China’s Take on FDI Remade in India

GoI’s decision to block the automatic route for approving foreign direct investments (FDI) from China has surprised many, and not just Chinese investors. But the decision was probably arrived at after much deliberation, and is meant to be used as a diplomatic lever in dealing with Beijing.

The order, if implemented without any amendment, will hit a wide range of companies that have some component of Chinese investments. These firms will find their future growth plans constrained. Incidentally, the Jio-Facebook partnership would operate in this same space and hit Indian tech companies with Chinese investments.

At least 18 of the top 30 unicorns have a component of Chinese investments. Nearly 1,000 Chinese companies have some presence in India. Besides, there are hundreds of small and big Indian companies who have either received Chinese investments or expect to do so in the coming year.

GoI seems to be bringing back the rationale on which the Foreign Investment Promotion Board (FIPB) once operated as an assessment agency — until its abolition in 2017. Finance minister Arun Jaitley had explained, ‘With the government easing the process of doing business by eliminating discretion and adopting market mechanism for allocation of resources, the industry does not have to visit corridors of power any more.’ So, what has changed now?

GoI was reportedly alarmed by a creeping investment of 1.01% of shares of HDFC, India’s biggest mortgage bank, by the People’s Bank of China (PBOC), the country’s central bank. But this may just be the right kind of excuse GoI was looking for before issuing the April 17 order.

But it may have been more than a knee-jerk decision. GoI may have wanted to arm itself with the power to reject a Chinese investment proposal, or force the investment company to amend its offer. This is what happened during the FIBP era when foreign investors and fund-receiving Indian companies tried to tailor their proposals to suit the government’s temperament as much as market requirements.

Welcome to the era of high-power business diplomacy with India’s embassy and consulates in China playing an important role, something perhaps expected with former Indian ambassador in Beijing S Jaishankar now foreign minister. Removing the automatic approval route will strengthen GoI’s bargaining arm with not only investing companies but also the Chinese State.

In the new scenario, Chinese companies may be forced to sweeten the deal by not just offering better terms, but also adding technology licensing in the package. A recent op-ed piece in the State-backed Global Times (bit.ly/2VXtEsz) stated that India can gain from Chinese investments in manufacturing.

Compared to China, which forced hundreds of western and Japanese firms to surrender technological knowhow and pass on management secrets to their Chinese partners in return for market access, India has done little by way of bargaining. India has given the world a glimpse of its desperation for foreign investments while simultaneously fearing foreign acquisition — contradictory though these two strands may be — in quite an unsubtle manner.

This may be a good time to remedy that situation, since a good part of the developed world is in the same boat when it comes to economic growth during Covid-19. The Indian move is, in fact, in line with a worldwide trend. It is also a reversal of previous thinking that Chinese companies would be eager to enter India simply because they face resistance elsewhere. Apparently, New Delhi has realised that this is not happening, particularly in manufacturing where new investments are required more urgently.

Chinese diplomats are known for aggressively lobbying on behalf of companies that Beijing wants to promote globally. It has a special preference for firms like Huawei and Tencent, which are capable of making strategic use of capital by grabbing new technologies or data-shedding markets.

It is interesting that the Chinese foreign ministry did not raise the issue at its regular briefing to avoid internationalising its objection to India’s new FDI norms. It was left to the Chinese embassy in New Delhi to critique the decision when it stated that the ‘barriers set by Indian side for investors from specific countries violate WTO’s principle of non-discrimination, and go against the general trend of liberalisation and facilitation of trade and investment’. China invoked WTO and the need for global cooperation when Germany tried to impose restrictions on investments by its companies.

There is nothing particularly harsh about this statement. Chinese propaganda specialists seem to have realised that most Indians now stand solidly with the Narendra Modi government’s fight against Covid-19, and any sign of aggressive criticism may result in a public outcry against China. Besides, China wouldn’t want to jeopardise future investment opportunities.

But it would be dangerous to overestimate the attractiveness of the Indian market for China, and assume that the FDI rule will force it to change its stance altogether.

A nifty-post COVID justice

Virtual methods, technologies should become the norm at all levels of judiciary

If every adversity presents an opportunity and every cloud has a silver lining, then the COVID-19 pandemic is the time to bring in innovations and new paradigms in the administration of justice. Though what follows is Supreme Court-centric, it can be replicated with appropriate modifications at all levels of the judiciary. What is sadly missing is not talent, capacity or funding but attention to detail and a holistic, uniform protocol at each level of the hierarchy.

First, we cannot have vacation court-like functioning during the pandemic and switch magically to the pre-COVID normal after the lockdown. It would be naive to assume that post lockdown, hordes of lawyers will, or should be, allowed to descend upon the SC, and business will resume as usual. Since pre-COVID normalcy is many months away, we must evolve three protocols, not two — lockdown, post lockdown pre-normal and normal.

Second, during the lockdown, there is no reason why a minimum of two-thirds, indeed all 35, of SC judges should not sit daily. Why is the best equipment, the best technology, not operational over the last month to enable this? Instead, we have two or three benches sitting and dealing with less than 50 matters every week. Indeed, with the state-of the-art technology, judges should not be required to meet and endanger themselves, as is currently happening.

Third, the two largest rooms at the new SC building should be fully equipped to enable a limited number of lawyers, who cannot afford virtual lawyering, to present their arguments from within the court — they should maintain strict social distancing. The lawyers who fall in this category or would want to come to court are, of course, a minuscule number. However, they must be facilitated.

Fourth, the strict test of urgency currently applied must be maintained. False urgency claims are the bane of Indian litigation. They clog the legal pipeline while ordinary and poor litigants have to undergo an eternal wait. COVID and its short-term aftermath is the best time to evolve two tracks of litigations. Judges holding courts that are akin to a vacation bench could deal only with hyper urgent cases — as is currently happening, albeit trebling the current listings. The bulk of the remaining 35 judges can then take up cases that are going on for 10 years or more. Within a few months, all the cruel figures which underline the high pendency rate of the SC will vanish. But this requires a ruthless listing procedure since one party will always be interested in causing delays. The procedure should also involve careful screening by judicial interns, advance invitations of five or seven-page written submissions should be issued and strict time limits, based on such pre-screening, fixed. All five-judge and higher bench references may be excluded from this list for the time being.

Fifth, for the full court to function, we should have had ramped up technology yesterday. It is deplorable that the apex court is not equipped with efficient technology. This would require Rs 100-crore at most — surely the SC deserves this amount. The judiciary should be the least concerned with issues such as seating arrangements for judges, the number of parties and advocates who can be accommodated and the quality of audio and video. All this should be operationalised by technicians working on government directions. We are inexcusably behind on all this.

Seventh, when full normalcy returns (the third phase), we must ensure that these methods are used to conduct a significant proportion, perhaps 33 per cent, of all hearings. The much-criticised orality of the Indian system will diminish, time limits that we have failed to implement for seven decades will become the new normal, and precision, through written submissions, will get a boost. Less crowding, less wastage, less dirt and less transmission of infection can easily become the new normal.

Eighth, as the above paradigms extend to lower court hierarchies, virtual lawyering will allow shift systems for courts and make evening and night courts routine, without egregiously enhanced strains on our infrastructure.

The possibilities are limitless. We have nothing to lose except our chains, habits and comfort zones. Let us start by utilising the full forthcoming SC vacation to virtually function at full strength.

No 100% quota

Supreme Court ruling stresses that overzealous reservation tends to affect rights of other communities

The Supreme Court is right in considering cent per cent reservation as anathema to the constitutional scheme of equality even if it is for the laudable objective of providing representation to historically deprived sections. The verdict quashing the reservation of 100% of all teaching posts in ‘Scheduled Areas’ of Andhra Pradesh for local Scheduled Tribes is not against affirmative programmes as such, but a caution against implementing them in a manner detrimental to the rest of society. A five-judge Constitution Bench found that earmarking teacher posts in areas notified under the Fifth Schedule of the Constitution adversely affected the interests of other candidates not only from Scheduled Castes and other backward communities but also other ST communities not native to those areas. Of course, what the State government did, in its original orders of 1986, and thereafter, in a subsequent order in 2000, was not without its own rationale. It found that there was chronic absenteeism among teachers who did not belong to those remote areas where the schools were located. However, its solution of drafting only members of the local tribes was not a viable solution. As the Bench noted, it could have come up with other incentives to ensure the attendance of teachers. Another aspect that the court took into account was that Andhra Pradesh has a local area system of recruitment to public services. The President, under Article 371D, has issued orders that a resident of a district/zone cannot apply to another district/zone for appointment. Thus, the 100% quota deprived residents of the Scheduled Areas of any opportunity to apply for teaching posts.

Affirmative action loses its meaning if it does not leave the door slightly ajar for open competition. Dr. B.R. Ambedkar observed during the debate in the Constituent Assembly on the equality clause, that any reservation normally ought to be for a “minority of seats”. This is one of the points often urged in favour of the 50% cap imposed by the Court on total reservation, albeit with some allowance for relaxation in special circumstances. It is still a matter of debate whether the ceiling has innate sanctity, but it is clear that wherever it is imperative that the cap be breached, a special case must be made for it. Such a debate should not divert attention from the fact that there is a continuing need for a significant quota for STs, especially those living in areas under the Fifth Schedule special dispensation. In this backdrop, it is somewhat disappointing that courts tend to record obiter dicta advocating a revision of the list of SCs and STs. While the power to amend the lists notified by the President is not in dispute, it is somewhat uncharitable to say that the advanced and “affluent” sections within SCs and STs are cornering all benefits and do not permit any trickle-down. Indian society is still some distance from reaching that point.

Joining of giants

The coming together of Facebook and Jio is exciting, but there is a risk of a monopoly

Facebook’s decision to invest ₹43,574 crore for a 9.9% stake in Reliance Industries Ltd.’s Jio Platforms marks a rare coming together of two giants who have a reputation for market domination. The focus of their combined might is the India retail sector, a difficult terrain as large parts of it are still unorganised. But then for the same reason, it holds potential for huge disruption. In recent years, the retail space has been an ongoing battlefield for behemoths such as Amazon and Walmart, themselves globally dominant players. The other interested parties in this are payment services companies such as the Softbank- and Alibaba-backed Paytm, and Google, which runs Google Pay. But the combination of Facebook and Reliance will be difficult to beat — they seem to have both the marketplace and the payment solution sides covered. For Facebook’s WhatsApp messaging service, India is the biggest market with over 400 million users. It currently awaits regulatory approval for its payment solutions. Jio is now India’s No. 1 telecom brand by user base, less than four years after it launched its service. And then, JioMart is a recently-launched commerce marketplace, which seeks to connect local retailers with consumers. And this is why, “the largest investment for a minority stake by a technology company anywhere in the world” (as a Reliance Industries press release put it to describe the Facebook move) has been notably accompanied by an agreement to “further accelerate” business on the JioMart platform using WhatsApp.

In short, it is a win-win deal for both players. While its social media services and messaging services have been extremely popular in India, Facebook has however struggled to get past regulatory concerns in India over some of its ambitious projects such as its free limited Internet offering Free Basics and digital currency Libra. While it stays blocked in mainland China, Facebook now gets to participate in a stronger way in one of the world’s fastest growing markets for e-commerce. Reliance can rely on the popular messaging service to accelerate the building of its marketplace. It has also received handy money to reduce its debt. The deal, coming as it does at a time when the world is fighting the coronavirus pandemic, is a thumbs up to India’s potential. It is noteworthy that this is the largest foreign direct investment in the technology sector in India. But will the deal that brings together the world’s largest social media company and the group that is a leader in everything from oil to data lead to more consolidation and fewer players, as it happened in the telecom sector? It is a big question mark, and the deal should not be passed without closely scrutinising this. For, the future of India’s Internet economy is at stake.

संकट के दौर में भी चीन की विस्तारवादी रणनीति जारी

दुनिया के अधिकतर देश कोविड-19 से पैदा हुई चुनौतियों से निपटने के लिए जूझ रहे हैं, लेकिन विवादित दक्षिण चीन सागर (एससीएस) में चीन की सैन्य गतिविधियां निर्बाध रूप से जारी हैं। हाल के दिनों में चीन ने समुद्री क्षेत्र में बड़ी संख्या में तैनाती करने के अलावा सैन्य अभ्यास भी किए हैं और साथ ही इस इलाके में ऊर्जा संसाधनों की खोज का आधिकारिक समारोह भी मनाया है। वियतनाम के विदेश मंत्रालय ने पिछले हफ्ते आरोप लगाया कि चीनी कोस्ट गार्ड के जहाज ने एससीएस के पारासेल द्वीप पर आठ वियतनामी मछुआरों को ला रही उसकी नौका को टक्कर मारकर डुबो दिया। उसने कहा है कि ऐसा करके चीन ने इस द्वीप पर उसकी संप्रभुता को चुनौती देने के साथ ही उसकी संपत्ति का नुकसान किया और लोगो की जिंदगी को खतरे में डाला। वियतनाम सरकार ने हनोई में चीनी दूतावास से इस पर विरोध भी जताया। नातुना सागर में भी चीन का मछली पकड़ने वाला जहाज और इंडोनेशिया का मछलीमार जहाज आमने-सामने आ गए थे। नातुना के निकट चीन की अवैध मछली पकड़ने की गतिविधि और यहां के जलमार्ग पर दावे के गंभीर वैश्विक परिणाम हो सकते हैं, क्योंकि इसी क्षेत्र से दुनिया का एक तिहाई समुद्री व्यापार होता है। इसके अलावा सैटेलाइट चित्रों से पता चलता है कि गत 28 मार्च को पश्चिमी फिलीपींस सागर के फायरी क्रॉस रीफ पर चीन का एक सैन्य विमान भी उतरा था। इसके अलावा चीन ने इस सागर में एक रिसर्च स्टेशन भी स्थापित किया है। ऐसा लगता है कि जब चीन में कोरोना का संकट चरम पर था, उस समय भी उसने अपनी विस्तारवादी क्षेत्रीय रणनीति को धीमा नहीं होने दिया। उस समय भी एससीएस क्षेत्र में चीन के ट्रांसपोर्ट विमानों की आवाजाही संकेत देती है कि देश के स्वास्थ्य संकट से चीनी सेना शायद ही प्रभावित हुई हो।

इस इलाके पर दावा जताने वाले फिलीपींस ने चीनी कोस्ट गार्ड की हरकत की आलोचना की है और विदेश मंत्रालय ने एक बयान में कहा है कि इस तरह की घटनाएं चीन और दक्षिण-पूर्व एशिया के संबंधों को कमजोर करेंगी। इस बीच, अमेरिका के विदेश विभाग ने भी एक बयान जारी किया है, ‘हम चीन से आह्वान करते हैं कि वैश्विक महामारी से लड़ने में वह अंतरराष्ट्रीय प्रयासों को मदद देने पर फोकस करे और अन्य देशों की संवेदनशीलता का इस्तेमाल एससीएस पर अपने अवैध दावे के लिए न करे।’ इन हरकतों से दुनिया में चीन की छवि ही खराब नहीं हो रही है, बल्कि यह सवाल भी उठ रहे हैं कि जब एससीएस के अन्य दावेदार देश कोविड-19 से जूझ रहे हैं, ऐसे में चीन इस क्षेत्र में अपनी हठधर्मिता पर क्यों अड़ा है?

कोविड-19 से निपटने के तरीके को लेकर चीन की कम्युनिस्ट पार्टी (सीसीपी) की विश्वसनीयता को लगी ठेस के बाद यह विस्तारवादी सैन्य नीति उसे सहारा देने के एक तरीके रूप में देखी जा रही है। वहीं सीसीपी में कई लोग इसे अमेरिका के कोरोना से जूझने में फंसे रहने की वजह से एक अवसर के तौर पर देखते हैं। हाल के दिनों में अमेरिका और वियतनाम के संबंधों में बढ़ोतरी हुई है। वियतनाम दक्षिण चीन सागर में अमेरिका की मुक्त नौपरिवहन नीति का हिमायती है। चीन हमेशा ही इसके खिलाफ रहा है और अमेरिका ने भी इसके लिए अपनी ताकत दिखाने से परहेज नहीं किया है। देश में कोविड-19 के फैलने से पहले अमेरिका ने दक्षिण चीन सागर के इस जलमार्ग में अपने गाइडेड मिसाइल की तैनाती वाले विनाशक यूएसएस मैककम्पबेल को तैनात किया था, उसके ठीक बाद चीन ने भी इस क्षेत्र में पनडुब्बी रोधी अभ्यास किया था।

वियतनाम अभी आसियान का अध्यक्ष है और वह लंबे समय से आचार संहिता बनाने पर जारी वार्ता की भी अध्यक्षता कर रहा है। वियतनाम हमेशा से इस पक्ष में रहा है कि इस क्षेत्र के गैर-दावेदार और बाहरी देश चीन को विवादित सागर में अपनी हठधर्मिता छोड़ने के लिए कहने में सक्रिय भूमिका निभाएं। सभी दावेदार देशों में वियतनाम अकेला ऐसा देश है, जिसने चीन की गतिविधियों के खिलाफ हमेशा कड़ा रुख अपनाया है। फिलीपींस चीनी गतिविधियों पर कई बार रुख बदलता रहा है और इंडोनेशिया ने नातुना सागर में चीन की चुनौती को बहुत देर से पहचाना। कोविड-19 पर वियतनाम आसियान के कुछ पहले देशों में था, जिसने फरवरी के शुरू में ही चीन से आने वाली उड़ानों पर रोक लगा दी थी। चीन एससीएस विवाद में वियतनाम की रणनीति पर करीब से नजर रखता है।

कोविड-19 के शुरुआती दौर में सूचनाओं को दबाने की वजह से चीन की वैश्विक छवि को नुकसान हुआ है। अगर वह अपनी वैश्विक विश्वसनीयता को बहाल करना चाहता तो एससीएस में तनाव पैदा करना उसकी प्राथमिकता नहीं होती। इतनी बड़ी महामारी के समय चीन का उदार होना, उसके दुनिया में आरोहण के हित में होता। लेकिन ऐसी उम्मीदों को चीन ने पहले भी झुठला चुका है और चीन की कम्युनिस्ट पार्टी आने विस्तारवादी क्षेत्रीय एजेंडे को शायद ही छोड़े।

इस्लामी शिक्षा का सही स्वरुप

पिछले कुछ दिनों से समाचार माध्यमों में दो तरह की खबरों की बहुलता है। एक के केंद्र में कोविड-19 महामारी है और दूसरे के केंद्र में तब्लीगी जमात। इंदौर एवं मुरादाबाद में डॉक्टरों के साथ मारपीट की जो घटनाएं हुईं उनसे एक समुदाय के मन में दूसरे समुदाय को लेकर सवाल उठे हैं और दूसरे समुदाय को यह शिकायत है कि कुछ मुट्ठी भर लोगों की गलती के कारण पूरे समुदाय को कैसे दोषी ठहराया जा सकता है? बहुसंख्यक समुदाय के मन में यह सवाल भी उठ रहा कि अल्पसंख्यकों के एक छोटे से वर्ग की गलतियों पर उनके समझदार लोग विरोध क्यों नहीं करते और जब सऊदी अरब जैसे इस्लामी देश मस्जिदें बंद कर सकते हैं तो भारत में कुछ जगहों पर जुमे की नमाज मस्जिद में पढ़ने की जिद क्यों पाली जाती है?

आखिर संपूर्ण देशवासियों के हित में जारी निर्देश कुछ लोगों को नागवार क्यों गुजरते हैं? इन सवालों से मुंह नहीं चुराया जा सकता। जिस इस्लाम के नाम पर मुट्ठी भर लोग ऊलजलूल हरकतें कर पूरे समुदाय पर अंगुली उठाने का मौका दे रहे उस इस्लाम की सबसे पवित्र किताब कुरान शरीफ एवं उसकी व्याख्या हदीस में वही निर्देश दिए गए हैं, जो इन दिनों केंद्र और राज्य सरकारें दे रही हैं। कुरान में साफ लिखा है कि जिस मुल्क में रहते हो उसके हुक्मरानों की बात मानो। फिर भी कुछ लोग हुक्मउदूली को अपनी शान समझते हैं। इसका कारण समझने की जरूरत है।

किसी भी मजहब में दी गई बुनियादी शिक्षा को यदि उसके वास्तविक रूप में देखा और माना जाए तो शायद किसी विवाद की गुंजाइश नहीं रहेगी। कुरान और हदीस की मान्यताओं को दुनिया तक ठीक-ठीक पहुंचाने के लिए भारत में दारुल उलूम देवबंद एवं अहले सुन्नात वल जमात (बरेलवी समुदाय) जैसे आंदोलनों की शुरुआत हुई। यह वह समय था, जब 1857 की क्रांति को अंग्रेजों द्वारा कुचले जाने के बाद राजे-रजवाड़ों के हौसले पस्त हो गए थे। देश में उस दौरान न तो हिंदुओं को संगठित एवं शिक्षित करने वाला कोई संगठन दिखाई दे रहा था, न ही मुस्लिमों को।

1857 के पहले राजे-रजवाड़ों और नवाबों-बादशाहों की छोटी-छोटी रियासतों ने अपने समुदायों को संगठित और शिक्षित करने की कोई जरूरत ही महसूस नहीं की, लेकिन क्रांति के बाद हाजी आबिद हुसैन एवं मौलाना कासिम ने 30 मई, 1866 को दारुल उलूम देवबंद की आधारशिला रखी। यूं तो दारुल उलूम की स्थापना इस्लामी शिक्षा एवं संस्कृति को सहेजने-संवारने के लिए हुई थी, लेकिन इसने स्वतंत्रता आंदोलन में भी अहम भूमिका निभाई। दारुल उलूम देवबंद के संरक्षक एवं अध्यापक मौलाना महमूद अल-हसन, जिन्हें शेखुल हिंद की उपाधि दी गई, के प्रमुख शिष्य मौलाना उबैदुल्ला सिंधी ने 1914 में अफगानिस्तान जाकर अंग्रेजों के विरुद्ध अभियान चलाया और वहां भारत की पहली स्वतंत्र सरकार स्थापित की। इस सरकार का राष्ट्रपति राजा महेंद्र प्रताप को बनाया गया।

साफ है कि भारत में मोहम्मद अली जिन्ना के उद्भव से पहले यहां के हिंदुओं और मुसलमानों को साथ लेकर चलने का प्रयास देवबंदी और बरेलवी जैसी संस्थाएं करती आ रही थीं। दारुल उलूम देवबंद, अहले सुन्नत वल जमात और जामिया मिलिया इस्लामिया, अलीगढ़ मुस्लिम यूनिवर्सिटी, हमदर्द यूनिवर्सिटी जैसे संस्थानों से बड़ी संख्या में इस्लामी विद्वान निकले और देश-विदेश में इस्लामी शिक्षा का काम शुरू किया।

चूंकि कुरान सऊदी अरब में उतरी इसलिए इसकी भाषा अरबी है। उसकी जुबान और लिपि में बदलाव इसलिए नहीं किया गया, क्योंकि अनुवाद करने पर कुछ न कुछ परिवर्तन आ ही जाता है। इसीलिए जब कुरान शरीफ को पढ़ा जाता है तो उसे अरबी में पढ़ा जाता है। कुरान और हदीस समझनी है तो अरबी या उर्दू आना जरूरी है। इन संस्थानों में उर्दू और अरबी की शिक्षा से ही पाठ्यक्रम की शुरुआत होती है। प्राइमरी की शिक्षा पूरी करने में पांच साल लगते हैं। इसके बाद अगले आठ साल आलिम बनने में लगते हैं। जो कुरान शरीफ को उसकी व्याख्या के साथ समझा सकता हो, उसे आलिम कहते हैं।

जो कुरान का बिल्कुल सटीक पाठ कर सके उसे ‘कारी’ का ओहदा मिलता है। यदि इस्लामी शिक्षा का यही स्वरूप ऊपर से नीचे तक इसी रूप में पहुंच पाता तो कोई दिक्कत नहीं होती, क्योंकि तब कुरान और हदीस में दिए गए संदेश हर मुस्लिम तक उनके सही स्वरूप में पहुंचते और लोग उनका उसी के अनुसार पालन करते।

मिस्र, मलेशिया, टर्की आदि में तो इस्लामी शिक्षा के प्रमुख संस्थान अपनी शाखाओं और उपशाखाओं को खुद से जोड़े रखते हैं, लेकिन भारत में स्थापित प्रमुख संस्थान अपनी शाखाओं-उपशाखाओं को खुद से जोड़े रखने का कोई तंत्र विकसित नहीं कर सके हैं। बरेलवी, देवबंदी या ऐसे अन्य संस्थानों से निकले या नहीं भी निकले कुछ लोग शहरों, गांवों और गली-कूचों में मदरसे तो स्थापित करते गए, लेकिन उनमें दी जा रही शिक्षा को स्तरीय बनाए रखने का कोई प्रबंध नहीं कर सके। मदरसों में शिक्षा देने वाले खुद पूरी तरह शिक्षित हैं या नहीं, इसे जांचने का कोई माध्यम नहीं है। देश का आम मुसलमान अपनी मजहबी किताबों को पढ़ना, समझना और उन पर अमल करना अपना कर्तव्य समझता है, लेकिन इसके लिए उसे मदरसों के शिक्षित-अर्धशिक्षित मौलानाओं-मौलवियों पर ही निर्भर रहना पड़ता है।

शुक्रवार को नमाज से पहले मस्जिद में खुतबा यानी व्याख्यान देने वाले का फर्ज है कि वह दुनिया, देश, शहर, कौम एवं हालात को देखते हुए कुरान की रोशनी में लोगों का मार्गदर्शन करे, लेकिन यह काम तो कोई आलिम ही कर सकता है। गली-मुहल्लों की मस्जिदों या मदरसों में इस्लाम का सही जानकार हो ही, यह जरूरी नहीं। यह स्थिति नीम हकीम खतरा-ए-जान वाले हालात पैदा कर रही है। जरूरत इसी से बचने की है।

बदलते परिदृश्य में चीन

दुनिया में कोरोना महामारी फैलाने के लिए अमेरिकी राष्ट्रपति डोनाल्ड ट्रंप ने चीन को जिम्मेदार ठहराया है। ट्रंप ने खुल कर कहा भी है कि अगर यह सिद्ध हो गया है तो चीन का इसका खमियाजा भुगतना पड़ेगा। और सिर्फ अमेरिका ही नहीं, दुनिया के ज्यादातर देश कोरोना विषाणु फैलने के लिए चीन को ही दोषी मान रहे हैं, भले अमेरिका की तरह खुल कर कह नहीं रहे हों। चीन ने अपने स्वार्थ की पूर्ति के लिए पूरी दुनिया को दहशत में डाल दिया है। अंतरराष्ट्रीय राजनीति में बहस छिड़ी हुई है कि क्या कोरोना का मामला ठंडा पड़ने के बाद वैश्विक राजनीति का जो नया रूप उभर कर आएगा, उसमे चीन दुनिया का मठाधीश बन पाएगा या नहीं? इस प्रश्न का सटीक उत्तर खोजने के लिए वर्तमान भू-राजनीतिक और विश्व व्यवस्था की चर्चा जरूरी है। कोरोना के आने के पहले से चीन और अमेरिका के बीच लंबे समय से व्यापार युद्ध चल रहा था। कोरोना ने इसमें आग में घी का काम कर दिया। शुरुआती दौर में अमेरिका ने चीन को यह कह कर घेरने की कोशिश कि यह वुहान विषाणु है। अमेरिकी टिप्पणी से आहत होकर चीन ने अमेरिका पर आरोप लगाया कि इसकी शुरुआत तो अमेरिकी सैनिकों द्वारा की गई थी, जब वे वुहान में सैन्य अभ्यास में शिरकत करने पहुंचे थे। लेकिन तेजी से बदलते घटनाक्रमों के बीच पूरी दुनिया चीन को दोषी मानती रही। फिर पासा पलटा। निश्चिंत अमेरिका और यूरोप जब इस बीमारी के चंगुल में फंसे तो उनकी सांसे थम गर्इं। कई यूरोपीय देश मसलन स्पेन, इटली, फ्रांस और इंग्लैंड कोरोना के जाल में बुरी तरह जकड़ते चले गए और चीन तो इसमें काफी पूछ छूट गया। खुद अमेरिका में हालात सबसे गंभीर हो गए। दूसरी ओर, निरंकुशता के दम पर चीन ने वुहान को कोरोना मुक्त घोषित करने की चाल चली। उसने अपने दुनिया के देशों के लिए मसीहा के रूप में एक ऐसे राष्ट्र की भूमिका में खड़ा कर दिय, जिससे दुनिया को लगने लगा कि इस हालत से बचाने कि क्षमता अगर किसी देश के पास है, तो वह चीन है। इसी के तहत चीन ने इटली, स्पेन और कई यूरोपीय देशों को सुरक्षा किट भेजने की कूटनीति अपनाई। चीन के द्वारा इस बात की पुष्टि की जाने लगी कि उसका आर्थिक और राजनीतिक तंत्र ज्यादा कारगर और सटीक है। पूरे विश्व में उदारवाद का पुरोधा अमेरिका और पश्चिमी दुनिया की राजनीतिक व्यवस्था हाशिए पर पहुंच गई है। दुनिया में इस बात की खूब चर्चा भी हो रही है। अब दुनिया तेजी से बदलने के लिए अभिशप्त है। इसका तीसरा दौर भी जल्दी ही शुरू हो गया। इसमें विश्व स्वास्थ्य संगठन (डब्ल्यूएचओ) पर अमेरिका का गाज गिरी। अमेरिका ने इस संगठन पर चीन को बचाने के आरोप लगाते हुए उसे पैसा देना बंद कर दिया है। केवल अमेरिका ही नहीं, दुनिया के अन्य देशों ने भी डब्ल्यूएचओ पर अंगुली उठानी शुरू कर दी। वहीं चीन जो इस बात का दावा कर रहा था कि उसके यहां से कोरोना खत्म हो चुका है, उसने फिर से चीन में दस्तक दे दी है। चीन ने पिछले पांच दशकों में प्रकृति का जितना दोहन किया है, उतना शायद ही किसी देश ने किया हो। हिमालय से बहने वाली नदियों के पर बड़े-बड़े बांध बना कर उनकी स्वाभाविक धारा को बदलने की साजिश रची गई, जिसका खमियाजा दक्षिण एशिया और दक्षिण पूर्व एशिया के देशों को झेलना पड़ रहा है। तिब्बत के मुहाने पर चीन ने आणविक कूड़ेदान की इजाजत दे दी, जहां से दर्जनों नदियों के शीतल जल का प्रवाह पच्चीस से तीस देशों के बीच होता है। जंगल काटे गए। प्राकृतिक संतुलन ने वन्यजीव को भारी नुकसान पहुंचाया। अगर कोरोना विषाणु के कारणों को जानने की कोशिश करें, तो यही बातें विशेषज्ञों के द्वारा कही जा रही हैं। यह बात कई बार कही जा चुकी है कि इक्कीसवीं शताब्दी एशिया के देशों के लिए है। यह सच है कि इस बीमारी ने परिवर्तन की गति को बढ़ा दिया है। अमेरिका का पतन इस बीमारी के दौरान तीखे ढंग से महसूस किया गया। दूसरे विश्वयुद्ध के बाद यह पहली घटना है जिसमें दुनिया के किसी देश ने अपने को बचाने के लिए अमेरिका से गुहार नहीं लगाई। खुद अमेरिका ने भी नेतृत्व देने की पेशकश नहीं की। कोरिया युद्ध से लेकर अफगानिस्तान संकट तक में अमेरिका संकट मोचक की तरह उपस्थित होकर अपना कूटनीतिक धर्म निभाने की जरूरत महसूस कराता था। लेकिन इस महामारी में वही सबसे ज्यादा संकट में है, इसलिए कैसे वह दूसरों के समक्ष मदद की पेशकश करता। संभवत: ‘अमेरिका पहले’ की नीति के तहत ही यह सब कुछ हो रहा है। दूसरा, जी-7 और जी-20 जैसे निगरानी करने वाले दुनिया के अमीर देशों के संगठन भी चुप्पी साधे रहे। इनके बीच बैठक भी हुई, तो उसमें कोई एकात्मक भाव दिखाई नहीं दिया। प्रश्न यह है कि क्या चीन ताजपोशी के लिए तैयार है या दुनिया के देश चीन को अपना प्रधान मानाने के लिए उत्सुक है? हालात बता रहे हैं कि चीन के लिए अमेरिका की तरह और अमेरिकी तर्ज पर दुनिया का प्रधान बनना मुश्किल ही नहीं नामुमकिन है। कोरोना संकट ने इस दूरी को और बढ़ा दिया है। पहला, चीन की अंतरराष्ट्रीय विश्वसनीयता खतरे में पड़ गई है। कई यूरोपीय देशों में जो सुरक्षा किट भेजे गए हैं, वे जांच में खतरे नहीं उतरे। भारत में जो किट चीन से आए, वे भी भरोसेमंद साबित नहीं हुए। चीन ने पूरी दुनिया को जिस तरह से खतरे में डाल दिया है, वह चीन की राजनीतिक व्यवस्था पर बेहद गंभीर प्रश्न खड़ा करता है। मठाधीशी के लिए चीन पूरी दुनिया को हाशिए पर धकेल सकता है। अगर उसके हाथ में चाबुक चला गया तो कब विश्व प्राकृतिक विध्वंस के खंडहर में जा गिरेगा, इसकी कल्पना भी नहीं की जा सकती। चीन का आर्थिक ढांचा इस वक्त खस्ताहाल हो चुका है। ऐसे में भी अगर वह इस बात का दावा कर रहा है कि उसकी व्यवस्था दुरुस्त हो गई है, तो यह केवल दुनिया को भ्रम में डालने से ज्यादा और कुछ नहीं है। चीन की आर्थिक व्यवस्था की रीढ़ निर्यात है। अमेरिका, फ्रांस और यूरोप के कुछ देशों को चीन कुल निर्यात का चालीस फीसद हिस्सा निर्यात करता है। लेकिन अब इन देशों ने चीन के लिए अपने दरवाजे बंद कर दिए है। तकरीबन यही स्थिति दुनिया के दूसरे देशों की भी है। इस परिस्थित में चीन की आर्थिक शक्ति कैसे बढ़ेगी। चीन के आर्थिक गलियारे का भी काम पूरी तरह से रुका हुआ है। अरबों डॉलर का कर्ज खटाई में जाता दिखाई दे रहा है। मलेशिया सहित कई देशों ने चीन की इस परियोजना पर सवाल खड़े किए हैं। दुनिया को जीतने के लिए चीन ने एक वैकल्पिक विश्व ढांचा बनाने में अपनी पूरी ताकत झोंक दी थी। अंतरराष्ट्रीय मुद्रा कोष की जगह उसने अपने एक बैंक की स्थापना की, जो उससे ज्यादा रकम दुनिया के दूसरे देशों को दे सकता है। इसके अलावा उसने उन अंतरराष्ट्रीय संगठनों को भी तिलांजलि दे दी, जो उसकी बात से इत्तफाक नहीं रखते। फिर भी चीन का दुनिया का सबसे ताकतवर देश बनाने का सपना अधूरा ही रहेगा। यह भी साफ है कि अमेरिका भी मठाधीश नहीं होगा। तब कैसी होगी दुनिया की व्यवस्था? क्या रूस, भारत, फ्रांस, जापान और ब्राजील जैसे देशों की अहमियत बढ़ जाएगी?

अर्थव्यवस्था में जान फूंकने के लिए

जनवरी में हमारी अर्थव्यवस्था की जो खस्ता हालत थी, वह लॉकडाउन के इस एक महीने में और ज्यादा खराब हो गई है। अब सवाल जीने या मरने का है। इसे यूं समझें कि अर्थव्यवस्था फिलहाल वेंटिलेटर पर है, जिसे जीवित रखने के लिए वेंटिलेटर मशीन को पर्याप्त बिजली की दरकार है। अर्थव्यवस्था के लिहाज से बिजली से आशय मांग और उत्पादन से है, यानी हमारी अर्थव्यवस्था तभी गतिशील रहेगी, जब देश में मांग की स्थिति बनी रहेगी और उत्पादन होता रहेगा। मगर क्या इस एक महीने की बंदी में ऐसा हो सका?

लॉकडाउन एक अच्छी नीयत से उठाया गया कदम है। यकीनन हमें इसकी जरूरत थी, ताकि कोरोना वायरस के बढ़ते संक्रमण को थामा जा सके। चूंकि हमारे देश का चिकित्सा तंत्र कमजोर है, इसलिए जब तक वह इस वायरस से लड़ने के काबिल नहीं हो जाता, हमें वक्त की जरूरत थी। इसमें हम कुछ हद तक कामयाब भी रहे। ‘सोशल ब्रेकडाउन’ (जान-माल की भारी तबाही) को रोकने में लॉकडाउन कारगर साबित हुआ। मगर इसे और बेहतर बनाया जा सकता था। दरअसल, हमारे देश में 94 फीसदी कामगार असंगठित क्षेत्र से जुडे़ हैं, जो रोज कमाते और खाते हैं। उनके पास इतनी बचत नहीं होती कि वे दो-तीन महीनों का राशन इकट्ठा कर सकें। जाहिर है, जो जहां है, उसकी बुनियादी जरूरतें वहीं पूरी की जानी चाहिए थी। जरूरतें पूरी न होने पर लॉकडाउन का उल्लंघन लाजिमी था। ऐसा हमने पिछले दिनों देखा भी कि किस तरह महानगरों से कामगारों का हुजूम गांवों की ओर निकल पड़ा।

ऐसा नहीं है कि हम असंगठित क्षेत्र के कामगारों की जरूरतें पूरी नहीं कर सकते। हमारे पास अनाज के पर्याप्त भंडार हैं और बुनियादी तौर पर अनिवार्य वस्तुओं का उत्पादन भी हो रहा है। इसलिए अगर प्रशासन चाहे, तो आवश्यक वस्तुओं की आपूर्ति जरूरतमंदों तक हो सकती है। इसके लिए एक व्यापक जन-वितरण प्रणाली की जरूरत है। इसमें अगर किसानों के हित भी जोड़ लिए जाएं, तो स्थिति कहीं बेहतर हो जाएगी। जैसे, लॉकडाउन के कारण खेतों से फसल मंडियों तक नहीं पहुंच रही है, क्योंकि माल ढुलाई बंद है। नतीजतन, किसान सब्जी-फल जैसे उत्पाद खेतों में ही नष्ट करने को मजबूर है। प्रशासन इन फसलों को खेतों से खरीदकर नजदीकी शहरों में जन-वितरण का काम कर सकता है। इससे गांवों में पैसा आएगा और मांग व उत्पादन, दोनों में गति आ सकेगी।

लॉकडाउन तभी सफल होगा, जब इसको सही ढंग से लागू किया जाएगा। अभी देश में सभी तरह के उत्पादन रुके हुए हैं। कृषि, बिजली, गैस आदि के क्षेत्र में थोड़ा-बहुत उत्पादन जरूर हो रहा है, मगर यह इतना नहीं कि देश की आर्थिक जरूरतें पूरी हो सकें। देखा जाए, तो अभी हमारी महज 25 फीसदी अर्थव्यवस्था काम कर रही है। विश्लेषक लॉकडाउन को कम से कम 10 हफ्ते तक बनाए रखने के पक्ष में हैं। ऐसे में, अगर कोरोना-काल के बाद हमने तेज गति से कदम बढ़ाए भी, तो इस वित्तीय वर्ष के अंत में हम वहीं रहेंगे, जहां जनवरी में थे। अनुमानों की मानें, तो पिछले साल हमारा उत्पादन 200 लाख करोड़ रुपये का था, जो इस साल घटकर 120 लाख करोड़ रुपये का हो सकता है। इसका असर यह होगा कि हमारा टैक्स कलेक्शन तेजी से गिरेगा, क्योंकि फिलहाल अनिवार्य वस्तुओं का उत्पादन ही होगा और कर-राजस्व गैर-अनिवार्य वस्तुओं से जुटाए जाते हैं। जाहिर है, जीएसटी-संग्रह भी 80-90 फीसदी तक गिर जाएगा। कॉरपोरेट टैक्स-संग्रह भी करीब-करीब शून्य रहेगा। इसका असर आयकर पर पडे़गा और उसमें भी तेज गिरावट आएगी, यानी इस साल बजट के तहत जरूरी काम करना भी सरकारों के लिए मुश्किल होगा। यह स्थिति केंद्र के सामने भी आएगी और राज्योंके सामने भी।

इससे लड़ने के लिए सरकारों को गैर-पारंपरिक रास्ता अपनाना होगा। उन्हें अनिवार्य सेवाओं की बहाली पर पूरा ध्यान देना होगा। यह काम तभी होगा, जब वे अपने खर्च घटाएंगी। उनको अपने नियमित खर्च में जबर्दस्त कटौती करनी होगी। निवेश एक साल के लिए रोकना होगा। हालांकि इसका असर यह होगा कि नए रोजगार के अवसर पैदा नहीं होंगे। मगर यह एक ऐसा वक्त है, जिसकी कभी कल्पना भी नहीं की गई होगी। आपात स्थिति युद्ध काल को माना जाता है, पर उसमें भी मांग बढ़ जाती है, लेकिन अभी न तो मांग है, न उत्पादन, आपूर्ति तो जैसे खत्म ही हो गई है। इसलिए सरकारों के पास जो थोड़ा-बहुत संसाधन बचे हैं, उनको वे जनता तक जरूरी खुराक पहुंचाने के काम में लगाएं। इसे ‘सरवाइवल पैकेज’ कहा जा सकता है, यानी जिंदा रहने के लिए जरूरी सामान का इंतजाम। ऐसे कदम सामाजिक विद्रोह की आशंका को निर्मूल साबित करते हैं।

इस पैकेज में कारोबारी हितों का भी ध्यान रखना होगा। असल में, लॉकडाउन का व्यापार पर खूब नकारात्मक असर पड़ रहा है। खासतौर से छोटी पूंजी वाले कारोबारी अपना लाभ कारोबार में ही लगाते रहते हैं। उनके पास जो थोड़ी-बहुत बचत होगी, वह अब खत्म हो चुकी होगी। बड़ी कंपनियों के पास बेशक संचित निधि होती है, लेकिन अगर वे इसका इस्तेमाल करती हैं, तो उन्हें भी नुकसान होगा। खासकर वित्तीय संस्थानों की सेहत सबसे ज्यादा खराब होने की आशंका है। अगर कोई भी वित्तीय संस्था डूबी, तो आपस में जुडे़ रहने के कारण वह अन्य कंपनियों को भी नुकसान पहुंचाएगी। लेहमन ब्रदर्स का उदाहरण हमारे सामने है। रियल एस्टेट की हालत भी फिलहाल सुधरती नहीं दिख रही। इससे निवेश पर काफी ज्यादा असर पडे़गा। मुश्किल यह है कि ये ऐसे क्षेत्र हैं, जहां लॉकडाउन में छूट देने के बाद भी तुरंत मांग नहीं बढ़ने वाली। इसलिए उद्योगों को फिर से गतिशील बनाना सरकारों के लिए काफी चुनौतीपूर्ण काम होगा।

साफ है, अनिवार्य वस्तुओं को छोड़कर बाकी उत्पादों की मांग शायद ही बढे़। लोगों की मानसिकता बदल चुकी है। वे अब बचत पर ज्यादा ध्यान देने लगे हैं। चूंकि कुल निवेश का ज्यादातर हिस्सा (लगभग 95 फीसदी) घरेलू निवेश है और सरकार के पास संसाधन कम होंगे, इसलिए वास्तविकता को समझते हुए वह अपने संसाधनों का इस्तेमाल करे। सरकार को इस तरह खर्च करना होगा कि उत्पादन बढ़े और मांग की स्थिति भी पैदा हो। क्या ऐसा हो सकेगा?

गांवों की उम्मीद

देश की सामाजिक, राजनीतिक और प्रशासनिक जटिलताओं के बीच ग्राम पंचायतें अपनी एक अलग भूमिका निभाती रही हैं। हर ग्राम पंचायत की अपनी एक राजनीति होती है, और अपनी ही समस्याएं। सैद्धांतिक रूप से हम भले इन ग्राम पंचायतों को देश के लोकतंत्र की आधारभूत इकाई मानते हों और उनसे बड़ी उम्मीदें भी बांधते हों, लेकिन राष्ट्रीय स्तर पर हमें उनकी याद साल में एक बार 24 अप्रैल को ही आती है, जब पंचायती राज दिवस आता है। आम तौर पर यह दिवस शुभकामना संदेशों, कुछ सरकारी योजनाओं की घोषणा और पंचायतों की भूमिका के यशोगान जैसी औपचारिकताओं के साथ ही बीत जाता है। लेकिन इस साल पंचायती राज दिवस ऐसे मौके पर पड़ा, जब देश एक अभूतपूर्व संकट से गुजर रहा है। ऐसे में, इस दिवस ने प्रधानमंत्री नरेंद्र मोदी को यह मौका दे दिया कि वे न सिर्फ इस मुद्दे पर ग्राम पंचायतों से सीधा संवाद बनाएं, बल्कि कोरोना वायरस के खिलाफ चल रही लड़ाई के लिए उन्हें तैयार भी करें। प्रधानमंत्री ने इस मौके पर देश की ढाई लाख ग्राम पंचायतों के सरपंचों से वीडियो कॉन्फ्रेंसिंग के जरिए जो बात की, उस सिलसिले को आगे बढ़ाते हुए इस लड़ाई को गांव के स्तर पर शुरू किया जा सकता है।

कोरोना वायरस के संक्रमण के शुरुआती डेढ़-दो महीनों में इसका ज्यादातर विस्तार महानगरों और छोटे-बडे़ शहरों में हुआ है। लेकिन तमाम पाबंदियों और लॉकडाउन के बावजूद जिस तेजी से यह फैल रहा है, उसमें यह खतरा हमेशा बना हुआ है कि यह वायरस संक्रमण किसी भी समय ग्रामीण क्षेत्रों में भी पहुंच सकता है। यही एक ऐसी आशंका है, जो केंद्र व राज्य सरकारों और पूरे चिकित्सा जगत को परेशान कर रही है। संक्रमण के ग्रामीण क्षेत्रों में पहुंचने का अर्थ होगा, देश की 70 फीसदी आबादी पर खतरे का मंडराना। गांवों में अभी भी मूलभूत चिकित्सा सुविधाएं बहुत नहीं हैं। कम से कम इतनी तो कहीं नहीं है कि वहां कोविड-19 के मरीज की पूरी देखभाल हो सके। शहरी अस्पताल वहां से बहुत दूर हैं और वे पहले ही काफी दबाव में हैं। ऐसे हालात में ग्राम पंचायतें अहम भूमिका निभा सकती हैं। खासकर कोरोना संक्रमण को रोकने के लिए। प्रधानमंत्री के संबोधन ने उन्हें यह भूमिका सौंपने की शुरुआत कर दी है। प्रधानमंत्री अच्छी तरह जानते हैं कि गांव वालों को ‘सोशल डिस्टेंसिंग’ जैसी शब्दावली में नहीं समझाया जा सकता, इसलिए उन्होंने ‘दो गज की दूरी’ जैसी शब्दावली का इस्तेमाल किया। इसमें राज्य सरकारों और प्रशासन के लिए यह संदेश छिपा है कि गांवों से संवाद बनाने के लिए उन्हें उन्हीं की भाषा को अपनाना होगा।

इस अवसर पर प्रधानमंत्री ने एक और महत्वपूर्ण बात यह कही है कि कोरोना संकट ने एक सबसे बड़ा सबक यह दिया है कि अब हमें आत्मनिर्भर बनना होगा, बिना आत्मनिर्भर बने इस तरह के संकटों का मुकाबला नहीं हो सकता। राष्ट्रीय स्तर पर हमने पिछले चंद रोज में ही यह देख लिया है कि चिकित्सा सामग्री के मामले में विदेशी बाजारों पर निर्भरता कितनी तरह की समस्याएं खड़ी कर सकती है। प्रधानमंत्री ने यह बात ग्राम पंचायतों से कही है, इसलिए इसका यह अर्थ भी लगाया जाएगा कि उनका संकेत गांवों को आत्मनिर्भर बनाने की ओर भी है, खासकर चिकित्सा सुविधा के मामले में। अगर सचमुच ऐसा हो सका, तो यह एक बहुत बड़े बदलाव की शुरुआत होगी।
