Bureaucrat’s Fix

Social media isn’t the lynch mob’s oxygen. Improve law and order, excise hate from politics

A panel of secretaries tasked with studying the spate of lynchings has found a convenient bugbear: social media. In a report to a Group of Ministers, the bureaucrats are reported to have stressed on the liability of social media platforms. They have proposed stronger penal provisions to tackle this new menace. But the conclusion that lynchings are the outcome of malicious content in cyberspace is by no means the full story. Over the last five years use of social media platforms has grown, even exploded, worldwide.

But nowhere else have they led to an explosion of lynchings as in India – where we are forced to read news about a fresh lynching almost every other day. Thus local factors are responsible – among which the weakness of policing, which in India appears geared to ensuring security for VIPs rather than citizens in general, bulks large. Stronger penal provisions to tackle lynching may help at the margins. But India has a plethora of laws and absence of political will, which in this instance permits vigilantism to gain currency. The latter is brought out starkly in the example of a Union minister garlanding lynching suspects, in a mistaken quest for votes in his constituency. Some of the lynchings, especially those involving gau raksha, have little social media interface and more to do with the upsurge of political Hindutva.

One should perhaps not expect a report prepared by bureaucrats to point at this larger rot. But it is incumbent on the government to try a different tack involving better policing, fast tracking of lynching cases, asking its ministers and functionaries not to fan hate themselves. Some of these measures were ordered by Supreme Court recently. Meanwhile, excessive curbs on social media will hurt India’s business competitiveness relative to its peers.

The most ill-considered economic move by the Modi government has been demonetisation

Following the release this Wednesday of Reserve Bank of India’s annual report of 2017-18, it is clear the government is clutching at straws by claiming that the objectives of the November 2016 demonetisation exercise have been realised. Almost 99.3% of demonetised currency was returned by its holders, belying claims of windfall gains for the taxman. From an economic standpoint, it is the most ill-advised move of the Narendra Modi government. An economy gaining in momentum recorded a slowdown for two consecutive years, at a time when about 120 countries witnessed a pickup in growth rates. This represents an enormous loss to the economy.

For the central bank, the move complicated monetary management. For farmers and the informal sector, traditionally the most cash dependent, it piled on long drawn out misery. The stated aims of demonetisation were to combat black money and “rising incidence of fake currency notes.” Five weeks after demonetisation began, finance minister Arun Jaitley told Lok Sabha that government had no estimate of black money in the economy either before or after demonetisation. In the absence of a reference point, demonetisation’s impact on black money is purely in the realm of faith. Given that most currency was returned, it may have helped launder black money overall.

For sure, an overnight ban on high value currency notes would have rendered fake notes harmless. But fake currency is a menace which requires constant vigil. As RBI’s annual report shows, new currency notes are also being forged. A collateral benefit was expected to be lower incidence of cash in the economy and a growth in digital transactions. One measure shows currency to GDP ratio was 10.9% in 2017-18, lower than the pre-demonetisation level. But even this level of currency usage is among the highest in the context of India’s emerging market peers. Moreover, there has been a surge in use of currency as a medium of financial saving. Cash hoarding by households is a fallout of demonetisation. Digital payments, after an initial surge in the absence of adequate currency notes, went back to trend level.

The key takeaway is that there is no substitute for relentless reforms which transform the economy by improving incentives. Grand gestures, high only on symbolism, hurt the economy while causing needless suffering. Black money can be curbed by adopting more transparent systems, as well as a taxation policy that lowers rates while avoiding special exemptions.

Supreme Defence Of Democracy, Dissent

The Supreme Court, by restraining the Pune police from taking into remand the five rights activists arrested on Tuesday, has played the wholesome role envisaged by the framers of the Constitution who divided state power among the legislature, the executive and the judiciary so as to create checks and balances that would maintain and advance democracy. The court has checked the executive from carrying out what could easily be an excess and mandated the Centre and the state government to present their case justifying the arrests by September 6.

More significantly, the court defended the right to dissent, and, thereby, the freedom of expression guaranteed by the Constitution. This is of the utmost significance, in a growing climate of intolerance where many sections view dissent as being nothing short of anti-national. The court protected liberty to the extent possible before the police case is examined, by ordering confinement of the activists to their own homes, instead of sending them to police custody. The court’s observation that dissent is the safety valve of democracy is welcome not for its substantive content but for its affirmation of the right to entertain diversity of views. Viewing dissent as a utilitarian adjunct to democracy does not do justice to the integral role of dissent in deepening democracy.

Dissent should be seen as a defining, constitutive part of democracy, not just a safety valve. Suppose there is no dissent and the view of the head of the government is the view of everyone else in the country. That would be an Orwellian dystopia in which progress depends solely on the vision and commitment of the person who occupies the most powerful office of the land. If that person is a philosopher king, society could gain. But then, that system of governance could be many things, but definitely not a democracy.

The court would do a major service if it were to not only reiterate the restrictive meaning of sedition derived in the Kedar Nath judgment but also prohibit, on pain of contempt, wanton misuse of the provision by lower courts, a trend that must not grow.

Being Human & Its Discontents

A number of social activists have been writing on, and working for, human rights, often working together with those that have been denied these rights, even sometimes by people whom we have elected to protect our Constitution. The arrest of these activists is startling. It suddenly reminds one of how far down the slippery slope we have got to, that such an action can be taken in the belief that it is legitimate.

Many fundamental questions come to me, perhaps because in my youth I anticipated the coming of a new society, subsequently there was hope of such a society through helping construct worthwhile institutions, to now seeing the fading away of that hope; and being left with the fear that the reincarnation of the society that one was born into, may end up on the brink of a nightmare.

Getting the Vision Right

How do we explain this? Perhaps by raising a few questions. Have we, in the last 70 years, understood what it means when we describe ourselves as a modern, democratic, secular society, as good as the best in the world? Are we that? Do we still have a vision of the kind of society we want in the coming years? Or has that vision been splintered into scattered fractions? Modernity involves an attitude of mind that can be cultivated through an education that encourages healthy doubts about the status quo, that asks questions, and that attempts to find solutions.

We took the easier path, tended to set aside doubts and questions and took the coming of change for granted. We saw ourselves as modern if we wore the clothes, lived the lifestyle, and used the gadgets and machinery of modern times. But the emphasis was not on developing a questioning mindset. There was either an acceptance of the status quo, or a regression to a more antiquated mindset. Democracy implies the equality of all citizens. This would have meant blurring, if not dismissing, caste distinctions wherever possible. But tradition, as we saw it, was encouraged to intervene. Applying the law and updating the economy took time and effort, and it lagged behind. The status quo could be maintained by providing loopholes in governance and multiple opportunities for corruption. Democracy assumes the working of one-man one-vote, which is a powerful right if independently applied.

It was negated by the growth of votebanks, eagerly bought over by political parties. In a democratic system, one shouldn’t require a fortune to stand successfully for election. Secularism is what the party in power is anxious to get rid of. Is it really tied to religion and the rights of religious minorities? We have understood it as in medieval Europe, suggesting secularism as opposed to religion. In India, it got rooted in the slogan of the coexistence of all religions, updated by some arguing for the equality of all religions.

This obviously has no appeal to an ideology that aims at a Hindu Rashtra and the Hindu being the primary citizen. But this does bring us to the crux of the meaning of secularism — the emergence of the citizen with human rights. Earlier identities have to recede, since the identity of being a citizen is primary. This latter identity is technically unique since it should not carry the baggage of caste and religion. All citizens have equal rights in what keeps them alive as working, thinking, active human beings — such as the minimal rights to food, education, health, employment and social justice. If the citizen is aware of her rights, she cannot be fobbed off with alternate attractions that come from a specific religion or caste.

Rooted in Old Identities

For a society that has been rooted in the older identities of religion and caste, citizenship means not necessarily discarding, but certainly subordinating, old identities, and asserting the demand for human rights that alone can sustain the new status of being a citizen. It is a status that can make demands on the state and ensure the continuance of rights. For a political ideology that bases itself on the primacy of one religious group — the Hindus — and defines this religion to conform to a political programme — Hindutva — the idea of citizenship as explained above would be unacceptable.

The groups that have maximally been denied rights in the past, and that are now trying to improve their status, are those for which these activists have been working. These groups and the minorities are most easily and frequently subjected to lynching and other forms of abuse. The religious Right offers them conversion to Hinduism, but this does not change their status or enhance their claim to rights. The activists supporting human rights encourage them to think of themselves as citizens with a right to equal status with all. The struggle is over human rights and the freedom to choose what each of us wants to be.

कृत्रिम बुद्धिमत्ता, असमानता और हमारा चयन

एमआईटी के कंप्यूटर विज्ञान और कृत्रिम बुद्धिमत्ता (एआई) प्रयोगशाला के पूर्व निदेशक रूडनी ब्रूक्स चेतावनी देते हैं, ‘भविष्य का पूर्वानुमान लगाना कठिन काम है, खासतौर पर समयपूर्व ऐसा करना।’ एआई को लेकर आम जनता के बीच वार्तालाप बढ़ रहा है। इसके आधार पर लोग अपनी धारणा बना रहे हैं और यह नीतियों को प्रभावित कर रहा है। हमें तकनीक से अपने जुड़ाव को लेकर किस तरह अनुमान लगाने चाहिए? हम किस तरह का प्रभाव उत्पन्न कर सकते हैं? पहली बात तो यह कि एआई और स्वचालन एक ही आर्थिक तंत्र में अलग-अलग गति से काम कर सकते हैं। कहा जा रहा है कि एआई चौथी औद्योगिक क्रांति के लिए वही काम करेगा जो पिछली क्रांति के लिए बिजली ने किया था। एआई, बिग डेटा, स्वचालन और क्वांटम कंप्यूटिंग आदि आर्थिक प्रगति को बहुत हद तक प्रभावित कर सकते हैं।

सरकारें राष्ट्रीय नीतियों को आगे बढ़ाती हैं। चीन 2030 तक एआई के क्षेत्र में महाशक्ति बनने का लक्ष्य लेकर चल रहा है।  यूरोपीय संघ, फ्रांस और जापान इस क्षेत्र में शोध एवं विकास पर काफी धनराशि खर्च कर रहे हैं। इस दौरान वे वैधानिक ढांचे में रहकर एआई के विकास पर कार्य कर रहे हैं। अमेरिका के एक कार्यबल ने विस्तृत शोध एवं विकास योजना की बात कही है और वह एआई को लेकर कार्यबल गठित कर रहा है। नीति आयोग का चर्चा पत्र भारत में ‘सबके लिए एआई’ की समावेशी दृष्टि की बात करता है।  परंतु यह बदलाव अलगाव लाने वाला नहीं होगा। पुराने और नए उद्योग, तकनीक और उत्पादन के तरीके सब एक साथ अस्तित्व में रहेंगे। यह बहुगतिक स्वचालन औद्योगिक नीतियों को जटिल बनाएगा। उभरती तकनीक और बड़ी बाजार हिस्सेदारी को लेकर पहले ही प्रयास शुरू हो चुके हैं। चीन की 2025 संबंधी नीति 10 क्षेत्रों को चिह्नित करती है जिसमें रोबोटिक्स और सेमी कंडक्टर शामिल हैं। इन क्षेत्रों में स्वदेशी कंपनियां स्वदेशी बाजार पर काबिज रहने के साथ वैश्विक स्तर पर प्रतिस्पर्धा करने की इच्छा रखती हैं। अनुमान लगाना आसान नहीं है।

चीन जिन 10 क्षेत्रों में रोबोट्स की बहुत अधिक भूमिका देखता है उनमें ऊर्जा और खनन, चिकित्सा और रक्षा क्षेत्र शामिल हैं। इनके अलावा सफाई, फिल्म निर्माण और साहचर्य भी शामिल हैं। औद्योगिक नीतियां अगर ऊपर से निर्धारित हों तो वे बहुत सीमित लक्ष्य हासिल कर पाती हैं। तकनीक हमें सक्षम बनाती है लेकिन वह अपने आप में लक्ष्य नहीं है। जवाबदेह उत्पादन और खपत इस बात पर निर्भर करती है कि एआई और स्वचालन की मदद से संसाधनों की किफायत किस तरह बढ़ाई जा सकती है, खाद्य क्षेत्र के नुकसान को कम किया जा सकता है और सामग्री का पुनर्चक्रण और दोबारा इस्तेमाल तय किया जा सकता है। नीतियां वह दिशा तय कर सकती हैं जो नवाचार की ओर ले जा सकते हैं।

दूसरा, भविष्य के रोजगार के बारे में अनुमान लगाने से बचना चाहिए। एआई और स्वचालन को लेकर जो भी टिप्पणियां की जा रही हैं वे रोजगार को होने वाले नुकसान की बातों से भरी रहती हैं। इसमें उच्च कौशल वाले रोजगार की बात भी शामिल है। इस बीच अमेरिका 78,000 एआई शोधकर्ता तैयार कर चुका है और चीन में उनकी संख्या इसके करीब आधी है। यह तकनीकी विकास का अहम संकेतक है लेकिन इससे रोजगार के नुकसान की बात तो सामने नहीं आती। कन्फेडरेशन ऑफ इंडियन इंडस्ट्री (स्पष्टीकरण : मैं संचालन समूह का सदस्य था) की 2017 की एक रिपोर्ट कई ऐसे कारकों की पहचान करती है जो रोजगार के माहौल को आकार देंगे। इसमें शिक्षण तंत्र, उद्यमों का आकार और ढांचा, सामाजिक सुरक्षा तंत्र और तकनीक और नवाचार के माध्यम से समावेशी वृद्घि की बात शामिल थी।

उत्पादक रोजगार और उत्कृष्ट काम के लिए हमें नए कौशल और नए क्षेत्रों में अवसर तलाशने होंगे। पानी, स्वच्छता, कचरा प्रबंधन और स्वच्छ ऊर्जा वृद्घि के लिहाज से महत्त्वपूर्ण क्षेत्र होंगे। जरा कल्पना कीजिए कि छतों पर विद्युत व्यवस्था लगाने में कितने नए रोजगार आएंगे या जल एवं स्वच्छता क्षेत्र के बुनियादी ढांचे में विकेंद्रीकरण अथवा अहम खनिज और अन्य संसाधनों के सही इस्तेमाल, पुनर्चक्रण और दोबारा इस्तेमाल का प्रशिक्षण पाने वालों को मिलने वाला काम। परंतु श्रमिकों के अधिकारों का क्या? नई तकनीक से संचालित होने वाली अर्थव्यवस्था में किसी का व्यक्तिगत आर्थिक मूल्य कामों के मानकीकरण के व्युत्क्रमानुपाती होता है। काम जितना विशिष्ट होगा, कामगारों में उसका मोल भी उतना ही अधिक होगा। कामगार कई तरह के कौशल विकसित कर सकते हैं। इस नई व्यवस्था में अगर हर कोई अपना मालिक खुद होगा तो वेतन वृद्घि या स्वास्थ्य कवरेज की मांग किससे की जाएगी?

तीसरी बात, लोकतांत्रिक सहभागिता पर पडऩे वाले दबाव को भी समझना होगा। सन 1949 में आंबेडकर ने कहा था कि सामाजिक और आर्थिक क्षेत्र की असमानता राजनीतिक लोकतंत्र को खतरे में डाल सकती है। अगर एआई स्वचालन और अन्य उभरती तकनीक आर्थिक असमानता को बढ़ावा देंगी तो लोकतांत्रिक प्रणाली में सांकेेतिक राजनीतिक असमानता पर क्या असर होगा? कराधान की बात करें तो अगर रोबोट मनुष्यों से अधिक उत्पादक हो गए तो क्या उन पर कर लगेगा? कई विकासशील अप्रत्यक्ष कराधान पर भरोसा करते हैं। अगर रोबोटों की संख्या बढ़ेगी तो अप्रत्यक्ष कर राजस्व बढ़ेगा। इसे स्वचालन बढऩे से प्रभावित वर्ग में वितरित किया जा सकता है। अगर रोबोट अनिवार्य सेवाओं को भी सस्ता बना देंगे तो सरकारों को नई तकनीक के बारे में सोचना होगा।

ऐसे राजनीतिक माहौल में रोबोट की बात सुनी जाएगी या उसके मालिकों की? या पीडि़तों की? अगर एआई अवसर की असमानता तथा सामाजिक और सांस्कृतिक पूर्वग्रह को बढ़ाएगा तो दिक्कत होगी। चौथा, तकनीक स्थायी विकास में मददगार हो सकती है। एआई ऊर्जा, जल, शहरों या जलवायु परिवर्तन के लिए ऐप्लीकेशंस विकसित करता है तो यह बहुत अहम होगा। अल्गोरिथम आधारित मशीन अन्य मॉडलों के पर्यवेक्षण की प्रामाणिकता के आधार पर आकलन कर सकती है। एआई अधिक लचीले और स्वायत्त बिजली ग्रिड को नवीकरणीय ग्रिड से जोडऩे में मदद कर सकता है। विंड टर्बाइन के प्रोपेलर अगर हवा की गति और दिशा का अंदाजा लगा सकें तो उनका प्रदर्शन बेहतर हो सकता है। सेंसर और कंट्रोल सिस्टम की मदद से पानी की कमी वाले इलाकों में सिंचाई सुविधा बढ़ाई जा सकती है। किसानों को बेहतर उपज वाली बुआई की जानकारी दी जा सकती है। चक्रवात की पहचान में एआई पहले ही मददगार है।

एआई को अब तकनीक से समाज की ओर ले आना होगा। हम अभी भी आम कृत्रिम बुद्धिमत्ता से दूर हैं। सन 2013-14 में 82,944 प्रोसेसर वाले एक सुपर कंप्यूटर को वह आकलन करने में 40 मिनट लगे थे जो इंसानी दिमाग एक सेकंड में कर सकता है। तकनीकी विकास का क्रम चलता रहेगा। असमानता और अवसर इस प्रक्रिया का हिस्सा हैं। महत्त्वपूर्ण यह है कि हम उनकी क्षमताओं का अपनी बेहतरी के लिए कैसे इस्तेमाल कर सकते हैं।

नोटबंदी के निष्कर्ष

भारतीय रिजर्व बैंक (आरबीआई) की बुधवार को जारी वार्षिक रिपोर्ट कुछ हद तक सरकार की नोटबंदी की कवायद पर भी नतीजे पेश करती है। सरकार ने 8 नवंबर, 2016 को 500 और 1,000 रुपये की तत्कालीन मुद्रा बंद करने की घोषणा की थी जो कुल प्रचलित मुद्रा का 86 फीसदी थी। रातोरात नोटबंदी के लिए कई दलील दी गई थीं। इनमें नकदी के रूप में भंडारित काले धन का खात्मा, सरकार को प्रचुर लाभ, देश के भुगतान तंत्र के डिजिटलीकरण और बचत को वित्तीय परिसंपत्तियों में बदलने जैसी बातें शामिल थीं। आरबीआई का कहना है कि नोटबंदी में बंद कुल नकदी में से 99.3 प्रतिशत नोट बाद के दिनों में सरकार की घोषणा के मुताबिक विभिन्न बैंकों में बदल लिए गए। आरबीआई की इस बात के लिए सराहना की जानी चाहिए कि उसने अंतिम आंकड़े जारी करने में सावधानी बरती, भले ही ये आंकड़े मौजूदा सरकार के लिए राजनीतिक रूप से शर्मिंदगी भरे क्यों न साबित हों। नीतिगत दृष्टि से देखें तो अब यह बात स्पष्ट हो चुकी है कि नोटबंदी के लिए तय लक्ष्य प्राप्त नहीं हो सके हैं।

सर्वाधिक आशावादी दृष्टिकोण दो अनुमानों पर आधारित था: पहला अनुमान यह था कि बहुत बड़ी मात्रा में नकदी को कर अधिकारियों से छिपाकर रखा गया है। दूसरा अनुमान यह था कि यह नकदी तंत्र में वापस नहीं आएगी, कम से कम उचित कर दर पर तो बिल्कुल नहीं। अगर नकदी उच्च कर दर पर वापस आती तो सरकार को अच्छा कर प्राप्त होता। अगर ऐसा नहीं होता तो इसे आरबीआई की बैलेंस शीट पर प्रचुर लाभ के रूप में दर्ज किया जाता क्योंकि तब वह इसे सरकार को सौंप सकता था। परंतु 99.3 प्रतिशत बंद नोटों की वापसी ने इस आकलन की धज्जियां उड़ा दीं। अन्य संभावित लाभ की बात भी परवान नहीं चढ़ी। उदाहरण के लिए ऐसी कोई जानकारी सामने नहीं आई है कि नकली नोट बनाने वाले नए नोटों की नकल नहीं कर पा रहे हैं। इसके अलावा चूंकि 500 और 1,000 रुपये के नोट की जगह 2,000 रुपये के नोट जारी किए गए तो यह भी स्पष्ट नहीं होता है कि भला उच्च मूल्य मुद्रा में होने वाले लेनदेन या भारी भरकम नकद राशि के भंडारण पर रोक कैसे लगेगी।

दुख की बात तो यह है कि नोटबंदी की कवायद ने आम घरों की बचत पर नकारात्मक प्रभाव डाला। आरबीआई ने बीते वर्षों के दौरान आम घरों की बचत के जो आंकड़े जारी किए हैं वे भी काफी कुछ बताते हैं। आम पारिवारिक बचत में छोटे असंगठित क्षेत्र के उद्यमों की बचत भी शामिल होती है। इन्हें भी नोटबंदी ने तगड़ा झटका दिया। हालांकि आम पारिवारिक बचत 11 फीसदी सकल राष्ट्रीय व्यय योग्य आय के साथ कई वर्षों के उच्चतम स्तर पर है परंतु इसकी बनावट का विश्लेषण दिलचस्प है। सच तो यह है कि आम परिवारों के पास अब नोटबंदी के पहले से ज्यादा नकदी बचत के रूप में है। बैंक जमा में आई उल्लेखनीय गिरावट की यह भी एक वजह हो सकती है। हालांकि शेयर बाजार का बेहतर प्रदर्शन भी इसका एक कारण है। दूसरे शब्दों में कहें तो बचत को वित्तीय तंत्र में लाने की कोशिश नाकाम रही। चाहे जो भी हो, सकल घरेलू उत्पाद में नकदी का अनुमान ऐसे स्तर पर पहुंच चुका है जिसकी तुलना नोटबंदी के पहले के स्तर से की जा सकती है। ऐसा प्रतीत होता है कि नोटबंदी से जो भी बदलाव आए वे सरकार की अपेक्षाओं से परे थे। अब आशा की जानी चाहिए कि सरकार भविष्य में नीतियां बनाते समय इस घटना से जरूरी सबक लेगी और नोटबंदी जैसे ऐसे कदमों से बचेगी जिन्होंने अर्थव्यवस्था को स्पष्ट रूप से धक्का पहुंचाया।

जिंदगी का ढर्रा भी बदले

घर की देहरी लांघ कामकाजी क्षेत्र में कदम रखने वाली महिलाओं के अंदर आज सबसे बड़ा डर यह है कि कहीं किसी कारण उनसे उनका काम न छीन लिया जाए। कहीं उनकी नौकरी न चली जाए। इसके लिए वे कई बंदिशें झेलती हैं। दुकानों-फैक्ट्रियों में तकरीबन अमानवीय स्थितियों में काम करती हैं। अपने अधिकारों को जानकर भी प्राय: अनजान बनी रहती हैं। लेकिन इधर केरल की कुछ महिलाओं ने एक यूनियन-असांगधादित मेखला तोझिलाली संघ (संक्षेप में एएमटीयू) बनाकर और काम के दौरान खाली वक्त में सीट पर बैठने के अधिकार (राइट टू सीट) पर केरल सरकार को कानून बनाने को बाध्य करके साबित किया है कि अगर उनकी जिंदगी में तब्दीली आई है तो उनकी जरूरतों और उन्हें देखने-समझने का ढर्रा भी बदलना होगा।असल में, केरल का मामला यह है कि वहां उत्तर भारत के उलट ज्यादातर दुकानों में ग्राहकों को सामान दिखाने और रेस्तरां में भोजन परोसने आदि का काम महिलाएं ही करती हैं।

उत्तर भारत में सिर्फ साड़ी, गहने और महिलाओं से जुड़े उत्पादों को ग्राहकों के सामने रखने-दिखाने का काम ही सेल्स गर्ल्स या सेल्स वूमेन के हवाले हैं, अन्य काम सेल्समैन (पुरुष) करते हैं। इस धारणा के चलते केरल और अन्य दक्षिण भारतीय राज्यों की महिलाओं को सेल्सगर्ल्स के रूप में काम करने के बेशुमार मौके मिले हैं। इससे कम पढ़ी-लिखी महिलाओं को भी छोटे-मोटे वेतन वाली नौकरियां आसानी से मिलती रही हैं।  नौकरी की वजह से कई बार घुटन भरे माहौल और घर से बाहर निकलने की आजादी भी इसी कारण वे हासिल कर पाई हैं। लेकिन इस पेशे से जुड़ी एक दिक्कत ने लंबे अरसे से उनकी समस्याएं बढ़ा रखी थीं। सेल्सगर्ल्स को काम के दौरान सीट पर बैठने की इजाजत प्राय: न के बराबर रही है। उन्हें सुबह से शाम तक कड़ी मेहनत के बाद भी ब्रेक लेने का अधिकार नहीं था। वे एक मिनट भी नहीं बैठ सकती थीं। इससे उन महिलाओं को पैर की नसों में सूजन (वेरीकोज वेन्स), यूरिनरी इन्फैक्शन और गर्भाशय की बीमारियां झेलने को मजबूर होना पड़ता है। असंगठित क्षेत्र के कामकाज से जुड़ी महिलाओं की समस्या यह भी है कि यदि वे बैठने के अधिकार जैसे विषयों पर दुकान या रेस्तरां मालिक से कोई बात करतीं, तो ज्यादा आशंका यही रहती थी कि उन्हें अपनी नौकरी न गंवानी पड़े।

कुछ उदाहरण ऐसे भी मिले, जब सेल्स वूमेन ने काम के घंटों के दौरान ग्राहक नहीं होने पर सीट पर जाकर बैठने की गलती की, तो उनके वेतन से इस लापरवाही के लिए एक रकम जुर्माने के तौर पर काट ली गई। इसमें भी एक बड़ी विडंबना का सामना उन्हें तब करना पड़ा जब सेल्स वूमेन या सेल्स गर्ल्स के साथ अमानवीय बर्ताव की शिकायतों को लेकर कुछ महिलाओं ने केरल के व्यापारी संगठनों और दुकान-रेस्तरां मालिकों से बात की। उन्होंने इस मुद्दे पर टके सा जवाब देते हुए कहा कि अगर महिलाएं काम के खाली वक्त में सीट पर बैठना चाहती हैं और अपने कामकाजी स्थलों पर टॉयलेट बनाना चाहती है, तो बेहतर होगा कि वे अपने घर चली जाएं और खाली बैठें। वर्ष 2010 से आठ साल के अरसे में पूरे राज्य में फैले राइट टू सीट अभियान के असर से केरल सरकार दुकान एवं वाणिज्यिक प्रतिष्ठान कानून में संशोधन करने को बाध्य हुई। हाल में इस संधोधन को नोटिफाई कर दुकानों, होटलों और रेस्तरां की महिला वर्करों को काम के दौरान जरूरी अधिकार दिए गए हैं।

यह अभियान सिर्फ एक मिसाल है कि महिला वर्करों को कामकाजी हलके में किस नजर से देखा जाता है और उन्हें कितनी सहूलियतें दी जाती हैं। पुरुष वर्करों के मुकाबले कम वेतन, दुकान या फैक्टरी परिसर में महिला शौचालय का अभाव और कई अन्य सुविधाओं के अभाव के बावजूद स्त्रियां काम करना चाहती हैं। अक्सर वे शिकायत भी नहीं करतीं। लेकिन जब काम के दौरान मामूली ब्रेक लेने पर वेतन में कटौती हो और 10-12 घंटे खड़े होकर काम करने की वजह से बीमारियां घेर लें, तो इस तकलीफ से निजात पाने की अपेक्षा उन्हें जरूर होती है। इन सबसे ऊपर उन्हें कामकाजी क्षेत्र में कायम इस मानसिकता से लड़ना पड़ता है कि अगर लड़की-स्त्री को काम दिया गया, तो शादी, बच्चे, ससुराल में किसी भी सदस्य की बीमारी-हारी में ज्यादा छुट्टी देने से उत्पादकता पर असर पड़ेगा। सवाल है कि अगर हमारा समाज बेटी को मेहनत से काम करके दो पैसे कमाने की सुविधा देने को तैयार नहीं है तो बेटी बचाने, बेटी पढ़ाने के नारे का आखिर क्या औचित्य बचता है?

आगे आएं पार्टियां

संगीन अपराधों में लिप्त लोगों के खिलाफ आरोप तय होने पर उन्हें चुनाव लड़ने से रोकने की याचिका पर सुप्रीम कोर्ट ने साफतौर पर कहा है कि अदालत द्वारा दोषी ठहराए जाने से पहले किसी व्यक्ति को चुनाव लड़ने से रोकना कठिन होगा। सुप्रीम कोर्ट की संविधान पीठ ने इस मसले पर चुनाव आयोग, केंद्र सरकार समेत सभी पक्षों की दलीलें पूरी करने के बाद अपना फैसला सुरक्षित रख लिया है। इसका आशय यह है कि राजनीतिक दल आपराधिक आरोपों का सामना कर रहे व्यक्तियों को टिकट और अपना चुनाव चिह्न आवंटित नहीं करते हैं, फिर भी वे स्वतंत्र चुनाव तो लड़ ही सकते हैं। हालांकि उसके जीतने की संभावना बहुत कम रहेगी। लेकिन सबसे महत्त्वपूर्ण सवाल तो यह है कि क्या इस मसले पर राजनीतिक दलों के बीच सहमति बन पाएगी? अगर ऐसा संभव होता तो चुनाव आयोग, जागरूक गैर-सरकारी संगठन और सुप्रीम कोर्ट पिछले तीस वर्षो से राजनीति के अपराधीकरण को रोकने के लिए जूझते नहीं रहते।

दरअसल, राजनीति के अपराधीकरण को रोकने की जितनी जिम्मेदारी चुनाव आयोग और सुप्रीम कोर्ट की है, उससे कहीं ज्यादा बड़ी जिम्मेदारी राजनीतिक दलों की है। अगर राजनीति के अपराधीकरण पर पूरी तरह अंकुश लगाने के मसले पर ये तीनों एकमत हो जाते हैं, तो इसमें शक की कोई गुंजाइश ही नहीं है कि राजनीतिक व्यवस्था स्वच्छ न रह पाए। इसलिए राजनीतिक दलों को जीत सुनिश्चित करने के अपने लालच से ऊपर उठना होगा। वरना सुप्रीम कोर्ट या चुनाव आयोग चाहे जितनी कोशिशें कर लें, राजनीतिक दल कोई न कोई चोर दरवाजा तलाश लेंगे। दरअसल, अपराधी किस्म का व्यक्ति राजनीतिक दलों के लिए ज्यादा मुफीद होता है, क्योंकि चुनाव जीतने में वह हर तरह की मदद करता है। इसलिए राजनीतिक दल राजनीति में अपराधियों का इस्तेमाल न करने के प्रति अपनी दृढ़ता नहीं दिखाते। राजनीतिक अपराधीकरण से जुड़ा एक और महत्त्वपूर्ण पहलू है, जो कम गंभीर नहीं है। सरकार की नीतियों के विरोध प्रदर्शन के दौरान राजनीतिक कार्यकर्ताओं पर अनेक मुकदमे दर्ज हो जाते हैं। इसलिए राजनीति में अपराधीकरण को रोकने के लिए कानून से ज्यादा नैतिकता की जरूरत है। क्या हमारे राजनीतिक दल इस दिशा में कोई पहल करेंगे।

गिरफ्तारी कितनी जायज

माओवादी होने और संघर्षरत माओवादियों का साथ देने के आरोप में हुई गिरफ्तारियों पर कई संगठनों, नेताओं, वकीलों और तथाकथित सामाजिक कार्यकर्ताओं ने तीखा विरोध किया है। इसके पहले भी पुणो पुलिस ने पिछले जून में जब पांच लोगों को गिरफ्तार किया था तब भी विरोध हुआ था लेकिन उस समय का तेवर ऐसा नहीं था। दरअसल, पुणो पुलिस इस वर्ष के आरंभ में भीमा कोरेगांव से आरंभ हिंसा और उसके विस्तार की जांच करती हुई इस निष्कर्ष पर पहुंची कि इसके पीछे शहरों में सामाजिक-सांस्कृतिक संगठनों के नाम पर काम कर रहे माओवादियों की भूमिका है। उन्हीं गिरफ्तार आरोपितों में से एक के मेल से जो पत्र बरामद हुआ, उसमें प्रधानमंत्री नरेन्द्र मोदी की स्व. राजीव गांधी की तर्ज पर हत्या की योजना की र्चचा थी। उसके बाद पुलिस और सक्रिय हुई और जांच के बाद उसके पास कुछ नाम आए जिनमें ये गिरफ्तारियां हुई हैं। इनमें वारवारा राव जैसे लेखक और कवि ने माओवादियों के समर्थक होने को कभी छिपाया भी नहीं। शेष के बारे में तो पुलिस ही बता सकती है।

भीमा कोरेगांव घटना के पूर्व यलगार परिषद आयोजित किया गया था, जिसमें काफी भड़काऊ भाषण हुआ था। उसके बाद शौर्य दिवस मना। उसमें भी कुछ नेताओं पर ऐसे ही भाषण का आरोप है। पुलिस का मानना है कि यह सब एक सोची-समझी साजिश का हिस्सा थी, जिसके पीछे शहरों में छद्म नाम से रह रहे माओवादियों का हाथ था। अगर यह सच है तो फिर ऐसे लोगों के प्रति किसी तरह की सहानुभूति प्रकट नहीं की जा सकती। अगर शहरों में छद्म वेश में बैठे माओवादी हिंसा करा रहे हैं तो यह बिल्कुल खतरनाक स्थिति है और इस तंत्र को ध्वस्त किया ही जाना चाहिए। यह भी सच है कि जंगलों में हथियार उठाए माओवादियों को कई स्तरों पर सहयोग और समर्थन मिल रहा है। इसके आरोप में पहले भी लोग गिरफ्तार हुए हैं। किंतु हमारा मानना है कि पुलिस के पास जब तक संबंधित व्यक्तियों के माओवादी गतिविधियों में संलिप्त होने के पुख्ता सबूत नहीं हों, उसे गिरफ्तार न करे। माओवादियों का समर्थक होना गलत है, लेकिन इस आधार पर किसी के खिलाफ कानूनी कार्रवाई हो सकती है या नहीं इस पर हमेशा दो राय रहे हैं। गिरफ्तारी के बाद किसी को अगर न्यायालय सबूतों के अभाव में रिहा कर देती है तो इससे माओवादियों का हौसला ही बुलंद होगा। इसलिए पुलिस ऐसे मामलों में पूरी सतर्कता से काम करे। उम्मीद करनी चाहिए पुणो पुलिस ऐसा ही कर रही होगी।

अंतरिक्ष की ओर

अंतरिक्ष में जाना मानव का शुरू से ही सपना रहा है। अमेरिका, रूस और चीन ने तो दशकों पहले ही इसमें बाजी भी मार ली थी, लेकिन भारत के लिए यह अब तक एक सपना ही बना रहा। लेकिन अब वह वक्त दूर नहीं जब भारत का यह सपना साकार होगा। चार साल बाद यानी 2022 में भारत अंतरिक्ष में मानव मिशन भेज कर ऐसा करने वाला दुनिया का चौथा देश हो जाएगा। साल 1984 में भारत के पहले और एकमात्र अंतरिक्ष यात्री राकेश शर्मा अंतरिक्ष में गए थे। लेकिन तब भारत के पास इसके लिए कोई सुविधा नहीं थी और उन्हें अमेरिकी यान टी सोयूज की मदद से भेजा गया था। अब भारत जो मिशन भेजेगा, वह पूरी तरह स्वदेशी होगा। ‘गगनयान’ नाम के इसके अभियान को कामयाब बनाने के लिए भारत जरूरी प्रौद्योगिकी विकसित कर चुका है।

अंतरिक्ष की उपलब्धियों के संदर्भ में देखें तो भारत ने काफी कुछ हासिल किया है, लेकिन दुनिया के कई देशों की तुलना में हम अभी बहुत पीछे हैं। जब पहली बार चांद पर मानव ने कदम रखा था, तब भारत के वैज्ञानिक राकेट के हिस्सों को साइकिल पर रख कर प्रक्षेपण स्थल तक ले जाते थे। अमेरिका की अंतरिक्ष एजेंसी नासा और यूरोपीय अंतरिक्ष एजेंसी ने अब तक ढेरों अंतरिक्ष मिशन पर काम किया है। दूसरे ग्रहों तक अपने यान भेजे। चांद पर अमेरिका और रूस अपने अंतरिक्ष यात्रियों को दशकों पहले उतार चुके हैं। चीन भी जल्द ही चंद्रमा पर अपना मानव मिशन भेजने और अपना अंतरिक्ष स्टेशन बनाने की तैयारी में है। अगर इन सब उपलब्धियों से तुलना करके देखें तो लगता है भारत ने अभी तक कुछ नहीं किया। इसलिए भारत को अभी काफी कुछ हासिल करना है। फिर भी यह तथ्य है कि भारत आज राकेट, प्रक्षेपण यान और उपग्रह बनाने और छोड़ने में कामयाबी हासिल कर चुका है। अंतरिक्ष में यात्रियों को भेजने का मिशन काफी जोखिम भरा होता है। भारत के लिए यह चुनौती भरा इसलिए भी है कि पहली बार इतने बड़े मिशन को अंजाम दिया जाना है।

अंतरिक्ष यान, उसे भेजने के लिए प्रक्षेपण यान, यात्रियों के लिए जरूरी सुरक्षा तकनीक इसरो पहले ही विकसित कर चुका है। यह यान अंतरिक्ष यात्रियों को लेकर लौटेगा भी। दस हजार करोड़ रुपए की लागत वाले इस अभियान को कामयाब बनाने के लिए इसरो कोई भी जोखिम नहीं लेना चाहता। इसलिए पहले दो मानव-रहित मिशन अंतरिक्ष में भेजे जाएंगे। इसरो के पूर्व प्रमुख जी माधवन नायर ने तो अंतरिक्ष यात्रियों के प्रशिक्षण में अमेरिका या रूस की मदद लेने की जरूरत बताई है, क्योंकि भारत के पास फिलहाल ऐसी सुविधा नहीं है। भारत को अभी अपना अंतरिक्ष यात्री प्रशिक्षण केंद्र स्थापित करने में काफी वक्त लगेगा। यों तो, अंतरिक्ष में मानव मिशन भेजने के लिए प्रौद्योगिकी विकसित करने का काम 2004 में शुरू हो चुका था, लेकिन बाद में इसे ठंडे बस्ते में डाल दिया गया। तब से यह मिशन आगे नहीं बढ़ पाया। हालांकि इस दिशा में छोटे-मोटे प्रयोग होते रहे। दो साल पहले तक भी इसरो प्रमुख ने कहा था कि अंतरिक्ष में मानव को भेजना प्राथमिकता नहीं है। जाहिर है, ऐसे मिशन सिर्फ राजनीतिक नेतृत्व की इच्छाशक्ति की वजह से सिरे नहीं चढ़ पाए। भारत के पास वैज्ञानिक प्रतिभाओं की कमी नहीं है। वैज्ञानिक संस्थानों को धन और संसाधनों के अभाव से जूझना पड़ता है और तमाम बड़ी परियोजनाएं फाइलों में दबी रह जाती हैं। अगर वैज्ञानिक संस्थानों को पैसे की कमी और सरकारी अड़ंगों का सामना नहीं करना पड़ता, और राजनीतिक इच्छाशक्ति होती तो शायद हम काफी पहले ही अंतरिक्ष में जाने का सपना पूरा कर लेते!

The safety valve

It was left to the Supreme Court to stand up for due process, and it took the first step. The Pune police had swooped in on human rights activists in six cities on Tuesday, raiding residences, and arresting five of them under a draconian law that has a very low bar for evidence and a very high tolerance of state arbitrariness. The lack of clarity about why they had been arrested was not incidental.

What were the dots that connected these activists to the anti-Dalit violence that broke out at Bhima Koregaon in January on the commemoration of a 200-year-old victory of Mahar soldiers in the British army over the Peshwa’s Maratha troops — the Unlawful Activities (Prevention) Act (UAPA), given teeth, incidentally, by a Congress-led government, does not oblige the state to answer that question.

Or any other, for that matter. What were the links between the Elgaar Parishad, a conclave held at Pune on the eve of the violence, and Naxal groups, and a purported conspiracy to assassinate the prime minister revealed by a letter found conveniently on a computer, and the activists who were raided and arrested? On Wednesday, the Supreme Court did not get daunted by a law that permits no questions even as it gives right of way to the state to trample on individual liberties. The court issued notices to the Centre and Maharashtra governments, sought answers, and allowed only house arrest of the activists till the next hearing a week later.

Most hearteningly, Justice DY Chandrachud, part of the CJI Dipak Misra-led bench homed in on the heart of the matter: “Dissent is the safety valve of democracy. If dissent is not allowed then the pressure cooker may burst”. Justice Chandrachud’s cautionary note, his warning, must be heeded by a government that has earned itself quite a reputation for intolerance of political opponents and criminalising of protest. Tuesday’s arrests will be read against a backdrop. It is made up of the attempts made earlier on the watch of the NDA government, to label slogan-shouting students on a university campus as “seditious” and “anti-national”. It is shored up by the coinage of “urban Naxal/Maoist” as a catch-all description for all those who dare to disagree with the powerful and the majoritarian.

There is, of course, a clear and identifiable danger called Naxalism/Maoism, of guerillas engaged in a civil war against the state. But it is a travesty that the term should be extended and loosened to encompass citizens apparently armed with nothing but their dissenting views, at a time, ironically, when the guerillas are in retreat.

The Supreme Court has asked the question. The state must answer why it felt the need to treat respected activists, a priest, a lawyer and a poet in the manner of dreaded terrorists and criminals. And the Supreme Court must hold the government to account for any and every perversion of due process, any and every sabotage of justice, that is bared in the process. When the law is draconian and the politics intolerant, it falls on the Supreme Court to safeguard and uphold the Constitution.

Challenges at BIMSTEC

Many of the elements that made SAARC hostage to political rivalry can re-emerge in Kathmandu

The Bay of Bengal Initiative for Multisectoral Technical and Economic Cooperation (BIMSTEC) summit in Kathmandu this week, which Prime Minister Narendra Modi is scheduled to attend, will be another milestone for India after the BRICS-BIMSTEC Outreach Summit hosted by it in 2016, as the grouping has gradually emerged as a key vehicle to take forward India’s regional, strategic and economic interests.

Stagnation of SAARC

Two major factors have driven India’s interests in the BIMSTEC forum. A key reason for India to reach out to its BIMSTEC neighbours has been the stagnation of the South Asian Association for Regional Cooperation (SAARC). This limited both the scope of India’s growing economic aspirations as well as the role it could play in improving regional governance.

This, however, did not stop India from revitalising the SAARC grouping when opportunities emerged. Two recent instances underscore its failed attempts. At the 18th SAARC Summit in Kathmandu, in 2014, India proposed the SAARC Motor Vehicles Agreement. However, this could not progress due to resistance from Pakistan. This compelled Bangladesh, Bhutan, India, and Nepal (BBIN) to sign the BBIN Motor Vehicles Agreement in 2015. As Prime Minister Narendra Modi said in Kathmandu, regional integration in South Asia would go ahead “through SAARC or outside it, among all of us or some of us,” keeping the doors open for those outside to join when they felt confortable to do so. Pakistan also opted out of the ambitious SAARC Satellite project proposed by India, leading to a change in its name to the South Asia Satellite. There is a tendency in some quarters to see India’s interests in BIMSTEC as part of its strategy to isolate Pakistan and position BIMSTEC as an alternative to SAARC. The above instances suggest otherwise.

The main motivation for India to push BIMSTEC is thus not Pakistan; rather, it is in the country’s interest to ensure that the region does not lag behind and that an unstable neighbourhood does not drag its growth. India’s desire to link South Asia to the economically dynamic Southeast Asia is also part of this strategy.

The rationale behind making the BIMSTEC mechanism work is to reassure South Asia that the region can work together to achieve common goals with India playing its due role.

A few challenges

There will be challenges for India from both within and outside. These will pose policy dilemmas. India is currently the largest contributor to the BIMSTEC secretariat’s budget. India’s annual contribution was Rs. 2 crore (or 32% of the total secretariat budget) for 2017-18. With the secretariat planning to strengthen its capacity by increasing human resources and the number of officials representing each member state, India may need to consider allocating more resources. India’s generosity would be a key test of its commitment to the subregional grouping.

Another issue would be for India to counter the impression that BIMSTEC is an India-dominated bloc, a problem that it faced for a long time in SAARC. In reality, the suspicion was mutual in SAARC — while India was wary of the smaller neighbours ‘ganging up’ against it, the smaller neighbours were worried that closer integration might lead to India’s domination.

Today, most of the smaller neighbours are more willing to engage so as to benefit from India’s economic rise. Nonetheless, for internal political reasons, the same issue may re-emerge and pose hurdles in the progress of BIMSTEC. To moderate such suspicions, India will need to show sensitivity to the concerns of smaller neighbours.

The China question

Another strategic challenge for India is that China has long desired to be part of the SAARC grouping. Some SAARC members also have their own interests in bringing China into the equation: they want it to balance India’s dominance. China has observer status in SAARC. When this was given, it only increased the demand to make China a full member of SAARC. India will have to carefully navigate the emerging regional geopolitics, as many of the elements that made SAARC hostage to political rivalry and turned it into a defunct mechanism can re-emerge in BIMSTEC.
