Data protection must strictly impose purpose limitation and penalties for breaches

A high-level government committee of experts headed by Justice BN Srikrishna has released a white paper seeking views from stakeholders on data protection. Coming against the backdrop of the apex court’s landmark decision upholding right to privacy as a fundamental right, data protection has certainly become a hot-button issue. Driving the debate is government and other agencies increasing the scope of Aadhaar linking for services – a matter slated to be adjudicated by a constitution bench of the Supreme Court.

In fact, the unique identification number bolstered by an individual’s biometric data is now being used for everything from school admissions to obtaining death certificates. While the utility of such moves is left vague, the fear that the data provided could be leaked or misused is real. Current data collection practices in the country hardly inspire confidence, with personal information regularly being shared among different parties without the knowledge of customers. In such a scenario, pushing Aadhaar linking for day-to-day transactions is akin to having a digital master key that can open all facets of an individual’s life.

Such a master key would certainly violate the right to privacy upheld by the Supreme Court. Not only could unscrupulous elements misuse personal data for profit or crime, there are also concerns that an Aadhaar-backed data architecture can be used to profile individuals on the basis of their caste, religion, sexual orientation, political opinion, etc. Given these anxieties, the need of the hour is for a comprehensive data protection framework. This should include an independent data protection authority to handle issues related to use of information collected by governments and corporations.

Among other things, data protection norms should strictly implement the purpose limitation principle whereby data collected is only used for the purpose stated to the individual. And tough penalties should also be imposed for breaches of purpose limitation. This could include stiff financial compensation to customers and even criminal prosecution of violators. Many of these provisions are part of BJD MP Baijayant Jay Panda’s private member’s bill on data privacy, which can be used as a guide. Add to this the need for a strong cyber security architecture to ensure data isn’t stolen through digital attacks. With the digital environment set to grow further – and government looking to push Digital India initiatives – it’s time to give data privacy its due importance.

More structural solutions regarding lower courts are needed

A few themes dominate popular news on courts in India: the tussle between the judiciary and executive over appointments; activism by the higher judiciary; and the mounting backlog of cases. More urgent and systemic issues that affect the ordinary citizen seeking justice, are often sidelined.

President Ram Nath Kovind, in an insightful address while inaugurating the National Law Day celebrations last Saturday, adopted a distinctively subaltern lens to focus public attention on several such issues. Though his entire address merits careful reading, two substantive issues raised by him — the culture of seeking adjournments, and the lack of attention paid to the lower judiciary — have the potential to alter the present public discourse on the judiciary. His underlying message, too, is potentially course-correcting: that the judiciary can no longer expect respect from the people by evoking awe and fear. Like other institutions of democracy, it would have to earn its respect through performance.Kovind described a paradox in Indianlitigation culture: of the poor shying away from legal battles due to their duration and cost, and the well-off often using litigation as a way to delaythe resolution of disputes. Both of these occur because of the frequency with which adjournments are asked for by lawyers, and granted by courts.

A Vidhi Centre for Legal Policy study, ‘Inefficiency and Judicial Delay: New Insights from the Delhi High Court’ (goo.gl/rKE59L), published earlier this year, found that counsel sought adjournments in more than 91% of cases in the data set filed in 2011-15 that were over two years old. While the Code of Civil Procedure limits adjournments to three per case, the Delhi High Court granted more than three adjournments in nearly 70% of cases. This underlines the truth of Kovind’s clear message that if the justice system is to work for the ordinary Indian, mindsets in the legal fraternity that tolerate generous adjournments need to change.

Kovind also turned public attention away from the shenanigans currently plaguing the Supreme Court to the subordinate courts, much neglected by the media. He particularly pointed to the need to build capacity of judges in lower courts and enhance trust in their judgements. This is a universally acknowledged need, but solutions have been of the band-aid variety. The quality of lower court judgements is viewed suspiciously by the higher judiciary, and often rightly so.However, the only remedy so far has been a growing acceptance of appeals by the high courts and Supreme Court, leading to an acute pendency problem. More structural solutions regarding lower courts are, thus, needed.

To do this, issues facing the lower courts must be analysed in far greater depth by policymakers. Another recent Vidhi report, ‘Ranking Lower Court Appointments’, found that the average timeline for recruitment of judges in most states far exceeds the timeline set by the Supreme Court, with a three-tier exam process for district judge and civil judge (junior) posts taking almost a year on average in different states. This is an unpardonably inefficient process disincentivising quality applications.

Second, career growth prospects of lower court judges need to be created. Currently, more than half of high court judges are recruited from the bar, lowering the chances of progression for career judges.These dim career prospects are insufficient to attract talent to the lower judiciary — which may, in turn, feed the higher judiciary’s tendency to appoint a greater number of its own from the bar. As the president highlighted, capacity-building of lower court judges in the form of continuing legal education is essential.

In making these points, Kovind wasn’t simply calling for substantive reform. Equally crucially, he appeared to be subtly challenging the dominant mindset in the higher echelons of the legal fraternity that popular respect for courts will remain high, even if difficult questions of integrity, efficiency and accountability are glossed over.By saying that “public life is today aglass house. There is a relentless demand for transparency and scrutiny. Our legal fraternity needs to be mindful of these legitimate urges of the people — the ultimate masters in ademocracy,” Kovind firmly reminded the Bar and the Bench that they cannot shy away from higher scrutiny and accountability, hallmarks of today’s information age.For a fraternity that appears to be wedded to a hidebound style of functioning, the message from the Head of State on the eve of the 67th anniversary of the Constitution was a timely one: in a constitutional democracy, courts will enjoy public confidence only if justice, for the poorest Indian, is not a cloistered virtue. To this end, much has been done. But much more remains.

Finance commission’s cup brimmeth over

Rethink states’ tax share hike to 42% from 32%

The government has set up the Fifteenth Finance Commission (FiFC) with a markedly ambitious agenda. The terms of reference of the commission, mandated mainly to determine the distribution of tax proceeds between the Centre and the states, are sweeping. Matters in the interest of sound finance can be referred to the commission, but overloading the commission with a host of spending and development goals to be achieved via devolution incentives is not a great idea. Taxes, including the devolved taxes, are the states’ right and not a favour to be dispensed by the Centre. Minor incentivisation of some small grant or the other is doable, but any attempt to link major transfers to fulfilment of central dreams would lead to avoidable federal strain.

The FiFC is expected to recommend a fiscal consolidation roadmap for sound fiscal management, and appropriate levels of general and consolidated debt and deficit. This makes sense, and previous commissions too had examined these matters. For the first time, the FiFC will assess the impact of the goods and services tax adopted in July this year, and other structural reforms, on the finances of the Centre and states. This is crucial, given the huge demand on resources for the government to meet infrastructure investments and spending needs.The Fourteenth Finance Commission pushed up the states’ share of the Centre’s taxes to 42% from 32%. This calls for a serious rethink. Now that the Centre and the states share a common tax base for most indirect taxes other than import duties, there is no rationale for retaining much of goods and services tax proceeds in the Centre’s divisible pool. Making goods and services tax simple will foster better compliance, and boost revenues. Sensible policy-making is the government’s remit, and cannot be left to any third party.

संतुलन जरूरी

गत सप्ताहांत राष्ट्रीय विधि दिवस के अवसर पर आयोजित एक कार्यक्रम में केंद्रीय कानून मंत्री रविशंकर प्रसाद और देश के प्रधान न्यायाधीश न्यायमूर्ति दीपक मिश्रा न्यायिक नियुक्तियों और संवैधानिक दायित्वों के बारे में अलग-अलग बातें करते नजर आए। दोनों ने एक दूसरे के संस्थान को आड़े हाथों लेते हुए आरोप लगाया कि उनका संस्थान दूसरे की सीमाओं का अतिक्रमण कर रहा है। प्रसाद ने सर्वोच्च न्यायालय द्वारा राष्ट्रीय न्यायिक नियुक्ति आयोग (एनजेएसी) को खारिज किए जाने की आलोचना की। इस आयोग के जरिये राजनेताओं और नागरिक समाज के लोगों को कुछ ऐसे अधिकार दिए जाने थे जो ऊपरी अदालतों में होने वाली नियुक्तियों को प्रभावित करने में भूमिका निभा सकते थे। एनजेएसी की योग्यता अथवा अयोग्यता पर बहस हो सकती है लेकिन प्रसाद ने जो कुछ कहा उसे एक राजनेता द्वारा अपने शासन प्रमुख के बचाव के रूप में ही देखा जाना चाहिए। प्रसाद ने कहा कि सर्वोच्च न्यायालय को मोदी में भरोसा दिखाना चाहिए था क्योंकि मोदी ‘एक लोकप्रिय और वैश्विक नेता’ हैं। जनता के भरोसे के चलते ही उनके पास परमाणु हथियारों का बटन तक है। अगर वह बतौर एक अधिवक्ता प्रधानमंत्री की भूमिका को संवैधानिक दायरे में व्याख्यायित करते तो कहीं अधिक बेहतर होता। मिश्रा के प्रतिवाद में सख्ती नजर आ रही थी। उन्होंने संविधान के अनुच्छेद 75 की व्याख्या करने वाले निर्णय की ओर संकेत किया जिसमें प्रधानमंत्री से की गई संवैधानिक अपेक्षाओं की बात कही गई है।

 इन बातों ने कार्यपालिका और न्यायपालिका के बीच के तनाव को सार्वजनिक किया होगा लेकिन सच तो यह है कि हाल के वर्षों में दोनों ही संस्थानों ने अपनी प्रतिष्ठïा का बचाव नहीं किया है। प्रधानमंत्री नरेंद्र मोदी ने आपातकाल में सर्वोच्च न्यायालय द्वारा दिए गए दो निर्णयों का जिक्र कर परोक्ष आलोचना की और कहा कि उस वक्त की सरकार सत्ता के संवैधानिक अलगाव का सम्मान नहीं करती थी। परंतु उनकी सरकार ने भी देश के पूर्व सोलिसिटर जनरल गोपाल सुब्रमण्यन को सर्वोच्च न्यायालय का न्यायाधीश बनाने की बात खारिज करके कोई अच्छी नजीर नहीं पेश की थी। जबकि उसने 2014 में सत्ता में आते ही तीन अन्य नामों को मंजूरी दी थी। याद रहे कि सुब्रमण्यन ने सोहराबुद्दीन मामले में न्याय मित्र (एमिकस क्यूरे) की भूमिका निभाई थी और उनकी भूमिका के चलते ही सर्वोच्च न्यायालय ने मोदी के मुख्यमंत्री रहते मामले की सीबीआई जांच की अनुशंसा की थी।
अगर मान लिया जाए कि कार्यपालिका में अदालत के भरोसे की दलील इसके चलते कमजोर पड़ती है तो साथ ही प्रधान न्यायाधीश ने जब यह कहा कि न्यायपालिका तीनों शक्तियों के बीच शक्ति विभाजन को पहचानती, स्वीकार करती और उसका परस्पर सम्मान करती है, तो वह भी बात को कुछ ज्यादा ही खींच रहे थे। हाल के वर्षों में न्यायपालिका की अनाधिकार चेष्टा के तमाम उदाहरण हैं। दूरसंचार लाइसेंस और कोयला खदान लाइसेंस रद्द करना इसका उदाहरण हैं। इनकी वजह से अर्थव्यवस्था महीनों तक अस्थिर रही। कई उद्योगपतियों की कैद के मामले में उसने बंदी प्रत्यक्षीकरण के सिद्घांत का उल्लंघन किया। न्यायपालिका की कमियों को दूर करने का काम भी ठीक से नहीं हुआ है। अदालतों में बड़े पैमाने पर रिक्तियां हैं। खासतौर पर निचली अदालतों में जहां लोग सबसे पहले न्याय मांगने जाते हैं। इसके चलते तमाम मामले लंबित हैं। इस बीच कई बेकार जनहित याचिकाओं की सुनवाई में अदालत का वक्त बरबाद होता है। प्रसाद और मिश्रा दोनों ने अगर राष्ट्रपति रामनाथ कोविंद की बातों पर ध्यान दिया होता तो बेहतर होता। उन्होंने कहा कि सरकार के तीनों अंगों के बीच गूढ़ और नाजुक संतुलन आवश्यक है। आम जनता के बीच बहसबाजी से यह लक्ष्य हासिल नहीं होगा।

खाद्य प्रसंस्करण के विकास पर हो जोर

पिछले दिनों दो ऐसी रिपोर्ट्स आईं, जिन पर ज्यादा लोगों का ध्यान नहीं गया, लेकिन यदि इन रिपोर्ट्स में कही बातों पर वास्तव में गंभीरतापूर्वक काम किया जाए तो हमारी ग्रामीण अर्थव्यवस्था के साथ-साथ रोजगार के परिदृश्य में भी व्यापक सुधार नजर आ सकता है। बीते 21 नवंबर को उद्योग मंडल एसोचैम और शिकागो की विश्व प्रसिद्ध एकाउंटिंग फर्म ग्रांट थॉर्टन द्वारा संयुक्त रूप से प्रकाशित अध्ययन रिपोर्ट में कहा गया कि भारत में खाद्य प्रसंस्करण (फूड प्रोसेसिंग) क्षेत्र से किसानों की आय में भारी सुधार के साथ-साथ रोजगार वृद्धि की उज्ज्वल संभावनाएं हैं। रिपोर्ट यह भी कहती है कि वर्ष 2024 तक भारत के खाद्य प्रसंस्करण क्षेत्र में 33 अरब डॉलर का नया निवेश आकर्षित करने और 90 लाख नए रोजगार अवसर सृजित करने की क्षमता है। इसी तरह पिछले दिनों नीति आयोग ने भी ‘भारत की ग्रामीण अर्थव्यवस्था में संरचनात्मक बदलाव का रोजगार तथा वृद्धि पर प्रभाव नामक परिचर्चा पत्र में कहा कि किसानों को फसल के अच्छे मूल्य के लिए सीधे कारखानों से जोड़ने और ग्रामीण क्षेत्रों में रोजगार वृद्धि के लिए खाद्य प्रसंस्करण सबसे उपयुक्त क्षेत्र है। रिपोर्ट के अनुसार बीते चार दशक के दौरान देश की ग्रामीण अर्थव्यवस्था में सात गुना वृद्धि हुई, लेकिन रोजगार दोगुने भी नहीं बढ़े हैं। ऐसे में खाद्य प्रसंस्करण में सुधार से कृषि व संबंधित क्षेत्रों में बड़ी मात्रा में रोजगार सृजित हो सकते हैं।

भारत में खाद्य प्रसंस्करण के तहत पांच क्षेत्र हैं। डेयरी क्षेत्र, फल व सब्जी प्रसंस्करण, अनाज का प्रसंस्करण, मांस-मछली एवं पोल्ट्री प्रसंस्करण तथा उपभोक्ता वस्तुएं जैसे पैकेटबंद खाद्य और पेय पदार्थ। नवीनतम आंकड़ों के अनुसार भारत दुनिया का सबसे बड़ा दुग्ध उत्पादक देश है। भैंस के मांस, पालतू पशुओं और मोटे अनाज के मामले में भी भारत सबसे बड़ा उत्पादक है। भारत का फलों और सब्जियों के उत्पादन में दुनिया में दूसरा क्रम है। भारत कुल खाद्यान्न् उत्पादन में भी विश्व में दूसरे स्थान पर है। लेकिन भारत में खाद्य उत्पादन के प्रसंस्करण का स्तर विश्व के अन्य देशों की तुलना में बहुत कम है। देश में कुल खाद्य उत्पादन का मात्र 10 प्रतिशत हिस्सा प्रसंस्करित किया जाता है, जबकि प्रतिवर्ष 40 फीसदी फसल नष्ट हो जाती है। विश्व में खाद्य प्रसंस्करित वस्तुओं के कुल निर्यात में भारत की हिस्सेदारी मात्र 2.2 प्रतिशत है। भारत से खाद्य प्रसंस्करित वस्तुओं के निर्यात में मात्रात्मक दृष्टि से भी काफी कमी आई है। 2012 में यह निर्यात 36.53 अरब डॉलर मूल्य का था, जो 2016 में घटकर 29.19 अरब डॉलर रह गया, जबकि ऐसे उत्पादों का आयात लगातार बढ़ा है।

वस्तुत: खाद्य प्रसंस्करण क्षेत्र कृषि और विनिर्माण दोनों क्षेत्रों का एक महत्वपूर्ण घटक है। खाद्य प्रसंस्करण की वजह से उपज का अधिकतम इस्तेमाल सुनिश्चित हो पाता है तथा प्रसंस्करित वस्तुएं उपभोक्ताओं तक सुरक्षित व साफ-सुथरी स्थिति में पहुंचती हैं। खाद्य प्रसंस्करण क्षेत्र कई अन्य पूंजी आधारित उद्योगों की तुलना में ज्यादा रोजगार प्रदान करता है।

इसमें दोमत नहीं कि सरकार ने खाद्य प्रसंस्करण क्षेत्र में विनिर्माण, तकनीकी शोध एवं विकास के लिए कई प्रयास किए हैं। खाद्य प्रसंस्करण से संबंधित नौ मेगा फूड पार्क संचालित हो रहे हैं, जबकि 41 फूड पार्क को मंजूरी मिली है। इसी तरह देश में 100 से अधिक शीत भंडारण श्र्ाृंखलाएं कार्यरत हैं, जबकि 236 के लिए मंजूरी दी गई है। सरकार ने निर्दिष्ट फूड पार्कों में अलग-अलग खाद्य प्रसंस्करण इकाइयों को सस्ता कर्ज उपलब्ध कराने हेतु राष्ट्रीय कृषि और ग्रामीण विकास बैंक (नाबार्ड) में 30 करोड़ डॉलर मूल्य के एक विशेष खाद्य प्रसंस्करण कोष की स्थापना की है। रिजर्व बैंक ने भी खाद्य और कृषि आधारित प्रसंस्करण व शीत भंडारण इकाइयों को कृषि गतिविधियों में शामिल करते हुए उनसे संबंधित ऋण को प्राथमिकता वाले क्षेत्र में शामिल किया है। स्कीम फॉर एग्रो मरीन प्रोसेसिंग एंड डेवलपमेंट ऑफ एग्रो प्रोसेसिंग क्लस्टर्स के विकास के लिए 6,000 करोड़ रुपए की राशि मंजूर की गई है। इन प्रयासों के साथ-साथ खाद्य प्रसंस्करण को प्रोत्साहन देने के लिए बीते 21 नवंबर को सरकार ने लॉजिस्टिक्स क्षेत्र को बुनियादी ढांचे का दर्जा दिया है।

देश-दुनिया के कृषि विशेषज्ञों का मानना है कि भारत में खाद्य प्रसंस्करण उद्योग को विकसित करने के लिहाज से काफी संभावनाएं हैं। लेकिन अब तक खाद्य प्रसंस्करण उद्योग से न तो किसानों की खुशहाली के अध्याय लिखे जा सके हैं और न ही पर्याप्त रोजगार अवसर निर्मित हो पाए हैं। वार्षिक औद्योगिक सर्वेक्षण के अनुसार देश में पंजीकृत खाद्य प्रसंस्करण इकाइयों में 17.41 लाख व्यक्ति कार्यरत हैं, जबकि अपंजीकृत खाद्य प्रसंस्करण क्षेत्र में 47.90 लाख लोगों को ही रोजगार मिला हुआ है।

देश में खाद्य प्रसंस्करण क्षेत्र के समक्ष जो समस्याएं व चुनौतियां है, उनका जल्द से जल्द निदान जरूरी है। तभी इस क्षेत्र में निहित संभावनाओं का पर्याप्त दोहन किया जा सकता है। अपर्याप्त परिवहन और भंडारण सुविधाओं के कारण खेत से खाद्य वस्तुएं कारखानों तक और कारखानों से प्रसंस्करित वस्तुएं उपभोक्ता तक पहुंचने में काफी नुकसान भी हो जाता है। खेतों का रकबा बहुत अधिक बंटा हुआ होने तथा नई तकनीक व प्रक्रियाओं की अपर्याप्तता तथा कुशल श्रमिकों की कमी भी खाद्य प्रसंस्करण उद्योग को प्रभावित कर रही है। विभिन्न् देशों द्वारा लागू किए गए व्यापार संबंधी कड़े तकनीकी अवरोधकों के कारण भारतीय खाद्य प्रसंस्करण उत्पादों की निर्यात क्षमता पर भी असर पड़ा है।नि:संदेह खाद्य प्रसंस्करण क्षेत्र को देश के विकास का आधार बनाने के लिए कई बातों पर ध्यान देना जरूरी है। सरकार द्वारा चिन्हित फूड पार्कों को विश्वस्तरीय बुनियादी व शोध सुविधाओं, परीक्षण प्रयोगशालाओं, विकास केंद्रों तथा परिवहन लिंकेज के साथ मजबूत बनाना होगा। बेहतर खाद्य सुरक्षा व गुणवत्ता प्रमाणन व्यवस्था, तकनीकी उन्न्यन, लॉजिस्टिक सुधार, पैकेजिंग गुणवत्ता और ऋण की आसान उपलब्धता की मदद से खाद्य प्रसंस्करण क्षेत्र में काफी सुधार लाया जा सकता है। खाद्य प्रसंस्करित उत्पादों के निर्यात को प्रोत्साहित करने के लिए वैश्विक मूल्य-श्र्ाृंखलाएं स्थापित करने के मद्देनजर ढांचागत व संस्थागत सहायता उपलब्ध कराई जाए। खाद्य प्रसंस्करण क्षेत्र के आकार और बढ़ोतरी की संभावनाओं को देखते हुए भारत की उद्योग और व्यापार नीति को भी उसी हिसाब से तय करना जरूरी है। बेहतर होगा कि केंद्र राज्य सरकारों से यथोचित सलाह-मशविरा कर राष्ट्रीय खाद्य प्रसंस्करण नीति तैयार करे। हम आशा करें कि केंद्र व राज्य सरकारें खाद्य प्रसंस्करण क्षेत्र के विकास में आ रही बाधाओं को दूर करने की दिशा में तेजी से काम करेंगी। ऐसा करने पर निश्चित रूप से खाद्य प्रसंस्करण क्षेत्र देश में कृषि पैदावार व किसानों की आय बढ़ाने के साथ-साथ रोजगार वृद्धि में भी सहायक होगा।

ठंड कायह मौसम हमारे लिए अब तक असंतोष भरा ही रहा है। हम पूरे पश्चिमोत्तर को घेर लाने वाले विषैले स्मॉग, घटती आर्थिक वृद्धि, नौकरियां जाने और जटिल जीएसटी से निपटने में लगे हैं। लेकिन, आखिरकार एक अच्छी खबर आई है। बिज़नेस करने की आसानी के मामले में भारत विश्व बैंक की वैश्विक रैंकिंग में 30 स्थान ऊंचा उठा है। सारे दस मानकों पर सुधार हुआ है। कोई अन्य देश ऐसा नहीं कर सका है। इस रिपोर्ट को आईडीएफसी/नीति आयोग के 3,200 से ज्यादा कंपनियों के एंटरप्राइज सर्वे पर आधारित अध्ययन के साथ पढ़ने से इस भरोसे का ठोस आधार मिलता है कि आखिरकार जमीन पर सांस्थानिक सुधार शुरू हो गए हैं। यह मोदी के ‘न्यूनतम सरकार, अधिकतम शासन’ के वादे का पहला सबूत है। मूडी ने भी भारत की रेटिंग बढ़ाकर यह रेखांकित किया है कि केवल संस्थागत सुधारों से ही भारत पूरी क्षमता का दोहन कर सकेगा।भारत की कहानी निजी क्षेत्र की कामयाबी और सार्वजनिक क्षेत्र की नाकामी की कहानी है। भारत इसलिए कामयाब हो रहा है, क्योंकि इसके लोग आत्म-निर्भर, महत्वाकांक्षी, किफायती और जोखिम लेने वाले हैं। दुर्भाग्य से हमारी लालफीताशाही और नौकरशाही सर्वाधिक नौकरियां पैदा करने वाले छोटे और मध्यम उद्यमियों का उत्साह खत्म कर देती हैं। कानून-व्यवस्था, शिक्षा, स्वास्थ्य और जल-आपूर्ति जैसी सेवाओं में सरकार की जरूरत होती है, वहां यह बहुत खराब काम करती है। जहां इसकी जरूरत नहीं है, वहां यह जरूरत से ज्यादा सक्रिय हैै।

विश्व बैंक 15 साल से इस ओर ध्यान दिलाता रहा है पर भारत की हर सरकार ने बिज़नेस करने की आसानी की उपेक्षा की। विश्व बैंक के मुताबिक बिज़नेस करने की आसानी को गंभीरता से लेने वाली यह पहली भारतीय सरकार है। जब मोदी ने 142 से उठकर 50वें स्थान पर आने का लक्ष्य रखा तो हर किसी ने इसे दिवास्वप्न माना लेकिन, अब यह हासिल करने लायक लगता है। शासन और नागरिकों का आदान-प्रदान ऑनलाइन लाना हमारी सफलता का मुख्य कारण है। दूसरा कारण राज्यों में स्पर्धा की भावना पैदा करना है। एक बार जीएसटी और दिवालिया कानून की दिक्कतें दूर हो जाएं तो भारत की रेटिंग में और सुधार होगा। विश्व बैंक अधिकारियों के अनुसार पहली बार नौकरशाही लोगों के फीडबैक पर ध्यान दे रही है। निचले स्तर की नौकरशाही का रवैया आखिरकार बदलने लगा है। वित्त मंत्रालय के अधिकारियों ने कबूला है कि उन्होंने जीएसटी प्रशासन में कई गलतियां की हैं और वे संशोधन कर रहे हैं ताकि यह लोगों के अधिक अनुकूल बन जाए।राज्यों की असेसमेंट रिपोर्ट में आंध्र/तेलंगाना पहले स्थान पर है और उसके बाद गुजरात, छत्तीसगढ़, मध्यप्रदेश हैं। दिल्ली, केरल, असम, हिमाचल और तमिलनाडु सबसे खराब प्रदर्शन वाले राज्य हैं। आईडीएफसी रिपोर्ट ने पुष्टि की है कि बिज़नेस करने की आसानी में सुधार करने वाले राज्यों को ऊंची आर्थिक वृद्धि का पुरस्कार मिला है। राज्य इस रैंकिंग का इस्तेमाल निवेशक, कंपनियां और नौकरियां आकर्षित करने के लिए कर रहे हैं। भारतीय न्यायपालिका सबसे कमजोर कड़ी पाई गई। अनुबंधों को लागू करने में लगने वाले वक्त के मामले में भारत अब भी सबसे निचले स्तर वाले देशों में है। खरीदार और विक्रेता के बीच विवाद के निराकरण पर बिज़नेस निर्णायक रूप से निर्भर है। लेकिन, भारत में अब भी कमर्शियल ट्रेनिंग प्राप्त जजों वाली जिला वाणिज्यिक अदालतों का अभाव है। ही हम जजों को सुनवाई के पहले दस्तावेज ऑनलाइन पढ़ने की अनुमति देते हैं वरना फैसले जल्दी होने लगें। अनुबंध को लागू करने में चीन में भारत की तुलना में दहाई वक्त ही लगता है।

बिज़नेस करने की आसानी भ्रष्टाचार से लड़ने वाली बड़ी ताकत है। अण्णा हजारे और अरविंद केजरीवाल लोकपाल के विचार से इतने प्रभावित थे कि उन्हें अहसास ही नहीं हुआ कि बिज़नेस करने की आसानी भ्रष्टाचार हटाने में कहीं बड़ा योगदान दे सकती है। भ्रष्टाचार मलेरिया की तरह है। इससे रोकने के लिए पानी भरे गड्‌ढे खत्म करने होते हैं। लोकपाल कुनैन की गोली जैसा था जिसे आप बीमार पड़ने पर लेते हैं। भ्रष्टाचारियों को पकड़ने की बजाय भ्रष्टाचार रोकना बेहतर है। कोई अचरज नहीं कि बिज़नेस करने में आसानी वाले शीर्ष देशों में बिल्कुल नहीं या के बराबर भ्रष्टाचार है। लेकिन, उनके यहां लोकपाल जैसा ओम्बुड्समैन होता है, ताकि उच्च अधिकारियों को जवाबदेह बनाया जा सके। बिज़नेस करने की आसानी से आमआदमी की ज़िंदगी में सुधार हो सकता है। दिल्ली नगर निगम ने निर्माण की अनुमति जल्दी देने के लिए जो प्रक्रियागत बदलाव किया, उसी से जन्म प्रमाण-पत्र मिलने के दिन भी घट गए। दिल्ली में ड्राइविंग लाइसेंस में बिना कोई लेन-देन के एक घंटा लगता है।सौ की रैंकिंग के साथ भारत को अब भी लंबा रास्ता तय करना है। आईडीएफसी रिपोर्ट ने इरादे और हक़ीकत में फर्क को रेखांकित किया है। ज्यादातर आंत्रप्रेन्योर नहीं जानते कि उनके राज्य में एक ही खिड़की से मंजूरी मिल जाती है। रोजगार पैदा करने वाले क्षेत्रों को अब भी भ्रष्ट लेबर इंस्पेक्टरों का सामना करना पड़ता है। भू-अधिग्रहण लालफीताशाही में फंसा है। जैसे ही सरकार को राज्यसभा में बहुमत मिले वह श्रम और भू-अधिग्रहण संबंधी लंबित विधेयक पारित करे। यदि अफसरों को समय पर मंजूरी देने और विवाद निपटाने के लिए प्रोत्सािहत पुरस्कृत किया जाए तो रेटिंग और सुधरेगी। मोदी ने वादा किया है कि अगले कार्यकाल में वे प्रशासनिक सुधार लाएंगे। कल्पना कीजिए कि यदि हमने 1991 में बिज़नेस करने को आसान बनाया होता! तब भारत आज की तुलना में बहुत कम भ्रष्टाचार के साथ दोगुना समृद्ध होता। भारत के समाजवादी युग ने सामाजिक न्याय के साथ अार्थिक वृद्धि का वादा किया था पर दोनों में से कुछ नहीं दिया। जब शेक्सपीयर ने ‘रिचर्ड थर्ड’ में कहा- ‘हमारे असंतोष की इस शीत ऋतु को यॉर्क के इस पुत्र ने अब भव्य ग्रीष्म में बदल दिया है’ तो वे कहना चाहते थे कि दुख का वक्त गुजर चुका है। मैं कामना करता हूं कि ऐसा हम अपने देश के लिए कह सकें। जब हमारी आर्थिक वृद्धि दर 8 फीसदी को पार करेगी और नौकरियां थोक में आएगी, तभी सच्चे अर्थों में ‘अच्छे दिन’ आएंगे। इस बीच, यह एक बहुत बड़ा कदम है।

असहमति से आगे

भारत के विकास में न्यायपालिका, कार्यपालिका और विधायिका के बीच संतुलन को लेकर आयोजित सम्मेलन के दौरान इन संस्थाओं के प्रतिनिधियों के बीच जैसी असहमति और तनातनी देखने को मिली वह कोई शुभ संकेत नहीं। हालांकि इस सम्मेलन के समापन अवसर पर प्रधानमंत्री ने यह कहकर कार्यपालिका और न्यायपालिका के बीच की तल्खी को कम करने की कोशिश की कि सभी संस्थाओं को मिलकर नए भारत के निर्माण के लिए काम करना चाहिए, लेकिन ऐसी अपेक्षा से शायद ही बात बने। बेहतर होगा कि तीनों संस्थाएं और विशेष रूप से कार्यपालिका और न्यायपालिका जन अपेक्षाओं को समझें और उसी के अनुरूप कदम उठाएं। इस क्रम में उन्हें आवश्यक हो चुके सुधारों की ओर भी बढ़ना चाहिए। जैसे यह निराशाजनक है कि राजनीतिक सुधारों की गति धीमी है वैसे ही यह भी कि न्यायिक सुधारों की गाड़ी जहां की तहां नजर आती है। कार्यपालिका और विधायिका पर तो तब भी सुधारों की दिशा में आगे बढ़ने के लिए दबाव डाला जा सकता है, लेकिन ऐसी कोई गुंजाइश न्यायपालिका के मामले में नहीं हैै। ऐसी कोई गुंजाइश होनी भी नहीं चाहिए। समाज और न्यायपालिका के हित में यही उचित है कि वह हर तरह के दबाव से मुक्त हो, लेकिन यह स्थिति इसकी भी मांग करती है कि वह स्वत: सुधारों की दिशा में आगे बढ़े। मुश्किल यह है कि यही नहीं हो रहा है। यह ठीक नहीं कि जब हर क्षेत्र में सुधार हो रहे हैैं तब न्यायिक सुधार करीब-करीब ठप नजर आ रहे हैैं। आखिर इसका क्या औचित्य कि अन्य सभी क्षेत्रों में तो सुधार हों, लेकिन न्यायपालिका सुधारों से अछूती रहे? क्या यह कहा जा सकता है कि न्यायपालिका को सुधारों की कोई जरूरत नहीं?

किसी को इस सवाल का जवाब देना ही चाहिए कि किसी लोकतांत्रिक देश में यह कितना लोकतांत्रिक है कि न्यायाधीश ही न्यायाधीशों की नियुक्ति करें? भारत में ऐसा ही हो रहा है। आखिर ऐसा किस संवैधानिक व्यवस्था के तहत हो रहा है? जब संविधान कोलेजियम जैसी व्यवस्था की बात नहीं करता तो फिर वह अस्तित्व में क्यों है? सच तो यह है कि ऐसे एक नहीं अनेक प्रश्न हैैं जो अनुत्तरित हैैं। उक्त सम्मेलन में ऐसे कुछ प्रश्न राष्ट्रपति ने भी उठाए थे। यह समय की मांग है कि इन प्रश्नों के उत्तर सामने आएं। इसी के साथ यह भी आवश्यक है कि न्यायिक सक्रियता को परिभाषित किया जाए, क्योंकि अब तमाम फालतू याचिकाएं सुनी जाने लगी हैैं। आज जब खुद सुप्रीम कोर्ट यह महसूस करने लगा है कि व्यर्थ की जनहित याचिकाएं उसका समय जाया कर रही हैैं तब फिर इसका क्या मतलब कि ऐसी ही याचिकाएं सुनी जाती रहें? आखिर व्यर्थ की जनहित याचिकाएं सुनने से किसके मौलिक अधिकारों का संरक्षण होता है? इससे तनिक भी संतुष्ट नहीं हुआ जा सकता कि न्यायपालिका और कार्यपालिका के प्रतिनिधि वर्ष में दो-तीन बार एक-दूसरे के विचारों के प्रति अपनी असहमति व्यक्त कर देते हैैं, क्योंकि इससे देश को कुछ हासिल नहीं हो रहा है। असहमति से आगे भी बढ़ा जाना चाहिए। यह आवश्यक ही नहीं, बल्कि अनिवार्य है कि सभी संस्थाओं में जो सुधार और बदलाव लंबित हैैंं उनकी सुधि ली जाए।

संतुलन का तकाजा

हालांकि कार्यपालिका, विधायिका और न्यायपालिका के बीच शक्तियों के पृथक्करण के सिद्धांत को सभी मानते हैं, फिर भी कईबार एक दूसरे से बेजा दखल की शिकायत और विवाद की स्थिति पैदा हो जाती है। इसकी झलक एक बार फिर दिखाई दी। मौका था संविधान दिवस का। इस अवसर पर जहां दो केंद्रीय मंत्रियों ने न्यायपालिका के प्रति असंतोष जताया, वहीं प्रधान न्यायाधीश ने उनकी शिकायतों को निराधार बताया, और प्रधानमंत्री ने विवाद को खत्म करने की कोशिश की, यह कहते हुए कि हमारे लोकतंत्र के तीनों अंगों को संतुलन और मर्यादा के साथ काम करना चाहिए। केंद्रीय वित्तमंत्री अरुण जेटली ने न्यायिक सक्रियता पर आपत्ति जताई तो केंद्रीय कानूनमंत्री रविशंकर प्रसाद ने जजों की नियुक्ति की बाबत कोलेजियम प्रणाली को बनाए रखने पर न्यायपालिका की आलोचना की।

ये दोनों मुद््दे ऐसे हैं जिन पर बरसों से जब-तब हुई न्यायपालिका की आलोचना के और भी हवाले दिए जा सकते हैं। न्यायिक सक्रियता के पक्ष में अकसर यह दलील दी जाती रही है कि अगर सरकार अपना काम ठीक से न करे, तो लोग अदालत की शरण में जाएंगे ही। जेटली ने इस तर्क की काट में सवाल उठाया कि क्या न्यायपालिका के अपना काम ठीक से न करने की सूरत में विधायिका या कार्यपालिका उसके काम में दखल दे सकती है!उनका सवाल सोलहों आने सही है, यानी दूसरे के कार्यक्षेत्र में हस्तक्षेप नहीं होना चाहिए। पर कई बार जिसे सरकार न्यायिक सक्रियता समझती है, वह नागरिक अधिकारों से जुड़े किसी मसले पर अदालत का फैसला या टिप्पणी होती है। जैसा कि प्रधान न्यायाधीश दीपक मिश्रा ने रेखांकित भी किया है, नागरिक अधिकार हमारे संविधान का मूलाधार हैं, और संविधान के बुनियादी ढांचे से छेड़छाड़ नहीं की जा सकती; की जाएगी तो न्यायपालिका को दखल देने का अधिकार है। लेकिन यह नहीं कहा जा सकता कि जजों की नियुक्ति की कोलेजियम प्रणाली भी संविधान के मूल ढांचे का हिस्सा है। कोलेजियम प्रणाली तो सुप्रीम कोर्ट के दो फैसलों की उपज है। फिर, 2015 में राष्ट्रीय न्यायिक नियुक्ति आयोग के कानून को सर्वोच्च न्यायालय ने क्यों खारिज कर दिया, जबकि उस कानून को संसद ने सर्वसम्मति से पारित किया था?

Two years after governments set a 2025 target to end child labour, delegates from 100 nations at a recent conference in Buenos Aires were told that they will miss the deadline. The implication is also that realising the objective could take well over 20 years after the expiry of the 2030 Sustainable Development Goals (SDGs).The International Labour Organisation (ILO) estimates that eight years from now, around 121 million boys and girls would still be engaged in various occupations. The present figure is around 152 million children aged 5-17. That is to say, only 31 million children are expected to be rescued between now and 2025 from conditions that deprive them for life of the fundamental ingredients of basic survival.

Should countries resolve to reinvigorate their efforts to reach the target, they would be looking at a reduction each year of 19 million. That is close to five times the prevalent pace of decline. That would be a stupendous record of eradicating a practice inconsistent with modern democratic norms.That goal seems elusive at the moment on a number of indicators. Overall, there was a slowdown in the reduction of child labour, just one percentage point, during the four years until 2016. In contrast was the fall of three percentage points in the corresponding period up to 2012. More worrisome is that there was almost no progress with respect to the rescue of children under 12 years in the four years since 2012. Equally, the decline in child labour among girls was only half the proportion of that of boys during this period.

The ILO points to four systemic failures that underpin the lack of progress. Foremost is the absence of national legislation to give effect to global conventions on the employment of children in hazardous industries, as well as on the minimum age of work. The fact that the two instruments have received the largest number of ratifications brings into sharp focus the lack of harmony between global commitments and domestic priorities. Relevant here is the research on the incoherency between laws that prescribe a minimum age for employment and those for completion of compulsory school education. It also means that the expansion of quality universal basic education has to extend beyond the fulfilment of statutory provisions.Complementing the legal inconsistencies is the lack of effective labour inspections in the informal economy. Around 71% of working children are concentrated in the agriculture sector, with 69% of them undertaking unpaid work in family units. A strong legal framework that mandates punitive action against errant firms and recruitment of youth and adults are important tools to guarantee the protection of children. A

Sink your differences: on the executive-judiciary relationship

A touch of pragmatism is what the judiciary and the executive need at this juncture

It is disconcerting that differences between the executive and the judiciary are emerging often in the public domain these days. By raising the question whether the judiciary does not trust the Prime Minister to make fair judicial appointments, and harping on the need to maintain the balance of power between the executive and the judiciary, representatives of the Union government have risked the impression that they are putting the judiciary on the defensive. Read between the lines and the executive’s profound dissatisfaction with the state of play in relations between the two wings is evident. Union Law Minister Ravi Shankar Prasad is undoubtedly entitled to hold the view that the Supreme Court’s 2015 verdict striking down the law creating the National Judicial Appointments Commission (NJAC) reveals the judiciary’s distrust in the Prime Minister and the Law Minister. His question whether an audit is needed to determine what has been lost or gained since the collegium system was created in 1993 is not without merit. However, it is debatable whether these issues should have been raised in public, that too in the presence of the Chief Justice of India and his fraternity. Chief Justice Dipak Misra seemed coerced into responding that the judiciary reposes the same trust that the Constituent Assembly had in the Prime Minister, and that the judiciary indeed recognised and respected the separation of powers enshrined in the Constitution. There was really no need for such a public affirmation of first principles in a democracy.

However, it does not mean that major concerns over whether there is real separation of powers, whether public interest litigation has become an interstitial space in which judges give policy directives, and whether the country needs a better system than the present one in which judges appoint judges should be brushed aside. The present collegium system is flawed and lacks transparency, and there is a clear need to have a better and more credible process in making judicial appointments. It is clear that differences over formulating a fresh Memorandum of Procedure for appointments are casting a shadow on the relationship. It is best if both sides take a pragmatic view of the situation and sink their differences on the new procedure, even if it involves giving up a point or two that they are clinging to. For a start, they could both disclose the exact points on which the two sides differ so that independent experts will also have a chance to contribute to the debate. If it is the right to veto a recommendation that the government wants on some limited grounds, the Collegium must not be averse to considering it. Resolution of this matter brooks no further delay.

चंद रोज बाद अर्जेंटीना की राजधानी ब्यूनस आयर्स में आयोजित विश्व व्यापार संगठन की 11वीं मंत्रीस्तरीय बैठक भारत के लिए कई मायने में अहम है। एक तरफ जहां देश अपने किसानों की आत्महत्याओं, एमएसपी बढ़ाने और कर्ज-माफी जैसे मुद्दों पर विरोध-प्रदर्शन व असंतोष का दंश झेल रहा है, वहीं दूसरी तरफ इसे कई तरह के वैश्विक दबावों का सामना भी करना पड़ रहा है। यह सम्मेलन उस समय हो रहा है, जब देश भर के किसान फसलों के न्यूनतम समर्थन मूल्य की मांग के साथ नई दिल्ली के संसद मार्ग पर आंदोलनरत हैं। इस स्थिति में केंद्र सरकार के साथ धर्मसंकट है कि वह देश के किसानों और विश्व व्यापार संगठन की शर्तों के बीच सामंजस्य कैसे स्थापित करे? एक तरफ अपने किसानों की रक्षा का सवाल है, तो दूसरी तरफ अंतरराष्ट्रीय मंच को संतुष्ट करने की प्रतिबद्धता भी है। विश्व व्यापार संगठन की आगामी बैठक भारत और विकासशील व अल्प विकसित राष्ट्रों के लिए चुनौतीपूर्ण इसलिए है, क्योंकि इससे स्थानीय जनसंख्या के सबसे बड़े तबके के सरोकार जुड़े हुए हैं और उन पर अंतरराष्ट्रीय फैसला थोपे जाने का खतरा भी मंडरा रहा है। वर्ष 2001 के दोहा डेवलपमेंट एजेंडा के तहत वर्ष 2013 तक निर्यात पर दी जाने वाली सब्सिडी यानी ‘एक्सपोर्ट सब्सिडी’ और अन्य सहयोग समाप्त करने जैसे विषय पर सहमति थोपी गई थी, लेकिन भारत ने कृषि को यहां का जीवन माध्यम बताकर अपना मजबूत पक्ष रखते हुए विकासशील देशों द्वारा कृषि के अंतरराष्ट्रीय व्यापार और वाणिज्य व्यवस्था को विकृत करने की अपनी जिम्मेदारी से किनारा कर लिया था।

एक बड़ा सच यह है कि विश्व व्यापार संगठन में विकसित देशों का नीतिगत वर्चस्व है। अंतरराष्ट्रीय व्यापार में भी बड़ी भागीदारी होने के कारण वे तीसरी दुनिया के मुल्कों पर अपना उत्पाद थोपने हेतु बाजार की तलाश में हैं। उनका प्रचार रहा है कि विश्व व्यापार संगठन व क्षेत्रीय व्यापार समझौतों के बाद खुली आयात की स्वतंत्रता होगी, जिससे खान-पान की वस्तुओं की कीमतों में कमी आएगी। यूरोपीय देशों की इस मंशा के पीछे भारतीय व अविकसित राष्ट्रों के बाजारों पर अपना वर्चस्व स्थापित करने का प्रयास है। पिछले 22 वर्षों के इतिहास में विश्व व्यापार संगठन के कृषि संबंधी समझौतों ‘एग्रीमेंट ऑन एग्रीकल्चर’ का विकसित देशों द्वारा सिर्फ अपने हित में इस्तेमाल किया गया है। हैरानी है कि अमेरिका व अन्य औद्योगिक राष्ट्र आर्थिक संपन्नता के बावजूद अपने किसानों को भारी कृषि सब्सिडी देते हैं, जबकि इसके इतर भारत जैसे कृषि आधारित अर्थव्यवस्था के लिए किसान विरोधी कानून बनाने का दबाव डालते आ रहे हैं। आंकड़े दर्शाते हैं कि विकसित देशों द्वारा किसानों को दी जाने वाली कृषि सब्सिडी में इजाफा होता रहा है। इस दिशा में भारत-चीन ने संयुक्त प्रस्ताव रखा है कि यूरोपीय संघ व अमेरिका जैसे राष्ट्र पहले अपने यहां से 160 बिलियन डॉलर की सब्सिडी देना बंद करें, जबकि इस बीच भारत में उर्वरक, सिंचाई और बिजली पर सब्सिडी जारी है।भारत पहले से ही साधन-संपन्नता की श्रेणी में पीछे है। यहां 95 फीसदी से ज्यादा भू-स्वामी या तो गरीब हैं या फिर साधनविहिन। कुल कृषि भूमि की आधे से ज्यादा भूमि गैर सिंचित है। पिछले 21 वर्षों में 3,18,528 किसानों ने आत्महत्या की है। प्रति वर्ष औसतन 15,168 किसान आत्महत्या को मजबूर होते हैं। ज्यादातर मामलों में आत्महत्या का कारण बैंकों से मिला कर्ज है। वर्तमान एमएसपी किसानों को घाटे की ओर ले जा रही है, जिसे बढ़ाने के लिए किसान निरंतर संघर्षरत हैं। कई राज्यों में धान में नमी की मात्रा बताकर एमएसपी से भी कम कीमत दिए जाने की शिकायतें हैं। गन्ना उत्पादकों के साथ भी ऐसी ही समस्या है। मौसमी फल, सब्जी समेत कई उत्पादों पर एमएसपी का प्रावधान नहीं है। इस स्थिति में उत्पादन के समय कीमतें शून्य और बाद में गगनचुंबी हो जाती हैं। उपज कौड़ी के भाव बिकती है, जिसका सीधा नुकसान किसान को होता है। बाद में वही टमाटर 100 रुपये प्रति किलो के भाव बिकता है। जरूरत है कि भारत खाद्य सुरक्षा और किसानी के मुद्दों पर पिछले अवसरों की तरह न सिर्फ अडिग रहे, बल्कि बढ़ती महंगाई के समवर्ती सुधार के नए प्रस्ताव भी रखे।

It’s the Constitution that has checked Hindutva forces to a great extent

 November 26, the day declared as “Constitution Day”, passed off like any other day with a ritual reference by the prime minister. Independent India began its tryst with destiny with great hopes and aspirations. But it also had to face tragedies such as Partition, Hindu-Muslim conflicts, that took a large number of lives on both sides, and the assassination of Mahatma Gandhi. But while finalising the Draft Constitution, B.R. Ambedkar did not let these exigencies overtake the need for a democratic Constitution — he ruled out any element of theocracy in the document. On November 26, 1949, he placed the Draft Constitution before the Constituent Assembly. The assembly adopted the Constitution and India became a democratic republic in 1950.The Constitution is much more than the country’s fundamental laws of governance. It affirms the values of a pluralistic and diverse society and is wedded to the ideals of liberty, equality, fraternity as well as to secularism, gender justice and social, political and economic justice for all. It has been, appropriately, described as a social document.

Defining our nation in terms of one culture, language or religion is a negation of the Constitution’s ideals. Through the federal framework, it provides scope for diverse cultures and languages to flourish. It provides safeguards to the marginalised sections of society and minorities. Its liberal provisions and egalitarian values celebrate the rights and freedoms of all citizens. The consolidation of India as a nation and its resilience owe a lot to the way the Constitution has worked for more than six decades. It created the conditions for the empowerment of the deprived and disinherited sections of society.The Constitution has often faced challenges from the forces which opposed its progressive architecture of rights. In 1999 and 2002, the then NDA government talked about reviewing the Constitution. The proposal had the potential of overturning the Constitution’s core ideals. K. R. Narayanan, the then president, took a firm stand against the review of the Constitution. “Let us examine if the Constitution has failed us or we have failed the Constitution,” he said. This forced the government of the day alter its stand to review the Constitution. It appointed a commission to review the working of the Constitution.

Narayanan’s stand assumes significance at a time the Constitution is being subverted by numerous administrative measures, which are contrary to its provisions. Ambedkar had cautioned that the Constitution could be negated by subtle administrative actions that are completely against its ideals. The idea of Constitutional morality that he enunciated not only mandates that the Constitutional offices be respected, it also calls for questioning these institutions when they trample upon the rights of people and subvert the Constitution itself. The cultivation of a comprehensive constitutional morality means — among other things — the ability to question the incumbents occupying the institutions created by the Constitution. Unfortunately, the country is dismayed at the aggressive posturing of the government against all those who dare to criticise it. This muscular approach is against the Constitution’s very essence.Accommodation and understanding — not division and confrontation — lay at the heart of the methods used to frame the Constitution. In using coercive and compulsive nationalism, the government has lost sight of this spirit. It’s the Constitution that is checking the Hindutva forces to a great extent. But this also means that these forces want to subvert the Constitution to usher in Hindu rashtra. Cow vigilantism, the lynching of Muslims in many parts of India in the name of cow protection and the barbaric attack on Dalits by the Hindutva groups go against the Constitution.

The right to life guaranteed by the Constitution includes rights to education and healthcare, right to work and shelter and right to clean air and water. The policies of the government have compromised such rights. Neo-liberal policies have not only resulted in jobless growth but also job losses.We need to be mindful of the plight of the poor and the toiling masses and socially discriminated sections of our society. Communal and fascist tendencies of the government pose a threat to the Constitution and the nation as a whole. It is extremely important to take concerted action to save the Constitution from such forces. Saving the Constitution would mean saving the nation.


 First among equals

The pillars of democracy were not designed as silos. Besides, the judiciary enjoys special status among them

Legislature should have the independence of making laws, the executive should have independence in taking decisions,” Prime Minister Narendra Modi said on Sunday. The law minister and the finance minister have also spoken on the separation of powers, which is a load-bearing beam of the fundamental structure of the Constitution. However, while the prime minister has stressed its need, he has done so in a way that suggests that the government would like to see the legislature, the judiciary and the executive as silos at arm’s length from each other, with each allowing the others to go about their business. Law Minister Ravi Shankar Prasad has said that if the people can trust the prime minister with the nuclear button, surely he can be trusted to appoint judges through his law minister. This is an apples and pears argument which seems to misunderstand, or to deny, that in the constitutional scheme, separation of powers is also a way of institutionalising checks and balances.Finance Minister Arun Jaitley has said that the judiciary may intervene in the event of executive failure, but only to issue directives to spur it into action. It should not commit judicial overreach by getting into executive functions, like organising the running of sports organisations or dealing with the non-performing assets of banks. True, but Jaitley has neglected to acknowledge the reality that much of progressive law was developed in courts through the innovation of public interest litigation, precisely because the legislatures had failed to enact laws in the public interest. The finest fruit of this process is the entire corpus of environmental law. If the ambit of the PIL territory has widened and the people regard the judiciary as the court of first resort, it only betrays a lack of confidence in securing executive or legislative action.

The prime minister affirmed the nation’s allegiance to the balance of powers, but stressed that each pillar of democracy should be aware of its “limits”. The president drew attention, instead, to the “intricate and delicate balance” between them. The pillars of democracy are not supposed to stand coyly aloof, careful not to trespass. They were designed to lean into each other with countervailing force, in order to hold up the edifice of democracy. Besides, amidst the high-minded talk of the equality of the three institutions, it is all too easy to forget that the judiciary is the first among equals. It is the custodian, interpreter, upholder and defender of the Constitution. The power of judicial review sets it above the others. If the government tries to even the odds, it must run the risk of being perceived to be in search of a “committed judiciary”, a mercifully short-lived institution which India’s people cast into the dustbin of history in 1977.
