Global innovations force-fitted in India won’t make an impact

There are few countries that enjoy the advantages India does when it comes to its ability to stimulate growth. We are in a sweet spot on the demographic curve, with the majority of our population young and productive.Their aspirations, and natural inclination to embrace new technologies, has transformed India into an economic power within just a couple of decades after liberalisation. But the benefits of liberalisation — increased industry, trade, foreign investments, modernisation and technological advancements — are yet to percolate evenly to marginalised sections of India’s population. There are villages that still don’t have access to very basic services such as electricity, roads and sanitation.

Which may be why India doesn’t need moonshot ideas like drones, self drive cars, domestic robots for now. What we need is to empower the downtrodden section of society to be more productive. For a country of 1.2 billion, it’s not an easy task.How do we do it? Innovation is the short answer. The nuanced one is India-focused innovation. As a nation and civilisation, we have an early history of innovation — think Indus Valley Civilisation — even if the rest has been largely fragmented. Still, India ranked 60 in the Global Innovation Index 2017 (goo.gl/o0oA8V) that was released on June 15, moving up from 66th position in 2016. While the report necessitates some introspection, inferring our innovation capability solely on its basis may be stretching it a bit. There are scores of examples of great recent innovations that are not only uniquely Indian, but are also innovations that remain unmatched anywhere else in the world.

Home-Developed Techs

Take Isro (Indian Space Research Organisation), which is challenging the might of the US’s Nasa (National Aeronautical and Space Administration) and the European Space Agency. Isro has demonstrated with alacrity that it needn’t cost the world to send a space probe out of this world.

Its use of home-developed technologies, a less-complicated payload design, simpler mechanics and cost rationalisation are all innovations we are proud of. Isro’s odyssey to Mars with the Mangalyaan probe, on a shoestring budget of just Rs 450 crore (about $73 million) isn’t something any other space agency can emulate. More recently, Isro’s launch of 104 satellites on a single rocket underscored its innovation prowess, the kind India desperately needs in all fields.Then, there’s the unique India-specific innovation our telecom industry made in the early 2000s. Low-cost prepaid mobile telephony — Rs 50 for a SIM card inclusive of talk time — made little business sense. The cost of telecom licences were steep and mobile penetration, by extension revenue, was low. It also had no other global precedence.

But our telecom industry recognised a critical differentiating factor India had: millions of people at the proverbial bottom of the pyramid. By innovating for them, a market with vast opportunities waiting to be unlocked, the industry turned that demographic into its biggest customer base. Innovations like that, and recharge sachets of Rs 5 and Rs 10 fanned a revolution that transformed India into the world’s second-largest telecom market in terms of mobile phone users and, subsequently, Internet users.

Internet penetration in Indian cities and villages has been nothing short of phenomenal, even if we lag developed nations in terms of speed.When we started Flipkart in 2007, we were of the view that Internet usage in India was on the cusp of a break through. While the start was alright for Flipkart, we quickly hit a major bump when we wanted to scale up. Indian customers weren’t willing to pay first and wait for a product to be delivered later. We needed a long-term solution.

Easy Ways to Pay

In 2010, Flipkart launched cash on delivery (CoD) on scale in India, an innovation that ushered e-commerce and helped build trust among customers for shopping online. CoD was a game-changer. It turbocharged our growth, which, in turn, acted as a catalyst for India’s nascent startup industry. Flipkart’s innovation DNA runs deep to this day, with initiatives such as ‘No Cost EMI’, which has made quality products affordable and accessible to millions.The other large-scale India innovation that empowered people is India Stack, on which Aadhaar is based. It is the one innovation that couldn’t have been conceived anywhere else. Our 1.2 billion population, widespread illiteracy and population migration necessitated a governance solution to ensure equal and unfettered access to public services for everyone. India Stack has brought millions into the formal economy, ensured government services are delivered efficiently and helped plug leakages that earlier cost the exchequer hundreds of crores of rupees.

Global innovations imported and force-fitted in India are unlikely to make an impact, because they lack the Indian context. India needs innovations in mass transport, healthcare, education, waste management, urban planning and traffic — all of which should be geared to the way we want to develop as a nation, which could be unique and different from how other countries have prospered.In 2010, the president announced 2010-2020 as the ‘Decade of Innovation’. We’re well past the halfway mark. This may be a good time to assess how we’re doing.

जॉब पैदा करना भी हमारी नैतिक अनिवार्यता

मैंने भाजपा को पहली बार 2014 में वोट दिया। यह सोचा-समझा फैसला था। मैंने खूबियों-खामियों, जोखिम व अवसरों और फायदे-नुकसान की दृष्टि से आकलन किया था। तीन साल बाद मैं खुद से पूछ रहा हूं कि इस फैसले का नतीजा क्या निकला? उतना अच्छा तो नहीं जैसी मैंने उम्मीद की थी पर फिर भी मैं दो साल और इंतजार करने को तैयार हूं।
मुझे तब चिंता थी कि भारत के पास ‘आबादीगत फायदे’ के रूप में अवसर की बहुत छोटी-सी गुंजाइश उपलब्ध है। यदि हमने सही प्रत्याशी को चुना तो करोड़ों लोगों की जिंदगी में समृद्धि आ जाएगी और समय के साथ हो सकता है कि भारत गरीबी को पूरी तरह मिटाकर मध्यवर्गीय देश बन जाए। भारत के लिए अवसर अनूठे ढंग से युवा आबादी के रूप में हैं और जो लोग अपनी उत्पादक उम्र में हैं, उन्हें रोजगार मुहैया करा दिया जाए तो संपन्नता में तेजी आ जाएगी, जो बुजुर्गों और बच्चों को सहारा देने के बोझ पर भारी पड़ेगी। यह जो छोटी-सी खिड़की उपलब्ध है, वह दर्जनभर वर्षों के बाद खत्म हो जाएगी, क्योंकि हमारा देश भी अन्य राष्ट्रों की तरह बूढ़ा होने लगेगा। इसलिए मैंने विभिन्न प्रत्याशियों का आकलन किया; राहुल गांधी, अरविंद केजरीवाल व नरेंद्र मोदी और उनके पूर्वइतिहास तथा चुनावी वादों के आधार पर मैंने निष्कर्ष निकाला कि मोदी ने जॉब पैदा करने और आबादीगत फायदे को भुनाने की सर्वश्रेष्ठ पेशकश की है। मोदी के बिना तो भाजपा के विकल्प में कोई आकर्षण नहीं था।
मैं मोदी को वोट देने में निहित जोखिम से भी वाकिफ था- वे ध्रुवीकरण लाने वाले, संप्रदायवादी और तानाशाह हैं। लेकिन, मेरा मानना था कि उन्हें वोट न देने में अधिक जोखिम था। यदि भारत आवश्यक संख्या में जॉब निर्मित नहीं कर पाया तो युवाओं की इतनी बड़ी उम्मीद निराशा में बदल जाएगी। फिर दंगे हो सकते हैं तथा हम एक और पीढ़ी को बलि चढ़ा देंगे। मुझे यह भी लगा कि देश की संस्थाएं बहुत मजबूत हैं। जैसे उन्होंने इंदिरा गांधी को तानाशाह बनने से रोक दिया, उसी प्रकार वे इस जोखिम को भी मिटाने में मदद करेंगे। मेरा आकलन यह भी था कि भारत कभी फासीवादी देश नहीं बनेगा और न गुजरात 2002 जैसे दंगे फिर होंगे। मैंने मोदी को उस सांप्रदायिक दाग से मुक्त नहीं किया। मेरी सरल-सी दलील यही थी कि जॉब पैदा करना वैसी ही नैतिक अनिवार्यता है, जैसी धर्मनिरपेक्षता। इस तरह उन्हें वोट देने के फायदे धर्मनिरपेक्षता के लिए संभावित जोखिम पर भारी पड़े।
तीन साल बाद मुझे लग रहा है कि मोदी ने आंशिक परिणाम ही दिए हैं। निश्चित ही जॉब निर्मित करने में कमजोर प्रदर्शन से राष्ट्र निराश हुआ है। हालांकि, सरकार ने कुल-मिलाकर अर्थव्यवस्था को काफी अच्छी तरह संभाला है : महंगाई 3 फीसदी के रिकॉर्ड न्यूनतम स्तर पर है, वित्तीय घाटा 4.5 फीसदी से घटकर 3.5 फीसदी पर आ गया है, आर्थिक वृद्धि दर 7 फीसदी तक पहुंच गई है और यदि नोटबंदी नहीं होती तो यह दर 8 फीसदी तक भी जा सकती थी। इतिहास में पहली बार भारत में अतिरिक्त बिजली मौजूद है और यह दुनिया में सबसे अधिक प्रत्यक्ष विदेशी निवेश आकर्षित करने वाला देश है। कुछ प्रमुख सुधार भी हासिल कर लिए गए हैं : जीएसटी- खामियों के बावजूद यह गेमचेंजर है। दीवालिया संबंधी कानून भी बहुत फर्क पैदा कर देगा। प्रत्यक्ष विदेशी निवेश की सीमा शिथिल करने, एफआईपीबी को खत्म करने, प्राकृतिक संसाधनों की नीलामी और दस्तावेजों के स्वप्रमाणीकरण को विस्तार देने जैसे कदम बहुत बड़ा फर्क पैदा कर देंगे।
फिर मोदी जॉब के मोर्चे पर नाकाम क्यों हो गए? मुझे लगता कि किसी ने भी एकाग्रचित्त होकर इस समस्या पर ध्यान नहीं दिया। बैंकों के कर्ज का समाधान खोजने में तीन साल व्यर्थ गंवा दिए गए, जो निजी निवेश के हाथ खींचने और नौकरियों के अभाव का कारण है। नौकरशाही पर जरूरत से ज्यादा निर्भरता है- ज्यादातर आईएएस अफसरों को इस बात का थोड़ी भी जानकारी नहीं है कि कैसे निजी अर्थव्यवस्था जॉब पैदा करती है। भारत में आवास का क्षेत्र सबसे ज्यादा जॉब पैदा करता है और फिर भी जब जीएसटी काउंसिल ने बिना सोच-विचार के सीमेंट को 28 फीसदी कर के दायरे में रखा तो किसी ने इसका विरोध नहीं किया। भारत को अत्यधिक उत्पादकता वाले जॉब चाहिए। यह तभी होगा जब हम वैश्विक बाजार के लिए उत्पादन करेंगे। सारे सफल देशों ने यही साबित किया है, जिसमें नवीनतम चीन है। ‘मेक इन इंडिया’ को ‘मेक फॉर वर्ल्ड’ कहना चाहिए।
यह तो स्तब्ध करने वाली बात है कि 1991 के पहले वाला ‘इम्पोर्ट सब्स्टिट्यूशन’ का विचार फिर जिंदा किया जा रहा है। निर्यात को लेकर निराशा गलत हैं। भारत के सामने अब भी निर्यात के विशाल अवसर हैं। अर्थशास्त्री अरविंद पनगढ़ियां ध्यान दिलाते हैं कि विभिन्न उत्पादों का वैश्विक बाजार 16 खरब डॉलर का है और इसमें भारत का योगदान मामूली 1.8 फीसदी है। जोखिम की बात करें तो कोई भी सांप्रदायिक घटना बेकाबू नहीं हुई पर विचलित करने वाला शोर बहुत है। दलित या मुस्लिम के खिलाफ घटना के बगैर कोई हफ्ता नहीं जाता। जानवरों के प्रति क्रूरता रोकने वाला कानून ही लीजिए। प्रचार के विपरीत वह गोवध तो नहीं रोकता पर उसका इरादा सांप्रदायिक है। जानवरों के बाजार में ‘लाइसेंस राज’ आ गया और चमड़े के सामान व मांस का निर्यात तथा लाखों जॉब संकट में आ गए हैं।
इतने वर्षों में मैं आरआरएस व भाजपा के कई लोगों से मिला हूं, उनमें से कई सोचने-समझने वाले लोग हैं। मैं उनकी विचारधारा से इत्तेफाक नहीं रखता पर उनकी गंभीरता के लिए उनका सम्मान करता हूं। ‘गोवध’ को लेकर हिंसा पर वे भी हैरान हैं। मोदी यदि इतिहास में महान नेता का स्थान पाना चाहते हैं तो पार्टी के उपद्रवी लोगों को रोकना होगा। तीन साल बाद, क्या मोदी को वोट देने का जोखिम लेने लायक था? जॉब पैदा करने में नाकामी और ध्रुवीकृत माहौल के बावजूद महत्वपूर्ण उपलब्धियां भी हैं। इसलिए मैं इस उम्मीद के साथ दो साल इंतजार करने को राजी हूं कि मोदी की सौद्देश्यता और दृढ़ संकल्प खामियों व नकारात्मकता पर भारी पड़ेगी। कांग्रेस व ‘आप’ जिस तरह खुद को नष्ट करने पर तुले हैं, संभव है 2019 में कोई विकल्प न हो। लेकिन, मुझे उम्मीद है कि तब मैं मोदी को विकल्प न होने के कारण नहीं, उनकी उपलब्धियों के कारण वोट दूंगा।

राष्ट्रपति का चुनाव आम सहमति से हो तो बेहतर

भाजपा अध्यक्ष अमित शाह ने मंगलवार को राष्ट्रपति चुनाव पर विपक्ष से संवाद साधने के लिए तीन सदस्यीय समिति बनाई, जिसके बाद उन्होंने गैर-एनडीए दलों के नेताओं से फोन और व्यक्तिगत मुलाकातों के जरिये संपर्क किया। लेकिन, लगता है कि किसी समान वैचारिक धरातल पर पहुंचने की बजाय इस संपर्क ने विपक्ष को बांटने का ही काम किया, क्योंकि वह इसी चर्चा में उलझ गया कि यदि भाजपा के नेतृत्व वाले एनडीए ने किसी विवादास्पद नेता को उम्मीदवार बनाया तो हम कैसे समर्थन देंगे।ममता बनर्जी ने कहा कि उम्मीदवार सुषमा स्वराज हुईं तो वे समर्थन देंगी तो एनसीपी ने महाराष्ट्र का कोई नेता होने पर सहमति जताने की तैयारी दिखाई। कांग्रेस भाजपा की ओर से प्रत्याशी घोषित करने का इंतजार करना चाहती है तो वामपंथी दलों की रुचि महात्मा गांधी के पोते गोपालकृष्ण गांधी को प्रत्याशी बनाकर राष्ट्रपति चुनाव को ‘गांधी विरुद्ध गोडसे’ का रंग देने में अधिक है।
अब सूचना-प्रसारण मंत्री वेंकैया नायडू का पेनल शुक्रवार को कांग्रेस अध्यक्ष सोनिया गांधी और माकपा प्रमुख सीताराम येचुरी से मिलेगा। चुनाव 17 जुलाई को होना है और यदि आम सहमति नहीं हुई तो चुनाव परिणाम 20 जुलाई को घोषित होंगे। जाहिर है जितनी रुचि भाजपा के नेतृत्व वाले एनडीए के प्रत्याशी में होगी, उतनी नहीं तो कुछ निगाहें तो विपक्षी उम्मीदवार पर होंगी। हालांकि, विपक्ष टक्कर देने की स्थिति में नहीं है और निर्वाचक मंडल की दृष्टि से एनडीए उससे बहुत आगे है।
उत्तर प्रदेश में भाजपा की जीत ने खासा फर्क ला दिया है। दक्षिण के प्रमुख दलों का समर्थन भी उसे मिल गया है। लेकिन सच तो यह है कि राष्ट्रपति देश के संविधान का संरक्षक होता है, इसलिए उसका निष्पक्ष होना बहुत जरूरी है। वैस कार्यकारी अधिकारों की दृष्टि से राष्ट्रपति के पास ज्यादा शक्तियां नहीं है लेकिन, त्रिशंकु संसद होने अथवा किसी राज्य सरकार को अनुच्छेद 356 के तहत बर्खास्त करने की दो नाजुक स्थितियों में उसकी भूमिका महत्वपूर्ण हो जाती है। राजनेता के राष्ट्रपति बनने पर यह सवाल बना रहता है कि वह ऐसी स्थिति में राजनीतिक पूर्वग्रहों से उठकर राष्ट्रहित में फैसला ले पाएगा अथवा नहीं। देश की एकता-अखंडता का प्रतीक राष्ट्रपति यदि आमसहमति से चुना जाए तो वही श्रेयस्कर है।

अच्छी शुरुआत

भारतीय रिजर्व बैंक (आरबीआई) ने देश के फंसे हुए कर्ज (एनपीए) से निपटने की दिशा में एक अहम शुरुआत की है। आरबीआई की ओर से गठित स्वतंत्र सलाहकार समिति ने मंगलवार को 12 गैर निष्पादित खातों को चुना जिनका निपटारा इन्सॉल्वेंसी ऐंड बैंक्रप्सी कोड (आईबीसी) के तहत किया जाना है। चुने गए खाते एक साथ मिलाकर देश के एनपीए में से 25 फीसदी के लिए जिम्मेदार हैं और अब इनको आईबीसी के नए प्रावधानों के मुताबिक निस्तारित किया जाएगा। यह एक स्वागतयोग्य कदम है और इसकी गति भी काफी तेज रही है। आरबीआई को स्वतंत्र समिति बनाने का अधिकार मिलने के करीब एक महीने में इतनी प्रगति हुई है। अभी यह स्पष्टï नहीं हैं कि कौन-कौन से खाते चुने गए हैं लेकिन आरबीआई का कहना है कि उसने इसके लिए कुछ सामान्य सिद्घांतों का पालन किया। इसके तहत करीब एक साल से अधिक समय से 60 फीसदी गैर निष्पादित संपत्ति वाले खातों को फंसे हुए कर्ज में गिना गया। ऐसे में मनमानेपन का आरोप लगाना आसान नहीं होगा। अब अहम बात यह है एक बार निर्णय हो जाने के बाद इस दिशा में सहज ढंग से आगे बढ़ा जाए। लेकिन कई चुनौतियां ऐसी भी हैं जिनसे मौजूदा कदमों के परिणाम आने के पहले ही निपटना होगा। आईबीसी का अभी तक परीक्षण नहीं हुआ है। कई लोग इस बात को लेकर शंकालु हैं कि यह बड़े पैमाने पर होने वाले ऐसे निस्तारण के लिए उपयुक्त भी है या नहीं । खासतौर पर यह देखते हुए कि इस कानून में समयसीमा काफी सख्त है। अब जबकि समिति ने कुछ खातों और संबद्घ परिसंपत्तियों को चुन लिया है तो अगले चरण में बैंकों को राष्टï्रीय कंपनी कानून पंचाट (एनसीएलटी) से संपर्क करना चाहिए। यह एक पेशेवर का चयन करेगी जो संबंधित परिसंपत्तियों का प्रबंधन करेगा। समस्या यह है कि इस अहम समय में नए महत्त्वाकांक्षी दिवालिया कानून के लिए उपयुक्त बुनियादी ढांचा ही नहीं तैयार हो सका है। ऐसे में जिन विभिन्न पंचाटों को इस कानून का प्रवर्तन करना है उनके लिए अत्यंत कठिन समय आ गया है। इसके अलावा इस काम के लिए प्रशिक्षित पेशेवरों की आवश्यकता भी उतनी ही अहम है। यह बात ध्यान देने लायक है कि छोटे खातों के मामले में आईबीसी के सफल क्रियान्वयन का कोई उदाहरण भी हमारे सामने नहीं है।

दुर्भाग्यवश फिलहाल आईबीसी के अधीन जिन परिसंपत्तियों पर काम हो रहा है वे अब तक निस्तारण के चरण को ही पास नहीं कर सके हैं। इनमें से अधिकांश मामले न्यायालयों में उलझे हुए हैं। इनमें सवाल संहिता की व्याख्या से जुड़ा हुआ है। कहने का तात्पर्य यह है कि नई व्यवस्था की क्षमताएं अब तक सामने नहीं आ सकी हैं। इसके अलावा विभिन्न वादों के परिणामस्वरूप और उसकी व्याख्या को लेकर उठे कानूनी प्रश्नों के चलते कई निस्तारण पेशेवर तत्काल इसके साथ जुडऩे से भी बच रहे हैं। वे आदर्श स्थिति में यही चाहेंगे कि पहले कानूनी मामले निपट जाएं। कोई भी नहीं चाहता कि पेशेवर सेवाएं देते वक्त सदिच्छा के साथ उठाए गए कदमों के लिए उसे अदालत में खड़ा होना पड़े। सरकार और कानून व्यवस्था को यह सुनिश्चित करने के लिए काफी मेहनत करनी होगी कि फंसे हुए कर्ज से निपटने की क्षमता विकसित की जा सके। परिसंपत्तियों की बिक्री की मूल्य निर्धारण प्रक्रिया भी चुनौतीपूर्ण होगी क्योंकि फिलहाल कारोबारी आत्मविश्वास डांवाडोल है और यह भी निश्चित नहीं है कि बैंक जरूरत के मुताबिक बड़ी कटौती के लिए तैयार हैं या नहीं। इनमें सबसे अहम है निगरानी समिति की स्वतंत्रता, उसका अधिकार संपन्न होना और उसका पृथक्करण। ये सारी बातें इसलिए अहम हैं क्योंकि कटौती का स्वरूप तय करने का महती काम उसके पास होगा।

मर्ज के बजाय लक्षण का उपचार

बीमारी पता हो और उसका इलाज भी, फिर भी बीमारी बनी रहे तो इसे क्या कहेंगे? अपने देश में किसानों और खेतीबाड़ी के साथ यही हो रहा है। पिछले सात दशक से किसान को इंतजार है ऐसी सरकार का जो उसके मर्ज का इलाज करे, लक्षण का नहीं। समस्या इतनी सी है कि किसान फसल उपजाने के लिए जितना खर्च करता है उसे बेचकर उतना भी नहीं कमा पाता। सरकारों का आलम यह है कि सिर ढ़ंकती हैं तो पैर निकल आता है। हरित क्रांति आई तो देश अनाज के मामले में आत्मनिर्भर हो गया। अब दूसरी हरित क्रांति की बात हो रही है। वह भी आ जाएगी पर किसान भूखा रहे, आत्महत्या करे या गोली खाए, यही उसका प्रारब्ध बन गया है। खेती घाटे का सौदा बन गई है। किसान खेती छोड़ना चाहता है, पर छूट नहीं रही, क्योंकि और कोई विकल्प नहीं है। उसे मुनाफे में लाने के लिए फूड प्रोसेसिंग को युद्ध स्तर पर बढ़ावा देने के अलावा कोई रास्ता नहीं है।
अपने देश की अर्थव्यवस्था में तरह-तरह के विरोधाभास हैं। किसान अपनी उपज बढ़ाता है तो सूखे या किसी प्राकृतिक आपदा के समय से भी ज्यादा दुर्गति को प्राप्त होता है। प्राकृतिक आपदा से उसके बचाव के लिए अब एक कारगर प्रधानमंत्री फसल बीमा योजना है पर ज्यादा उपज से निपटने का न तो उसके पास कोई उपाय है और न ही सरकार के पास। सरकार समर्थन मूल्य तो बढ़ा देती है, पर किसान की पूरी उपज खरीदने का उसके पास साधन नहीं है। ज्यादा उपज के समय निर्यात पर प्रतिबंध और स्टॉक लिमिट हटने में समय लगता है। स्टॉक लिमिट बनी रहने से निजी व्यापारी ज्यादा खरीद नहीं पाता और सरकार के पास भंडारण की क्षमता नहीं है इसलिए मारा किसान जाता है। मध्य प्रदेश और महाराष्ट्र का ताजा आंदोलन इसी का नतीजा है। इस मर्ज का इलाज करने के लिए जो कदम उठाया जाता है वह कोढ़ में खाज का काम करता है। राजनीतिक दलों को इससे निकलने का सबसे आसान रास्ता नजर आता है किसानों की कर्ज माफी। किसान भी यह समझने को तैयार नहीं हैं कि यह कर्ज माफी उन्हें जीवन नहीं देती, सिर्फ मौत की तारीख टाल देती है। उत्तर प्रदेश विधानसभा चुनाव से पहले राज्य में किसानों के कर्ज माफ करने का वादा करके भाजपा ने इस जिन्न को फिर से बोतल से निकाल दिया है। उत्तर प्रदेश में सरकार बनने और कर्ज माफी की घोषणा के साथ ही महाराष्ट्र में भी ऐसी मांग उठी और सरकार को मानना पड़ा। यह आग धीरे-धीरे फैल रही है। मध्य प्रदेश के मंदसौर और आस-पास के इलाकों में जो हुआ वह भारतीय कृषि की एक दूसरी समस्या है, लेकिन वहां भी कर्ज माफी की मांग हो रही है।
मध्य प्रदेश देश का इकलौता राज्य है जहां पिछले दस साल से कृषि विकास की दर दहाई के आंकड़े में है। इसके बावजूद किसान आंदोलित है। मध्य प्रदेश की समस्या पिछले सत्तर सालों में किसानों को लेकर होने वाली राजनीति का ज्वलंत उदाहरण है। देश की सबसे बड़ी विपक्षी पार्टी के नेता राहुल गांधी किसानों की समस्या का एक ही हल जानते हैं और वह है कर्ज माफी। इससे पता चलता है कि उन्हें किसानों और कृषि क्षेत्र की समस्या की कोई समझ नहीं है। उन्होंने कभी यह सोचने की जरूरत नहीं समझी कि 2008 में हुई कर्ज माफी का किसान की हालत पर क्या असर पड़ा? मध्य प्रदेश की समस्या कृषि क्षेत्र के बारे में प्रशासनिक अव्यवस्था का भी उदाहरण है। सरकार ने अरहर की दाल का समर्थन मूल्य बढ़ाकर पांच हजार पचास
रुपये कर दिया। इसके साथ ही मोजांबिक से भी दाल आयात कर ली। नतीजा यह हुआ कि बाजार में भाव गिर गया। समर्थन मूल्य पर
कोई खरीदने को तैयार नहीं था। किसानों ने शिकायत की तो सरकार ने घोषणा कर दी कि समर्थन मूल्य से कम पर खरीदना गैर कानूनी होगा। व्यापारियों ने खरीदना बंद कर दिया, किसान और कठिनाई में फंस गया। न सरकार खरीद रही थी और न व्यापारी।
अपने देश में फूड प्रोसेसिंग की हालत नौ दिन चले अढ़ाई कोस जैसी है। देश में कोल्ड स्टोरेज की हालत अच्छी नहीं है। 2007 में केंद्र सरकार ने कोल्ड चेन के विकास की स्थिति और सुधार के उपाय सुझाने के लिए टास्क फोर्स का गठन किया था। उसके मुताबिक देश के अस्सी फीसदी कोल्ड स्टोरेज सिर्फ आलू रखने के काम आते हैं। देश के नब्बे फीसदी कोल्ड स्टोरेज अमोनिया रेफ्रिजरेशन की पुरानी तकनीक से चलते हैं। जो कोल्ड स्टोरेज हैं भी उनके लिए प्रशिक्षित लोगों की भारी कमी है। एक तरफ जरूरत बहुत है, पर प्रशिक्षित लोगों की उपलब्धता नहीं है।

यह स्थिति कौशल विकास मंत्रालय बनने के बाद है। इसका सीधा सा अर्थ यह है कि कौशल विकास मंत्रालय और खाद्य प्रसंस्करण मंत्रालय में कोई तालमेल नहीं है। देश में डिब्बा बंद खाद्य पदार्थ का उपभोग सालाना प्रति व्यक्ति केवल 24 किलो है। विकसित देशों में कुल कृषि उपज का 90 फीसद पैकेज्ड होता है। अपने देश में यह अनुपात छह फीसदी है। एक आकलन के मुताबिक यदि देश की कुल कृषि उपज का साठ फीसदी डिब्बा बंद होने लगे तो किसानों की आय दुगना हो जाएगी। किसानों की समस्या के फौरी हल में सरकारें हमेशा किसान की बजाय उपभोक्ता के हितों को तरजीह देती हैं। किसी कृषि उपज का दाम बढ़ जाता है तो देश भर में हल्ला हो जाता है और सरकार भी सक्रिय हो जाती है। अगर किसान की उपज का दाम गिर जाए तो उससे किसान को ही निपटना पड़ता है। किसान चाहता है कि सरकार उसे इस अनिश्चितता और असुरक्षा के माहौल से मुक्ति दिलाए। कर्ज माफी से किसान की समस्या का कोई स्थाई समाधान होता नहीं, उलटे बैंकिंग व्यवस्था पर बुरी मार पड़ती है। इसका खामियाजा पूरी अर्थव्यवस्था को भुगतना पड़ता है। कर्ज माफी की इस संस्कृति ने नए तरह के बिचौलियों को जन्म दिया है जो किसानों को कर्ज दिलाने का ही धंधा करते हैं-इस आश्वासन के साथ कि यह नहीं तो अगली सरकार कर्ज माफ कर देगी।किसानों की स्थिति सुधारना है तो सरकार को एग्रो इंडस्ट्री क्षेत्र में कुछ बड़े कदम उठाने होंगे। 2016-17 के केंद्रीय बजट में सरकार ने इस क्षेत्र में ऑटोमेटिक रूट से सौ फीसद विदेशी निवेश की इजाजत दे दी है, लेकिन जब तक सरकारी और निजी (देश का) निवेश नहीं बढता, स्थिति में कोई बड़ा बदलाव होना मुश्किल है। समस्या यह है कि जितने लोग कृषि पर निर्भर हैं उनका बोझ उठाने की क्षमता कृषि क्षेत्र में नहीं है। इसलिए बड़े पैमाने पर किसानों को वैकल्पिक रोजगार के अवसर उपलब्ध कराने होंगे। राजनीतिक दबाव में कर्ज माफी के जरिये समस्या को टालने की एक सीमा है और नुकसान भी। अब तक जितना पैसा कर्ज माफी में गया है उतना कृषि क्षेत्र में बुनियादी ढांचा खड़ा करने में लगता तो आज किसान की हालत बेहतर होती। किसान का उद्धार कर्जमाफी से नहीं कर्ज लौटा सकने योग्य बनाने से होगा।

नोटबंदी ने रखी नए भारत की नींव

सकल घरेलू उत्पाद यानी जीडीपी के ताजा आंकड़े सामने आने के बाद नोटबंदी के आलोचक फिर से मुखर हुए और उन्होंने जीडीपी की रफ्तार सुस्त पड़ने के लिए नोटबंदी को जिम्मेदार ठहराया। ध्यान रहे कि इन आलोचकों ने नोटबंदी के फैसले को भी गलत ठहराया था। पिछले साल नवंबर में प्रधानमंत्री नरेंद्र मोदी ने जब इसका एलान किया था तो पूरा देश सन्न रह गया था। जिस देश में 96 फीसद लेनदेन नकदी में होता हो वहां वित्तीय तंत्र में मौजूद 86 प्रतिशत नकदी को एकाएक अमान्य घोषित कर देने से अर्थव्यवस्था लकवे की शिकार हो सकती थी तो हंगामे और सामाजिक असंतोष के आसार भी बन सकते थे। हालांकि नोटबंदी के शुरुआती दिनों में बैंकों और एटीएम के बाहर जरूर अंतहीन कतारें देखी गईं, लेकिन किसी तरह की आपाधापी और सामाजिक असंतोष देखने को नहीं मिला। विपक्षी दलों ने इसके खिलाफ हवा बनाने की भरसक कोशिशें कीं, लेकिन उनकी हर तिकड़म नाकाम ही हुई। दुनिया भर के अर्थशास्त्री और खासतौर से भारत में अर्थशास्त्रियों ने नोटबंदी की आलोचना करते हुए उसे अर्थव्यवस्था के लिए विध्वंसक तक बताया। यहां तक कि पूर्व प्रधानमंत्री और ख्यातिप्राप्त अर्थशास्त्री डॉ. मनमोहन सिंह ने संसद में इसे ‘ऐतिहासिक कुप्रबंधन’ से लेकर ‘संगठित लूट’ तक करार दिया। वैश्विक स्तर पर जानी जाने वाली पत्रिका ‘द इकॉनमिस्ट’ ने लिखा कि ‘नोटबंदी अर्थव्यवस्था के सबसे अहम नीतिगत माध्यम यानी उसके धन पर नियंत्रण के दुरुपयोग की आंखें खोल देने वाली दास्तान है।’ इसी तरह ‘द वॉल स्ट्रीट जर्नल’ में लिखा गया कि नकदी पर चोट करने के बुरे असर ने नरेंद्र मोदी की साख पर जबरदस्त बट्टा लगाया है।
हालांकि मेरे जैसे कुछ लोगों का मानना था कि कुछ समय के लिए परेशानियां पैदा करने के बावजूद भविष्य में यह फैसला सुखद रूप से फलदायी होगा। असल में यह प्रधानमंत्री मोदी का ही करिश्मा था जिसकी वजह से लोगों का गुस्सा कम से कम फूटा। उनकी संवाद शैली, लोगों से जुड़ने में महारत, प्रबंधन में भागीरथ प्रयास और समन्वय के साथ योजनाओं के क्रियान्वयन ने असुविधा को कम करने के साथ ही आम लोगों में सकारात्मक भाव बनाए रखा। मीडिया खासतौर से इलेक्ट्रॉनिक मीडिया के लोग नोटबंदी के आलोचकों को आवाज देने में बेहद मुखर रहे, लेकिन उन्हें निराशा ही हाथ लगी, क्योंकि देश भर में आम आदमी के रूप में उन्हें इसके समर्थक ही मिले। उत्तर प्रदेश के चुनावी नतीजे इस फैसले पर जनता की मुहर लगाने वाले साबित हुए जिससे नेता के तौर पर नरेंद्र मोदी का कद और भी ज्यादा ऊंचा हो गया। नए नोटों की तेजी से आवक और एटीएम मशीनों को शीघ्रता के साथ नए नोटों के अनुरूप बनाने से लोगों की तकलीफें और अर्थव्यवस्था की दुश्वारियां कम हुईं। इससे कश्मीर में पत्थरबाजी और नक्सली गतिविधियों पर कुछ समय के लिए अंकुश भी लगा और नकली नोटों की बीमारी भी दूर हो गई। लघु अवधि में होने वाले फायदों और अर्थव्यवस्था पर उनके दीर्घावधिक संभावित प्रभावों के संकेतों ने असर दिखाना भी शुरू कर दिया है। भारत का डिजिटलीकरण तेज रफ्तार के साथ हो रहा है। कार्ड के जरिये लेनदेन को अंजाम देने वाली पीओएस मशीनों की बिक्री में तेजी आई है। मौद्रिक लेनदेन महज एक क्लिक की बात रह गई है। बैंकिंग सेवाओं का कायाकल्प साफतौर पर देखा जा सकता है। प्रत्यक्ष कर संग्र्रह पिछले साल की तुलना में 17 प्रतिशत बढ़कर 1.46 लाख करोड़ रुपये के स्तर पर पहुंच गया। आयकरदाताओं की तादाद में भी खासा इजाफा हुआ। नोटबंदी के बाद आइटी रिटर्न की ई-फाइलिंग में भी 22 प्रतिशत की बढ़ोतरी हुई। केंद्रीय प्रत्यक्ष कर बोर्ड के प्रमुख ने बताया कि ‘ऑपरेशन क्लीन मनी’ के तहत पहले चरण में 18 लाख लोगों को चिन्हित किया गया है। इसमें करीब 1.73 लाख करोड़ रुपये की राशि दांव पर लगी है। दूसरे और तीसरे चरण के लिए भी तमाम लोगों को निगरानी के दायरे मे लाया जा रहा है।
नोटबंदी के बाद से ही रोजाना एक से दो लाख नए पैन नंबर जारी किए जा रहे हैं और पैन धारकों की कुल तादाद 30 करोड़ के भारी आंकड़े को पार कर गई है। काले धन का भी बड़े पैमाने पर भंडाफोड़ हुआ है। लगता है कि ऑपरेशन क्लीन मनी को खुली छूट दे दी गई है और यह काले धन वाली अर्थव्यवस्था पर तगड़ी चोट कर उसका दायरा सिकोड़ने जा रहा है। नोटबंदी के कई ऐसे फायदे होंगे जिनका असर कुछ समय के बाद नजर आएगा। भारतीय अर्थव्यवस्था दिनोंदिन अधिक इलेक्ट्रॉनिक बनती जा रही है। कर अनुपालन की राह आसान बन रही है। राजस्व संग्र्रह में बढ़ोतरी के साथ ही जीडीपी के अनुपात में कर दायरा भी बढ़ता जा रहा है। इनसे अर्थव्यवस्था को बहुत फायदा पहुंचेगा और देश को तेज आर्थिक विकास की राह पर उन्मुख किया जा सकेगा। खासतौर से भौतिक एवं सामाजिक बुनियादी ढांचे का व्यापक स्तर पर निर्माण होगा जिसमें सबसे खास बात यही होगी कि यह सब कर्ज लिए बिना या करों की दर में बढ़ोतरी के बगैर ही किया जा सकेगा।
नकद लेनदेन की लागत काफी ऊंची आती है। इलेक्ट्रॉनिक मुद्रा के अधिकाधिक प्रयोग से इसकी लागत घटने के साथ ही अर्थव्यवस्था और प्रभावी एवं सक्षम बनेगी। इसके साथ ही अगर जीएसटी के क्रियान्वयन को भी जोड़ लें तो भारत 10 प्रतिशत की वृद्धि के अगले दौर में दाखिल हो सकता है। देश की आने वाली पीढ़ियां नोटबंदी से होने वाले फायदों की फसल काटेंगी। यह निश्चित रूप से बेबाक और साहसिक फैसला था जिसे कोई मजबूत नेता ही ले सकता था। इस पर प्रधानमंत्री को भी लगा होगा कि यह राजनीतिक तौर पर उनके लिए नुकसानदेह भी साबित हो सकता है। फिर भी उन्होंने फैसला लेने की दिलेरी दिखाई। इतिहास आकलन करेगा कि एक नेता ने देश और आने वाली पीढ़ियों के फायदे के लिए अपनी राजनीतिक पूंजी को दांव पर लगाने से भी गुरेज नहीं किया। दूसरी ओर आलोचक वही पुराना राग अलापते हुए इसकी वजह से हुई कुछ परेशानियों का ही करुण रुदन करते रहेंगे। बहरहाल अभिव्यक्ति की आजादी और जीवंत लोकतंत्र की मेहरबानी से वे ऐसा करने के लिए स्वतंत्र भी हैं, लेकिन देश को इस साहसिक फैसले के फायदों का लुत्फ उठाना चाहिए।

Leaning On The Law

Rules regulating animal livestock markets are legally and constitutionally sound

 Constitutional evaluation of laws is tricky business. It stands in stark contrast to terming a law or rule as being desirable or undesirable, though it is possible that an undesirable law is also unconstitutional. Merely because a law is inconvenient or results in hardship to some, cannot be the same as saying that the law is constitutionally abhorrent. For that, the law or rule must necessarily surpass the prohibitions embedded in the Constitution itself, or in the case of statutory rules or regulations, go beyond the rule-making power. It is with this spectacle that one must view the Government’s attempt to regulate animal livestock markets.

Parliament enacted the Prevention of Cruelty to Animals Act, 1960, Section 38 whereof empowers the Central Government alone to make rules. The Government notified the Rules last month for constituting and regulating animal markets for transacting sale and purchase of animals without subjecting them to cruelty. Rule 22, which has attracted the most controversy, requires certain measures for ensuring that in animal markets, cattle are transacted for agricultural purposes only, and not for slaughter. The other provisions in these rules constitute Animal Market Committees and lay down several measures for preventing cruelty to animals. It is evident that the purpose of these rules is to free animal markets of transactions which would result in animals being treated cruelly, and the prohibition of cattle slaughter is incidental to that purpose.

The primary objection against these rules is that they violate the right of butchers to practise their trade and occupation freely [Article 19(1)(g)]. It is now an established position that even though Directive Principles are themselves not enforceable by courts, yet Fundamental Rights are to be read in such a manner that the Directive Principles do not remain mere empty declarations. One of the Gandhian principles embodied in Article 48 directs future Governments “to endeavour to…take steps for preserving and improving the breeds, and prohibiting the slaughter of cows and calves and the other milch and drought cattle”. In the same vein, Article 47 requires “…the State…to…endeavour to bring about prohibition of the consumption except for medicinal purposes of intoxicating drinks and of drugs which are injurious to health”, and liquor prohibition has consequently been upheld by treating liquor trade as res extra commercium [not only held by our Supreme Court in Khoday Distilleries v. State of Karnataka, (1995) 1 SCC 574, but also by the American Supreme Court more than a century ago in Crowley v. Christensen, (1890) 137 US 86].

The question of whether slaughter of milch cattle could be prohibited in its entirety, took nearly half a century to be settled. While in the fifties, the Supreme Court in Mohd. Hanif Qureshi v. State of Bihar [AIR 1958 SC 731] rejected the argument that religious freedom was hindered on account of such prohibition, although it did hold that the prohibition to slaughter even those animals ceasing to be capable of yielding milk or of breeding or working as draught animals, was unjustified as it run foul of the butcher’s right to freedom of trade and occupation under Article 19(1)(g). A larger seven-Judge Bench of the Supreme Court revisited this reasoning and overruling it, held in State of Gujarat v. Mirzapur Moti Kureshi [(2005) 8 SCC 534] that bovine animals did not become useless on their ceasing to be capable of yielding milk or of breeding or working as draught animals. Relying on Directive Principles to hold these restrictions as being reasonable and in public interest, thus saved by Article 19(6), the Court further held that economically, bovine animals can never be useless on account of the value and utility of their dung and urine. Finally, the Court struck a chord of compassion towards animals and reasoned that cruelty to any living creature must be curbed and desisted.The contention based on the fundamental right to religion under Article 25 even in respect of cow protection laws has been categorically rejected throughout in all these judgments. It is thus specious to say that the 2017 Rules are violative of any fundamental rights.

Our Constitution envisages a distribution of powers that leans in favour of the Union – the most obvious evidence of this being that the Union has the residuary legislative power (Article 248 read with Entry 97, List I of Schedule VII). The Supreme Court has consistently afforded wide amplitude to this residuary entry, thus reaffirming the Centre-leaning legislative scheme [Union of India v. Harbhajan Singh Dhillon, (1971) 2 SCC 779].

The law under which the rules have been notified is the Prevention of Cruelty to Animals Act, 1960, is a Central law and falls squarely within the Concurrent List entry of ‘prevention of cruelty to animals’ [Entry 17, List III]. The argument breaching federalism is clearly fallacious as List II of Schedule VII reveals that no entry can be connected with prohibition of animal slaughter so as to vest exclusive power in the State legislature or executive. For instance, Entry 15 of the State List provides “preservation, protection and improvement of stock and prevention of animal disease; veterinary training and practice”, but that is neither the purpose of the Act nor of the rules – the purpose being to prevent cruelty to animals, and not to improve animal stock or prevent animal disease. Similarly, Entry 28 of State List relating to “markets and fairs” cannot also be marshaled since the pith and substance of the 2017 Rules is to prevent cruelty to animals, and regulation of animal markets is incidental and consequential.

It is thus difficult to say that the 2017 Rules do not meet constitutional muster. The hue and cry on the validity of these rules is on account of the conflation of desirability and legality. Rule of law requires that the legal examination of these rules, albeit challenging, insulate itself from the din of propriety and desirability surrounding these rules.

Big data, big dangers

India needs to negotiate the world of big data technology with adequate safeguards

With the Supreme Court turning its gaze on privacy issues associated with Aadhaar, can we take a moment to look to the myriad ways in which our privacy is being assaulted in the digital world? When my neighbour across the street got too curious about my life, I installed curtains to block his gaze. But what about when the invisible drones at Facebook send him a message that one of my colleagues has tagged me enjoying a music festival in Goa and he might want to “like” this picture? How do we draw a curtain around our digital lives?

Think beyond the nosy neighbour to the corporations that want to utilise minutia of your life to sell products that you may or may not need. Corporations have always been interested in understanding consumer behaviour and been collecting data about users using their products or service. What is unique about Big Data Technology (BDT) is the scale at which this data collection can take place. For instance, Google has stored petabytes of information about billions of people and their online browsing habits. Similarly, Facebook and Amazon have collected information about social networks. In addition to using this data to improve products or services that these corporations offer, the stored data is available also to highest bidders and governments of nations where these companies are based.

 Looming dangers

One major problem with collecting and storing such vast amounts of data overseas is the ability of owners of such data stores to violate the privacy of people. Even if the primary collectors of data may not engage in this behaviour, foreign governments or rogue multinationals could clandestinely access these vast pools of personal data in order to affect policies of a nation. Such knowledge could prove toxic and detrimental in the hands of unscrupulous elements or hostile foreign governments. The alleged Russian interference in the U.S. election tells us that these possibilities are not simply science fiction fantasies.

The other major problem is the potential drain of economic wealth of a nation. Currently, the corporations collecting such vast amounts of data are all based in developed countries, mostly in the U.S. Most emerging economies, including India, have neither the knowledge nor the favourable environment for businesses that collect data on such a vast scale. The advertising revenue that is currently earned by local newspapers or other media companies would eventually start to flow outside the country to overseas multinationals. A measure of this effect can already be seen in a way that consumer dollars are being redistributed across the spectrum of U.S. businesses touching them. For instance, communication carriers such as AT&T, Verizon and cable networks find that their revenue has remained flat to slightly falling in the last five years whereas the revenues of Google, which depend on these carriers to provide connectivity to consumers, are increasing exponentially. Unless we employ some countermeasures, we should expect the same phenomenon repeat itself for corporations based in India.

Sadly, BDT is a tiger the world is destined to ride. It is no longer possible to safely disembark, but staying on is not without its perils. The only way to negotiate this brave new world is to make sure that India does it on her own terms and finds a way to protect both financial rewards and ensure individual privacy and national security through appropriate safeguards.

 What India can do

China has apparently understood this dynamic and taken measures to counter this threat. It has encouraged the formation of large Internet companies such as Baidu and Alibaba and deterred Google and others from having major market share in China by using informal trade restraints and anti-monopoly rules against them. India may not be able to emulate China in this way, but we could take other countermeasures to preserve our digital economy independence. The heart of building companies using BDT is their ability to build sophisticated super-large data centres. By providing appropriate subsidies such as cheap power and real estate, and cheap network bandwidth to those data centres, one would encourage our industries to be able to build and retain data within our boundaries. In the short term, we should also create a policy framework that encourages overseas multinationals such as Google and Amazon to build large data centres in India and to retain the bulk of raw data collected in India within our national geographical boundaries.

Moreover, we should also build research and development activities in Big Data Science and data centre technology at our academic and research institutions that allow for better understanding of the way in which BDT can be limited to reduce the risk of deductive disclosure at an individual level. This will require developing software and training for individuals on how to protect their privacy and for organisations and government officials to put in place strict firewalls, data backup and secure erasure procedures. In the West, we already are seeing a number of start-ups developing technology that enables users to control who gets access to the data about their behaviour patterns in the digital world.

The government has approved the “Digital India” Plan that aims to connect 2.5 lakh villages to the Internet by 2019 and to bring Wi-Fi access to 2.5 lakh schools, all universities and public places in major cities and major tourist centres. This is indeed a very desirable policy step. But unless we evolve appropriate policies to counter the side effects of the Digital Plan, this could also lead to the unforeseen eColonisation of India.
