EC does a great job holding polls. Let Parliament decide who should make appointments in EC

The legal challenge to the appointment of election commissioners saw the Supreme Court bench make strong observations on the current selection process. The bench suggested that the Chief Justice of India’s presence in the appointment committee would be appropriate and that Chief Election Commissioners were getting very brief tenures despite the six-year term provided for them. The Centre countered, questioning the wisdom of judicial intervention and citing the separation of powers doctrine. Demands for bipartisan appointments to the Election Commission have been around for decades, but governments have seldom agreed. In that context, the present constitutional challenge is an interesting development.

EC as an institution plays a stellar role in safeguarding democracy. In election after election, EC has unfailingly ensured that the writ of the voter carries the day, and continuity or transition of governments happen without any questions posed over the election process. This is a phenomenal achievement, which even the ongoing hearings must applaud. Nevertheless, the shift towards abipartisan, consultative appointment process would be desirable because that has been the larger trend of India’s legislative and democratic evolution in the past two decades.

The CVC Act 2003 empowers a committee comprising the PM, CJI and the leader of opposition to recommend central vigilance commissioners. These three also make recommendations for appointment to the Lokpal body and CBI director under the Lokpal Act 2013. The quashed NJAC Act 2014 had tasked the trio to select two eminent persons to be part of the six-member judges appointment commission. As can be seen, governments under three different PMs converged on a bipartisan model for key appointments.

This does make a case for following a similar process for EC too. But SC’s quibble that CECs aren’t getting the fixed six-year tenure is puzzling. What is important is a CEC’s independence, and the difficult removal process requiring impeachment ensures the post has security of tenure. Perhaps, the two other election commissioners must also be similarly protected, since conventionally the seniormost becomes CEC later. The pricklier question is whether SC should intervene in appointments to a coordinate institution since no abuse of power has happened, unlike say malafide executive interference in pre-collegium era judicial appointments. Ideally, political parties should arrive at a consensus and work out the EC appointment process in Parliament. SC has a point. But Parliament should decide.

How to Make It Easier For EC Transparency

Wishing the robustness of state institutions need not stem only from concern. Suggestions to buttress such institutions is, thus, welcome. As the Supreme Court highlighted on Tuesday, the Election Commission’s functioning must be independent and appointment of election commissioners more transparent. It is the manner of appointment — not the duration of tenure as mentioned by the court — that holds the key to greater transparency. Appointments that have wider non-executive endorsement, for instance, could serve this pivotal institution well, even better. A judicious blend of executive, legislative and judicial approval — rather than the current format of presidential (read: executive) endorsement — would go a distance to remove any impression of lack of transparency or bias the court has mentioned being the case over decades under different dispensations.

Where the Supreme Court observation has conflated matters may be in its stern remarks regarding ‘truncated tenures’ being the source of alleged manipulation. That it finds the ‘situation on the ground [to be] alarming’ sounds rather extravagant, considering the court is hearing petitions recommending reforms in the process of appointment of EC members, CEC included, not US-style charges of ‘electoral appropriation’. Also, the supposed ‘shortness’ of tenure of EC members bears little weight on institutional independence. Appointments start for EC, some of whom graduate as CEC, not a brief period of time by any measure.

As for the court’s wish to have a CEC ‘like T N Seshan’, that would be a personality-based wish, not an input for institutional bulwark. One suggestion that could be worth pursuing, though, is expanding the pool for EC members to members beyond the civil service.

Space, not time

Equal tenure security for CEC and Election Commissioners will boost their independence

The ongoing hearing before a Constitution Bench of the Supreme Court of India on the need to have a neutral mechanism for appointment of Election Commissioners raises important questions on the election body’s functional independence. The Election Commission of India (ECI) has generally enjoyed a high reputation for holding free and fair polls since the dawn of the Republic, although not immune to charges of favouring the ruling party. However, given the Court’s vocal concern about the ECI’s independence, the relevant question now is whether the Commissioners should be appointed on the recommendation of an independent body. Article 324(2) envisages a parliamentary law for the purpose, but no law has been enacted so far. The Government is pushing back strongly against the Court’s apparent inclination to devise an independent mechanism, possibly a selection committee that includes the Chief Justice of India. The perceived legislative vacuum could provide an occasion for the Court to frame a process on its own — something the Government, quite rightly, wants to avoid. There is no doubt an independent body doing the selection will enhance the ECI’s independence, but the Court will have to decide if it wants to spell out its composition or leave it to Parliament.

Justice K.M. Joseph, heading the Bench, has noted that Chief Election Commissioners (CEC) in the past had fairly long tenures, unlike in recent times. However, it should be remembered that since 1993, the ECI has become a multi-member body, comprising a CEC (chairman) and two Election Commissioners (EC). The current convention is to appoint ECs, and elevate them as CEC on the basis of seniority. In effect, it is the appointment process for ECs that requires scrutiny as it is here that there is scope for personal whimsy to play a role. The CEC has a six-year tenure, but should demit office on attaining 65. The Court has questioned the practice of appointing CECs close to that age so that they have only a brief tenure. However, it may be argued that even Chief Justices have brief tenures, but that does not undermine their independence. The Government has contended that a member’s whole tenure in the ECI should be considered, and not merely the duration as CEC. The real difference is security of tenure that could come from operational freedom and space. While Supreme Court judges have security of tenure — they can be removed only by impeachment by Parliament — only the CEC enjoys the same status. The ECs can be removed on the CEC’s recommendation. There is a good case for extending the same tenure security to the ECs too, regardless of what kind of appointment process is in place.

India is losing its cherished right to know

The possibility that the very institution mandated to guard India’s transparency regime could also be responsible for its own downfall is cause for concern

The most vital mandate of the Central Information Commission, the apex body under India’s transparency regime, is to decide whether certain information sought by a citizen ought to be disclosed or not. Its primary duty is to decide the disclosure or the non-disclosure of information. But the commission has seemingly relinquished this primary duty in cases of larger public importance.

Citizens can file applications under the Right to Information Act with any public body and are guaranteed a reply from the public information officer of that public body within 30 days. In case of a no reply or dissatisfaction with the response, the citizen can file an appeal at the departmental level and then a second and final appeal with the Information Commission. Each State has its own State Information Commission to deal with second appeals concerning State bodies.

At the centre, it is the Central Information Commission (CIC). Until the 2019 amendment to the RTI Act, Information Commissioners (ICs) appointed to the CIC were equal in status to the Chief Election Commissioner, and that of a Supreme Court judge. They had a five-year fixed term and terms of service. After the amendments of 2019, the Centre gave itself powers to change and decide these terms whenever it wished, thereby striking at the independence of the commission and those who man it.

From transparency to hurdles

The CIC was a functioning institution until four years ago. It had passed orders seeking transparency in many cases of public importance — from boldly pronouncing that political parties were under the RTI Act’s ambit, and hence accountable to the public, to ordering disclosure of the current Prime Minister’s education qualifications and the Reserve Bank of India’s list of willful defaulters of loans. The commission acted as a strong proponent of transparency in public life.

Now, the CIC has become more like a walking dead institution, where records will show that not a single order for disclosure has been forthcoming in matters of public importance. The present set of Information Commissioners have together adopted a new jurisprudence that has created additional hurdles in a citizen’s quest for accountability.

Cases at the CIC come up for a hearing roughly after a two year wait. If the matter is not already infructuous or lost its significance, one can look forward to the commission deciding one’s case. But in matters of public importance, such as cases seeking disclosure of files related to the national lockdown during COVID-19, or the case seeking disclosure of data pertaining to phone tapping orders passed by the Home Ministry, the Commission has adopted a new way of delegating its mandate — to decide cases — to the Ministry before it (the very same party that stands accused of prohibiting transparency). In most cases, the Ministries reiterate their earlier stand of non-disclosure, most often under vague grounds of national interest.

More worryingly, after these public authorities pass fresh orders, which are usually a reiteration of their earlier stand against disclosure, the CIC refuses to accept any further challenge to such orders, therefore, refusing to do its duty of deciding the cases. One of the cardinal rules of natural justice is that no one should be a judge in their own cause. However, the commission now allows, or rather wants, the very Ministry that stands accused of violating the RTI Act to act as the judge in their own cause and decide whether a disclosure is necessary.

A similar situation arose when the CIC refused to hear the Internet Freedom Foundation’s challenge to the fresh non-disclosure order passed by the Home Ministry in the phone tapping case. The organisation had the resources to challenge this before the Delhi High Court and enforce their right to a fair hearing before the Commission. But many do not, in a country where a small percentage of the populace has the access and the resources to justice redress. And it is not as though the Information Commissioners were not made aware of this problem with their orders. They were. Hence, the need to strongly protest such conduct on their part which continues.

Fairly simple to handle

More recent examples from CIC cases do not instill confidence about where India’s information regime is headed. In a case seeking disclosure of documents relating to the making of the Unlawful Activities (Prevention) Amendment Act, 2019, the commission has resorted to keeping the matter pending for final order for more than three months now, something which is unheard of. Unlike court cases, RTI matters do not involve complex legal arguments and are fairly simple to adjudicate. In another case related to disclosure of non-performing assets and top defaulters of a co-operative bank, the matter was listed out-of-turn to issue a “stay” order against the Bank’s First Appellate Authority’s order for disclosure. A stay order is unheard of and there is no provision in the RTI Act for the same.

One cannot help but ask whether actions or inactions such as these are meant to deliberately frustrate citizens who dare to seek answers from the powers that be, and reduce the efficiency of the RTI Act. The effects are already being felt. It is getting more difficult, if not impossible, to extract any information of importance under the present dispensation. Bureaucrats reject RTIs with glee with no fear of facing penal provisions outlined in Section 20 of the RTI Act, knowing fully well that they have a free hand under the Information Commissioners.

To even think of the possibility of the very institution mandated to guard India’s transparency regime to be responsible for its downfall should set alarm bells ringing as far as civil society and citizens who care and dare to question are concerned. Dark clouds surround India’s transparency regime. Citizens have to mount intense pressure on authorities to act and appoint commissioners of integrity. Lawyers have to help willing citizens take matters to court and seek justice. If there is a failure to do so, India will lose its cherished right to know.

निडर और निष्पक्ष मुख्य चुनाव आयुक्त जरूरी

सुप्रीम कोर्ट की एक संविधान पीठ ने सुनवाई के दौरान कहा कि आज जरूरत है ऐसे मुख्य चुनाव आयुक्त (सीईसी) की, जो नैतिक बल का व निष्पक्ष हो और जिसे भयभीत न किया जा सके। पीठ ने कहा कि इस पद पर नियुक्ति के लिए बने पैनल में सीजेआई को भी शामिल किया जाए तो निष्पक्षता सुनिश्चित हो सकेगी। पीठ का कहना था कि संविधान ने सीईसी और दो अन्य आयुक्तों के कंधों पर भारी बोझ डाल दिया है। बेंच का मानना था कि शेषन (जिन्होंने चुनाव सुधार की क्रांति को जन्म दिया था) कभी-कभी पैदा होते हैं। दरअसल पिछले 18 वर्षों में एक भी सीईसी अपना छह साल का कार्यकाल पूरा नहीं कर सका है। इसका कारण यह है कि सन् 1991 के कानून में प्रावधान है अगर आयुक्त छह साल पूरे होने के पहले 65 साल का हो जाता है तो उसका कार्यकाल खत्म हो जाएगा। लिहाजा सरकार ऐसे व्यक्ति को नियुक्त करती है, जो कार्यकाल से पहले ही 65 का हो जाए, ताकि वह नया सीईसी नियुक्त कर सके। इससे सीईसी दबाव में रहते हैं। जजों की उपरोक्त टिप्पणी देश के गवर्नेस पर प्रहार है। आखिर क्यों सरकारें नैतिक रूप से मजबूत और निष्पक्ष आयुक्त नहीं चुन पातीं? अगर ऐसे लोगों की कमी है तो यूपीएससी और अन्य संस्थाओं की क्या स्थिति होगी? क्या हर जगह सीजेआई नियुक्ति के पैनल में बैठेंगे?

पर्यावरण के सवालों के स्थानीय समाधान खोजें

सीओपी – 27 की पर्यावरण बैठक में जिस ऐतिहासिक फंड की स्थापना की चर्चा हो रही है वो एक तरफ | लेकिन ज्यादा बड़ा प्रश्न यह है कि क्या इस तरह के फंड अब तक की हुई हानि की भरपाई कर पाएंगे! या क्या हमने स्वीकार कर लिया है कि पर्यावरण-सम्बंधी आपदाएं होती रहेंगी और उनके लिए जो भरपाई अमीर देश करेंगे, बात वहीं समाप्त हो जाएगी? जबकि बड़ा सवाल ये है कि जब दुर्घटनाएं होती हैं तो सिर्फ जान- माल की हानि नहीं होती। इससे एक देश भी काफी पीछे चला जाता है।

इस भरपाई से हम अपने उस उद्देश्य से मुक्त नहीं हो सकते, जो लगातार सीओपी में बहस का मुद्दा रहा है। कि औद्योगिक क्रांति से पहले जो 1.5 डिग्री सेल्सियस कम वैश्विक तापमान था, उसको हम किस तरह से वापस ला सकते हैं। यह बात यूएन और यूरोपियन कमीशन ने बार-बार कही कि शायद हम अपने उस उद्देश्य से भटक गए हैं, जिसके लिए इकट्ठा हुए हैं। यह बात सत्य भी है क्योंकि लगातार पिछली 26 सीओपी मीटिंग में कोई ऐतिहासिक बड़ा निर्णय नहीं हो पाया। इतनी गोष्ठियों के बाद हम अगर पता करने जाएं कि क्या हम कार्बन उत्सर्जन को रोक पाए हैं तो शायद हमें हताशा ही मिलेगी। इसमें दो राय नहीं कि इस तरह की अंतरराष्ट्रीय गोष्ठियां मायने रखती हैं, लेकिन प्रकृति, पर्यावरण और पृथ्वी से जुड़े सवालों में हम यह मानकर चलते हैं कि वसुधैव कुटुम्बकम् की कल्पना के अंतर्गत सब इनमें भागीदारी करें, ऐसा उनसे प्रतीत नहीं होता । प्रायः ये ऐसी बहस की तरफ बढ़ जाती हैं कि भारत कितना आगे बढ़ रहा है या चीन ने क्या कमाल किया और अमेरिका ने कितना कार्बन उत्सर्जित किया है। खेमे बंट जाते हैं। बहस कहीं और चली जाती है। एक कॉमन फंड सबका मुंह बंद करने के लिए सामने आ जाता है। इस परिपाटी को स्वीकार नहीं किया जा सकता, क्योंकि अगर हम पारिस्थितिकी तंत्र को हो रही हानियों को देखें तो पाएंगे कि कोई भी सीओपी सफल नहीं हुई और यह एक तरह से कॉन्फ्लिक्ट ऑफ पार्टीज का मामला बन चुका है।

पिछले सीओपी से लगातार यह बात कही जा रही है कि 2050 तक कार्बन उत्सर्जन इतना कर दो, उतना कर दो। इन बैठकों से कुछ निकलकर नहीं आया। क्योंकि सबसे बड़ी बात जो है, वो आर्थिकी की लड़ाई की है, पर्यावरण का तो मात्र दिखावा है। दुर्भाग्य यह है कि बहुत सारे विकासशील देश विकसित देशों की बराबरी करने के लिए अपने हिस्से के विकास को नकारना नहीं चाहते। यह बात दूसरी है कि उन्हें ये स्वीकार है कि जो भी नुकसान हो, अमीर देश उसकी भरपाई कर दें। ये न तो प्रकृति के साथ न्याय होगा, न पृथ्वी के साथ। कहीं न कहीं हम उसी सुर में विकास का राग अलापते रहेंगे। इसका पूर्ण अवलोकन होना चाहिए कि जब से सीओपी शुरू हुई है, तब से हम कौन-कौन-से बड़े निर्णय ले पाए, जिससे कि कुछ बेहतर दिखाई दिया हो ?

पेरिस एग्रीमेंट में यह निर्णय लिया गया था कि दुनिया के देश ग्लोबल वॉर्मिंग को नियंत्रित करने के लिए एकीकृत क्लाइमेट एक्शन लेंगे, जो कि 1.5 डिग्री टारगेट कहलाया है। अगर यह स्वीकार कर लिया जाए कि हम किसी भी हालत में 1.5 डिग्री लक्ष्य को अर्जित करेंगे, तो वही सबसे बड़ा निर्णय होगा। इसके लिए जो बाध्यता होगी, वो सबको स्वीकारनी होगी। क्योंकि इस तरह की गोष्ठियों में दुनिया – जहान की बातें भले हों, जान बचाने की बात भरपाइयों में निपटकर रह जाती है। अपने देश को ही देख लीजिए कि मेट्रो शहरों में वायु प्रदूषण कैसे बढ़ रहा है। एक अध्ययन से पता चला है कि इस प्रदूषण की मार बच्चों पर ज्यादा पड़ रही है। 2030 तक अगर ये ही हालात रहे तो हमारा तापमान लगातार बढ़ता चला जाएगा। 21वीं सदी के समाप्त होते-होते आधी से ज्यादा दुनिया पूरी तरह से त्रस्त हो चुकी होगी। हमें एक अवलोकन यह भी कर लेना चाहिए कि इन सब हालात के बीच पानी, जंगल, हवा, मिट्टी के क्या स्तर रहेंगे और अभी क्या हैं? इसमें सबसे अहम बिंदु यह है कि अंतरराष्ट्रीय स्तर की गोष्ठियों से इसके समाधान शायद उस हद तक नहीं निकलेंगे, जितने स्थानीय प्रबंधन से निकल सकते हैं। स्थानीय उपायों से भी हम जान बचाने के 60 से 70 प्रतिशत समाधान निकाल सकते हैं। अंतरराष्ट्रीय गोष्ठियों से कम अपेक्षा कम रखते हुए, हर देश हर राज्य को अपने स्तर पर बातचीत और काम करके इन सब दिक्कतों को ठीक करना होगा।

विश्वसनीयता के लिए

किसी भी देश के लोकतंत्र का आधार इस बात पर टिका होता है कि वहां चुनाव की प्रक्रिया को कितने निष्पक्ष और स्वच्छ तरीके से संचालित किया जाता है और उस पर आम जनता को कितना भरोसा है। जाहिर है, एक स्वतंत्र और निष्पक्ष चुनाव इस पर निर्भर करता है कि निर्वाचन आयोग और उसका संचालन करने वाले अधिकारी किसी नेता या पार्टी के आभामंडल से प्रभावित हुए बिना कैसे सिर्फ नियम-कायदे के मुताबिक अपना काम करते हैं। लेकिन कई बार चुनावों के दौरान मतदान प्रक्रिया से लेकर नतीजों तक को लेकर पार्टियां जिस तरह से सवाल उठाती हैं, उससे ऐसा संदेश निकलता है कि चुनावों को और ज्यादा विश्वसनीयता का आधार देने की जरूरत है। हालांकि देश के निर्वाचन आयोग ने स्वच्छ चुनाव आयोजित कराने के लिए हर स्तर पर चौकसी बरती और कोशिश की कि नतीजों और प्रक्रिया को लेकर कोई शिकायत न उभरे। लेकिन काम के बोझ और जिम्मेदारियों के विस्तृत दायरे के बीच अगर किसी भी पक्ष की ओर से उठे सवाल विश्वसनीयता को परखे जाने की मांग करते हैं, तो यह इस बात का संकेत है कि ऐसे तंत्र को भरोसे की कसौटी पर खरा साबित किया जाना चाहिए।

शायद यही वजह है कि सर्वोच्च न्यायालय ने मंगलवार को निर्वाचन आयुक्त की नियुक्ति को लेकर एक अहम टिप्पणी की और एक मजबूत मुख्य चुनाव आयुक्त की जरूरत पर जोर दिया। एक याचिका पर सुनवाई करते हुए अदालत ने कहा कि संविधान ने मुख्य निर्वाचन आयुक्त और दो अन्य निर्वाचन आयुक्तों के ‘नाजुक कंधों’ पर बहुत जिम्मेदारियां सौंपी हैं और वह मुख्य चुनाव आयुक्त के तौर पर टीएन शेषन की तरह के सुदृढ़ चरित्र वाले व्यक्ति को चाहता है। सच यह है कि पिछले कुछ समय से चुनाव प्रक्रिया जिस तरह संचालित होती रही है, उसे लेकर उठने वाली आशंकाएं इस संस्था की मजबूती और विश्वसनीयता को और मजबूत करने की जरूरत दर्शाती हैं। संविधान और आम नागरिकों के भरोसे के मुताबिक मुख्य चुनाव आयुक्त को किसी भी राजनीतिक प्रभाव से अछूता माना जाता है, इसलिए उसे स्वतंत्र और स्वायत्त होना चाहिए। इसलिए अदालत ने खासतौर पर मुख्य निर्वाचन आयुक्त की नियुक्ति की प्रक्रिया को तकलीफदेह करार दिया और कहा कि इसके लिए कोई कानून न होने का फायदा उठाने की प्रवृत्ति ठीक नहीं है।

दरअसल, चुनावों के दौरान अलग-अलग मसलों को लेकर विपक्षी दलों की ओर से सवाल उठाए जाते रहे हैं और शिकायतें आयोग को भेजी जाती रही हैं। एक स्वस्थ और मजबूत लोकतंत्र में होना यह चाहिए कि आयोग ऐसी शिकायतों पर बिना किसी आग्रह के स्पष्ट संदेश देने वाली कार्रवाई करे। लेकिन यह तभी संभव है जब आयोग को संचालित करने वाले इसके अधिकारी का व्यक्तित्व सुदृढ़ और मजबूत हो। इसीलिए सुप्रीम कोर्ट के संविधान पीठ में मौजूद न्यायमूर्ति केएम जोसेफ ने यहां तक कहा कि हमें मौजूदा दौर में ऐसे मुख्य चुनाव आयुक्त की जरूरत है जो प्रधानमंत्री के खिलाफ शिकायत मिलने पर भी कार्रवाई कर सके। गौरतलब है कि भारत में चुनावों के संचालन के संदर्भ में जो याद रखी जाने वाली कुछ शख्सियतें रहीं, टीएन शेषन उनमें से प्रमुख थे। नब्बे के दशक में जब वे मुख्य निर्वाचन आयुक्त थे, उस दौर में स्वच्छ और निष्पक्ष चुनाव आयोजित कराना एक चुनौती थी। लेकिन उन्होंने अपने कार्यकाल में किसी नेता या दल के प्रभाव में आए बिना जिस तरह संपूर्ण निर्वाचन प्रक्रिया का संचालन किया, वह स्वतंत्र, निष्पक्ष और स्वच्छ चुनावों के आयोजन का एक ठोस उदाहरण है। इसलिए सुप्रीम कोर्ट ने अगर एक सुदृढ़ चरित्र वाले मुख्य निर्वाचन आयुक्त की जरूरत पर जोर दिया है, तो इसकी अहमियत समझी जा सकती है।

पूर्वोत्तर का शिवजी

कहानी है वर्ष 1671 के मार्च के महीने की जब लगभग पूरे देश पर बाहरी आक्रांताओं के आक्रमण चरम पर थे। अहोम राजा स्वर्गदेव चक्रध्वज सिंघा बर्बर आक्रमणकारियों के हाथों अपने पूर्ववर्ती राजा जयध्वज सिंघ की अपमानजनक हार के बाद अहोम शिविर में नवीनतम घटनाओं की जानकारी के लिए उत्सुकता से प्रतीक्षा कर रहे थे। बाहरी खतरों और आक्रमणकारियों को सफलतापूर्वक दूर रखकर अहोम वंश ने लगभग चार शताब्दियों तक ब्रह्मपुत्र घाटी पर निर्विवाद शासन किया। 17वीं शताब्दी के उत्तरार्ध में अहोम राजवंश सम्राट शाहजहां के साथ सीधे संघर्ष में शुरू कर रहा था। कोच और कमता राज्य पश्चिम में मुगल और पूर्व में अहोम के बीच मध्यस्थ शक्ति की तरह थे। मुगलों ने कोच साम्राज्य पर हमले करके क्षेत्र का तत्काल विलय करना शुरू कर दिया।

एक तरफ अहोम और दूसरी तरफ मुगलों के बीच अब अंतहीन सैन्य संघर्ष शुरू हो गया था। अहोम साम्राज्य पर मुगलों द्वारा सत्रह बार हमले किये गए। लेकिन मुगल यहां तलवार के बल पर अपना शासन स्थापित करने में कभी सफल नहीं हो सके। अहोम साम्राज्य के खोए हुए क्षेत्रों को लड़कर पुनः प्राप्त करने के लिए अपनी सेना को पुनर्गठित कर पाते‚इससे पहले आक्रमणकारियों के हाथों हार के दुःख और अपमान ने जयध्वज सिंघा का जीवन छीन लिया। इसलिए अहोम साम्राज्य की खोई प्रतिष्ठा बहाल करने के लिए चक्रध्वज पूरी कोशिश कर रहे थे। भूमि पर लड़ने में मुगल सैनिक पारंगत थे‚दूसरी ओर अहोम सैनिकों ने इस क्षेत्र के जल–निकायों के माध्यम से दुश्मन को भगाने में अपने पारंपरिक ज्ञान का सबसे अच्छा उपयोग किया। चक्रध्वज सिंघ शुरू में उलझन में थे कि मुगलों के खिलाफ अहोम सेना का नेतृत्व करने के लिए किसे प्रभारी बनाया जाए। अंततः वे अहोम सेना के एक युवा सैनिक पर केंद्रित हो गए। युवा सैनिक के पास न केवल दुश्मन से लड़ने के लिए अच्छी काया थी बल्कि वह युद्ध की रणनीति में भी अच्छी तरह अनुभवी था। वह थे लाचित बरफुकन। लाचित गुरिल्ला युद्ध में अच्छी तरह प्रशिक्षित थे और अतीत में सफल लड़ाइयों का नेतृत्व कर चुके थे। दुश्मन को शिकस्त देने के उनके जुनून ने उन्हें राजा चक्रध्वज सिंघ के लिए एकदम सही विकल्प बना दिया था।

मुगलों के साथ आगे की लड़ाई की तैयारियों के संबंध में लाचित के पास पहले से ही तैयार योजना थी। मुगलों को पहले जमीन पर करारी हार चखा कर विशाल ब्रह्मपुत्र नदी के पानी की ओर मोड़ना था‚जहां से वे कभी अहोम साम्राज्य में कदम रखने की हिम्मत नहीं कर सकें। मुगल पहले ही गुवाहाटी में भूमि के एक बड़े हिस्से पर अपने स्वामित्व का दावा कर चुके थे। लाचित के तहत अहोम सेना के लिए यह जीवन–मृत्यु की स्थिति बन गई थी। लड़ाई से कुछ दिन पहले तेज बुखार और शारीरिक कमजोरी से लाचित पीडि़त हो गए थे। लेकिन इसके बावजूद उन्होंने अपने सैनिकों को निर्देश जारी किए कि जब तक युद्ध की तैयारियां पूरी नहीं हो जातीं तब तक बिल्कुल न सोएं। लचित ने पहले ही उन्हें युद्ध की विभिन्न रणनीतियों के बारे में समझा दिया था ताकि मुगलों को जमीन पर सफलतापूर्वक हराने के बाद ब्रह्मपुत्र नदी के किनारे की ओर धकेला जा सके। सेना को तद्नुसार मुगलों को ब्रह्मपुत्र के उत्तरी तट पर स्थित सराईघाट नामक स्थान की ओर ले जाने के लिए निर्देशित किया गया। सराईघाट की अनूठी भौगोलिक स्थिति को ध्यान में रखते हुए लाचित ने यह निर्णय लिया। ब्रह्मपुत्र अत्यंत चौड़ी नदी है जो सराईघाट में संकीर्ण हो जाती है। इसलिए अहोम की नौसेना की रक्षा के लिए स्वाभाविक रूप से सराईघाट आदर्श और उपयुक्त स्थान था। मतलब यह कि ब्रह्मपुत्र की चौड़ाई ने अहोम सेना को दुश्मन के जहाजों पर नजर रखने और गुरिल्ला हमलों के साथ उन्हें आश्चर्यचकित करने के लिए सबसे लाभप्रद स्थान प्रदान किया था।

सराईघाट की प्रसिद्ध लड़ाई (1671) भारतीय इतिहास में उल्लेखनीय है क्योंकि यह एकमात्र नौसैनिक युद्ध था जो नदी के तट पर लड़ा गया था। अत्यंत साहसी और दृढ़ अहोम सेना अंततः मुगलों को सराईघाट के पानी में वापस धकेलने में सक्षम हो गई थी‚जहां उन्हें भारी नुकसान उठाना पड़ा। उन्होंने जल्द ही आत्मसमर्पण कर दिया और असम व दक्षिण–पूर्व एशिया सहित पूरा उत्तर–पूर्वी क्षेत्र हमेशा के लिए मुगल खतरे से मुक्त हो गया था। असम के लोगों की लोकप्रिय सामाजिक और सांस्कृतिक कल्पना में लाचित बरफुकन का नाम अंकित हो गया।

जरूरी चुनाव सुधार

चुनाव आयोग की स्वायत्तता पर अगर देश के सर्वोच्च न्यायालय की निगाह गई है, तो यह सुखद और स्वागतयोग्य है। सुप्रीम कोर्ट ने ‘चुनाव आयोग के क्रियाकलापों पर बड़े सवाल उठाए हैं, जिन पर आने वाले दिनों में चर्चा बढ़ना तय है। सर्वोच्च न्यायालय की गंभीरता का अंदाजा इस बात से लगता है कि न्यायालय ने केंद्र सरकार से चुनाव आयोग में अरुण गोयल की नियुक्ति के दस्तावेज पेश करने को कहा है। मंगलवार को न्यायालय ने दोटूक कहा कि एक के बाद एक सरकारों ने भारत के चुनाव आयोग की स्वतंत्रता को नष्ट कर दिया है। 1996 से किसी भी मुख्य चुनाव आयुक्त को चुनाव आयोग के प्रमुख के रूप में पूरे छह साल का कार्यकाल नहीं मिला है। लगे हाथ, पांच न्यायमूर्तियों की संविधान पीठ ने खेद जताया है कि चुनाव आयुक्तों की नियुक्ति के लिए यथोचित कानून के अभाव में एक खतरनाक प्रवृत्ति सामने आई है। यह अच्छी बात है कि सर्वोच्च न्यायालय ने किसी एक राजनीतिक दल को निशाना नहीं बनाया है। चुनाव आयुक्तों को चुनने संबंधी सवाल पर संविधान की चुप्पी का सभी राजनीतिक दलों ने सत्ता में रहते हुए लाभ उठाया है।

न्यायमूर्ति के एम जोसेफ की अगुवाई वाली पीठ ने बहुत विस्तार से चुनाव आयोग की परेशानियों को देखा है। टी एन शेषन 1990 और 1996 के बीच छह साल मुख्य चुनाव आयुक्त रहे थे। उसके बाद गिरावट तब शुरू हुई, जब किसी भी चुनाव आयुक्त को पूर्ण कार्यकाल नहीं दिया गया। सरकार को अच्छे से पता है कि वह क्या कर रही है, जब वह किसी को नियुक्त करती है, तब उसे पता रहता है कि नियुक्त होने वाले की जन्मतिथि क्या है? सरकार अगर चाहे, तो आसानी से किसी ऐसे आयुक्त को नियुक्त कर सकती है, जो पूरे छह साल तक आयोग में सेवा देने में सक्षम हो, लेकिन ऐसा नहीं हो पा रहा है। यह सहज आकलन है कि टी एन शेषन को पूरा समय मिला था, इसलिए वह बेहतर काम कर पाए, लेकिन उनके रहते ही चुनाव आयोग की रूपरेखा को बदल दिया गया था। चौकस मुख्य चुनाव आयुक्त से परेशान होने के बाद तमाम राजनीतिक दल अपेक्षाकृत कमजोर चुनाव आयोग के पक्षधर थे । सत्ता से तालमेल बिठाकर चलना एक तरह से आयोग की मजबूरी लगती है। आलोचना करते हुए भी सुप्रीम कोर्ट ने जैसी शालीनता का परिचय दिया है, वह काबिले तारीफ है। पीठ का इशारा देखिए, हम ऐसा नहीं कह रहे हैं, लेकिन ऐसा लग रहा है।

इस स्वस्थ आलोचना को सही रूप में ग्रहण करना चुनाव आयोग और लोकतंत्र, दोनों के लिए बहुत जरूरी है। हालांकि, इसके पीछे दूसरी राजनीति खोजने – बताने वाले भी कम नहीं हैं। पिछले दिनों न्यायाधीशों की नियुक्ति पर एक मंत्री ने शीर्ष अदालत के मॉडल की आलोचना की थी। लोग यही चाहेंगे कि चुनाव आयोग में सुधार का कोई भी प्रयास न्यायपालिका और कार्यपालिका के बीच विवाद की वजह बनकर न रह जाए । सर्वोच्च न्यायालय में उठे मुद्दों का समाधान आवश्यक है, राजनीति को अगर मौका दिया जाएगा, तो सुधार की कोई भी कोशिश ठिकाने लग जाएगी। हमारे लोकतंत्र व सांविधानिक संस्थाओं में जो कमियां आ गई हैं, उन पर चर्चा और समाधान से हम मुंह नहीं चुरा सकते । संविधान अपेक्षा करता है कि सभी सांविधानिक संस्थाएं या स्तंभ एक-दूसरे को सुधारें और सही संचालन की राह पर चलें। चुनाव आयुक्त ही नहीं, सभी सांविधानिक पदों पर किसी भी नियुक्ति के लिए तटस्थ और योग्य चयन समिति समय की मांग है।

ताकि ‘सात बहनें’ आपस में न लड़ें

पूर्वोत्तर के राज्य असम और मेघालय के बीच हुई हिंसक झड़प में छह लोगों की मौत का कारण बेशक लकड़ी तस्करी से उपजे विवाद को बताया जा रहा हो, लेकिन इसके मूल में बीते पांच दशकों से दोनों राज्यों के बीच जारी सीमा विवाद ही है। यदि ऐसा नहीं होता, तो असम सरकार इस मामले में आनन-फानन कार्रवाई करते हुए वन विभाग के अधिकारियों को निलंबित कर सीबीआई जांच की हामी नहीं भरती। अभी इसी साल असम और मेघालय सरकार ने सीमा विवाद को सुलझाने के लिए 12 विवादित इलाकों में से छह के लिए एक समझौते पर हस्ताक्षर किए थे। मगर उन इलाकों में रहने वाले लोगों को यह समझौता मंजूर नहीं। ताजा हिंसा की जड़ें भी इसी मतभेद में छिपी हैं।

वैसे तो ‘सेवेन सिस्टर्स’ कहलाने वाले पूर्वोत्तर के राज्यों का सीमा विवाद बहुत पुराना है, लेकिन हाल में इस वजह से उनके बीच हिंसक झड़पें तेजी से बढ़ी हैं। इसकी वजहों को समझने के लिए अतीत में झांकना जरूरी है। दरअसल, जब असम से काटकर मिजोरम, मेघालय, अरुणाचल प्रदेश और मणिपुर जैसे राज्यों का गठन किया गया था, तब इस इलाके में आबादी बहुत कम थी और सीमावर्ती इलाके घने जंगलों से घिरे थे। मगर आबादी के बढ़ते दबाव की वजह से लोगों की जरूरतों के हिसाब से जब जगह कम पड़ने लगी, तो जमीन का मुद्दा उठने लगा। इसे शुरुआती दौर में ही सुलझाया जा सकता था, पर तब केंद्र और राज्यों की सरकारें इस ओर से आंखें मूंदे रहीं । इसी विवाद के चलते बीते साल मिजोरम पुलिस के हाथों असम पुलिस के छह जवानों की मौत हो गई थी।

प्रशासनिक सहूलियत के लिए असम से काटकर नए राज्यों के गठन का सिलसिला वर्ष 1962 के बाद शुरू हुआ था, लेकिन तब सीमाओं का सही तरीके से निर्धारण नहीं किया गया था। असम और अरुणाचल प्रदेश के बीच सीमा पर सबसे पहले वर्ष 1992 में हिंसक झड़प हुई थीं। इन दोनों राज्यों की सीमा 804.1 किलोमीटर लंबी है। कबीलाई मानसिकता से प्रभावित पक्ष एक-दूसरे पर अतिक्रमण और हिंसा भड़काने के आरोप लगाते रहते हैं। पहले जिस इलाके को असम के लुसाई हिल्स जिले के नाम से जाना जाता था, उसे 1972 में पहले केंद्रशासित क्षेत्र और फिर 1987 में पूर्ण राज्य मिजोरम का दर्जा दिया गया। दक्षिण असम के साथ मिजोरम की करीब 165 किलोमीटर लंबी सीमा सटी है। मिजोरम का दावा है कि उसके लगभग 509 वर्गमील इलाके पर असम का अवैध कब्जा है।

वर्ष 1993 में असम और मणिपुर सरकार ने लुसाई हिल्स व मणिपुर राज्य के बीच के इलाकों की सीमा का निर्धारण कर दिया था, लेकिन मिजोरम की दलील है कि यह सीमांकन वर्ष 1875 की अधिसूचना पर आधारित होना चाहिए। नेताओं का कहना है कि 1933 में मिजो समुदाय से सलाह नहीं ली गई थी, इसलिए इस अधिसूचना के तहत निर्धारित सीमा वैध नहीं है। उधर, असम सरकार 1933 की अधिसूचना के आधार पर ही सीमाएं तय करने के पक्ष में है।

सीमा विवाद के मुद्दे पर असम और नगालैंड में भी अक्सर हिंसा होती रही है। इन दोनों राज्यों के बीच 434 किलोमीटर लंबी सीमा है। वर्ष 1979, 1985, 1989, 2007 और 2014 में विभिन्न घटनाओं में नगालैंड से सशस्त्र बलों के हमलों में कई लोग मारे जा चुके हैं। इनमें से ज्यादातर असम के थे। केंद्र ने असम- नगालैंड सीमा विवाद सुलझाने के लिए अगस्त 1971 में विधि आयोग के तत्कालीन अध्यक्ष के वी के सुंदरम को नियुक्त किया था। सुंदरम ने सीमा का संयुक्त सर्वेक्षण करने का सुझाव दिया था। मगर नगालैंड इस पर सहमत नहीं हुआ। असम सरकार ने वर्ष 1988 में सर्वोच्च न्यायालय में इस सीमा विवाद को लेकर एक याचिका दायर की थी। उसकी मांग थी कि शीर्ष अदालत उसे सभी अतिक्रमित क्षेत्रों का असली मालिक घोषित करे और नगालैंड को उन क्षेत्रों का शांतिपूर्ण नियंत्रण सौंपने का निर्देश दे। यह मामला अभी तक अदालत में लंबित है।

इस इलाके की भौगोलिक स्थिति भी विवाद की एक प्रमुख वजह है। नदियों, पहाड़ों और घने जंगलों से घिरे होने के कारण कई इलाकों में सीमा को भौतिक रूप से चिह्नित नहीं किया जा सका है। कहा जाता है कि साल 1956 में सीमांकन की कवायद के दौरान इन विसंगतियों का समाधान नहीं किया गया। फिर, जब असम से काटकर नगालैंड (1963), मिजोरम, मेघालय, त्रिपुरा, मणिपुर (1972) और अरुणाचल प्रदेश (1987) को अलग राज्य का दर्जा दिया गया, तब भी इस पर ध्यान नहीं दिया गया था।

दरअसल, आजादी के बाद से ही असम, नगालैंड, मणिपुर और त्रिपुरा जैसे राज्यों में उग्रवाद की समस्या ने जिस गंभीरता से सिर उठाया, उससे बाकी तमाम मुद्दे हाशिये पर चले गए। केंद्र और राज्यों का ध्यान उग्रवाद पर ही लगा रहा। हालांकि, इसमें कितनी कामयाबी मिली, इस पर सवाल हो सकते हैं, क्योंकि तमाम दावों के बावजूद इलाके में उग्रवाद का खात्मा नहीं हो सका है। केंद्र की उपेक्षा और इन राज्यों में सत्ता संभालने वाली राजनीतिक पार्टियां भी सीमा विवाद जैसे गंभीर मुद्दों को सुलझाने के बजाय अपने हितों को साधने में ही जुटी रहीं । पूर्वोत्तर में उग्रवाद अब तक तमाम राजनीतिक दलों के लिए एक ऐसा कवच रहा है, जिसके पीछे सीमा विवाद और आम लोगों से जुड़ी तमाम समस्याएं छिपती रही हैं। सरकारों के इस रवैये का खामियाजा खासकर सीमावर्ती इलाकों में रहने वालों को भुगतना पड़ता है।

इनर लाइन परमिट (आईएलपी) प्रणाली भी असम के साथ कम से कम चार राज्यों के सीमा विवाद की प्रमुख वजह है। यहां के अरुणाचल प्रदेश, नगालैंड, मिजोरम और मणिपुर में यह लागू है। परमिट के बिना बाहर का कोई व्यक्ति इन राज्यों में नहीं पहुंच सकता, और वह परमिट में लिखी अवधि तक ही वहां रुक सकता है। मगर इन राज्यों के लोग बिना किसी रोक के असम में आवाजाही कर सकते हैं।

सीमावर्ती इलाके में अक्सर होने वाली हिंसा के कारण विकास योजनाओं के साथ आम लोगों का जीवन भी प्रभावित हो रहा है। केंद्र सरकार को इस समस्या के स्वीकार्य समाधान की दिशा में ठोस पहल करते हुए सीमा निर्धारण के लिए किसी आयोग का गठन करना चाहिए, ताकि दशकों पुराने इन विवादों को शीघ्र निपटाया जा सके। ऐसा न होने की स्थिति में सीमावर्ती इलाकों में हिंसा बार-बार सिर उठाती रहेगी।
