When govts intervene in matters of personal and religious choice, social peace & livelihoods suffer

First there was uproar on hijab, then a controversy over halal meat, next an outcry against azaan on loudspeakers. A series of communal dog-whistles have created a situation where religious processions have led to communal clashes in both BJP and opposition governed states.

And when government bulldozers demolish homes and commercial establishments without first seeking judicial process, vital reconciliation between citizens cannot take place.

Fanning the flames of religious hatred in mixed neighbourhoods has led to a spiral of violence. There are many reasons for the hate hysteria: social media fallout, failure of the police and the role of Hindu and Islamic groups engaging in action and reaction on the ground.

But the root of the problem is the state’s failure to be non-partisan and governments meddling in social, religious and private matters of food, dress and modes of worship. If any of these cause disputes, these are best left to courts, citizens groups, and institutions to negotiate and navigate through dialogue between local stakeholders.

In Haryana the government took it upon itself to force out namazis practising open air namaz, with the CM declaring such a practice would not be tolerated. Ideally the matter should have been resolved through a citizens’ dialogue or judicial process in which all sides were heard.

If the state becomes the sponsor of identity, new political adventurers will jump in demanding state protection for a growing list of new flags and totems. Are governments going to endlessly keep shoring up identity divides? UP’s ‘love jihad’ law is another example of state intrusion into personal choices. Family or clan objections to inter-faith couples need to be privately resolved, if needed by recourse to existing laws. Why must the bullying state intervene through specific legislation as if to penalise certain personal relationships?

UP CM Yogi Adityanath has recently announced that no religious processions will be allowed without police permission. A tough-sounding move, but will the UP administration be even-handed in ensuring that the law prevails across communities?

In Uttarakhand, CM Pushkar Dhami has issued instructions to conduct a verification of residents. The state may end up circumscribing citizens’ constitutional rights to move freely throughout India without restrictions, explicitly provided in Article 19.

Of course, every party practises partisan politics through state instruments. In Bengal, the Left’s state capture entrenched one-party rule and TMC is now accused of similar intimidation of rivals.

BJP though seems to have taken partisanship on religious issues to another level. In Karnataka the Bommai government first brought in an anti-conversion bill, which was seen as targeting the Christian community. The government then took a stand against hijab, then certain ministers supported boycott of Muslim vendors at Hindu temple fairs, and ruling party officials inveighed against halal meat.

By excluding citizens from the meat business or fairs, the government is gravely interfering in citizens’ right to livelihoods. It required a sharp intervention from entrepreneur Kiran Majumdar Shaw for the Bommai government to back off.

State sponsorship of identity opens a Pandora’s Box. When Rajput Karni Sena went on a violent rampage against the film Padmaavat , politicians across party lines were helpless, because governments today see organised identities as vote banks.

But in the process of patronising groups, individual freedoms are being lost. The freedom to eat, worship, marry, dress, watch movies are all in danger if state power is harnessed to moral policing informed by any ideological position. If arbitrary government action is welded to majoritarian groups then minorities will always feel paranoid and some majority groups will be recklessly emboldened.

Constitutional functionaries should not publicly cast moral judgement against a citizen wearing ripped jeans nor should governments intervene in students’ dress codes. In a rights-based republic, institutions and individuals must be at liberty to decide on clothing. Similarly, meat eating is a legal right, which cannot be taken away on grounds of religion or culture.

The principle of constitutional democracy is that we enjoy our freedoms because others enjoy theirs. Vegetarians have every right to exercise their freedom to reject meat, equally non-vegetarians have their right to eat the food of their choice. The point is, no group should be able to access state power or mob power to impose their own personal choices on others.

Gandhi believed passionately in vegetarianism and celibacy but did not seek to impose these values on others through state power or laws. Ambedkar became a Buddhist but did not seek state support for Buddhism.

Yet the rising Hindu Right is blurring the lines and some groups are whipping up communal passions, demanding state patronage and often obtaining it. Only token arrests were made after a dharam sansad became the platform for calls for communal violence. On the other side of the divide Islamist groups are galvanising hotheads within the community.

Instead of taking sides on religious and cultural matters, governments need to focus on the basic task: Impartially upholding law and order and respecting individual dignity.

A Modern Traditional Option for Healthcare

The establishment of the World Health Organisation (WHO) Global Centre for Traditional Medicine (GCTM) is a major step that could help achieve the 2030 goal of universal healthcare. Nearly 80% of the world’s population relies on traditional medicine. Despite that, there has been little effort to base traditional medicine in evidence and data.

Much of traditional medicine is based on received knowledge and home remedies. Faith and transgenerational anecdotal evidence have been its mainstay, remedies a free market for anyone with persuasive skills. The WHO GCTM is a concrete step to change this by working on four strategic areas: evidence and learning; data and analytics; sustainability and equity; and innovation and technology to optimise the contribution of traditional medicine to global health. Ensuring that traditional medicine in rooted in evidence, data and analytics will give it equal footing with modern medicine systems. A solid evidence base for traditional medicine will help countries integrate it as appropriate into their health systems. The collaborative nature — 32 memoranda of understanding (MoUs) with universities and research centres across WHO member countries — of the centre will make this possible. Traditional medicine must not remain the option for those who do not have access to modern medicine or the ignorant.

Health systems are about maintaining health, preventing disease, diagnosing and treatment. The goal is to create a system with universal access and acceptability, based in science, which uses technological advances, focuses on well being, prevention, diagnosis and treatment by deploying the best available solutions, be they ‘traditional’ or ‘modern’ medicine. With its strong base in traditional medicine, India is a natural home for this endeavour.

Need Aatmanirbhar Naari

India Inc can help change social norms holding back women from the workplace

Horror of horrors, Saudi Arabian women now have a much higher work participation rate than Indian women. In recent years, Saudi Arabia has had a series of reforms to reduce gender discrimination, resulting in women in large numbers, across age groups, joining the labour force. Published data show that Saudi women’s labour force participation has increased from 18% in 2016 to 33% in 2020.

Meanwhile, in India, women’s workforce participation has been on afree fall. As per government data, it fell from 31% in 2012 to 21% in 2021. Other data sources, such as the Centre for Monitoring Indian Economy (CMIE), give a much lower statistic of 11-12%.

Alas, no one is losing sleep over Indian women’s low and falling work participation rate. India has not seen reforms on this front similar to Saudi Arabia. Women’s employment is not included in GoI’s aatmanirbharta agenda, or in making India a $5 trillion economy, or in earlier slogans such as India Shining.

It is tempting to conclude from these data that gender norms are worsening, and that years of very high economic growth have failed to open economic opportunities for Indian women. On recent field visits, I found that the reality was more complicated on account of a large set of factors. These factors had less to do with the market, and more to do with cultural and societal norms that do not take pride in women’s employment and the interaction of these norms with caste divisions and rising levels of seasonal migration.

Two months ago, I visited villages in Uttar Pradesh and Haryana and asked several groups of women why women’s workforce participation is low and falling in rural India. In a dalit village in Badhoi district in eastern UP, one group of women mentionedsexual harassment by men of higher caste as the primary cause of women’s workforce withdrawal. ‘Sexual harassment was common and accepted by our ancestors. Not any more. We refuse to work for them,’ said one woman angrily. Clearly, for this group, withdrawal from the workforce helped end generational exploitation and harassment from highercaste men.

Veiled Attack

Another woman — holding a smartphone, and hiding her face in her ghoonghat — dismissed my concerns with the following response, ‘There is a lot of work at home. We don’t get the time to go out to work. ’ To which women around her retorted, ‘Her husband sends her enough from the city that she does not need to work. ’ The woman in the ghoonghat simply smiled.

An activist, who was visiting from Puna, an important destination for migrant workers in UP, explained things to me. When the entire family migrates, women, men and their children, they all work in factories in the city. But if only the male member of the family migrates, the women back home prefer to exit the workforce. Perhaps they feel more insecure and vulnerable without their husbands. Here, too, women’s withdrawal suggests escape from exploitation.

Another villager added that the biradari (community) does not respect households that have women working outside. People are reluctant to marry their sons or daughters to families where women go out to work. When asked whether they would like their daughters to get school or college education, most people said yes. But what is the use of such education, if they are not going to work? Education improves marriageability, is the reply. No one wants to marry their sons to illiterate girls.

In a village in Mirzapur district, I met a group of young girls, aged 16 to 25, who have been in contact with an NGO and have aspirations to be independent. One girl in the group said, ‘You have no idea how much pressure we face from our families. We have to fight with our families to attend meetings like this and to discuss our future work prospects. ’ Another added, ‘We face constant pressure to get married. Once married, we are pressurised to have children. ’ If there is no child within a year after marriage, parents and in-laws begin to worry there might be something wrong with the marriage.

One girl in the group said, ‘Time is ticking for us. If we do not get a job within a certain time, our parents will marry us off and that would be the end of our career. ’ These young girls did not fear discrimination at the workplace. They faced a much bigger challenge — centuries-old cultural norms that do not approve of working women.

Minions With Opinions

My travels next took me to a village in Haryana, where I met a group of around 25 girls who worked as krishi sathis (village companions) with a pesticide company introducing farmers to new technologies. Their ages, as with the Mirzapur girls, varied from 18 to 25. Many were working while enrolled in part-time college. Many were married, and four of them earned more than their husbands. ‘It feels really nice when my father-inlaw asks for my advice for important decisions about the household such as making large purchases and future investments,’ said one. Her mother and mother-in-law did not get such respect.

The pesticide company hired only women for this job. Such gender sensitivity is rare. Corporations can play a role in changing social norms. But that will take a long time.

Unfounded apprehensions about this Act

In the Criminal Procedure (Identification) Act, data collection does not seem disproportionate with the Act’s objectives

The Criminal Procedure (Identification) Bill, 2022 (now Act), that received the President’s assent on April 18 and ‘shall come into force on the day of such notification’, has raised eyebrows. The Act authorises the police and prison authorities to take ‘measurements’ of convicts and others for the purpose of identification and investigation in criminal matters and to preserve records. The allegation is that the Act is unconstitutional and may be subject to misuse. The Act seeks to repeal the Identification of Prisoners Act (IPA) of 1920, whose scope was limited to recording measurements which include finger impressions and footprint impressions of certain convicts and non-convict persons.

Broader scope

While the scope of the ‘measurements’ in the IPA was limited, the Act now includes physical measurements such as finger impressions, palm prints, footprint impressions, photographs, iris and retina scans; biological samples and their analysis; and behavioural attributes including signatures, handwriting; or any other examination referred to in Sections 53 or 53A of the Code of Criminal Procedure (CrPC), 1973.

The CrPC provides for ‘examination’ (of the accused by a medical practitioner) which includes examination of blood, semen, swabs (in the case of sexual offences), sputum and sweat, hair samples and fingernail clippings using modern and scientific techniques including DNA profiling and other necessary tests which could provide evidence as to the commission of an offence. Similarly, Section 311A of the CrPC empowers a magistrate to direct any person (including an accused person) to give a specimen signature or handwriting for the purpose of any investigation or proceedings.

It is evident that the apparently enlarged scope of ‘measurements’ in the Act is nothing but a merger of the scope of ‘measurements’ in the IPA and provisions of the CrPC highlighted above, with the addition of modern techniques of identification such as an iris and retina scan. Thus, the Act does not empower the enforcement agencies additionally but only explicitly provides for various measurements and includes the use of the latest scientific techniques.

The old code, the Code of Criminal Procedure, 1898, did not have the provision of medical examination of the accused. The Law Commission, in its 41st Report (1969), considered the necessity of physical examination of the arrested person for an effective investigation, without offending Article 20(3) of the Constitution. The recommendation was included in the CrPC (of 1973), as Section 53. Later, an amendment was made in the CrPC (with effect from June 23, 2006) and an Explanation of ‘examination’ was added to Section 53 to provide legal backing to materials/biological samples on which the medical examination could be conducted. Similarly, Section 311A was added to facilitate providing a specimen signature or handwriting during investigation.

A settled constitutionality

As early as 1961, the Supreme Court of India in State of Bombay vs Kathi Kalu held that the person in custody giving his specimen handwriting or signature or impression of his thumb, finger, palm or foot, to the investigating officer, cannot be included in the expression “to be a witness” under Articles 20(3) of the Constitution. Similarly, in a catena of cases, it has been held that taking a blood sample for the purpose of a DNA test, taking a hair sample or voice sample will not amount to compelling an accused to become a witness against himself, as such samples by themselves are innocuous and do not convey information within personal knowledge of the accused. Thus, the constitutionality of collecting biological samples or other measurements for facilitating investigation, has been settled since long.

The only exceptions are scientific techniques, namely narcoanalysis, polygraphy and brain fingerprinting which the Supreme Court in Selvi vs State of Karnataka (2010) held to be testimonial compulsions (if conducted without consent), and thus prohibited under Article 20(3) of the Constitution. These tests do not fall under the scope of expression “such other tests” in Explanation of Section 53 of the CrPC. The Court also laid down certain guidelines for these tests.

Since the Act does not lay down any specific scientific tests for the analysis of biological samples or otherwise, taking any sample or measurements for the sake of identification or comparison would not automatically violate any constitutional provision. The validity of any new scientific technique, to be applied in future, would need to be tested on the touchstone of permissible restrictions on fundamental rights.

The IPA includes three categories of persons, namely, ‘convicts of any offence punishable with rigorous imprisonment for a term of one year or upwards or of any offence which would render him liable to enhanced punishment on a subsequent conviction; persons ordered to give security for their good behaviour; and persons arrested in connection with an offence punishable with rigorous imprisonment for a term of one year or upwards’.

No harm is likely

The Act has done away with any such limitation for convicts and arrested persons. However, it is important to note that most offences punishable with imprisonment up to one year are non-cognisable. Otherwise too, for example, in a simple cognisable offence (though punishable with simple imprisonment up to only one month or fine) of a chakka-jam (which generally take place during political and other protests), though arrest may become necessary to clear the road and prevent a continuing offence, no biological samples would be required normally to facilitate investigation. Only physical measurements would be sufficient to record identity. Further, not only has the amended Section 41(1) of the CrPC put limitations on arrest in cognisable offences punishable with imprisonment up to seven years, but the Act also makes a non-obligatory provision for giving biological samples in such cases. Thus, by expanding the scope of measurements, no harm is likely to be done to an individuals’ privacy. Measurements per se do not reveal any inculpatory information.

The provision for persons ordered to give security for good behaviour or maintaining peace, the provision regarding refusal or resistance to allow taking of measurements, and the provision relating to the power of the magistrate to direct a person to give measurements for the purpose of any investigation, remain the same as provided for in the IPA.

Records of juveniles

Though the Act does not explicitly bar taking measurements of juveniles, the provisions of the (Special Act) Juvenile Justice Act, 2015 regarding destruction of records of conviction under the Act, shall apply. Since no disqualification can be attached to a conviction of an offence by a juvenile, no measurement (if taken) can be used for any future reference. The legislature has purposefully avoided the word “arrest” in the entire Juvenile Justice Act. A first information report is to be written only in heinous cases (offences punishable with imprisonment for seven years or more). In all other cases, delinquent juveniles are produced before the Juvenile Justice Board along with a general daily diary report and social background report. The power to apprehend is to be exercised only regarding heinous offence, unless it is in the best interest of the child.

However, it would have been prudent to add a provision in the Act for juveniles for clarity and allay any doubts. Similarly, since the records of juveniles are required to be erased, the period of storage of measurements of adults could have been conveniently reduced by 10 years, as the probability of committing a crime by any person after the age of 80 years is negligible. The Crime in India – 2020statistics published by the National Crime Records Bureau (NCRB) shows that the number of arrested persons over 60 years of age is less than 1.5%.

The Act does not mandate the compulsory recording of all measurements for all types of offences. The measurements shall be taken ‘if so required’ and as may be prescribed by governments. The purpose is to help the enforcement agencies in the prevention and the detection of crime. The NCRB will store, process, and preserve whatever data is collected by the States and Union Territories. The Crime and Criminal Tracking Network & Systems (CCTNS) data have only helped enforcement agencies across States in matching missing persons with found persons and unidentified bodies, matching lost/stolen mobile phones and vehicles with the recovered ones, tracking habitual criminals and inter-State gangs, etc.

The biological sample of an accused person is required during investigation for comparison with seized body fluids and blood from the scene of crime to establish linkage. Signature and handwriting specimens are taken for comparison with those on disputed or forged documents. Similarly, since fingerprints are unique in nature, latent chance finger impressions lifted from the scene of crime are admitted as clinching evidence in a court of law to establish the presence of the accused. Access to biometrics collected by the Unique Identification Authority of India (UIDAI) has been refused to enforcement agencies on the pretext of ‘technology issues’ and strict provisions of the concerning law. The matter is pending with the Delhi High Court and the Supreme Court.

Better technology cuts errors

The objective of the Act is to facilitate identification and investigation in criminal matters. Enforcement agencies must be allowed to use scientific methods to prevent and detect crime. A number of analytical tools can be applied nowadays to the database of measurements to do predictive policing (which is very common in developed countries). The use of better technology will only help in minimising the probability of errors. The right of an individual will have to be considered in the background of the interests of society. The data proposed to be collected through measurements of convicts and others does not appear to be disproportionate with the stated objectives of the Act.

The Delhi MCA Act denudes the spirit of federalism

The interference of the Centre in matters such as municipal issues strikes a blow against the model of decentralisation

When the State Election Commission of Delhi had called a press conference at 5 p.m. on March 9, 2022, it was widely reported that the schedule for the elections to the three Municipal Corporations of Delhi would be declared. However, the State Election Commissioner (SEC), S.K. Srivastava, informed the media that it would be deferring the announcement following a letter from the Centre just earlier proposing the unification of the three municipal corporations.

Large-scale usurpation

In less than a month, both Houses of Parliament passed the Delhi Municipal Corporation (Amendment) Act, 2022. In a move that appears to simply unify the trifurcated Delhi Municipal Corporations, the Central government has conferred upon itself various crucial powers to assume control over the Municipal Corporation of Delhi from the State government. The casualty of these changes introduced by the Central government is federalism.

The Central government’s line is that the amendment has been passed as in Article 239AA of the Constitution, which is a provision that provides for special status to Delhi. The Union Home Minister, Amit Shah, stated in Parliament that the law is based on the power of Parliament under Article 239AA(3)(b) to make laws for the State of Delhi “on any matter”. The law provides that the power to determine the number of wards, extent of each ward, reservation of seats, number of seats of the Corporation, etc. will now be vested in the Central government. The number of seats of councillors in the Municipal Corporations of Delhi is also to be decided now by the Central government. By exercising that very power, the number of councillors to the Municipal Corporations of Delhi has been reduced from 272 to 250.

The Central government has also taken over powers from the State to decide on matters such as ‘salary and allowances, leave of absence of the Commissioner, the sanctioning of consolidation of loans by a corporation, and sanctioning suits for compensation against the Commissioner for the loss or waste or misapplication of municipal fund or property’. The large-scale usurpation of powers by the Central government has been done without any consultation with the Delhi government, and all the major stakeholders kept in the dark during the process.

Dent in federal architecture

The Central government has consciously chosen to overlook Part IXA of the Constitution that specifically states that it will be the Legislature of the State that will be empowered to make laws concerning representation to the municipalities. The argument of the Centre that Article 239AA can be applied over and above Part IXA of the Constitution does not hold good as the latter is a specific law that will override the general law relatable to Article 239AA. Further, Part IXA of the Constitution concerning municipalities was inserted into the Constitution through the Seventy-Fourth Constitutional Amendment Act of 1992 and it succeeded the Sixty Ninth Amendment Act of 1991 that brought in Article 239AA. Therefore, it can be meaningfully concluded that if the intention of Parliament was to exclude Delhi from the purport of Part IXA, it would have specifically spelt so.

No consultation

The Delhi Municipal Corporation was split into three regions, i.e., east, south and north, in 2011 after much deliberation and discussion at various levels. The split-up was first proposed in the 1987 Balakrishnan Committee Report which was bolstered in the 2001 Virendra Prakash Committee Report. A seven-member Delhi Legislative Assembly Panel was set up in 2001 to study the recommendations and suggest modalities.

Since the recommendations had to be processed by the Central government, another committee was constituted under the chairmanship of Ashok Pradhan to study the issue. The proposal finally took shape in 2011 and the law to trifurcate was enacted. Although the plan to split up the Delhi Municipal Corporation was well thought-out and studied, the decision to reunify has been done at the behest of the Central government without any study or consultation.

Article 239AA has, from its very enactment, been subject to numerous litigations and its scope finally determined by the Supreme Court of India in the famous State of NCT of Delhi vs Union of India judgment pronounced in 2018.

Potential for litigation

The Court held, “The Constitution has mandated a federal balance wherein independence of a certain required degree is assured to the State Governments. As opposed to centralism, a balanced federal structure mandates that the Union does not usurp all powers and the States enjoy freedom without any unsolicited interference from the Central Government with respect to matters which exclusively fall within their domain.” It was made clear in no uncertain terms that the aid and the advice of the State government of Delhi would bind the decision of the Lieutenant General in matters where the State government has the power to legislate. No doubt, the amendment to the Delhi Municipal Corporation Act, 1957 will lead to further litigation on the aspect of a sharing of powers between the State of NCT of Delhi and the Central government. The interference of the Centre in matters such as municipal issues strikes a blow against federalism and the celebrated Indian model of decentralisation.

कंज्यूमर गुड्स की मांग में कमी अच्छे संकेत नहीं

महंगाई का लगातार बढ़ना अर्थ-व्यवस्था के लिए खतरे की घंटी है। एक रिपोर्ट के अनुसार ग्रामीण भारत में और खासकर गरीब तबके में अचानक टूथपेस्ट से लेकर साबुन-तेल तक सभी उपभोक्ता सामग्री की खपत कम हो गई है। जीवन जीने के लिए आवश्यक अनाज, सब्जियों और खाद्य तेल की कीमत पहले से ही बढ़ी हुई थीं, जिनमें कटौती करना संभव नहीं था। लिहाजा अन्य उपभोक्ता सामानों की खपत कम करना मजबूरी हो गई है। उधर आरबीआई ने भी माना है कि महंगाई दर उसकी उम्मीद से ज्यादा बढ़ रही है, लगातार छठवें महीने में यह बढ़कर मार्च में 6.95% हो चुकी है। दुनिया के अन्य बड़े देश जैसे ब्रिटेन और अमरीका भी इस संकट से जूझ रहे हैं। भारत में इस स्थिति का सबसे बड़ा दुष्प्रभाव एमएसएमई सेक्टर पर होगा, क्योंकि निर्मित सामान का न बिकना उनकी लिक्विडिटी को कम करेगा, जिससे वे उत्पादन रोक देंगे। इससे रोजगार कम होगा यानी देश में बेरोजगारी और बढ़ेगी। शायद इन्हीं तथ्यों के मद्देनजर प्रधानमंत्री ने जनता से स्वदेशी सामान खरीदने की अपील की है। लेकिन यहां खरीद में विदेशी-स्वदेशी के बीच चुनाव की बात तो तब आएगी जब आम जनता उन्हें खरीदने की स्थिति में हो। दूसरा, बड़ी और मल्टी-नेशनल कंपनियां तो अपने सामान की कीमत घटा भी सकती हैं लेकिन एमएसएमई सेक्टर तो इस हालत में भी नहीं होता कि वह तेल-साबुन की दरों में कटौती करके व्यापार में बना रहे। सरकार को अगर स्वदेशी उत्पाद के लिए जनता को प्रेरित करना है तो उत्पादों की गुणवत्ता और उत्पादन लागत में कमी के लिए कौशल-विकास, नई तकनीकी और उद्यमिता को गांव और कस्बों तक ले जाना होगा।

हाल ही में संयुक्त राष्ट्र के पर्यावरण कार्यक्रम की वार्षिक फ्रंटियर रिपोर्ट ने यूपी के मुरादाबाद को ध्वनि प्रदूषण के मामले में दुनिया का दूसरा सबसे प्रदूषित शहर करार दिया। दुनिया के 61 सबसे ध्वनि-प्रदूषित शहरों में भारत के पांच शामिल हैं। शेष चार हैं- कोलकाता, आसनसोल, जयपुर और दिल्ली। वहीं दुनिया का सबसे शांत शहर जोर्डन का इब्रिड है, जबकि दूसरे नम्बर पर फ्रांस का लियोन है।

ध्वनि-प्रदूषण यानी ध्वनि के स्तरों में नियमित बढ़ोतरी, जिसका मनुष्य या दूसरे जीवित प्राणियों पर बुरा असर पड़े। 1999 की गाइडलाइन के मुताबिक डब्ल्यूएचओ ने 70 डेसीबल्स से ऊपर की ध्वनियों को स्वास्थ्य के लिए हानिप्रद माना है। दरअसल पृथ्वी पर खमोशी जैसी कोई चीज नहीं है। हर तरफ ध्वनियां हैं। लेकिन जब ध्वनियां निरंतर और तीव्र होती हैं तो शोर बन जाती हैं। आज ध्वनि प्रदूषण को पर्यावरण के लिए एक प्रमुख खतरा माना गया है। जैसे-जैसे शहरों का विकास हो रहा है, रेल, सड़क, हवाई ट्रैफिक और उद्योगों से होने वाला ध्वनि प्रदूषण बढ़ता जा रहा है। घरेलू गतिविधियों और मनोरंजन के साधनों से भी इसमें बढ़ोतरी हो रही है। ध्वनि प्रदूषण के निरंतर सम्पर्क में रहने से तनाव, अनिद्रा, हृदय रोग, मेटाबोलिक डिसऑर्डर्स, बहरापन आदि समस्याएं हो सकती हैं। इससे लोकस्वास्थ्य पर दबाव बढ़ता है।

प्राणियों की अनेक प्रजातियों में अकूस्टिक-कम्युनिकेशन उनके बचाव में अहम भूमिका निभाता है। रिपोर्टों में पाया गया है कि आज अनेक प्रजातियों ने शहरीकरण से बढ़ रहे ध्वनि प्रदूषण से बचाव करने के लिए अपनी पिच, टाइमिंग और फ्रीक्वेंसी में बदलाव कर लिया है। मिसाल के तौर पर, यूरोपियन शहरों में रोबिन पक्षी अब रात में अधिक चहचहाने लगा है, ताकि दिन में होने वाले व्यवधानों से बच सके। कुछ मेंढक गैप-कॉलिंग बिहेवियर प्रदर्शित करने लगे हैं, ताकि शोर के बीच अपनी आवाज को बचा सकें। लम्बे समय में इस तरह के परिवर्तन उनकी प्रजनन-क्षमता को प्रभावित कर सकते हैं और उनके परम्परागत निवास स्थानों से उनके विलोप का कारण बन सकते हैं। बढ़ते शोर से केवल धरती के प्राणी ही प्रभावित नहीं, समुद्र में रहने वाले जीवों के लिए भी यह एक बड़ी समस्या है। जहाज, ऑइल ड्रिल्स, सोनार डिवाइसेस, भूकम्प सम्बंधी परीक्षणों आदि के चलते किसी जमाने में शांत रहने वाला समुद्री पर्यावरण भी कोलाहल और अराजकता से भर गया है। इससे ह्वेलों और डॉल्फिनों पर विशेष तौर पर असर पड़ा है।

दूसरी तरफ, प्राकृतिक ध्वनियां हमारे स्वास्थ्य के लिए अत्यंत लाभकारी होती हैं। बहती नदी, बारिश, हवा की आवाज, चिड़ियों की चहचहाहट से हम शांति महसूस करते हैं और रिलैक्स होते हैं। इसलिए व्यापक अर्थों में ध्वनि प्रदूषण का सामना करने के लिए आवाजों को खत्म करने की जरूरत नहीं है, बल्कि ऐसा वातावरण बनाना जरूरी है, जिसमें सभी प्रजातियां जी सकें। शहरी ध्वनि प्रदूषण की लगाम कसने के लिए आज पूरी दुनिया में प्रयास किए जा रहे हैं। हाईवे और एयरपोर्ट के समीप ट्री-बेल्ट बनाने से ध्वनि प्रदूषण को 2 डेसीबल तक घटाया जा सकता है। शहरों में सुनियोजित तरीके से हरियाली होने से भी ध्वनि प्रदूषण कम किया जा सकता है। रेलवे-ट्रैक और हाईवे पर साउंड बैरियर बनाए जाना जरूरी हैं, ऐसे इंजिन वाली गाड़ियों को प्राथमिकता दी जानी चाहिए जो कम शोर करते हों और लो-नॉइज़ अस्फाल्ट रोड सर्फेस का इस्तेमाल करना चाहिए। इलेक्ट्रिक वाहनों के उपयोग को बढ़ावा देना भी जरूरी है। आज पूरी दुनिया में साइकिल चलाने पर जोर दिया जा रहा है। व्यक्तिगत तौर पर हम भी इसमें योगदान दे सकते हैं। घरेलू उपकरणों को बंद करके, प्राइवेट स्पेस में वॉल्यूम कम करके, वाहनों की निरंतर सर्विसिंग पर ध्यान देकर, जरूरत पड़ने पर ईयर-प्लग का इस्तेमाल करके और पौधारोपण को बढ़ावा देकर हम एक खुशनुमा साउंडस्केप बना सकते हैं।

क्रिएटिविटी-इनोवेशन डे: दुनिया की समस्याएं इन्हीं से हल होंगी

कलात्मक सोच यानी क्रिएटिव थिंकिंग और नवाचार यानी इनोवेशन का विचार सदा से ही हमारे जीवन में बदलाव और बेहतरी की धुरी रहा है। सांस्कृतिक मूल्यों को सहेजने से लेकर वैज्ञानिक आविष्कारों को आम जीवन से जोड़ने तक, रचनात्मक समझ और नवोन्मेष का भाव जरूरी है, क्योंकि एक विचार कुछ सहेजने और दूसरा नया रचने से जुड़ा है। इसी समझ को बढ़ावा देने के लिए दुनियाभर में 21 अप्रैल को ‘विश्व रचनात्मकता और नवोन्मेष दिवस’ मनाते हैं।

हर साल एक विशेष विषय के साथ मनाए जाने वाले इस दिवस की इस बार की थीम ‘कॉलेब्रेशन’ यानी कि सहयोग है। इस दिन से क्रिएट, इनोवेट एंड कॉलेब्रेशन का भाव प्रमुखता से जुड़ा ही है। विचारणीय प्रश्न है कि किसी भी देश की सामाजिक और आर्थिक उन्नति में शिक्षा का बड़ा योगदान होता है। शिक्षा के क्षेत्र में नवाचार की अहम भूमिका होती है। हमारे देश के परिप्रेक्ष्य में तो यह बात और भी प्रमुखता से लागू होती है। जहां अपना कारोबार शुरू करने या पूंजी लगाने के हालात और कौशल भी हर किसी के पास नहीं हैं। साथ ही उद्यमशीलता के लिए मौजूद माहौल भी इतना सरल और सहायक नहीं। देश के कितने ही काबिल और होनहार विद्यार्थी नए शोध और अनुसंधान के लिए अन्य देशों को चुनते हैं। ऐसे में सहयोगी व्यवहार के साथ ही नए विचारों और नव-अनुसंधान को प्रोत्साहन देना सामाजिक और आर्थिक पहलुओं पर बड़ा बदलाव ला सकता है। बढ़ती बेरोजगारी और बदलते मानवीय व्यवहार के इस तकलीफदेह दौर में नवाचार और कला, जीवन को सहेजने वाले साबित हो सकते हैं।

रोजगार के मोर्चे पर ‘क्रिएटिव इकोनॉमी’ यानी कि रचनात्मक अर्थव्यवस्था अब सतत विकास का अहम् उपकरण बन गई है। संयुक्त राष्ट्र व्यापार और विकास सम्मेलन (अंकटाड) के मुताबिक रचनात्मक अर्थव्यवस्था, व्यापार, श्रम और उत्पादन सहित रचनात्मक उद्योगों के सभी भागों को समग्र रूप को परिभाषित करती है। गौरतलब है कि संयुक्त राष्ट्र की इस संस्था ने करीब 20 वर्षों से रचनात्मक वस्तुओं और सेवाओं में व्यापार की बदलती स्थितियों का लेखा-जोखा करते हुए पाया कि क्रिएटिव इकोनॉमी अब दूसरे उद्योगों से आगे काफी निकल गई है। साथ ही इंसानी जीवन में विकास और बेहतरी का हर पक्ष नवोन्मेष की गतिविधियों से तो जुड़ा ही है। विचारणीय है तो बस यह कि नवाचार और अनुसंधान की बदौलत जुटाई गई सुविधाओं व तकनीकों का इस्तेमाल सकारात्मक कार्यों के लिए हो। युद्धोन्माद-सीमाओं के विस्तार की सोच के इस दौर में हर देश के लिए यह मानवीय समझ रखना भी बेहद जरूरी है।

चिंतनीय यह भी है कि नवाचार से जुड़ी गतिविधियों और विचारों को कोरोना के दौर ने भी गहराई से प्रभावित किया है। दो वर्ष का यह ठहराव शोध व अनुसंधान के क्षेत्र में भी रुकावटें पैदा करने वाला ही रहा है। ऐसे में ‘सहयोग’ की थीम पर विचार करते हुए दुनिया के सभी देशों को यह समझना होगा कि नए विचारों के आगमन और अनुसंधान के बिना विकास के मार्ग पर आगे नहीं बढ़ा जा सकता। इतना ही नहीं उद्यमशीलता और कौशल विकास के लिए भी नए विचारों का होना भी आवश्यक है। साथ ही अनुसंधान और नूतन वैचारिक पहल अगर सृजनात्मकता के भाव भी जुड़ी हो तो रचने-सहेजने का सुखद मेल मानवीय जीवन के हर पक्ष को बेहतर बना सकता है।

सामाजिक न्याय का पूरा होता एजेंडा

भाजपा ने अपने 42वें स्थापना दिवस के अवसर पर सात से 20 अप्रैल तक सामाजिक न्याय पखवाड़े का आयोजन किया। इस दौरान पार्टी ने गरीबों के लिए चल रही सरकार की योजनाओं के प्रति देशवासियों को जागरूक किया। यह पखवाड़ा बाबा साहब डा. भीमराव आंबेडकर, ज्योतिबा फुले को भी समर्पित था, जिन्होंने सामाजिक न्याय को अपने जीवन में सर्वोच्च प्राथमिकता दी। प्रधानमंत्री मोदी ने इन महापुरुषों के सामाजिक न्याय के मंत्र को अपनी सुशासन की राजनीति का महत्वपूर्ण उपकरण बना दिया है। लोकतंत्र में सरकारें आती-जाती रहती हैं, लेकिन व्यक्ति को स्वावलंबी और राष्ट्र को आत्मनिर्भर बनाने की नीति ही ‘राष्ट्रनीति’ बन जाती है। इसी कारण हाल में उसे चार राज्यों में जीत मिली।

भाजपा की नीति, नीयत पर जनता का भरोसा बढ़ा है तो उसकी बड़ी वजह है-गरीब समर्थक और सक्रिय शासन। केंद्र से लेकर देश भर में जहां-जहां भाजपा की सरकारें हैं, वहां योजनाओं की डिलिवरी का सिस्टम बेहतर हुआ है। आयुष्मान भारत जैसी विश्व की सबसे बड़ी स्वास्थ्य योजना ने गरीबों की जेब पर इलाज और दवाइयों के भारी-भरकम बोझ को कम किया है। 17 करोड़ से ज्यादा आयुष्मान भारत कार्ड आज उस गरीब और वंचित तबके का संबल बने हैं, जिनके सामने अक्सर यह प्रश्न खड़ा रहता था कि अगर बीमार पड़ गए तो इलाज का पैसा कहां से आएगा? सबको पक्का मकान मिले, इस दिशा में जाति-मजहब से हटकर सभी वर्गों तक मोदी सरकार ने क्रांतिकारी पहल की। आज पीएम आवास योजना के अंतर्गत तीन करोड़ से अधिक मकान बनाए जा चुके हैं। इसी तरह जल जीवन मिशन देश के विकास को नई गति दे रहा है। आजादी के 70 वर्षों में देश के सिर्फ तीन करोड़ घरों में नल कनेक्शन था, इससे दोगुने से ज्यादा कनेक्शन सिर्फ तीन वर्षों में ही लगाए जा चुके हैं। किसानों को लेकर दशकों से सिर्फ बातें होती रहीं।

संप्रग सरकार के करीब 52 हजार करोड़ रुपये की कर्ज माफी की योजना का खूब ढिंढोरा पीटा गया, जो कागजों तक ही सीमित रही, लेकिन मोदी सरकार ने बीते कुछ वर्षों में ही 11 करोड़ से अधिक किसानों के बैंक खाते में सीधे पौने दो लाख करोड़ रुपये से अधिक की राशि पहुंचाकर अन्नदाताओं को सम्मान और सहारा दिया है। छात्रवृत्ति से लेकर स्टैंडअप इंडिया जैसी योजनाओं ने समाज के वंचित वर्गों के छात्रों और महिलाओं को एक नई पहचान दी है। अब तक 1.34 लाख लोग स्टैंडअप इंडिया योजना का लाभ उठा चुके हैं। इसमें 81 प्रतिशत से अधिक महिलाएं हैं। यह उद्यमिता के माध्यम से आर्थिक सशक्तीकरण एवं रोजगार सृजन का उदाहरण बनकर उभरी है। मुद्रा योजना के जरिये भी अब तक 34 करोड़ से ज्यादा लोगों को लोन स्वीकृत किए जा चुके हैं। इनमें 70 प्रतिशत से अधिक महिलाएं, 50 प्रतिशत से अधिक अनुसूचित जाति एवं जनजाति, पिछड़े वर्ग और वंचित समाज के लोग हैं।

समाज के अंतिम छोर के व्यक्ति तक लाभ पहुंचाने के विजन को आप पीएम स्वनिधि योजना के उदाहरण से भी समझ सकते हैं। कोविड के वक्त जब रेहड़ी-पटरी वालों की आजीविका पर संकट आया तो इसी योजना ने उन्हें सहारा दिया। इसका लाभ लेने वालों में 41 प्रतिशत संख्या महिलाओं की है तो पिछड़े वर्ग के 51 और अनुसूचित जाति/जनजाति वर्ग के 22 फीसद लोग इसके लाभार्थियों में शामिल हैं। कोविड काल में दो सौ करोड़ वैक्सीन की डोज लगाने के आंकड़े तक पहुंचता भारत आज दुनिया में अपनी सामर्थ्य दिखा रहा है और गरीब से गरीब व्यक्ति तक मुफ्त सुरक्षा कवच पहुंचा रहा है। इसी महामारी के दौर में शुरू पीएम गरीब कल्याण अन्न योजना ने गरीबों को बड़ा सहारा दिया है। अंतरराष्ट्रीय मुद्रा कोष इस प्रयास की खुले दिल से सराहना कर रहा है। इसी तरह विश्व बैंक ने भी माना है कि भारत में ग्रामीण क्षेत्रों में 2011 में जो गरीबी 26.3 फीसद थी, वह 2019 में घटकर 11.6 फीसद रह गई। इसी अवधि में शहरी क्षेत्रों में गरीबी 7.9 फीसद घटी।

आजादी के छह-सात दशकों तक 50 प्रतिशत से ज्यादा आबादी बैंकिंग सिस्टम से दूर थी, लेकिन जन-धन जैसी योजना से आज हर नागरिक बैंकिंग प्रणाली से जुड़ने लगा है और किसी तरह के भ्रष्टाचार के बिना केंद्र सरकार की योजनाओं का शत-प्रतिशत लाभ उठाने में समर्थ हुआ है। स्वच्छता अभियान हो या पोषण का मिशन, अब यह आंदोलन बन चुका है। कौन सोच सकता है कि कोई प्रधानमंत्री लाल किले से स्वच्छता या सामाजिक वर्जनाओं को तोड़ते हुए सैनिटरी पैड की बात करेगा। आज भारत अपनी आजादी का अमृत महोत्सव मना रहा है। इसके जरिये प्रधानमंत्री आजादी के आंदोलन में योगदान देने वाले समाज के उन महापुरुषों को भी सम्मान दिला रहे हैं, जिन्हें चंद परिवारों तक समेटकर रखा गया था। साफ है इतिहास का सही मायनों में लोकतांत्रिक बनाने की पहल प्रधानमंत्री मोदी ने ही की है।

नि:संदेह भाजपा की स्पष्ट नीति और नीयत से किए जाने वाले कामों की वजह से उसे जनता का भरपूर आशीर्वाद मिल रहा है। आज दलितों, पिछड़ों, आदिवासियों, किसानों, नौजवानों के साथ-साथ महिलाएं भाजपा के पक्ष में मजबूती से खड़ी हुई हैं, जो एक नए युग की ताकत का प्रतिबिंब है। आजादी के अमृत वर्ष में शुरू हुई स्वर्णिम वर्ष (2047) की अमृत यात्रा का लक्ष्य विराट है, क्योंकि अब जनकल्याण की हर योजनाओं को शत-प्रतिशत लोगों तक पहुंचाना है। इसके निहितार्थ स्पष्ट हैं। जाति-मजहब नहीं, बल्कि समाज के सभी वर्गों का समान विकास और आखिरी व्यक्ति तक सरकारी लाभ को पहुंचाना है। आज ऐसे नए भारत का निर्माण हो रहा है, जहां ‘सबका साथ, सबका विकास, सबका विश्वास और सबका प्रयास’ ही आधार स्तंभ है।

बेहतर विपणन से पनपेगा औषधीय पौधों का कारोबार

साधारण बीमारियों तथा तकलीफों के इलाज में अपेक्षाकृत सस्ती तथा पौधों आदि से बनने वाली दवाओं के बढ़ते इस्तेमाल के कारण देश में औषधीय पौधों की खेती आकर्षक कृषि कारोबार बन गया है। वनों में मिलने वाली जड़ी बूटियां जो विभिन्न प्रकार के उपचारों में काम आती थीं, वे तेजी से कम हो रही हैं। ऐसे में अब आवश्यक हो गया है कि इन औषधीय पौधों को खेतों में उगाया जाए ताकि औषधि, सौंदर्य प्रसाधन तथा अन्य उद्योगों में इनकी बढ़ती मांग को पूरा किया जा सके। इन पौधों की खेती में आम तौर पर बहुत अधिक निवेश की आवश्यकता नहीं होती, बहुत अधिक जमीन की जरूरत भी नहीं होती मगर ये बहुत अच्छी कीमत पर बिकते हैं। पौधों से संबंधित कृषि-आर्थिकी का कुछ ज्ञान अच्छा प्रतिफल पाने में अवश्य मददगार होता है। अब ऐसे विभिन्न मंच हैं जहां यह जानकारी तत्काल हासिल की जा सकती है। कई सरकारी और निजी संस्थान औषधीय पौधों की खेती का प्रशिक्षण देते हैं। जड़ी बूटियों से बनने वाली औषधियों तथा अन्य मूल्यवर्धित उत्पादों के अधिकांश बड़े निर्माता अनुबंधित कृषि पसंद करते हैं जहां वे उत्पादकों को साझी सहमति वाली कीमत पर पूरी उपज खरीदने की गारंटी देते हैं।

कई किसान उत्पादक संगठन और स्टार्ट अप भी इस क्षेत्र में आ गये हैं। उनमें से कई ने अपने ब्रांड भी बना लिए हैं। सबसे अहम बात यह है कि औषधीय जड़ी बूटियों, उनके सत्व तथा अन्य उत्पादों का निर्यात भी जोर पकड़ रहा है। वर्ष 2019-20 में भारत ने 53.9 करोड़ डॉलर की आयुर्वेदिक औषधियों, त्वचा की देखभाल से जुड़े उत्पादों तथा अन्य औषधीय उत्पादों का निर्यात किया। इसमें से ज्यादातर निर्यात यूरोप तथा अन्य विकसित देशों को किया गया।

विश्व स्वास्थ्य संगठन (डब्ल्यूएचओ) के मुताबिक दुनिया भर में 80 फीसदी से अधिक लोग मामूली स्वास्थ्य समस्याओं के लिए पौधों से बनी घरेलू दवाओं पर भरोसा करते हैं। आम तौर पर लोग प्राथमिक चिकित्सा के लिए देसी तरीकों पर ही भरोसा करते हैं। इससे भी अहम बात यह है कि फिलहाल इस्तेमाल हो रही करीब 40 फीसदी औषधीय सामग्री पौधों तथा अन्य प्राकृतिक चीजों से बनती हैं। भारत में पारंपरिक स्वास्थ्य प्रबंधन प्रणाली की जड़ें अन्य देशों की तुलना में कहीं अधिक गहरी हैं। आयुर्वेद के अलावा प्राचीन चिकित्सा प्रणाली का भी तेजी से आधुनिकीकरण हो रहा है। सिद्ध और यूनानी जैसी कई चिकित्सा पद्धतियां अब भारतीय स्वास्थ्य सेवा जगत का नियमित हिस्सा बन चुकी हैं। यहां तक कि होमियोपैथी जिसमें बड़ी तादाद में पौधों के सत्व का इस्तेमाल किया जाता है, वह भी देश में चिकित्सा पद्धति के रूप में स्थापित है। हाल ही में डब्ल्यूएचओ ने भारत के साथ एक समझौता किया, जिसके तहत गुजरात के जामनगर में पारंपरिक औषधियों का वैश्विक केंद्र स्थापित किया जाएगा। यह संस्थान आधुनिक विज्ञान और प्राद्योगिकी की मदद से दुनिया भर की पारंपरिक औषधि संबंधी ज्ञान जुटाने के लिए काम करेगा।

अच्छी बात यह है कि भारत में औषधीय और उपचारात्मक गुणों वाले पौधे प्रचुर मात्रा में उपलब्ध हैं। देश के 15 अच्छी तरह परिभाषित कृषि-जलवायु क्षेत्रों में करीब 18,000 तरह के पौधे पाये गए, जिनमें से आधे में चिकित्सकीय गुण हैं। भारतीय वनस्पति सर्वेक्षण ने करीब 8,000 चिकित्सकीय पौधों का रिकॉर्ड तैयार किया है। उनमें से कई हिमालय, पश्चिमी घाट और उन क्षेत्रों में पाये जाते हैं जो इंसानी हस्तक्षेप से बचे रहे मसलन अंडमान- निकोबार द्वीप समूह के कुछ हिस्से। उनमें से कई पौधों को देश के अलग-अलग हिस्सों में संरक्षित किया गया है। भारतीय वनस्पति सर्वेक्षण के अलावा कुछ अन्य संगठन मसलन नैशनल मेडिसिनल प्लांट बोर्ड (एनएमपीबी) और भारतीय कृषि अनुसंधान परिषद का नैशनल ब्यूरो ऑफ प्लांट जेनेटिक रिसोर्सेज आदि भी औषधीय पौधों के संरक्षण में लगे हैं। औषधीय पौधों की इस बड़ी तादाद में से करीब 2,800 प्रजातियां ऐसी हैं, जिनका भारतीय चिकित्सा व्यवस्था में व्यापक प्रयोग होता है। इनमें से करीब 1,000 की बाजार में काफी खरीद बिक्री की जाती है जबकि 200 पौधे ऐसे हैं जिनकी सालाना खरीद बिक्री 100 टन से अधिक है। तुलसी, एलो वेरा, ब्राह्मी, अश्वगंधा, इसबगोल और सेना जैसे व्यापक खपत वाले औषधीय पौधों की खेती से सालाना प्रति हेक्टेयर एक लाख रुपये तक का मुनाफा कमाया जा सकता है। शंखपुष्पी, अतीस, करंज, गुग्गल, बेल, सतावरी, कालमेघ, अशोक, गिलोय, सफेद मूसली और आंवला आदि वाणिज्यिक मूल्य वाले अन्य औषधीय पौधे हैं, जिनकी बाजार में अच्छी मांग है।

राजस्थान में सबसे अधिक रकबे में औषधीय पौधों की खेती होती है जबकि मध्य प्रदेश उत्पादन में सबसे आगे है। उत्तर प्रदेश, तमिलनाडु, पंजाब, छत्तीसगढ़, आंध्र प्रदेश और बिहार में भी इन पौधों की अच्छी मात्रा में खेती और उत्पादन होता है। कई अन्य राज्यों में भी औषधीय पौधों की खेती की संभावनायें छिपी हैं, जिनका दोहन अब तक नहीं किया गया है। बहरहाल औषधीय पौधों की खेती में विपणन का काम अब तक कमजोर रहा है क्योंकि बिचौलिये हावी रहे हैं। वे उत्पादकों तथा जंगल से इन जड़ी बूटियां बीनने वालों का शोषण करते हैं। कीमतों में पारदर्शिता नहीं है। अब आयुष (आयुर्वेद, योग, यूनानी, सिद्ध और होमियोपैथी) मंत्रालय यह समस्या हल करने की कोशिश कर रहा है। इस दिशा में ताजा पहल है ई-चरक की शुरुआत। यह इलेक्ट्रॉनिक प्लेटफॉर्म है जहां चिकित्सकीय पौधों से संबंधित हितधारक आपस में बातचीत कर सकते हैं। यह पोर्टल आयुष मंत्रालय के एनएमपीबी और सेंटर फॉर डेवलपमेंट ऑफ एडवांस कंप्यूटिंग (सी-डैक) ने मिलकर बनाया है। यहां विभिन्न उत्पादों की खरीद, बिक्री, उन्हें साझा करने का काम होता है और विभिन्न पक्ष जानकारी भी साझा करते हैं। चिकित्सकीय पौधा क्षेत्र के भरपूर विकास में मदद करने के लिए सुधारोन्मुखी हस्तक्षेप की आवश्यकता है।

शिक्षा की उड़ान

काफी समय से उच्च शिक्षण संस्थानों में बेहतरी और कौशल विकास संबंधी नए पाठ्यक्रमों को जोड़ने की सिफारिश की जाती रही है। मगर धन की कमी आदि के चलते इसके लिए संसाधन जुटाना संस्थानों के सामने एक बड़ी चुनौती रही है। हालांकि इस समस्या से पार पाने के लिए विश्वविद्यालयों और सरकारी शैक्षणिक संस्थानों ने अपने शुल्क आदि में बढ़ोतरी की, स्ववित्तपोषित पाठ्यक्रमों की शुरुआत की, मगर पढ़ाई-लिखाई के लिए अपेक्षित संसाधन जुटाना फिर भी मुश्किल बना हुआ है। इसके अलावा संस्थानों का निरंतर मूल्यांकन करने की प्रणाली विकसित की गई, ताकि उनमें परस्पर प्रतियोगिता का वातावरण बने और वे अपने यहां शैक्षणिक स्तर में सुधार का प्रयास कर सकें। पर यह तरीका भी बहुत कारगर साबित नहीं हो रहा। ऐसे में विश्वविद्यालय अनुदान आयोग ने विदेशी विद्यालयों के सहयोग से संयुक्त या दोहरी डिग्री हासिल करने की मान्यता देकर इस दिशा में एक सकारात्मक कदम उठाया है। यानी अब विद्यार्थी एक साथ दो डिग्रियां हासिल कर सकेंगे। नैक यानी राष्ट्रीय मूल्यांकन प्रत्यायन परिषद द्वारा मान्यता प्राप्त कोई भी भारतीय शिक्षण संस्थान 3.01 न्यूनतम अंक के साथ एक हजार संस्थानों में से किसी भी विदेशी संस्थान का सहयोग कर या प्राप्त कर सकता है। इसके लिए उन्हें यूजीसी से इजाजत भी नहीं लेनी होगी।

इस फैसले का लाभ यह होगा कि भारतीय शिक्षण संस्थान विदेशी संस्थानों के साथ तालमेल करके कौशल विकास संबंधी नए पाठ्यक्रम शुरू कर सकेंगे। इस तरह विद्यार्थी किसी विदेशी संस्थान में दाखिला लेने के बाद भी भारतीय संस्थान में शिक्षण का लाभ ले सकता है। इससे उनके धन की काफी बचत होगी। भविष्य में अगर रूस-यूक्रेन युद्ध जैसी कहीं कोई समस्या पैदा होती है, जिससे दूसरे देशों में पढ़ रहे विद्यार्थियों के सामने बीच में पढ़ाई छूटने का संकट पैदा होता है, तो वह इससे दूर हो सकता है, क्योंकि वह अपने देश के संबद्ध शिक्षण संस्थान से उसे पूरा कर सकता है। फिर उच्च शिक्षण संस्थानों के सामने जो विशेषज्ञों की कमी है, उसमें विदेशी विशेषज्ञों की मदद भी मिल सकेगी। पढ़ाई-लिखाई का अलग वातावरण बनेगा और कौशल विकास तथा अनुसंधान और शोध की दिशा में भी कुछ बेहतर नतीजे की संभावना बनेगी। अभी स्थिति यह है कि सभी विद्यार्थियों को सरकारी संस्थानों में प्रवेश नहीं मिल पाता। मजबूरन उन्हें निजी संस्थानों का रुख करना पड़ता है। मगर उन संस्थानों की फीस इतनी अधिक होती है कि सबके लिए उसे वहन करना मुश्किल होता है। ऐसे में बहुत सारे विद्यार्थी ऐसे देशों का रुख करते हैं, जहां भारतीय निजी संस्थानों की अपेक्षा कम फीस चुकानी पड़ती है। यूक्रेन में इसी वजह से बहुत सारे विद्यार्थी जाते रहे हैं। इस तरह हमारे देश का काफी पैसा बाहर चला जाता है।

विश्वविद्यालय अनुदान आयोग के ताजा फैसले के बाद अब अपने ही देश के शिक्षण संस्थानों में वे डिग्रियां मिल सकेंगी, जो विदेशी संस्थानों से मिलती रही हैं। फिर एक साथ दो डिग्री हासिल करने की छूट मिलने से विद्यार्थियों के पास विकल्प बढ़ जाएंगे और एक अतिरिक्त डिग्री हासिल करने में उन्हें जो दोगुना समय खर्च करना पड़ता था, उसकी बचत होगी। मगर यह प्रश्न अब भी अनुत्तरित है कि इस फैसले से सरकारी संस्थानों के पास जरूरी संसाधन कैसे और कितना जुटाए जा सकेंगे। इसके अलावा, उनमें दाखिले की वही मारामारी फिर भी बनी रहेगी या कम होगी, जो अभी रहती है। इन पक्षों में सुधार की दरकार अब भी अपेक्षित है।

रिश्तों पर हावी बाजारवाद

आज के उपभोक्तावादी समाज में हर वस्तु बिकाऊ बना दी गई है। कहा जाता है कि बाजार का केवल एक नियम होता है कि बाजार का अपना कोई नियम नहीं होता। इसलिए हर चीज, यहां तक कि भावना और रिश्ते भी उपभोग की वस्तु बन चुके हैं। जिसे मन चाहा, दाम लगा कर बेचा और खरीदा जा सकता है। दुनिया तेजी से बदल रही है, इसलिए परिवार, शिक्षा, राजनीति और अर्थव्यवस्था भी समय के अनुरूप तेजी से करवटें ले रही हैं। इसमें कोई दो राय नहीं कि तेजी से बदलते इस दौर ने मनुष्य की उम्र के हर पड़ाव को प्रभावित किया है। अगर बाल्यावस्था की बात करें, तो बचपन खो गया है या कहें कि आज के दौर में बचपन जैसा कुछ रह ही नहीं गया। बच्चे सीधे किशोर या युवावस्था में कदम रखने लगे हैं। अब बच्चे खिलौनों से नहीं, मोबाइल और कंप्यूटर से खेलते हैं, इसलिए वे वास्तविक विश्व और समाज का हिस्सा नहीं बन पा रहे। इसकी जगह आभासी समाज ने ले ली है। कंप्यूटर गेम की इस दुनिया ने उनके व्यक्तित्व को पूरी तरह से बदल दिया है। किशोर आबादी कंप्यूटर गेम, गैजेट, सोशल मीडिया आदि में उलझ कर रह गई है। यह सब बाजारवाद और उपभोक्तावाद का परिवार और समाज पर बढ़ते प्रभाव का ही नतीजा है।

बाजार का एकमात्र लक्ष्य अधिक से अधिक लाभ कमाना ही होता है। इसके लिए वह मनुष्य की भावनाएं, रिश्ते, दुख-दर्द, खुशी सबका कारोबार करता है। हाल में छपी एक खबर के अनुसार जापान के एक अरबपति ने इंसानी भावनाओं को समझने और उनका अकेलापन दूर करने वाले रोबोट बनाने वाली कंपनी में निवेश किया है। इस उत्पाद का नाम लोवोट है जो लव और रोबोट से मिल कर बना है। उनका दावा है कि यह रोबोट इंसान की हर भावना को समझने और उन्हें खुश और स्वस्थ रखने में सक्षम है। उनका तर्क है कि कोरोना काल में इस तरह के रोबोट ने बीमार लोगों के जीवन में सकारात्मक भूमिका निभाई। सच भी है कि जब समाज में मनुष्य की भूमिका पर सवाल उठने लगे या वह अपनी भूमिका निभाना छोड़ दे, तो मशीनों द्वारा इंसानों को विस्थापित करना कहीं न कहीं एक मजबूरी भी लगने लगती है।

केवल इतना ही नहीं, लाभ का बाजार दिनोंदिन व्यापक होता जा रहा है। अब व्यक्ति के वे निजी क्षण भी बाजार का हिस्सा बन गए हैं, जो कभी उसके परिवार तक सीमित थे। फिल्मों और धारावाहिकों ने इस निजी जीवन को बाजार तक पहुंचाने में कम बड़ी भूमिका नहीं निभाई। अब अधिकांश शादियों से पहले महंगे-महंगे कपड़े पहना कर, महंगी-महंगी जगहों पर दूल्हा-दुल्हन के शादी पूर्व की फिल्में तक बनाई जाती हैं और इस तरह उन्हें उस आभासी दुनिया की सैर करवाई जाती है जिसका वास्तविक दुनिया से कोई सरोकार नहीं होता। और यह सफर केवल यहीं खत्म नहीं होता, फिर शादी समारोह आयोजित करवाने वाली प्रबंधन कंपनियां सक्रिय हो जाते हैं जो शादी को परी-लोक की कहानी बनाने में कोई कसर नहीं छोड़तीं। इसी तरह आजकल मातृत्व के दौरान की स्मृतियों को सहेजने के लिए ‘मैटरनिटी फोटोशूट’ का चलन भी तेजी से चल निकला है। पता ही नहीं चला कि वस्तुओं और सेवाओं को बेचते-बेचते कब भावनाओं का बाजार मूर्त रूप लेता गया। इस क्षणिक आनंद के लिए मनुष्य अपना सब कुछ दांव पर लगाने को तैयार हो जाता है, फिर उसे कर्ज ही क्यों न लेना पड़े। क्योंकि उपभोक्तावादी समाज में इन सब दिखावों से ही किसी की प्रतिष्ठा का निर्धारण होता दिखता है।

उपभोक्तावादी संस्कृति और बाजार के विस्तार ने आवश्यकताओं के स्थान पर लालच और दिखावे के उपभोग को महत्त्वपूर्ण बना दिया है। इसलिए बाजारवादी शक्तियां बच्चों के सामने उत्पन्न संकट की स्थितियों को भी एक व्यावसायिक अवसर के रूप में ही देखती हैं। उन्हें इस बात से कोई मतलब नहीं कि बच्चे समय से पहले ही बड़े हो रहे हैं। संभवत: यही कारण है कि आए दिन ऐसी अनेक घटनाएं सामने आती हैं जिनमें बच्चे अपराधी की श्रेणी में खड़े नजर आते हैं। सोशल मीडिया और कंप्यूटर खेलों के कारण पिछले कुछ वर्षों में बच्चों और किशोरों की आपराधिक गतिविधियों में सहभागिता तेजी से बढ़ी है। नेशनल क्राइम रिकार्ड ब्यूरो के आंकड़ों के अनुसार पिछले एक वर्ष में नाबालिगों द्वारा किए गए अपराधों में आठ सौ बयालीस हत्याएं, सात सौ पच्चीस अपहरण, छह हजार से ज्यादा चोरी, लूट और डकैती की घटनाएं शामिल हैं। खेलने और पढ़ने की उम्र में बच्चों और किशोरों द्वारा इतने बड़े-बड़े अपराधों को अंजाम देना चिंता का विषय भी है और समाज के लिए बड़ी चुनौती भी। मोबाइल गेम में बड़ी रकम हार जाने पर अपने घर में चोरी, या अपहरण की कहानी गढ़ कर परिवारजनों से पैसे ऐंठना या फिर पैसों के लिए उनकी हत्या तक कर देना अब सामान्य अपराध हो गया है। लगता है, राज्य और समाज तो बच्चों के प्रति अपने दायित्व से मुक्त होकर दूर खड़ा तमाशा देख रहे हैं।

दुख की बात यह है कि शिक्षा भी इस दिशा में कोई महत्त्वपूर्ण भूमिका नहीं निभा पा रही है। परिवार और विद्यालय भी मूक दर्शक बन गए हैं। शिक्षा का उद्देश्य बच्चों को आत्मनिर्भर, अपने अधिकारों और कर्तव्यों के प्रति जागरूक, स्वतंत्र निर्णय लेने में सक्षम और देश व समाज के उत्थान के लिए एक समर्पित व मजबूत व्यक्तित्व का निर्माण करना है। पर आज की शिक्षा उन्हें केवल प्रतियोगिता का हिस्सा बना रही है, क्योंकि इस प्रतियोगिता में विजयी होना ही उसके अस्तित्व की पहचान है। इन प्रतियोगिताओं में जीत के लिए उन्हें विभिन्न शिक्षण उद्योगों में प्रवेश लेना जरूरी है, वरना उनकी हार सुनिश्चित है। ये शिक्षण और कोचिंग उद्योग सिर्फ अभिभावकों की खर्च करने की क्षमता देखते हैं, न कि बच्चों की रुचि या योग्यता। और यही एक बड़ी वजह है कि जो बच्चे इन प्रतियोगिताओं में पिछड़ जाते हैं या बिना इच्छा के इन प्रतियोगिताओं में धकेल दिए जाते हैं, वे जिंदगी से हार मानने लगते हैं। क्योंकि शिक्षा ने उन्हें यह नहीं सिखाया कि जिंदगी किसी एक प्रतियोगिता तक सीमित नहीं है, न ही जिंदगी दूसरों से प्रतिस्पर्धा का नाम है, बल्कि खुद को जीतना और खुद से जीतना जिंदगी है।

इस तरह के सामाजिक संकट के लिए परिवार भी कम जिम्मेदार नहीं हैं। कुछ समाज वैज्ञानिक मानते हैं कि परिवार की अवधारणा में ऐसे कुछ तत्व होते हैं जो परिवार को समाज विरोधी बनाते हैं। उनके अनुसार परिवार इसलिए समाज विरोधी है, क्योंकि यह महिलाओं के शोषण की वैधता को स्थापित करता है और यह परिवार के परिवेश के बाहर महिला के जीवन की किसी भी संभावना को समाप्त करता है। विभिन्न विज्ञापनों और मीडिया में महिलाओं को सौंदर्य की वस्तु के रूप में प्रस्तुत करना मुनाफे के बाजार को विस्तार देता है, न कि महिला सशक्तिकरण को। बाजार का चरित्र कल्याणकारी नहीं होता, बल्कि व्यक्तिवादी होता है, इसलिए लाभ कमाने के आलावा उसका कोई उद्देश्य नहीं होता।

बाजार की शक्तियां केवल मुनाफे के लिए काम करती हैं, इसलिए उनसे कोई अपेक्षा नहीं की जा सकती। लेकिन एक लोकतांत्रिक और कल्याणकारी राज्य, परिवार और शिक्षक समुदाय का ऐसे मुद्दों से मुंह मोड़ना समाज में उत्पन्न होने वाले जोखिमों की ओर संकेत करता है। अगर वर्तमान ऐसा है तो भविष्य की कल्पना कितनी भयावह होगी, कहने की आवश्यकता नहीं है। बाजार मानव आवश्यकताओं को पूरा करे, यहां तक तो ठीक है, लेकिन अगर जरूरतों को निर्देशित और नियंत्रित करने लगे, तो वह समाज और राष्ट्र के लिए खतरा बन जाता है।

बेहिसाब शोर से मिलती बीमारियां

शोर से होने वाली बहरेपन की बीमारी एक गंभीर स्वास्थ्यगत समस्या है। विश्व स्वास्थ्य संगठन की ‘वर्ल्ड हीयरिंग रिपोर्ट’ के मुताबिक, विश्व की 1.5 अरब आबादी बहरेपन के साथ जी रही है, जिनमें से कम से कम 43 करोड़ लोग ऐसे हैं, जिनके मर्ज का इलाज हो सकता है। अंदेशा है, साल 2050 तक ऐसे लोगों की संख्या 70 करोड़ हो जाएगी। ध्वनि प्रदूषण दरअसल ऐसे अवांछित विद्युत-चुंबकीय संकेत हैं, जो इंसान को कई रूपों में नुकसान पहुंचाते हैं। इसीलिए, शोर-प्रेरित बहरेपन पर फौरन ध्यान देने की जरूरत है।

वैश्विक अध्ययन बताते हैं कि निर्माण कार्य, औद्योगिक कामकाज (मोटर वाहन उद्योग, खदान, कपड़ा उद्योग आदि), जहाज बनाने या मरम्मत करने संबंधी काम, अग्निशमन, नागरिक उड्डयन आदि सेवाओं में लगे श्रमिकों में शोर-प्रेरित बहरेपन का खतरा ज्यादा होता है। हालांकि, श्रवण के लिहाज से असुरक्षित मनोरंजन के साधन, आवासीय स्थान, और असैन्य व सैन्य सेवाएं भी बहरेपन की समस्या बढ़ा सकती हैं। आकलन है कि 15 फीसदी नौजवान संगीत कार्यक्रमों, खेल आयोजनों और दैनिक कामकाज में होने वाले तेज शोर से बहरेपन का शिकार होते हैं।

शोर-प्रेरित बहरेपन की समस्या विकासशील देशों में ज्यादा है, जहां तीव्र औद्योगिकीकरण, अनौपचारिक क्षेत्र के विस्तार और सुरक्षात्मक व शोर-नियंत्रणरोधी उपायों की कमी से लोग चौतरफा शोर-शराबे में दिन बिताने को अभिशप्त हैं। भारत में तो शोर-प्रेरित बहरेपन को फैक्टरी ऐक्ट ऐसी बीमारी मानता है, जिस पर तुरंत ध्यान देने की जरूरत है। महानिदेशालय कारखाना सलाह सेवा व श्रम संस्थान (डीजीएफएएसएलआई) ने आठ घंटे तक ही अधिकतम 90 डेसीबल आवाज में रहने की अनुशंसा की है।

सन् 2015 में विश्व स्वास्थ्य संगठन ने अनुमान लगाया था कि श्रवण के असुरक्षित तरीकों से 1.1 अरब नौजवानों में बहरेपन का खतरा है। मगर कार्यस्थलों पर शोर ही मूल समस्या नहीं है। हाल के दिनों में धर्मस्थलों या इबादतगाहों में आस्था के नाम पर लाउडस्पीकरों का जमकर इस्तेमाल होने लगा है। विश्व शांति के लिए होने वाले आयोजन भी बिना शोर-शराबे के पूरे नहीं होते हैं, जबकि 85 डेसीबल से अधिक तेज आवाज अगर हमारे कानों में पहुंचती है, तो हमें अस्थायी बहरेपन की समस्या हो सकती है और हमारी सुनने की क्षमता कम हो सकती है। तेज आवाज के संपर्क में आने के 10-15 दिनों में इसका इलाज संभव है। मगर कान की रोम कोशिकाएं और संबंधित तंत्रिका तंतु यदि बार-बार या निरंतर शोर के संपर्क में रहे, तो बहरापन स्थायी बन सकता है। अत्यधिक शोर के असर से स्थायी स्मृति लोप और मानसिक रोग भी हो सकते हैं।

तेज संगीत और आसपास के शोर या अचानक तेज आवाज के संपर्क में आने से भी सुनने की हमारी क्षमता धीरे-धीरे खत्म हो सकती है। दरअसल, तेज आवाज नाजुक श्रवण कोशिकाओं को उत्तेजित करती है, जिससे वे स्थायी रूप से चोटिल या खत्म हो सकती हैं। इस तरह से एक बार यदि सुनने की क्षमता खत्म हो जाए, तो उसे फिर से हासिल करना नामुमकिन है। इसी तरह, सड़कों पर गाड़ियों के हॉर्न का अविवेकपूर्ण इस्तेमाल और देश के अलग-अलग समुदायों में सामाजिक व धार्मिक जलसों में लाउडस्पीकरों के व्यापक उपयोग से भी कई तरह की स्वास्थ्यगत समस्याएं हो सकती हैं। इनसे मानसिक रोग, बहरापन, उच्च रक्तचाप, चक्कर आना, घबराहट, अनिद्रा जैसी बीमारियां हो सकती हैं। तेज शोर के संपर्क में आने वाला व्यक्ति रक्त-बहाव तंत्र से जुड़ी बीमारियों, हृदय रोग, उच्च रक्तचाप, पेप्टिक अल्सर और तंत्रिका संबंधी रोगों का शिकार भी हो सकता है।

जाहिर है, हमें उन उपायों को अमल में लाना होगा, जिनसे तेज शोर के कारण होने वाली समस्याएं खत्म हो सकें। इनमें से सबसे अच्छा रास्ता तो यही है कि शोर या आसपास की तेज आवाज को कम किया जाए। सर्वोच्च अदालत का मानना है कि ध्वनि प्रदूषण को नियंत्रित करने के लिए अदालत से निर्देश जारी हो सकता है, भले ही वह शोर धार्मिक गतिविधियों की वजह से क्यों न पैदा हो रहा हो। उसने कहा है, कोई भी धर्म इसकी अनुमति नहीं देता कि दूसरों की शांति को भंग करके प्रार्थना की जानी चाहिए। एक सभ्य समाज में मजहब के नाम पर ऐसी गतिविधियों की अनुमति नहीं दी जा सकती, जो वृद्ध या दुर्बल लोगों, छात्रों या बच्चों की रात, सुबह या दिन की नींद में खलल डालती हैं। अदालत का यह निर्देश दिवाली और अन्य त्योहारों के समय होने वाली आतिशबाजी के संदर्भ में आया था। कोर्ट ने माना है कि भारतीय समाज बहुलतावादी है। यहां के लोग विभिन्न जातियों और समुदायों में बंटे हुए हैं और विभिन्न धर्मों में आस्था रखते हैं। वे विभिन्न त्योहार मानते हैं। वे एक-दूसरे के प्रति सहिष्णु हैं। इसलिए यदि एक को छूट दी जाती है, तो दूसरे को छूट न देने का कोई औचित्य नहीं होगा। और, अगर हम ऐसा करते हैं, तो छूट नियम बन जाएगी। तब कानूनों को लागू कराना मुश्किल हो जाएगा।

वैसे भी, निद्रा हमारा मौलिक अधिकार है। शीर्ष अदालत भी यह मानती है कि बेहतर स्वास्थ्य के आवश्यक तत्वों में संतुलन बनाए रखने के लिए इंसान के लिए नींद अनिवार्य है। इसीलिए, नींद एक मूलभूत आवश्यकता है, जिसके बिना मानव जीवन का अस्तित्व खतरे में पड़ जाएगा। नींद में खलल डालना यातना के समान होगा, जिसे अब मानव अधिकार के उल्लंघन के रूप में स्वीकार किया जाता है।
