CJI Makes A Case

Reducing govt litigation, smarter law-making and clearer govt policies can help court pendency

With the Prime Minister and state chief ministers in attendance, Chief Justice of India NV Ramana laid down what was nothing less than a manifesto on good government practices to mitigate the judiciary’s pendency crisis. CJI Ramana was able to demonstrate that government as the largest litigant has to clean up its act. He proceeded bottom-up from panchayat and civic bodies to tehsildars and other revenue officials, from policing at thanas to service laws that trigger disputes over postings and transfers, to signal how non-performance and lack of adherence to constitutional due process kicks off copious litigation.

The CJI then proceeded to the upper tier of governance. His list of lapses was long: hasty enactment of laws by legislatures, often done without discussion, frivolous litigation by various government departments, deliberate inaction by governments on implementing judicial pronouncements, transferring the burden of decision-making to courts, slow process of judicial appointments, and lag in upgradation of judicial infrastructure. Top politicians of the country who govern at the Centre and in states and who return from the conference with judges to their offices have a constitutional responsibility to set right this drift.

Judges can only interpret the law; for everything else pertaining to governance, the Constitution empowers the political executive and the bureaucracy, which is the permanent executive, to make laws, frame procedures and loosen purse-strings. The CJI’s remark that land disputes account for 66% of pendency offers governments a focus area to the extent that clearer policies can solve some of these disputes. Governments must also address the fear of prosecution that haunts officers and decisionmaking at all levels. That’s one of the reasons administrators find it safer to go to court than settle a dispute quickly.

Badly conceived laws that criminalise liquor and marijuana consumption, dissent, teenage sexuality, interfaith marriages or increased compliance burdens on businesses and the countless politically motivated cases across India are a poor advertisement for governance and constitutionalism. These cases breed corruption, which hits the poor the hardest, besides spawning a hard to dislodge neta-babu-cop nexus. If government departments can ensure justice to citizens by following due process, courts wouldn’t be overburdened and wouldn’t fail in their watchdog duties. It’s not a chicken and egg problem.

Desi Commerce

GoI’s ecommerce network for small players is a good idea. Customer interface will be critical

GoI’s quest to build an open digital ecommerce network for small businesses holds great promise. The proposed model can potentially be a game-changer for small retailers and new tech startups facing big ecommerce giants and their market dominance and commissions. It can also address sellers’ limitations of being tied down to one platform, and supposedly opaque algorithms used by them to prioritise some sellers. Physical retail still accounts for well over 90% of retail sales, but mom-and-pop stores enjoying a large chunk of consumer goods sales (75-80%) are feeling the heat of ecommerce players aggressively targeting new segments like groceries, promising 10-minute deliveries.

After its technological successes of the Aadhaar system and digital payments solution UPI, GoI can justly claim a good track record. Another promising digital venture is the National Digital Health Mission that aims to digitise health records of all citizens. And it’s good that the presence of ecommerce biggies Amazon and Walmart-owned Flipkart hasn’t daunted GoI. There’s economic logic in safeguarding livelihoods in the unorganised retail sector and boosting MSMEs, as long as this isn’t done by introducing any distortion or discrimination. Roping in the likes of Nandan Nilekani, who played key roles in conceptualising Aadhaar and UPI, for the Open Network for Digital Commerce (ONDC), has also added to the project’s heft.

But unlike in digital payments and the pioneering UPI, ecommerce has dominant players with user-friendly websites and apps, excellent customer service and fast delivery networks. ONDC-based offerings have to be just as good to attract sellers and customers. ONDC, with its premise of greater cross-platform visibility and discoverability of sellers, shouldn’t be thrust on anybody. If interoperable networks and applications built on ONDC ease tasks like cataloguing, inventory management, order fulfilment and delivery logistics, both buyers and sellers would be automatically attracted. ONDC can also help tomorrow’s ecommerce/tech startups save redundant investments in the ecommerce network and focus on customer acquisition. Next month’s pilot ONDC project will be keenly watched.

Making the NE AFSPA-Mukt

Narendra Modi’s announcement last Thursday in Assam regarding ongoing efforts to completely remove the Armed Forces (Special Powers) Act (Afspa) from the Northeast is reassuring. This builds on the earlier announcement to reduce the number of disturbed areas brought under the Act in Nagaland, Assam and Manipur from April 1. The PM’s announcement should now be followed up with a roadmap and timeline. This will build on the credibility that the Centre has garnered on its willingness to minimise the use of this law.

The improvement in the law and order situation — reports suggest a 75% decrease in violence in the region — is good news for the development and economic growth of the Northeast. This is
also indicative of improved governance. Afspa, granting special almost unbridled powers to Indian Armed Forces to maintain public order in ‘disturbed areas’. The law was first imposed in the form of the Armed Forces (Assam and Manipur) Special Powers Act in 1958 in the Naga Hills region (then a part of Assam), and later expanded across the Northeast. Over the years, Afspa has remained in force in parts of the Northeast, resulting in abrogation of various aspects of democratic and open societies. Efforts at ensuring peace in the region proved to be unsuccessful, the continued imposition of Afspa adding to the vicious cycle of distrust.

The efforts by the state governments in the region and the central government — as well as participation of the local people — has helped to seriously reduce the earlier endemic violence, the provocation for the imposition of the law in the first place. It’s fitting that the region where Afspa first raised its unhelpful head is the very place where GoI is working to make Afspa-mukt. One hopes other district under Afspa across the country also follow suit.

Ending AFSPA

AFSPA should go entirely because of the impunity it offers armed forces

It augurs well for the future that Prime Minister Narendra Modi has given the first authentic indication that the operation of the Armed Forces (Special Powers) Act (AFSPA) may come to an end in the whole of the north-eastern region, if ongoing efforts to normalise the situation bear fruit. Mr. Modi’s remark that a good deal of work is being done in that direction, not only in Assam but also Nagaland and Manipur, may be rooted in his keenness to demonstrate the level of progress achieved in the region under his regime; but it will bring immense relief to the citizens, nevertheless. Areas notified as ‘disturbed areas’ under AFSPA have been progressively reduced in the last few years, mainly due to the improvement in the security situation. About a month ago, the Union Home Ministry reduced such notified areas considerably in Assam, Nagaland and Manipur. There was a substantial reduction in Assam, where AFSPA was removed entirely in 23 districts and partially in one. In Nagaland, after the removal of the law from 15 police stations in seven districts, it remains in areas under 57 police stations, spread across 13 districts. Areas under 82 police stations are still notified under the Act in Manipur, even though 15 police station areas were excluded from the notification from April 1. Mr. Modi, who spoke at a ‘peace, unity and development rally’ in Diphu in Assam last week, cited “better administration” and the “return of peace” as the reasons for the removal of AFSPA in these areas in a region that has seen insurgencies for decades.

AFSPA was revoked in Tripura in 2015 and in Meghalaya in 2018. It is not unforeseeable that other States will also be excluded from its purview at some point of time. It is convenient to link the exclusion of an area from AFSPA’s purview with reduction in violence by armed groups, improvement in the security situation and an increase in development activity, but what is important is the recognition that the law created an atmosphere of impunity and led to the commission of excesses and atrocities. It was hardly four months ago that 15 civilians were killed in Mon district in Nagaland in a botched military operation. Therefore, alongside the gradual reduction in the areas under the Act, there should be serious efforts to procure justice for victims of past excesses too. On the political side, it is indeed true that much headway has been made in moving towards a political solution to some of the multifarious disputes in the region, in the form of peace accords, ceasefire and creation of sub-regional administrative arrangements. The removal of AFSPA from the entire region will be an inevitable step in the process. But irrespective of the security situation, AFSPA should not have allowed such impunity to the armed forces.

Invigorating the Ayush industry

Its integration into mainstream systems will give wider acceptance to traditional systems of the country

The global market for herbal medicine was valued at $657.5 billion in 2020. It is expected to grow to $746.9 billion in 2022. In China, the traditional medicine industry had total revenue of $37.41 billion in 2018, according to an IBISWorld report. In fact, the Healthy China 2030 plan forecasts that the value of traditional Chinese medicine (TCM) market may reach $737.9 billion within China and globally by 2030.

The growth of the TCM industry in China is attributed to the immense attention the sector has received in the country. In 1982, the Constitution of China gave full recognition to TCM. Since 2009, there has been continuous support for TCM in health policies. China has focused upon developing quality infrastructure for TCM to co-exist with modern medicine under the same roof.

The NAM scheme

In India, the National Ayush Mission (NAM) was launched in 2014 by the Department of Ayush, Ministry of Health and Family Welfare, to promote Ayush systems and address the needs of the sector in a comprehensive way. Providing cost-effective services, strengthening educational systems, quality control of drugs and sustainable availability of raw materials are the main objectives of NAM. The industry is projected to reach $23.3 billion in 2022, according to a Research and Information System for Developing Countries (RIS), 2021, report. The Indian herbal medicine market is worth $18.1 billion.

The Indian Ayush sector has grown by 17% between 2014 and 2020. Related segments such as plant derivatives grew by 21%, plant extracts by 14.7%, and herbal plants by 14.3% during the same period.

Under the ‘Medicinal Plants’ component of the NAM scheme (2015–16 to 2020–21), the cultivation of prioritised medicinal plants in identified clusters/zones is being supported. Cultivation of plants on farmer’s land, establishment of nurseries with backward linkages, post-harvest management with forward linkages, and primary processing, marketing, etc., are all covered under the scheme. For the cultivation of plants, subsidies at 30%, 50% and 75% of the cultivation cost for 140 medicinal plants are being provided. So far, approximately 56,396 hectares are under the cultivation of medicinal plants, as per the Ministry of Ayush.

Further, last year Union Ayush Minister Sarbananda Sonowal announced that medicinal plants will be cultivated on 75,000 hectares of land. The Ministry of Finance has also announced a ₹4000-crore package under the Aatmanirbhar Bharat Abhiyaan for the promotion of herbal cultivation.

There is no doubt about the potential of the sector and the above measures will surely help. However, the Ayush sector requires a multi-dimensional thrust, ranging from initiatives at the institutional level, massive awareness and promotion of cultivation of medicinal plants by farmers, to trade-related interventions and quality focus measures.

SMPBs to be strengthened

The National Medicinal Plant Board (NMPB) implements the medicinal plant component of Ayush through state bodies—State Medicinal Plant Boards (SMPBs). The organisational structure of SMPBs needs to be strengthened. They should have experts for conservation, cultivation, R&D, herbal garden and nurseries, IEC and marketing and trade of medicinal plants. On the trade front, developing comprehensive databases on Ayush trade, products and raw materials is needed. To date, most ISM (Indian System of Medicine) products, herbal products and medicinal plants products are not identified under specific HS (Harmonised system) codes. Expansion of HS national lines to accommodate various features of traditional medicine and medicinal plant products based on existing requirements is required to provide more comprehensive trade data on Ayurvedic products.

Prime Minister Narendra Modi laid the foundation of the WHO-Global Centre for Traditional Medicine in Jamnagar on April 19, 2022. This will be the first and only global outpost centre for traditional medicine across the world.

NITI Aayog has already constituted a committee and four working groups on integrative medicine, with more than 50 experts across the country, to provide deeper insights and recommendations in the areas of education, research, clinical practice and public health and administration. Considerable progress has been made by the committee for the finalisation of the report. Integration of Ayush systems into mainstream systems will certainly give wider acceptance for traditional systems of the country.

The Ayush industry in India can provide cost-effective healthcare to people across States. It has all the ingredients of success, to co-exist with the modern health systems, as a choice-based system of traditional medicine.

समान नागरिक संहिता

समान नागरिक संहिता को लेकर जारी बहस के बीच ऐसे स्वर फिर से खूब उभर रहे हैं, जो इस या उस बहाने ऐसी किसी संहिता के निर्माण को अनावश्यक बता रहे हैं। यह कोई नई बात नहीं। दशकों से यही होता चला आ रहा है। जब भी समान नागरिक संहिता को लेकर कोई पहल होती है अथवा उसके निर्माण की आवश्यकता जताई जाती है, तब कुछ दल, खास सोच वाले बुद्धिजीवी और इंडियन मुस्लिम पर्सनल ला बोर्ड जैसे संगठन कुतर्को और काल्पनिक भय के साथ उसके विरोध में खड़े हो जाते हैं। इन दिनों भी ऐसा ही हो रहा है। कोई यह कह रहा है कि समान नागरिक संहिता का निर्माण लोगों के धार्मिक मामलों में अनावश्यक हस्तक्षेप होगा तो कोई ऐसे बयान दे रहा है कि यह महंगाई, बेरोजगारी आदि से लोगों का ध्यान बंटाने की कोशिश है। क्या इससे बेतुकी बात और कोई हो सकती है? क्या समान नागरिक संहिता का निर्माण न करने से महंगाई और बेरोजगारी की समस्या का समाधान हो जाएगा? प्रश्न यह भी है कि महिलाओं को उनके अधिकार दिलाना और उन्हें अन्याय एवं शोषण से बचाना किसी के धार्मिक मामलों में हस्तक्षेप कैसे कहा जा सकता है? क्या किसी पंथनिरपेक्ष और लोकतांत्रिक देश में धार्मिक मामलों के नाम पर मनमानी होने दी जा सकती है?

समान नागरिक संहिता को लेकर बेलगाम बयानबाजी होने का एक बड़ा कारण यह है कि उसके विरोधियों और यहां तक कि समर्थकों को भी यह नहीं पता कि वह कैसी होगी और उससे क्या बदलेगा? यही कारण है कि मनमाने बयान दिए जा रहे हैं। यह सिलसिला तब तक नहीं थमने वाला, जब तक समान नागरिक संहिता का कोई मसौदा सामने नहीं लाया जाता। उचित यह होगा कि इस संहिता का कोई मसौदा तैयार कर उसे जनता के समक्ष विचारार्थ प्रस्तुत किया जाए, ताकि उस पर व्यापक बहस हो सके। गोवा में यह संहिता लागू है। उसके जरिये उसका एक नया मसौदा आसानी से तैयार किया जा सकता है। समान नागरिक संहिता को लेकर गंभीरता प्रदर्शित कर रहे सत्तारूढ़ लोगों के लिए यह आवश्यक है कि सबसे पहले वे उसका मसौदा सामने लाएं। यह जानना दयनीय है कि 21वें विधि आयोग को समान नागरिक संहिता से जुड़े प्रविधानों का विस्तृत अध्ययन करने का काम सौंपा गया था, लेकिन यह काम किए गए बगैर उसका कार्यकाल खत्म हो गया। इसके बाद कहा गया कि 22वें विधि आयोग को यह जिम्मेदारी सौंपी जा सकती है, लेकिन कोई नहीं जानता ऐसा कब होगा?

मुश्किलें बढ़ाती महंगाई

पिछले हफ्ते दिल्ली में आयोजित रायसीना संवाद में विदेश मंत्री एस. जयशंकर ने कहा कि रूस-यूक्रेन युद्ध और आपूर्ति शृंखला में बाधा की वजह से दुनियाभर में खाद्यान्न की कमी होने लगी है और महंगाई तेजी से बढ़ती जा रही है। सरकार से लेकर अर्थशास्त्री तक इस हालात को लेकर चिंतित नजर आ रहे हैं। भारत में भी आम आदमी कीमतों में बढ़ोतरी से जूझ रहा है, लेकिन खाद्यान्न अनुकूलता के कारण अभी यहां वैसे हालात पैदा नहीं हुए हैं, जैसे दुनिया के और मुल्कों में देखने को मिल रहे हैं। इस समय भारत अपने खाद्यान्न भंडारों के कारण दुनिया को खाद्य संकट से उबारने में मदद भी कर पाने की स्थिति में है।

गौरतलब है कि अमेरिका, ब्रिटेन, तुर्की, पाकिस्तान सहित अधिकांश देशों में जहां महंगाई भारत की तुलना में काफी अधिक है, वहीं जर्मनी, इटली, स्पेन सहित कई यूरोपीय देशों में खाद्य तेलों और आटे का स्टाक खत्म होने की खबरें भी आ रही हैं। महामारी संकट तथा महंगाई और बढ़ने की आशंका को देखते हुए लोग घरों में सामान जमा कर रहे हैं। इस कारण कई यूरोपीय देशों को तो सीमित मात्रा में सामान बेचने का नियम लागू करने को बाध्य होना पड़ा है, ताकि जमाखोरी न बढ़े। इतना ही नहीं कई यूरोपीय देशों में उद्योग-कारोबार में गिरावट के कारण कर्मचारियों की छंटनी का सिलसिला भी जारी है। वैसे भी बेरोजगारी दुनिया की बड़ी और गंभीर समस्या बन गई है।

उल्लेखनीय है कि भारत में खाद्यान्न अनुकूलता के बावजूद महंगाई बढ़ने के चार परिदृश्य सामने हैं। एक, थोक और खुदरा महंगाई दर बढ़ रही है। दो, पेट्रोल और डीजल की कीमतों में वृद्धि रोजमर्रा के खर्च को प्रभावित कर रही है। तीन, चीन सहित कई देशों से आयातित वस्तुएं महंगी हो गई हैं और इंडोनेशिया ने पाम आइल का निर्यात रोकने का फैसला किया है। चार, ब्याज दरों में वृद्धि से कर्ज महंगा होने से महंगाई बढ़ रही है। गौरतलब है कि 18 अप्रैल को आए आंकड़ों के अनुसार मार्च में थोक महंगाई दर बढ़ कर 14.55 फीसद पर पहुंच गई। यह बीते चार माह में सबसे ज्यादा रही। यह लगातार बारहवां महीना रहा, जब थोक महंगाई दर दस फीसद से ऊपर रही। इसी तरह खुदरा महंगाई भी इस साल मार्च में 6.95 फीसद पर पहुंच गई, जो पिछले सत्रह महीनों में सबसे ज्यादा रही। यह लगातार तीसरा महीना है जब खुदरा महंगाई भारतीय रिजर्व बैंक (आरबीआइ) के दो से छह फीसद से दायरे से बाहर बनी हुई है।

यह बात भी महत्त्वपूर्ण है कि रूस-यूक्रेन के बीच युद्ध की वजह से कच्चे तेल के बढ़ते दाम और वस्तुओं की आपूर्ति बाधित होने से वैश्विक जिंस बाजार में भी भारी तेजी बनी हुई है। शंघाई सहित चीन के कई औद्योगिक शहरों में कोरोना फिर से फैलने की वजह से पूर्णबंदी जैसे कदम उठाए जा रहे हैं। इस कारण उत्पादन में कमी होने से चीन से आयातित कच्चा माल काफी महंगा हो गया है। इसका असर भारत के उद्योगों पर पड़ रहा है। रूस-यूक्रेन युद्ध की वजह से सूरजमुखी के तेल का आयात पहले से प्रभावित है। इंडोनेशिया ने पिछले हफ्ते से पाम आयल का निर्यात बंद कर दिया है। भारत में खाद्य तेल की खपत दो सौ पच्चीस लाख टन सालाना की है और इसमें अस्सी लाख टन पाम आयल भी शामिल है। भारत में पाम आयल का इस्तेमाल खाने से लेकर साबुन, बिस्कुट, टूथपेस्ट, शैंपू जैसी रोजमर्रा के इस्तेमाल वाली वस्तुओं के उत्पादन में किया जाता है। ऐसे में पाम आयल के गहराते संकट की वजह से खाद्य तेलों के अलावा दूसरी वस्तुएं भी महंगी हो रही हैं। इससे अप्रैल की खुदरा महंगाई दर पर असर पड़ेगा।

सरकार के साथ रिजर्व बैंक भी बढ़ती महंगाई के दुष्प्रभावों से अनजान नहीं है। इस समय रिजर्व बैंक की प्राथमिकता महंगाई को काबू करना है। इसी को ध्यान में रखते हुए रिजर्व बैंक के कहने पर देश के विभिन्न व्यावसायिक बैंकों ने कर्ज दर (एमसीएलआर) में इजाफा किया है। इससे कर्ज महंगे हो गए हैं। कर्जदारों, कारोबारियों और उद्योगपतियों को कर्ज पर ज्यादा किस्त और ब्याज चुकाना होगा। कर्ज दर बढ़ने से महंगाई के दौर में लोगों की मुश्किलें और बढ़ेंगी। एमसीएलआर बैंकों की ऐसी मानक ब्याज दर होती है, जिस पर बैंक ग्राहकों को कर्ज देते हैं। हालांकि कर्ज का महंगा होना महंगाई नियंत्रण की दिशा में एक प्रभावी कदम है, लेकिन इससे आर्थिक गतिविधियों पर प्रतिकूल प्रभाव पड़ने की आशंका रहती है। वस्तुत: महंगी दर पर कर्ज लेने से आम आदमी, उद्यमी व कारोबारी पीछे हटेंगे। इससे बाजार में विभिन्न उत्पादों की मांग और आपूर्ति में कमी आएगी। स्थिति यह भी है कि इस साल मार्च से बढ़ी महंगाई के बाद जहां आम आदमी के जीवन पर महंगाई का असर पड़ा है, वहीं कर्ज के भुगतान पर भी इसका प्रभाव दिखने लगा है। कर्ज नहीं चुका पाने वालों की संख्या बढ़ रही है। जबकि पिछले साल नवंबर में आर्थिक गतिविधियों में तेजी को देखते हुए कर्जदारों की भुगतान क्षमता सुधार दिखा था। लेकिन मार्च में खाद्य वस्तुओं और तेल की बढ़ती कीमतों से आर्थिक हालात फिर से बिगड़ने लगे।

इस समय दूसरे देशों की तुलना में भारत में महंगाई का असर कम है। भारत में महंगाई को तेजी से बढ़ने से रोकने में कुछ अनुकूलताएं स्पष्ट दिखाई दे रही हैं। देश में अच्छी कृषि पैदावार खाद्य पदार्थों की कीमतों के नियंत्रण में महत्त्वपूर्ण भूमिका निभा रही है। इसके अलावा देश में न केवल सार्वजनिक वितरण प्रणाली (पीडीएस) के लिए आवश्यकता से अधिक चावल और गेहूं का सुरक्षित केंद्रीय भंडार भरपूर है, बल्कि देश गेहूं और चावल का निर्यात भी कर रहा है। यह बात भी महत्त्वपूर्ण है कि देश में महंगाई को काबू करने में सार्वजनिक वितरण प्रणाली की उपयोगिता दिखाई दे रही है। राष्ट्रीय खाद्य सुरक्षा अधिनियम के तहत सार्वजनिक राशन प्रणाली के तहत करीब अस्सी करोड़ लाभार्थियों में से जनवरी 2022 तक सतहत्तर करोड़ से अधिक लाभार्थी डिजिटल रूप से सभी राशन दुकानों से जुड़ गए। सरकार ने तिलहन और खाद्य तेलों पर भंडारण सील की अवधि छह महीने बढ़ा कर 31 दिसंबर 2022 तक कर दी है। भंडारण सीमा के तहत खुदरा विक्रेता तीन टन तक और थोक व्यापारी पचास टन तक खाद्य तेल का भंडारण कर सकता है। इस कदम से जमाखोरी पर नियंत्रण रहेगा। रिजर्व बैंक भी कह चुका है कि वह अब विकास दर में वृद्धि के बजाय महंगाई नियंत्रण को अधिक प्राथमिकता देगा और अपने नरम रुख को धीरे-धीरे वापस लेगा। जिस तरह पिछले वर्ष 2021 में पेट्रोल और डीजल की कीमतें सौ रुपए प्रति लीटर से अधिक होने पर केंद्र सरकार ने पेट्रोल व डीजल पर सीमा व उत्पाद शुल्क में और कई राज्यों ने वैट में कमी की थी, वैसे ही कदम अब फिर जरूरी दिखाई दे रहे हैं।

उम्मीद की जानी चाहिए कि सरकार ऐसे विभिन्न रणनीतिक प्रयासों से देश के आम आदमी और अर्थव्यवस्था को महंगाई के खतरों से बचाने के लिए तेजी से आगे बढ़ेगी। भारतीय मौसम विभाग ने इस वर्ष सामान्य मानसून रहने का जो पूर्वानुमान किया है, वह सटीक रहेगा और सामान्य मानसून से भी महंगाई नियंत्रित होगी।

प्रधानमंत्री नरेन्द्र मोदी ने कहा है कि अदालतों में स्थानीय भाषाओं का इस्तेमाल ज्यादा से ज्यादा किया जाए तो न्याय प्रणाली में आम नागरिकों का विश्वास बढ़ेगा और वे इससे जुड़ाव महसूस करेंगे। छह वर्ष के अंतराल पर शनिवार को हुए मुख्यमंत्रियों और उच्च न्यायालयों के मुख्य न्यायाधीशों के संयुक्त सम्मेलन को संबोधित करते हुए प्रधानमंत्री मोदी ने बताया कि एक समूह दो प्रारूपों पर विचार कर रहा है-एक विशिष्ट कानूनी भाषा में तो दूसरा साधारण भाषा में जिसे आम लोग समझ सकते हैं। ऐसा विभिन्न देशों में प्रचलित है, और दोनों प्रारूप कानूनी रूप से स्वीकार्य हैं। इससे पूर्व प्रधान न्यायाधीश एनवी रमण ने कहा कि अदालतों में स्थानीय भाषाओं का इस्तेमाल करने के लिए एक कानूनी व्यवस्था की दरकार है। प्रधान न्यायाधीश की टिप्पणी का जिक्र करते हुए प्रधानमंत्री ने कहा कि भारत आज जब स्वतंत्रता की 75वीं वषर्गांठ मना रहा है, तो ऐसी न्यायिक प्रणाली के निर्माण पर ध्यान केंद्रित किया जाना चाहिए जहां न्याय आसानी से उपलब्ध हो, त्वरित मिले और सर्वसुलभ हो। दरअसल, यह सम्मेलन न्यायिक क्षेत्र के समक्ष चुनौतियों और उनके समाधान में आने वाली अड़चनों पर गौर करने का अवसर था। इसी के मद्देनजर प्रधान न्यायाधीश जस्टिस रमण ने ध्यान दिलाया कि कार्यपालिका और विधायिका की विभिन्न शाखाओं के अपनी पूरी क्षमता के साथ काम नहीं करने के कारण अदालतों में लंबित मामलों का अंबार लग गया है। सरकारों को ‘सबसे बड़ा वादी’ करार देते हुए उन्होंने कहा कि पचास प्रतिशत लंबित मामलों के लिए सरकारें जिम्मेदार हैं। कार्यपालिका की विभिन्न शाखाओं की निष्क्रियता नागरिकों को अदालतों का दरवाजा खटखटाने पर विवश करती है। अदालतों के फैसले सरकारें वर्षो तक लागू नहीं कर पातीं तो अदालतों में अवमानना याचिकाओं की बाढ़ आ जाती है। जनसंख्या के बरक्स न्यायाधीश कम होने से याचिकाओं के निपटारे में विलंब होता है, और कानून क्षेत्र की प्रसिद्ध उक्ति-जस्टिस डिलेड इज जस्टिस डिनाइड-चरितार्थ होने लगती है। ऐसे में जरूरी है कि राज्य के तीनों अंग-कार्यपालिका, विधायिका और न्यायपालिका-अच्छे से अपने दायित्व का निर्वहन करें। प्रधान न्यायाधीश ने भी इस तरफ ध्यान दिलाया है कि ये तीनों क्षेत्र अपनी ‘लक्ष्मण रेखा’ के प्रति सचेत रहें तो नागरिकों को त्वरित न्याय सुनिश्चित होगा। अवमानना तथा जनहित याचिकाओं की संख्या कम होगी और अदालतों पर बोझ कम हो सकेगा।

ख्वाब ही रहेगा या..

आमतौर पे हमारे देश में सिर्फ चुनाव के समय स्त्री मतदाता की बात होती है। आज जब कहीं भी चुनाव नहीं हो रहे हैं, तब भी भारतीय स्त्री की समानता एवं उसके साथ जुड़े प्रश्नों की बात करना जरूरी है। साक्षरता, शिक्षा और तेजी से बदलता समाज मौजूदा सदी की एक महत्त्वपूर्ण विशेषता है, लेकिन फिर भी देश की महिला आम तौर पर पुरु ष से बहुत पीछे है। पिछले तीन दशकों में टेक्नोलॉजी और वैश्विकीकरण के चलते मानव जीवन शैली में बदलाव की प्रक्रियाएं प्रत्यक्ष रूप से तेज हुई हैं। फिर भी समाज में महिलाओं एवं लड़कियों का स्थान दोयम दर्जे का ही बना हुआ है।

आजादी के सत्तर साल बाद भी महिला की तरक्की के लिए सरकार, नागर समाज, समाज एवं परिवार में इच्छा-शक्ति और ताल-मेल की जरूरत है। महिला का वोट लेने के लिए राजनैतिक पार्टयिां कई हथकंडे अपनाती रही हैं। लेकिन क्या महिला की भूमिका सिर्फ वोट तक सीमित होनी चाहिए? बेटी बचाओ, बेटी पढ़ाओ; लड़की हूं, लड़ सकती हूं, अच्छे नारे हैं। अब इन नारे से आगे जाकर महिला के वास्तविक जीवन में सुधार होना जरूरी है। कई राज्यों में महिलाएं बड़ी तादाद में वोट डालने निकलती हैं। कहीं-कहीं तो महिलाओं का मतदान प्रतिशत पुरुषों से ज्यादा भी हो जाता है। यही वजह है कि पार्टयिां प्रचार के समय महिला महिला जपती हैं, लेकिन महिला को मानवीय अधिकार एवं मान-सम्मान दिलाने के लिए आवश्यक कदम उठाने से कतराती हैं। सरकारें एवं राजनैतिक पार्टयिां पितृसत्तात्मक सामाजिक व्यवस्था से टकराना तो दूर, उन्हें बरकरार रखने वाले कई कथन-कृत्य करती नजर आती हैं।

महिला के लिए शिक्षा, रोजगार, सुरक्षा, मानवीय गरिमा एवं सामाजिक न्याय सबसे बड़ी चुनौतियां हैं। हालांकि देश का संविधान महिला नागरिक को समान हक देता है, लेकिन पुरुष प्रधानता के चलते महिला पीछे रह जाती है। फिर राजनैतिक पार्टयिां भी पुरु ष प्रधानता पर आधारित व्यवस्था से काम करती हैं। उन्हें सिर्फ महिला के वोट से मतलब है न कि असल बदलाव से। संसद में महिला आरक्षण कानून का प्रस्ताव 30 से अधिक वर्षो से धूल खा रहा है। साफ है कि राजनीतिक पार्टियों के नेता-मुखिया महिला के समर्थन में बातें ही करते हैं, लेकिन कोई ठोस कदम नहीं उठाना चाहते। ज्यादातर राजनेता खुद पुरु षवादी मानसिकता से पीड़ित हैं। वे नहीं चाहते कि कोई महिला राजनीति में प्रवेश करे या तरक्की करे। लगता है कि महिला आरक्षण कानून का प्रस्ताव आने वाले कई वर्षो तक यूं ही पड़ा रहेगा। भाजपा, कांग्रेस, वामपंथी दलों समेत तमाम अन्य राजनैतिक दल इस देरी के लिए जिम्मेदार हैं। एक तरफ शिक्षा के निजीकरण के चलते किसी भी गरीब और विशेष रूप से ग्रामीण और पिछड़े परिवार के लिए बेटियों की शिक्षा और दूभर हो चली है। दूसरी तरफ, कोविड-19 महामारी के चलते करीब दो वर्षो तक स्कूल-कॉलेज और शिक्षण-प्रशिक्षण संस्थान बंद रहे। ऑनलाइन मॉड में शिक्षा के चलते गरीब परिवारों के बच्चों और खासकर बच्चियों को शिक्षा से वंचित रहना पड़ा है। कोविड महामारी के कारण कई महिलाओं को रोजगार से हाथ धोना पड़ा है।

सेंटर फॉर मॉनिटरिंग इंडियन इकॉनमी (सीएमआईई) के एक अध्ययन के मुताबिक करीब 25% महिला कामगारों का रोजगार हमेशा के लिए छीन गया है यानी ये महिलाएं रोजगार के दायरे से बाहर हो गई हैं, और अब पूरी तरह से अपने परिवार पर और भी निर्भर हो गई हैं। उधर, राष्ट्रीय महिला आयोग की एक रिपोर्ट दशर्ती है कि महामारी के चलते घरेलू हिंसा का चलन और भी बढ़ गया है जबकि भारत में पिछले कई वर्षो से घरेलू हिंसा निषेध कानून लागू है। साथ ही, मानसिक उत्पीड़न एवं मानसिक स्वास्थ्य से जुड़ी समस्याएं भी सामने आ रही हैं। वैसे तो कोविड महामारी की मार पूरे देश ने झेली है लेकिन महिलाओं और लड़कियों ने इसकी और भी ज्यादा कीमत चुकाई है। सरकारें इस समस्या को पहचानें और इसका हल निकालें, यह उम्मीद करना भी शायद मजाक ही होगा। वैसे तो देश की सभी महिलाएं कामकाजी महिलाएं हैं। कोई स्त्री घर के अंदर काम करती है, तो कोई घर के अंदर और बाहर, दोनों जगहों पर काम करती है। लेकिन हमारा समाज महिला के काम को काम ही नहीं मानता। ऐसी स्थिति में काम के दाम मिलें, यह उम्मीद रखने की तो सोचना भी मुश्किल है। जाहिर है कि इन हालात में महामारी की मार तो स्त्री को झेलनी ही थी!

आज महिलाओं के खिलाफ लैंगिक हिंसा भी आम हो चली है। गांवों, शहरों और कस्बों से बलात्कार एवं जातीय हिंसा की खबरें रोज सुनने को मिलती रहती हैं। कई बार तो सत्ता में बैठे लोगों के द्वारा भी हिंसा किए जाने की खबर हमें चौंकाती है। इन घटनाओं और खबरों पर राजनीतिक पुरुषों की प्रतिक्रियाएं भी अचंभित करने वाली होती हैं। स्त्री को सुरक्षा और न्याय दिलाने की बजाय वे महिला को ही हिंसा का दोषी ठहराते हैं, या कहते हैं कि बलात्कार की कोई घटना हुई ही नहीं है। दोषियों को सजा दिलवाना तो दूर रहा, वे दोषियों को बचाने की पूरी कोशिश में लग जाते हैं। फिर घटना के साथ जाति एवं मजहब भी जोड़ दिया जाता है। कुल मिलाके देश की बेटियों को असुरक्षा और हिंसा की घटना के साथ ही जीवन व्यतीत करने का अनुभव होता है। हालात से लड़ने की जिम्मेदारी लड़की और उसके परिवार की होकर रह जाती है, जो इस समस्या से अपने दम जूझने को विवश दिखलाई पड़ते हैं।

भारत का संविधान स्त्री नागरिकों को समान अधिकार देता है। इसके बावजूद समाज में स्त्रियों से खुले आम अन्याय होता है। जब बेटी आगे बढ़ेगी तो ही परिवार आगे बढ़ेगा और समाज एवं देश आगे बढ़ेगा। आज भी कुछ विशेष हालात में जन्मी स्त्रियों को छोड़कर अन्य सभी स्त्रियां शिक्षा एवं प्रगति के अवसर से वंचित रह जाती हैं। संविधान में व्यवस्था के बावजूद आज तक हमारा समाज और हमारे देश की राजनीति मूलभूत रूप से पुरुष प्रधान है। अधिकतर स्त्रियों को अपनी मानवीय गरिमा एवं क्षमता पूर्ण रूप से हासिल करना 21वीं सदी में भी मुश्किल है। देश की बेटियों को समान हक और न्याय तभी मिल पाएगा जब सरकार, राज्य व्यवस्था, समाज और विशेष रूप से पुरु ष समाज इसकी ओर प्रतिबद्ध हो। इनकी गैर-मौजूदगी में स्त्री समानता एक ख्वाब ही रहेगा।

जब किराये की कोख से आने लगे धनाढ्य लोगों के बच्चे

कहा तो यह जाता है कि जो महिलाएं गर्भधारण नहीं कर सकतीं या जिनकी उम्र ज्यादा है, वे सरोगेसी की मदद से मां बनने की कोशिश करती हैं। जैसे कि हाल ही में मशहूर अभिनेत्री प्रियंका चोपड़ा या प्रीति जिंटा मां बनी हैं।

मगर यह हमेशा का सच नहीं है। कई माता-पिता जिनके बच्चे कुछ बड़े हो गए हैं, वे भी इस तकनीक की मदद से बच्चे पैदा करा रहे हैं, जैसे आमिर खान या शाहरुख खान। कई धनाढ्य या हस्तियां जो अविवाहित हैं, उन्होंने भी इस तकनीक की मदद से बच्चे का सुख प्राप्त किया है, जैसे कि निर्माता एकता कपूर, उनके भाई अभिनेता तुषार कपूर और करण जौहर। यह परंपरा धनाढ्य वर्ग में जोर पकड़ती जा रही है। क्या हम उस ओर बढ़ रहे हैं, जहां सक्षम महिलाएं शायद गर्भधारण और प्रसव पीड़ा से गुजरना ही न चाहें?

तकनीक ने बदलाव का रास्ता आसान कर दिया है। एक समय में विदेशी भी भारत में इस तकनीक से बच्चा प्राप्त करने के लिए बड़ी संख्या में आते रहे हैं। क्योंकि विदेश के मुकाबले भारत में यह तकनीक बहुत सस्ती है। एक अनुमान है कि इसमें तेरह-चौदह लाख रुपये तक का खर्च आता है, लेकिन कई बार ऐसा होता है कि तमाम मानवाधिकारों तक को भुला दिया जाता है। भारत में एक ऑस्ट्रेलियाई दम्पत्ति को जुड़वां बच्चे हुए थे, एक लड़का और एक लड़की। मगर वे लड़के को यहां यह कहकर छोड़ गए कि उन्हें लड़का नहीं चाहिए, क्योंकि उनका एक लड़का पहले से है। कितना दुखद है कि एक बच्चा जन्मते ही माता-पिता के होते हुए भी इस दुनिया में अकेला रह गया। बच्चा चुनने या छोड़ देने का यह अधिकार किसी को ताकत या धन के आधार पर देना कहां तक उचित है?

ऐसी ही बहुत सी घटनाएं रही होंगी, जिस कारण से भारत सरकार ने विदेशियों को यहां से सरोगेसी के जरिए बच्चा प्राप्त करने पर रोक लगा दी। इस तकनीक से कुछ महिलाएं तो लगभग हर साल बच्चे पैदा कर रही थीं। उनके स्वास्थ्य पर किसी का कोई ध्यान नहीं था। धन केलोभ महिलाएं भी अपने स्वास्थ्य से समझौता करने लगी थीं। अधिक बच्चों का जन्म महिलाओं के स्वास्थ्य पर बुरा असर डालता है। पहले ही भारत में जचगी के दौरान एनीमिक होने या खून की कमी के कारण बड़ी संख्या में महिलाओं की मौत हो जाती है।

स्त्रीवादियों द्वारा यह आरोप भी लगाया जाता है कि एक स्त्री की कोख को व्यवसाय अपने हितों के लिए इस्तेमाल कर रहा है। स्त्री के मां बनने के अधिकार को पैसे से खरीदा जा रहा है। वे इसे पैसे वालों का गरीब स्त्री के शरीर पर आक्रमण भी बताते हैं। वे औरत के शरीर को बच्चा पैदा करने वाली मशीन बनाने का विरोध भी करते हैं, जो सही भी है।

अपने यहां माना जाता है कि कोख से पवित्र कुछ नहीं है। बच्चे पर पहला अधिकार उस मां का होता है, जिसने उसे जन्म दिया। मगर यहां तो जो मां जन्म देती है, जन्मते ही बच्चे को उससे अलग कर दिया जाता है। जो स्वयं जन्म नहीं देती, जो प्रसव पीड़ा नहीं झेलती, वह पूरे अधिकार से मां बनकर बच्चे को ले जाती है। जन्म देने वाली मां की पहचान हमेशा केलिए खो जाती है। ऐसी कोख से जन्म लेने वाला बच्चा जब बड़ा होगा, तो क्या वह जन्म देने वाली मां को खोजेगा, क्या वह ममता का सही व स्वाभाविक मोल समझेगा? माना जाता है कि चूंकि बच्चे को जन्म देने के लिए मां को पैसे दिए गए हैं, इसलिए उसका उस पर कोई अधिकार नहीं है। जबकि गर्भावस्था के दौरान मां और बच्चे के बीच भावनात्मक सम्बंध जुड़ जाता है। यदि यह सम्बंध न हो, तो यह बच्चे के स्वास्थ्य और मानसिक विकास के लिए बुरा है। बच्चे और मां के बीच जो नाभि-नाल सम्बंध होता है, उसे बिल्कुल भुला दिया जाता है। आज स्टेम सेल विज्ञान इसी नाल से तमाम ऐसी बीमारियों का इलाज खोज रहा है, जिन्हें आज तक लाइलाज माना जाता है।

बच्चे के विकास के लिए भावनात्मक सम्बंध कितने जरूरी हैं, आखिर इस पर ध्यान क्यों नहीं दिया जाता? हाल ही में हुई रिसर्च ने बताया था कि बच्चे अपनी मां को खुशबू से पहचानते हैं। जब तक वे भाषा नहीं सीखते, तब तक इसी खुशबू से काम चलाते हैं। आपने देखा ही होगा कि किसी दूसरे की गोद में अगर बच्चा रो रहा है, तो वह अपनी मां की गोद में आते ही चुप हो जाता है। यह खुशबू जन्म देने वाली मां की ही होती है। सरोगेसी से जन्मे बच्चे आखिर इस गंध को कहां से पाते होंगे? इस लेखिका ने कई वीडियो में भी ऐसा देखा है कि बच्चे जन्म के बाद जब अपनी मां के पास लाए गए, तो वे उन्हें सूंघने लगे। पैसे देकर किसी बच्चे को जन्मते ही खरीदना एक तरह से बच्चे के अधिकार का हनन तो है ही, उसे एक उत्पाद बना देना भी है। जैसे एक साबुन, शैम्पू या बिस्कुट, कपड़ा, आप बाजार से खरीदते हैं, उसी प्रकार पैसे देकर बच्चे भी खरीद सकते हैं।
