Multi-agency investigation into tax havens is the right step. Global clean-up should continue

The latest data dump, dubbed Pandora Papers, on offshore accounts in tax havens by a consortium of journalists, has catalysed GoI to set up a multi-agency body to oversee investigations into potential tax evasion by Indians. This is the third major leak in five years of confidential data of intermediaries who organise these accounts for clients. The leaks have been used to check for possible tax evasion and the last two have resulted in detection of undisclosed income of Rs 20,352 crore, according to GoI.

For sure, all offshore accounts are not illegal. The larger issue here is the ecosystem that allows intermediaries to help clients use the banking network to conceal income in tax havens and thereby evade taxes. Tax havens are characterised by negligible or zero tax rates and a system of secrecy that conceals a firm’s beneficial owner, or the natural person behind a legal or tax arrangement. It’s the secrecy that causes problems for other countries. The pushback against it came on the heels of the 2008 global financial crisis. In 2009, G20 leaders pledged to root out banking secrecy. Later, in 2013 the foundation was laid for common reporting standards that led to an automatic exchange of information between countries and information sharing on request.

The goal behind the apparatus is to ensure that beneficial owners cannot hide behind layered structures designed to conceal their identity. This goal is being pursued through multiple fora, including the FATF. Consequently, two structures used to conceal beneficial ownership, nominee shareholding and bearer shares, have been phased out in many countries. In this context, it’s relevant to note that India’s electoral bonds are bearer bonds which carry the same set of risks as they provide complete anonymity to the donor. Supreme Court should decide on their constitutionality at the earliest.

As the Pandora Papers show, there’s still a long way to go before the ecosystem that allows concealment of beneficial ownership can be dismantled. The G20 finance ministers meeting in July reiterated that the body will pursue this aim. Separately, FATF is working on a recommendation to sharpen this focus to curb money laundering and terror financing. Nudging tax havens to synchronise their laws with others requires a bigger effort from the world’s largest economy, the US. The optics here are unflattering following the leak of Pandora Papers. The US itself hosts some of the most secretive financial havens, South Dakota and Delaware. The clean-up should start there.

With AUKUS, India must keep its head above water

The security grouping spells opportunities but also possible unique challenges which New Delhi can ill-afford to ignore

The announcement by the United States of a trilateral ‘enhanced security partnership’ involving Australia, the United Kingdom and the United States (AUKUS) has taken everyone by surprise, competitors and allies alike. With close partners on both sides, India has maintained an ambiguous stand on the issue. A lot of commentary since has talked of how this is a welcome step for India to access technologies, build complementarities and so on. While it does present opportunities, the flip side is that AUKUS represents a threshold breach and could pose unique challenges for India, depending on how China responds to it, and the issue spiralling.

A different game now

The decision by the U.S. to make a very rare exemption, even for its allies, to supply nuclear-powered attack submarines (SSN) takes the whole issue of arms transfers and containing China’s expansion to a new level. Submarines are the most potent and secretive military platform to asymmetrically counter an adversary and an SSN represents the pinnacle. The entry barrier for acquiring these is very steep, proven by how few countries possess them; and once that is breached, there is no technological leap to counter it but only incremental measures to negate it, which would nonetheless be another expensive endeavour.

The U.S. has now set a precedence to this and how it unfolds and how long it remains an exception has to be seen. The next question is how will China, which has sharply reacted to the announcement of AUKUS, respond to this? Will it resort to further proliferation, in any manner, as it has done in the past, and likely involving its closest partner, Pakistan?

If so, the only country in the region which will face the real implications of this is India; for the others, it is more of stated positions and rules-based order which are a matter of convenience and not of survival. The whole Pakistani missile and nuclear weapons programme and its proliferation trail are proof of it.

Data leak

The China threat notwithstanding, this development is as much, if not more, about the tussle between arms industries of the two sides which collectively dominate the global arms industry. A case in point is the leak, in 2016, of 22,000 pages of secret data on the capabilities of six Scorpene submarines being built for the Indian Navy by the French Naval Group (then DCNS) barely months after DCNS was declared the winner in the Australian tender, only to be thwarted by the U.S. five years later.

While the real intention (of the leak) and those responsible may never be known, the fallout, though likely coincidental, was on India. The Naval Group had then said that it may have been the victim of “economic warfare.”

India’s stand, China factor

Another tangent that needs to be observed as the initiative takes shape is whether AUKUS is an attempt by the U.S. to position Australia as a ‘Net Security Provider’ in the Indo-Pacific. This is especially so given India’s reluctance to add a military dimension to the Quadrilateral grouping comprising India, Australia, Japan and the U.S.

The Quad — as a grouping of major democracies in the Indo-Pacific — has seen momentum in terms of engagement in the last two years especially in the backdrop of a violent stand-off between India and China along the disputed boundary in Eastern Ladakh last year which is yet to be resolved. However, India has reiterated on several occasions that it sees the Quad as a platform for consultations at the political and diplomatic level but does not see a military dimension to it. So, with Australia and Japan being U.S. allies, the limiting factor for deepening military engagement for the Quad as a grouping, beyond a point, is India.

Incidentally, the current Chief of the Naval Staff, Admiral Karambir Singh, since he assumed charge of the force in May 2019, had stated his reluctance in using the term ‘Net Security Provider’ and instead propagated the phrase, ‘Preferred Security Partner’.

Probably the best articulation of this was put forward in May 2018 by his predecessor and then Chief of the Naval Staff, Admiral Sunil Lanba, while delivering a talk at the Vivekananda International Foundation. Responding to questions, he stated that there were “dependencies” for group members on China and also the “uncertainty” of America when push comes to shove. He said, “So I don’t think there is [a] need for a military dimension to Quad… We are not going down that route. And I don’t think there is [a] need to go down that route.”

Admiral Lanba further said, “What do you think a military dimension will achieve? India is the only country in the Quad with a land border with China. In case of conflict… nobody will come and hold your hand.” The validation for this observation manifested itself in 2020 in the Himalayan ranges with a new normal now on the ground along the Line of Actual Control (LAC) and the trust between India and China along with the agreements that held it in tatters.

More recently, on several occasions External Affairs Minister S. Jaishankar, while terming the Quad as a platform that looks at the future, has also echoed similar views.

Speaking at the Raisina Dialogue in April, he categorically stated that Quad will not be an ‘Asian NATO’ and added that “people need to get over this….” He had also highlighted 10 broad subjects of cooperation including vaccine collaboration, climate action, emerging technologies, resilient supply chains, semiconductors, disinformation, counterterrorism and maritime security among others.

The Quad versus AUKUS

The outcome of the first ever in-person meeting of Quad leaders in the U.S. on September 24 only reinforces this trend. The Quad countries have outlined cooperation in several important areas including high technology; military cooperation and a mention of China were conspicuous in their absence. Essentially, the Quad is taking shape as an organisation of broader cooperation among the four countries, while AUKUS, for now, remains an organisation for high-end military trade. This only gives further credence that the U.S. may be preparing Australia for a greater military role in the Indo-Pacific.

Afghanistan has shown that New Delhi cannot depend on or tag along with anyone to protect its national interests. Given the surprise and setback India received with the sudden exit of the U.S., the country can ill-afford to lower its guard by taking AUKUS at face value. While working with AUKUS through other platforms and advancing its own strategic cooperation with each of the countries, India also needs to offset any fallout of the development which will only unfold in the long term.

The Met on the mat

A new culture of ethics, not deterrent punishments alone, can transform the conduct of the police

The Metropolitan Police of London are in the news for the wrong reasons. The gruesome murder of a teacher, Sabina Nessa (28), when she was walking through a park in south-east London to meet her friend at a pub, has caused outrage. The police have been accused of negligence yet again. An Albanian garage worker has been held as a suspect.

Diminishing trust in the police

According to the media, since the death of Sarah Everard, a 33-year-old marketing executive, in March this year, at least 81 women have been killed in the U.K. where the suspects are men. Many critics bemoan the fact that women are not being protected despite the Met being led by a woman Commissioner, Dame Cressida Dick.

What has added fuel to the fire is that a Met police officer, Wayne Couzens, was arrested for raping and murdering Everard. Couzens falsely arrested Everard on the charge of violating COVID-19 restrictions, forced her into a hired car, drove far away, raped her, strangled her and then burnt the body. Couzens had planned his barbaric crime for several weeks. Everard was a random target — a lone young woman negotiating a poorly lit area. It is appalling that despite being linked to two previous allegations of indecent exposure, Couzens had gone unpunished. This was culpable indifference on the part of senior officers. It is difficult to believe that this despicable behaviour had not been escalated to more senior officers.

One is reminded of the senseless deaths of a father and son in Sattankulam in Tamil Nadu. They were arrested allegedly for keeping their shop open and thus violating lockdown restrictions. They later died in hospital, after being tortured by the police in custody. The police in the U.S. have a similar inglorious record. One cannot forget how in May 2020, a black man, George Floyd, was pinned to the ground by three police officers in Minneapolis until he died of suffocation. His crime was that he had bought cigarettes with a counterfeit bill at a convenience store.

Two points emerge from these and other episodes, some of which are reported and many of which are buried stealthily. Police organisations in several parts of the world are not trusted for civilised and lawful behaviour. This is despite the many mechanisms that are in place that do not permit clandestine police actions against crime suspects. The numerous controls that have been established have not had the desired effect.

A few unscrupulous and overzealous policemen are responsible for this sorry situation. Blame sometimes also lies at the door of a few in the political executive who misuse their authority to settle personal scores with their adversaries. The judiciary has tried to set right this distortion in the criminal justice system, but success has been marginal. The Chief Justice of India recently gave expression to his misgivings on police conduct. But deterrent punishments are not the answer; only a new culture of ethics can bring about visible transformation. Bringing about such a change will take decades and requires enlightened police as well as political leadership. Merely upgrading police technology, such as compulsory body cameras on patrol policemen and video recording of police station proceedings, without a corresponding change in mindset will not be enough.

Perhaps most painful is the popular impression that women are easy prey to marauding policemen. It is unfortunate that the whole force gets a bad name because of a few deviants such as the senior officer in Tamil Nadu who is facing trial for sexual harassment of a female colleague. This is no justification, however, for showing any latitude to the police leadership or police officers.

A possible example for all chiefs

Met Commissioner Dick is a doughty warrior. She is the first woman to occupy this position. It is a travesty that a force headed by a distinguished woman officer is being accused of gender insensitivity. She has been facing calls to resign ever since the murder of Everard. But she has never shown inclination to step down. She apologised for the Met’s failure in recognising the danger posed by Couzens and said she would do everything in her power to ensure that the force has learned from “one of the most dreadful events” in its history. Her resolve to make London safer is impressive and could set an example for police chiefs everywhere.

Many good choices have been made in several Indian cities. Commissioners are being credited with striking innovations in the area of response to distress calls from the public, especially women and the elderly. The pursuit of speed and professionalism in this regard is a never-ending challenge. Enormous government funding for additional infrastructure — both manpower and technology — can help shape a sleek and humane police force. But only marginally.

भारत को पड़ोसी नीति पर गंभीर होना चाहिए

दिल्ली के ‘सेंटर फॉर पॉलिसी रिसर्च’ ने हमारी विदेश नीति पर गंभीर शोध-पत्र प्रकाशित किया है। इसे तैयार करनेवाले विशेषज्ञों में ऐसे लोग भी हैं, जो बरसों विदेश मंत्रालय का संचालन करते रहे हैं। उन्होंने इसमें विदेश नीति के कई पहलुओं का विश्लेषण कर उन्हें बेहतर बनाने के सुझाव दिए हैं। जिस पहलू पर मेरा ध्यान सबसे ज्यादा गया है, वह है- हमारी पड़ोसी नीति!

वे देश जो भारत के पड़ोस में हैं, उनमें दक्षेस (सार्क) के सभी 8 देश आ जाते हैं। भारत, अफगानिस्तान, पाकिस्तान, बांग्लादेश, नेपाल, श्रीलंका, भूटान और मालदीव इसके सदस्य हैं। जब 1985 में दक्षेस (दक्षिण एशियाई क्षेत्रीय सहयोग संगठन) बना, तब अफगानिस्तान इसका सदस्य नहीं था। मैं सोचता हूं कि म्यामांर और ईरान को भी इसका सदस्य बनाना चाहिए। सदियों से अराकान से खुरासान का यह इलाका आर्यावर्त्त के रूप में जाना जाता रहा है। दक्षिण एशिया का यह विशाल क्षेत्र आज भी सांस्कृतिक व आर्थिक दृष्टि से बड़े परिवार की तरह है।

दक्षिण एशिया के सभी देशों की आजादी के बावजूद यहां यूरोपीय संघ या आसियान की तरह कोई क्षेत्रीय संगठन बरसों तक नहीं बना, लेकिन 1985 में जब बांग्लादेश के राष्ट्रपति जिया-उर-रहमान ने पहल की तो भारत के लगभग सभी पड़ोसी देश सहमत हो गए, लेकिन भारत को पहले से अंदाज था कि भारत-पाक तनातनी इस संगठन का बड़ा सिरदर्द साबित हो सकता है। 2014 में जबसे पाकिस्तान इसका अध्यक्ष बना है, भारत ने इसके शिखर सम्मेलन में भाग ही नहीं लिया है। ‘सार्क’ के संविधान के मुताबिक शिखर सम्मेलन तब तक नहीं हो सकता, जब तक कि प्रत्येक सदस्य उसमें भाग न ले।

भारत को डर था कि इस संगठन का दुरुपयोग करने में पाकिस्तान कोई कसर नहीं छोड़ेगा। इसीलिए उसने इसके संविधान में यह प्रावधान करवा दिया था कि कोई भी सदस्य राष्ट्र इसमें द्विपक्षीय आपसी मामले नहीं उठाएगा। लेकिन द्विपक्षीय मतभेद के कारण ही अब दक्षेस लगभग निष्क्रिय हो गया है। यदि भारत ने दक्षेस के बदले अब पूर्व के सात देशों, बांग्लादेश, भूटान, भारत, नेपाल, श्रीलंका, म्यांमार और थाईलैंड को लेकर ‘बिम्सटेक’ संगठन खड़ा कर लिया है, तो पाकिस्तान ने डेढ़ साल में कोरोना के नाम पर चीन के साथ मिलकर पाकिस्तान, अफगानिस्तान, बांग्लादेश, नेपाल और श्रीलंका की चार बैठकें बुला ली हैं। ये सारे देश चीन के ‘रेशम महापथ’ के समर्थक हैं। इन्होंने मिलकर संकल्प लिया है कि दक्षिण एशिया में चीन की मदद से ये गरीबी-उन्मूलन व विकास कार्यक्रम चलाएंगे।

यदि भारतीय विदेश नीति इस वक्त सक्रियता नहीं दिखाएगी तो आशंका है कि ये देश मिलकर चीन को कहीं दक्षेस का सदस्य बनाने की पहले ही न कर डालें। यों भी चीन नेपाल में रेल की लाइन डालने और पेशावर-काबुल रेलवे बनाने का जिम्मा ले सकता है। पाकिस्तान जैसे कभी अमेरिका का दामन थामे था, आजकल चीन की नाक का बाल बना हुआ है। चीन आजकल काबुल में तालिबान की गड़बड़झाला सरकार को जो दिल खोलकर मदद दे रहा है, उसके पीछे चीन-पाक गठबंधन ही है। चीन ने ईरान पर भी गलबहियां डाल रखी हैं, क्योंकि परमाणु मुद्दे पर अमेरिका व ईरान के बीच अभी अविश्वास की खाई भरी नहीं है।

नेपाल और श्रीलंका पर चीन ने सिक्का जमा रखा है। भारत के ये पड़ोसी चीन के रेशम महापथ पर तो पहले से ही फिसले जा रहे हैं, इधर भारत के साथ इनके संबंधों में इसलिए भी ढीलापन आ गया है कि इन दोनों देशों में अमेरिका की मदद से बननेवाली सड़कों की योजना भी रद्द हो गई हैं। माना जा रहा है कि दोनों योजनाएं चीन-विरोधी हैं। अमेरिका के बढ़ते प्रभाव का अर्थ भारत की पकड़ का मजबूत होना लगाया जा रहा है। जहां तक म्यांमार का सवाल है, पिछले 20-25 वर्षों में चीन ने इस बौद्ध देश की अर्थव्यवस्था पर कब्जा-सा कर लिया है। इसके साथ उसका व्यापार 1.4 बिलियन डॉलर का है। चीन बर्मी तेल और गैस लाने के लिए रेल और पाइप लाइनें बिछा रहा है। वहां बिजली-उत्पादन के लिए अरबों रु. लगा रहा है।

दूसरे शब्दों में चीन की कोशिश है कि भारत को वह चारों तरफ से घेर ले। उसके सभी पड़ोसी चीन के चप्पू बन जाएं। चीन की यह रणनीति गलवान घाटी की मुठभेड़ से भी ज्यादा खतरनाक है। इसका मुकाबला करने के लिए ‘सेंटर फार पॉलिसी रिसर्च’ के शोधपत्र में कई सुझाव दिए गए हैं। उनमें से यह भी है कि पाकिस्तान से भारत बात शुरू करें। हमारी सरकार के अपने कुछ ठोस तर्क हो सकते हैं, इस रास्ते के विरुद्ध! लेकिन ऐसा है तो मैं समझता हूं कि यह बिल्कुल सही समय है जबकि भारत और पड़ोसी राष्ट्रों के प्रबुद्ध नागरिकों को मिलकर एक नए संगठन ‘जन-दक्षेस’ (पीपुल्स सार्क) की स्थापना करनी चाहिए।

कड़ा रुख

सुप्रीम कोर्ट ने चालीस-चालीस मंजिला दो इमारतों को गिराने के मामले में सुपरटेक को कोई राहत नहीं देकर अपने कड़े रुख को साफ कर दिया है। सर्वोच्च अदालत ने तीस नवंबर तक इन दोनों इमारतों को गिराने का आदेश दे रखा है। नोएडा प्राधिकरण इसकी तैयारी भी कर रहा है। लेकिन भवन निर्माता ने एक बार फिर अदालत का दरवाजा खटखटाया और इमारतों को गिराने के आदेश में संशोधन कर राहत मांगी। पर अदालत ने उसकी याचिका खारिज कर दी। इससे यह साफ हो गया कि भवन निर्माताओं की मनमानी पर लगाम लगाने के लिए सुप्रीम कोर्ट सख्त फैसले लेने और उन्हें लागू करने में कोई रियायत नहीं बरतने वाला। उसकी नजर में उपभोक्ताओं का हित सर्वोपरि है। अब यह तो साफ है कि सुपरटेक ने जो अवैध निर्माण किया है, वह सुप्रीम कोर्ट की ओर से तय की गई अवधि के भीतर गिरा दिया जाएगा। अदालत का ऐसी सख्ती उन दूसरे भवन निर्माताओं के लिए भी बड़ा सबक है जो प्राधिकरणों की मेहरबानी से नियम-कानूनों को ताक पर रख कर गैरकानूनी तरीके से इमारतें खड़ी करते रहे हैं और उपभोक्ताओं के साथ छल करते आए हैं।

नोएडा, ग्रेटर नोएडा सहित राष्ट्रीय राजधानी क्षेत्र में बड़ी संख्या में भवन निर्माण परियोजनाएं चल रही हैं। लेकिन आज भी लाखों उपभोक्ताओं को घरों का कब्जा नहीं मिला है। ऐसी परियोजनाओं की तादाद भी काफी है जो अधूरी पड़ी हैं। मामला इसलिए भी गंभीर है कि नामी-गिरामी भवन निर्माता भी संबंधित प्राधिकरण की मदद से भवन निर्माण के निर्धारित मानकों का उल्लंघन करते हुए ढांचे खड़े करते रहे हैं। सुपरटेक के मामले में तो इलाहाबाद हाई कोर्ट छह साल पहले ही दोनों इमारतों को गिराने का आदेश दे चुका था। पर कंपनी ने कानूनी रास्ते का फायदा उठाते हुए सुप्रीम कोर्ट में याचिका दायर कर दी। उसे उम्मीद रही होगी कि यहां उसे राहत मिल जाएगी। पर सुप्रीम कोर्ट ने इलाहाबाद हाई कोर्ट के फैसले को बरकरार रखते हुए अवैध निर्माण गिराने का आदेश दिया। यह फैसला इसलिए भी सख्ती से लागू होना जरूरी है ताकि भवन निर्माता अवैध निर्माण करने से डरें। इस मामले में अदालत ने भवन निर्माता के अलावा संबंधित प्राधिकरण पर भी नकेल कसी और इसी का नतीजा है कि आज इस मामले में विशेष जांच दल की जांच में छब्बीस अधिकारी दोषी पाए गए हैं। देखने की बात अब यह है कि उत्तर प्रदेश सरकार इनके खिलाफ कितनी सख्त कार्रवाई करती है जो एक मिसाल बने।

पूरा पैसा दे देने के बावजूद समय पर घर नहीं मिलने और भवन निर्माता द्वारा धोखाधड़ी किए जाने जैसे मामलों को लेकर अदालतों में मुकदमे चल रहे हैं। लोग एक छत के लिए जीवन भर की गाढ़ी कमाई लगा देते हैं। ऐसे में अगर सालों तक घर मिलने का इंतजार करना पड़ जाए तो कितनी मानसिक पीड़ा होती होगी, इसका अंदाज सहज ही लगाया जा सकता है। अगर प्राधिकरण जिम्मेदार निकाय की तरह काम करें तो शायद उपभोक्ताओं को इतना परेशान न होना पड़े और भवन निर्माताओं में भी खौफ रहे। लेकिन हैरानी की बात तो यह है कि प्राधिकरण ही भ्रष्टाचार के गढ़ में तब्दील हो गए हैं। उपभोक्ताओं के हितों के ध्यान में रखते हुए अब सर्वोच्च अदालत ने भवन निर्माता और खरीददार के बीच एक पुख्ता अनुबंध पत्र बनाने पर भी जोर दिया है। इससे भी उपभोक्ताओं को धोखाधड़ी से बचाया जा सकेगा। जरूरत इस बात की है कि सरकारी तंत्र सतर्क होकर काम करे ताकि भ्रष्ट अधिकारियों और भवन निर्माताओं के गठजोड़ पर लगाम लगे। तभी उपभोक्ताओं के हितों की भी सुरक्षा हो पाएगी।

विलुप्त होतीं वनस्पतियां

आने वाले दशकों में वनस्पतियों की प्रजातियों के लुप्त होने का सबसे बड़ा कारण कटिबंधी वनों का विनाश होगा। यह चेतावनी वाशिंगटन स्थित विश्व संसाधन संस्थान के अध्ययन में दी गई है। गौरतलब है कटिबंधीय वनों में ही संपूर्ण वनस्पतियों की पचास फीसद वनस्पतियां पाई जाती हैं। ये प्रकृति के संतुलन को बनाए रखती हैं। धरती के प्राकृतिक संतुलन को बनाए रखने में मानव से भी ज्यादा भूमिका वन्य प्राणियों और वनस्पतियों की है। इसलिए इनके विलुप्त होने से प्रकृति पर गहरा असर पड़ेगा। इस खतरे को देखते हुए ही पिछले तीन दशकों में ज्यादातर देशों ने वन्य जीवों और वनस्पतियों के संरक्षण के लिए गंभीर प्रयास शुरू तो किए हैं, लेकिन ये अभी तक कोई ठोस नतीजे सामने नहीं आए हैं।

आंकड़े बताते हैं कि धरती पर उन्नीस हजार से ज्यादा पेड़-पौधे विलुप्त होने के कगार पर आ गए हैं। विलुप्त हो रहे ये पेड़-पौधे जैव विविधता विलोपन के अंतर्गत आते हैं। इसके मुताबिक यदि किसी वन्य जीव के प्राकृतिक वास को सत्तर फीसद कम कर दिया जाए तो वहां निवास करने वाली पचास फीसद प्रजातियां लुप्त होने की स्थिति में पहुंच जाएंगी। इससे यह पता चलता है कि वन्य जीवों और वनस्पतियों में सहजीवन की पूरकता है। इसलिए जितना वनस्पतियों को विलुप्त होने से बचाना जरूरी है, उतना ही वन्य जीवों को भी। आंकड़े और शोध बताते हैं कि विश्व में जंगली पेड़ों की आधी प्रजातियां विलुप्त होने के कगार पर आ गई हैं। इससे वैश्विक स्तर पर जंगलों के पारिस्थितिकी तंत्र का चरमराने का खतरा बढ़ गया है। इस संबंध में पिछले दिनों ‘स्टेट ऑफ द वर्ल्ड्स ट्रीज रिपोर्ट’ भी जारी की गई। इसमें पांच साल पहले तक चले अंतरराष्ट्रीय अध्ययन में जंगली पेड़ों की सत्रह हजार पांच सौ दस प्रजातियों का अस्तित्व गंभीर खतरे में पाया गया है।

गौरतलब है यह आंकड़ा वैश्विक स्तर पर पेड़ों की कुल ज्ञात अट्ठावन हजार चार सौ सनतानवे प्रजातियों का 29.9 फीसद है। अध्ययन में 7.1 फीसद अन्य प्रजातियों का अस्तित्व भी खतरे में होने की बात सामने आई है। अध्ययन में बताया गया है कि 21.6 फीसद प्रजातियों की मौजूदा स्थिति का विस्तृत विश्लेषण नहीं किया जा सका है, जबकि 41.5 फीसद प्रजातियों का अस्तित्व शोधकर्ताओं को सुरक्षित मिला। अध्ययन में ब्राजील में विलुप्तप्राय प्रजातियों की संख्या सबसे अधिक एक हजार सात सौ अट्ठासी दर्ज की गई है। इसमें महोगनी, शीशम आदि प्रमुख हैं। वहीं पर वनस्पति विविधता के लिहाज से कम संपन्न माने जाने वाले यूरोप और उत्तर अमेरिका में भी पेड़ों की कई प्रजातियां खतरे में मिली हैं। कीटों का आतंक और कीटनाशकों का ज्यादा इस्तेमाल इसकी मुख्य वजह बताई गई है।

स्टेट ऑफ द वर्ल्डस ट्रीज रिपोर्ट के मुताबिक ब्राजील में सबसे ज्यादा जंगली वनस्पतियों के विलुप्त होने का खतरा है। अध्ययन के अनुसार ब्राजील में पाई जाने वालीं आठ हजार आठ सौ सैंतालीस प्रजातियों में से एक हजार सात सौ अट्ठासी यानी बीस फीसद जंगली वनस्पतियों के विलुप्त होने का खतरा बढ़ गया है। इसी तरह कोलंबिया में पाई जाने वाली पांच हजार आठ सौ अड़सठ जंगली वनस्पतियों में से आठ सौ चौंतीस यानी चौदह फीसद वनस्पतियां विलुप्ति के कगार पर हैं। इंडोनेशिया में पाई जाने वाली पांच हजार सात सौ सोलह जंगली वनस्पतियों में से एक हजार तीन सौ छह यानी तेईस फीसद वनस्पतियों पर विलुप्ति का खतरा मंडरा रहा है।हरे-भरे मलेशिया की हालत भी लगभग ऐसी ही है। आंकड़े बताते हैं कि मलेशिया में पाई जाने वाली पांच हजार चार सौ बाईस जंगली वनस्पतियों में से एक हजार दो सौ पनचानवे यानी चौबीस फीसद इसी संकट से गुजर रही हैं। गौरतलब है कि मलेशिया ऐसा देश है जहां लोग वन और वनस्पतियों को लेकर काफी जागरूक हैं। छोटे से देश वेनेजुएला में चार हजार आठ सौ बारह जंगली वनस्पतियां पाई जाती है जिसमें छह सौ चौदह यानी तेरह फीसद समाप्ति की ओर हैं। और दुनिया के सबसे ज्यादा आबादी वाले देश चीन में पाई जाने वाली चार हजार छह सौ आठ वनस्पतियों में से आठ सौ नब्बे यानी उन्नीस फीसद जंगली वनस्पतियों पर विलुप्त होने का खतरा मंडरा रहा है। इन आंकड़ों से एक बात तो साफ है कि वनस्पतियों की सुरक्षा और संरक्षण के प्रति तकरीबन सभी देशों में उदासीनता और लापरवाही की स्थिति है। गौरतलब है वन्य जीवों के प्रति भी लोगों की कमोवेश ऐसी ही असंवेदनशीलता देखने को मिल रही है।

भारत में पिछले पचास वर्षों में सबसे ज्यादा जंगली वनस्पतियों का विलोपन हुआ। इसकी एक बड़ी वजह पेड़-पौधों की अंधाधुंध कटाई रही है। लेकिन दूसरे भी कई कारण हैं। जैसे वनस्पतियों के संरक्षण के प्रति लोगों की घटती दिलचस्पी, सूखा या बाढ़ और वनस्पतियों को जीवन का हिस्सा मानने की प्रवृति का कम होते जाना भी है। बहुराष्ट्रीय कंपनियों के फैलाव, उनके द्वारा उस इलाके की वनस्पतियों को उजाड़ने और पानी का अंधाधुंध दोहन की वजह से भी तमाम उपयोगी वनस्पतियां देखते ही देखते हमेशा के लिए विलुप्त हो गर्इं। सरकारी और गैरसरकारी प्रयास उन क्षेत्रों तक ही सीमित रहे जहां वनस्पतियों की सुरक्षा का दायित्व वन विभाग को सौंपा गया।

वन्य जीवों के संरक्षण के लिए अंतरराष्ट्रीय स्तर पर एक सौ चौरानवे देश लुप्त प्राय और अन्य जोखिम वाली प्रजातियों के संरक्षण के लिए जैव विविधता कार्ययोजना तैयार करने के लिए सहमति जताने वाले समझौते पर हस्ताक्षर कर चुके हैं। दरअसल, पुरानी पीढ़ी के लोग पेड़-पौधों को ‘मित्र’ के रूप में देखते थे। वनस्पति विज्ञान की समझ वैज्ञानिक रूप से न होने के बावजूद लोग यह मानते थे कि जीव-जंतु और वनस्पतियां उनकी जिंदगी के अहम हिस्से हैं। इनके बगैर खुशहाल जीवन की कल्पना भी नहीं की जा सकती है। इसलिए लोगों में जागरूकता थी। यही कारण है पेड़-पौधों के अंधाधुंध कटाई को रोकने के लिए भारत और दूसरे देशों में जमीनी स्तर पर आंदोलन भी चलाए गए। भारत में कर्नाटक में आपिको आंदोलन चलाया गया। इसी तरह चिपको आंदोलन चला। झारखंड के वनवासियों ने जंगल बचाओ आंदोलन चलाया। इसका असर यह हुआ कि 2006 में तत्कालीन केंद्र सरकार ने जंगल अधिकार कानून पास किया। लेकिन भारत में इसके बावजूद पेड़-पौधों की कटाई और छोटी वनस्पतियों की नुचाई बेतहाशा होती रही। इसका परिणाम यह हुआ कि तमाम बहुमूल्य वनस्पतियां हमेशा के लिए विलुप्त हो गईं।

पिछले पचास-पाठ सालों में इंसान प्रकृति से लगातार दूर होता चला गया है। बल्कि यह कहना ज्यादा सटीकहोगा कि उसने अपने स्वार्थ में वनों को उजाड़ डाला है। यह उन देशों में भी हो रहा है जहां वन्य जीवों और वनस्पतियों के विनाश या काटने के खिलाफ कठोर कानून बनाए गए हैं और लोगों में कई मामलों में जागरूकता है। यदि हम देखें तो कानून का डर लोगों में वैसा नहीं है, जैसा होना चाहिए। दूसरी बात, मानव ने धरती की हर वस्तु या तत्त्व पर अपना एकाधिकार मान लिया है। उसे अपना जीवन, अपना सुख और अपना स्वार्थ ही सबसे महत्त्वपूर्ण लगता है। सहचर और मैत्री की पूरकता की भावना समाप्त हो चुकी है। इसलिए लोगों में धरती के अकूत दोहन को रोकने के साथ उसकी सुरक्षा के प्रति जागरूकता पैदा करने की जरूरत है। जब तक लोगों में वन्य जीवों और वनस्पतियों के प्रति संवेदना और संरक्षण की भावना नहीं बढ़ेगी, तब तक वन्य जीवों और वनस्पतियों के विलुप्त होने का खतरा खत्म नहीं हो सकता।

सर्वोच्च न्यायालय ने कहा है कि वह विचार करेगा कि क्या किसी कानून की वैधता को चुनौती देने वाले संगठनों या व्यक्तियों को उसी मुद्दे पर विरोध प्रदर्शन करने की अनुमति है‚ जब मामला विचाराधीन हो। तीन कृषि कानूनों का विरोध कर रहे एक किसान संगठन किसान महापंचायत की याचिका पर सुनवाई करते हुए सोमवार को न्यायमूर्ति एएम खानविलकर और न्यायमूर्ति सीटी रविकुमार की पीठ ने पूछा कि आंदोलनकारी किसान किसलिए विरोधकर रहे हैं‚ जब अदालत ने इन कानूनों पर पहले ही रोक लगा रखी है। किसान महापंचायत ने दिल्ली के जंतर मंतर पर ‘सत्याग्रह’ करने की अनुमति देने के लिए अधिकारियों को निर्देश देने का अनुरोध किया है। इस पर शीर्ष अदालत ने कहा कि मामला विचाराधीन होने और इन कानूनों के क्रियान्वयन पर रोक की स्थिति में आप कैसा ‘सत्याग्रह’ करना चाहते हैं‚ आंदोलन किसलिए। आपने समूचे शहर को घेर रखा है और अब शहर में प्रवेश करके प्रदर्शन करना चाहते हैं। इससे पूर्व नोएड़ा निवासी एक महिला की शिकायत पर सुप्रीम कोर्ट की अन्य पीठ ने 30 सितम्बर को कहा था कि सड़कों और राजमार्गों को लगातार अवरुद्ध नहीं रखा जा सकता। महिला ने शीर्ष अदालत के समक्ष दायर याचिका में कहा था कि नोएड़ा से दिल्ली तक उसे लगने वाला बीस मिनट का समय दो घंटा हो गया है क्योंकि आंदोलनकारी किसानों ने रास्ते जाम कर रखे हैं। बेशक‚ किसी भी आंदोलन से आम जन को दिक्कत नहीं होनी चाहिए। किसानों ने भी बारंबार कहा है कि वे जनजीवन को किसी भी सूरत में अवरुद्ध नहीं करना चाहते। पुलिस प्रशासन ने रास्तों को बैरिकेड़ लगाकर बंद कर दिया है। आवाजाही के लिए भी जगह नहीं छोड़ी है। नवम्बर‚ 2020 से चले आ रहे किसान आंदोलन में अभी तक 600 से ज्यादा किसानों की मौत हो चुकी है। कृषि कानूनों के संबंध में शीर्ष अदालत ने एक कमेटी गठित की थी। कमेटी ने मार्च‚ 2021 में सीलबंद रिपोर्ट पेश कर दी थी‚ लेकिन अभी तक फैसला नहीं लिया गया है। जरूरी है कि जल्द उस रिपोर्ट को सार्वजनिक किया जाए और किसान आंदोलन के शांतिपूर्ण समाधान के लिए जरूरी प्रयास किए जाएं। मानकर चलना सही नहीं है कि किसानों को राजनीतिक स्वार्थों के चलते बरगला दिया गया है। संभवतः यही संशय आंदोलन का नतीजाकुन फैसला नहीं होने दे रहा।
