Adultery, a crime?

Queen Victoria no longer rules, bring rapists to book instead

Supreme Court has admitted a petition demanding annulment of the Indian Penal Code provision criminalising adultery, citing its gender discriminatory character. SC will examine whether Section 497 IPC treats the man as adulterer and a married woman as victim and why the offence of adultery ceases if the husband consented to the relationship. Of course fixing liability for an adulterous relationship on the man, that too only if the husband of the married woman objects, is absurdly sexist. But SC must also examine another fundamental question. Is adultery a crime, and secondly, does criminalising adultery, which would entail peeking into consensual relationships and bedrooms and is a remnant of Victorian mindsets – IPC dates back to 1860 – violate individual liberties?

Marriage is essentially a civil contract between two individuals and there can certainly be ethical objections to lying or cheating in a relationship founded on trust. At worst adultery is a violation of contract, not a criminal offence. Most Western nations have decriminalised adultery relegating the biblical commandment forbidding adultery to the realm of religion. The state should legislate on marriages, only to the extent of protecting rights of stakeholders. For instance, triple talaq should be outlawed because it discriminates against women. But prescribing jail terms for violators is counterproductive and will only vitiate civil divorce and alimony proceedings. Further, what punishment will governments prescribe for men who abandon wives without formally divorcing them?

It is critically important to draw clear separations between consensual sexual activity and moral policing and between reasonable and arcane/draconian legislations. Madhya Pradesh has passed a bill mooting death penalty for rapists whose victims are less than 12. Besides disregarding “rarest of rare” stipulation, the law provides perverse incentive to rapists to kill their victims to destroy evidence. Draconian laws only lead to more injustices.

Similarly, rape laws fail to make allowances for teenage sexuality or relationships souring between adults and not culminating in marriage. After much harassment, it is left to courts and conscientious judges to sift fact from bruised pride. Recognising agency of adults to take responsibility for their lives will free up the state to focus its energies where they are critically needed. Just one in every four reported rape case ended in conviction in 2016. Instead of moral policing, the state and legal system must focus more on real crimes.

Red herring

Instead of targeting private hospitals, Delhi government should improve public healthcare

Delhi government’s decision to cancel the licence of Max hospital, Shalimar Bagh, for declaring a premature newborn dead even though he was still alive, is bizarre and draconian. The 22-week newborn, part of a twin delivery where his sister was stillborn, later died in a nursing home. The chances of the newborn’s survival were slim. There is no doubt that the doctor and staff at Max should have shown greater professionalism and empathy. But cases of negligence should be tackled at the individual level and action, if required, taken against particular doctor or staff.

But to cancel the licence of an entire hospital is not only unwarranted, it is hypocritical. It comes as part of a crusade against private hospitals, with chief minister Arvind Kejriwal declaring that he won’t tolerate open loot and criminal negligence. The implication is that private hospitals are carpetbaggers who prey on patients’ vulnerabilities. This conveniently ignores the fact that providing affordable, quality healthcare is primarily government’s responsibility. India has just over a million doctors to treat its population of 1.3 billion people – of these only 10% work in the public health sector – and one state-run hospital for every 90,343 people.

An RTI reply in 2015 revealed that over the previous five years 12-15% of children admitted to neo-natal and paediatric ICU wards in government hospitals in Delhi had died. It’s clear that public healthcare is in a shambles, which makes people go to private hospitals in the first place. The answer cannot be to make private healthcare the whipping boy. If government truly cares about health, it should improve public hospitals and get them to compete with their private counterparts. That’s the way to affordable, quality, universal healthcare. Shutting hospitals, on the other hand, forecloses the very possibility of healthcare.

The law prevails

NGT’s order on Art of Living rightly asserts the fundamental principle of green law — polluter must pay

The National Green Tribunal has closed the matter of the World Culture Festival held by Sri Sri Ravi Shankar’s Art of Living (AoL) in March 2016, which had degraded the Yamuna floodplain in Delhi. It has held that AoL has damaged the ecosystem of the plain and that the Delhi Development Authority (DDA) had wrongfully permitted it to conduct the event. The DDA has been directed to evaluate the damage and Sri Sri Ravi Shankar’s organisation must pay for the restoration of the flood plain. AoL had put up Rs 5 crore pursuant to an earlier order, but will now have to pay on actuals.Throughout this affair, AoL has maintained a cavalier attitude to the law, ranging from indifference through defiance to contempt. One headline on its website reads: “NGT committee is biased, unscientific and lacks credibility”, with a subhead saying: “All facts point to the male fide intention of the National Green Tribunal (NGT) committee to malign The Art of Living.” However, the NGT has been scrupulously correct. It has declined to comment on the propriety of holding such events, considering it beyond its remit, and has restricted itself to the question of pollution and environmental degradation. It has pointed out that a floodplain should not be regarded as waste or fallow land, but as a commons, since it is instrumental in the cleansing of river waters, recharging of aquifers and the maintenance of wetland habitats populated by numerous species. It has observed that the government and the people have a duty to protect it.But how could the government do its duty, when its top office-bearers had attended the event and shared the dais with the promoters? Only Pranab Mukherjee, then president, stayed away. Not surprisingly, though the World Culture Festival caused a public uproar, the political response was minimal and there was little denunciation from the ruling party, though river protection and regeneration is part of its agenda for governance. Perhaps it was the silence of the state which emboldened Sri Sri Ravi Shankar’s organisation to defy and disparage the law. It is heartening that the NGT has done its duty and gone by the book, demonstrating that the polluter pays principle, which is the bedrock of environmental law, must stand, no matter how well-connected and politically influential the perpetrator may be.

जुर्माने से भरपाई नहीं

राष्ट्रीय हरित अधिकरण (एनजीटी) ने आखिरकार श्री श्री रविशंकर द्वारा संचालित आर्ट ऑफ लिविंग के यमुना नदी के किनारे मार्च 2016 में कार्यक्रम को पर्यावरण के नजरिये से गलत माना है और उस नुकसान की भरपाई का आदेश दिया है। श्री श्री रविशंकर जब उस कार्यक्रम की तैयारी कर रहे थे तब एनजीटी ने पहले सख्ती दिखाई थी और यह उम्मीद बंधी थी कि वह पर्यावरण को होने वाले नुकसान को रोक सकेगा। लेकिन फिर उसके रु ख में एक लचीलापन आया और उस कार्यक्रम को रोकने में वह सफल नहीं हो सका जबकि पर्यावरण का नुकसान होने की ठोस वजहें बताई गई थीं। भारतीय समाज के गठन और विस्तार के परंपरागत रास्ते में प्राकृतिक ढांचे और संतुलन को लेकर गंभीरता दिखाई देती है। लेकिन विकास की एक अलग से ऐसी अवधारणा आयात की गई कि तमाम ऐसी चिंताओं और सुरक्षा के उपायों को समाज की रोज ब रोज की गतिविधियों से बाहर होते चले गए। विकास की भूख को अफीम के नशे के रूप में समाज में बांटा गया कि विकास के सामने पानी, हवा, मिट्टी, पेड़-पौधे, जंगल, जानवर और समस्त वातावरण में संतुलन का प्रश्न ही हाशिये पर धकेल दिया गया। लेकिन राष्ट्र का तो भूगोल होता है ,पर्यावरण का कोई राष्ट्र नहीं होता है।पर्यावरण नियंतण्र स्तर पर एक राजनीतिक और रणनीतिक प्रश्न हो गया है। पूंजीवादी देश प्रदूषण को पिछड़े और गरीब देशों के भीतर धकेलकर अपनी अमीरी और सुख सुविधाओं को पर्यावरण के स्तर पर भी बेहतर बनाने की कोशिश में लगातार रहते हैं। भारत में पर्यावरण के प्रश्नों को बारीकी से देखने की तमीज हाल में आई है। हम अभी सड़क और घरों में सफाई अभियान कूड़ा-कचरे को ठीक से रखने आदि जैसे कार्यक्रमों की शुरुआत कर रहे हैं। जब महान नदियों को सुखा दिया। मजेदार बात है कि अपने धार्मिंक कूड़ों के लिए उन सूखी नदियों में बहते नाले को भी हम नहीं छोड़ रहे हैं। जाहिर-सी बात है कि एनजीटी से भी ये उम्मीद नहीं कर सकते हैं कि वह अपने फैसलों में कोई नीतिगत दबाव बनाने की अपनी क्षमताओं को प्रदर्शित करें। इसीलिए एनजीटी अपने आदेशों के जरिये पर्यावरण को शहरीकृत होने का एक भ्रम पैदा कर देता है क्योंकि उसके समक्ष ज्यादातर मसले शहरों और खासतौर से दिल्ली और मुबंई जैसे बड़े शहरों से जुड़े होते हैं। दिल्ली में वायु प्रदूषण के इर्द-गिर्द बड़े वाहनों को शहर में नहीं घुसने देने या सिमेंट, कंक्रीट के निर्माण पर रोक लगाने आदि जैसे फैसलों को लेकर एनजीटी र्चचा में रहता है। दरअसल पर्यावरण एक अलग विषय नहीं है, वह समाज में संपूर्णता का एक हिस्सा है। लेकिन एनजीटी की परिकल्पना में उसे केवल पर्यावरणीय पहलुओं पर अपना दृष्टिकोण और फैसला देना है। इसीलिए उसने दिल्ली में जंतर मंतर पर होने वाले राजनीतिक स्वतंत्रता के अधिकार के नुकसान होने की परवाह किए बगैरह ही ध्वनि प्रदूषण की दृष्टि से धरना-प्रदर्शन पर रोक लगा दिया।

एनजीटी भी केवल जुर्माना लगा सकता है, ठीक उसी तरह जैसे मानवाधिकार आयोग किसी के मानवाधिकार के उल्लंघन के हालात में मुआवजा देने का निर्देश दे सकता है। एनजीटी ने श्री श्री रविशंकर के कार्यक्रम से होने वाले नुकसान के लिए जुर्माना देने का निर्देश दिया। यानी पर्यावरण के नुकसान को दुरु स्त करने के लिए उनसे पांच करोड़ रु पये जमा कराए गए। किसी के मानवाधिकार के उल्लंघन की मात्रा का आकलन रु पये-पैसे में नहीं किया जा सकता है। ठीक उसी तरह पर्यावरण के नुकसान का आकलन रु पये पैसे में संभव नहीं है। लेकिन पूंजीवाद का यह नियम है कि वह रु पये-पैसे के आधार पर नैसर्गिक अधिकारों व संसाधनों पर हमले की जरूरत करने के रास्ते तैयार कर लेता है। पर्यावरण को लगातार तमाम स्तरों पर नुकसान हो रहा है। लेकिन जब हालात एक सीमा से बाहर जाने के संकेत देता है तो सरकार और उसकी संस्थाएं सक्रिय दिखने लगती हैं। दिल्ली में वायु प्रदूषण पर लगातार कई वर्षो से चिंता की जा रही है। बसों में डीजल की जगह गैस आ गई और अब इसको भी नुकसानदेह बताया जा रहा है। यानी पर्यावरण को लेकर तात्कालिक कोई कदम उठाने के लिए ये संस्थाएं सक्रिय दिखती हैं।पर्यावरण का मसला सरकार के फैसले और सरकारी संस्था एनजीटी के बीच के चलने वाली गतिविधियों का पर्याय नहीं है। अभी हद से हद यह होता है कि सरकार एक फैसला करती है तो उसके खिलाफ अधिकरण में जाया जा सकता है या कोई फैसला नहीं होने के हालात में जाया जा सकता है।

लेकिन पर्यावरण के लिए कोई जन दबाव की स्थिति नहीं दिखती है; क्योंकि यह एक बुनियादी सवाल के रूप में हमारे लिए राजनीतिक प्रश्न नहीं बना हुआ है। जैसे दुनिया के कई देशों में पर्यावरण के मसलों को लेकर ही राजनीतिक पार्टयिां सक्रिय हैं और किसी सरकार के बनने और बिगड़ने की हालत में उनकी भूमिका होती है। आस्ट्रेलिया में भारत के एक कॉरपोरेट गौतम अडानी को कोयला की खादानों के लिए बड़े आंदोलन का सामना करना पड़ा और वहां की सरकार भी उसके सामने विवश हो गई। यहां बड़े बांधों के खिलाफ नर्मदा आंदोलन पर्यावरण की दृष्टि से भी सबसे बड़ा और लगातार चलने वाला है, लेकिन सरकारों ने लगातार उसकी उपेक्षा करते हुए अपने फैसलों को लागू किया। अदालतें भी कारगर भूमिका नहीं निभा सकीं। एनजीटी का संगठनात्मक ढांचा सिविल और आपराधिक न्यायालयों से निकला है।उच्च न्यायालयों में मुकदमों के बोझ को कम करने के इरादे से पर्यावरण से जुड़े मुकदमें वहां आए हैं। यह पर्यावरण की सैद्धांतिकी से निकला प्राधिकरण नहीं है। पर्यावरणीय दृष्टि और दर्शन का न्याय सिद्धांत अभी समृद्ध किया जाना बाकी है। पर्यावरण के न्यायिक सिद्धांतों को इस रूप में विकसित करना है कि पर्यावरण के नुकसान को ही रोका जा सकें। पर्यावरण को नुकसान की इजाजत और फिर जुर्माना लगाने का न्यायिक सिद्धांत एक धोखा है। इसमें केवल सरकार और संस्थाएं सक्रिय दिखती हैं, लेकिन पर्यावरण को नुकसान होता रहता है।

Rights & wrongs — on Transgender Persons Bill

The Centre should reconsider its draft Bill on transgender rights

It will be a travesty of its avowed objectives if the proposed legislation to protect the rights of transgender persons is not sufficiently rooted in a rights-based approach. News that the Centre has brushed aside a parliamentary standing committee’s report and plans to introduce the Transgender Persons (Protection of Rights) Bill without changes is a disappointment. The process of recognising the rights of the community and seeking to protect it by legislation gained momentum in 2014, when the Supreme Court gave a landmark verdict in the NALSA case. The court recognised the community as a third gender entitled to the same rights and constitutional protection as other citizens. It called for an end to discrimination based on gender against those who do not conform to the gender assigned to them at birth. Besides this negative right against discrimination, the court ruled that transgender persons had a positive right to make decisions about themselves, express themselves and participate in community life. It directed the government to accord them ‘socially and educationally backward’ status so they could benefit from affirmative action. In 2014, a private member’s Bill moved by DMK MP Tiruchi N. Siva was passed in the Rajya Sabha. In the Lok Sabha, the government introduced its own Bill, which was referred to the Standing Committee on Social Justice and Empowerment.

The Standing Committee, in its July 2017 report, suggested some modifications and additions to the draft. In particular, it disagreed with the definition of ‘transgender’ in the draft Bill and wanted modifications to bring it in line with global norms. The Committee felt that the definition violated the principle that transgender persons have a right to self-identification of their gender. Activists and experts have also rightly pointed to the absence of any reference to the implications of criminal and civil laws that are based on the traditional gender binary. While provisions on equality and non-discrimination would promote equal opportunity, in the process the real benefit of reservation in jobs should not be denied. Social legislation should not be merely benevolent; rather, it should be imbued with an approach that extends to the marginalised sections the freedom, dignity and autonomy that other citizens enjoy. In the domain of legislation, disagreements over drafts are natural. It is up to the government of the day to adopt an inclusive approach towards divergent opinions and come up with the best law possible. Ignoring the opinions of experts and parliamentary committees does not help the process. The Centre should revisit its draft and incorporate the inputs of the standing committee and an expert panel that submitted a report in 2014.

सामूहिकता जब नजीर बन जाए

अच्छे से बाल बांधकर पीली टी-शर्ट पहने पांच साल की सौम्या कश्यप की फोटो देखकर एकाएक नजरें उसकी बड़ी-बड़ी आंखों पर टिक जाती हैं। सौम्या की गोलमटोल आंखें न जाने दुनिया को खोजने की चाहत बयां करती हैं। फोटो में दिख रही उसकी आंखों की चमक और मासूम चेहरा अब असल जिंदगी में देखने को नहीं मिल पाएगा। दो महीने पहले शनिवार के दिन स्कूल जाते समय वह स्कूल बस के पहियों के नीचे आ गई। दिल दहला देने वाली यह घटना सिर्फ सौम्या की ही नहीं है, बल्कि ऐसी दर्दनाक घटनाएं रोजाना देश की सड़कों पर होती हैं। पिछले साल के आंकड़ों को देखें, तो पता चलता है कि भारत में हर दिन 29 बच्चे सड़क हादसों में अपनी जान गंवाते हैं। इस साल जनवरी की बात है, जब उत्तर प्रदेश के एटा में तेज गति से आ रहे ट्रक ने स्कूल बस को टक्कर मार दी और इस घटना में 25 नन्हे बच्चों की जिंदगी चली गई। कई बच्चे घायल हुए थे। 42 सीट वाली इस स्कूल बस में करीब 66 बच्चे बैठे थे।बच्चों की सुरक्षा को देखते हुए 1997 में सुप्रीम कोर्ट ने स्कूल बसों की सुरक्षा से जुड़े दिशा-निर्देश जारी किए थे। इसके बाद 2005 में ऑटोमोटिव रिसर्च एसोसिएशन ने स्कूल बसों में सुरक्षा जरूरतों के लिए एआईएस मानक 063 जारी किया था। एटा की घटना के बाद सेंट्रल बोर्ड ऑफ सेकेंडरी एजुकेशन ने कहा था कि अगर सुरक्षा में लापरवाही बरती गई, तो स्कूल की मान्यता तक रद्द हो सकती है। ये मानक किस हद तक लागू हुए, यह नहीं कहा जा सकता। दूसरी दिक्कत यह है कि ऐसे मानक उन स्कूल वैन, आरटीवी या मिनी बसों पर लागू नहीं होते, जिन पर बड़ी संख्या में बच्चों को स्कूल लाया और ले जाया जाता है, क्योंकि ये वाहन बहुत किफायती होते हैं। मोटर वाहन अधिनियम 1988 में बच्चों की सुरक्षा को लेकर कोई निर्देश नहीं दिया गया है, हालांकि अब इस कानून में कई बदलाव किए जा रहे हैं।

इसके नए स्वरूप में यह जोड़ा गया है कि चार साल से ज्यादा उम्र के बच्चों के लिए हेलमेट लगाना अनिवार्य है और 14 साल से कम उम्र के बच्चों की सुरक्षा वयस्कों को सीट बेल्ट या वाहन में बच्चों से जुड़े सुरक्षा सिस्टम लगाकर सुनिश्चित करानी होगी। यह बिल अभी कानून नहीं बना है, क्योंकि लोकसभा में तो यह पास हो गया है, मगर राज्यसभा में अभी इसका पारित होना बाकी है।एक दूसरी दिक्कत यह भी है कि भारत में बच्चों की सुरक्षा को लेकर बने कानून अंतरराष्ट्रीय स्तर के नहीं हैं। मसलन, अमेरिका के कोड ऑफ फेडरल रेगुलेशन 49, स्टैंडर्ड नंबर 213 में ‘चाइल्ड रिस्ट्रेंट सिस्टम’ का अभाव, यानी बच्चों की सुरक्षा के लिए वाहनों की सीट या बैठने का तरीका ऐसा डिजाइन किया जाना, जिससे बच्चे की सुरक्षा बढ़े। इसमें बैकलेस रिस्ट्रेंट, बेल्ट से जुड़ी सीट, बूस्टर सीट, कार बैड, ऐंकर या हेलमेट इत्यादि शामिल है। भारत में ऐसा कोई प्रावधान नहीं है, जिसके तहत कार में कोई सीट सिर्फ बच्चों के लिए हो या बच्चों के हेलमेट हों। हेलमेट पहनने से गंभीर चोट से 70 फीसदी तक बचा जा सकता है और 40 फीसदी तक मृत्यु का खतरा कम होता है। इसके अलावा भारत में बच्चों के लिए स्टैंडर्ड हेलमेट ही नहीं मिलते। बच्चे या तो बड़ा हेलमेट पहनते हैं, या फिर उन्हें हेलमेट पहनाया ही नहीं जाता। ‘चाइल्ड रिस्ट्रेंट सिस्टम’ का इस्तेमाल दुनिया भर में किया जाता है।यह दुर्घटना के समय शिशुओं के 70 फीसदी और छोटे बच्चों के 54 से 80 फीसदी तक मृत्यु के खतरे को कम करता है। हमारे देश में मांएं अक्सर अपने बच्चे को बुरी नजर और तमाम तरह की होनी-अनहोनी से बचाने व बलाओं को टालने के लिए काला टीका लगाती हैं। जब हम अपने बच्चे की सुरक्षा को लेकर इतने चिंतित हैं, तो बच्चों की सड़क सुरक्षा को लेकर क्यों कोताही बरतते हैं?पिछले साल देश के दस हजार से ज्यादा बच्चों की जान सड़क हादसों में गई। लेकिन ये आंकड़े उन बच्चों के हैं, जो सड़क पर आवागमन कर रहे थे। इसके साथ ही एक चिंताजनक बात यह भी है कि सड़क पर रहने वाले बच्चों की दुर्घटनाओं के हमारे पास कोई आंकड़ा नहीं है। उन्हें तो सुरक्षा की श्रेणी में भी नहीं रखा गया है, जबकि उन्हें इसकी सबसे ज्यादा जरूरत है। सुरक्षा हर बच्चे का अधिकार है।

भ्रष्ट आचरण के खिलाफ

आज जब पूरी दुनिया एक बार फिर भ्रष्टाचार विरोधी दिवस मना रही है, तो यह पुरातन सवाल भी एक बार फिर हमारे सामने खड़ा है कि वैश्विक स्तर पर इतनी शपथ और भारत के पैमाने पर इतने बड़े-बड़े भाषणों, संविधान की मूल आत्मा में प्रदत्त शर्त होने के बावजूद भ्रष्टाचार की यह बुराई अभी तक खत्म क्यों नहीं हुई? वैसे यह स्पष्ट कर देना जरूरी है कि अन्य तमाम दिवसों की तरह ही यह भी विदेश से आयातित एक दिवस है, जिसकी मंशा बहुत साफ है। यह 31 अक्तूबर, 2003 को भ्रष्टाचार के खिलाफ संयुक्त राष्ट्र सम्मेलन की उस शपथ का प्रतिफल है, जिसमें विश्व के हर कोने में सामाजिक और संस्थानिक शुचिता के लिए भ्रष्टाचार विरोधी दिवस मनाने की घोषणा थी, और जिसे पहली बार 9 दिसंबर, 2006 को मनाया गया। माना गया होगा कि इस संकल्पना और परिकल्पना के बाद आमूल परिवर्तन आएगा और भ्रष्टाचार का सूचकांक धराशाई हो जाएगा, लेकिन हुआ क्या, यह सोचने-समझने और चिंता करने का विषय है।यह हमारे देश में सांगठनिक रूप पा चुके भ्रष्टाचार का ही सुबूत है कि हमारा 5,000 करोड़ से ज्यादा धन स्विस बैंकों में जमा है और हम भारतीय हर साल करीब सवा हजार करोड़ से ज्यादा राशि घूस में देते हैं।

नेशनल कौंसिल ऑफ अप्लाइड इकॉनामिक की रिसर्च भी बताती है कि भारत का औसत शहरी परिवार हर साल 4,400 रुपये और औसत ग्रामीण परिवार हर साल 2,900 रुपये घूस में खर्च करता है। सर्वे यह भी बताता है कि इस राशि का अधिकांश हिस्सा सामान्य कामकाज के अलावा शिक्षा क्षेत्र और पुलिस की जेब में जाता है। दिवस की रस्म अदायगी के बीच हमारे बीच से निकले घूसखोरी और काला धन के ये आंकड़े याद दिलाते हैं कि हमारे देश के भ्रष्टाचार विरोधी आंदोलनों का क्या हश्र हुआ? यह हमें 2011 की उन कई रातों और सुबहों की खुशनुमा याद भी दिलाता है, जब पूरा देश एक बिल्कुल नए तरह के आंदोलन की धुन पर झूम रहा था और लोग बड़ी उम्मीद से भविष्य निहारने लगे थे। लेकिन राजनीति के भ्रष्टाचार ने सारी उम्मीदें हड़प लीं। उस आंदोलन की पहल पर निकले जन लोकपाल बिल या व्हिसल ब्लोअर प्रोटेक्शन बिल का क्या हुआ, यह छिपा नहीं है। सच तो यही है कि हमारे देश में भ्रष्टाचार सही मायने में कभी मुद्दा रहा ही नहीं। व्हिसल ब्लो करने वालों या भ्रष्टाचार के खिलाफ सबको सचेत करने वालों का हमारे समाज और व्यवस्था ने क्या हश्र किया, इसे समझने के लिए बिहार में सड़क माफिया से टकराने वाले सत्येन्द्र दुबे और यूपी में पेट्रोल माफिया से टकराने वाले मंजूनाथ की हत्या से समझा जा सकता है। दरअसल, भ्रष्टाचार हमारे समाज में गहरे पैठ चुकी वह बुराई है, जिसकी जड़ें राजनीति के खाद-पानी से मजबूत होती रही हैं। दुर्भाग्य से यह खाद-पानी न बंद हुआ है और न ऐसी कोई उम्मीद दिखती है। हां, समय के साथ इसने रूप और रंग जरूर बदले हैं। दरअसल, भ्रष्टाचार एक ऐसा सवाल है, जो किसी महज संस्थागत प्रयास, कानून और भय से नहीं खत्म होने वाला। इसके खात्मे के लिए हमारी सोई हुई संवेदनाओं का जाग्रत होना जरूरी है, क्योंकि यही हमें लंबी लड़ाई के लिए प्रेरित कर पाएगा। वह जनाक्रोश जगा पाएगा, जो इस लड़ाई में विजय के लिए जरूरी है। भ्रष्टाचार के खिलाफ जनाक्रोश ही है, जो नहीं दिखाई दे रहा। यह सर्वव्यापी और सर्वग्रासी बनता जा रहा है और हम एक कृत्रिम लड़ाई में उलझे हुए हैं, जो हर दिन नई उम्मीद बंधा जाती है। हमें उम्मीदों की इस आपाधापी से बाहर निकलना होगा। सच है कि इसके लिए हमें अपनी ओढ़ी हुई जरूरतों से भी मुठभेड़ करना होगा। एक सीधी और आत्महंता होने की जिद जैसी मारक मुठभेड़।
