. The Governor is an appointee of the President, which means the Union government. Although Article 154(1) of the Constitution vests in the Governor the executive power of the State, he is required to exercise that power in accordance with the Constitution. In other words, the Governor can act only on the aid and advice of the Council of Ministers. Though there is not much deviation from the language used in the Government of India Act of 1935 in the context of the powers of the British-era Governors, it is a settled constitutional position that the Governor is only a constitutional head and the executive power of the State is exercised by the Council of Ministers. In Shamsher Singh vs State of Punjab (1974), the Supreme Court had clearly affirmed this position in the following words: “We declare the law of this branch of our Constitution to be that the President and Governor, custodians of all executives and other powers under various Articles, shall, by virtue of these provisions, exercise their formal constitutional powers only upon and in accordance with the advice of their Ministers save in a few well known exceptional situations”.

Dr. Ambedkar explained the position of the Governor in the Constituent Assembly as follows: “The Governor under the Constitution has no functions which he can discharge by himself: no functions at all.” The Sarkaria Commission restates this position in its report, “it is a well-recognized principle that so long as the council of ministers enjoys [the] confidence of the Assembly its advice in these matters, unless patently unconstitutional, must be deemed as binding on the governor”. In 2016, a five-judge constitution Bench of the Supreme Court (the Nabam Rebia case) reaffirmed the above position on the governors’ powers in our constitutional setup.

The pathways available

It may be stated here that this analysis of the Governor’s powers is meant to enable readers to have a perspective on the issue of the Governor of Tamil Nadu not deciding on the request for assent to the NEET Bill passed by the Assembly even after the passage of more than two months. What exactly are the options before the Governor in the matter of giving assent to a Bill passed by the Assembly?

Article 200 of the Constitution provides for four alternative courses of action for a Governor when a Bill after being passed by the legislature is presented to him for his assent. Assent of the Governor or the President is necessary for a Bill to become law. The Governor can give his assent straightaway or withhold his assent. He may also reserve it for the consideration of the President, in which case the assent is given or withheld by the President. The fourth option is to return the Bill to the legislature with the request that it may reconsider the Bill or any particular provision of the Bill. The Governor can also suggest any new amendment to the Bill. When such a message is received from the Governor, the legislature is required to reconsider his recommendations quickly. However, if the legislature again passes the Bill without accepting any of the amendments suggested by the Governor he is constitutionally bound to give assent to the Bill.

The Governor of Tamil Nadu returned the NEET Bill to the Assembly for reconsideration of the Bill. Accordingly, the Assembly held a special session in the first week of February and passed it again and presented it to the Governor for his assent. He has not assented to the Bill so far.

A wrong view

In the meantime, some sources in the Raj Bhavan have reportedly said that the Constitution has not fixed any time line within which to act. This, then, is the crux of the issue. The point that is made by these sources is that since the Constitution has not fixed any time frame, the Governor can postpone a decision indefinitely. Needless to say, it is a very wrong view.

While it is true that Article 200 does not lay down any time frame for the Governor to take action under this Article, it is imperative on the part of the Governor to exercise one of the options contained therein. A constitutional authority cannot circumvent a provision of the Constitution by taking advantage of an omission. The option mentioned in Article 200 is meant to be exercised by the Governor without delay. The context of Article 200 needs to be understood to be able to take the correct decision. After a Bill is passed by the legislature, it is sent to the Governor immediately. Although Article 200 does not say by what time the Governor should take the next step, it clearly and unambiguously states the options for him to exercise. It is obvious that if the Governor does not exercise any of those options he will not be acting in conformity with the Constitution because non-action is not an option contained in Article 200.

But sitting on the Bill after the Assembly has passed it again and sent it to him is impermissible under the Constitution. Article 200 (proviso) clearly says that when the Assembly reconsiders the Bill on the recommendations of the Governor and presents it to him, he shall not withhold assent. The Constitution makers could never have intended that the Governor could sit on a Bill passed by the legislature for as long as he wants and take advantage of the absence of any specific time frame.

In fact, the words used in Article 200 “… it shall be presented to the governor and the governor shall declare….” indicates that the Constitution requires the Governor to act without delay upon the presentation of the Bill. The reason is obvious. The legislature passes a Bill because there is an urgency about it. But if the Governor does not act, the will of the legislature is frustrated. It is not the constitutional policy to frustrate the legislative will as expressed through the Bill. Therefore, in view of the mandatory provision in the proviso to Article 200, it is clear that the Constitution does not permit the Governor to sit on a Bill after the Assembly re-submits it to him after reconsideration.

An undemocratic option

Giving assent to a Bill passed by the legislature is a part of the legislative process and not of the executive power. But the Constitution has by providing for definite options made it obligatory for the Governor to exercise any of those options without delay. Withholding of assent, though an option, is not normally exercised by Governors because it will be an extremely unpopular step. Besides, withholding assent to a Bill by the Governor, an appointee of the President, neutralises the entire legislative exercise by an elected legislature enjoying the support of the people. In the opinion of this writer, this option is undemocratic and essentially against federalism. In the United Kingdom it is unconstitutional for the monarch to refuse to assent to a Bill passed by Parliament. Similarly, in Australia, refusal of assent to a Bill by the crown is considered repugnant to the federal system.

In our constitutional system, the Governor or the President is not personally responsible for their acts. It is the elected government that is responsible. Under Article 361, the President or a Governor is not answerable to any court for anything done in the exercise and performance of their powers and duties. But when a Governor does not take any decision on a Bill which is put up for his assent, he is not acting in exercise and performance of the duties cast upon him.

Joblessness on the rise in India

India is in the throes of a widening joblessness crisis and misinformation does not help

After many years of refusing to recognise there is a jobs crisis in India, the government of India, faced with relentless data to the contrary, has now resorted to misinformation. Scholars associated with the government have contributed to this effort. Two pieces – “Here’s why it’s V not K”, March 3, 2022 in The Times of India and “A hazy picture on employment in India”, February 1, 2022 in The Hindu are cases in point and are examined here. Regrettably, both pieces show an inadequacy in understanding the jobs situation.

As compared to the 8% per annum GDP growth in the period 2004-14, and 7.5 million new non-farm jobs created each year over 2005 to 2012 (NSO’s employment-unemployment survey), the number of new non-farm jobs generated between 2013-2019 was only 2.9 million, when at least 5 million were joining the labour force annually (NSO’s Periodic Labour Force Survey (PLFS)). The NSO itself states clearly that the two surveys provide comparable data; the claim that those two surveys are not comparable is not correct.

Unpaid family labour

A claim is made that between 2017-18 and 2019-20, the worker participation rate (WPR) and labour force participation rate (LFPR) is rising, showing improvement in the labour market. The next question is: how come these rates are rising, exactly when the economy is slowing down sharply from 2017 to 2020? The reality is that this rise in WPR and LFPR is misleading. It was caused mostly by increasing unpaid family labour within self-employed households, mostly by women.

The claim that manufacturing employment increased between 2017-18 and 2019-20 by 1.8 million is technically correct (based on PLFS). What this ignores is that between 2011-12 and 2017-18, manufacturing employment fell in absolute terms by 3 million, so a recovery is hardly any consolation. Manufacturing as a share of GDP fell from 17% in 2016 to 15%, then 13% in 2020, despite ‘Make in India’.

Meanwhile, another argument offered is that GDP in FY22 “could not have returned to pre-COVID FY20 level without workers returning to work and MSMEs recovering too”. Clearly, this fails to recognise that organised economic activity could recover without a corresponding increase in unorganised activities, thus cancelling each other out, and still leave the jobless without work, or even less work.Second, a fall in urban unemployment after July 2020 to January-March 2021 has now been reversed, with urban unemployment rate rising in April-June 2021 back to mid-2020 level, and labour force participation falling again. This is a K-shaped recovery.

In any case, the authors provide no evidence that MSMEs, that provide most of the non-farm employment, have recovered to pre-COVID levels. Meanwhile, here is the evidence. The Consortium of Indian Association (CIA) conducted a survey of over 81,000 micro businesses across Indian in June 2021, two months after the second wave was over. Of them 59% reduced their staff compared to pre-COVID levels; 88% respondents had not availed of any government stimulus packages; 28% reported they were unable to get payment dues from their customers from private or government; 64% reported banks were not giving loans..

Farm employment

In any case, the recovery of urban employment till March 2021 clearly ignores that urban employment barely captures a third of total employment. Besides, agriculture output may have performed well during COVID, and free rations may have alleviated acute distress. This completely ignores that between 2019 and 2020, the absolute number of workers in agriculture increased from 200 million to 232 million, depressing rural wages — a reversal of the absolute fall in farm employment of 37 million between 2005-2012, when non-farm jobs were growing 7.5 million annually, real wages were rising, and number of poor falling. Rising farm employment is a reversal of the structural change underway until 2014.

Finally, another dubious argument is offered to supplement the claim that organised formal employment is rising, because new registration in employment provident fund rose in the last two years. One limitation of EPFO-based payroll data is the absence of data on unique existing contributors. Employees join, leave and then rejoin leading to large and continuous revisions in EPFO enrolment.

There has been a massive increase in joblessness of at least 10 million due to COVID-19, on top of the 30 million already unemployed in 2019. This happened while the CMIE is reporting the employment rate has fallen from nearly 43% in 2016 to 37% in just four years. If this is not a V-shaped recovery, what is? Poverty had already increased during pre-COVID times, and increased further post-COVID by all estimates.

कोर्ट में स्थानीय भाषा का प्रयोग बेहतर होगा

प्रधानमंत्री ने न्यायालयों में क्षेत्रीय भाषा में अदालती काम करने की सलाह दी है ताकि आम-जन में न्याय के प्रति भरोसा बढ़े। इससे हटकर पीएम ने एक और बात कही जिसके दूरगामी जनोपयोगी परिणाम होंगे। उन्होंने कहा कि कानून की भाषा आम जनता की समझ में नहीं आती क्योंकि उसमें तमाम कानूनी/तकनीकी शब्दों का प्रयोग होता है। जाहिर है जो कानून समझ में नहीं आता हो उसके पालन की अपेक्षा अशिक्षित लोगों से करना गलत है। पीएम ने बताया कि केंद्र सरकार इस बात का प्रयास कर रही है कि कानून बनाते समय ही मूल कानून के साथ सहज भाषा में भी उसकी व्याख्या दी जाए। इस प्रयास से कानून केवल वकीलों और जजों की दुनिया से निकल कर सामान्य नागरिक तक पहुंचेगा। क्षेत्रीय भाषा में कोर्ट्स के काम की अवधारणा को भी अमल में लाना मुश्किल नहीं है। अभी तक देश के हाई कोर्ट और सुप्रीम कोर्ट में केवल अंग्रेजी में काम होता है। जरा सोचें, केरल-मूल का युवा सिविल सेवा अधिकारी बंगाल कैडर में चुने जाने के बाद एक साल की ट्रेनिंग के बाद छोटे जिले में मुख्य विकास अधिकारी रहता है और उससे स्थानीय भाषा में संवाद की अपेक्षा की जाती है। वह यह नहीं कहता कि उसे मलयाली या अंग्रेजी में प्रार्थना-पत्र दिया जाए। लिहाजा यह तर्क देना कि हाई-कोर्ट जजों को अन्य राज्यों में ट्रांसफर पर जाना होता है, कतई तार्किक नहीं है। अगर गूढ़ कानूनी शब्दों का प्रयोग कर अंग्रेजी में ही फैसले आएंगे तो कई बार अनपढ़, गरीब या ग्रामीण को तो छोड़िए स्थानीय कोर्ट्स को भी सुप्रीम कोर्ट और हाई कोर्ट्स के फैसले समझने में गलती होती है। विकल्प के रूप में शुरू में कोर्ट्स क्षेत्रीय भाषा की जगह हिंदी शब्दों को विकल्प के रूप में चुन सकते हैं।

नए दौर में पुराने कानून कब तक चलेंगे?

लंबे अर्से बाद प्रधानमंत्री, कानून मंत्री, सुप्रीम कोर्ट और हाईकोर्ट के सभी चीफ जस्टिस के साथ राज्यों के मुख्यमंत्री एक मंच पर एकत्र हुए। प्रधानमंत्री ने आमजन के मनोभावों को व्यक्त करते हुए कहा कि लोगों को जल्द न्याय मिले तभी स्वराज आएगा। सुप्रीम कोर्ट के चीफ जस्टिस ने इस मर्ज के तीन पहलुओं पर विस्तार से चर्चा की। पहला, अंग्रेजों के जमाने से चल रही जटिल कानूनी व्यवस्था से आज के समय में इंस्टैंट जस्टिस संभव नहीं है। दूसरा, अदालतों में जजों की कमी के साथ जरूरी इन्फ्रास्ट्रक्चर नहीं है। तीसरा, सरकारें जिम्मेदारियों का पालन नहीं करतीं, जिससे अदालतों को नीतिगत मामलों में हस्तक्षेप करना पड़ता है। संसद, सरकार या सुप्रीम कोर्ट- कोई भी लक्ष्मण रेखा लांघे, यह संवैधानिक दृष्टि से ठीक नहीं। लेकिन पहले लक्ष्मण रेखा को समझना जरूरी है। एक लाइन में कहें तो लक्ष्मण रेखा का निर्धारण संसद द्वारा बनाए कानून और सुप्रीम कोर्ट के फैसलों से होता है।

पुरानी कानूनी व्यवस्था की वजह से आमजन 4.5 करोड़ से ज्यादा मुकदमों के साथ जेलों में बंदी हैं। 2014 में प्रधानमंत्री मोदी ने कहा था कि वे रोजाना एक कानून को रद्द करेंगे। शुरुआती 5 साल के कार्यकाल में सरकार ने पंद्रह सौ कानूनों को रद्द किया, इस लिहाज से कमोबेश उन्होंने अपने वचन को पूरा किया। लेकिन जमीनी हकीकत भयावह है। ऑब्ज़र्वर रिसर्च फाउंडेशन की नवीनतम रिपोर्ट के अनुसार देश में 69233 रेगुलटरी कानूनों में 26134 का पालन नहीं होने पर जेल जाने का खतरा होता है। इससे भ्रष्टाचार के साथ लोगों का दमन भी बढ़ता है। रिजर्व बैंक की एक रिपोर्ट के अनुसार कोरोना के पिछले तीन सालों में भारत में लगभग 50 लाख करोड़ मूल्य के उत्पादन का घाटा हुआ। पुराने कानून जिन पर लागू होते हैं, उनमें से 80 करोड़ से ज्यादा कोरोना काल में सरकारी राशन पर निर्भर रहे।

अब एक नजर नई डिजिटल अर्थव्यवस्था पर भी डालना जरूरी है। 2014 में देश में लगभग 400 स्टार्टअप थे, जिनकी संख्या अब 68 हजार हो गई है। डिजिटल पेमेंट में 40 फीसदी हिस्सेदारी की वजह से भारत विश्व में सिरमौर है। ऑनलाइन गेम मार्केट ने देश के 40 करोड़ से ज्यादा लोगों को गिरफ्त में ले लिया है। ई-कॉमर्स, क्रिप्टो और फिनटेक जैसे अनेक सेक्टर के लिए कानून, नियम या गाइडलाइंस की कोई लक्ष्मण रेखा नहीं है। इसको ऐसे समझें कि पुरानी सड़क जो धीरे-धीरे बेकार होने के बाद प्रचलन में नहीं है, उस पर सफर कर रहे लाचार लोगों पर सभी तरह के कानूनों की मार और टैक्स की वसूली होती है। दूसरी तरफ सरकारी अनुदान से बने राजमार्ग पर डिजिटल का काफिला स्वच्छंद विचरण कर रहा है। कानून को अपडेट रखने यानी विधायी मोर्चे पर विफलता को इन 12 बिंदुओं से समझा जा सकता है-

1. समान नागरिक संहिता पर संसद से ही कानून बन सकता है। संविधान के अनुच्छेद 44 में दी गई इस जिम्मेदारी को पूरा करने में पिछले 72 सालों में केंद्र सरकार विफल रही। इसकी वजह से उत्तराखंड और हिमाचल प्रदेश जैसे राज्य संविधान-उल्लंघन कर रहे हैं।

2. सुप्रीम कोर्ट ने आईटी एक्ट की धारा 66-ए को रद्द कर दिया, पर सरकार ने नया कानून नहीं बनाया। फलस्वरूप सोशल मीडिया पोस्ट पर राज्यों की पुलिस आईपीसी के तहत मामले दर्ज करके मनमानी कर रही है।

3. 150 साल पहले अंग्रेजों ने राजद्रोह का जो कानून बनाया था। उसके दुरुपयोग पर चिंता जताने के बावजूद संसद से 124-ए को निरस्त करने की प्रक्रिया नहीं हुई।

4. डेटा सुरक्षा और प्राइवेसी पर सुप्रीम कोर्ट के नौ जजों के पांच साल पुराने फैसले के बावजूद केंद्र सरकार ने डाटा सुरक्षा कानून नहीं बनाया।

5. लिव-इन रिलेशनशिप, समलैंगिक विवाह आदि के बारे में केंद्रीय स्तर पर कानून नहीं होने से लक्ष्मणरेखा पार करने का नैतिक आधार मिल गया है।

6. चेक बाउंस जैसे सिविल अपराध के मामलों को आपराधिक दायरे में लाने से 33 लाख से ज्यादा मुकदमे कारोबारियों और अदालतों के गले की फांस बन गए। डिजिटल पेमेंट का सिस्टम शुरू हो गया, पर पुराने मामलों को खत्म करने के लिए कानून में बदलाव नहीं हुए।

7. श्रम कानूनों पर बहस के बाद बड़े मसौदे बने। लेकिन डिजिटल अर्थव्यवस्था में काम कर रहे लाखों गिग वर्कर्स के हितों के लिए कोई नियम-कानून नहीं बना।

8. विपक्ष शासित पांच राज्यों में सहमति नहीं मिलने से बैंकिंग फ्रॉड के 21 हजार करोड़ से ज्यादा के मामलों की सही जांच नहीं हो पा रही। हाईकोर्ट ने सीबीआई की वैधता पर सवाल खड़े किए, पर विशेष कानून नहीं बना।

9. ऑटो और टैक्सी वालों के लिए पुराने नियम बने हैं। एप आधारित कंपनियां डाटा चोरी के साथ ग्राहकों की जेब पर डकैती डाल रही हैं। उनके लिए कानून नहीं बना।

10. सोशल मीडिया और साइबर के लाखों अपराध मामले दर्ज नहीं होने की वजह से एनसीआरबी के आंकड़ों में नहीं दिखते। सीईआरटी के अनुसार साइबर अपराध के मामलों में 6 घंटे के भीतर रिपोर्टिंग जरूरी है। इसके बावजूद आईटी एक्ट में समयानुकूल बदलाव नहीं हुए।

11. सुप्रीम कोर्ट चीफ जस्टिस के अनुसार आधे से ज्यादा मुकदमों में सरकार पक्षकार है। देश में राष्ट्रीय मुकदमा नीति बनी थी, जिसे अपडेट और लागू नहीं करने से मुकदमों का बोझ दिन दूना रात चौगुना बढ़ रहा है।

12. सुप्रीम कोर्ट ने 7 साल पहले जो फैसला दिया था, उसके अनुसार सरकार को एमओपी में बदलाव करना था। इसमें टालमटोल से जजों की नियुक्ति प्रक्रिया में विलंब के साथ न्याय की गाड़ी पटरी से उतर रही है।

चुनावों में मुफ्त उपहार के वादे देश के लिए खतरनाक

देश चुनावी मोड में है। पार्टियां खुद को औरों से बेहतर साबित करना चाहती हैं। परम्परागत वोटरों को अपने पक्ष में करने के लिए हरसम्भव तरीके आजमाए जा रहे हैं। चूंकि चुनावों में बहुत कुछ दांव पर होता है, इसलिए उनमें बहुत तनावपूर्ण संघर्ष होता है। विचारधाराओं का टकराव होता है। लेकिन हमें याद रखना चाहिए कि किसी भी पार्टी को चुनाव जीतने के लिए वे उपाय नहीं आजमाने चाहिए, जो देश की सेहत के लिए नुकसानदेह साबित हों। क्योंकि नेशन फर्स्ट ही हमारा स्लोगन है। दुर्भाग्य से चुनाव जीतने पर मुफ्त उपहार देने के वादे एक ऐसी ही प्रवृत्ति है, जो देश के लिए अच्छी नहीं कही जा सकती।

एक जनहित याचिका पर सुनवाई करने के दौरान सर्वोच्च अदालत ने इस विषय में चिंता जताई थी और कहा था कि चुनावों में मुफ्त उपहार देने के वादे गम्भीर समस्या है। वरिष्ठ अधिकारियों ने इस बारे में प्रधानमंत्री को अवगत कराया, क्योंकि प्रधानमंत्री की छवि ऐसे नेता की है, जो निर्णय लेने में संकोच नहीं करते। उन्होंने उन्हें सचेत किया कि मतदाताओं को लुभाने के लिए राज्य सरकारों द्वारा किए जाने वाले वादे अंतत: वित्तीय संकट की ही स्थिति निर्मित करेंगे। इस मामले में चुनाव आयोग ने असमर्थता जाहिर की है। अब गेंद राजनीतिक दलों के पाले में है, लेकिन वे नकार के मोड में हैं। वे जानते हैं कि यह प्रवृत्ति हानिकारक है, इससे संसाधनों की क्षति होती है और सरकारी खजाने को नुकसान पहुंचता है, फिर भी वे इसे समाप्त नहीं करना चाहते। वोटरों को भी इसके दूरगामी नतीजे नहीं पता, जो उनके लिए ही बुरे साबित होंगे।

ये मुफ्त उपहार- जो फ्रीबी कहलाते हैं- सामाजिक-आर्थिक राहत राशि के रूप में दिए जाते हैं, जबकि यह भ्रामक है। आर्थिक राहत तभी सम्भव है, जब समाज के सबसे निचले तबके के व्यक्तियों को भी सामाजिक-आर्थिक विकास प्रक्रिया में उत्पादक के तौर पर सहभागी बनाए जाए। नागरिकों में गैर-उत्पादकता को प्रोत्साहित करने से तो नुकसान ही होंगे। लेकिन फ्रीबी बांटने की लोकलुभावन नीति के पीछे चैरिटी का वह रूप है, जो कार्यक्षम लोगों को निष्क्रिय बनने को प्रेरित करता है और इस तरह से देश पर बोझ बढ़ाता ही है। यह अव्यावहारिक नीति ऊपर से चाहे जितनी भावनात्मक मालूम होती हो, लेकिन अंत में उन्हीं लोगों के लिए नुकसानदेह साबित होती है, जिनके लिए उसे लागू किया गया था। महामारी ने हमें बहुत सारी चीजें सिखाई हैं, और उनमें से एक यह है कि जब रोजगारों पर संकट पैदा होता है तो सबसे पहली चोट गरीबों पर ही पड़ती है। अर्थव्यवस्था में गिरावट आती है तो स्वास्थ्य-सेवाएं प्रभावित हुए बिना नहीं रह पातीं।

जरा श्रीलंका और वेनेजुएला जैसे देशों का उदाहरण देख लें। वास्तव में श्रीलंका आज एक केस स्टडी बन चुका है। वहां भी चुनावों के दौरान गैर-व्यावहारिक लोकलुभावन घोषणाएं की गई थीं। उन्हीं को पूरा करने के फेर में आज श्रीलंका की यह हालत हो गई है। जनता से टैक्स में छूट के वादे किए गए, जो पूरे नहीं किए जा सकते थे। भारी सब्सिडी देने, कर्ज और बिल माफ करने के सपने दिखाए गए। यह सब समानता के नाम पर किया गया। जबकि इस तरह की चीजें उलटे सामाजिक न्याय के आदर्श को नुकसान पहुंचाती हैं। वेनेजुएला जैसा देश, जिसके पास अकूत तेल-सम्पदा है, वेलफेयर प्रोग्राम के नाम पर की गई शाहखर्ची से दिवालिया होने के कगार पर आ गया है। ये सच है कि महिलाओं और बच्चों के सशक्तीकरण, स्वास्थ्य सुरक्षा, रोजगार-वृद्धि, वरिष्ठजनों के कल्याण आदि के लिए चलाए जाने वाले कार्यक्रम सराहनीय हैं, लेकिन उनमें भी हितग्राही को रचनात्मक रूप से सहभागी बनाते हुए उसके सशक्तीकरण पर जोर दिया जाना चाहिए, अन्यथा राज्यसत्ता के संसाधन अनुत्पादक व्ययों में खर्च हो जाएंगे। एक सच्चे नेता को यह अहसास होना चाहिए कि अदूरदर्शितापूर्ण कदमों से राष्ट्र-निर्माण सम्भव नहीं है।

ई-खुदरा में क्रांति !

ओपन नेटवर्क फॉर डिजिटल कॉमर्स (ओएनडीसी) के रूप में जो महत्त्वाकांक्षी पहल देश के पांच शहरों में प्रायोगिक तौर पर की गई है वह देश में ई-कॉमर्स को पूरी तरह बदल सकती है। एकीकृत भुगतान इंटरफेस (यूपीआई) की तरह ओएनडीसी एक ओपन डिजिटल नेटवर्क विकसित कर रहा है जिसे कुछ इस प्रकार तैयार किया गया है कि सभी प्रकार के ई-खुदरा ऐप और प्लेटफॉर्म उसी तरह एक दूसरे के साथ संवाद कर सकेंगे जैसे कि यूपीआई हर भुगतान ऐप को अबाध ढंग से पैसे का लेनदेन करने देता है। ओएनडीसी डिजिटल पारिस्थितिकी तंत्र और उसके डेटा प्रवाह पर कई असर डाल सकता है। यह खरीदारों और विक्रेताओं के लिए पहुंच को बराबर कर सकता है, इस व्यवस्था में डेटा प्रबंधन और डेटा संरक्षण को लेकर भी चिंता है। इसके अलावा जब ओएनडीसी बड़े पैमाने पर काम करेगा तो ई-बाजार संचालित कर रहे कई विदेशी समूहों पर अभी लगे प्रतिबंधों को हटाने की भी तार्किक वजह उत्पन्न होगी।

फिलहाल भारत के ई-खुदरा क्षेत्र में एमेजॉन और फ्लिपकार्ट की हिस्सेदारी 60 प्रतिशत से अधिक है। परंतु एमेजॉन की ऐप का इस्तेमाल कर रहा ग्राहक उन उत्पादों और सेवाओं को नहीं देख सकता जो फ्लिपकार्ट की ऐप पर सूचीबद्ध हैं। इसी तरह जोमैटो ऐप स्विगी पर सूचीबद्ध रेस्तरां नहीं दिखाएगा। ओएनडीसी ऐसे सभी प्लेटफॉर्म को जोड़ेगा जिससे विकल्प बढ़ेंगे और ऑनलाइन खरीदारी करने वालों को ज्यादा विकल्प मिलेंगे। इससे 1.2 करोड़ छोटे किराना कारोबारियों और 4.2 करोड़ छोटे और मझोले कारोबारों को अपने उत्पाद प्रदर्शित करने में मदद मिलेगी और उनके लॉजिस्टिक्स की समस्या भी हल होगी। ओएनडीसी के घोषित उद्देश्य हैं नए विक्रेताओं के लिए प्रतिस्पर्धा में सुधार करना और मौजूदा ई-मार्केट का नेतृत्व करने वालों के दबदबे को नियंत्रित करना। इस विषय में जुलाई 2021 में एक सलाहकार परिषद स्थापित की गई और ओएनडीसी को यूपीआई का संचालन करने वाले भारतीय राष्ट्रीय भुगतान निगम की तरह एक गैर लाभकारी कंपनी के रूप में पंजीकृत किया गया है। ओएनडीसी ने एक रणनीति पत्र प्रकाशित किया है जो उन चुनौतियों और समस्याओं के बारे में बताता है जिन्हें वह हल करने का प्रयास करेगा। यहां उसकी बनावट के बारे में कुछ विस्तृत जानकारी सामने आती है। बहरहाल इस पर्चे में डेटा की निजता और सुरक्षा के उपायों की जानकारी नहीं दी गई है।

यदि ओएनडीसी वैसे ही काम करता है जैसा बताया गया है तो वह बहुत बड़े पैमाने पर संवेदनशील निजी और वाणिज्यिक डेटा का प्रबंधन करेगा। ऐसे में डेटा सुरक्षा बहुत अहम है। इस विषय में मोटी-मोटी जानकारी दी गई है जिसे विस्तार की जरूरत है, खासकर यह देखते हुए कि डेटा संरक्षण कानून अभी लंबित है। दस्तावेज में कहा गया है कि लेनदेन संबंधी डेटा केवल खरीदार और विक्रेता की ऐप में रहेंगे और वे ओएनडीसी पर नहीं नजर आएंगे। ओएनडीसी किसी आंकड़े को न तो जमा करेगा और न ही देखेगा। डेटा नीतियां सहमति आधारित तथा सीमित उद्देश्य वाली होंगी। ओएनडीसी यह सुनिश्चित करेगा कि लेनदेन के डेटा तथा व्यक्तिगत पहचान संबंधी सूचना एवं विक्रेताओं की अहम जानकारी को सुरक्षित रखा जाए। नेटवर्क की विश्वसनीयता के लिए यह देखना अहम होगा कि ओएनडीसी इस स्तर की सुरक्षा कैसे सुनिश्चित करेगा।

क्या अपनी ऐप बनाने, स्मार्ट लॉजिस्टिक्स प्रबंधन तथा कम लागत वाली वेयरहाउसिंग सुविधाओं पर अरबों डॉलर की राशि व्यय करने वाले बाजार के शीर्ष कारोबारी ओएनडीसी से जुडऩा चाहेंगे जबकि वह स्वैच्छिक होगा? यदि ओएनडीसी बड़े पैमाने पर काम करने में सफल होता है तो विदेशी खुदरा कंपनियों पर प्रतिबंध कम करने की बात उठेगी। ये प्रतिबंध अभी उन्हें बहु ब्रांड स्टोर बनने से रोकते हैं। यदि सब ठीक रहा तो ओएनडीसी बहुत क्रांतिकारी साबित होगा। यह न केवल छोटे कारोबारियों को बड़ा बाजार मुहैया कराएगा बल्कि बड़े पैमाने पर कारोबार लॉजिस्टिक्स को किफायती बनाएगा। लॉजिस्टिक्स की लागत में भारी कमी से अर्थव्यवस्था अधिक सक्षम बनेगी।

रिश्तों की कूटनीति

प्रधानमंत्री नरेंद्र मोदी का जर्मनी, डेनमार्क और फ्रांस जैसे यूरोपीय देशों का दौरा तेजी से बदल रही वैश्विक राजनीति में भारत की बढ़ती अहमियत को रेखांकित करता है। यह यात्रा महत्त्वपूर्ण इसलिए भी है कि रूस-यूक्रेन युद्ध की वजह से दुनिया में खेमेबाजी बढ़ी है और भारत किसी भी गुट में शामिल नहीं है। भारत शुरू से ही तटस्थ रुख अपनाता आया है और आज भी इस पर कायम है। जर्मनी के चांसलर ओलाफ शाल्ज के साथ भी प्रधानमंत्री मोदी ने यही कहा कि किसी भी सूरत में युद्ध रुकना चाहिए और भारत पहले ही दिन से ही इसकी वकालत और प्रयास करता रहा है। डेनमार्क में भी प्रधानमंत्री ने रूस-यूक्रेन युद्ध को तत्काल रोकने पर जोर दिया। इससे भारत ने दुनिया को एक बार फिर दो-टूक संदेश दिया है कि वह किसी गुट का सदस्य बनने के बजाय युद्ध रोकने और शांतिके प्रयासों में ही भरोसा रखता है। गौरतलब है कि फ्रांस, जर्मनी और डेनमार्क सहित यूरोपीय संघ के सदस्य देश यूक्रेन के साथ और रूस के खिलाफ खड़े हैं। यूरोपीय संघ भारत से भी यह अपेक्षा कर रहा है कि इस मुद्दे पर वह रूस के खिलाफ खड़ा हो और यूक्रेन पर हमले का विरोध करे।

देखा जाए तो मामला रूस-यूक्रेन युद्ध तक ही सीमित नहीं है। यूरोपीय देश भारत को एक बड़े भागीदार के रूप में भी देखते रहे हैं। चाहे जलवायु संकट से निपटने का मुद्दा हो या हरित ऊर्जा, अंतरिक्ष सहयोग जैसे दूसरे क्षेत्र हों, सभी में भारत की गिनती अहम और निर्णायक भूमिका अदा करने वाले देश के रूप में हो रही है। विकसित देश भी इस हकीकत को स्वीकार कर रहे हैं कि भारत को नजरअंदाज करके वैश्विक संकटों से निपटना संभव नहीं है। वरना जर्मनी के चांसलर शाल्ज भारत को समूह सात (जी-7) शिखर सम्मेलन के लिए न्योता क्यों देते? यह बात इसलिए भी अहमियत रखती है कि यूक्रेन के मुद्दे पर तटस्थ रुख रखने के बाद भी बड़े देश भारत को अलग-थलग करने की नहीं सोच सकते। हालांकि भारत पर इसके लिए दबाव कम नहीं पड़े हैं। यह बात तो फ्रांस, जर्मनी जैसे देश समझते ही हैं कि युद्ध एक न एक दिन खत्म होगा ही, लेकिन भारत के साथ भागीदारी और कारोबारी संबंध हमेशा चलने वाले हैं। इसमें तो कोई संशय नहीं कि युद्ध ने यूरोपीय देशों को भी बुरी तरह प्रभावित किया है। ऐसे में उनके लिए भारत जैसा देश एक बड़े मददगार के रूप में साथ खड़ा है। गौरतलब है कि हाल में ब्रिटेन के प्रधानमंत्री बोरिस जानसन और यूरोपीय संघ की प्रमुख उर्सूला लेयन ने भी भारत का दौरा इसी उद्देश्य से किया था कि भारत के साथ रिश्तों को और मजबूती दी जा सके।

इस यात्रा का एक और बड़ा हासिल यह भी है कि जर्मनी हिंद-प्रशांत क्षेत्र में भारत का सहयोगी बनने को राजी हो गया है। इससे पहले ब्रिटेन भी इसकी रजामंदी दे चुका है। यूरोपीय संघ की प्रमुख उर्सूला लेयन ने भी इस मुद्दे पर भारत के साथ सहमति जता दी है। यानी हिंद-प्रशांत क्षेत्र में रणनीतिक दबदबा बनाने की दिशा में यूरोप के मुल्क भी भारत के साथ आ रहे हैं। अमेरिका के नेतृत्व में बना क्वाड समूह, जिसका भारत भी सदस्य है, पहले से इस क्षेत्र की सुरक्षा को लेकर सतर्क है। सबकी चिंता हिंद-प्रशांत क्षेत्र के जलमार्ग को चीन के दबदबे से बचाने की है। प्रधानमंत्री के यूरोप दौरे से यह और साफ हो गया है कि भारत भले किसी गुट में न हो, लेकिन उसकी कूटनीति की धमक जरूर बनने लगी है।

जरूरी है जल संरक्षण

गर्मी के मौसम के साथ ही देश के अलग-अलग हिस्सों से जल संकट की खबरें सामने आने लगती हैं। इस बार भी ऐसा ही हो रहा है। राजस्थान के कोटा शहर का उदाहरण ही लें। यह शहर चंबल नदी के किनारे बसा है। लेकिन इस शहर की अनेक बस्तियों में पानी की किल्लत हो गई है। स्थिति यह है कि कई बस्तियों में तो नलों से बूंद-बूंद टपकने वाले पानी के सहारे अपनी जरूरत पूरी करने के लिए लोगों को रात-रात भर जागना पड़ता है। पिछले दिनों आई एक रिपोर्ट के अनुसार राजस्थान के हाड़ौती अंचल में भूजल पाताल तक पहुंच गया है। पश्चिमी राजस्थान में मरुस्थल है और वहां पानी का संकट नई बात नहीं है। लेकिन हाड़ौती अंचल राजस्थान के जिस दक्षिण-पूर्वी हिस्से में है, उसे सरसब्ज इलाके के तौर पर जाना जाता है। चंबल, कालीसिंध, पार्वती, परवन, आहू, ताकली, उजाड़ जैसी नदियों के अलावा इस अंचल में एक दर्जन छोटी या सहायक नदियां बहती हैं। बरसात के दिनों में जब इन नदियों में उफान आता है, तब इनमें होने वाली पानी की आवक का पता चलता है। इसके बावजूद यदि इलाके में भूजल का स्तर पाताल में पहुंच गया है और लोगों को पानी की पर्याप्त आपूर्ति नहीं हो पा रही है, तो इसका अर्थ केवल यही है कि हम पानी के प्रबंधन में कहीं पिछड़ गए हैं। हाड़ौती तो एकमात्र उदाहरण भर है, देश के ज्यादातर हिस्सों में जलसंकट की कमोबेश यही कहानी है।

महाभारत में एक जगह कहा गया है-‘अति परिचयाद् अवज्ञा भवति।’ सहजता से उपलब्ध हो जाने वाली वस्तुओं के वास्तविक मूल्य का अनुमान हम आसानी से नहीं लगा सकते, भले ही वे जीवन के लिए कितनी ही उपयोगी क्यों न हों। पानी के साथ भी ऐसा ही हुआ है। पृथ्वी की सतह का दो तिहाई हिस्सा पानी से भरा है। इसलिए कई लोगों को लगता है कि जब चारों तरफ इतना पानी है, तो फिर चिंता की क्या बात? शायद कुछ लोगों का यही सोच है। लेकिन ऐसे लोग इस तथ्य को भूल जाते हैं कि पृथ्वी की सतह पर मौजूद कुल पानी में से दो प्रतिशत से भी कम मनुष्य के उपयोग लायक है। आज भी पीने के पानी के लिए दुनिया का बड़ा हिस्सा बरसात या नदियों के प्रवाह पर ही निर्भर है। विज्ञान ने हमें भले ही उन्नति के नए सोपान सौंपे हैं, लेकिन आज तक दुनिया की किसी प्रयोगशाला में मनुष्य की जरूरतों को पूरा करने लायक पानी नहीं बनाया जा सका है। इजराइल जैसे देशों ने समुद्री पानी को पीने के योग्य बनाने का दावा किया है, लेकिन उनकी तकनीक या तो इतनी महंगी है या इतनी अप्रचलित है कि दुनिया में यह चलन लोकप्रिय नहीं हो पाया।

ऐसे में जरूरी यह था कि हम उन संसाधनों को बचाएं जो हमें साल भर तक पीने का पानी मुहैया कराते हैं। नदियों के अलावा झीलों, तालाबों, कुओं, बावड़ियों, टांकों, जोहड़ों जैसे जल संसाधनों को इस श्रेणी में रखा जा सकता है। हमारे पूर्वज जानते थे कि पानी जीवन की सबसे बड़ी जरूरत है और इसके संरक्षण के जरा-सी भी लापरवाही पीढ़ियों के अस्तित्व को संकट की ओर धकेल सकती है। इसीलिए प्राचीन भारतीय मान्यताओं में किसी जल स्रोत के निर्माण को बहुत पुण्यदायक माना गया। राजाओं, सेठों और सामर्थ्यवान लोगों ने अपने जीवन के किसी महत्त्वपूर्ण अवसर की स्मृति को अक्षुण्ण रखने के लिए भव्य जल संसाधनों का निर्माण करवाया। भारत की सबसे भव्य बावड़ियों में एक ‘रानी जी की वाव’ गुजरात के अन्हिलवाड़ा पाटन में स्थित है। राजा भीमदेव प्रथम की स्मृति में इस बावड़ी का निर्माण उनकी रानी उदयामति ने करवाया था। यह बावड़ी अब विश्व विरासत में शामिल है। मध्यप्रदेश की राजधानी में स्थित भोपाल के प्रसिद्ध बड़े तालाब का निर्माण परमार राजा भोज ने ग्यारहवीं सदी में एक चर्म रोग से छुटकारा पाने के उपक्रम में करवाया था। युद्ध के दौरान अपनी प्रजा और सेना को शत्रु से बचाए रखने के लिए प्राचीन शासक किलों और दुर्गों में विशेष जलाशय बनवाते थे। चित्तौड़ के विश्व प्रसिद्ध गढ़ में चौरासी जलाशय थे। राजस्थान की जयसमंद और राजसमंद जैसी विशाल झीलें अपने अपने दौर में अकाल के दौरान लोगों को रोजगार देने की योजना के तहत बनवाई गई थीं। इन झीलों में जमा पानी ने बाद में लंबे समय तक इलाके को अकाल से लड़ने का हौसला दिया। मरुस्थलीय इलाकों में रहने वाले लोगों से बेहतर पानी की कीमत कौन समझ सकता है? पश्चिमी राजस्थान में न केवल पाताल की छाती तोड़ कर पानी निकाल लाने वाले कुँओं का निर्माण करवाया गया, बल्कि इन कुओं की शुचिता की रक्षा के लिए विशेष प्रबंध भी किए गए।

जैसलमेर में एक तालाब है- गढ़सीसर तालाब। बरसात शुरू होने के पहले सारा शहर इस तालाब की सफाई के लिए जमा होता था। स्वयं राजा श्रमदान हेतु लोगों के साथ उपस्थित होते थे। इस तालाब के जल को गंदा करना अपराध माना जाता था। आज भी देश के कुछ गांवों में ऐसे जलाशय हैं जिनके जल को गंदा करना सहज क्षम्य नहीं होता। प्राचीन भारतीय मान्यताएं भी जलाशयों को गंदा करना शुभ नहीं मानतीं। लेकिन समय ने हमारी प्राथमिकताओं को बदल दिया। जब शहरों की आबादी बढ़ी तो पुराने तालाबों को पाट कर बाजार और बस्तियां बसा दी गईं । हमारे यहां कई उत्सवों पर कुएं की पूजा करना एक महत्त्वपूर्ण अनुष्ठान माना जाता था। इस परंपरा का मूल यह था कि हम कुएं की कल्याणकारी भूमिका को स्वीकारें, जो अपने अंतस में हमारी जरूरतों का पानी सहेजे रहता है। लेकिन नलों के माध्यम से पानी घरों तक पहुंचा, तो लोगों ने कुओं को उपेक्षित छोड़ दिया। यही कारण है कि आज देश के अधिकांश प्राचीन कुएं और बावड़ी गंदगी से अटे पड़े हैं।

पुराने तालाब, कुएं, बावड़ी, जोहड़, टांके या झील अपने अंतस में बरसात के पानी को तो सहेजते ही थे, उनमें संचित जल शनै: शनै: धरती के अंदर जाकर भूगर्भीय जल के स्तर को बचाए रखने में भी मदद करता था। लेकिन दुर्भाग्य से विकास की आधुनिक अवधारणा ने इस सच को अनदेखा कर दिया। विकास की आधुनिक अवधारणा ने इन तालाबों की जमीनों को पाट दिया। कहीं बस्तियां बस गईं , कहीं बाजार बना दिए गए, तो कहीं रेलवे स्टेशन और न जाने क्या-क्या। भूजल को समृद्ध करने के साधन तो खत्म हुए ही, 1970 के दशक के अंत में जनता को पानी मुहैया कराने के लिए जगह-जगह नलकूप भी खोद दिए गए, जिनसे मनमाने तरीके से जमीन के अंदर का पानी बाहर उलीचा जाने लगा। परिणाम यह हुआ कि भूजल का स्तर पताल में जा पहुंचा।

देश के कुछ हिस्सों से ऐसी खबरें सामने आई हैं, जिनमें बताया गया है कि एक छोटा-सा घड़ा पानी भरने के लिए भी स्त्रियों और बच्चों को अपनी जान जोखिम में डाल कर गहरे कुएं में उतरने को मजबूर होना पड़ता है और इस कुएं तक पहुंचने के लिए भी उन्हें अपने घर से बहुत दूर चिलचिलाती धूप में जाना पड़ता है। पानी को लेकर होने वाले संघर्ष ऐसे ही कारणों से उग्र और हिंसक होते हैं। ऐसे में आवश्यक है कि हम पानी के सदुपयोग के और वर्षा जल को संग्रहित करने के महत्व को समझें। दुनिया भर में पानी को बचाने की चेतना जगाने के लिए संवेदनशील लोग सक्रिय हैं क्योंकि पानी के अभाव में मनुष्य की तरक्की के सारे दावे अर्थहीन हो जाएंगे। शायद इसीलिए रहीम ने कहा था-‘रहीमन पानी राखिये, बिन पानी सब सून/ पानी गये न ऊबरे, मोती-मानुष- चून।’

भारत की सर्वप्रिय भाषा बने हिंदी

मुझे हिंदी से प्रेम है। यह बचपन से रहा है, जब मेरी मां ने मुझसे हिंदी में बात करनी शुरू की। सिर्फ हिंदी में। उनकी भाषा हिंदी नहीं थी। तमिज्ह थी। हां, तमिज्ह, तमिल या तामिल या तामील या फिर टामिल नहीं, तमिज्ह। चेन्नई जिस प्रांत की मुख्य नगरी है, यानी तमिज्ह नाड़ की, उस प्रांत की भाषा तमिज्ह है। भारत के हिंदीभाषी प्रांतों में उस भाषा का नाम ‘तमिल’ से प्रचलित हो गया है। तमिज्ह को तमिल कहने में कोई भयंकर गलती नहीं, लेकिन उसका सही उच्चारण है, तमिज्ह। यह ‘ज्ह’ कुछ मुश्किल है कहना, लेकिन उसको समझना और सही उच्चारण में कहना श्रेयस्कर है। उतना ही, जैसे हिंदी को हिंदी कहना, न कि हिंड्डी या हिन्ढी।

तो, मेरी मां (जिनका नाम लक्ष्मी था) तमिज्हभाषी थीं। लेकिन बहुत आनंद और लगन से उन्होंने हिंदी को बोलना, लिखना व प्यार करना सीखा और उस भाषा पर अद्भुत अधिकार पाया। उनके पिता थे चक्रवर्ती राजगोपालाचार्य, जिन्होंने रामायण का मूल तमिज्ह में सुंदर रूपांतर किया है। बेटी लक्ष्मी ने फिर उस रूपांतर का हिंदी में अनुवाद किया- दशरथ-नंदन श्रीराम के शीर्षक से। उसी लक्ष्मी ने (जिनका नाम शायद सरस्वती होना चाहिए था) मुझको और मेरी बहन व मेरे भाइयों को हिंदी सिखाई। भाषा के साथ संस्कार भी। उदाहरण के लिए, उन्होंने एक दिन कहा- ‘गोपू, ‘आ’, ‘आओ’ और ‘आइए’ में फर्क है न? बड़ों को तुम ‘आ’ नहीं कहोगे, न ही ‘आओ’। तुम कहोगे, ‘आइए’। ‘आइए’ से भी आगे एक शब्द है, आइएगा। अगर तुम ‘आइए’ कहो, तो कुछ गलती न होगी, लेकिन ‘आइएगा’ कहो, तो शिष्टाचार से भी आगे एक भावना का परिचय दोगे, संस्कार का।

स्कूल (बाराखंबा रोड, नई दिल्ली) में भी सौभाग्यवश मुझे हिंदी के जो अध्यापक मिले, वे उसी कोटि के मिले- पुण्यश्लोक वेदव्यास जी और विष्णुदत्त जी। इन्होंने मुझे हिंदी के और भी निकट किया। गजब के अध्यापक थे वे। पाठ्यक्रम को पूरा करना सामान्य बात होती है, जो हर शिक्षक करता है, लेकिन पाठ के प्रति प्यार की भावना अंकुरित करना कुछ और बात होती है। यह उन्होंने किया।

ऐसी मां के, जिनकी मातृभाषा हिंदी नहीं, तमिज्ह थी, और जिन्होंने मुझे तमिज्ह सीखाने से पहले हिंदी सिखाई, ज्ञानदान की स्मृति में आज यह कहता हूं कि हिंदी संस्कारी भाषा है। हिंदी जिनकी मातृभाषा नहीं, उनके मन, हृदय में हम हिंदीभाषी हिंदी के प्रति लगाव देखना चाहेंगे या नाराजगी? क्या हम नहीं चाहेंगे कि हिंदी भाषा के लिए, साहित्य के लिए, साहित्यकारों के लिए उनमें आदर, स्नेह और आकर्षण बने?

‘हिंदी ही एकमात्र राष्ट्रभाषा है भारत की!’ यह कहना भारत जैसे बहुभाषी राष्ट्र में अनुचित ही नहीं, अनुपयुक्त भी है। जो लोग संविधान से परिचित हैं, वे जानते हैं कि संविधान की आठवीं अनुसूची में शामिल भाषाओं में हिंदी समेत हमारी राज्य भाषाएं भी हैं। ‘जो हिंदी नहीं बोलेगा, वह नागरिकता खो लेगा’ के आक्रामक कथन में हिंदी की शीलता नहीं, अवधी का सुर नहीं, ब्रजभाषा का माधुर्य नहीं। उसमें बिहारी के दोहों का हास्य नहीं, रसखान की शब्द-क्रीड़ा नहीं, महादेवी का महाहृदय नहीं, निराला का चिंतन नहीं, प्रेमचंद का व्यवहार नहीं, जैनेंद्र का गांभीर्य नहीं। उसमें जवाहरलाल नेहरू का गुलाबी मन नहीं, लाल बहादुर शास्त्री का स्नेही हाथ नहीं, अटल जी की दरियादिली नहीं।

हिंदी में जन-बल है, उसको दंगल-बल की रेत में न ढालें। भारत में दक्षिण नाम की भी एक जगह है। यह हम हिंदीभाषी न भूलें। कवि प्रदीप कतई न भूले थे। तभी तो उन्होंने चिर-स्मरणीया लता मंगेशकर के गाने को कोई गोरखा कोई मदरासी वाले अमर्त्य शब्द दिए थे। भारत के तन को भारत के मन से हम अलग न करें। हमारे कविवर रवींद्रनाथ टैगोर ने गाया है- जन गण मन। उस मन को हम हर वक्त याद रखें।

और उस दक्षिण में हिंदी अनिष्ट नहीं है। बिल्कुल नहीं। ‘हिंदी-नीति’ की दक्षिण में एक छवि है- हिंदी का आरोपण हो रहा है। हिंदी-जगत यह कह सकता है कि आरोपण करने का उद्देश्य किसी का नहीं है। अगर नहीं है, तो फिर यह छवि क्यों? कैसे? उस छवि को कौन और कैसे दूर करे? जवाहरलाल नेहरू का और फिर लाल बहादुर शास्त्री का आश्वासन तमिज्ह जगत को विश्वसनीय लगा। आरोपण का भय जाता रहा। हिंदी गौण रूप से दक्षिण में सहज, सरल और खुले रूप से बोली-सुनी जाने लगी। कोई जोर नहीं, कोई जबर्दस्ती नहीं, कोई प्रतियोगिता नहीं। यह स्थिति बदलनी नहीं चाहिए, बल्कि उसको और बल मिलना चाहिए।

कई हिंदीभाषी हैं, जो कहते हैं कि हिंदी ही राष्ट्रभाषा है। कम हिंदीभाषी हैं, जो कहते हैं, भारत भाषाओं का सागर है; दक्षिण हिंदी सीखे, उत्तर दक्षिण भाषाएं सीखे। तमिज्ह महाकाव्य तिरुक्कुरल हिंदी में उपलब्ध है। कितने हिंदीभाषी हैं, जिन्होंने उसको पढ़ने और उसके ज्ञान से लाभ उठाने का प्रयत्न किया? क्या यह जानने का प्रयत्न किया है कि बसव के कन्नड़ महावाक्य हिंदी में मिलेंगे या नहीं? क्या श्री नारायण गुरु के मलयाली कथन और त्यागराज के तेलुगू कीर्तन हिंदी में अनुदित हैं? हिंदी-नीति हिंदी के विस्तार के लिए ही नहीं, हिंदी जगत की आतंरिक सीमाओं के विस्तार, उसकी संकीर्णताओं को दूर करने के लिए कटिबद्ध होनी चाहिए। और यह देखने के लिए कि उस सुशील भाषा के प्रेमियों में अन्य भारतीय भाषाओं के प्रति-उपनिवेशवाद की मानसिकता कभी न आ सके।

भाषाओं से नहीं, भाषाओं में निहित संदेशों से देश जुड़ता है। हम हिंदी में या किसी भी भारतीय भाषा में ऐसे संदेश पाएंगे, जो भारत के संयुक्त परिवार में समन्वय लाते हैं, और ऐसे भी, जो उस परिवार में अलगाव लाते हैं। भारत के हिंदीभाषी निश्चय ही बहुमत में हैं। हिंदी भारत की सर्वोच्च ‘लिंक’ भाषा बने, यह हिंदी जगत में एक स्वाभाविक भावना है। हिंदी भारत की सर्वप्रिय भाषा बने, यह हिंदी जगत का एक स्वधर्मी उद्देश्य होना चाहिए। राष्ट्र प्रेम में हिंदी का योगदान निश्चित रूप से बड़ा है। अगर हिंदी-प्रेम में राष्ट्र का योगदान लाना है, तो हिंदी को खुद से नहीं, अन्य भाषाओं और अन्य भाषियों से प्रेम करना सीखना होगा।
