Educational Quality: Not by Funds Alone

Budget 2020 counts education as a part of ‘aspirational India’, critical to realising India’s demographic dividend. The sector’s allocation has registered a 5% increase over the current fiscal’s, to `99,311crore. Yet, public expenditure, including the states’ spending, as a share of GDP remains stagnant at 3.1%.

It is unlikely to go up dramatically, given the slow growth in tax revenue. The budget permits external commercial borrowings (ECBs) and foreign direct investment (FDI) to bridge the fund gap. Access to funds is fine, but college fees will be hostage to macroeconomic management and global financial turbulence that make exchange rates and hedging costs volatile. The move would benefit a tiny elite capable of bearing the fees necessitated to service external investment.

This will not automatically help raise the quality of higher education. India needs to fundamentally transform its education sector. Public expenditure must focus on schools and research that would not find private backers.

India’s higher education comprises 993 universities, 39,931 colleges and 10,725 stand-alone institutions. Most of them would require state support, but must be encouraged to augment revenues, via student fees, endowments and industry partnerships. To ensure access, low-cost student loans must supplement scholarships. In the US, state guarantee and securitisation lower the cost of education loans. The UK caps share of income used for servicing such loans.

More money for the education sector is welcome. But without a plan that improves the quality of education across the entire chain, more money will do little to address the needs of aspirational India. Perhaps, as a first step, government needs to ensure that the available funds are used properly and efficiently so as to maximise outcomes.

All Farmhands on the Deck

Agriculture can be a wealth creator and the Economic Survey has identified areas where investment is needed. This year’s Union budget has taken the cues, allocating ₹2.83 lakh crore for agriculture and allied activities, irrigation and rural development.

The Survey reveals a fluctuating trend for gross capital formation (GCF) in agriculture and allied sectors relative to gross value added (GVA) in agriculture — from 16.5% in 2012-13 to 15.2% in 2017-18. This is due to decline in private investment in agriculture from 15.6% in 2013-14 to 12.8% in 2016-17. Moreover, investments in the crop sector are high, more than 80%, compared to allied sectors considering their contributions in total GVA and indicating higher growth potential in allied sectors. Changing dietary preferences and rising global population create prospects for increase in demand for milk, meat, eggs, fish and other livestock products, which explains the substantial support to allied sectors in the budget.

Small and marginal farmers account for more than 85% of operational holdings and 45% of cultivated area with limited resources to invest in fixed assets. Public sector investments must bridge this gap through investments in agri-infrastructure including storage, transport and irrigation. Also, there is an urgent need to encourage corporate private sector investment, currently at about 3%. This requires an enabling environment, including changes in regulatory and institutional frameworks such as the Agricultural Produce Market Committee (APMC) Act, Essential Commodities Act (ECA), land tenure and contract farming.

The budget’s 16-point action plan, including developing seamless national cold supply chain, village storage schemes, Kisan Rail, Krishi Udan and implementation of model laws on land leasing, contract farming and the Agriculture Produce and Livestock Marketing (Promotion & Facilitation) (APLM) Act, is critical in this context.

The Seeds of Mechanisation

The Survey finds that farm mechanisation in India is low at 40%, compared to about 60% in China and 75% in Brazil. Mechanisation can offset rising cultivation costs, driven by rising labour costs due to shrinking labour pool and rising wages.

As per the 2015-16 Agriculture Census, 86.08% of all holdings are small and marginal holdings. The average holding size has declined from 1.15 hectares in 2010-11 to 1.08 hectares. Mechanisation geared to small holdings, as done in China with average holdings of 0.6 hectares, can ensure efficient utilisation and higher productivity.

Developing solar energy-powered farm machinery would promote sustainable cultivation and create local demand for solar farming. This is reflected in the budget’s push for the Pradhan Mantri Kisan Urja Suraksha evam Utthaan Mahabhiyan (PM-KUSUM) scheme.

The Survey reveals that distribution of agricultural credit is skewed against the northeastern, hilly and eastern states. Less than1% of agricultural credit is disbursed in the northeastern states, primarily because of limited sources for credit for farmers here. Commercial banks, which provide 75% of total credit, have limited presence in these areas, the share of cooperatives dropped steadily from over 50% in 1991 to 12.9% in 2017-18, and the share of regional rural banks (RRBs) has been stagnant at around 12%.

Small and marginal farmers are unable to access credit as they lack collateral. To remedy this, the budget proposes expanding the National Bank for Agriculture and Rural Development (Nabard) refinance scheme, setting an agricultural credit target of ₹15 lakh crore for FY2021, and covering all eligible beneficiaries of PM-KISAN under the Kisan Credit Card (KCC) scheme.

Risk is inherent to agriculture, which impacts profitability and private investment. The Survey shows that crop insurance coverage is low at 23% of gross cropped area, compared to 69% in China and 89% in the US. Lack of awareness, and unavailability of land records and other documents are main reasons for this. The compensation is often delayed, inadequate and sometimes denied. These concerns must be addressed given the rising incidence and intensity of extreme weather events due to climate change.

Conservation of natural resources is critical for wealth creation. Micro-irrigation is recognised as a farm imperative in the Survey. The budget, therefore, proposes comprehensive measures for 100 water-stressed districts.

Fishing in Calm Waters

The Survey has recognised the allied sectors of high potential. The budget, too, makes several provisions for livestock sector, including elimination of foot and mouth disease, and brucellosis in cattle and peste des petits ruminants (PPR), a.k.a ‘goat plague’, in sheep and goat by 2025. The coverage of artificial insemination is also to be increased from 30% to 70%. Fish production is to be raised to 200 lakh tonnes by 2022-23 and fishery exports to ₹1 lakh crore by 2024-25 by involving 3,477 ‘Sagar Mitras’ and 500 fish farmer producer organisations (FPOs).

Together, the critical areas identified in the Survey, and measures announced in the budget, will help realise the objective of doubling farmer’s income by 2022-23 and wealth creation.

बेरोजगारी को लेकर सरकार सवालों के घेरे में

डिपार्टमेंट ऑफ पर्सनलएंड ट्रेनिंग यानी कार्मिक एवंप्रशिक्षण विभाग ने हाल मेंएक दिशा-निर्देश जारी कियाहै जिसके मुताबिक सरकारकी ओर से हर माह एकरिपोर्ट बनेगी जिसमें किनकिन मंत्रालयों में कितनी नईनियुति हुई इसका लेखाजोखा दिया जाएगा। इसमेंसीधी और प्रतियोगिता केमाध्यम से होने वाली दोनोंनियुतियां शामिल होंगी।सभी मंत्रालयों और विभागोंको भेजे गए दिशा-निर्देश मेंनई व्यवस्था को फरवरी सेलागू करने के लिए कहागया है।

ऐसे समय में जब देश केयुवा बेरोजगारी की समस्यासे जूझ रहे हैं, वैसीपरिस्थिति में निश्चित रूप सेसरकार का यह पहल एकस्वागत योग्य कदम है। केंद्रसरकार ने तमाम मंत्रालयोंऔर विभागों में पिछले छह वर्षो के दौरान रित पदोंको भरने की प्रक्रिया में लगातार तेजी आने का दावाभी किया है और इसके लिए सरकार ने आंकड़ा भीजारी किया है। नौकरी और बेरोजगारी को लेकरसरकार लगातार सवालों के घेरे में रही है। इस मुद्देको लेकर विपक्ष सरकार पर हमलावर है और उसेघेरती रही है। ऐसे में लगता है कि सरकार नेयुवाओं को रोजगार देने और विपक्ष की चुनौतियों सेनिपटने के लिए एक बेहतर दिशा-निर्देश जारी कियाहै। सरकार का कहना है कि खाली पदों की संख्या में पिछले छह वर्ष में पांच फीसद कमी आई है। वर्ष2014 में यह 16 फीसद थी जो 2019 में घटकर 11फीसद रह गई है। अभी कुल खाली पदों की संख्या 6,83,823 है। सरकार ने अपनी रिपोर्ट में कहा हैकि अभी करीब चार लाख पदों को भरने कीप्रक्रिया चल रही है। हालांकि यह अलग बात है किइस रिपोर्ट में यह आंकड़ा नहीं दिया गया है किकितने पदों को समाप्त किया गया है या कितने पदोंको मिला कर एक पद किया गया है।

दरअसल सरकार को समझना होगा कि भारत मेंलंबे समय से रोजगार की स्थिति ठीक नहीं है। जिस तेजी से ग्रामीण खपत में कमी आई है और देश मेंबेरोजगारी की दर बढ़ी है उसे गंभीरता से लियाजाना चाहिए। दूसरी तरफ केंद्र में सासीन मोदीसरकार भारत को पांच ‘ट्रिलियन डॉलर इकॉनामीबनाने का सपना देख रही है। यह तभी संभव है जबहर हाथ को काम मिले और देश में बेरोजगारी कीदर कम हो। इसके लिए हमें त्वरित कार्रवाई करनीहोगी और लगातार प्रयास करने होंगे।नौकरी को लेकर देश और विदेश से असरजारी होने वाली रिपोर्ट चिंता बढ़ाने का काम करतीहै। हाल में स्टेट बैंक ऑफ इंडिया की रिसर्च रिपोर्ट’इकोरैप के अनुसार मौजूदा विा वर्ष में नौकरियोंमें भारी गिरावट की आशंका है। रिपोर्ट केमुताबिक, अर्थव्यवस्था में सुस्ती की वजह सेरोजगार पर बुरा असर पड़ा है। रिपोर्ट में यह भीबताया गया है कि विा वर्ष 2018-19 के मुकाबलेवर्ष 2019-20 में 16 लाख कम नई नौकरियांसृजित हुईं और रोजगार के कुल 89.7 लाख नएमौके आए थे।

आम लोगों के लिए रोजगार एक बहुत ही अहममुद्दा होता है। इससे वे अपने परिवार का भरणपोषण करते हैं और अगर लोगों के पास रोजगार नाहो तो इससे देश की अर्थव्यवस्था पर भी असरपडऩा स्वाभाविक है। ‘इकोरैप रिपोर्ट के इस हिस्सेसे आसानी से समझा जा सकता है। रिपोर्ट केमुताबिक असम, बिहार, राजस्थान, उार प्रदेश औरओडिशा जैसे राज्यों से मजदूरी और नौकरी के लिएबाहर गए लोगों के घर वापस भेजे जाने वाले पैसोंमें भी कमी दर्ज की गई है।

आम लोगों के सामने नौकरी की समस्या एकबड़ा सवाल होती है। सरकार भी इस बात कोसमझती है और शायद यही वजह है कि डीओपीटीने सभी विभागों और मंत्रालयों को दिशा-निर्देशजारी किया है। राष्ट्रीय अपराध रिकार्ड ब्यूरो(एनसीआरबी) के हाल के एक रिपोर्ट के मुताबिक,वर्ष 2018 में प्रतिदिन औसतन 35 बेरोजगारों और स्वरोजगार से जुड़े 36 लोगों ने खुदकुशी की।आधिकारिक आंकड़ों के अनुसार, ऐसे में इन दोनों श्रेणियों को मिलाकर वर्ष 2018 में कुल 26,085लोगों ने आत्महत्या की। आंकड़ों के अनुसार उसवर्ष 12,936 बेरोजगारों और स्वरोजगार से जुड़े13,149 लोगों ने खुदकुशी की। यह आंकड़ा कृषिक्षेत्र से जुड़े खुदकुशी करने वाले 10,349 लोगों कीतुलना में अधिक है।

निश्चित रूप से एनसीआरबी का यह आंकड़ाचौंकाने और चिंतित करने वाला है। आमतौर पर यहमाना जाता है कि देश की कुल आबादी का एकबड़ा हिस्सा कृषि क्षेत्र पर निर्भर है। देश में कृषिसेटर की स्थिति बहुत बेहतर और आदर्शजनकनहीं है। आमतौर पर हम मान कर चलते हैं कि देशमें कृषि संकट के दौर से गुजर रहा है और इसमेंसुधार नहीं होने और माली हालत खराब होने केकारण किसान खुदकुशी कर रहे हैं।

हालांकि ऐसा करते हुए शायद हम बेरोजगारों की खुदकुशी से जुड़ी एक अहम बात को नजरअंदाजकर देते हैं। यह रिपोर्ट बताती है कि देश मेंबेरोजगारी की स्थिति कितनी भयावह है। अगर ऐसानहीं होता तो किसानों की तुलना में बेरोजगार इतनीअधिक संख्या में खुदकुशी नहीं करते। बेरोजगारोंके अत्महत्या की घटनाएं चिंतित और परेशान करनेवाली है। हमें इन घटनाओं पर लगाम लगाना हीहोगा। इसके लिए हमें वर्तमान हालत में सुधारकरना होगा और रोजगार दर को बढ़ाना होगा ताकिकोई युवक बेरोजगार नहीं रहे और वह खुदकुशीकरने के लिए मजबूर ना हो। निश्चित रूप से इसकेलिए सरकार प्रभावी और ठोस कदम उठा रही है।हालांकि साथ में सामाजिक संगठनों को भी अहमऔर प्रमुख भूमिका निभानी होगी और समयबद्धतरीके से कार्रवाई करनी होगी।

प्रासंगिकता पर बहस जरूरीविधान परिषद

छले महीने आंध्र प्रदेश विधानसभा ने राज्य की विधान परिषद (विप) को समाप्त करने का प्रस्ताव पारित कर केंद्र के पास भेज दिया। दरअसल‚ राज्य में सत्तारूढ़ वाईएसआर कांग्रेस 9 सदस्यों के साथ विप में अल्पमत में है। इससे उसे विधेयकों को पारित कराने में कठिनाई का सामना करना पड़ रहा था। और 2021से पहले उसे विप में बहुमत मिलने की संभावना भी नहीं है। 58 सदस्यों वाली राज्य विप में फिलहाल पूर्व मुख्यमंत्री चंद्रबाबू नायडू के नेतृत्व वाला प्रमुख विपक्षी दल तेलुगू देशम 28 सदस्यों के साथ सबसे बड़ा दल है। माना जा रहा है कि विप में तीन राजधानियों से संबंधित महवपूर्ण विधेयक पारित करवाने में विफल रहने के बाद जगन मोहन रेड्डी के नेतृत्व वाली सरकार ने यह अहम कदम उठाया है।

आंध्र प्रदेश ने दूसरी बार राज्य विधान परिषद को समाप्त करने का निर्णय लिया है। इससे पहले 1985 में भी इसे समाप्त कर दिया गया था। आंध्र प्रदेश के इस निर्णय ने देश में विप की उपयोगिता और व्यावहारिकता पर सिरे से पुनवचार की बहस को तेज कर दिया है। साथ ही राजनैतिक सहूलियत के हिसाब से संवैधानिक संस्थाओं के साथ मनमानी को भी रेखांकित किया है। फिलहाल देश में आंध्र के अलावा पांच अन्य राज्यों में विप है। ये राज्य हैं; उत्तर प्रदेश (100)‚ बिहार (75)‚ महाराष्ट्र (78)‚ कर्नाटक (75) और तेलंगाना (40)। जम्मू–कश्मीर (36) के पुनर्गठन के बाद लद्दाख और जम्मू–कश्मीर दो अलग–अलग केंद्र शासित प्रदेश बन गए हैं। इससे वहां की स्थिति स्पष्ट नहीं है। बड़़ा सवाल है कि द्विसदनों की यह व्यवस्था जो पांच राज्यों में लागू है‚ उसे अन्य राज्य अपने यहां पिछले 80 सालों में लागू करने को लेकर उदासीन क्यों रहेॽ क्या द्विसदन की इस व्यवस्था को लागू नहीं करने से उनके कामकाज की गुणवत्ता पर कोई प्रभाव नहीं पड़ा हैॽ फिलवक्त ऐसा कोई शोध उपलब्ध नहीं है‚ जो विधान परिषद की अनिवार्यता के पक्ष में दिखे। इसके विपरीत‚ समय–समय पर विप पर होने वाले खर्च पर सवाल जरूर उठते रहे हैं। पिछले साल जब मध्य प्रदेश सरकार ने राज्य में विप के गठन का जो मसौदा पेश किया तो उसका कुल बजट 150 करोड़ रुपये सालाना आंका गया। विप गठन के पीछे मूल मकसद राज्य विधानमंडलों में प्रतिनिधित्व को विविधता और व्यापकता प्रदान करना था‚ जो आज राजनीतिक तुष्टीकरण तक सिमट कर रहा गया है।

संविधान सभा में भी द्विसदन व्यवस्था के औचित्य पर उठे सवाल पर राज्य सभा के समर्थकों ने इसे लोक दबावों से मुक्त ‘विवेक की सभा’ कहा था। जिसके सदस्य नीति निर्माण में अपनी बौद्धिकता का प्रयोग कर उसे बेहतर बनाने में महवपूर्ण योगदान दे सकते हैं। वर्तमान में विप के पैरोकार बड़े राज्य में विस्तारित प्रतिनिधित्व के साथ ‘चेक एंड बैलेंस’ व्यवस्था के संदर्भ इसकी महत्ता गिनाते हैं। वे इसके अधिकारों में बढ़ोतरी कर इसे सलाहकार की भूमिका से बाहर निकालने के पक्ष में हैं। वहीं आलोचक इस पर होने वाले खर्च और इसकी उत्पादकता पर सवाल खड़े करते हैं। यही नहीं चुनाव में शिकस्त खाए नेताओं को बैकडोर इंट्री की तोहमत भी लगती है।

बिहार के मुख्यमंत्री पिछले 15 सालों से बिहार विप के सदस्य हैं। इन मतांतर के बीच विप अपने होने के लिए बहुत मजबूत तर्क नहीं दे पा रही है। विप को राज्यों की ‘राज्य सभा’ यानी उच्च सदन भी कहा जाता है‚ लेकिन अधिकार के मामलों में ये कमतर है। इसकी बड़ी वजह संविधान का अनुच्छेद 169 है‚ जिसके अंतर्गत इसका गठन होता है। इसके तहत राज्य विधानसभा को अपने विवेक के अनुसार इसके गठन का अधिकार है। इसके अलावा वित्त संबंधी विधेयक इसके अधिकार क्षेत्र से बाहर हैं। किसी विधेयक पर सहमत न होने की स्थिति में यह उसे सिर्फ तीन महीने तक अपने पास रोक सकती है। विप के एक तिहाई सदस्य राज्य विधानसभा के सदस्यों द्वारा चुने जाते हैं।

1970 में पंजाब और 1986 में तमिलनाडु की विप समाप्त कर दी गई थी। इसके उलट बीते दशक में तमिलनाडु‚ ओडिशा‚ मध्य प्रदेश‚ असम और राजस्थान में विप के गठन को लेकर दिलचस्पी देखी गई है‚ जिससे फिलहाल इनकी संख्या बढ़ भी सकती है। ऐसे में विप में कला‚ विज्ञान‚ खेल‚ संस्कृति जैसे क्षेत्रों की प्रतिभाओं को अपने यहां ज्यादा स्थान देकर अपनी रचनात्मक उपयोगिता और उत्पादकता‚ दोनों सिद्ध कर सकती है। बिहार विप ने तो महात्मा गांधी के नेतृत्व वाले चंपारण आंदोलन में नील किसानों के समर्थन में कानून बनाया था। यह उस समय सदस्य रहे लोगों की बौद्धिक साहस के कारण ही संभव हो पाया था‚ जिसका आज की हर विप में अभाव दिखता है।

सुविधा के साथ

किसी दंपति के भीतर अपनी संतान की इच्छा स्वाभाविक है और अगर किन्हीं प्राकृतिक या स्वास्थ्य कारणों से वे इसमें सक्षम नहीं हैं तो इसके लिए वे उपलब्ध चिकित्सीय उपायों का सहारा ले सकते हैं। इस क्रम में सरोगेसी पद्धति यानी गर्भ के लिए किसी अन्य महिला का सहारा लेने का चलन सामने आया, लेकिन इसने जैसा स्वरूप अख्तियार कर लिया, उसमें इसे लेकर कई सवाल उठने लगे। इसके व्यावसायिक होने के संदर्भ में यह मुश्किल सामने आई कि संतान के इच्छुक दंपति द्वारा गर्भधारण के लिए जिस महिला का सहारा लिया जाता है, उसके स्वास्थ्य से लेकर अन्य अधिकार क्या हैं। साथ ही इससे जुड़े नैतिकता के प्रश्न सहित इसके लिए पात्रता संबंधी शर्तें क्या होनी चाहिए, ताकि इस मसले से जुड़ी आशंकाओं को दूर किया जा सके। इस संबंध में ज्यादा बड़ा सवाल यह सामने आया कि सरोगेसी से बच्चा पैदा करने का चलन आज जिस तरह एक व्यवसाय बन गया है और उसकी शिकार गरीब तबके की महिलाएं हो रही हैं, उनके साथ जैसी समस्याएं पेश आ रही हैं, उससे निपटने के लिए क्या सरकार को ठोस उपाय नहीं करने चाहिए!

इसी के मद्देनजर पिछले साल सरोगेसी (नियमन) बिल- 2019 लोकसभा में पेश किया गया था, जो पारित भी हो गया, लेकिन इसका राज्यसभा में पास होना अभी बाकी है। लेकिन इस विधेयक में जो प्रावधान किए गए, उनके कई बिंदुओं पर असहमति के स्वर उभरे। खासतौर पर विधेयक में सरोगेट मां बनने के लिए ‘करीबी रिश्तेदार’ को चुनने की बाध्यता की वजह से दंपति के लिए जैसी समस्या को लेकर सवाल उठे, उसके ठोस आधार थे, क्योंकि इससे इस चिकित्सीय सुविधा का लाभ उठाने के इच्छुक लोगों के सामने विकल्प बेहद सीमित हो जाते हैं। फिर कुछ खास पहचान वाले जोड़ों या लोगों को बाहर रखने के मसले पर भी असहमति के बिंदु उभरे थे। शायद यही वजह है कि एक संसदीय समिति ने सरोगेसी को लेकर सरकार से कुछ अहम सिफारिशें की हैं। समिति के मुताबिक संतान पैदा करने में अक्षम दंपतियों के लिए ‘करीबी रिश्तेदार’ के किराए की कोख देने वाली महिला के रूप में स्वीकार करने की बाध्यता को हटाया जाए और किसी भी ‘इच्छुक’ महिला को यह भूमिका निभाने की इजाजत दी जाए। प्रावधान में दर्ज एक अन्य मसले पर समिति ने यह राय दी है कि पैंतीस से पैंतालीस साल की विधवा या तलाकशुदा ‘अकेली भारतीय महिला’ को भी सरोगेसी की सुविधा का इस्तेमाल करने की छूट दी जाए। साथ ही समिति ने सरोगेट मां के लिए विधेयक में प्रस्तावित बीमा सुरक्षा की अवधि सोलह महीने से बढ़ा कर छत्तीस महीने करने सहित पंद्रह सिफारिशें की हैं। अब सरकार अगर इस ओर कोई पहलकदमी कर रही है तो उम्मीद की जानी चाहिए कि इससे जुड़े अन्य सभी पहलुओं को ध्यान में रखा जाएगा। यह किसी से छिपा नहीं है कि सरोगेसी से बच्चा हासिल करने के क्रम में गर्भ मुहैया कराने वाली मां और बच्चों के कल्याण और सुरक्षा से जुड़े व्यापक सामाजिक, शारीरिक, मनोवैज्ञानिक, भावनात्मक और आर्थिक मुद्दों की अनदेखी की जाती है। एक बड़ी समस्या यह है कि गर्भ में पल रहे शिशु में अगर सेहत संबंधी कोई जटिलता आती है तो गर्भधारण करने वाली महिला के अधिकार किस हद तक सुनिश्चित होते हैं! इसलिए अब अगर सरकार सरोगेसी के नियमन को लेकर कानून ला रही है तो उम्मीद की जानी चाहिए कि इसमें दंपतियों की सुविधा के साथ-साथ कोख मुहैया कराने वाली मां के अधिकार भी तय किए जाएं।

How recklessly progressive of the judicial system to venture into the derivatives market for sedition, and to take the dramatic step in the context of an LGBTQ rally. The market is the most appropriate frame of reference for the denial of anticipatory bail to a 22-year-old student of the Tata Institute of Social Sciences (TISS) charged with sedition. She was one of the 51 protesters against whom an FIR was lodged by the Mumbai police for participating in a rally. Her case drew attention because of a single slogan which, according to her counsel, she raised only once, in which she referred to Sharjeel Imam, a former JNU student, against whom several states have filed sedition cases for speaking against the Citizenship (Amendment) Act. This is definitely the first known derivative of sedition, surpassing the charge of sedition by association that people like Binayak Sen have been accused of.

Perhaps the policemen who filed the FIR were not cognisant of developments in sedition law, but lower judiciary cannot be ignorant of the substantial case law which has developed thanks to the government’s propensity for using sedition as a handy solution for containing people who disagree with it. Most recently, in 2016, a Supreme Court bench had recalled a judgement from 1962 dismissing a sedition matter, to observe that only action taken towards a “violent revolution” could attract the charge. A slogan raised only once about a perso55n accused of sedition fails to tick the requisite box. Sloganeering is an organic activity, widening the ambit of the central message by absorbing current political references, and the student’s counsel had argued that Imam’s name had been voiced in the heat of the moment, along with routine points of reference like B R Ambedkar and Rohith Vemula.

However, the sessions court in Mumbai held that the charges were serious enough to merit custodial interrogation, and has denied anticipatory bail. It has paid scant regard to the case law which has developed on sedition and effectively, the lower court is in contempt of the Supreme Court. The law of sedition is deeply problematic anyway, since it is a device introduced by a colonial power to keep a subject population in check, and does not belong in a democratic nation which is owned by the people. Cases like this one, where the law is applied completely arbitrarily, reaffirms the general conviction that the law should be repealed.
